			 49, United States Code, is amended—</text>

				Infrastructure Investment Fund</header>
							<section id="idEFDEDD79C3384AB1A3188A69846D05E3"><enum>361.</enum><header>Definitions</header><text display-inline="no-display-inline">In this subchapter:</text>
								<paragraph id="id88356C5ECC6C4513A1813F2B0F941892"><enum>(1)</enum><header>Board</header><text>The
				term <term>Board</term> means the Board of Directors of the Fund appointed
				pursuant to section 363(b).</text>
								</paragraph><paragraph id="id3F61B55B60A64E6B9B4B1BBB2496B972"><enum>(2)</enum><header>Direct
				loan</header><text>The term <term>direct loan</term> has the meaning given the
				term under section 502(1) of the Congressional Budget Act of 1974 (2 U.S.C.
				661a(1)).</text>
								</paragraph><paragraph id="id7B23F236D4EE41909E89538729C5E9BE"><enum>(3)</enum><header>Economic
				competitiveness</header><text>The term <term>economic competitiveness</term>
				means the ability of the economy to more efficiently produce goods and deliver
				services, including—</text>
									<subparagraph id="id2D2C70BFE9DA4DDA8FCBE48CA5DCA120"><enum>(A)</enum><text>reductions in
				travel time of goods and people, including reductions in average delay or the
				uncertainty of travel time; and</text>
									</subparagraph><subparagraph id="idCE0B2AC1834A4DE293ED86A1145B533E"><enum>(B)</enum><text>net benefits to
				society through economic benefits attributable to improving the spatial
				clustering of economic activity.</text>
									</subparagraph></paragraph><paragraph id="id3AF0956133D74263A3A58FD7172EFFA1"><enum>(4)</enum><header>Eligible
				project</header><text>The term <term>eligible project</term> means a capital
				project that—</text>
									<subparagraph id="idAF5B96DBB66D4D8B86125F9F5EAB5058"><enum>(A)</enum><text>advances the
				objectives of this subchapter;</text>
									</subparagraph><subparagraph id="id818EA79AF40A4AE7976795FE1BEB9840"><enum>(B)</enum><text>is comprised of
				activities included in a regional, State, or national plan, either at the time
				of submission of the application or before the obligation of funds from the
				Fund;</text>
									</subparagraph><subparagraph id="id0FC753F51B834BBB8C9CD404E6B1B164"><enum>(C)</enum><text>has eligible
				project costs related to a single project, or has aggregate eligible project
				costs related to a program of projects that are coordinated to achieve a
				unified improvement; and</text>
									</subparagraph><subparagraph id="idA2294081D9EA4BC8BE85448009B5B592"><enum>(D)</enum><text>is a
				transportation-related project.</text>
									</subparagraph></paragraph><paragraph id="id73449BB7D36E4A76BDAB97DC4933F2E0"><enum>(5)</enum><header>Eligible
				funding recipient</header><text>The term <term>eligible funding
				recipient</term>—</text>
									<subparagraph id="id4C9FBBF19C2C47C9A6D5F1E763F8EFFB"><enum>(A)</enum><text>means an entity
				that has received a financing award from the Fund;</text>
									</subparagraph><subparagraph id="idAED118D286D641C2A19F6A53E3638FBA"><enum>(B)</enum><text>shall be—</text>
										<clause id="id6D6AF19ABCEA421D89AEE0E052B190B5"><enum>(i)</enum><text>a
				non-Federal governmental entity, agency, or instrumentality; or</text>
										</clause><clause id="id1C824E4014304518878BF52C5CF5AFA9"><enum>(ii)</enum><text>a
				nongovernmental entity, such as a corporation, partnership, joint venture, or
				other instrumentality, that seeks funding for an eligible project; and</text>
										</clause></subparagraph><subparagraph id="idC2859CE230D24B4181FA7F994F9ADA87"><enum>(C)</enum><text>shall have a
				non-Federal governmental cosponsor of the project if it is a non-governmental
				entity.</text>
									</subparagraph></paragraph><paragraph id="id5A8C77F8430346BB81E3584C2F604CD0"><enum>(6)</enum><header>Eligible
				project cost</header><text>The term <term>eligible project cost</term>—</text>
									<subparagraph id="id46426E0BDD6A43E18B82F39EBBBFAF00"><enum>(A)</enum><text>includes costs
				associated with development phase planning and design activities, construction,
				acquisition, rehabilitation, environmental remediation, interest expense during
				construction or reconstruction, and reasonable required reserves; and</text>
									</subparagraph><subparagraph id="idE9D2D1B9559E4C7B9AD3A14DE25B30D6"><enum>(B)</enum><text>excludes
				operating costs, research and development costs, and any other costs not
				otherwise specifically provided for in subparagraph (A).</text>
									</subparagraph></paragraph><paragraph id="id9D455E3476634BDA834FEA0005B3B1DD"><enum>(7)</enum><header>Executive
				director</header><text>The term <term>Executive Director</term> means the
				Executive Director of the Fund appointed pursuant to section 363(a)(1).</text>
								</paragraph><paragraph id="id022B2173DDCB46E28723F659523E9BC3"><enum>(8)</enum><header>Fund</header><text>The
				term <term>Fund</term> means the American Infrastructure Investment Fund of the
				Department of Transportation established under section 362.</text>
								</paragraph><paragraph id="id2F8EDC044673461FA0D46723E952A530"><enum>(9)</enum><header>Investment
				plan</header><text>The term <term>Investment Plan</term> means a written mutual
				agreement between the Fund and an applicant that outlines the prospective terms
				of financial assistance to be invested by the Fund.</text>
								</paragraph><paragraph id="id67B708021EF5471D8457E42658552D30"><enum>(10)</enum><header>Line of
				credit</header><text>The term <term>line of credit</term> means an agreement
				entered into between the Fund and an eligible funding recipient to provide a
				direct loan at a future date upon the occurrence of certain events.</text>
								</paragraph><paragraph id="id47BC2E25D89C4C1790EAFD92D65F5022"><enum>(11)</enum><header>Loan
				guarantee</header><text>The term <term>loan guarantee</term> has the meaning
				given the term under section 502(3) of the Congressional Budget Act of 1974 (2
				U.S.C. 661a(3)).</text>
								</paragraph><paragraph id="idA305E8CC747147B998912A0331F5DFE3"><enum>(12)</enum><header>Operating
				guidance</header><text>The term <term>Operating Guidance</term> means the
				detailed description of the Fund's operating policies and procedures that has
				been published in accordance with this subchapter.</text>
								</paragraph><paragraph id="id925D29BC851345F689AAF6A2CF15E534"><enum>(13)</enum><header>Qualified
				application</header><text>The term <term>Qualified Application</term> means an
				application that the Executive Director has certified to have met eligibility
				and qualification standards under this subchapter.</text>
								</paragraph><paragraph id="id126A0AA3226D48AFAC81B5FA0ED48C42"><enum>(14)</enum><header>Rural</header><text>The
				term <term>rural</term> means all population and territory that are not within
				an Urbanized Area (as such term is defined in the most recent decennial United
				States census).</text>
								</paragraph><paragraph id="id6FCE982941AF4C69BDC04F9AA478C3D0"><enum>(15)</enum><header>Secretary</header><text>Except
				as otherwise specified, the term <term>Secretary</term> means the Secretary of
				Transportation.</text>
								</paragraph><paragraph id="idAD176E923F6D4867B2E83E72271C9ED6"><enum>(16)</enum><header>Transportation-related
				project</header><text>The term <term>transportation-related project</term>
				means a project that is part of, or related to, a transportation improvement,
				including projects related to the construction or improvement of—</text>
									<subparagraph id="id73F1BAF18ADA437D9931C42E2753E90D"><enum>(A)</enum><text>a passenger or
				freight rail line;</text>
									</subparagraph><subparagraph id="idAC9B41CFE8964C949482C92F471B09F3"><enum>(B)</enum><text>a highway;</text>
									</subparagraph><subparagraph id="id14B19313916B4E8B824898A5B7DD598F"><enum>(C)</enum><text>a bridge;</text>
									</subparagraph><subparagraph id="id4D924C75CCA1493582EBEA2DA5C6389B"><enum>(D)</enum><text>an
				airport;</text>
									</subparagraph><subparagraph id="id45C88B1B74D945A58A8A1251CD35F9BB"><enum>(E)</enum><text>an air traffic
				control system;</text>
									</subparagraph><subparagraph id="idCABE6E7DBFD64B929A4C4946BB7B6B56"><enum>(F)</enum><text>a port or marine
				facility;</text>
									</subparagraph><subparagraph id="id779F5851959E4E8FBD2B23FDE52EA29F"><enum>(G)</enum><text>an inland
				waterway;</text>
									</subparagraph><subparagraph id="id99F6B299CED144F48FF1F1B5A9BC0BC6"><enum>(H)</enum><text>a transmission or
				distribution pipeline;</text>
									</subparagraph><subparagraph id="id6B8AB952FCE440E993C41BBEE2DE080E"><enum>(I)</enum><text>public
				transportation facilities or systems;</text>
									</subparagraph><subparagraph id="id307597972DD64662B1C332E7757A9850"><enum>(J)</enum><text>intercity
				passenger bus or passenger rail facilities or equipment; or</text>
									</subparagraph><subparagraph id="id3DADD23BEF214F79A75487CB5527669A"><enum>(K)</enum><text>freight rail
				facilities or equipment.</text>
									</subparagraph></paragraph></section><section id="idF99A3CBDBA394484945678FEA82BEAAF"><enum>362.</enum><header>Establishment
				of Fund</header>
								<subsection id="id3BE807026A034703824248AB3A0F5D14"><enum>(a)</enum><header>Establishment</header><text>There
				is established in the Department of Transportation an entity to be known as the
				<quote>American Infrastructure Investment Fund</quote>.</text>
								</subsection><subsection id="id3D28C082ED7841AF851447AEBC44FC70"><enum>(b)</enum><header>Objectives</header>
									<paragraph id="id232A34C8615B4F1A8018B2A651672C69"><enum>(1)</enum><header>Primary
				objective</header><text>The Fund's primary objective shall be to invest in
				infrastructure projects that provide measurable improvements to the economic
				competitiveness of all or part of the United States by increasing or otherwise
				improving economic output, productivity, or competitive commercial
				advantage.</text>
									</paragraph><paragraph id="idB604598EABAB42488DE214028A12E188"><enum>(2)</enum><header>Secondary
				objectives</header><text>The Fund's secondary objectives shall be—</text>
										<subparagraph id="ID7c3f88f89259453caf2553af0440a78c"><enum>(A)</enum><text>to provide
				funding for projects that face significant funding barriers due to problems
				associated with the need to combine resources across multiple jurisdictions or
				modes of transportation;</text>
										</subparagraph><subparagraph id="IDd96cc30623724057b08732c4b7626d15"><enum>(B)</enum><text>to improve the
				efficiency or throughput of a national or regional transportation network
				by—</text>
											<clause id="ID2dbb1961b38b40e19568d1164cc34356"><enum>(i)</enum><text>improving the
				integration between networks; or</text>
											</clause><clause id="IDc2a84d1d7612489da6319e1dd7a30700"><enum>(ii)</enum><text>improving the
				condition, performance, or long-term cost structure of existing
				infrastructure;</text>
											</clause></subparagraph><subparagraph id="ID1c39f73c78164e449deb26e6eee5b615"><enum>(C)</enum><text>to improve the
				safety of transportation facilities and systems, as measured by the reduction
				in risk of transportation-related crashes, injuries, or deaths; and</text>
										</subparagraph><subparagraph id="id9E63B2A4C6314769B947CA878DDD98AA"><enum>(D)</enum><text>to improve the
				environmental sustainability of a national or regional transportation network,
				as measured by—</text>
											<clause id="id3C67F50DD19646A59CC08824C95BAC1D"><enum>(i)</enum><text>improvement in
				energy efficiency;</text>
											</clause><clause id="id3F0BAE3076254CAF8501127CEF39C070"><enum>(ii)</enum><text>reduction in
				greenhouse gas and other harmful emissions;</text>
											</clause><clause id="idAC6F77D3FB2F4C0588E597C55E817F69"><enum>(iii)</enum><text>conservation of
				natural resources;</text>
											</clause><clause id="id1EDE061148A745CB93F1A3BBD366DE6B"><enum>(iv)</enum><text>improvement in
				water quality;</text>
											</clause><clause id="id745B8C74BF714DC5922E819185AFF43C"><enum>(v)</enum><text>improvement in
				infrastructure resilience to environmental hazards and natural disasters;
				and</text>
											</clause><clause id="id88D0BB0635E945FC9036BDC99333BDCC"><enum>(vi)</enum><text>other beneficial
				environmental impacts.</text>
											</clause></subparagraph></paragraph></subsection><subsection id="id9BA5D9D680884D22B1B4E977AF2CC301"><enum>(c)</enum><header>Strategy</header>
									<paragraph id="idEF1856243B6D49E3B5B4847A2ECC70B9"><enum>(1)</enum><header>In
				general</header><text>The Fund shall advance the objectives set forth in
				subsection (b) by providing financial assistance for individual projects or
				programs of related projects identified in State, regional, or national plans
				and designed to significantly improve national or regional economic
				competitiveness.</text>
									</paragraph><paragraph id="id763D249A774241C1ABA600E98BAA8764"><enum>(2)</enum><header>Project
				portfolio</header><text>The Fund shall—</text>
										<subparagraph id="idAD4562F7A23D4F869CF5C839B91AD8B9"><enum>(A)</enum><text>target projects
				or programs of related projects with a demonstrated difficulty in obtaining
				complete financing through other available public or private sources of funds,
				for reasons including project complexity, modes, or other comparable
				transactional barriers;</text>
										</subparagraph><subparagraph id="id85B9425F27BF49B492B947F0D7B2E41A"><enum>(B)</enum><text>seek to identify
				appropriate Investment Plans for selected projects and programs of projects;
				and</text>
										</subparagraph><subparagraph id="id7315450A630F4C91A6FEB208E974BDCF"><enum>(C)</enum><text>use Fund
				resources to build a portfolio of transformational investments that—</text>
											<clause id="id09D3DEBCCEB844E18F92B691E8BC9FB7"><enum>(i)</enum><text>promotes greater
				efficiency in the movement of freight or the provision of services;</text>
