			</subsection></section><section id="ID0811dd6ed06748ac84a8aae076194bad"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="ID95c6eef1d2ad468ba3bd224ecd06633f"><enum>(1)</enum><header>Executive
			 agency</header><text>The term <term>Executive agency</term> has the meaning
			 given the term in section 105 of title 5, United States Code.</text>
			</paragraph><paragraph id="ID0e2e731f6e5f45ec917ac28b4bd912fc"><enum>(2)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of Energy.</text>
			</paragraph></section><section id="ID383f1aa12eaa42bbb4065550bd8994db"><enum>3.</enum><header>Transparency and
			 accountability of energy use by Federal facilities</header><text display-inline="no-display-inline">Section
			 543 of the National Energy Conservation Policy Act (42 U.S.C. 8253) is
			 amended—</text>
			<paragraph id="IDb9a3ab565ca7452ebdc965b95c2aa7de"><enum>(1)</enum><text>by redesignating
			 the second subsection (f) (as added by section 434(a) of the Energy
			 Independence and Security Act of 2007 (Public Law 110–140; 121 Stat. 1614)) as
			 subsection (g); and</text>
			</paragraph><paragraph id="ID24b2459084bd4f149d177a5996926e0a"><enum>(2)</enum><text>in subsection
			 (f), by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id9E60989D252F4BDCA8959F6D0FE5ABF0" style="OLC">
					<paragraph id="IDb3d7ba077e334cdcb3812cd9b5907bd3"><enum>(12)</enum><header>Reporting on
				commissioning and energy and water savings measures</header>
						<subparagraph id="ID80dd80214a7645baa6cc58a1330d3134"><enum>(A)</enum><header>In
				general</header><text>Each energy manager shall submit the evaluations,
				commissioning reports, plans, measurements, and verifications obtained under
				paragraphs (3) and (5) to the web-based system established under paragraph (7)
				or to another publicly available web-based system established by the
				Secretary.</text>
						</subparagraph><subparagraph id="ID27f4daa4b65947ad856c98f4ac87646a"><enum>(B)</enum><header>Standardizing
				reporting formats</header><text>Not later than 1 year after the date of
				enactment of this paragraph, the Secretary, in consultation with the
				Administrator of General Services, representatives of relevant professional
				societies and industry associations, and other relevant individuals, shall
				recognize or develop a standardized format for obtaining and reporting the
				information described in subparagraph (A).</text>
						</subparagraph></paragraph><paragraph id="ID7bad39be1c1247c7ab7f21ee35076986"><enum>(13)</enum><header>Annual report
				on Federal building energy and water characteristics</header><text>Not later
				than 1 year after the date of enactment of this paragraph and annually
				thereafter, the Secretary shall make available on a publicly available website
				a report summarizing the energy and water use and high-performance attributes
				of Federal buildings, including—</text>
						<subparagraph id="ID9719b43018554591858fab713761e4fa"><enum>(A)</enum><text>data on energy
				use, water use, and greenhouse gas emissions data by Department of Energy
				climate zone, building type, primary building use, department or agency, and
				building vintage;</text>
						</subparagraph><subparagraph id="IDcee89c2b212c43ad9764fe2d9922215a"><enum>(B)</enum><text>data on total
				energy usage and energy usage by heating, ventilation, and air conditioning,
				lighting, plug-loads, and other subsystems;</text>
						</subparagraph><subparagraph id="ID1cfb70d6417148fc9636703f2b3baf75"><enum>(C)</enum><text>data on the
				energy, water, and greenhouse gas emissions savings attributable to compliance
				with relevant Federal law and the baseline used for a determination of the
				savings;</text>
						</subparagraph><subparagraph id="ID69ca07399fe74676a426950e10c23f4b"><enum>(D)</enum><text>a description of
				the requirements and programs relating to energy use, water use, or greenhouse
				gas emissions applicable to the design and operation of Federal buildings and
