			</subsection></section><section id="ID10f600565fb84a74af0b06483d17d71c"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that in order for a
			 comprehensive, effective literacy program to address the needs of readers and
			 writers it is critical to address the following:</text>
			<paragraph id="IDb8bebb939b8d435d992de8a795bb2c5f"><enum>(1)</enum><text>Literacy
			 development is an ongoing process that requires a sustained investment
			 beginning in early childhood and continuing through elementary school and
			 secondary school.</text>
			</paragraph><paragraph id="ID93599bb14ba74d198e6513fad563853f"><enum>(2)</enum><text>Developing
			 literacy skills begins at birth as infants and toddlers associate sounds,
			 gestures, and marks on paper with consequences and meaning. Many low-income
			 children from birth through kindergarten entry lack oral and print
			 language-rich environments in their homes and early childhood education
			 programs and teachers and staff in early childhood education programs are often
			 not provided with high-quality professional development on how to support
			 children’s language and literacy development.</text>
			</paragraph><paragraph id="IDe1db223078dc4274b6f76b805a3f9cb1"><enum>(3)</enum><text>Early childhood
			 educators whose professional preparation and ongoing development includes study
			 of language learning and early childhood development promote early language and
			 literacy as part of the overall curriculum for children’s readiness for school,
			 particularly for young English language learners and children with disabilities
			 or developmental delays.</text>
			</paragraph><paragraph id="ID9097ea116b9b47fb92b4839952e7ba65"><enum>(4)</enum><text>Research shows
			 that writing leads to improved reading achievement, reading leads to better
			 writing performance, and combined instruction leads to improvements in both
			 areas. Children in kindergarten through grade 12 need to be engaged in combined
			 reading and writing experiences that lead to a higher level of thinking than
			 when either process is taught alone.</text>
			</paragraph><paragraph id="ID2ae68621e812486a806b203dc40d672d"><enum>(5)</enum><text>Environments rich
			 in language and literacy experiences, books, resources, and models facilitate
			 reading and writing development. Schools, principals, librarians, and teachers
			 must have the knowledge, skills, and tools to create environments appropriate
			 to meet the diverse literacy needs of children from birth through grade 12,
			 especially for children whose home environments lack support for literacy
			 development.</text>
			</paragraph><paragraph id="ID70eb86257e694d998f0aa502a0ab729f"><enum>(6)</enum><text>Middle school and
			 secondary school teachers need professional development to improve the reading
			 and writing abilities of students who are reading and writing several years
			 below grade level. Middle school and secondary school teachers in core academic
			 subjects must have the tools and skills to teach reading and writing for
			 subject area understanding and to differentiate and provide instruction for
			 students with varying literacy skills.</text>
			</paragraph><paragraph id="IDbc96298c46c543b19b237b60ba51a85b"><enum>(7)</enum><text>The intellectual
			 and linguistic skills necessary for writing and reading must be developed
			 through explicit, intentional, and systematic language activities, to which
			 many low-income and minority students do not currently have access.</text>
			</paragraph><paragraph id="IDcf57a545006f44b59baa6b7a6d5c0f25"><enum>(8)</enum><text>Between 1971 and
			 2004, the reading levels of America's 17-year-olds showed little to no
			 improvement at all. The ability of secondary school students to read complex
			 texts is strongly predictive of their performance in college mathematics and
			 science courses.</text>
			</paragraph><paragraph id="ID5c59e18c92f34f61bac1f5927e30125e"><enum>(9)</enum><text>Fewer than 2 in
			 10 eighth graders from the secondary school graduating classes of 2005 and 2006
			 met all 4 EXPLORE College Readiness Benchmarks (English, Mathematics, Reading,
			 and Science), the minimum level of achievement that ACT has shown is necessary
			 if students are to be college and career ready upon their secondary school
			 graduation.</text>
			</paragraph><paragraph id="ID590960ed767b47bea05bcba4583fa59a"><enum>(10)</enum><text>Seventy percent
			 of eighth graders read below the proficient level on the 2007 National
			 Assessment of Educational Progress, indicating that students in middle schools
			 and secondary schools struggle to graduate because the students' literacy
			 achievement is alarmingly low. Only one-third of secondary school students who
			 enter grade 9 each year can expect to graduate in 4 years with the skills the
			 student needs to succeed in college and the workplace.</text>
			</paragraph><paragraph id="ID366f94fec2784cfebbcbc67febf68054"><enum>(11)</enum><text>Secondary school
			 graduation rates for low-income students and students of color hover around 50
			 percent, as do graduation rates for students in urban school districts and
			 students with disabilities. Graduation rates for English language learners are
			 particularly low.</text>
			</paragraph><paragraph id="IDc29a19fab5c74940a96c244668cff30e"><enum>(12)</enum><text>Only 71 percent
			 of secondary school students graduate on time with a diploma, meaning that
			 every year 1,230,000 students fail to graduate from secondary school. These
			 1,230,000 nongraduates cost the Nation more than $319,000,000,000 in lost
			 wages, taxes, and productivity over the lifetimes of the nongraduates.</text>
			</paragraph><paragraph id="ID25512ed0cf55404f8af530ebe34c3e35"><enum>(13)</enum><text>About 40 percent
			 of secondary school graduates lack the literacy skills employers seek. The 25
			 fastest growing professions have far greater than average literacy demands,
			 while the fastest declining professions have lower than average literacy
			 demands.</text>
			</paragraph><paragraph id="ID53add99dbe4640839a82cdf1be10a55a"><enum>(14)</enum><text>Research shows
			 that low expectations for the reading and writing achievement of students in
			 schools results in curriculum that does not challenge or adequately support the
			 student’s literacy learning and in subsequent low achievement, while high
			 academic expectations can help boost student learning and achievement.</text>
			</paragraph><paragraph id="IDd331e6bef31b49e0a88c1b8f99f0959f"><enum>(15)</enum><text>Children learn
			 best in settings where teachers understand the developmental continuum of
			 language, reading, and writing and are skilled in a variety of strategies that
			 help the children achieve.</text>
			</paragraph><paragraph id="IDa025d11d29a84162a51091ad78abf6de"><enum>(16)</enum><text>Meaningful
			 engagement of families in their children’s early learning supports school
			 readiness and later academic success.</text>
			</paragraph><paragraph id="ID1adb1f34c7d543bdb4189803026b19c1"><enum>(17)</enum><text>Parental
			 literacy habits are positively associated with parental reading beliefs,
			 parent-child literacy and language activities in the home, children’s print
			 knowledge, and parents' and children's interest in reading and writing.</text>
			</paragraph></section><section id="IDc3f32bfeae724d949d99e57719784192"><enum>3.</enum><header>Purposes</header><text display-inline="no-display-inline">The purposes of this Act are—</text>
			<paragraph id="id5D7ED094AD2B46F599F9EC1689506893"><enum>(1)</enum><text display-inline="yes-display-inline">to improve reading, writing, and academic
			 achievement for children and students by providing Federal support to State
			 educational agencies to develop, coordinate, and implement comprehensive
			 literacy plans that ensure high quality instruction and effective practices in
			 reading and writing from early childhood education through grade 12; and</text>
			</paragraph><paragraph id="id99302261D8DF4E318DEC85ECA7A0216F"><enum>(2)</enum><text display-inline="yes-display-inline">to assist State educational agencies in
			 achieving the purposes described in paragraph (1) by—</text>
				<subparagraph id="ID5b8e3bbf667845feb66835751d18c6a9"><enum>(A)</enum><text>supporting the
			 development and implementation of comprehensive early childhood education
			 through grade 12 literacy programs in every State that are based on
			 scientifically valid research, to ensure that every child can read and write at
			 grade level or above;</text>
				</subparagraph><subparagraph id="ID3e51b67a5cfd478b935ebf53737720bb"><enum>(B)</enum><text>providing
			 children from birth through kindergarten entry with learning opportunities in
			 high quality, language rich, literature rich, informational text rich,
			 culturally relevant, developmentally appropriate environments, such as child
			 care, Early Head Start, Head Start, public library programs, and other early
			 childhood education settings, so that the children develop the fundamental
			 knowledge and skills necessary for literacy engagement, development, and
			 achievement in kindergarten and beyond;</text>
				</subparagraph><subparagraph id="idF1EFAC6CF21447AD888A70201D4EA0C5"><enum>(C)</enum><text>educating parents
			 in the ways the parents can support their child’s communication and literacy
			 development;</text>
				</subparagraph><subparagraph id="ID47cae49f2fee409e9377327e4895b251"><enum>(D)</enum><text>supporting
			 efforts to link and align standards and research-based teaching practices and
			 instruction in early childhood education programs serving children from birth
			 through kindergarten entry;</text>
				</subparagraph><subparagraph id="ID561670d070244eb6ae5e4a71ad223fe2"><enum>(E)</enum><text>supporting
			 high-quality and effective educational, and developmental, environments for
			 children from birth through grade 12 to develop oral language, reading
			 comprehension, and writing abilities through high quality research-based
			 instruction and practices;</text>
				</subparagraph><subparagraph id="IDaf389cec4c6f40509dcec5ba3782ee2e"><enum>(F)</enum><text>improving student
			 achievement by establishing adolescent literacy initiatives that provide
			 explicit and systematic instruction in oral language, reading, and writing
			 development across the curriculum;</text>
				</subparagraph><subparagraph id="ID1f7f993739a048d9b9a22e5bc71fa97e"><enum>(G)</enum><text>identifying and
			 supporting students reading and writing significantly below grade level by
			 providing research-based, intensive interventions, including those conducted
			 during extended learning time, to help the students acquire the language and
			 literacy skills the students need to stay on track for graduation;</text>
				</subparagraph><subparagraph id="ID2aeaab63fd24415da7cb7df04900513f"><enum>(H)</enum><text>providing
			 assistance to local educational agencies in order to provide educators with
			 ongoing, job-embedded professional development and other support focusing on
			 imparting and employing—</text>
					<clause id="id6D1EC7CD7C674DA49EE9A11A501A8464"><enum>(i)</enum><text>the
			 characteristics of effective language and literacy instruction;</text>
					</clause><clause id="idFD1DE0517C0B49E988D6509E3832A24F"><enum>(ii)</enum><text>the special
			 knowledge and skills necessary to teach and support literacy development
			 effectively across the developmental span and age span;</text>