											</clause><clause id="idEE4B1EB286644F7E8E4F4E6EA9A409AA"><enum>(ii)</enum><text>promotes greater
				efficiency in the movement of people;</text>
											</clause><clause id="id4FCE2340E855469CB0A541DE5292AAB3"><enum>(iii)</enum><text>integrates
				multiple transportation modes in the movement of passengers or freight;</text>
											</clause><clause id="id83207339AA61447DA00A4C82910AD35B"><enum>(iv)</enum><text>promotes the use
				of innovation and best practices in the planning, design, development, and
				delivery of projects, including practices that promote performance-based
				decision making to achieve national, State, or regional objectives;</text>
											</clause><clause id="idF2015E62917040DC8674A9700A585102"><enum>(v)</enum><text>promotes
				cross-jurisdictional infrastructure planning and coinvestment among a broad
				range of participants, including States, tribal governments, municipalities,
				and public and private investors; and</text>
											</clause><clause id="idD68B423E7861456298CA7EA4C8E4EE50"><enum>(vi)</enum><text>integrates
				transportation infrastructure investment planning, such as regional
				transportation plans, with land-use economic development and other
				infrastructure Investment Plans.</text>
											</clause></subparagraph></paragraph><paragraph id="id93DE6B2A22CB4C7C949A91A297271441"><enum>(3)</enum><header>Investment
				prospectus</header>
										<subparagraph id="idE68B0C9B79F14DE2AF2484B94AA0CADE"><enum>(A)</enum><header>Publication</header><text>Not
				later than 1 year after the date of the enactment of the
				<short-title>American Infrastructure Investment Fund Act
				of 2011</short-title>, the Fund shall publish a detailed description of its
				strategy in an Investment Prospectus that—</text>
											<clause id="id7D8450C00D4F4346A31F1C9A0CF229C8"><enum>(i)</enum><text>specifies what
				will be considered significant to the economic competitiveness of all or part
				of the United States in a manner consistent with the primary objective set
				forth in subsection (b)(1);</text>
											</clause><clause id="id818A3C84E5C5409B98B64E7FD97B236C"><enum>(ii)</enum><text>specifies the
				priorities and strategic focus of the Fund in—</text>
												<subclause id="idF259A6170C8844C384ED0748AE87CBFA"><enum>(I)</enum><text>reaching the
				objectives set forth in subsection (b); and</text>
												</subclause><subclause id="id028806CB03024604A32EC185C4403D46"><enum>(II)</enum><text>carrying out the
				Fund strategy described in this subsection;</text>
												</subclause></clause><clause id="id920FC20807EC472191FDB2E16848FBB3"><enum>(iii)</enum><text>describes in
				detail—</text>
												<subclause id="idA93BC68058FF4197BBD043020D590C80"><enum>(I)</enum><text>the framework and
				methodology for calculating the qualification score assigned under section
				364(f)(3);</text>
												</subclause><subclause id="idFCE0527274EF4C25B18928F3B4B74D01"><enum>(II)</enum><text>the data to be
				requested from applicants; and</text>
												</subclause><subclause id="idC0931D76391342FE98792027E20496D9"><enum>(III)</enum><text>the formula to
				be applied to such data to calculate the qualification score;</text>
												</subclause></clause><clause id="id4F7F30F323DF4AFF97899947B9A2C534"><enum>(iv)</enum><text>describes how
				selection criteria will be applied by the Fund to determine the competitiveness
				of an application and its qualification score relative to other current
				applications and previously funded applications; and</text>
											</clause><clause id="id39C2043AA2E941FDB97FA38BA5C42A3D"><enum>(v)</enum><text>describes how the
				qualification score methodology and project selection framework are consistent
				with maximizing the Fund's goals in urban and rural areas.</text>
											</clause></subparagraph><subparagraph id="id41A937A255024A92BACB687C1BDE457E"><enum>(B)</enum><header>Updates</header><text>Not
				later than 2 years after the original publication of the Investment Prospectus,
				and biennially thereafter, the Fund shall publish an updated Investment
				Prospectus.</text>
										</subparagraph><subparagraph id="id301B47A199C7412DB8FD9A8720717BA1"><enum>(C)</enum><header>Approval</header><text>The
				Fund may not publish the Investment Prospectus or any subsequent updates under
				subparagraph (B) until the Board has approved the Investment Prospectus by a
				majority vote.</text>
										</subparagraph></paragraph><paragraph id="id0B5D47F43BA84087A1360AAF6EBE03CE"><enum>(4)</enum><header>Operating
				guidance</header>
										<subparagraph id="idD54AA7242827451CBA464FD27E907D0E"><enum>(A)</enum><header>Publication</header><text>Not
				later than 1 year after the date of the enactment of the
				<short-title>American Infrastructure Investment Fund Act
				of 2011</short-title>, the Fund shall establish and publish its Operating
				Guidance for the management of the Fund, which shall—</text>
											<clause id="idB74E9397DE46461E9AAB86B168161408"><enum>(i)</enum><text>establish general
				operating procedures to be followed by the Fund in carrying out its authorities
				under this subchapter;</text>
											</clause><clause id="idFEA7BE94F353416B9ECCD0A867AF5F83"><enum>(ii)</enum><text>establish
				criteria, requirements, and standards regarding the provisions of various forms
				of assistance authorized under this subchapter, including the various forms and
				terms of credit assistance that are consistent with the requirements under this
				subchapter;</text>
											</clause><clause commented="no" id="id94BDD7ABBDF240169227B6137F16B98B"><enum>(iii)</enum><text>establish an
				application and award process for Planning and Feasibility Loans in accordance
				with the provisions under this subchapter;</text>
											</clause><clause id="id55B4DD225A5C426787836FC6B9B6AE7A"><enum>(iv)</enum><text>establish
				disclosure and application procedures for nominating or otherwise proposing
				applications for project assistance, either solicited or unsolicited, that are
				consistent with the requirements under this subchapter;</text>
											</clause><clause id="idB3C0603A8713412CBCE2FB316740EF3E"><enum>(v)</enum><text>describe in
				detail the form and timing of data and other information required of applicants
				in conjunction with consideration of an application for financial assistance
				under this subchapter; and</text>
											</clause><clause id="id2588332B6B6B4C45AAC23B167CBD403B"><enum>(vi)</enum><text>establish a
				schedule of regular time intervals for the submission for consideration of sets
				of 1 or more Investment Plans to the Board.</text>
											</clause></subparagraph><subparagraph id="idEB59DE07DACF47CDA817B8F843275A14"><enum>(B)</enum><header>Review and
				update</header><text>The Fund shall periodically review, and may update, the
				Operating Guidance published under subparagraph (A).</text>
										</subparagraph></paragraph><paragraph id="idA33BC6EB89C643FE8A26BC7CF544EF27"><enum>(5)</enum><header>Rulemaking</header><text>Paragraphs
				(3) and (4) shall be carried out in accordance with the rulemaking procedures
				set forth in section 553 of title 5, United States Code.</text>
									</paragraph></subsection></section><section id="id731ABF78F35541C6A88AF7F6686E0A53"><enum>363.</enum><header>Organizational
				structure and duties</header>
								<subsection id="id226D4C12F4FA4888BFD88A41750355AE"><enum>(a)</enum><header>Executive
				Director</header>
									<paragraph id="id1B726CA87262488CB60BB7A2C717896F"><enum>(1)</enum><header>Appointment;
				authority</header><text>The President shall appoint, by and with the advice and
				consent of the Senate, an Executive Director, who shall be the chief executive
				officer of the Fund, and shall have such executive functions, powers, and
				duties as set forth in this subchapter or prescribed by the Board.</text>
									</paragraph><paragraph id="idC133EBF8C3B84A80B165CEF272435A48"><enum>(2)</enum><header>Supervision</header><text>The
				Executive Director shall be subject to the supervision and direction of the
				Secretary of Transportation, consistent with the Executive Director's duties
				under this subchapter and other requirements set forth in the Operating
				Guidance referred to in section 362(c)(4).</text>
									</paragraph><paragraph id="id63503A7CE2BF48F7B032012B04B9B4C6"><enum>(3)</enum><header>Qualifications</header><text>The
				Executive Director shall have demonstrated expertise in at least 2 of the
				following 3 areas:</text>
										<subparagraph id="idEEE5ABA11C5941EF95FA9FC612B9FBF3"><enum>(A)</enum><text>Economic
				analysis.</text>
										</subparagraph><subparagraph id="idEA36DB7CC2664A69B8D3BE6701BB80C4"><enum>(B)</enum><text>Project, public,
				or corporate finance.</text>
										</subparagraph><subparagraph id="idAD37227C06D64A7A93CFFC3A06A2EC3A"><enum>(C)</enum><text>Organizational
				management.</text>
										</subparagraph></paragraph><paragraph id="id28CD29A6207F421E858D355F88557B96"><enum>(4)</enum><header>Term of
				service; vacancy</header><text>The Executive Director shall serve a 5-year
				term, which may be renewed in accordance with paragraph (1). A vacancy in the
				position of Executive Director shall be filled as expeditiously as possible in
				the manner in which the original appointment was made.</text>
									</paragraph><paragraph id="idB36453D87ACF4DB8908A7CD5145EC450"><enum>(5)</enum><header>Duties</header><text>In
				addition to the other activities required to carry out the authorities and
				purposes of the Fund under this subchapter, the Executive Director
				shall—</text>
										<subparagraph id="idAEC3D43B869E4A4B8AD117B38FFB4C23"><enum>(A)</enum><text>be responsible
				for the day-to-day operations of the Fund;</text>
										</subparagraph><subparagraph id="idA7D928C7922C405597CBEED18A4C5F20"><enum>(B)</enum><text>establish and
				approve the Operating Guidance in accordance with section 362(c)(4);</text>
										</subparagraph><subparagraph id="id71F244DD76F4432ABABA73F69A883AFA"><enum>(C)</enum><text>hire and
				supervise a staff of qualified transportation infrastructure planning
				professionals that will—</text>
											<clause id="id57010E62A99D483285FAD716ED42BEC3"><enum>(i)</enum><text>establish and
				maintain a project application origination capability at the Fund;</text>
											</clause><clause id="idD18CA62D0C9744FC9BD55CF2698613A3"><enum>(ii)</enum><text>conduct a
				nationwide search for projects that promote the strategy set forth in the most
				recently published Investment Prospectus; and</text>
											</clause><clause id="idBD09933357CB497996ED2D29BEF373F0"><enum>(iii)</enum><text>solicit
				applications from eligible funding recipients to finance projects described in
				clause (ii);</text>
											</clause></subparagraph><subparagraph id="id12AFB3281F9B46B5B8635A49B44E99E7"><enum>(D)</enum><text>hire and
				supervise a staff of qualified economics professionals that will—</text>
											<clause id="id73A248A0F44F443DB04306167528FA4A"><enum>(i)</enum><text>establish and
				maintain an analysis capability at the Fund;</text>
											</clause><clause id="idEA3608462C1F440E8147F2AD6EE33C65"><enum>(ii)</enum><text>collect and
				analyze application data; and</text>
											</clause><clause id="id9FF41E3E7938487F8EF9168FD6C37565"><enum>(iii)</enum><text>report to the
				Executive Director on qualification scores, measures of uncertainty, and other
				analyses of applications;</text>
											</clause></subparagraph><subparagraph id="id037654AA53044155B5DEEA02ACD2FA03"><enum>(E)</enum><text>hire and
				supervise a staff of qualified project finance professionals that will—</text>
											<clause id="idF97120D465F140C897EFD46C39B761FB"><enum>(i)</enum><text>establish and
				maintain an investment planning process capability at the Fund;</text>
											</clause><clause id="idD579772FF4234F9C8FE50CC4D985F10C"><enum>(ii)</enum><text>review qualified
				applications; and</text>
											</clause><clause id="id546F56D308234ED89E377275F5DB1804"><enum>(iii)</enum><text>structure
				Investment Plans; and</text>
											</clause></subparagraph><subparagraph id="id530A36C7AF964935BBDCB3DA95B90DA5"><enum>(F)</enum><text>hire and
				supervise a staff of qualified project management professionals that
				will—</text>
											<clause id="id9FE1AE633D8A4CF3A87ACD36379F26B6"><enum>(i)</enum><text>establish and
				maintain a technical assistance capability at the Fund;</text>
											</clause><clause id="id8933C8EBF3004D81A8CFE771951B1558"><enum>(ii)</enum><text>assist those
				entities receiving funding from the Fund in the successful execution of their
				Investment Plans; and</text>
											</clause><clause id="id337407E299AA4D8E9E4976244FA5C5E6"><enum>(iii)</enum><text>otherwise
				implement the funding decisions of the Secretary.</text>
											</clause></subparagraph></paragraph></subsection><subsection id="id1C9E7339A35147B894EA3C988A93FD0A"><enum>(b)</enum><header>Board of
				Directors</header>
									<paragraph id="id0BBB4FBA3C4C4CD7B38CA48B0EBFD9C8"><enum>(1)</enum><header>Establishment</header><text>There
				is established within the Fund a deliberative body to be known as the
				<quote>Board of Directors</quote>.</text>
									</paragraph><paragraph id="idC77F1E2A6E26471FA045D2747A5D47AA"><enum>(2)</enum><header>Membership</header><text>The
				Board shall be composed of 7 members, including—</text>
										<subparagraph id="id7CA247A2CBCA4E25968B7872DEE4284B"><enum>(A)</enum><text>the Secretary of
				the Treasury, the Secretary of Commerce, and the Secretary of Energy, who shall
				serve as permanent members; and</text>
										</subparagraph><subparagraph id="id9E6DD7BDFACF411AB367C7FFE6B57B26"><enum>(B)</enum><text>4 executives of
				the Department of Transportation appointed by the Secretary, of whom—</text>
											<clause id="id9DCEF31E5BC54EF8B466AB4AC6A33AC9"><enum>(i)</enum><text>not more than 2
				shall serve concurrently as—</text>
												<subclause id="idB2383271108049EE8CDFCDCDCC11EF14"><enum>(I)</enum><text>the Deputy
				Secretary;</text>