				the outcomes of the requirements and programs, including—</text>
							<clause id="id6A43FCD4F6E04589A1CC92BFA8E68B63"><enum>(i)</enum><text>requirements and
				programs such as green building and energy rating systems and energy codes and
				standards; and</text>
							</clause><clause id="idBDE1FC73836F431CA8A6D10B6DC8704C"><enum>(ii)</enum><text>outcomes such as
				energy, water, and greenhouse gas emissions savings;</text>
							</clause></subparagraph><subparagraph id="ID857e7cb30e84404dab08abd3631c85c1"><enum>(E)</enum><text>a description of
				the use of design or technological features that contribute to reductions in
				energy and water use, including features relating to—</text>
							<clause id="id51567B50BBAF41678245F53C6357FCAB"><enum>(i)</enum><text>building
				controls;</text>
							</clause><clause id="id3D937B707C0B454186F49C30F065AB95"><enum>(ii)</enum><text>heating and
				cooling;</text>
							</clause><clause id="id44E0024C40B0477E8BCD1BB2D39BA74A"><enum>(iii)</enum><text>ventilation;</text>
							</clause><clause id="idB6988738B8354A05A4F4F2020E9947ED"><enum>(iv)</enum><text>efficient
				lighting;</text>
							</clause><clause id="id2A2025E4529E483D82C31D309812B05A"><enum>(v)</enum><text>lighting
				controls;</text>
							</clause><clause id="idD53070B902C245A180C47F585CD0A31E"><enum>(vi)</enum><text>daylighting;</text>
							</clause><clause id="idE70021AA077A4E8DBF377F293E0ACF04"><enum>(vii)</enum><text>plumbing
				fixtures;</text>
							</clause><clause id="idF2F84015EA644BB097C3F6CB72F8C68A"><enum>(viii)</enum><text>building
				envelopes;</text>
							</clause><clause id="id726613899769440393619F99A9385652"><enum>(ix)</enum><text>orientation;</text>
							</clause><clause id="idE1EFAC288C954DEBA5F74524C063FEBC"><enum>(x)</enum><text>site
				selection;</text>
							</clause><clause id="id6D3F0D163F3242899E02B921B4F6866A"><enum>(xi)</enum><text>integrated
				design;</text>
							</clause><clause id="id34BECC6F76094CCB8A9EC17F5F93E1CC"><enum>(xii)</enum><text>building
				information modeling;</text>
							</clause><clause id="id66A432848DCB497DAEB390D37A8F7B21"><enum>(xiii)</enum><text>commissioning;
				and</text>
							</clause><clause id="id2D16168CB65447DDBB33A531F1E3F37A"><enum>(xiv)</enum><text>other matters
				determined appropriate for inclusion by the Secretary;</text>
							</clause></subparagraph><subparagraph id="IDc973f740590e43589a96571dcdb2acd0"><enum>(F)</enum><text>a description of
				any lessons learned from and case studies included in the information submitted
				under paragraph (12); and</text>
						</subparagraph><subparagraph id="ID65ae16b5ae084db5aec454e1e9e9c515"><enum>(G)</enum><text>a description of
				the characteristics of high-performance buildings and high-performance green
				buildings (as defined in section 401 of the Energy Independence and Security
				Act of 2007 (42 U.S.C. 17061)), including with respect to—</text>
							<clause id="IDbb43d92127db44aa92509c21b96625ae"><enum>(i)</enum><text>indoor
				environmental quality;</text>
							</clause><clause id="ID18958bba67ec46a79becfd7cab497735"><enum>(ii)</enum><text>air and water
				pollution;</text>
							</clause><clause id="IDfa2c507d80a7470c844c57cf52bbd574"><enum>(iii)</enum><text>waste
				generation;</text>
							</clause><clause id="IDda0a56a8f55347beb238add5d2f1d0b2"><enum>(iv)</enum><text>impacts on
				transportation due to building location and site design;</text>
							</clause><clause id="ID7b7c0a6f649b4c3ebe2320319f8f1f71"><enum>(v)</enum><text>safety, security,
				and resiliency attributes;</text>
							</clause><clause id="IDcd850dfa77c242d3b203cabd62afabb6"><enum>(vi)</enum><text>historic
				preservation;</text>
							</clause><clause id="ID9894751727b24da8b6ebb0c97266f2c6"><enum>(vii)</enum><text>operation and
				functionality characteristics; and</text>
							</clause><clause id="ID5bb393ae0e22482c8d6f07b4351b1cc2"><enum>(viii)</enum><text>additional