					</clause><clause id="idDB47F8885C434A34A8DFD7EC6E466484"><enum>(iii)</enum><text>the essential
			 components of reading instruction; and</text>
					</clause><clause id="id6C8D8E2B8FCB49B68D7E9C4AA229D284"><enum>(iv)</enum><text>the essential
			 components of writing instruction;</text>
					</clause></subparagraph><subparagraph id="ID5ce2c791abcc4e8daed83b8d5792b12d"><enum>(I)</enum><text>supporting State
			 educational agencies and local educational agencies in improving reading,
			 writing, and literacy-based academic achievement for children and students,
			 especially children and students who are low-income, are English language
			 learners, are migratory, are children with disabilities, are Indian or Alaskan
			 Native, are neglected or delinquent, are homeless, are in the custody of the
			 child welfare system, or have dropped out of school;</text>
				</subparagraph><subparagraph id="ID5423afc997484c8b855859e9abc9002b"><enum>(J)</enum><text>supporting State
			 educational agencies and local educational agencies in using age appropriate
			 and developmentally appropriate instructional materials and strategies that
			 assist teachers as the teachers work with students to develop reading and
			 writing competencies appropriate to the students' grade and skill
			 levels;</text>
				</subparagraph><subparagraph id="ID76c61c419f8148bfb3c910e7901345d2"><enum>(K)</enum><text>strengthening
			 coordination among schools, early literacy programs, family literacy programs,
			 juvenile justice programs, public libraries, and outside-of-school programs
			 that provide children and youth with strategies, curricula, interventions, and
			 assessments designed to advance early and continuing language and literacy
			 development in ways appropriate for each context;</text>
				</subparagraph><subparagraph id="ID7b1c2186baab40e8841e8a6d2e45185d"><enum>(L)</enum><text>supporting
			 professional development for educators based on scientific approaches to adult
			 learning; and</text>
				</subparagraph><subparagraph id="idDCA25CEDC1554653ADB54FCCE29AB606"><enum>(M)</enum><text>evaluating
			 whether the professional development activities and approaches supported under
			 this Act are effective in building—</text>
					<clause id="id1B008385356D41C1B36C1038F0D91B55"><enum>(i)</enum><text>the
			 knowledge and skills of educators; and</text>
					</clause><clause id="id0004535071194BA6A87130A9F3BB3B3F"><enum>(ii)</enum><text>the educators'
			 use of appropriate and effective practices.</text>
					</clause></subparagraph></paragraph></section><section id="ID195d9066c8a44b8ab8d5ac79c53215fa"><enum>4.</enum><header>Definitions</header>
			<subsection id="id25BEB79C04F2424B820BCFACC69F223C"><enum>(a)</enum><header>In
			 general</header><text>Unless otherwise specified, the terms used in this Act
			 have the meanings given the terms in section 9101 of the Elementary and
			 Secondary Education Act of 1965 (20 U.S.C. 7801).</text>
			</subsection><subsection id="idA799C81C65C945BCBA28CC7EC159110D"><enum>(b)</enum><header>Other
			 terms</header><text>In this Act:</text>
				<paragraph id="ID43f58c7546d34e17bae69dfb49846031"><enum>(1)</enum><header>Characteristics
			 of effective literacy strategies and instruction</header><text>The term
			 <term>characteristics of effective literacy strategies and instruction</term>
			 means—</text>
					<subparagraph id="ID9b1d54c00d3c45388f7bbc000ed464e3"><enum>(A)</enum><text>for children from
			 birth through kindergarten entry—</text>
						<clause id="ID300dfe89a6c540b5bb2ba45105339248"><enum>(i)</enum><text>providing high
			 quality professional development opportunities for early childhood educators,
			 teachers, and school leaders in—</text>
							<subclause id="id4FA7A13086064A65BF2BE959C14B0C52"><enum>(I)</enum><text>literacy
			 development;</text>
							</subclause><subclause id="id1B5505C2BD1F4FA186A4AAAEA9A70F36"><enum>(II)</enum><text>language
			 development;</text>
							</subclause><subclause id="id4933537F4271492A99F9FD33F7ACE46D"><enum>(III)</enum><text>English
			 language acquisition (as appropriate); and</text>
							</subclause><subclause id="id49FE6EE1C2A24F9B925298657B85270C"><enum>(IV)</enum><text>effective
			 language and literacy instruction and teaching strategies aligned to State
			 standards;</text>
							</subclause></clause><clause id="ID127e9330d5724bd3882bbd209b6a8aad"><enum>(ii)</enum><text>reading aloud to
			 children, engaging children in shared reading experiences, discussing reading
			 with children, and modeling age and developmentally appropriate reading
			 strategies;</text>
						</clause><clause id="ID9695d4f364b5421880092244612c096a"><enum>(iii)</enum><text>encouraging
			 children’s early attempts at communication, reading, writing, and drawing, and
			 talking about the meaning of the reading, writing, and drawing with
			 others;</text>
						</clause><clause id="ID1fa02546704743e2b5de8f2c1f0edb67"><enum>(iv)</enum><text>creating
			 conversation rich classrooms and using oral modeling techniques to build oral
			 language skills;</text>
						</clause><clause id="ID8b556f7eb92a4c72b3fc45f772cd90b3"><enum>(v)</enum><text>multiplying
			 opportunities for children to use language with peers and adults;</text>
						</clause><clause id="IDc8831ee8f6f14960bff8e148b2367e64"><enum>(vi)</enum><text>providing
			 strategic and explicit instruction in the identification of speech sounds,
			 letters, and letter-sound correspondence;</text>
						</clause><clause id="ID8c516c8f89c047f0a48419bff710e614"><enum>(vii)</enum><text>integrating
			 oral and written language;</text>
						</clause><clause id="IDad44953be63f4cd4b35498bae28df97f"><enum>(viii)</enum><text>stimulating
			 vocabulary development;</text>
						</clause><clause id="ID999032899af64310b5f434d4d64b8704"><enum>(ix)</enum><text>using
			 differentiated instructional approaches or teaching strategies,
			 including—</text>
							<subclause id="idAE9CF73D8C7D4642AE33A78B6F9438EB"><enum>(I)</enum><text>individual and
			 small group instruction or interactions; and</text>
							</subclause><subclause id="idFFFBC5104C6E4158B10736EB74DCD36C"><enum>(II)</enum><text>professional
			 development, curriculum development, and classroom instruction;</text>
							</subclause></clause><clause id="id6D89C2B2B66C44FE85CB67A6ED65DD28"><enum>(x)</enum><text>applying the
			 principles of universal design for learning;</text>
						</clause><clause id="ID41148c4d0df3446a897f697e3e543cfb"><enum>(xi)</enum><text>using
			 age-appropriate screening assessments, diagnostic assessments, formative
			 assessments, and summative assessments to identify individual learning needs,
			 to inform instruction, and to monitor—</text>
							<subclause id="id0D19452507D04FD7B2E532DBDCEB299D"><enum>(I)</enum><text>student progress
			 and the effects of instruction over time; and</text>
							</subclause><subclause id="id3BB7D09B66584D7592DB7E9F8C91EB80"><enum>(II)</enum><text>for children
			 between the ages of birth and kindergarten entry, progress and development
			 within established norms;</text>
							</subclause></clause><clause id="ID73ac30498f2f4b8e88f16d740c1c71a0"><enum>(xii)</enum><text>coordinating
			 the involvement of families, early childhood education program staff,
			 principals, other school leaders, and teachers in the reading and writing
			 achievement of children served under this Act;</text>
						</clause><clause id="IDcb2e7d1c889749bfb0aa6840b2ed3e43"><enum>(xiii)</enum><text>using a
			 variety of age and developmentally appropriate, high quality materials for
			 language development, reading, and writing;</text>
						</clause><clause id="ID9f5adf41b8bf4ce0b7adf721ccd280a3"><enum>(xiv)</enum><text>encouraging
			 family literacy experiences and practices, and educating teachers, public
			 librarians, and parents and other caregivers about literacy development and
			 child literacy development; and</text>
						</clause><clause id="id96A10A87419B41A89FE9376637E32904"><enum>(xv)</enum><text>using strategies
			 to enhance children's—</text>
							<subclause id="id41BC1B01FA5747AC987276AFDC5F1E03"><enum>(I)</enum><text>motivation to
			 communicate, read, and write; and</text>
							</subclause><subclause id="id8F6F7A7DD4DE4BA9A9B8D819A4A67DC4"><enum>(II)</enum><text>engagement in
			 self-directed learning;</text>
							</subclause></clause></subparagraph><subparagraph id="ID0a2d5749a6be41e3bb999ce420b82329"><enum>(B)</enum><text>for students in
			 kindergarten through grade 3—</text>
						<clause id="ID175b4cd935574cb5881c685b1907a133"><enum>(i)</enum><text>providing high
			 quality professional development opportunities, for teachers, literacy coaches,
			 literacy specialists, English as a second language specialists (as
			 appropriate), school librarians, and principals, on literacy development,
			 language development, English language acquisition, and effective literacy
			 instruction that—</text>
							<subclause id="id1B1ADF67C7D14E959BD99E87C8ADCF0D"><enum>(I)</enum><text>aligns to State
			 standards as well as local curricula and instructional assessments; and</text>
							</subclause><subclause id="idDFD6B70E5220436AB7EA5FD304F28B89"><enum>(II)</enum><text>addresses
			 literacy development opportunities across the curricula;</text>
							</subclause></clause><clause id="idAC9E344AC74A41B496E191F865AB6820"><enum>(ii)</enum><text>providing age
			 appropriate direct and explicit instruction;</text>
						</clause><clause id="IDc612f2f43dbc452599524d3481aa3702"><enum>(iii)</enum><text>providing
			 strategic, systematic, and explicit instruction in phonological awareness,
			 phonic decoding, vocabulary, reading fluency, and reading comprehension;</text>
						</clause><clause id="IDf68005ab4e27470d8d5926aa88f17d5c"><enum>(iv)</enum><text>making available
			 and using diverse texts at the reading, development, and interest level of
			 students;</text>
						</clause><clause id="IDf1a8d4f579d147bc87fa1ae97e943b89"><enum>(v)</enum><text>providing
			 multiple opportunities for students to write individually and collaboratively
			 with instruction and feedback;</text>
						</clause><clause id="IDbf342bbc95134693b0766e25d91d7be0"><enum>(vi)</enum><text>using
			 differentiated instructional approaches, including individual, small group, and
			 classroom-based instruction and discussion;</text>
						</clause><clause id="ID3001e493bb3346cfb1107103b47cd081"><enum>(vii)</enum><text>using oral
			 modeling techniques and opportunities for students to use language with the
			 students' peers and adults to build student language skills;</text>
						</clause><clause id="ID97cc52c3de35437893adb719d3eb5b08"><enum>(viii)</enum><text>providing time
			 and opportunities for systematic and intensive instruction, intervention, and
			 practice to supplement regular instruction, which can be provided inside and
			 outside the classroom as well as during and outside regular school
			 hours;</text>
						</clause><clause id="IDee7d6350ea9a46b2af616e0eef79e99f"><enum>(ix)</enum><text>providing
			 instruction in uses of print materials and technological resources for research
			 and for generating and presenting content and ideas;</text>
						</clause><clause id="ID37c9ab2f029f461e90dd8e5e6688d6e1"><enum>(x)</enum><text>using screening
			 assessments, diagnostic assessments, formative assessments, and summative
			 assessments to identify student learning needs, to inform instruction, and to
			 monitor student progress and the effects of instruction over time;</text>