												</subclause><subclause id="id58F8B20A3EBF4E38A41E2C791608F797"><enum>(II)</enum><text>the Under
				Secretary of Transportation for Policy;</text>
												</subclause><subclause id="id1110D32FE1644C60B82CD2B14864DBAD"><enum>(III)</enum><text>the General
				Counsel;</text>
												</subclause><subclause id="idF268C9042FD04070A0274161A312AAF4"><enum>(IV)</enum><text>the Chief
				Financial Officer;</text>
												</subclause><subclause id="id0DE53A0E92214F3DB1933F33C43FBC33"><enum>(V)</enum><text>the Assistant
				Secretary of Transportation for Policy; or</text>
												</subclause><subclause id="id06C6E8C8EC134BBB85AD04BE73813F02"><enum>(VI)</enum><text>the Assistant
				Secretary of Transportation for Aviation and International Affairs; and</text>
												</subclause></clause><clause id="id73796E7E6EF34DFA9FAE75B8B0A78B27"><enum>(ii)</enum><text>not more than 2
				shall serve for not longer than 2 years, while concurrently serving as—</text>
												<subclause id="idED7532BBD6574A7E90A8184B42B55F16"><enum>(I)</enum><text>the Administrator
				of the Federal Aviation Administration;</text>
												</subclause><subclause id="idF6169CCDAE284755A4DB8995102E99D7"><enum>(II)</enum><text>the
				Administrator of the Federal Highway Administration;</text>
												</subclause><subclause id="id8FEC5B08AEE7484293B4EED721455382"><enum>(III)</enum><text>the
				Administrator of the Federal Railroad Administration;</text>
												</subclause><subclause id="id7A293DC8501B4E24BE442FD59609A971"><enum>(IV)</enum><text>the
				Administrator of the Federal Transit Administration;</text>
												</subclause><subclause id="id35EB8938D656488E94FB87DCB2F0291A"><enum>(V)</enum><text>the Administrator
				of the Maritime Administration;</text>
												</subclause><subclause id="idDE0B9BA3C39A40C4B33B7D4DCD8028A4"><enum>(VI)</enum><text>the
				Administrator of the Pipeline and Hazardous Materials Safety Administration;
				or</text>
												</subclause><subclause id="id698AFB3223654309B55748383FD08689"><enum>(VII)</enum><text>the
				Administrator of the Federal Motor Carrier Safety Administration.</text>
												</subclause></clause></subparagraph></paragraph><paragraph id="id374C38B37D674FF885A3EDB247596930"><enum>(3)</enum><header>Duties</header><text>The
				Board shall—</text>
										<subparagraph id="id83FB04CDA8814D4B93F7799D076BDAD6"><enum>(A)</enum><text>not later than
				180 days after the date of the enactment of the
				<short-title>American Infrastructure Investment Fund Act
				of 2011</short-title>, establish and approve the Investment Prospectus, in
				consultation with the Fund Advisory Committee;</text>
										</subparagraph><subparagraph id="id644FA2B8FD3C4793BF12295453479F59"><enum>(B)</enum><text>on each biennial
				anniversary of its original publication, update the Investment Prospectus, in
				consultation with the Fund Advisory Committee;</text>
										</subparagraph><subparagraph id="id810DEC80D7034D779A3613067FECFED3"><enum>(C)</enum><text>review Investment
				Plans, related application materials, and other analyses provided to the Board
				by the Executive Director;</text>
										</subparagraph><subparagraph id="idE84071431E1346CD906244E355A70E39"><enum>(D)</enum><text>determine by
				majority vote whether or not to recommend Investment Plans submitted by the
				Executive Director to the Secretary; and</text>
										</subparagraph><subparagraph id="idA49A818973CC4DA1BC3B2109FD6F6FE1"><enum>(E)</enum><text>certify reports
				to Congress and other publications of the Fund.</text>
										</subparagraph></paragraph><paragraph id="id0D4FFA2D76124127BC689D77EFAA7BAF"><enum>(4)</enum><header>Majority vote
				required</header><text>Each action or decision by the Board shall be by
				majority vote of all members, whether in person or in absentia. Each member
				shall be provided a reasonable opportunity to vote on all matters before the
				Board.</text>
									</paragraph></subsection><subsection id="id813121EA28474B958126D98293FCBA37"><enum>(c)</enum><header>Fund Advisory
				Committee</header>
									<paragraph id="id7624554FBCFC436C9CE3BC32C674DD8D"><enum>(1)</enum><header>Establishment</header><text>Not
				later than 180 days after the date of the enactment of the
				<short-title>American Infrastructure Investment Fund Act
				of 2011</short-title>, the President shall establish an advisory committee, to
				be known as the <quote>Fund Advisory Committee</quote>.</text>
									</paragraph><paragraph id="id458EB02AC8A94178B52ECB617271D71C"><enum>(2)</enum><header>Membership</header>
										<subparagraph id="idFBF1A03790294148B8198751D9DC3367"><enum>(A)</enum><header>Appointment</header><text>The
				President shall appoint not fewer than 5 people and not more than 7 people to
				serve 3-year terms as members of the Fund Advisory Committee, including 1
				member to serve as Chair of the Committee.</text>
										</subparagraph><subparagraph id="idF9B499FE06ED471D8ADAFB75086142C4"><enum>(B)</enum><header>Qualifications</header><text>Each
				member shall have expertise in—</text>
											<clause id="id91E8B4DD35EA4AFCBD5F68433E5F3088"><enum>(i)</enum><text>economics and
				economic analysis;</text>
											</clause><clause id="id5B0593A3D0DF47B3859BEB8AACD95412"><enum>(ii)</enum><text>project or fund
				management;</text>
											</clause><clause id="id1218242421ED491EB2D950CA8DD5A2F8"><enum>(iii)</enum><text>portfolio or
				fund management;</text>
											</clause><clause id="id0462F904B47B4EF1A340B397552A79DE"><enum>(iv)</enum><text>organized labor
				interests;</text>
											</clause><clause id="id05C6766BE8924E8BBC50B018BBB3F6EA"><enum>(v)</enum><text>environmental
				interests;</text>
											</clause><clause id="id6B580D971E7B410AB0DF9656A42E297B"><enum>(vi)</enum><text>American
				business and trade interests;</text>
											</clause><clause id="id1981E0C76CE2416F80E11AE2744EAE0F"><enum>(vii)</enum><text>rural community
				and economic development;</text>
											</clause><clause id="id73AF172991CD491681D4FE4B0BD33A41"><enum>(viii)</enum><text>metropolitan
				economic development and clustering of economic development;</text>
											</clause><clause id="id609E749E11D3456A9335DD022116D00F"><enum>(ix)</enum><text>State Department
				of Transportation or Metropolitan Planning Organization policies and
				priorities; or</text>
											</clause><clause id="id0A909AA5E0EE421CB0566C533971EF24"><enum>(x)</enum><text>other
				infrastructure planning, redevelopment, and development-related codes and
				policies.</text>
											</clause></subparagraph><subparagraph id="id656EC43A74144A3FA5E398DC685B6A6C"><enum>(C)</enum><header>Representation</header><text>The
				President shall ensure that the membership of the Fund Advisory
				Committee—</text>
											<clause id="id6AE9C4DC8AAD452D98A1CBEFA4231AD5"><enum>(i)</enum><text>is
				bipartisan;</text>
											</clause><clause id="idA9425FB128B24C7B84BA3847EA9DB9ED"><enum>(ii)</enum><text>is
				geographically and economically balanced; and</text>
											</clause><clause id="idDB1762ED73954E9990114C1276DD006F"><enum>(iii)</enum><text>is balanced in
				terms of the functions to be performed by the Fund Advisory Committee.</text>
											</clause></subparagraph></paragraph><paragraph id="idD099F49F304847828A88C2635492A9F4"><enum>(3)</enum><header>Advice</header><text>The
				Fund Advisory Committee shall advise the Board and the Secretary with respect
				to—</text>
										<subparagraph id="id0D6230AEAB9F4DA0893C1275ED23781A"><enum>(A)</enum><text>the alignment of
				the Investment Prospectus with the primary and secondary objectives, and other
				elements of the Fund strategy described in section 362(c);</text>
										</subparagraph><subparagraph id="id8CFC285EA20E4FCBA8E49256E56F8A54"><enum>(B)</enum><text>the alignment of
				the framework and methodology used to determine qualification scores and
				uncertainty estimates with the primary objective, secondary objectives, and the
				Fund strategy;</text>
										</subparagraph><subparagraph id="id0D7BE4391BFC4CE385FB3A7AFD10C164"><enum>(C)</enum><text>the consistency
				of the calculation of qualification scores and uncertainty estimates with
				academic standards for analytical rigor and data quality typically applied to
				peer-reviewed research;</text>
										</subparagraph><subparagraph id="idE0474E665C804F73B71EBD49501FA678"><enum>(D)</enum><text>the alignment of
				investment decision mechanics and outcomes with the Investment Prospectus and
				the requirements under this subchapter;</text>
										</subparagraph><subparagraph id="id3222942FAA34478C95879AC7F119B352"><enum>(E)</enum><text>the integrity and
				effectiveness of Fund operations and performance, including application
				evaluation processes, Investment Plan processes and determinations, and the
				optimization of the Fund's performance as a portfolio; and</text>
										</subparagraph><subparagraph id="id0D7A0A72D82E448594BC000E522EBD82"><enum>(F)</enum><text>prospects for the
				extension of the Fund's activities to nontransportation infrastructure sectors
				likely to benefit the United States, including renewable energy generation,
				energy transmission and storage, energy efficiency, drinking water and
				wastewater systems, and telecommunications.</text>
										</subparagraph></paragraph><paragraph id="id8206300FD4684ACA8CABE5334F8688CA"><enum>(4)</enum><header>Applicability
				of FACA</header><text>The Fund Advisory Committee shall be subject to the
				Federal Advisory Committee Act (5 U.S.C. App.).</text>
									</paragraph></subsection></section><section id="id4B55631D4B32478DBC922382D05E86D0"><enum>364.</enum><header>Fund
				authorities and assistance</header>
								<subsection id="idECD0A39CD0E845279C1CDDB691F7F7BE"><enum>(a)</enum><header>Agreements with
				other organizations</header><text>The Fund may—</text>
									<paragraph id="idD431688C90F84AD9A26145EEB28848F9"><enum>(1)</enum><text>enter into an
				agreement with any organization within the Department of Transportation to
				obtain necessary technical expertise and assistance; and</text>
									</paragraph><paragraph id="id51AB75B7D83548619781F5492B21589C"><enum>(2)</enum><text>may request any
				Federal agency to detail employees to the Fund for purposes of carrying out its
				duties under this subchapter.</text>
									</paragraph></subsection><subsection id="idB118045BAD21434CBFA8F50910137E5C"><enum>(b)</enum><header>Fees for
				services</header>
									<paragraph id="idE92A47D8FBCD425AB3E00D875E385D5E"><enum>(1)</enum><header>Administrative
				fees</header><text>The Fund may establish and collect fees from eligible
				funding recipients, including application and processing fees and other fees
				associated with the costs of loan servicing, at a level sufficient to cover all
				or a portion of the administrative costs to the Federal Government of providing
				funding assistance and servicing the credit instruments entered into under this
				subchapter.</text>
									</paragraph><paragraph id="id8AC164A9AD44459FB87BD2FEB7835E10"><enum>(2)</enum><header>Other
				fees</header><text>The Fund may establish and collect fees from eligible
				funding recipients at a level sufficient to cover all or a portion of the costs
				of expert firms, including counsel in the field of municipal and project
				finance, and financial advisors to assist with underwriting, credit analysis,
				or other independent reviews, as appropriate.</text>
									</paragraph><paragraph id="idCE184E0D6F0F4F1BAB86E28689A7BD9D"><enum>(3)</enum><header>Limitation</header><text>The
				Fund may not collect fees under paragraph (1) or (2) that originate as a loan
				or a debt obligation guaranteed by the Federal Government.</text>
									</paragraph><paragraph id="id386914962AAE439B92F386ACB2E92173"><enum>(4)</enum><header>Availability of
				amounts</header><text>Amounts collected under paragraphs (1) and (2) shall be
				available to be expended to carry out the duties under this subchapter.</text>
									</paragraph></subsection><subsection id="id9A8CB809547647728A491F32103C4375"><enum>(c)</enum><header>Planning and
				feasibility loans</header>
									<paragraph id="id32109316D2CF475BB11A4826396A3939"><enum>(1)</enum><header>In
				general</header><text>The Fund may provide loans, which may be forgivable, to
				eligible funding recipients to fund activities related to the planning,
				preparation, or design of an eligible project proposal, including costs
				associated with—</text>
										<subparagraph id="idD7980D5A2ED54C25B4798AC814BD74D0"><enum>(A)</enum><text>planning and
				formulating optimal project design;</text>
										</subparagraph><subparagraph id="idD08A211D745448D89A9A068100DE163B"><enum>(B)</enum><text>assessing project
				technical feasibility; and</text>
										</subparagraph><subparagraph id="idC989D36C735C4A4999561835E9B1BEF2"><enum>(C)</enum><text>assessing
				potential project performance.</text>
										</subparagraph></paragraph><paragraph id="idB43B03303632454B9DC05616B1CE2676"><enum>(2)</enum><header>Loan program
				criteria</header><text>In providing loans under this subsection, the Fund shall
				give priority to activities that are likely to lead to projects that—</text>
										<subparagraph id="id2AB24B2034A6491C8B02D9501C63052F"><enum>(A)</enum><text>advance the
				objectives set forth in section 362(b); and</text>
										</subparagraph><subparagraph id="id470CFAE1CD1B472CBC32C4AB5A4E9294"><enum>(B)</enum><text>are consistent
				with the strategy described in section 362(c).</text>
										</subparagraph></paragraph><paragraph id="id42DE6CCBD24242CC95BD6F4F11AF18F3"><enum>(3)</enum><header>Federal
				share</header><text>The Fund may enter into a loan agreement with an eligible
				recipient in which the Fund agrees to pay up to 100 percent of eligible
				planning and feasibility costs of an eligible project under this
				subsection.</text>
									</paragraph><paragraph id="id772D698DC13D419CA87EE47E7174D191"><enum>(4)</enum><header>Eligible