				information determined appropriate for inclusion by the
				Secretary.</text>
							</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="ID071bc0628b094a44bba003b5b802fabf"><enum>4.</enum><header>Modernizing
			 Federal building energy efficiency performance standards</header><text display-inline="no-display-inline">Section 305 of the Energy Conservation and
			 Production Act (42 U.S.C. 6834) is amended—</text>
			<paragraph id="ID1fcd521261e3440fad68937e0f78b224"><enum>(1)</enum><text>by striking
			 subsection (b) and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="idA1D59CCF3E28473A89A2E4BD5718EB4F" style="OLC">
					<subsection id="IDa1950aa6060445099b3f7e03a2d530b4"><enum>(b)</enum><header>Revised Federal
				building energy standards</header>
						<paragraph id="ID96d0465f9c674bd19c56c122d344e62b"><enum>(1)</enum><header>Affirmative
				determination that revision will improve energy efficiency</header>
							<subparagraph id="IDce576da84c0a40e1804cb56fa30fabfa"><enum>(A)</enum><header>In
				general</header><text>If the Secretary elects not to update the Federal
				building energy efficiency performance standard under subsection (a)(3)(B) and
				an affirmative determination has been published under section 304(b)(2)(A), the
				appropriate Federal building energy efficiency performance standard for all
				projects receiving congressional approval following the affirmative
				determination shall be the standard or code receiving the affirmative
				determination and any additional criteria necessary to achieve energy
				consumption levels described in subsection (a)(3)(A)(i)(I).</text>
							</subparagraph><subparagraph id="ID880c65190858407196afe841792dc5a9"><enum>(B)</enum><header>Savings</header><text>To
				determine the necessary savings required under the revised Federal building
				energy performance standard, an Executive agency (as defined in section 105 of
				title 5, United States Code) (referred to in this subsection as an
				<quote>Executive agency</quote>) shall use the savings identified in the
				affirmative determination over ASHRAE Standard 90.1–2004 or the 2004
				International Conservation Code.</text>
							</subparagraph><subparagraph id="IDd3cb10c32f27433e810a08e26fc919af"><enum>(C)</enum><header>Criteria</header><text>Absent
				additional criteria from the Secretary to achieve the energy consumption levels
				described in subsection (a)(3)(A)(i)(I), an Executive agency shall consult with
				ASHRAE, the International Code Council, the project design team, and others as
				necessary to incorporate the criteria necessary to achieve the required energy
				consumption levels into contracts and designs.</text>
							</subparagraph></paragraph><paragraph id="ID506798098dde4ae198559a26feb577c2"><enum>(2)</enum><header>No affirmative
				determination that revision will improve energy efficiency</header>
							<subparagraph id="ID10512eb6537c4b27b2a07d0cbc20515c"><enum>(A)</enum><header>In
				general</header><text>If the Secretary elects not to update the Federal
				building energy efficiency performance standard under subsection (a)(3)(B) and
				no affirmative determination has been published under section 304(b)(2)(A), the
				appropriate Federal building energy efficiency performance standard for all
				projects receiving congressional approval following the election by the
				Secretary not to update the standard shall be the standard or code that
				triggered a determination under subsection (a)(3)(B) and any additional
				criteria necessary to achieve energy consumption levels that are at least 30
				percent below the revised standard.</text>
							</subparagraph><subparagraph id="ID291193a9a64148cb9fdc4afee42dc8bf"><enum>(B)</enum><header>Criteria</header><text>Absent
				additional criteria from the Secretary to achieve energy consumption levels 30
				percent lower than the revised standard, an Executive agency shall consult with
				ASHRAE, the International Code Council, the project design team, and others as