						</clause><clause id="ID2eb6c070dd6b49ec901994a08283a02c"><enum>(xi)</enum><text>coordinating the
			 involvement of families, caregivers, teachers, principals, other school
			 leaders, and teacher literacy teams in the reading and writing achievement of
			 children served under this Act;</text>
						</clause><clause id="ID24277eba6491401687fd8c67e363fa43"><enum>(xii)</enum><text>encouraging
			 family literacy experiences and practices; and</text>
						</clause><clause id="id686F2845D49B4A2D90113D1883D06183"><enum>(xiii)</enum><text>using
			 strategies to enhance students'—</text>
							<subclause id="id3B296DAF0021408FA07B053A93712F13"><enum>(I)</enum><text>motivation to
			 read and write; and</text>
							</subclause><subclause id="idFF40D628D2644125BBAFDCDFC9855561"><enum>(II)</enum><text>engagement in
			 self-directed learning; and</text>
							</subclause></clause></subparagraph><subparagraph id="ID30bef73a812d4cd389b62aae801589bd"><enum>(C)</enum><text>for students in
			 grades 4 through 12—</text>
						<clause id="IDda10d88f3a54428080b91c675746c119"><enum>(i)</enum><text>providing high
			 quality professional development opportunities for teachers, literacy coaches,
			 literacy specialists, English as a second language specialists (as
			 appropriate), school librarians, and principals, including professional
			 development on literacy development, language development, and effective
			 literacy instruction embedded in schools and aligned to State standards;</text>
						</clause><clause id="ID9bb838f03a4647a2b246fa050b181286"><enum>(ii)</enum><text>providing direct
			 and explicit comprehension instruction;</text>
						</clause><clause id="ID1d156b3c5a9a422b9c2b02e0b05b98d3"><enum>(iii)</enum><text>providing
			 direct and explicit instruction that builds academic vocabulary and strategies
			 and knowledge of text structure for reading different kinds of texts within and
			 across core academic subjects;</text>
						</clause><clause id="ID74ad721b806143e6bedc6fa55f3e33d1"><enum>(iv)</enum><text>making available
			 and using diverse texts at the reading, development, and interest level of the
			 students;</text>
						</clause><clause id="ID2aa8b60428c242cc8853a1a2fb3740bf"><enum>(v)</enum><text>providing
			 multiple opportunities for students to write with clear purposes and critical
			 reasoning appropriate to the topic and purpose and with specific instruction
			 and feedback from teachers and peers;</text>
						</clause><clause id="IDc902a73f10654e6d868e0988fb184b51"><enum>(vi)</enum><text>using
			 differentiated instructional approaches;</text>
						</clause><clause id="ID78fe848e03054f1bacf500015a188bd4"><enum>(vii)</enum><text>using
			 strategies to enhance students’—</text>
							<subclause id="idD2968445E0224FA1A8C51A989D6B085C"><enum>(I)</enum><text>motivation to
			 read and write; and</text>
							</subclause><subclause id="idF0CC5DF2BC314F028CC8FCA00DC12487"><enum>(II)</enum><text>engagement in
			 self-directed learning;</text>
							</subclause></clause><clause id="IDee02f5088a1743d1b3480f2fbb6676c1"><enum>(viii)</enum><text>providing for
			 text-based learning across content areas;</text>
						</clause><clause id="IDf034016ae7204ee2b7e985fcef1c8616"><enum>(ix)</enum><text>providing
			 systematic, strategic, and individual and small group instruction, including
			 intensive supplemental intervention for students reading significantly below
			 grade level, which may be provided inside and outside the classroom as well as
			 during and outside regular school hours;</text>
						</clause><clause id="ID5663f55f2535404bb264285c2a0169ef"><enum>(x)</enum><text>providing
			 instruction in the uses of technology and multimedia resources for classroom
			 research and for generating and presenting content and ideas;</text>
						</clause><clause id="ID0cc9a75202d34912a20cd9e5ec1ff4ac"><enum>(xi)</enum><text>using screening
			 assessments, diagnostic assessments, formative assessments, and summative
			 assessments to identify learning needs, inform instruction, and monitor student
			 progress and the effects of instruction;</text>
						</clause><clause commented="no" id="IDd6fe8e01f7244e2b84c78f8f09f08079"><enum>(xii)</enum><text>coordinating
			 the involvement of families and caregivers, to the extent feasible and
			 appropriate as determined by the Secretary, to improve reading, writing, and
			 academic achievement; and</text>
						</clause><clause id="ID48d373d66eb74e2b82b08ffa38e6d7ba"><enum>(xiii)</enum><text>coordinating
			 the involvement of school librarians, teachers, principals, other school
			 leaders, teacher literacy teams, and English as a second language specialists
			 (as appropriate), that analyze student work and plan or deliver instruction
			 over time.</text>
						</clause></subparagraph></paragraph><paragraph id="id921E4A96F1E940D981885FCAECF94622"><enum>(2)</enum><header>Child</header><text>The
			 term <term>child</term> means an individual from the ages of birth through the
			 final year for which the State provides free public education.</text>
				</paragraph><paragraph id="IDb7dedb8eca7846b59fffc51af738914d"><enum>(3)</enum><header>Classroom-based
			 instructional assessment</header><text>The term <term>classroom-based
			 instructional assessment</term> means an assessment, for children between birth
			 through grade 3, that—</text>
					<subparagraph id="IDd267acb015f34ae1a0a5d8ac27456a75"><enum>(A)</enum><text>is valid and
			 reliable for the age and population of children being assessed;</text>
					</subparagraph><subparagraph id="id76E437EB7EA04EB392DA7EA035023843"><enum>(B)</enum><text>is used to
			 evaluate children’s developmental progress and learning, including systematic
			 observations by teachers of children performing tasks, including academic and
			 literacy tasks, that are part of their daily classroom experience; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID2ce06ca64bc84326a883aad81fda6867"><enum>(C)</enum><text>is used to
			 improve classroom instruction.</text>
					</subparagraph></paragraph><paragraph id="IDf0312113b81a42dd9b4bc9400e8ecc9f"><enum>(4)</enum><header>Comprehensive
			 literacy instruction</header><text>The term <term>comprehensive literacy
			 instruction</term> means instruction that—</text>
					<subparagraph id="idC0DE7D1DA6A948348299BF6BF2D6581E"><enum>(A)</enum><text>involves the
			 characteristics of effective literacy instruction; and</text>
					</subparagraph><subparagraph id="idAE464EAB99DE47C9B7D3918EDD4F4750"><enum>(B)</enum><text>is designed to
			 support the essential components of reading instruction and the essential
			 components of writing instruction.</text>
					</subparagraph></paragraph><paragraph id="idEBA56E6F11864E13A52CF46A21C205C0"><enum>(5)</enum><header>Developmental
			 delay</header><text>The term <term>developmental delay</term> has the meaning
			 given the term in section 632 of the Individuals with Disabilities Education
			 Act (20 U.S.C. 1432).</text>
				</paragraph><paragraph id="ID222f6a0cc34d43c68b0d5a6712b69847"><enum>(6)</enum><header>Diagnostic
			 assessment</header><text>The term <term>diagnostic assessment</term> means an
			 assessment that—</text>
					<subparagraph id="ID2c642bb99b794925bc7545b85b3ccedb"><enum>(A)</enum><text>is valid,
			 reliable, and based on scientifically valid research on language, literacy, and
			 English language acquisition;</text>
					</subparagraph><subparagraph id="ID765c4e3c2ac6488ba1aa76f51cadfa4e"><enum>(B)</enum><text>is used for the
			 purposes of—</text>
						<clause id="ID2f06ed433ad8431a9d39cec1e5fdce5a"><enum>(i)</enum><text>identifying a
			 student’s specific areas of strengths and weaknesses in oral language and
			 literacy;</text>
						</clause><clause id="IDa86c43a1c101471b892127b598d24e2f"><enum>(ii)</enum><text>determining any
			 difficulties that the student may have in oral language and literacy and the
			 potential cause of such difficulties; and</text>
						</clause><clause id="IDca783c918d6149c68261f69681cfaac1"><enum>(iii)</enum><text>helping to
			 determine possible literacy intervention strategies and related special needs
			 of the student; and</text>
						</clause></subparagraph><subparagraph id="IDd6b6d7cf306446519cf5e44b05276cfa"><enum>(C)</enum><text>in the case of
			 young children, is conducted after a screening assessment that identifies
			 potential risks or a lack of school preparedness, including oral language and
			 literacy development, or delayed development.</text>
					</subparagraph></paragraph><paragraph id="ID1c0e4051564f49ae8cd6f2449b8748ca"><enum>(7)</enum><header>Eligible
			 entity</header><text>The term <term>eligible entity</term> means—</text>
					<subparagraph id="id7768370DEFD84047B3ADC53341B62C71"><enum>(A)</enum><text>when used with
			 respect to children from birth through kindergarten entry—</text>
						<clause id="idFE411FAB61BE4649B8538D788C536DCB"><enum>(i)</enum><text>1
			 or more local educational agencies providing early childhood education
			 programs, or 1 or more public or private early childhood education programs,
			 serving children from birth through kindergarten entry (such as a Head Start
			 program, a child care program, a State-funded prekindergarten program, a public
			 library program, or a family literacy program), that has a demonstrated record
			 of providing effective literacy instruction for the age group such agency or
			 program proposes to serve under section 9; or</text>
						</clause><clause id="id37CA11F132A94CEE8BF5AC8FB2842E87"><enum>(ii)</enum><text>1
			 or more entities described in clause (i) acting in partnership with 1 or more
			 public agencies or private nonprofit organizations that have a demonstrated
			 record of effectiveness—</text>
							<subclause id="ID945500543c7b418ba469b8feea82b580"><enum>(I)</enum><text>in improving the
			 early literacy development of children from birth through kindergarten entry;
			 and</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="ID4a99b85e6b8b496a8f3b62594871e8c6"><enum>(II)</enum><text>in providing
			 professional development aligned with the activities described in section
			 9(e)(1); or</text>
							</subclause></clause></subparagraph><subparagraph commented="no" id="ID38a988f3a03046a88cb7cd01d03372fb"><enum>(B)</enum><text>when used with
			 respect to students in kindergarten through grade 12, a local educational
			 agency, a consortium of local educational agencies, or a local educational
			 agency or consortium of local educational agencies that—</text>
						<clause commented="no" id="id9F0D3C296A3C4CC3836B9CB03E680FEE"><enum>(i)</enum><subclause commented="no" display-inline="yes-display-inline" id="id4A44D70AD12E43B5AD0C0853959ACA31"><enum>(I)</enum><text>is among, or consists
			 of, the local educational agencies in the State with the highest numbers or
			 percentages of students reading or writing below grade level, based on the most
			 currently available State assessment data;</text>
							</subclause><subclause commented="no" id="ID10bb50d02a0a4ec5ac351cd903e33772" indent="up1"><enum>(II)</enum><text>has jurisdiction over a significant
			 number or percentage of schools that are identified for school improvement
			 under section 1116(b) of the Elementary and Secondary Education Act of 1965 (20
			 U.S.C. 6316(b)); or</text>
							</subclause><subclause commented="no" id="ID55951605bf8f4e59b8a854f8c9285595" indent="up1"><enum>(III)</enum><text>has the highest numbers or percentages
			 of children who are counted under section 1124(c) of such Act (20 U.S.C.