				costs</header><text>Loan amounts received under this subsection may be used
				for—</text>
										<subparagraph id="id14753792A5C84370BBAFA2B885DC613F"><enum>(A)</enum><text>any activity
				reasonably necessary to obtain Federal, State, and local permits, licenses, and
				approvals for an eligible project, including—</text>
											<clause id="id4DC7742C59E54BD3A3CC893A063BFDE5"><enum>(i)</enum><text>concept
				development and preliminary design;</text>
											</clause><clause id="id4DEEF55C2C224FE2B9638256D87F3392"><enum>(ii)</enum><text>economic and
				environmental analyses; and</text>
											</clause><clause id="id8B9A6A3CF3E145409F5DB01AE51BAD34"><enum>(iii)</enum><text>application,
				licensing, and permit fees.</text>
											</clause></subparagraph><subparagraph id="id2E6EDA99A98F406C8299538FC8EACA71"><enum>(B)</enum><text>the preparation
				of financial analyses and other economic analyses that are reasonably necessary
				to secure funding to implement an eligible project.</text>
										</subparagraph></paragraph><paragraph id="id2D212DEFD3864C1CB54A7C491BCD586B"><enum>(5)</enum><header>Alignment with
				investment prospectus</header><text>The Fund may not provide a loan for a
				project under this subsection unless the application materials demonstrate that
				the eligible project is aligned with the strategy outlined in the Investment
				Prospectus.</text>
									</paragraph><paragraph id="id0E7C07D356FC48978B2A8E4F393C07CE"><enum>(6)</enum><header>Designation for
				receipt of certain funds</header><text>If a non-Federal governmental entity,
				agency, or instrumentality is carrying out the planning and feasibility
				activities, the eligible funding recipient may designate such entity, agency,
				or instrumentality to receive loan amounts for such activities directly from
				the Fund.</text>
									</paragraph></subsection><subsection id="idFC27BDD5B04D474D91B12E0A8CC608FB"><enum>(d)</enum><header>Direct loans
				and loan guarantees</header>
									<paragraph id="idB9981F8DFDB747818744E67A9B226A96"><enum>(1)</enum><header>Direct
				loans</header>
										<subparagraph id="idE1FDCB83409F4910A0E24A5AF5F60918"><enum>(A)</enum><header>Agreements</header><text>The
				Fund is authorized to make direct loans to eligible funding recipients for
				eligible projects on such terms and conditions, and containing such covenants,
				representations, warranties, and requirements, including required audits, as
				the Fund determines appropriate, in accordance with the provisions under this
				subchapter, the Operating Guidance, and all other statutory and regulatory
				requirements.</text>
										</subparagraph><subparagraph id="idF139558D511B4AF2A5C5E22165D11D9C"><enum>(B)</enum><header>Approved
				investment plan</header><text>Direct loans made under this paragraph—</text>
											<clause id="id7F130A93E5764A89BB924B6318147B05"><enum>(i)</enum><text>may only be used
				to fund eligible project costs covered in an Investment Plan approved by the
				Secretary; and</text>
											</clause><clause id="idD4FF3D37150648139134B824D8DAAFA5"><enum>(ii)</enum><text>are subject to
				the terms and conditions of the approved Investment Plan.</text>
											</clause></subparagraph><subparagraph id="id76CA75E0A0F6418EB3E78C1C8096F81D"><enum>(C)</enum><header>Terms,
				conditions, and limitations</header><text>Direct loans made under this
				paragraph will be on such terms, conditions, and limitations as the Executive
				Director may prescribe, except that—</text>
											<clause id="idF721E1E50A2D464D80E6FBA549D3ADCC"><enum>(i)</enum><text>the Fund may not
				provide credit assistance to any prospective borrower unless such
				assistance—</text>
												<subclause id="id960D917890554B0EA865704BD1D51683"><enum>(I)</enum><text>is necessary to
				alleviate a credit market imperfection; or</text>
												</subclause><subclause id="id47023C7C88CB4CE5A00E064ED11394E9"><enum>(II)</enum><text>is necessary to
				achieve specified Federal objectives by providing credit assistance; and</text>
												</subclause><subclause id="id2FD4420F46F041D59BB42B1DC57C9E3C"><enum>(III)</enum><text>is the most
				efficient way to meet such objectives on a borrower-by-borrower basis;</text>
												</subclause></clause><clause id="idCF6C9D9C2D5642868917F37286FC9309"><enum>(ii)</enum><text>loans made under
				this paragraph may not be subordinated (unless such subordination is necessary
				to achieve Federal objectives, consistent with the criteria and policies set
				forth in the Operating Guidance) to—</text>
												<subclause id="idFC082F20E7224F119000DE6E5FA6ABC6"><enum>(I)</enum><text>another debt
				contracted by the borrower; or</text>
												</subclause><subclause id="id4FADE32ED7F94EBEAC240DA170D9FFE5"><enum>(II)</enum><text>any other claims
				against the borrower in the case of default;</text>
												</subclause></clause><clause id="idC640D965D68648A5A0F2192C6CA6FF90"><enum>(iii)</enum><text>direct loans or
				interest supplements on loan guarantees shall be at an interest rate that is
				set by reference to a benchmark interest rate (yield) on marketable Treasury
				securities with a similar maturity to the direct loans being made or the
				non-Federal loans being guaranteed, and includes any necessary credit risk
				premium at a level consistent with the interest rate policy set forth in the
				Operating Guidance;</text>
											</clause><clause id="idC652D47EDE774562B4E5D946A80E1006"><enum>(iv)</enum><text>the Executive
				Director—</text>
												<subclause id="id0887FC2DC90A4E10B27880D2791FDFA7"><enum>(I)</enum><text>shall prescribe
				explicit standards for use in periodically assessing the credit risk of new and
				existing direct loans and guaranteed loans; and</text>
												</subclause><subclause id="id19848FFEF73B493294BF268E83576050"><enum>(II)</enum><text>may not extend
				credit assistance without determining that there is a reasonable assurance of
				repayment;</text>
												</subclause></clause><clause id="id0E7BB3F5FD10446D88B6202ACB7C0592"><enum>(v)</enum><text>new direct loans
				may not be obligated and new loan guarantees may not be committed except to the
				extent that appropriations of budget authority to cover their costs are made in
				advance, as required under section 504 of the Federal Credit Reform Act of 1990
				(2 U.S.C. 661c);</text>
											</clause><clause id="id17C5743376D54910A2B44F89360DDB23"><enum>(vi)</enum><text>the total
				principal amount of the direct loan or loan guarantee may not exceed—</text>
												<subclause id="idB5DFD7D11F3E472ABABE17CFF21594A9"><enum>(I)</enum><text>the lower of 70
				percent of total eligible project cost less the percentage of eligible project
				costs that are otherwise funded by the Fund; or</text>
												</subclause><subclause id="id24E11C583C7D4BB2AB9B33515F88B7C5"><enum>(II)</enum><text>another level
				prescribed in the Operating Guidance; and</text>
												</subclause></clause><clause id="id53F71068CDE04545BD8EF09BD092EE61"><enum>(vii)</enum><text>notwithstanding
				any other provision of law relating to the acquisition, handling, or disposal
				of property by the Federal Government, the Fund may complete, recondition,
				reconstruct, renovate, repair, maintain, operate, or sell any property acquired
				by the Fund under this subchapter.</text>
											</clause></subparagraph><subparagraph id="idD374E899C98947CB83074EF903298DCA"><enum>(D)</enum><header>Repayment</header>
											<clause id="id1DA68B422534475DBBB4BC6C5C44884B"><enum>(i)</enum><header>Policies</header><text>The
				Fund shall—</text>
												<subclause id="id940BB8945A6146588D8A4F0B9678BB4B"><enum>(I)</enum><text>adhere to the
				policies set forth in the Operating Guidance concerning repayment terms;
				and</text>
												</subclause><subclause id="id7AE8B9F403AA41A3BD4319982DB4CF71"><enum>(II)</enum><text>establish
				repayment terms for each direct loan based on the projected cash flow from
				project revenues or other repayment sources.</text>
												</subclause></clause><clause id="id41C8F0FF90D244749A57C528677E0766"><enum>(ii)</enum><header>Maturity
				date</header><text>The final maturity date of a direct loan under this
				paragraph—</text>
												<subclause id="idFEC68E74A57848D59D65D2F3687C2FAD"><enum>(I)</enum><text>shall not exceed
				90 percent of the estimated useful economic life of the asset being financed,
				except under conditions set forth in the Operating Guidance; and</text>
												</subclause><subclause id="id9770B63B3E754056A6C4D82C1C87D989"><enum>(II)</enum><text>may not be later
				than the estimated useful economic life of the asset being financed.</text>
												</subclause></clause></subparagraph><subparagraph id="idD49AF5F2D4414FA49ACA6AC7FA51ADBC"><enum>(E)</enum><header>Risk
				assessment</header><text>Before entering in any agreement under this section,
				the Executive Director shall complete a risk assessment of the project to be
				funded. Requirements for risk assessment shall be outlined in the Operating
				Guidance.</text>
										</subparagraph></paragraph><paragraph id="id88E1B6B8B7CB48F38E4ECEBF02A41069"><enum>(2)</enum><header>Loan
				guarantees</header>
										<subparagraph id="id418D792CE91F4783AD9B31890DB39291"><enum>(A)</enum><header>In
				general</header><text>The Fund is authorized to provide loan guarantees to
				eligible funding recipients on such terms and conditions and containing such
				covenants, representations, warranties, and requirements (including required
				audits) as the Fund determines appropriate, in accordance with the provisions
				under this subchapter, the Operating Guidance, and all other statutory and
				regulatory requirements.</text>
										</subparagraph><subparagraph id="idB3E82AB0925B49C38379AA3480E618EE"><enum>(B)</enum><header>Approved
				investment plan</header><text>Loan guarantees provided under this
				paragraph—</text>
											<clause id="id757EDEE0B08A4E85B017946ECD3D5BBE"><enum>(i)</enum><text>may only cover
				eligible project costs in an approved Investment Plan; and</text>
											</clause><clause id="id45744E71776B4F528E88377A77159FF2"><enum>(ii)</enum><text>are subject to
				the terms and conditions of the approved Investment Plan.</text>
											</clause></subparagraph><subparagraph id="id3E41723E0B8D4BBAA2FB1E77A9AEBF78"><enum>(C)</enum><header>Terms,
				conditions, and limitations</header>
											<clause id="id60A827072D59445ABB0220A10D11E93E"><enum>(i)</enum><header>In
				general</header><text>The terms, conditions, and limitations of a guaranteed
				loan shall comply with the terms, conditions, and limitations set forth in
				paragraph (1) for a direct loan, including maximum Fund share requirements,
				except that the interest rate on the guaranteed loan and any repayment features
				shall be negotiated between the eligible funding recipient and the lender in
				accordance with the policies set forth in the Operating Guidance, and with the
				consent of the Secretary.</text>
											</clause><clause id="id0BE111F953E74C4BBEBBDC1A6C1FA597"><enum>(ii)</enum><header>Income
				excluded</header><text>A loan may not be guaranteed under this paragraph
				if—</text>
												<subclause id="id58EB2383F54748F18D528DFEA478AC8D"><enum>(I)</enum><text>the income from
				such loan is excluded from gross income for the purposes of chapter 1 of the
				Internal Revenue Code of 1986; or</text>
												</subclause><subclause id="idE0DB0F6BE8AC418E832619A442AB9635"><enum>(II)</enum><text>the guarantee
				provides significant collateral or security, as determined by the Executive
				Director, for other obligations generating income that is similarly
				excluded.</text>
												</subclause></clause><clause id="id655B43924B194CC683B4792EDC6C4264"><enum>(iii)</enum><header>Fees</header><text>Fees
				or premiums for a loan guarantee or insurance coverage shall be set at levels
				that minimize the cost to the Government (as defined in section 502(5) of the
				Federal Credit Reform Act of 1990 (6 U.S.C. 661a(5))) of such coverage, while
				supporting achievement of the program's objectives, in accordance with policies
				set forth in the Operating Guidance.</text>
											</clause><clause id="id82FAE68E150B47D9AB1314CCD368C0C3"><enum>(iv)</enum><header>Percent
				guaranteed</header><text>A loan guarantee under this paragraph may not exceed
				80 percent of the loss of the loan. Borrowers who pose less of a risk shall
				receive a lower guarantee as a percentage of the loan amount.</text>
											</clause><clause id="idF8EC7156A17C4A0089D9A689555FCAB1"><enum>(v)</enum><header>Criteria</header><text>A
				loan may not be guaranteed under this paragraph unless the Executive Director
				determines that—</text>
												<subclause id="id98752EA61FBE442BB116554D7F195ED7"><enum>(I)</enum><text>the lender is
				responsible; and</text>
												</subclause><subclause id="id0F94BB878D45487AA9AAD81A90C72CE8"><enum>(II)</enum><text>adequate
				provision is made for servicing the loan on reasonable terms.</text>
												</subclause></clause><clause id="id45045E6C053447728515301456F6D8F4"><enum>(vi)</enum><header>Conclusive
				evidence</header><text>Any guarantee shall be conclusive evidence that—</text>
												<subclause id="id551853836C674A9C8743C2D49FE96684"><enum>(I)</enum><text>such guarantee
				has been properly obtained;</text>
												</subclause><subclause id="idF05344CF99B642F6A9ED1E2823435661"><enum>(II)</enum><text>the underlying
				loan qualified for such guarantee; and</text>
												</subclause><subclause id="id9A894740631644E79CCFC29ABC23861D"><enum>(III)</enum><text>such guarantee
				is presumed to be valid, legal, and enforceable, unless such guarantee was
				obtained through fraud or material misrepresentation by the holder.</text>
												</subclause></clause><clause id="idC881918D232949DFA63C3385E5FF0622"><enum>(vii)</enum><header>Effect of
				default</header><text>If, as a result of a default by a borrower under a
				guaranteed loan, after the holder of the loan has made such further collection