				necessary to incorporate the criteria necessary to achieve the required energy
				consumption levels into contracts and designs.</text>
							</subparagraph><subparagraph id="IDda41eaeaaedf4a95b6949ef2ecca0f39"><enum>(C)</enum><header>Compliance</header><text>If
				a revised Federal building energy performance standard is established under
				this paragraph, the requirements of subsection (a)(3)(A)(i)(I) shall be
				considered to be satisfied.</text>
							</subparagraph></paragraph><paragraph id="ID79298b56bc8c4914a5d1303c44abbfcf"><enum>(3)</enum><header>Approval prior
				to revision</header><text>If a project receives congressional approval prior to
				a revision of the Federal building energy efficiency performance standard, an
				Executive agency may use the most current Federal building energy efficiency
				performance standard.</text>
						</paragraph></subsection><after-quoted-block>;
				and</after-quoted-block></quoted-block>
			</paragraph><paragraph id="ID6c8d64baba204b3783db4a1f6dcc6958"><enum>(2)</enum><text>by striking
			 subsection (d).</text>
			</paragraph></section><section id="ID6d410fe00c5542d8a1c79f107b81c225"><enum>5.</enum><header>Surveying
			 renewable energy potential of Federal facilities</header>
			<subsection id="IDf654e7ffd3d843469fa9e8e0c5aa61b5"><enum>(a)</enum><header>In
			 general</header><text>Not later than 1 year after the date of enactment of this
			 Act, the Secretary, in consultation with the Secretary of Defense and the
			 Administrator of General Services, shall promulgate regulations that establish
			 appropriate methods and procedures for use by Executive agencies to implement
			 (unless inconsistent with the mission of the Executive agencies or
			 impracticable due to environmental constraints) the identification of all
			 potential locations at Federal facilities of the Executive agencies for
			 renewable energy projects (including available land, building roofs, and
			 parking structures).</text>
			</subsection><subsection id="IDae7adf0381544066aab7c853e4d6b8f6"><enum>(b)</enum><header>Identification
			 of potential locations</header><text>Not later than 2 years after the date of
			 the promulgation of regulations under subsection (a), each Executive agency
			 shall complete the report of the Executive agency that identifies potential
			 locations described in subsection (a).</text>
			</subsection></section><section id="ID36440dffc7e94bda81218eab8b555cf9"><enum>6.</enum><header>Smart metering
			 of Federal facilities</header><text display-inline="no-display-inline">Section
			 543(e) of the National Energy Conservation Policy Act (42 U.S.C. 8253(e)) is
			 amended—</text>
			<paragraph id="ID4bd880eaeff9421a8df030094cc80f62"><enum>(1)</enum><text>in paragraph
			 (1)—</text>
				<subparagraph id="IDf575898cd5c54e1eae96f0081ec640f7"><enum>(A)</enum><text>by designating
			 the first, second, third, and fourth sentences as subparagraphs (A), (B), (C),
			 and (E), respectively; and</text>
				</subparagraph><subparagraph id="IDdaf5933b6f64440d83b70391e80b0043"><enum>(B)</enum><text>by inserting
			 after subparagraph (C) (as so designated) the following:</text>
					<quoted-block display-inline="no-display-inline" id="idA46F5C0E67FD435D96B29A96470DC7A9" style="OLC">
						<subparagraph id="ID810a158680bd4d2aa5a29efddb93b185"><enum>(D)</enum><header>Whole building
				smart meters and smart submeters</header>
							<clause id="IDdbe6d8131e60448184d49a864ac6a79c"><enum>(i)</enum><header>In
				general</header><text>Each agency shall use—</text>
								<subclause id="ID988a03a1384048beaf91f99fd28fb8c0"><enum>(I)</enum><text>whole building
				smart meters for all Federal buildings, owned or leased, with a gross square
				footage of 30,000 square feet or more; and</text>
								</subclause><subclause id="IDc7fb739cf1864ab2b21e3bf90e2e0f64"><enum>(II)</enum><text>smart submeters
				for subsystems that use 30 percent or more of whole building energy.</text>