			 6333(c)), in comparison to other local educational agencies in the State;
			 and</text>
							</subclause></clause><clause commented="no" id="id67E45B30EB2E43D899DF90D2DCAFE13D"><enum>(ii)</enum><text>may act in
			 partnership with 1 or more public agencies or private nonprofit organizations,
			 which agencies or organizations shall have a demonstrated record of
			 effectiveness, consistent with the purposes of their participation, in
			 improving literacy achievement of students from kindergarten through grade 12
			 and in providing professional development described in section
			 10(a)(3)(B).</text>
						</clause></subparagraph></paragraph><paragraph id="ID713a4ddec8bc410aa4ab542bbbb7e820"><enum>(8)</enum><header>English
			 language acquisition</header>
					<subparagraph id="id8F97B2AB1CFC45238EDB3C208B34756D"><enum>(A)</enum><header>In
			 general</header><text>The term <term>English language acquisition</term> means
			 the process by which a non-native English speaker acquires proficiency in
			 speaking, listening, reading, and writing the English language.</text>
					</subparagraph><subparagraph id="idB29DB56CD57147408DF3FD802A62BDCE"><enum>(B)</enum><header>Inclusions for
			 English language learners in school</header><text>For an English language
			 learner in school, such term includes not only the social language proficiency
			 needed to participate in the school environment, but also the academic language
			 proficiency needed to acquire literacy and academic content and demonstrate the
			 student's learning.</text>
					</subparagraph></paragraph><paragraph id="IDa24dc657162846ec9946c07483549f07"><enum>(9)</enum><header>Essential
			 components of reading instruction</header><text>The term <term>essential
			 components of reading instruction</term> means developmentally appropriate,
			 contextually explicit, systematic instruction, and frequent practice, in
			 reading across content areas.</text>
				</paragraph><paragraph id="ID8e24c5f478ab443aad899b80f5fa463d"><enum>(10)</enum><header>Essential
			 components of writing instruction</header><text>The term <term>essential
			 components of writing instruction</term> means developmentally appropriate and
			 contextually explicit instruction, and frequent practice, in writing across
			 content areas.</text>
				</paragraph><paragraph id="id3FE71C1A29A64E1EB9F3DD5668C0E10D"><enum>(11)</enum><header>Family
			 literacy services</header><text>The term <term>family literacy services</term>
			 means literacy services provided on a voluntary basis that are of sufficient
			 intensity in terms of hours and duration and that integrate all of the
			 following activities:</text>
					<subparagraph id="idF5D4804B7CD74973BF7EC5AE85843ABC"><enum>(A)</enum><text>Interactive
			 literacy activities between or among parents and their children, including
			 parent literacy training.</text>
					</subparagraph><subparagraph id="idE27B695BA2B54C02BBBBBBF6F36A4E77"><enum>(B)</enum><text>Training for
			 parents regarding how to be the primary teacher for their children and full
			 partners in the education of their children.</text>
					</subparagraph></paragraph><paragraph id="ID015975986ac44c618772e6292856cbd8"><enum>(12)</enum><header>Formative
			 assessment</header><text>The term <term>formative assessment</term> means a
			 process that—</text>
					<subparagraph id="ID3eeeac75cca14a5bbc21493e3f5200b4"><enum>(A)</enum><text>is
			 teacher-generated or selected by teachers and students during instructional
			 learning;</text>
					</subparagraph><subparagraph id="IDab90f539015140729f8661b33a5cbbfe"><enum>(B)</enum><text>is embedded
			 within the learning activity and linked directly to the current unit of
			 instruction; and</text>
					</subparagraph><subparagraph id="IDe50fca02b2484e5882b384a11ea7fb7b"><enum>(C)</enum><text>provides feedback
			 to adjust ongoing teaching and learning to improve students’ achievement of
			 intended instructional outcomes.</text>
					</subparagraph></paragraph><paragraph id="ID5a5691dc8f9640f8b3b0a0c8eb987fd2"><enum>(13)</enum><header>High-quality
			 professional development</header><text>The term <term>high-quality professional
			 development</term> means professional development that—</text>
					<subparagraph id="idAFC287264ABA4DB283810667D6E1ECCD"><enum>(A)</enum><text>is job-embedded,
			 ongoing, and based on scientifically valid research;</text>
					</subparagraph><subparagraph id="IDe027064b3cf74e02b7fd97e79b67a821"><enum>(B)</enum><text>is sustained,
			 intensive, and classroom-focused, and is not limited in scope to a 1-day or
			 short-term workshop or conference;</text>
					</subparagraph><subparagraph id="ID5209a3866e8c48818885ecea29320b3e"><enum>(C)</enum><text>is designed to
			 increase the knowledge and expertise of teachers, early childhood educators and
			 administrators, principals, other school leaders, and other program staff in
			 applying—</text>
						<clause id="idE9E7CA20D04A4C178A1FF21C4F590C28"><enum>(i)</enum><text>the
			 characteristics of effective literacy instruction;</text>
						</clause><clause id="id56A528E498E74C52AFCCEFF72D48D964"><enum>(ii)</enum><text>the essential
			 components of reading instruction;</text>
						</clause><clause id="idD8704951C6FD487788CB6B16FB3E9CFF"><enum>(iii)</enum><text>the essential
			 components of writing instruction; and</text>
						</clause><clause id="id5E3AFD4809C4480CABF3605A191F169B"><enum>(iv)</enum><text>instructional
			 strategies and practices that are appropriate to the age, development, and
			 needs of children and improve student learning, including strategies and
			 practices consistent with the principles of universal design for
			 learning;</text>
						</clause></subparagraph><subparagraph id="ID4d2bbd026d7b49dd8c321b10b0c58c26"><enum>(D)</enum><text>includes and
			 supports teachers in effectively administering age appropriate and
			 developmentally appropriate assessments, and analyzing the results of such
			 assessments for the purposes of planning, monitoring, adapting, and improving
			 effective classroom instruction or teaching strategies to improve student
			 literacy;</text>
					</subparagraph><subparagraph id="ID7ce42b63022e4d9ab0f4785d09b6fec1"><enum>(E)</enum><text>for educators
			 working with students in kindergarten through grade 12—</text>
						<clause id="idF10CE2A4DABF49B4B7BA3D18DC9807D8"><enum>(i)</enum><text>supports the
			 characteristics of effective literacy instruction through core academic
			 subjects, and through career and technical education subjects where such career
			 and technical education subjects provide for the integration of core academic
			 subjects; and</text>
						</clause><clause id="ID4bb1282ae1384dc5a416fea5d609e537"><enum>(ii)</enum><text>includes
			 explicit instruction in discipline-specific thinking and how to read and
			 interpret discipline-specific text structures and features;</text>
						</clause></subparagraph><subparagraph id="id07EAF91AA3E14B968DD10FCDEADBFD15"><enum>(F)</enum><text>includes
			 instructional strategies utilizing one-to-one, small group, and classroom-based
			 instructional materials and approaches based on scientifically valid research
			 on literacy;</text>
					</subparagraph><subparagraph id="ID83972d21599240e2ab3260043e7af9cb"><enum>(G)</enum><text>provides ongoing
			 instructional literacy coaching—</text>
						<clause id="id380CBF7C2826428B8049E0880A4F0129"><enum>(i)</enum><text>to
			 ensure high-quality implementation of effective practices of literacy
			 instruction that are content-centered, integrated across the curricula,
			 collaborative, and embedded in the school, classroom, or other setting;
			 and</text>
						</clause><clause id="id89051CAB46404447803EA61EC8EF1C90"><enum>(ii)</enum><text>that uses
			 student data to improve instruction;</text>
						</clause></subparagraph><subparagraph id="ID21367685550441aead24cc0f32b499b3"><enum>(H)</enum><text>includes and
			 supports teachers in setting high reading and writing achievement goals for all
			 students and provides the teachers with the instructional tools and skills to
			 help students reach such goals; and</text>
					</subparagraph><subparagraph id="id4495BE14C026454BA4B03B4FB57250C4"><enum>(I)</enum><text>is differentiated
			 for educators working with children from birth through kindergarten entry,
			 students in kindergarten through grade 5, and students in grades 6 through 12,
			 and, as appropriate, by student grade or student need.</text>
					</subparagraph></paragraph><paragraph id="IDc05e5c9f1c944bd79ccab71b5c33e541"><enum>(14)</enum><header>Literacy
			 coach</header><text>The term <term>literacy coach</term> means a
			 professional—</text>
					<subparagraph id="IDf0ac240a858448e0bca33477ed25aec2"><enum>(A)</enum><text>who—</text>
						<clause id="IDe4a81af62e024d99ae71bd74ddde5e8a"><enum>(i)</enum><text>has
			 previous teaching experience and—</text>
							<subclause id="id04A272BF992B42C7A4B6901A454CC666"><enum>(I)</enum><text>a master’s degree
			 with a concentration in reading and writing education;</text>
							</subclause><subclause id="idF4D5DF8D91D043A18489019E251E343B"><enum>(II)</enum><text>demonstrated
			 proficiency in teaching reading or writing in a core academic subject
			 consistent with the characteristics of effective literacy instruction;
			 or</text>
							</subclause><subclause id="id67BA84C23C2A40508368E8343281955A"><enum>(III)</enum><text>in the case of
			 a literacy coach for children from birth through kindergarten entry, a
			 concentration, credential, or significant experience in child development and
			 early literacy development; and</text>
							</subclause></clause><clause id="IDe8f1ae3d047d43bab907457ee871aa27"><enum>(ii)</enum><text>is
			 able to demonstrate the ability to help teachers—</text>
							<subclause id="ID6d2116bdbb9c4193a9943ed976bcab2a"><enum>(I)</enum><text>apply research on
			 how students become successful readers, writers, and communicators;</text>
							</subclause><subclause id="IDcfa9c37471b0422f9191958f03168ad9"><enum>(II)</enum><text>apply multiple
			 forms of assessment to guide instructional decisionmaking and use data to
			 improve literacy instruction;</text>
							</subclause><subclause id="IDcb814b7741194146a73f5c881f9fdccf"><enum>(III)</enum><text>improve student
			 writing and reading in and across content areas such as mathematics, science,
			 social studies, and language arts;</text>
							</subclause><subclause id="ID5f29f165a26d47139e88f9dc731a6cc5"><enum>(IV)</enum><text>develop and
			 implement differentiated instruction and teaching approaches to serve the needs
			 of the full range of learners, including English language learners and children
			 with disabilities;</text>
							</subclause><subclause id="id091FCD67AE924DD393FE9EB7226ACCB6"><enum>(V)</enum><text>apply principles
			 of universal design for learning;</text>
							</subclause><subclause id="ID3c10b242c8e54a04b00ee15f65de5ff2"><enum>(VI)</enum><text>employ best
			 practices in engaging principals, early childhood educators and administrators,
			 teachers, and other professionals supporting literacy instruction to change