				efforts and instituted such enforcement proceedings as the Executive Director
				may require, the Executive Director determines that the holder has suffered a
				loss, the Executive Director—</text>
												<subclause id="id0411A3751ABE427E8FEE6ED3E083560B"><enum>(I)</enum><text>shall pay to the
				holder not more than 80 percent of such loss, as specified in the guarantee
				contract;</text>
												</subclause><subclause id="id0E2B97E759614F0F995E4D971C384A30"><enum>(II)</enum><text>upon making such
				payment, shall be subrogated to all the rights of the recipient of the payment;
				and</text>
												</subclause><subclause id="id02A05121E197480E93527E68494237B8"><enum>(III)</enum><text>shall be
				entitled to recover from the borrower the amount of any payments made pursuant
				to any guarantee entered into under this paragraph.</text>
												</subclause></clause><clause id="id09BC788A164B4EC7B972BB83FA27ABD1"><enum>(viii)</enum><header>Enforcement</header><text>The
				Attorney General shall take such action as may be appropriate to enforce any
				right accruing to the United States as a result of the issuance of any loan
				guarantee under this paragraph.</text>
											</clause><clause id="id0D452E74664341C490001B0D6805AEB8"><enum>(ix)</enum><header>Savings
				provision</header><text>Nothing in this paragraph may be construed to preclude
				any forbearance for the benefit of the borrower, which may be agreed upon by
				the Executive Director, if budget authority for any resulting modification cost
				(as defined under section 502 of the Congressional Budget Act (6 U.S.C. 661a))
				is available.</text>
											</clause></subparagraph><subparagraph id="id8CC627DA9E404470A39D1C6B2E42857C"><enum>(D)</enum><header>Repayment</header><text>The
				Fund shall adhere to policies set forth in the Operating Guidance concerning
				repayment terms and shall establish repayment terms for each direct loan based
				on the projected cash flow from project revenues or other repayment
				sources.</text>
										</subparagraph><subparagraph id="idC9DCFB83C52344DC9320F6F5BDE4C18F"><enum>(E)</enum><header>Risk
				assessment</header><text>Requirements for risk assessment shall be outlined in
				the Operating Guidance.</text>
										</subparagraph></paragraph></subsection><subsection id="id120DC8B5235F4B7C971B36DE00DFD9DC"><enum>(e)</enum><header>Application
				evaluation and qualification</header>
									<paragraph id="id7A91CF911C554A41A0D976CC58C3C788"><enum>(1)</enum><header>Application
				eligibility standard</header><text>An application for financial assistance from
				the Fund may not be considered unless—</text>
										<subparagraph id="idAB0E650387E84A08AF81BBE51CEECD81"><enum>(A)</enum><text>funding recipient
				or recipients, project or program of related projects, and associated project
				costs identified in the application are eligible for such funding under this
				subchapter;</text>
										</subparagraph><subparagraph id="idAEFBC1BC39E54FD2AD634A81F0A50DFE"><enum>(B)</enum><text>eligible project
				costs identified in the application—</text>
											<clause id="id70B113C0713C44A681DF7AC92CA72C4F"><enum>(i)</enum><text>are greater than
				$50,000,000; or</text>
											</clause><clause id="id8F44EE6E6F3447DB83E377852A05D10E"><enum>(ii)</enum><text>if the
				application is for a project or program of related projects located entirely in
				a rural area, are greater than $10,000,000;</text>
											</clause></subparagraph><subparagraph id="idC83CFB20305E4432B12E38C8737510C2"><enum>(C)</enum><text>the application
				identifies financial assistance from sources outside of the Fund equal to at
				least 30 percent of the total eligible project costs;</text>
										</subparagraph><subparagraph id="id6EF33BDBB6054A46AFAEF5CDF365D071"><enum>(D)</enum><text>the application
				identifies project benefits that are distributed broadly, either at a national
				or a regional level; and</text>
										</subparagraph><subparagraph id="idCACEE24D4A8C4FF2A09EA266C11FF1F9"><enum>(E)</enum><text>the applicant is
				not ineligible to receive Federal loans, loan guarantees, or insurance due to a
				delinquency on Federal tax or non-tax debts, including judgment liens against
				property for a debt to the Federal Government.</text>
										</subparagraph></paragraph><paragraph id="idF0738DC5DA674379B34EF0AFC0FE2B9D"><enum>(2)</enum><header>Resolution of
				debts</header><text>The Fund shall use credit bureaus as a screening tool and
				ask applicants about delinquencies described in paragraph (1)(E) on the
				application form. An application from an applicant that is delinquent on a debt
				to the Federal Government may not be processed until after the applicant
				satisfactorily resolves the debts in compliance with section 3720B of title 31,
				United States Code, and section 285.13 of title 31, Code of Federal
				Regulations.</text>
									</paragraph><paragraph id="id5D6C0B8F5A2749B1889CDDC409D37827"><enum>(3)</enum><header>Qualification
				score</header>
										<subparagraph id="id334828E66DA44DD2B36FDB3FFB26A6F6"><enum>(A)</enum><header>Assignment</header><text>The
				Fund shall assign to each eligible application a single numerical factor, which
				shall be—</text>
											<clause id="id7D70587F68274CF9BFDD026CCEA26AF1"><enum>(i)</enum><text>based upon an
				evaluation of the information and data collected from the applicant;</text>
											</clause><clause id="idA14AA1C836B343A993478C81E0AEA706"><enum>(ii)</enum><text>referred to as
				the <quote>qualification score</quote>; and</text>
											</clause><clause id="id9D42B10293774F27890DD6E22FB42540"><enum>(iii)</enum><text>equal to the
				ratio between the present value of benefits to the present value of costs
				reasonably expected to result from the funding of the project or projects
				proposed in the application.</text>
											</clause></subparagraph><subparagraph id="idADA6714DE0184C0FBA0010B81C11369B"><enum>(B)</enum><header>Calculation</header><text>The
				calculation of the qualification score shall be determined through a
				consistently and transparently applied analytic and systematic framework. In
				order to indicate the potential uncertainty of the qualification score, the
				Fund shall use a measure of the uncertainty of expected project benefits and
				costs to derive a range of ratio values with the qualification score as the
				midpoint of that range.</text>
										</subparagraph><subparagraph id="idDDB5EE3D0C9A4BFFAF158AC107B987F0"><enum>(C)</enum><header>Methodology</header><text>The
				methodology used to calculate the qualification score and uncertainty measures
				shall—</text>
											<clause id="idA93A3E5A1E2D4673979E6BE18FB4F1A9"><enum>(i)</enum><text>apply equal
				weighting to all measures of the net present value of benefits and
				costs;</text>
											</clause><clause id="idFA15C75A08E04366B161A7B015B8FB6B"><enum>(ii)</enum><text>include
				standardized measures of the expected uncertainty in both total and specific
				benefits and costs associated with the project; and</text>
											</clause><clause id="idDF06138B939946C3BE9260D67A99BDDC"><enum>(iii)</enum><text>include a
				descriptive statement delineating the significant factors and analysis that
				went into determination of the score and the range.</text>
											</clause></subparagraph><subparagraph id="idBE34A1DA4048444791FB786E2622A600"><enum>(D)</enum><header>Publication</header>
											<clause id="idCBFE6019236A4A4FB431368B35B262C0"><enum>(i)</enum><header>Investment
				prospectus</header><text>The methodology of the framework for calculating the
				qualification score, including the specific mechanics of its calculation, shall
				be published in the Investment Prospectus.</text>
											</clause><clause id="idC917D661068948B2A9839481A5181E2E"><enum>(ii)</enum><header>Methodology</header><text>The
				quantification score, the methodology used to calculate the qualification
				score, the calculation of the qualification score, and the measure of
				uncertainty shall be—</text>
												<subclause id="id55A28F2C3B08484D9D8EC305B939E6F8"><enum>(I)</enum><text>provided to the
				applicant not later than 15 days after their final determination; and</text>
												</subclause><subclause id="id701F9335DEA9486B8A540F6247564105"><enum>(II)</enum><text>published on the
				Fund's website not later than 30 days after their final determination.</text>
												</subclause></clause></subparagraph></paragraph><paragraph id="id34443E2FF9294D33BB5EA930D76F4749"><enum>(4)</enum><header>Application
				certification</header><text>The Executive Director may not certify an
				application as qualified for financial assistance on the basis of an evaluation
				of the information and data collected from the applicant unless the Executive
				Director determines that the application's qualification score—</text>
										<subparagraph id="id6DE48D9A194E46E19D52D2B17F6B90FF"><enum>(A)</enum><text>has been
				calculated on the basis of data, estimates, and assumptions that are defensible
				according to accepted standards of economic analysis;</text>
										</subparagraph><subparagraph id="id3360E3D8184549A28F2E0B83AED05EB0"><enum>(B)</enum><text>appears valid
				based on efforts by the Fund to conduct due diligence and verification;</text>
										</subparagraph><subparagraph id="idF0002B5022184583AFF6EFCB1645D6B4"><enum>(C)</enum><text>is greater than
				the threshold for qualification published in the Investment Prospectus;
				and</text>
										</subparagraph><subparagraph id="id22ED1D94849A483EB4C92F26BD8D9C40"><enum>(D)</enum><text>is competitive
				with scores issued to applications currently under consideration and scores
				issued to applications previously funded under this section, after taking into
				account the extent to which the application under consideration, in order of
				priority—</text>
											<clause id="id1745D21F1EB3448BB071669598D5A3FA"><enum>(i)</enum><text>advances the
				objectives of the Fund set forth in section 362(b);</text>
											</clause><clause id="id0DFDA3B5B59647DE9650896C4DE67FBB"><enum>(ii)</enum><text>addresses a
				special infrastructure investment challenge due to cost, complexity,
				cross-jurisdictional scope, multi-modal features, or the use of innovative
				technologies;</text>
											</clause><clause id="id0007752F0F5F42B196CEF835FD449866"><enum>(iii)</enum><text>provides a
				cost-effective approach to achieving the benefits described in the application
				relative to alternative approaches to achieving comparable benefits, after
				taking into account the estimated uncertainty in measures of costs and benefits
				associated with the project;</text>
											</clause><clause id="idCD8D126EA458476C9C5DD134151B8DDC"><enum>(iv)</enum><text>combines amounts
				received from the Fund with other revenue sources to leverage substantial
				co-investment from non-Federal sources;</text>
											</clause><clause id="id4BC1BC3EF1D146FDB3AF4DA52689D7D4"><enum>(v)</enum><text>delivers revenue
				streams from public or private sources dedicated to pay debt service, meet
				ongoing operating expenses, or provide for needed maintenance and capital
				renewal over the life cycle of the funded asset; and</text>
											</clause><clause id="id4200CD67F5D24E2085F4E6D4610AAFC2"><enum>(vi)</enum><text>encourages the
				use of innovative procurement, asset management, or financing to optimize the
				all-in-life-cycle cost-effectiveness of a project.</text>
											</clause></subparagraph></paragraph></subsection><subsection id="id169EE23A2AFC481988DA84FD1871EB9C"><enum>(f)</enum><header>Investment
				plans</header>
									<paragraph id="idD3365C47C5AD496686F44EDB30073B2F"><enum>(1)</enum><header>Qualified
				application requirement</header><text>After an application is certified by the
				Executive Director as qualified under subsection (e)(4), the Executive Director
				and the applicant shall enter a process for producing a mutually agreeable
				Investment Plan. Financial assistance may not be provided to an applicant under
				this section unless the applicant's Investment Plan has been recommended by the
				Board and approved by the Secretary.</text>
									</paragraph><paragraph id="idC51AE8F2605A4B2E9CAF8CE30AA16843"><enum>(2)</enum><header>Investment
				planning process</header><text>The Fund shall establish an investment planning
				process for determining the level, form, and terms of financial assistance to
				be offered by the Fund, including a mutually agreeable financing package
				that—</text>
										<subparagraph id="idEFAA0A20C493434C8181C1E817D80AD7"><enum>(A)</enum><text>is adequate to
				fund the project or projects included in the application;</text>
										</subparagraph><subparagraph id="id1D3E7ED862494182821E1A2D0A319EDA"><enum>(B)</enum><text>maximizes total
				expected project benefits relative to total expected costs; and</text>
										</subparagraph><subparagraph id="idB4215E498C574D6F99E2848A7E384599"><enum>(C)</enum><text>considers the
				portion of total costs to be financed by the Fund.</text>
										</subparagraph></paragraph><paragraph id="idBE542316DA4B4953B3EE618B3BF78F55"><enum>(3)</enum><header>Considerations</header><text>When
				considering the appropriate level and form of Fund resources to include in an
				Investment Plan, the Fund shall—</text>
										<subparagraph id="id1DC6E86D922648979C8F6793C1C78535"><enum>(A)</enum><text>consider the
				qualification score achieved by the application relative to other current
				applications and previously funded applications;</text>
										</subparagraph><subparagraph id="idF75C42014A1145C3B86AD3C05BA9525C"><enum>(B)</enum><text>strive to make
				investment plan decisions on the basis of maximizing total net benefits
				relative to cost; and</text>
										</subparagraph><subparagraph id="id96CD31DA53C443F89A5916F1CEEDAA4F"><enum>(C)</enum><text>consider—</text>
											<clause id="id4926AA5D51F04252B994BA9B44B7E252"><enum>(i)</enum><text>the amount of
				Fund budgetary resources required to complete a financing package;</text>