								</subclause></clause><clause id="IDcc313cc92fd34f3599d3a6523c5ca2b2"><enum>(ii)</enum><header>Frequency</header><text>The
				advanced meters and advanced metering devices shall, to the maximum extent
				practicable, provide data at least daily and measure at least hourly
				consumption of electricity in the Federal buildings of the
				agency.</text>
							</clause></subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</subparagraph></paragraph><paragraph id="ID414909c9b0d942d189c606555c930d8a"><enum>(2)</enum><text>in paragraph (3),
			 by inserting <quote>and updated annually thereafter,</quote> after
			 <quote>paragraph (2)</quote>.</text>
			</paragraph></section><section id="ID274762af701b4ec9a5f9b04ddc3f60e0"><enum>7.</enum><header>Improving
			 computer energy management at Federal agencies</header>
			<subsection id="ID7e92cb8abd8f4496ab0b0c3ae909f62e"><enum>(a)</enum><header>In
			 general</header><text>Not later than 1 year after the date of enactment of this
			 Act, the Secretary, in consultation with the Secretary of Defense, the
			 Secretary of Veterans Affairs, and the Administrator of General Services, shall
			 issue guidance for Executive agencies to employ advanced tools allowing energy
			 savings through the use of computer hardware, energy efficiency software, and
			 power management tools.</text>
			</subsection><subsection id="IDe594bc597687415ab787d11f9f264f21"><enum>(b)</enum><header>Reports on
			 plans and savings</header><text>Not later than 180 days after the date of the
			 issuance of the guidance under subsection (a), each Executive agency shall
			 submit to the Secretary a report that describes—</text>
				<paragraph id="IDa64bc649d96548e7b6f1c8dbfeaa92ff"><enum>(1)</enum><text>the plan of the
			 Executive agency for implementing the guidance within the Executive agency;
			 and</text>
				</paragraph><paragraph id="IDe2dd5a7fab1d47eab925d84d13f0c12f"><enum>(2)</enum><text>estimated energy
			 and financial savings from employing the tools described in subsection
			 (a).</text>
				</paragraph></subsection></section><section id="ID9d2c2039e6c1461c819f269119d64e09"><enum>8.</enum><header>Broadening
			 definition of renewable energy to include thermal</header><text display-inline="no-display-inline">Section 203 of the Energy Policy Act of 2005
			 (42 U.S.C. 15852) is amended—</text>
			<paragraph id="IDba567c5c29ed46cbb009f7e9101dbce3"><enum>(1)</enum><text>in subsection
			 (a), in the matter preceding paragraph (1), by striking
			 <quote>electric</quote>;</text>
			</paragraph><paragraph id="ID9486b99acf89447cb2ee383620071d92"><enum>(2)</enum><text>by redesignating
			 subsection (d) as subsection (e); and</text>
			</paragraph><paragraph id="IDaced706b39bf4027b59158903a5811e3"><enum>(3)</enum><text>by inserting
			 after subsection (c) the following:</text>
				<quoted-block display-inline="no-display-inline" id="id7B0777E75D3F4FAAA8D73140B39D2C07" style="OLC">
					<subsection id="IDcae14b9e46b648dc803d10ffec4b390a"><enum>(d)</enum><header>Separate
				calculation</header><text>Renewable energy produced at a Federal facility, on
				Federal land, or on Indian land (as defined in section 2601 of the Energy
				Policy Act of 1992 (25 U.S.C. 3501))—</text>
						<paragraph id="IDa228cd4a746a4a35b0226c3637a89587"><enum>(1)</enum><text>shall be
				calculated separately from renewable energy used; and</text>
						</paragraph><paragraph id="IDe555f0387f1441f18e53aec0b7d3399d"><enum>(2)</enum><text>may be used
				individually or in combination to comply with subsection
				(a).</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="ID09faac92668645ceae3d619e7ed8aa6a"><enum>9.</enum><header>Expanding use of
			 energy savings performance contracts</header>
			<subsection id="ID5b1d9011461f4b6a8403f0a3c7f43d8e"><enum>(a)</enum><header>Authority To
			 enter into contracts</header><text>Section 801(a)(1) of the National Energy
			 Conservation Policy Act (42 U.S.C. 8287(a)(1)) is amended in the first sentence