			 school cultures to better encourage and support literacy development and
			 achievement; and</text>
							</subclause><subclause id="IDac2450752a04426fa34c34ab22d348d6"><enum>(VII)</enum><item commented="no" display-inline="yes-display-inline" id="id03FB4E74EB1C402691FBF0F38C6F51B5"><enum>(aa)</enum><text>for children from
			 birth through kindergarten entry, set developmentally appropriate expectations
			 for language; and</text>
								</item><item id="idD244FB82E4214CB584FCBC2026CB0EB7" indent="up1"><enum>(bb)</enum><text>for all children, set literacy
			 development and high reading and writing achievement goals and select, acquire,
			 and use instructional tools and skills to help the children reach such goals;
			 and</text>
								</item></subclause></clause></subparagraph><subparagraph id="IDd3b119bfb0234b1699eb3e5da90cb662"><enum>(B)</enum><text>whose role with
			 teachers and professionals supporting literacy instruction is—</text>
						<clause id="ID466fb19500b542a58f6e162998b3098c"><enum>(i)</enum><text>to
			 provide high-quality professional development;</text>
						</clause><clause id="ID1775cd28414a431b8b5f085cf54cd64e"><enum>(ii)</enum><text>to
			 work cooperatively and collaboratively with principals, teachers, and other
			 professionals in employing strategies to help teachers identify and support
			 student language and literacy needs and teach literacy across content areas and
			 developmental domains; and</text>
						</clause><clause id="ID551554d062b442e6b1adc08a217947a0"><enum>(iii)</enum><text>to work
			 cooperatively and collaboratively with other professionals in employing
			 strategies to help teachers teach literacy across content areas so that the
			 teachers can meet the needs of all students, including children with
			 disabilities, English language learners, and students who are reading at or

			 agency</term>—</text>
					<subparagraph id="id9A37D5CF65D149C68C699A8BD255034B"><enum>(A)</enum><text>has the meaning
			 given the term in section 9101 of the Elementary and Secondary Education Act of
			 1965 (20 U.S.C. 7801); and</text>
					</subparagraph><subparagraph id="id83FD0FCCB1024B148B732D24F76AAE6A"><enum>(B)</enum><text>includes any
			 public charter school that constitutes a local educational agency under State
			 law.</text>
					</subparagraph></paragraph><paragraph id="ID040263f0308647bf98ec9c1b1840f470"><enum>(16)</enum><header>Multitier
			 system of support</header><text>The term <term>multitier system of
			 support</term> means a comprehensive system of differentiated supports that
			 includes evidence-based instruction, universal screening, progress monitoring,
			 formative assessments, summative assessments, research-based interventions
			 matched to student needs, and educational decisionmaking using academic
			 progress over time</text>
				</paragraph><paragraph id="ID913e872e10634a398cbd9bcc962c5f7f"><enum>(17)</enum><header>Reading</header><text>The
			 term <term>reading</term> means a complex system of deriving meaning from print
			 that requires, in ways that are developmentally, content, and contextually
			 appropriate, all of the following:</text>
					<subparagraph id="IDaed1dc49c49c493ba8d9bf45ef649a42"><enum>(A)</enum><header>Phonemes</header><text>The
			 skills and knowledge to understand how phonemes, or speech sounds, are
			 connected to print.</text>
					</subparagraph><subparagraph id="IDdfa2410841b44b5bbea8831b3cdf4943"><enum>(B)</enum><header>Accuracy,
			 fluency, and understanding</header><text>The ability to read accurately,
			 fluently, and with understanding.</text>
					</subparagraph><subparagraph id="IDaa3d63e40111486cbabf875c6c5266c4"><enum>(C)</enum><header>Reading
			 comprehension</header><text>The use of background knowledge and vocabulary to
			 make meaning from a text.</text>
					</subparagraph><subparagraph id="IDa8a9876d7fa64effa834082c6eddc5b1"><enum>(D)</enum><header>Active
			 strategies</header><text>The development and use of appropriate active
			 strategies to interpret and construct meaning from print.</text>
					</subparagraph><subparagraph id="ID0f2bfeb95dfb45fb8a4b1dfa0dc29529"><enum>(E)</enum><header>Engaged and
			 self-directed reader</header><text>The development and maintenance of an
			 engaged and self-directed reader.</text>
					</subparagraph></paragraph><paragraph id="ID00bd6fdcb0fa448abe2cbaf071bb61f3"><enum>(18)</enum><header>School
			 leader</header><text>The term <term>school leader</term> means an individual
			 who—</text>
					<subparagraph id="ID50395e0d777d420dba43052c42141009"><enum>(A)</enum><text>is an employee or
			 officer of a school; and</text>
					</subparagraph><subparagraph id="ID82421a16ae3d4067afd756e61993f55d"><enum>(B)</enum><text>is responsible
			 for—</text>
						<clause id="IDed0a4b9244844a58b98f8dfc6d50cb35"><enum>(i)</enum><text>the
			 school's performance; and</text>
						</clause><clause id="IDe5c2e674f4cf4aa18bdaa69330eeba69"><enum>(ii)</enum><text>the daily
			 instructional and managerial operations of the school.</text>
						</clause></subparagraph></paragraph><paragraph id="ID4c816e448a2e44b8b718d099b2d0aab8"><enum>(19)</enum><header>Scientifically
			 valid research</header><text>The term <term>scientifically valid
			 research</term> has the meaning given the term in section 200 of the Higher
			 Education Act of 1965 (20 U.S.C. 1021).</text>
				</paragraph><paragraph id="ID0de59e41c1fc431b9c40528f67510b41"><enum>(20)</enum><header>Screening
			 assessment</header><text>The term <term>screening assessment</term> means an
			 assessment that—</text>
					<subparagraph id="IDd938682b0e4448d48fcc03d543bed95d"><enum>(A)</enum><text>is valid,
			 reliable, and based on scientifically valid research on literacy and English
			 language acquisition; and</text>
					</subparagraph><subparagraph id="ID9a38920b039545bd93c75859d3f414e4"><enum>(B)</enum><text>is a procedure
			 designed as a first step in identifying children who may be at high risk for
			 delayed development or academic failure and in need of further diagnosis of the
			 children's need for special services or additional literacy instruction.</text>
					</subparagraph></paragraph><paragraph id="idAEEC5F09218B42A3A1B61372E84EE9EE"><enum>(21)</enum><header>State</header><text>The
			 term <term>State</term> has the meaning given the term in section 103 of the
			 Higher Education Act of 1965 (20 U.S.C. 1003).</text>
				</paragraph><paragraph id="ID3d806eb14abe47ab97b01ba5af5aede6"><enum>(22)</enum><header>State literacy
			 leadership team</header>
					<subparagraph id="idBAD2BA08879E4E1584FEE1AB169A81E4"><enum>(A)</enum><header>In
			 general</header><text>The term <term>State literacy leadership team</term>
			 means a team that—</text>
						<clause id="idFBDBAB8EB2BE44DE8C803B13ED9FB3C1"><enum>(i)</enum><text>is
			 appointed and coordinated by the State educational agency;</text>
						</clause><clause id="idED5E8C6FC9D84CCA9B10CFC42CADBA35"><enum>(ii)</enum><text>assumes the
			 responsibility to guide the development and implementation of a statewide,
			 comprehensive literacy plan;</text>
						</clause><clause id="id7D9F8BB01E4E4415BC0B446264875C84"><enum>(iii)</enum><text>is composed of
			 not less than 11 individuals;</text>
						</clause><clause id="ID67fe249f750644e8a3944d98e2daf2d6"><enum>(iv)</enum><text>shall
			 include—</text>
							<subclause id="ID658c3647f14b41788597ef3fc225be0b"><enum>(I)</enum><text>not less than 3
			 individuals who have literacy expertise in one of each of the areas of—</text>
								<item id="ID0b9d58cf7003430388fcad8cdf982aa7"><enum>(aa)</enum><text>birth through
			 school entry, such as the State Head Start collaboration director;</text>
								</item><item id="ID9e42357fcad0411ba974e034fa60c8d1"><enum>(bb)</enum><text>kindergarten
			 entry through grade 5; and</text>
								</item><item id="ID1e8e0720256c458e82bb03c91c69d0a9"><enum>(cc)</enum><text>grades 6 through
			 12;</text>
								</item></subclause><subclause id="ID8261da89f73046278aba633fb5e3df64"><enum>(II)</enum><text>a school
			 principal;</text>
							</subclause><subclause id="ID9014f78543e64f728e1557e28075a8ad"><enum>(III)</enum><text>a teacher with
			 literacy expertise or an administrator with special education and literacy
			 expertise;</text>
							</subclause><subclause id="ID8d50bb5ea1d847d39fc8881b608f578d"><enum>(IV)</enum><text>a teacher or
			 administrator with expertise in teaching the English language to English
			 language learners;</text>
							</subclause><subclause id="ID91170746af4a4acab957e4cb0ec46d6f"><enum>(V)</enum><text>a representative
			 from the State educational agency who oversees literacy initiatives; and</text>
							</subclause><subclause id="ID549ccf55d8b941eabbabd6be1afae1d1"><enum>(VI)</enum><text>a representative
			 from higher education who is actively involved in research, development, or
			 teacher preparation in literacy instruction and intervention based on
			 scientifically valid research; and</text>
							</subclause></clause><clause id="ID46aa3df6b9fc4cd0b53611a0af5bfd6e"><enum>(v)</enum><text>may
			 include—</text>
							<subclause id="idA322921A54B145DF9859EBDBBDBB5773"><enum>(I)</enum><text>a literacy
			 specialist serving in a school district within the State;</text>
							</subclause><subclause id="id6BC44E383CED4A00B9C338BE861E7AE5"><enum>(II)</enum><text>a literacy
			 coach;</text>
							</subclause><subclause id="id2E8A95A25C3942F1B44D0AB4CE9BEEDF"><enum>(III)</enum><text>a library media
			 specialist;</text>
							</subclause><subclause id="id06FF3F6F508D498288234B999C73FFFA"><enum>(IV)</enum><text>a representative
			 from the family literacy community;</text>
							</subclause><subclause id="id61FCDA87432C45FD98EF58CA26A3C517"><enum>(V)</enum><text>a representative
			 from a State agency serving children, with expertise in literacy
			 instruction;</text>
							</subclause><subclause id="id6A3A324AA53E4BF3855E5C33C706202C"><enum>(VI)</enum><text>a school
			 counselor;</text>
							</subclause><subclause id="id3E731A22C4CF4D6BB083735AB8F4E5A3"><enum>(VII)</enum><text>a teacher of a
			 core academic subject;</text>
							</subclause><subclause id="id0A6869DB6A4C412DB549104A6CA69DDA"><enum>(VIII)</enum><text>a special
			 education administrator;</text>
							</subclause><subclause id="idBF9E62A5E14F4A42A1304EE5542AFB65"><enum>(IX)</enum><text>a professor of a
			 4-year institution of higher education;</text>
							</subclause><subclause id="id443E57D494014FAF9494745FC9EB0E4D"><enum>(X)</enum><text>a parent;</text>
							</subclause><subclause id="id7BA9C4E41E484D22A82CBD731AA50996"><enum>(XI)</enum><text>a business
			 leader;</text>
							</subclause><subclause id="id54F21C3D664A4E87A15E756D3D0A94FE"><enum>(XII)</enum><text>a
			 representative from the Governor’s office;</text>
							</subclause><subclause id="id082BFE7931CE452CBBB7128BEC9671DE"><enum>(XIII)</enum><text>a
			 representative from the State board of education;</text>
							</subclause><subclause id="idE41EA0C0998543F39396143150F31D8B"><enum>(XIV)</enum><text>a
			 representative from the State legislature;</text>
							</subclause><subclause id="idC59FB44D9C424E3C81F9EDF318DB8658"><enum>(XV)</enum><text>a nonprofit and