											</clause><clause id="id40CA646BFC0340AA8B9E5FE4889C240C"><enum>(ii)</enum><text>the percentage
				of Federal resources included in the Investment Plan in the form of
				grants;</text>
											</clause><clause id="idA8E6366689ED4DCC9E3BB32B7F6BFE6B"><enum>(iii)</enum><text>the level of
				certainty of the proposed net benefits, including the risks to the Federal
				taxpayer and the project sponsor in the event of project cost overrun or
				failure; and</text>
											</clause><clause id="idAF0CBDFC1B3C42C99F79799F319CBA2D"><enum>(iv)</enum><text>the percentage
				of eligible project costs to be funded through non-Federal resources pledged by
				the applicant to complete a financing package.</text>
											</clause></subparagraph></paragraph><paragraph id="idF36F0ACC1E4F4EE0822F8EA7E8E7CC8A"><enum>(4)</enum><header>Investment
				plans</header><text>As part of the investment planning process—</text>
										<subparagraph id="idABCC1EA75AE44A25B7B2F2436517C6DF"><enum>(A)</enum><text>the Fund shall
				have the sole discretion to determine the terms of assistance to be offered to
				applicants, subject to the provisions under this subchapter, the availability
				of funding, and any other statutory and regulatory requirements;</text>
										</subparagraph><subparagraph id="id0A182734741D4ADFBA8AF27072F51907"><enum>(B)</enum><text>if the Fund and
				the applicant are able to reach mutually agreeable terms, the Fund shall record
				the determination on Fund assistance and the details of the complete financing
				package in an Investment Plan;</text>
										</subparagraph><subparagraph id="idFBFB4606D73D4A8DBD56988A70A669A2"><enum>(C)</enum><text>the Fund may not
				approve an Investment Plan that does not identify a complete financing package;
				and</text>
										</subparagraph><subparagraph id="idF7C8DB03608F4C5F90FC12AD68E3F2EE"><enum>(D)</enum><text>the Fund is not
				required or compelled to reach agreement on an Investment Plan.</text>
										</subparagraph></paragraph><paragraph id="id07B172FFD7EC483E8E36684B6ABB254F"><enum>(5)</enum><header>Submission to
				board</header><text>The Executive Director shall advance Investment Plans for
				qualified applications to the Board at regular submission intervals, as set
				forth in the Operating Guidance.</text>
									</paragraph><paragraph id="id6B6687739F5044C9926A5CA36F3A0B99"><enum>(6)</enum><header>Conflict of
				interest protections</header><text>The Secretary of Transportation and the Fund
				shall jointly establish, in operating procedures and in the Operating Guidance,
				communications practices and compliance procedures that protect professional
				staff of the Fund who are responsible for negotiating Investment Plans from
				outside or otherwise inappropriate influence, and conflicts of interest,
				including necessary restrictions on communications between staff of the Fund
				who are responsible for the investment planning process and individuals and
				organizations within and outside the Department of Transportation,
				including—</text>
										<subparagraph id="idAADB28131F684A54B7639A61A3683F5E"><enum>(A)</enum><text>the Board;</text>
										</subparagraph><subparagraph id="idAE7A0DD96F154EBBA3B604E83FD52D49"><enum>(B)</enum><text>the Office of the
				Secretary;</text>
										</subparagraph><subparagraph id="id8A650CC98F68403691D8FE9E4D52D120"><enum>(C)</enum><text>the Secretary;
				and</text>
										</subparagraph><subparagraph id="idAA37AAB0DB3A47A58E4468DCF64C8F4D"><enum>(D)</enum><text>others needed to
				safeguard the ability of the Fund to fairly and independently formulate
				Investment Plans under this subsection.</text>
										</subparagraph></paragraph></subsection><subsection id="id057C5D253B684839BE6ABC0C2F1E75DA"><enum>(g)</enum><header>Funding
				decisions</header>
									<paragraph id="id4FF8E67ECD0F46D78BFB7CFCE77CB482"><enum>(1)</enum><header>Investment plan
				submission requirement</header><text>The Board may not consider recommending an
				application for funding before receiving an Investment Plan from the Executive
				Director.</text>
									</paragraph><paragraph id="idA7441C6F53AA435FA7113FAFA0A9C03D"><enum>(2)</enum><header>Application
				funding recommendation</header><text>Not later than 15 days after receiving an
				Investment Plan from the Executive Director, the Board shall—</text>
										<subparagraph id="id85B4B233CA4C495493434B682BB2CBF4"><enum>(A)</enum><text>vote on whether
				to recommend funding for the Investment Plan;</text>
										</subparagraph><subparagraph id="idD4DF514B019E4350BED2CE2408DB7278"><enum>(B)</enum><text>notify the
				Secretary of the outcome of such vote; and</text>
										</subparagraph><subparagraph id="id1B1A711EFCC84E4B904E1F0094740E21"><enum>(C)</enum><text>if funding is
				recommended, forward the Investment Plan to the Secretary for approval.</text>
										</subparagraph></paragraph><paragraph id="idEEE722F3D0C145C8A7B2D68EE8862099"><enum>(3)</enum><header>No
				modification</header><text>Neither the Board nor the Secretary may modify any
				Investment Plan.</text>
									</paragraph><paragraph id="id326BEE9BB21C4EC495D1A86BE912FA87"><enum>(4)</enum><header>Funding
				consideration</header>
										<subparagraph id="idE35EC62AF1DA4561B93357100911E927"><enum>(A)</enum><header>Determination</header><text>After
				considering an Investment Plan recommended by the Board, the Secretary shall
				approve or reject the Investment Plan.</text>
										</subparagraph><subparagraph id="idFE499F5FD70A404EB7BCF66F34DA77E0"><enum>(B)</enum><header>Approval</header><text>If
				the Investment Plan is approved by the Secretary, it shall be funded in
				accordance with the provisions of the Investment Plan.</text>
										</subparagraph><subparagraph id="idC817BFBEF7D4431E818E1DA7E2750815"><enum>(C)</enum><header>Rejection</header><text>If
				the Investment Plan is rejected by the Secretary, the Investment Plan—</text>
											<clause id="id33BF9ADCC97D43239BBB31ED0CABBABD"><enum>(i)</enum><text>shall be returned
				to the Executive Director with a detailed justification for rejecting the
				Investment Plan, which shall be forwarded to the applicant; and</text>
											</clause><clause id="idF09DF4F589994417BF51B4811A9CC57F"><enum>(ii)</enum><text>may be
				reconsidered by the Fund not earlier than 1 year after such date of
				return.</text>
											</clause></subparagraph></paragraph></subsection><subsection id="id8243BB6F575B48B2950C69A9430B65F0"><enum>(h)</enum><header>Project
				sponsorship; public benefit analysis; legal compliance</header>
									<paragraph id="idCAAFA10ED559476BBE6F3CD01FE699A2"><enum>(1)</enum><header>Compliance with
				applicable laws</header>
										<subparagraph id="idA5C481148DA54372B1E174CE3AAF4790"><enum>(A)</enum><header>In
				general</header><text>Subject to subparagraphs (B) and (C), the Fund shall
				determine which requirements under chapter 53 of this title or title 23 shall
				be applicable to projects receiving financial assistance under this subchapter
				that would otherwise be eligible for financial assistance under such chapter or
				title.</text>
										</subparagraph><subparagraph id="idE4B47102EE0B49D8A6B6286517E21AE7"><enum>(B)</enum><header>Labor
				standards</header><text>Labor standards under chapter 53 of this title and
				title 23 shall be applicable to projects described in subparagraph (A),
				including—</text>
											<clause id="idAF431ED54180432783805834E943500A"><enum>(i)</enum><text>applicable
				employee protective arrangement under section 5333(b);</text>
											</clause><clause id="idCCFADBE4540344099539FCEC38A2B83D"><enum>(ii)</enum><text>the requirement
				that all laborers and mechanics employed by contractors or subcontractors on
				construction work performed on the projects be paid wages at rates not less
				than those prevailing on similar construction in the locality, as determined by
				the Secretary of Labor under subchapter IV of chapter 31 of title 40, United
				States Code (except for section 3145).</text>
											</clause></subparagraph><subparagraph id="id68FC34C079FA4393ABEE3CC0FB7F9819"><enum>(C)</enum><header>Planning and
				environmental laws</header><text>A project that receives financial assistance
				under this subchapter shall comply with—</text>
											<clause id="id4A8D2F95D8FE481AA7482D5A1F526A6E"><enum>(i)</enum><text>the applicable
				planning and programming requirements under section 134 and 135 of title 23;
				and</text>
											</clause><clause id="idE5DBC7EA119348519C3DBFE70B7E0D3A"><enum>(ii)</enum><text>all applicable
				environmental laws and requirements, including the National Environmental
				Policy Act of 1969 (42 U.S.C. 4321 et seq.) and the National Historic
				Preservation Act of 1966 (16 U.S.C. 470 et seq.).</text>
											</clause></subparagraph></paragraph><paragraph id="idAA203D564CFC42CBAB592E7A5D8636C9"><enum>(2)</enum><header>Lead
				agency</header>
										<subparagraph id="id4E38C6A231C14D6C90F5C9682E15A655"><enum>(A)</enum><header>In
				general</header><text>The Department of Transportation shall be the Federal
				lead agency in the environmental review process for a project that receives
				financial assistance under this subchapter. Subject to subparagraphs (B)
				through (D), the Secretary of Transportation may delegate this responsibility
				to an operating administration.</text>
										</subparagraph><subparagraph id="idD97930E111644619B047EDC7E4993BE1"><enum>(B)</enum><header>Joint lead
				federal agency</header><text>Nothing in this paragraph precludes another
				Federal agency from being a joint lead agency in accordance with the
				regulations adopted by the President's Council on Environmental Quality.</text>
										</subparagraph><subparagraph id="id6455A1C7B1CC4DFEB44A5C2CA1EA8799"><enum>(C)</enum><header>Joint lead
				state agency</header><text>A non-Federal government entity, agency, or
				instrumentality receiving funds under this subchapter may—</text>
											<clause id="id71D5A7EB288E472F89F4DA894B0A5EEC"><enum>(i)</enum><text>serve as a joint
				lead agency with the Department of Transportation under the National
				Environmental Policy Act of 1969 (42 U.S.C. 4321 et seq.); and</text>
											</clause><clause id="id03150E4398694613A1C6984CA2084DEC"><enum>(ii)</enum><text>at the
				discretion of the lead Federal agency, prepare any environmental document
				required in support of the project if the lead Federal agency—</text>
												<subclause id="id7CDEBCC9EC1B4BD1842107AC7D17E02F"><enum>(I)</enum><text>furnishes
				guidance in such preparation; and</text>
												</subclause><subclause id="id57D8F01A8C0A4D96873FF896CDB38637"><enum>(II)</enum><text>independently
				evaluates, approves, and adopts the State or local government's environmental
				documentation before taking any action on the project.</text>
												</subclause></clause></subparagraph><subparagraph id="id56FEF9F9D8D44F32B92B6E15E240B04E"><enum>(D)</enum><header>Nongovernmental
				funding recipients</header><text>If a project is undertaken by a
				nongovernmental entity, the non-Federal government entity, agency, or
				instrumentality cosponsor of the project shall—</text>
											<clause id="id9AD04E7F7D224640B4593D4A8B7A3770"><enum>(i)</enum><text>serve as a joint
				lead agency with the Department; and</text>
											</clause><clause id="idE37367C8B9394C8AAA3318B648E3DA5F"><enum>(ii)</enum><text>have the
				authority to prepare the environmental documents described in subparagraph
				(C)(ii).</text>
											</clause></subparagraph></paragraph><paragraph id="idD400F383F916495985DBCC2120BDC3F6"><enum>(3)</enum><header>Determination
				of applicable modal requirements</header><text>If a project has cross-modal
				components, the Fund may designate the specific requirements that shall apply
				to the project.</text>
									</paragraph></subsection><subsection id="id9403D3DF904149C28A1C719615796249"><enum>(i)</enum><header>Investment-Grade
				rating requirement</header><text>The Fund shall maintain a portfolio of
				projects whose average rating is not less than investment grade.</text>
								</subsection></section><section id="idF26B262694DD4A9FBA81CB3775735E00"><enum>365.</enum><header>Studies and
				reports</header>
								<subsection id="id3202F410DC2D4BAB81772B6DC3092396"><enum>(a)</enum><header>Annual
				financial audit</header>
									<paragraph id="id9526AEACB30444AAB3DDB93FE71F8E7C"><enum>(1)</enum><header>In
				general</header><text>The Fund shall be subject to an annual financial audit by
				an independent public accounting firm selected by the Board to ensure that its
				operations meet generally accepted accounting principles.</text>
									</paragraph><paragraph id="idB1BDE249420140F380D786D59740D692"><enum>(2)</enum><header>Dissemination</header><text>The
				Fund shall—</text>
										<subparagraph id="id508B19A49A03454D90D121C084B115C9"><enum>(A)</enum><text>submit the
				results of each audit under paragraph (1) to the
				<committee-name committee-id="SSCM00">Committee on Commerce, Science, and
				Transportation of the Senate</committee-name> and the
				<committee-name committee-id="">Committee on Transportation and Infrastructure
				of the House of Representatives</committee-name>; and</text>
										</subparagraph><subparagraph id="id02908F4CBE394DE2900DAEE10AD561AB"><enum>(B)</enum><text>post such audit
				results on the Fund’s website.</text>
										</subparagraph></paragraph></subsection><subsection id="id0763070C77D74776BD445BDE9C9373AD"><enum>(b)</enum><header>Annual
				performance evaluation</header>
									<paragraph id="id16EB0F4B02964848817D6F9D1744D433"><enum>(1)</enum><header>In
				general</header><text>The Comptroller General shall conduct an annual
				assessment—</text>
										<subparagraph id="id3B0F681B6B574F0FA0D48871F79A4BB1"><enum>(A)</enum><text>to evaluate the
				Fund’s overall performance; and</text>
										</subparagraph><subparagraph id="id64E585E53BC244F680146FF5CD32D7C0"><enum>(B)</enum><text>to determine the