			 by inserting before the period at the end the following: <quote>, including
			 savings and benefits involving nonbuilding applications</quote>.</text>
			</subsection><subsection id="ID770ebd4366de40e1bcb8f74a0e07e5ca"><enum>(b)</enum><header>Payment of
			 costs</header><text>Section 802 of the National Energy Conservation Policy Act
			 (42 U.S.C. 8287a) is amended by inserting before the period at the end the
			 following: <quote>or the use of fuel purchased with those funds</quote>.</text>
			</subsection><subsection id="ID8a735f229fcf44cf9c37945e5c08d88b"><enum>(c)</enum><header>Definitions</header>
				<paragraph id="ID0fb20242220846fda013ecc96f6cf2e4"><enum>(1)</enum><header>Energy
			 savings</header><text>Section 804(2) of the National Energy Conservation Policy
			 Act (42 U.S.C. 8287c(2)) is amended—</text>
					<subparagraph id="ID3fee6fef4d8c4552ad3b93d2914b1250"><enum>(A)</enum><text>in subparagraph
			 (A), by striking <quote>or other federally owned facilities</quote> each place
			 it appears and inserting <quote>, other federally owned facilities, or other
			 buildings or facilities at which an Executive agency pays for
			 utilities</quote>;</text>
					</subparagraph><subparagraph id="IDf4585ed15a7f46ce94795b9582b7c600"><enum>(B)</enum><text>in subparagraph
			 (C)—</text>
						<clause id="ID8883f3308c5743f086dce1999037c84a"><enum>(i)</enum><text>by
			 inserting <quote>(including new hydroelectric generation at Federal dams that
			 do not have hydroelectric generation facilities)</quote> after
			 <quote>cogeneration</quote>; and</text>
						</clause><clause id="ID4d7509cefeee4ff1892fa4b10d01122a"><enum>(ii)</enum><text>by
			 striking <quote>and</quote> after the semicolon at the end;</text>
						</clause></subparagraph><subparagraph id="ID72a8a99f79194367839361d254ef7d29"><enum>(C)</enum><text>in subparagraph
			 (D), by striking the period at the end and inserting <quote>; and</quote>;
			 and</text>
					</subparagraph><subparagraph id="ID429589589cc6420fa5de00c49a6af0ae"><enum>(D)</enum><text>by adding at the
			 end the following:</text>
						<quoted-block display-inline="no-display-inline" id="id81E7DBE5AC7C448C8A6DD5DF4CDA83DF" style="OLC">
							<subparagraph id="ID83258d62fa054af4906baeb83e7571c2"><enum>(E)</enum><text>the increased
				efficient use of nonbuilding applications; and</text>
							</subparagraph><subparagraph id="ID9e128375d23d4dabb5bdf505cde156a6"><enum>(F)</enum><text>the savings
				realized from reduced fuel use, including secondary
				savings.</text>
							</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="IDb5e06bc0c038461b959bb3323713ef28"><enum>(2)</enum><header>Nonbuilding
			 application; secondary savings</header><text>Section 804 of the National Energy
			 Conservation Policy Act (42 U.S.C. 8287c) is amended by adding at the end the
			 following:</text>
					<quoted-block display-inline="no-display-inline" id="idCBA3C0600FB242E2A4361ED07759E1E7" style="OLC">
						<paragraph id="IDbb8dc74a16144cc49fd03d5b48e9cb55"><enum>(5)</enum><header>Nonbuilding
				application</header><text>The term <term>nonbuilding application</term>
				means—</text>
							<subparagraph id="idA5B090DA6CE145DB98E07EE48D974742"><enum>(A)</enum><text>any class of
				vehicles, devices, or equipment that is transportable under the power of the
				applicable vehicle, device, or equipment by land, sea, or air and that consumes
				energy from any fuel source for the purpose of—</text>
								<clause id="ID72b7087407e84204998c4abdd381a09d"><enum>(i)</enum><text>that
				transportation; or</text>
								</clause><clause id="ID842de79fb1084bb1aefdc8bc7c92d9e9"><enum>(ii)</enum><text>maintaining a
				controlled environment within the vehicle, device, or equipment; and</text>
								</clause></subparagraph><subparagraph id="IDb3ce96fda04f4c1684fc2fffe74a5f42"><enum>(B)</enum><text>any federally
				owned equipment used to generate electricity or transport water.</text>