			 community-based organization providing literacy instruction and support;
			 and</text>
							</subclause><subclause id="id0A2DA0CC283C470AAC4B1D3E2B04287F"><enum>(XVI)</enum><text>a
			 representative from a school district superintendent's office.</text>
							</subclause></clause></subparagraph><subparagraph id="ID8ff4f7d8a4254261847dae114a2a6a04"><enum>(B)</enum><header>Inclusion of a
			 preexisting partnership</header><text>If, before the date of enactment of this
			 Act, a State educational agency established a consortium, partnership, or any
			 other similar body that was considered a literacy partnership for purposes of
			 subpart 1 or 2 of part B of title I of the Elementary and Secondary Education
			 Act of 1965 (20 U.S.C. 6361 et seq., 6371 et seq.) and that includes the
			 individuals required under subparagraph (A)(iv), such consortium, partnership,
			 or body may be considered a State literacy leadership team for purposes of
			 subparagraph (A).</text>
					</subparagraph></paragraph><paragraph id="IDc89f36d0e26b46ceb893533ce68af6dc"><enum>(23)</enum><header>Summative
			 assessment</header><text>The term <term>summative assessment</term> means an
			 assessment that—</text>
					<subparagraph id="ID95200981a61440e1ab87944b9d87f58c"><enum>(A)</enum><text>is valid,
			 reliable, and based on scientifically valid research on literacy and English
			 language acquisition; and</text>
					</subparagraph><subparagraph id="ID55987e0b04ca4a26847639c265183be6"><enum>(B)</enum><text>measures—</text>
						<clause id="idEDE481DE66C941699904EC82C679B460"><enum>(i)</enum><text>for
			 children from birth through kindergarten entry, how the children have
			 progressed over time relative to developmental norms; and</text>
						</clause><clause id="id9F5E8E376A8F40F3991150A7747C7191"><enum>(ii)</enum><text>for students in
			 kindergarten through grade 12, what the students have learned over time,
			 relative to academic content standards.</text>
						</clause></subparagraph></paragraph><paragraph id="idACFF60A24A7B4C68AC919D18AF2929F4"><enum>(24)</enum><header>Universal
			 design for learning</header><text>The term <term>universal design for
			 learning</term> has the meaning given the term in section 103 of the Higher
			 Education Act of 1965 (20 U.S.C. 1003).</text>
				</paragraph><paragraph id="ID57c65622455245f083dc448a0c230bb2"><enum>(25)</enum><header>Writing</header><text>The
			 term <term>writing</term> means—</text>
					<subparagraph id="idEA899462F9A046389B56D80D413D1A7D"><enum>(A)</enum><text>composing meaning
			 in print or through other media, including technologies, to communicate and to
			 create new knowledge in ways appropriate to the context of the writing and the
			 literacy development stage of the writer;</text>
					</subparagraph><subparagraph id="IDd32fc7209ec548fbbf8109eee9c8bbcd"><enum>(B)</enum><text>composing ideas
			 individually and collaboratively in ways that are appropriate for a variety of
			 purposes, audiences, and occasions;</text>
					</subparagraph><subparagraph id="ID1e414191b3b54378bfc998d328a242be"><enum>(C)</enum><text>choosing
			 vocabulary, tone, genre, and conventions, such as spelling and punctuation,
			 suitable to the purpose, audience, and occasion; and</text>
					</subparagraph><subparagraph id="ID085cb9658a8541c698c94109a930a07e"><enum>(D)</enum><text>revising
			 compositions for clarity of ideas, coherence, logical development, and
			 precision of language use.</text>
					</subparagraph></paragraph></subsection></section><section id="ID01a17e6a07554689811650e372317258"><enum>5.</enum><header>Program
			 authorized</header>
			<subsection id="idE690EADFE9DF4C21B97953F51DC929F2"><enum>(a)</enum><header>In
			 general</header><text>The Secretary is authorized—</text>
				<paragraph id="id299ED823E03E4000AC54BD87A9384E8F"><enum>(1)</enum><text>to award State
			 planning grants in accordance with section 6; and</text>
				</paragraph><paragraph id="id32BDA5951B29432CBFF3EFDE4DAD7472"><enum>(2)</enum><text>to award State
			 implementation grants in accordance with section 7 to enable the State
			 educational agency to—</text>
					<subparagraph id="id70289EBEDB2C480B9F8D79A42CE5356E"><enum>(A)</enum><text>carry out the
			 State activities described in section 8;</text>
					</subparagraph><subparagraph id="id81EDF60343BA41B69EE74533A9D42A36"><enum>(B)</enum><text>award subgrants
			 to eligible entities in accordance with section 9; and</text>
					</subparagraph><subparagraph id="id19082F0FA374465BACF924E2E4833CCE"><enum>(C)</enum><text>award subgrants
			 to eligible entities in accordance with section 10.</text>
					</subparagraph></paragraph></subsection><subsection id="ID93944ac308854ebdb7a9e43cb0b8b90c"><enum>(b)</enum><header>Awards to State
			 educational agencies</header>
				<paragraph id="ID4449cf02c33745d08960785003746f31"><enum>(1)</enum><header>Amounts less
			 than $500,000,000</header><text>If the amount appropriated under section 14 for
			 a fiscal year is less than $500,000,000, then the Secretary shall—</text>
					<subparagraph id="ID9eb1946776a3496aad495d7d667b44b1"><enum>(A)</enum><text>reserve not more
			 than a total of 5 percent of such amount for the national evaluation,
			 dissemination of information, and technical assistance under section 11;</text>
					</subparagraph><subparagraph id="ID044c6e1b51a640f7b08b50ba226981b2"><enum>(B)</enum><text>reserve not more
			 than 5 percent to award planning grants, on a competitive basis, to State
			 educational agencies, in accordance with section 6; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id883B832AAD7149BA90C5E185120DCFA3"><enum>(C)</enum><text display-inline="yes-display-inline">use the amount not reserved under
			 subparagraphs (A) and (B) to make awards, on a competitive basis, to State
			 educational agencies serving States that have applications approved under
			 section 7 to enable the State educational agencies to carry out sections 7 and
			 8.</text>
					</subparagraph></paragraph><paragraph id="ID30780bf165f8475a99eb3c11175e5ee6"><enum>(2)</enum><header>Amounts equal
			 to or exceeding $500,000,000</header>
					<subparagraph id="idD44E3228A6514D76ACC5888F7706EC0C"><enum>(A)</enum><header>In
			 general</header><text>If the amount appropriated under section 14 for a fiscal
			 year equals or exceeds $500,000,000, then the Secretary shall—</text>
						<clause id="IDd4746d470b7644d1b2d35348dde78f18"><enum>(i)</enum><text>reserve a total
			 of 1 percent of such amount for—</text>
							<subclause id="IDc8dcc7939258407cbb7d291744f9025c"><enum>(I)</enum><text>allotments for
			 the United States Virgin Islands, Guam, American Samoa, and the Commonwealth of
			 the Northern Mariana Islands, to be distributed among such outlying areas on
			 the basis of their relative need, as determined by the Secretary in accordance
			 with the purposes of this Act; and</text>
							</subclause><subclause id="ID79e068a0ae20447f8f0e8e2f8d8beef7"><enum>(II)</enum><text>the Secretary of
			 the Interior for programs under sections 6, 7, 8, 9, and 10 in schools operated
			 or funded by the Bureau of Indian Education;</text>
							</subclause></clause><clause id="ID44706165bb674e4bbcf81d166dc568a3"><enum>(ii)</enum><text>reserve not more
			 than 5 percent to award planning grants, to State educational agencies serving
			 States, in accordance with section 6;</text>
						</clause><clause id="IDda4e2deb553a4d09bfd73ff8d80f156a"><enum>(iii)</enum><text>reserve not
			 more than 5 percent for the national evaluation, dissemination of information,
			 and technical assistance under section 11; and</text>
						</clause><clause id="id8ADBA249AD8B4E7F97841A04DBA6A93A"><enum>(iv)</enum><text>use the amount
			 not reserved under clauses (i), (ii), and (iii) to make awards, from allotments
			 under subparagraph (C), to State educational agencies serving States that have
			 applications approved under section 7 and that are not receiving an allotment
			 under clause (i)(I), to enable the State educational agencies to carry out
			 sections 7 and 8.</text>
						</clause></subparagraph><subparagraph id="IDb546ff6b19f64104b9a76d741edef00c"><enum>(B)</enum><header>Special
			 rules</header>
						<clause id="id6BD88E94823C4B1C9F752FC32423E774"><enum>(i)</enum><header>Proportional
			 division</header><text>In each fiscal year, the amount reserved under
			 subparagraph (A)(i) shall be divided between the uses described in subclauses
			 (I) and (II) of subparagraph (A)(i) in the same proportion as the amount
			 reserved under section 1121(a) of the Elementary and Secondary Education Act of
			 1965 (20 U.S.C. 6331(a)) is divided between the uses described in paragraphs
			 (1) and (2) of such section 1121(a) for such fiscal year.</text>
						</clause><clause id="id8449A5B22DF94B51B180CC9DA47738A6"><enum>(ii)</enum><header>Consultation</header><text>A
			 State educational agency that receives an allotment under this paragraph shall
			 engage in timely and meaningful consultation with representatives of Indian
			 tribes located in the State in order to improve the coordination and quality of
			 activities designed to develop effective approaches to achieve the purposes of
			 this Act consistent with he cultural, language, and educational needs of Indian
			 students.</text>
						</clause></subparagraph><subparagraph id="IDc53de3b9efd04ab5b51e77ed98846ad2"><enum>(C)</enum><header>State allotment
			 formula</header><text>The Secretary shall allot the amount made available under
			 subparagraph (A)(iv) for a fiscal year among the States not receiving an
			 allotment from the reservation under subparagraph (A)(i)(I) in proportion to
			 the number of children, from birth through age 17, who reside within the State
			 and are from families with incomes below the poverty line for the most recent
			 fiscal year for which satisfactory data are available, compared to the number
			 of such children who reside in all such States for that fiscal year.</text>
					</subparagraph></paragraph><paragraph id="ID3a7791a990b944b18aa637744b36f950"><enum>(3)</enum><header>Minimum award
			 amount</header><text>Notwithstanding paragraphs (1) and (2), no State
			 educational agency receiving an award under this section for a fiscal year may
			 receive less than one-fourth of 1 percent of the total amount appropriated
			 under section 14 for the fiscal year, except as provided under paragraph
			 (2)(A)(i).</text>
				</paragraph></subsection><subsection id="ID98dd9fa86dbb4f888fb95b3db31ec8c6"><enum>(c)</enum><header>Peer
			 review</header>
				<paragraph id="ID1ad9ca038853436c9f998e2e615ffc20"><enum>(1)</enum><header>In
			 general</header><text>The Secretary shall convene a peer review panel to
			 evaluate the application for each grant awarded to a State educational agency
			 under sections 6 and 7 using the evaluation criteria described in paragraph
			 (2).</text>
				</paragraph><paragraph id="ID17de25b8b8ed4bc289eb4f13f48bfaa7"><enum>(2)</enum><header>Development of
			 evaluation criteria</header><text>The Secretary shall report to Congress the
			 peer review process and evaluation criteria that shall be used to evaluate the