				effectiveness of the Fund at meeting its objectives and strategy.</text>
										</subparagraph></paragraph><paragraph id="idCED1A2576A2C44EB8AC94A8843E59959"><enum>(2)</enum><header>Dissemination</header><text>The
				Comptroller General shall submit a report containing the results of the
				evaluation conducted under paragraph (1) to the
				<committee-name committee-id="SSCM00">Committee on Commerce, Science, and
				Transportation of the Senate</committee-name> and the
				<committee-name committee-id="">Committee on Transportation and Infrastructure
				of the House of Representatives</committee-name>.</text>
									</paragraph></subsection><subsection id="idF5BBC54C27D647A1A07589A330D3200D"><enum>(c)</enum><header>Semiannual
				report</header><text>The Executive Director shall post semiannual reports on
				the Fund’s website that describe the Fund’s activities, including—</text>
									<paragraph id="ID323625d348fd45358680d3d7679151a3"><enum>(1)</enum><text>the status of
				applications received;</text>
									</paragraph><paragraph id="ID47425cc270f24454b4f45edf71c4a560"><enum>(2)</enum><text>the outcome of
				application evaluations;</text>
									</paragraph><paragraph id="ID4f9579b541634293adbe145829d98a35"><enum>(3)</enum><text>the outcome of
				investment planning processes;</text>
									</paragraph><paragraph id="IDd924006cdcd04830b7a86ca10a6a0dfa"><enum>(4)</enum><text>the status of
				Investment Plans submitted to the Board; and</text>
									</paragraph><paragraph id="IDbe959af7f0a541fa9afd308c08bfd065"><enum>(5)</enum><text>the status of
				financial assistance awards approved by the Secretary.</text>
									</paragraph></subsection><subsection id="id0F433DAD22D9479C91AD149AFEA5D78C"><enum>(d)</enum><header>Biannual
				report</header>
									<paragraph id="id1C2D89C5CACF4CF8A8B92B8A433886A5"><enum>(1)</enum><header>In
				general</header><text>Every 2 years after the date of the enactment of the
				<short-title>American Infrastructure Investment Fund Act
				of 2011</short-title>, the Board, in consultation with the Director of the
				Office of Management and Budget and the Fund Advisory Committee, shall prepare
				a report that—</text>
										<subparagraph id="idD4FB008C9C8940E69B70BDC6E6294989"><enum>(A)</enum><text>evaluates the
				Fund's performance;</text>
										</subparagraph><subparagraph id="id0EC9978752C741CD8DAFD0B99377BF80"><enum>(B)</enum><text>includes an
				assessment of the Fund as a model for infrastructure investment; and</text>
										</subparagraph><subparagraph id="idCCD35982B4DD4FACB616C477625B5DCF"><enum>(C)</enum><text>may include a
				recommendation on whether to extend the Fund's activities to nontransportation
				infrastructure sectors likely to benefit the United States, including—</text>
											<clause id="id2BBBF99971164B97848808AB070B34B5"><enum>(i)</enum><text>renewable energy
				generation;</text>
											</clause><clause id="idAE3AA80625B443A6B5EA398CBEE05DCC"><enum>(ii)</enum><text>energy
				transmission and storage;</text>
											</clause><clause id="idEA7A2F0E5DC641629239AD56C68A02D3"><enum>(iii)</enum><text>energy
				efficiency;</text>
											</clause><clause id="idEF9B3A6E1993476691565102CCB3E941"><enum>(iv)</enum><text>drinking water
				and wastewater systems;</text>
											</clause><clause id="idD613DF835AE84D6E967F70447E00DFB0"><enum>(v)</enum><text>telecommunications;
				and</text>
											</clause><clause id="id80A1E04CFC7844B19E5BB3D17F0EBB0D"><enum>(vi)</enum><text>other
				infrastructure activities.</text>
											</clause></subparagraph></paragraph><paragraph id="id38DEFC4C90F44CB39924BE9283A92746"><enum>(2)</enum><header>Dissemination</header><text>The
				Board shall—</text>
										<subparagraph id="id51D3BA91AE444EC9A424E22F8E76FFAD"><enum>(A)</enum><text>submit the report
				prepared under paragraph (1) to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation of the
				Senate</committee-name> and the <committee-name committee-id="">Committee on
				Transportation and Infrastructure of the House of
				Representatives</committee-name>; and</text>
										</subparagraph><subparagraph id="id2DF47640613A44D190E77A1749E2DF7E"><enum>(B)</enum><text>post the report
				on the Fund's website.</text>
										</subparagraph></paragraph></subsection><subsection id="idF68B6FB9B4B440C88FC37CBDFB4505C8"><enum>(e)</enum><header>Investment plan
				and decisions</header><text>Not later than 90 days after the Board's decision
				on an Investment Plan, the Fund Advisory Committee shall post a report on the
				Fund's website that assesses—</text>
									<paragraph id="idC05B5D5E4C1D468FB229B0578E49C0DE"><enum>(1)</enum><text>the adherence of
				each funding decision to the requirements of the Investment Prospectus,
				Operating Guidance, and this subchapter;</text>
									</paragraph><paragraph id="idD06E3EC07C144EFA98E9E3E488313046"><enum>(2)</enum><text>the consistency
				of funded applications with the primary objective, the secondary objectives,
				the Fund strategy, and the requirements under this subchapter;</text>
									</paragraph><paragraph id="id4ADF227C205240F5AC21D6E538D70F8F"><enum>(3)</enum><text>the validity of
				the qualification certification of each funded application;</text>
									</paragraph><paragraph id="idE2AC5A5D6477414584529B7D854D2887"><enum>(4)</enum><text>the return on
				Federal investment likely to result from each funded Investment Plan;
				and</text>
									</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id13B2CF16DF1945C2801C7742FCA5A7FD"><enum>(5)</enum><text>the return on
				total investment likely to result from each funded Investment
				Plan.</text>
									</paragraph></subsection></section></subchapter><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="id8F56052D574444A9921FF7145A70F1A6"><enum>(b)</enum><header>Authorization
			 of appropriations</header>
				<paragraph id="id911E86ED5D0044BEAC4468AC61AA11A5"><enum>(1)</enum><header>Amounts
			 authorized</header>
					<subparagraph id="id069DFC103B434BDF8F732C50E5B3F187"><enum>(A)</enum><header>In
			 general</header><text display-inline="yes-display-inline">There are authorized
			 to be appropriated to carry out subchapter IV of chapter 3 of title 49, United
			 States Code, as added by subsection (a), $5,000,000,000 for each of the fiscal
			 years 2012 and 2013.</text>
					</subparagraph><subparagraph id="id020348F26EC948EB8902A79CABC3811F"><enum>(B)</enum><header>Availability of
			 funds</header><text>Amounts made available under subparagraph (A) shall remain
			 available until expended.</text>
					</subparagraph></paragraph><paragraph id="id4343755756EB41A1AABD0DD3FCB3DC19"><enum>(2)</enum><header>Administrative
			 expenses</header><text>Of the amounts appropriated pursuant to paragraph (1),
			 the Fund may expend, to pay the reasonable costs of administering such
			 subchapter IV, inclusive of any fees collected pursuant to such
			 subchapter—</text>
					<subparagraph id="id14A3FF5479344125A4587E76803EF648"><enum>(A)</enum><text>not more than
			 $50,000,000 in fiscal year 2012; and</text>
					</subparagraph><subparagraph id="idEAAA0088D07C4E3E8146F5BE9D55B6AA"><enum>(B)</enum><text>not more than
			 $51,000,000 in fiscal year 2013.</text>
					</subparagraph></paragraph></subsection></section><section id="IDC4D377F34E444D179FDBFF747C2B79B2"><enum>3.</enum><header>National
			 infrastructure investment grants</header>
			<subsection id="ID2299E796C5BA415D8C88A7761E70538B"><enum>(a)</enum><header>Establishment
			 of program</header><text>Chapter 55 of title 49, United States Code, is amended
			 by adding at the end the following:</text>

					<subchapter id="ID0B820D87A12E423D86A8700937B97AC0"><enum>III</enum><header>Financial
				assistance</header>
						<section id="ID2BED622496034D6AA2398BE3F1DF1034"><enum>5581.</enum><header>National
				infrastructure investment grants</header>
							<subsection id="ID089CC0C0C5814ADCACB891E9F85D19DD"><enum>(a)</enum><header>Establishment
				of program</header><text>The Secretary of Transportation shall establish a
				competitive grant program to provide financial assistance for projects that
				will have a significant impact on the Nation, a metropolitan area, or a
				region.</text>
							</subsection><subsection id="IDE2342CA269674C1DAB2AE9927D15953B"><enum>(b)</enum><header>Eligible
				projects</header><text>An applicant is eligible for a grant under this section
				for a project that is part of, or related to, a transportation improvement,
				including projects related to the construction or improvement of—</text>
								<paragraph id="IDddef9901b78343d491599966b2201d57"><enum>(1)</enum><text>a passenger or
				freight rail line;</text>
								</paragraph><paragraph id="ID8ae8a53e4feb4b179154537944111181"><enum>(2)</enum><text>a highway;</text>
								</paragraph><paragraph id="IDcef00796a9f04e8586da032bfde971c2"><enum>(3)</enum><text>a bridge;</text>
								</paragraph><paragraph id="ID7893bb12a36247f2a3690a97ca93e79a"><enum>(4)</enum><text>an
				airport;</text>
								</paragraph><paragraph id="IDe3677f7c431b4bd19471e6347eab24f7"><enum>(5)</enum><text>an air traffic
				control system;</text>
								</paragraph><paragraph id="IDabba715d21fb419ba1b0a4623fc913d1"><enum>(6)</enum><text>a port or marine
				facility;</text>
								</paragraph><paragraph id="ID066e8578b4784059b9acee8430404936"><enum>(7)</enum><text>an inland
				waterway;</text>
								</paragraph><paragraph id="ID9c5eb5746836497bb5dedf938eb551da"><enum>(8)</enum><text>a transmission or
				distribution pipeline;</text>
								</paragraph><paragraph id="ID90f524527f3044c5926d7bd12f1b9733"><enum>(9)</enum><text>public
				transportation facilities or systems;</text>
								</paragraph><paragraph id="IDdca03cf8334b4847ba3448ad2f704606"><enum>(10)</enum><text>intercity
				passenger bus or passenger rail facilities or equipment;</text>
								</paragraph><paragraph id="ID9659c085f1f447b5b243bb24b1e6f61e"><enum>(11)</enum><text>freight rail
				facilities or equipment; or</text>
								</paragraph><paragraph id="ID45637f9750e04af08226695e2c76bd58"><enum>(12)</enum><text>planning,
				preparation, or design of any project described in paragraphs (1) through
				(11).</text>
								</paragraph></subsection><subsection id="ID8B4464EE8750428C8BEA9C4D74005007"><enum>(c)</enum><header>Project
				selection criteria</header><text>In determining whether to award a grant to an
				eligible applicant under this section, the Secretary shall consider the extent
				to which the project—</text>
								<paragraph id="ID595ED02C626740DC8B954BCD07D026DF"><enum>(1)</enum><text>leverages Federal
				investment by encouraging non-Federal contributions to the project, including
				contributions from public-private partnerships;</text>
								</paragraph><paragraph id="IDB92CA1A578734EC9856A8567764647F6"><enum>(2)</enum><text>improves the
				mobility of people, goods, and commodities;</text>
								</paragraph><paragraph id="ID09CDB2E389C147FEACCC4D3EB99258DE"><enum>(3)</enum><text>incorporates new
				and innovative technologies, including intelligent transportation
				systems;</text>
								</paragraph><paragraph id="IDA9CEC7F82C1A4C299FD2239001917B4D"><enum>(4)</enum><text>improves energy
				efficiency or reduces greenhouse gas emissions;</text>
								</paragraph><paragraph id="ID5B7612F82A5F4054A31A3679F3F7946D"><enum>(5)</enum><text>helps maintain or
				protect the environment, including reducing air and water pollution;</text>
								</paragraph><paragraph id="ID01AC4BF78EA0442EBF464BDD9066E67A"><enum>(6)</enum><text>reduces
				congestion;</text>
								</paragraph><paragraph id="IDD82F4428866B461DA9BD8B92D73C5A4D"><enum>(7)</enum><text>improves the
				condition of transportation infrastructure, including bringing it into a state
				of good repair;</text>
								</paragraph><paragraph id="ID5792E3C9ECDF4424924587A98CEE8BBA"><enum>(8)</enum><text>improves safety,
				including reducing transportation accidents, injuries, and fatalities;</text>
								</paragraph><paragraph id="IDDA587D82EB0F4DE8B1E6D1F7FEC8DDD3"><enum>(9)</enum><text>demonstrates that
				the proposed project cannot be readily and efficiently realized without Federal
				support and participation; and</text>
								</paragraph><paragraph id="ID1FD29EA563174499AB8B3F6F1FC7FC81"><enum>(10)</enum><text>enhances
				national or regional economic development, growth, and competitiveness.</text>
								</paragraph></subsection><subsection id="ID6016D3AEADBA4E0DA668274E57801E37"><enum>(d)</enum><header>Priority</header><text>The
				Secretary shall give priority to projects that have the highest system
				performance improvement relative to their benefit-cost analysis.</text>
							</subsection><subsection id="IDEA74D3338F564211B8A2C8E31EBAD0C4"><enum>(e)</enum><header>Letters of
				intent</header>
								<paragraph id="ID2CD873E3EC4C4270B4C85FB95E5896E9"><enum>(1)</enum><header>In
				general</header><text>The Secretary may issue a letter of intent to an
				applicant announcing an intention to obligate, for a major capital project
				under this subsection, an amount from future available budget authority
				specified in law that is not more than the amount stipulated as the financial
				participation of the Secretary in the project.</text>
								</paragraph><paragraph id="ID698F0897DAD440FBBB9DD2D89B7BD6D5"><enum>(2)</enum><header>Notification</header><text>Not
				later than 30 days before issuing a letter under paragraph (1), the Secretary
				shall submit written notification of the proposed letter or agreement to the
				<committee-name committee-id="SSCM00">Committee on Commerce, Science, and
				Transportation of the Senate</committee-name> and the
				<committee-name committee-id="">Committee on Transportation and Infrastructure
				of the House of Representatives</committee-name>, which shall include—</text>
									<subparagraph id="id4641B002F19F4087BAE681D0E860076E"><enum>(A)</enum><text>a copy of the
				proposed letter or agreement;</text>
									</subparagraph><subparagraph id="idA81A752BF1D84EF781B4326C1F36F192"><enum>(B)</enum><text>the criteria used
				under subsection (c) for selecting the project for a grant award; and</text>