							</subparagraph></paragraph><paragraph id="IDbf26ea91038d4011a2ac8d79f34b2ad5"><enum>(6)</enum><header>Secondary
				savings</header><text>The term <term>secondary savings</term> means additional
				energy or cost savings that are a direct consequence of the energy savings that
				result from the energy efficiency improvements that are financed and
				implemented pursuant to an energy savings performance
				contract.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="ID7a6c56e923834f4e8585e15eec75c5ee"><enum>(d)</enum><header>Guidance</header><text>Not
			 later than 1 year after the date of enactment of this Act, the Director of the
			 Office of Management and Budget, in consultation with the Secretary, the
			 Secretary of Defense, and the Administrator of General Services, shall issue
			 guidance and rules to Executive agencies to implement the amendments made by
			 this section.</text>
			</subsection></section><section id="ID80297cdac80743c1a8bd3b6e9bf77458"><enum>10.</enum><header>Modernizing
			 outdated, inefficient Federal building designs</header><text display-inline="no-display-inline">Section 3307, of title 40, United States
			 Code, is amended—</text>
			<paragraph id="IDd5f7e49e8fa3486fa68ababf3c40c6b8"><enum>(1)</enum><text>by redesignating
			 subsections (d) through (h) as subsections (e) through (i), respectively;
			 and</text>
			</paragraph><paragraph id="ID24eb4f7f3756446db60aab3ce0ef4a65"><enum>(2)</enum><text>by inserting
			 after subsection (c) the following:</text>
				<quoted-block display-inline="no-display-inline" id="id99028B6385AB4A9A89EC1B0BE449FCE7" style="OLC">
					<subsection id="IDef50ed28452e4babb7f1d37b46fea879"><enum>(d)</enum><header>Availability of
				funds for design updates</header>
						<paragraph id="ID8da3256bce134a5d87cf2c47187f8fad"><enum>(1)</enum><header>In
				general</header><text>Subject to paragraph (2), for any project for which
				congressional approval is received under subsection (a) and for which the
				design has been substantially completed but construction has not begun, the
				Administrator of General Services may use appropriated funds to update the
				project design to meet applicable Federal building energy efficiency standards
				established under section 305 of the Energy Conservation and Production Act (42
				U.S.C. 6834) and other requirements established under section 3312.</text>
						</paragraph><paragraph id="ID22c2971ee5c84ba0b24cab13a4170abe"><enum>(2)</enum><header>Limitation</header><text>The
				use of funds under paragraph (1) shall not exceed 125 percent of the estimated
				energy or other cost savings associated with the updates as determined by a
				life-cycle cost analysis under section 544 of the National Energy Conservation
				Policy Act (42 U.S.C.
				8254).</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="ID322ff9ad9fa548f1b59370f673378357"><enum>11.</enum><header>Ongoing
			 commissioning of Federal facilities</header>
			<subsection id="ID5558a31377c349cea4afe4a4a8224e75"><enum>(a)</enum><header>In
			 general</header><text>Section 3312 of title 40, United States Code, is
			 amended—</text>
				<paragraph id="IDc800f59e93e44c52a24fe62b7ea6f16e"><enum>(1)</enum><text>by redesignating
			 subsections (c) through (g) as subsections (d) through (h), respectively;
			 and</text>
				</paragraph><paragraph id="ID81722da29ff54018a8ac107200155a01"><enum>(2)</enum><text>by inserting
			 after subsection (b) the following:</text>
					<quoted-block display-inline="no-display-inline" id="id060A369707374F49A578D1E67B534299" style="OLC">
						<subsection id="ID1864d8f91f73446b85a62581e12fe171"><enum>(c)</enum><header>Ongoing
				commissioning within the Federal building stock</header>
							<paragraph id="ID4ff4acc7ce0d4170814a70930abe1da0"><enum>(1)</enum><header>In
				general</header><text>Not later than 1 year after the date of enactment of the
				Reducing Federal Energy Dollars Act of 2011, the Administrator and the
				Secretary of Energy shall incorporate commissioning and recommissioning