			 grant applications under sections 6 and 7.</text>
				</paragraph><paragraph id="IDc6a685d677b648d1a0771ffa8eeffbe6"><enum>(3)</enum><header>Membership</header>
					<subparagraph id="ID8945ce4ac9294bd98ba89174154a2b8b"><enum>(A)</enum><header>Composition</header><text>A
			 peer review panel convened under paragraph (1) shall be composed of not less
			 than 9 members, of whom—</text>
						<clause id="ID1e2efce8232945b4a0698a9360a5f491"><enum>(i)</enum><text>3
			 shall be appointed by the Secretary;</text>
						</clause><clause id="ID7691b94f2e7945dda2ccb3f9ada34b8e"><enum>(ii)</enum><text>3
			 shall be appointed by the Secretary from among individuals—</text>
							<subclause id="idBB3328C29C434094A4B91EBC39CD85E9"><enum>(I)</enum><text>recommended by
			 the Chairman of the National Research Council of the National Academy of
			 Sciences; and</text>
							</subclause><subclause id="id017C82F6DC0E4D909A834EF1B030E32D"><enum>(II)</enum><text>with expertise
			 in literacy instruction and learning at various developmental stages;
			 and</text>
							</subclause></clause><clause id="ID9331be97f986488eb5bf0ae4d0e3c568"><enum>(iii)</enum><text>3
			 shall be appointed by the Secretary from among individuals—</text>
							<subclause id="id86CAF72CEBD3466CB32A5CAF53C52089"><enum>(I)</enum><text>recommended by
			 the Director of the National Institute of Child Health and Human Development;
			 and</text>
							</subclause><subclause id="id801284783EE34C54BFEAD1BCDE15F21A"><enum>(II)</enum><text>with expertise
			 concerning literacy development from birth through grade 12.</text>
							</subclause></clause></subparagraph><subparagraph id="ID0be9e4190e5c422aafb94915a9861c41"><enum>(B)</enum><header>Competency and
			 expertise; expertise</header><text>The peer review panel appointed under this
			 paragraph may include—</text>
						<clause id="IDfee3753efda94c1a909eb1695b926d7f"><enum>(i)</enum><text>classroom
			 teachers with expertise in literacy, and literacy coaches, including—</text>
							<subclause id="id5BD5382387B64E0A9FEF3899376B5889"><enum>(I)</enum><text>special education
			 teachers;</text>
							</subclause><subclause id="id5F29565C2DA94161A4586F3038C5D471"><enum>(II)</enum><text>teachers of
			 students who are English language learners; and</text>
							</subclause><subclause id="id2B5C8F5B20A545A38968250E2C32D11A"><enum>(III)</enum><text>early childhood
			 educators;</text>
							</subclause></clause><clause id="ID2ce99407a95f44b6813a5e407100f955"><enum>(ii)</enum><text>experts who
			 provide high-quality professional development to teachers and other individuals
			 to support children’s literacy development;</text>
						</clause><clause id="ID2fb3f7ae01ab4272a54c212f4703c90f"><enum>(iii)</enum><text>experts in the
			 screening assessment, diagnostic assessment, or other assessment of children’s
			 literacy (including reading and writing) development and progress; and</text>
						</clause><clause id="ID40a859876534454aa8584a80de44841b"><enum>(iv)</enum><text>experts in
			 strategies and instruction in reading and writing, language development, and
			 English language acquisition (as appropriate), including reading and writing in
			 core academic subjects.</text>
						</clause></subparagraph></paragraph><paragraph id="ID855c03b31535494e83a9eb3ebade30da"><enum>(4)</enum><header>Distribution of
			 recommendations</header><text>Not later than 120 days after a peer review panel
			 submits to the Secretary the panel's recommendation regarding an application by
			 a State educational agency for a grant under section 6 or 7, the Secretary
			 shall notify the State educational agency that the application has been
			 approved or disapproved and shall provide to such State educational agency a
			 copy of the peer review panel's recommendation.</text>
				</paragraph></subsection><subsection id="ID8f77880b89274df498c80a974ce32983"><enum>(d)</enum><header>Supplement not
			 supplant</header><text>Award funds provided under this Act shall supplement,
			 and not supplant, non-Federal funds that would, in the absence of such award
			 funds, be made available for literacy instruction and support of children and
			 students participating in programs assisted under this Act.</text>
			</subsection><subsection id="ID009ec1f2f2e14a8ba1e0b3bf428c48f2"><enum>(e)</enum><header>Maintenance of
			 effort</header><text>Each State educational agency that receives an award under
			 this section, and each eligible entity that receives a subgrant under section 9
			 or 10, shall maintain for the fiscal year for which the grant or subgrant is
			 received and for each subsequent fiscal year the expenditures of the State
			 educational agency or eligible entity, respectively, for literacy instruction
			 at a level not less than the level of such expenditures maintained by the State
			 educational agency or eligible entity, respectively, for the fiscal year
			 preceding such fiscal year for which the grant or subgrant is received.</text>
			</subsection></section><section id="ID43f67e3aa4d140f39b7b40bff64808be"><enum>6.</enum><header>State planning
			 grants</header>
			<subsection id="ID2da4d7624ac248729a9c6b8bce146f7c"><enum>(a)</enum><header>Planning grants
			 authorized</header>
				<paragraph id="ID2860958af82f4f6cbde3363daa512af8"><enum>(1)</enum><header>In
			 general</header><text>From any amounts made available under paragraph (1)(B) or
			 (2)(A)(ii) of section 5(b), the Secretary may award planning grants to State
			 educational agencies to enable the State educational agencies to complete
			 comprehensive planning to carry out activities that improve literacy for
			 children and students from birth through grade 12.</text>
				</paragraph><paragraph id="IDd41365e14b894c0e934a8ac4c83c1ceb"><enum>(2)</enum><header>Grant
			 period</header><text>A planning grant awarded under this section shall be for a
			 period of not more than 1 year.</text>
				</paragraph><paragraph id="IDce482fef1e7e4fbf91155454fc865344"><enum>(3)</enum><header>Nonrenewability</header><text>The
			 Secretary shall not award a State educational agency more than 1 planning grant
			 under this section.</text>
				</paragraph></subsection><subsection id="IDac372fe2a11747e59109a3768b1b026d"><enum>(b)</enum><header>Application</header>
				<paragraph id="ID8d5e72b6159347889a29bac778056328"><enum>(1)</enum><header>In
			 general</header><text>Each State educational agency desiring a planning grant
			 under this section shall submit an application to the Secretary at such time,
			 in such manner, and accompanied by such information as the Secretary may
			 require.</text>
				</paragraph><paragraph id="ID0ce918d5a1c846ce8a2323547ca304d5"><enum>(2)</enum><header>Contents</header><text>Each
			 application submitted under this subsection shall, at a minimum, include a
			 description of how the State educational agency proposes to use the planning
			 grant funds awarded under this section to develop a plan for improving State
			 efforts to develop, coordinate, and implement comprehensive literacy activities
			 that ensure high-quality language development and effective strategies and
			 instruction in reading and writing for all students in early childhood
			 education programs serving children from birth through kindergarten entry
			 through grade 12 programs, with a particular focus on students who are reading
			 or writing below grade level and children whose early literacy skills are below
			 the appropriate age or developmental level. Such plan for improvement
			 shall—</text>
					<subparagraph id="IDb3c64d7476354d458235aeba782d45e9"><enum>(A)</enum><text>describe the
			 activities for which assistance under this section is sought;</text>
					</subparagraph><subparagraph id="IDcee6f81ac8744be88a9c884261a1110d"><enum>(B)</enum><text>provide a budget
			 for the use of the planning grant funds to complete the required activities
			 described in subsection (c);</text>
					</subparagraph><subparagraph commented="no" id="ID2fabcf6d7fd4400dba7d5455cf8ab77d"><enum>(C)</enum><text>include an
			 assessment of child and student language and literacy data to identify baseline
			 and benchmark levels to monitor progress and improvement; and</text>
					</subparagraph><subparagraph commented="no" id="id2A67DA58BA5446C09D78479AF7302632"><enum>(D)</enum><text>provide an
			 assurance that all State agencies responsible for administering early childhood
			 education programs and services (including the State Head Start Collaboration
			 Office), including the State agency responsible for administering child care
			 and the State Advisory Council on Early Childhood Education and Care
			 established under section 642B(b) of the Head Start Act (42 U.S.C. 9837b(b)),
			 collaborated with the State educational agency to write the early learning
			 portion of the grant application submitted under this subsection.</text>
					</subparagraph></paragraph><paragraph id="idDD0D6F20EE8840A39BD800C8D7FE1F6A"><enum>(3)</enum><header>Approval of
			 applications</header>
					<subparagraph id="idD37D7F098B034B07A3742A5D75C9DEC9"><enum>(A)</enum><header>In
			 general</header><text>The Secretary, in consultation with the peer review panel
			 described in subparagraph (B), shall evaluate State educational agency
			 applications under this subsection based on the responsiveness of the
			 applications to the application requirements under this subsection.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5242CC8029DA415FBFC084CCF5063B86"><enum>(B)</enum><header>Peer
			 review</header><text>The Secretary shall convene a peer review panel in
			 accordance with section 5(c) to evaluate planning grant applications under this
			 section.</text>
					</subparagraph></paragraph></subsection><subsection id="IDb88e9ff360904a619cdcc463412f0cf2"><enum>(c)</enum><header>Required
			 activities</header><text>A State educational agency receiving planning grant
			 funds under this section shall carry out each of the following
			 activities:</text>
				<paragraph id="ID4da01998e1784b069d6404037c13fa6c"><enum>(1)</enum><header>Review</header><text>Reviewing
			 reading, writing, or other literacy resources and programs, such as school
			 library programs, and data across the State to identify any literacy needs and
			 gaps in the State.</text>
				</paragraph><paragraph id="ID813e3b26c0ee481ab8e07f6c2a4f7d53"><enum>(2)</enum><header>State literacy
			 leadership team</header><text>Forming or designating a State literacy
			 leadership team which shall execute the following functions:</text>
					<subparagraph id="IDe51eef5f2cf34a70aa3c5c6b83a63615"><enum>(A)</enum><header>Comprehensive
			 State literacy plan</header><text>Creating a comprehensive State literacy plan
			 that—</text>
						<clause id="idE52EFD9463024B968A17F10798CB9D8B"><enum>(i)</enum><text>is
			 designed to improve language, reading, writing, and academic achievement for
			 children and students, especially those reading below grade level;</text>
						</clause><clause id="id4FB39D1AF7F4442DBFC03AED220D7A39"><enum>(ii)</enum><text>includes a needs
			 assessment and an implementation plan, including an analysis of child and