									</subparagraph><subparagraph id="idE6075E7D846748C18462211D5E8A802F"><enum>(C)</enum><text>a description of
				how the project meets such criteria.</text>
									</subparagraph></paragraph><paragraph id="IDDDFB314C481C44E4BEDC05E4F19F47D2"><enum>(3)</enum><header>Commitment</header><text>An
				obligation or administrative commitment may be made only when amounts are made
				available. The letter of intent shall state that the contingent commitment is
				not an obligation of the Federal Government, and is subject to the availability
				of funds under Federal law and to Federal laws in force or enacted after the
				date of the contingent commitment.</text>
								</paragraph></subsection><subsection id="IDE858CF3EFB074E5DB37AD779AB06EA69"><enum>(f)</enum><header>Federal share
				of net project cost</header>
								<paragraph id="ID19B06039CA334DFE8AE5E1131D71EA35"><enum>(1)</enum><header>In
				general</header><text>The Federal share of a grant for the project shall not
				exceed 80 percent of the project net capital cost.</text>
								</paragraph><paragraph id="id5DB281719ED540618D8B6ED6DCA52642"><enum>(2)</enum><header>Estimate</header><text>The
				Secretary shall estimate the net project cost based on engineering studies,
				studies of economic feasibility, and information on the expected use of
				equipment or facilities.</text>
								</paragraph><paragraph id="ID0B3F35B7592E401094863B691291ACB7"><enum>(3)</enum><header>Priority</header><text>The
				Secretary shall give priority in allocating future obligations and contingent
				commitments to incur obligations to grant requests seeking a lower Federal
				share of the project net capital cost.</text>
								</paragraph></subsection><subsection id="ID9E99C93A5FDA4377A609774C2DB138A9"><enum>(g)</enum><header>Cooperative
				agreements</header>
								<paragraph id="IDA90FF1E628D84D58AFEB057A4271E322"><enum>(1)</enum><header>In
				general</header><text>An applicant may enter into an agreement with any public,
				private, or nonprofit entity to cooperatively implement any project funded with
				a grant under this subchapter.</text>
								</paragraph><paragraph id="ID225CCD121F614CBDB3B2A7399214C031"><enum>(2)</enum><header>Forms of
				participation</header><text>Participation by an entity under paragraph (1) may
				consist of—</text>
									<subparagraph id="IDF555AE6591E3473AA09B8DBF713283C5"><enum>(A)</enum><text>ownership or
				operation of any land, facility, vehicle, or other physical asset associated
				with the project;</text>
									</subparagraph><subparagraph id="ID88E9CB3B52704E26B1D75BF85628B766"><enum>(B)</enum><text>cost-sharing of
				any project expense or non-Federal share of the project cost, including in kind
				contributions;</text>
									</subparagraph><subparagraph id="ID0F86CFAC350D405E898129536B4E4BE0"><enum>(C)</enum><text>carrying out
				administration, construction management, project management, project operation,
				or any other management or operational duty associated with the project;
				and</text>
									</subparagraph><subparagraph id="ID9122E104A4D94C1CBF513A9A79280D14"><enum>(D)</enum><text>any other form of
				participation approved by the Secretary.</text>
									</subparagraph></paragraph></subsection><subsection id="ID1825BDD007AB4A91A5090C7B6B9ECA30"><enum>(h)</enum><header>Oversight
				program</header>
								<paragraph id="ID37C178A42AE24B47A50BD9888ADCF708"><enum>(1)</enum><header>Establishment</header>
									<subparagraph id="ID25988773260740EAB618468277D3ACE5"><enum>(A)</enum><header>In
				general</header><text>The Secretary shall establish an oversight program to
				monitor the effective and efficient use of funds authorized to carry out this
				section.</text>
									</subparagraph><subparagraph id="IDF00B208B94394ECE8E13E599648A012D"><enum>(B)</enum><header>Minimum
				requirement</header><text>At a minimum, the program shall be responsive to all
				areas relating to financial integrity and project delivery.</text>
									</subparagraph></paragraph><paragraph id="ID2CF65847FCDC4672958BBAE1A89F17A0"><enum>(2)</enum><header>Financial
				integrity</header>
									<subparagraph id="ID2BADEA429D424C8280ABFB61186465BE"><enum>(A)</enum><header>Financial
				management systems</header><text>The Secretary shall perform annual reviews
				that address elements of the applicant's financial management systems that
				affect projects approved under subsection (a).</text>
									</subparagraph><subparagraph id="IDAF36A66D09CA48699247C02F15019800"><enum>(B)</enum><header>Project
				costs</header><text>The Secretary shall develop minimum standards for
				estimating project costs and shall periodically evaluate the practices of
				applicants for estimating project costs, awarding contracts, and reducing
				project costs.</text>
									</subparagraph></paragraph><paragraph id="IDCE8EB6EF59E2430FB65E33AAC3741F59"><enum>(3)</enum><header>Project
				delivery</header><text>The Secretary shall perform annual reviews that address
				elements of the project delivery system of an applicant, which elements include
				one or more activities that are involved in the life cycle of a project from
				conception to completion of the project.</text>
								</paragraph><paragraph id="ID5B5EEA8867B3448EA813CE42FFD4BEF3"><enum>(4)</enum><header>Responsibility
				of the applicants</header>
									<subparagraph id="ID9EF8CAC63F2C457D81E62F8C24B1C81C"><enum>(A)</enum><header>In
				general</header><text>Each applicant shall submit to the Secretary for approval
				such plans, specifications, and estimates for each proposed project as the
				Secretary may require.</text>
									</subparagraph><subparagraph id="ID16662ECFE4274642902391153E9739E2"><enum>(B)</enum><header>Applicant
				subrecipients</header><text>The applicant shall be responsible for determining
				that a subrecipient of Federal funds under this section has—</text>
										<clause id="IDA0452CC78D7F49B7BCFAFAB20B916702"><enum>(i)</enum><text>adequate project
				delivery systems for projects approved under this section; and</text>
										</clause><clause id="ID502F1626C7CD4122A0DE16E13F53D32D"><enum>(ii)</enum><text>sufficient
				accounting controls to properly manage such Federal funds.</text>
										</clause></subparagraph><subparagraph id="ID6EB186EDE93E453F9C884F97000D9A2D"><enum>(C)</enum><header>Periodic
				review</header><text>The Secretary shall periodically review the monitoring of
				subrecipients by the applicant.</text>
									</subparagraph></paragraph><paragraph id="ID20083BFFDE2046BCBC6C2FE3B740FD8A"><enum>(5)</enum><header>Specific
				oversight responsibilities</header><text>Nothing in this section shall affect
				or discharge any oversight responsibility of the Secretary specifically
				provided for under this title or other Federal law.</text>
								</paragraph></subsection><subsection id="IDA7F8E17F988B412FB1E668724C9AC0A8"><enum>(i)</enum><header>Major
				projects</header>
								<paragraph id="IDE61E33E578AE4376AD70FA83D6DBD9A3"><enum>(1)</enum><header>In
				general</header><text>A recipient of a grant for a project under this section
				with an estimated total cost of $500,000,000 or more, and a recipient for such
				other projects as may be identified by the Secretary, shall submit to the
				Secretary for each project—</text>
									<subparagraph id="IDF8161AEE46394FE7B1338244A321DA76"><enum>(A)</enum><text>a project
				management plan; and</text>
									</subparagraph><subparagraph id="ID88D959D9F2164E5BA68ADA8374E73B71"><enum>(B)</enum><text>an annual
				financial plan.</text>
									</subparagraph></paragraph><paragraph id="IDDDD87733C8BD4AAFAAA50348392AA314"><enum>(2)</enum><header>Project
				management plan</header><text>A project management plan shall document—</text>
									<subparagraph id="IDE8613A06E25441D8A45AF713E21781BA"><enum>(A)</enum><text>the procedures
				and processes that are in effect to provide timely information to the project
				decision makers to effectively manage the scope, costs, schedules, quality of,
				and the Federal requirements applicable to, the project; and</text>
									</subparagraph><subparagraph id="ID1482A8767F4642A587C9486804E3B3F4"><enum>(B)</enum><text>the role of the
				agency leadership and management team in the delivery of the project.</text>
									</subparagraph></paragraph><paragraph id="ID4CEF2870A3264C818DECA1F79EE5C4F7"><enum>(3)</enum><header>Financial
				plan</header><text>A financial plan shall—</text>
									<subparagraph id="ID0988ADC285FE4B3FB15FE0FC4EEDE277"><enum>(A)</enum><text>be based on
				detailed estimates of the cost to complete the project; and</text>
									</subparagraph><subparagraph id="IDC4A773B3B60248A6B0436DC4F7EF31BE"><enum>(B)</enum><text>provide for the
				annual submission of updates to the Secretary that are based on reasonable
				assumptions, as determined by the Secretary, of future increases in the cost to
				complete the project.</text>
									</subparagraph></paragraph></subsection><subsection id="ID167261179C244C6280A1DD94A58C1989"><enum>(j)</enum><header>Other
				projects</header><text>A recipient of Federal financial assistance for a
				project under this title with an estimated total cost of $100,000,000 or more
				that is not covered by subsection (i) shall prepare an annual financial plan.
				Annual financial plans prepared under this subsection shall be made available
				to the Secretary for review upon the request of the Secretary.</text>
							</subsection><subsection id="ID2F77E78E109D4051A309400CC219184C"><enum>(k)</enum><header>Other terms and
				conditions</header><text>The Secretary shall determine what additional grant
				terms and conditions are necessary and appropriate to meet the requirements of
				this section.</text>
							</subsection><subsection id="ID379E0218B5F44C38A4D8E828C4EABFAA"><enum>(l)</enum><header>Regulations</header><text>Not
				later than 1 year after the date of the enactment of the
				<short-title>American Infrastructure Investment Fund Act
				of 2011</short-title>, the Secretary shall prescribe regulations to implement
				this section.</text>
							</subsection><subsection id="IDF9DE0186AF6C47EA977983C7F1D87569"><enum>(m)</enum><header>Applicant
				defined</header><text>In this subchapter, the term <term>applicant</term>
				includes a State, a political subdivision of a State, government-sponsored
				authorities and corporations, and the District of Columbia.</text>
							</subsection><subsection id="IDF555AEA0BE1A48E596E9CAEEA50C4DBE"><enum>(n)</enum><header>Secretarial
				oversight</header>
								<paragraph id="ID00F9ECEE020044AEAADDC90B980598A6"><enum>(1)</enum><header>Construction
				management contracts</header><text>The Secretary may use not more than 1
				percent of amounts made available in a fiscal year for capital projects under
				this subchapter to enter into contracts to oversee the construction of such
				projects.</text>
								</paragraph><paragraph id="ID6602A0D8663C450889D64764C864F745"><enum>(2)</enum><header>Compliance
				reviews</header><text>The Secretary may use amounts available under paragraph
				(1) to make contracts for safety, procurement, management, and financial
				compliance reviews and audits of a recipient of amounts under paragraph
				(1).</text>
								</paragraph><paragraph id="IDEFC503A801BE4F3082843E43F35E75E7"><enum>(3)</enum><header>Federal
				costs</header><text>The Federal Government shall pay the entire cost of
				carrying out a contract under this subsection.</text>
								</paragraph></subsection><subsection id="idC919E6B84F35474B873F59AEBC95CADA"><enum>(o)</enum><header>Performance
				evaluation</header>
								<paragraph id="ID1df28d0e39214c03946b0a76373532b6"><enum>(1)</enum><header>Annual
				report</header>
									<subparagraph id="ID07428ad85c8a4531b39a8eba8c062c94"><enum>(A)</enum><header>In
				general</header><text>The Comptroller General of the United States shall
				conduct an annual assessment to evaluate the overall performance of grants made
				under the program established pursuant to subsection (a).</text>
									</subparagraph><subparagraph id="IDed51d59c6aa74d22ad813946262561c2"><enum>(B)</enum><header>Dissemination</header><text>The
				Comptroller General shall submit a report containing the results of the
				evaluation conducted under subparagraph (A) to the
				<committee-name added-display-style="italic" committee-id="SSCM00" deleted-display-style="strikethrough">Committee on Commerce, Science, and
				Transportation of the Senate</committee-name> and the
				<committee-name committee-id="">Committee on Transportation and Infrastructure
				of the House of Representatives</committee-name>.</text>
									</subparagraph></paragraph><paragraph id="ID93da05d122c842d8b6ec3322cdf0075a"><enum>(2)</enum><header>Biannual
				report</header><text>Not later than 1 year after the date of the enactment of
				the <short-title>American Infrastructure Investment Fund
				Act of 2011</short-title>, and every 6 months thereafter, the Secretary of
				Transportation shall submit a report to the congressional committees set forth
				in paragraph (1)(B) that documents—</text>
									<subparagraph id="ID4f10bf3f9871484895d92e535f7d7e21"><enum>(A)</enum><text>the number of
				applications received under this section;</text>
									</subparagraph><subparagraph id="IDc8caa12d521d4701bd03bd882da7ba1f"><enum>(B)</enum><text>the status of
				such applications;</text>
									</subparagraph><subparagraph id="ID2362e37e224c4b2cadd6e7f543456ec2"><enum>(C)</enum><text>the outcome of
				application evaluations; and</text>
									</subparagraph><subparagraph id="ID279b8f2b7887428d92edb0ae4a6cfbcb"><enum>(D)</enum><text>the status of
				grants awarded under the program established pursuant to subsection (a).</text>
									</subparagraph></paragraph></subsection><subsection id="id731D6FF6092048848E51A15C6EADCAE6"><enum>(p)</enum><header>Authorization
				of appropriations</header><text>There are authorized to be appropriated to the
				Secretary $600,000,000 for each of the fiscal years 2012 and 2013 to carry out
				this
				section.</text>