				standards (as those terms are defined in section 543(f) of the National Energy
				Conservation Policy Act (42 U.S.C. 8253(f))), for all real property
				that—</text>
								<subparagraph id="ID4d8a28b2a79842188c194062092b24e6"><enum>(A)</enum><text>is more than
				$10,000,000 in value;</text>
								</subparagraph><subparagraph id="ID374036d512c8493486295c8745d2f6ae"><enum>(B)</enum><text>has more than
				50,000 square feet; or</text>
								</subparagraph><subparagraph id="ID0a2d2cf41c37469abc1890dfc8ae5fce"><enum>(C)</enum><text>has energy
				intensity of more than $2 per square foot and an area of more than 10,000
				square feet (or energy expenditures greater than $20,000 per year).</text>
								</subparagraph></paragraph><paragraph id="ID046b050e8e5a43b4b2ede5b24997c874"><enum>(2)</enum><header>Regulations</header><text>Not
				later than 1 year after the date of enactment of the Reducing Federal Energy
				Dollars Act of 2011, the Administrator and the Secretary of Energy shall
				promulgate such regulations as are necessary to carry out this subsection,
				including prospective Federal leases that meets the requirements of
				subparagraph (A), (B), or (C) of paragraph
				(1).</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="ID39253f9c3a844360a9d93e1faea534d0"><enum>(b)</enum><header>Conforming
			 amendments</header><text>Section 3312 of title 40, United States Code, is
			 amended—</text>
				<paragraph id="ID543f1823805c4c888496e17b8eb41e0e"><enum>(1)</enum><text>in subsection
			 (e)(1) (as redesignated by subsection (a)(1)), in the matter preceding
			 subparagraph (A), by striking <quote>and (c)</quote> and inserting <quote>and
			 (d)</quote>;</text>
				</paragraph><paragraph id="ID6742ce490f404410b9b805172e554fc2"><enum>(2)</enum><text>in the first
			 sentence of subsection (f) (as so redesignated), by striking <quote>and
			 (c)</quote> and inserting <quote>and (d)</quote>; and</text>
				</paragraph><paragraph id="IDb6f196c92963424bbf6cc2474f14f97e"><enum>(3)</enum><text>in subsection (g)
			 (as so redesignated), by striking <quote>subsection (b), (c), or (d) or for
			 failure to carry out any recommendation under subsection (e)</quote> and
			 inserting <quote>subsection (b), (d), or (e) or for failure to carry out any
			 recommendation under subsection (f)</quote>.</text>
				</paragraph></subsection></section><section id="ID165be51d4eca4c5fa5b7333ebf2c0336"><enum>12.</enum><header>Audit and
			 report on Federal energy management</header>
			<subsection id="IDa36d1294fdcf42308d2b35f5689e58ad"><enum>(a)</enum><header>Audit</header><text>Not
			 later than 1 year after the date of enactment of this Act, the Comptroller
			 General of the United States shall carry out an audit to determine—</text>
				<paragraph id="IDc20c5d571c2649238ed9e2253d387f8b"><enum>(1)</enum><text>the overall
			 progress and efficacy of Federal energy management efforts;</text>
				</paragraph><paragraph id="ID49e3089748174fe3afd606b0c8655ff1"><enum>(2)</enum><text>progress made
			 towards energy consumption reduction and management goals established by law or
			 Executive order;</text>
				</paragraph><paragraph id="IDc8ad63c728764640bae0d47ec00264c4"><enum>(3)</enum><text>financial cost
			 savings associated with Federal energy consumption and intensity reduction
			 efforts; and</text>
				</paragraph><paragraph id="ID186a7cc867d245e98911a8ca4c1facba"><enum>(4)</enum><text>considerations
			 for Congress to streamline Federal energy management requirements established
			 by law or Executive order.</text>
				</paragraph></subsection><subsection id="ID433c22642ab447479790ae374cc107c1"><enum>(b)</enum><header>Report</header><text>Not
			 later than 90 days after the date described in subsection (a), the Comptroller
			 General of the United States shall submit to the appropriate committees of
			 Congress a report that contains a description of the results of the audit
			 carried out under subsection (a).</text>