			 student literacy data to identify baseline and benchmark levels of literacy and
			 early literacy skills in order to monitor progress and improvement, and a plan
			 to improve literacy levels among all children and students;</text>
						</clause><clause id="id471A3E28E4D64BB3A92AC36FA01225AB"><enum>(iii)</enum><text>ensures high
			 quality strategies and instruction in early literacy development (which
			 includes communication, reading, and writing) in early childhood education
			 programs serving children from birth through kindergarten entry and in
			 kindergarten through grade 12 programs;</text>
						</clause><clause id="id50612FDE94E741F3BA5A099538C2BA80"><enum>(iv)</enum><text>provides for
			 activities designed to improve literacy achievement for students who—</text>
							<subclause id="id16A9DA0C23C34D4EAB9606C29DC07E1B"><enum>(I)</enum><text>read or write
			 below grade level;</text>
							</subclause><subclause id="id5AE3C2DC3E5C468EBD53625599CCE670"><enum>(II)</enum><text>attend schools
			 that are identified for school improvement under section 1116(b) of the
			 Elementary and Secondary Education Act of 1965 (20 U.S.C. 6316(b)); and</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="id36A9C0CEBEDD4F2AB6914AEEDF789705"><enum>(III)</enum><text>are counted
			 under section 1124(c) of the Elementary and Secondary Education Act of 1965 (20
			 U.S.C. 6333(c)); and</text>
							</subclause></clause><clause id="id78CAFEDE39D842EEB152CAE2C3C192CC"><enum>(v)</enum><text>is
			 submitted to the Secretary.</text>
						</clause></subparagraph><subparagraph id="IDe148b1c0bf654ed280810ba45d0918b8"><enum>(B)</enum><header>Standards</header><text>Providing
			 recommendations to guide the State educational agency in the State educational
			 agency's process of strengthening State literacy standards and embedding State
			 literacy standards with the State’s challenging academic content standards and
			 academic achievement standards under section 1111(b) of the Elementary and
			 Secondary Education Act of 1965, and early learning and development
			 standards.</text>
					</subparagraph><subparagraph id="IDd5c112e305504401bc87670e0b129201"><enum>(C)</enum><header>Progress</header><text>Providing
			 recommendations to guide the State educational agency in the State educational
			 agency's process of measuring, assessing, and monitoring progress in literacy
			 at the school, local educational agency, and State levels.</text>
					</subparagraph><subparagraph id="ID35fc035cb83a4487a07c8d7397b742b8"><enum>(D)</enum><header>Criteria</header><text>Identifying
			 criteria for high quality professional development providers, which providers
			 may include qualified teachers within the State, for the State educational
			 agency and local educational agencies.</text>
					</subparagraph><subparagraph id="ID11159e10246a4d59be10fc8da70e00b2"><enum>(E)</enum><header>Data</header><text>Advising
			 the State educational agency on how to help ensure that local educational
			 agencies and schools provide timely and appropriate data to teachers to inform
			 and improve instruction.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID2cd2de189b784e9d904d6441a96b1d33"><enum>(F)</enum><header>Educator
			 capacity</header><text>Providing recommendations to guide the State educational
			 agency in the State educational agency's planning process of building
			 educators’ capacity to provide high-quality literacy instruction.</text>
					</subparagraph></paragraph><paragraph id="IDf025041fef624f309dffc5a39c148b31"><enum>(3)</enum><header>Reporting
			 requirement</header><text>Not later than 1 year after a State educational
			 agency receives a planning grant under this section, the State educational
			 agency shall submit a report to the Secretary on the State educational agency's
			 performance of the activities described in this subsection.</text>
				</paragraph></subsection></section><section id="ID82dbdcc6a0734fbbbbc3520207b46940"><enum>7.</enum><header>State
			 implementation grants</header>
			<subsection id="id203F8256111347909B623A96178A3CD2"><enum>(a)</enum><header>Implementation
			 grants authorized</header>
				<paragraph id="id33FFFB0F49AD4652958C6BC544226AF4"><enum>(1)</enum><header>In
			 general</header><text>From awards made available under paragraph (1)(C) or
			 (2)(A)(iv) of section 5(b), the Secretary shall, on a competitive basis or
			 through allotments, respectively, award implementation grants to State
			 educational agencies to enable the State educational agencies—</text>
					<subparagraph id="id7339141C67864738838BCCE4EEE225AB"><enum>(A)</enum><text>to implement a
			 comprehensive literacy plan that meets the criteria in section 6(c)(2)(A) for
			 early childhood education programs serving children from birth through
			 kindergarten entry through grade 12 programs;</text>
					</subparagraph><subparagraph id="idD7B501E342A44E51B64D4321F3B0111C"><enum>(B)</enum><text>to carry out
			 State activities under section 8; and</text>
					</subparagraph><subparagraph id="idB6E0CE8F9AA6440D90811C6509599D1C"><enum>(C)</enum><text>to award
			 subgrants under sections 9 and 10.</text>
					</subparagraph></paragraph><paragraph id="ID218b2d167ee74724a16c38cf77b046ce"><enum>(2)</enum><header>Duration of
			 grants</header><text>An implementation grant under this section shall be
			 awarded for a period of not more than 5 years.</text>
				</paragraph><paragraph id="ID233769b3b92f474ca327e42d5697eee7"><enum>(3)</enum><header>Renewals</header>
					<subparagraph id="IDb423586720e64f72bdab1502d7c4a805"><enum>(A)</enum><header>In
			 general</header><text>Implementation grants under this section may be
			 renewed.</text>
					</subparagraph><subparagraph id="ID83e9366590dd45fd9831668836cf2d45"><enum>(B)</enum><header>Conditions</header><text>In
			 order to be eligible to have an implementation grant renewed under this
			 paragraph, the State educational agency shall demonstrate to the satisfaction
			 of the Secretary that—</text>
						<clause id="id8786D18F2A80454BB5D6A32542ED1A8D"><enum>(i)</enum><text>the
			 State educational agency has complied with the terms of the grant, including
			 using the funds to—</text>
							<subclause id="ID32bf229cec1a417fb7a2136527e47382"><enum>(I)</enum><text>increase access
			 to high-quality professional development;</text>
							</subclause><subclause id="ID5eb700d608164b908a111d025f51c176"><enum>(II)</enum><text>use
			 developmentally appropriate curricula and teaching materials; and</text>
							</subclause><subclause id="IDbf65b96947664ac49f3ca806e4428cc5"><enum>(III)</enum><text>use
			 developmentally appropriate classroom-based instructional assessments and
			 developmentally appropriate screening and diagnostic assessments; and</text>
							</subclause></clause><clause id="id2C80BB1DAA31458FA2C102A25A81972B"><enum>(ii)</enum><text>with respect to
			 students in kindergarten through grade 12, during the period of the grant there
			 has been significant progress in student achievement, as measured by
			 appropriate assessments, including meeting the measurable annual objectives
			 established pursuant to section 1111(b)(2)(C)(v) of the Elementary and
			 Secondary Education Act of 1965 (20 U.S.C. 6311(b)(2)(C)(v)).</text>
						</clause></subparagraph></paragraph></subsection><subsection commented="no" id="IDfbf72a414ed94d3ab6e2785ffe7b03ff"><enum>(b)</enum><header>State
			 applications</header>
				<paragraph commented="no" id="ID0b325e053d8c4117886bc9cdc3690a84"><enum>(1)</enum><header>In
			 general</header><text>A State educational agency that desires to receive an
			 implementation grant under this section shall submit an application to the
			 Secretary at such time, in such manner, and containing such information as the
			 Secretary may require. The State educational agency shall collaborate with all
			 State agencies responsible for administering early childhood education
			 programs, and the State agency responsible for administering child care
			 programs, in the State in writing and implementing the early learning portion
			 of the grant application under this subsection.</text>
				</paragraph><paragraph commented="no" id="idB825FB8FB58A421796A5997768E51B35"><enum>(2)</enum><header>Contents</header><text>An
			 application described in paragraph (1) shall include the following:</text>
					<subparagraph commented="no" id="id6BB0EEBAF659441EB5804BEC36BD9175"><enum>(A)</enum><header>State literacy
			 leadership team; comprehensive State literacy leadership plan</header><text>A
			 description of the members of the State literacy leadership team and a
			 description of how the State educational agency has developed a comprehensive
			 State literacy plan, as described in section 6(c)(2)(A).</text>
					</subparagraph><subparagraph commented="no" id="ID0c37df5ae5304fe0b14ac6412d15f44d"><enum>(B)</enum><header>Implementation</header><text>An
			 implementation plan that includes a description of how the State educational
			 agency will—</text>
						<clause id="IDb2b970b78ebd4c63b06e1a2ebf49d962"><enum>(i)</enum><text>carry out the
			 State activities described in section 8;</text>
						</clause><clause commented="no" id="IDd5b10e082ac2496c957fd381af845807"><enum>(ii)</enum><text>assist eligible
			 entities with—</text>
							<subclause commented="no" id="IDbaea9beae73c497987e9cd1c3c01c01d"><enum>(I)</enum><text>providing
			 strategic and intensive literacy instruction based on scientifically valid
			 research for students who are reading and writing below grade level, including
			 through the use of multitier systems of support, including addressing the
			 literacy needs of children and youth with disabilities or developmental delays
			 and English language learners in early childhood education programs serving
			 children from birth through kindergarten entry and programs serving students
			 from birth through grade 12;</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="IDddc6031090a8459aa5f9a2b42beb9b9e"><enum>(II)</enum><text>providing
			 training to parents, as appropriate, so that the parents can participate in the
			 literacy related activities described in sections 9 and 10 to assist in the
			 language and literacy development of their children;</text>
							</subclause><subclause commented="no" id="id028B833EC20E406889814EAB844C1A73"><enum>(III)</enum><text>selecting and
			 using reading and writing assessments;</text>
							</subclause><subclause commented="no" id="id07429D46330B40EF929FEE3B19E26D28"><enum>(IV)</enum><text>providing
			 classroom-based instruction that is supported by one-to-one and small group
			 work;</text>
							</subclause><subclause commented="no" id="id0E945289C37F42EDB7EDE6F9862A0E8B"><enum>(V)</enum><text>using curricular
			 materials and instructional tools, which may include technology, to improve
			 instruction and literacy achievement;</text>
							</subclause><subclause commented="no" id="id498EFE8658344EE8B36D6085A9E7EFA6"><enum>(VI)</enum><text>providing for
			 high-quality professional development; and</text>
							</subclause><subclause id="IDcab88c5c76f7486598a87cca42ca04ec"><enum>(VII)</enum><text>using the
			 principles of universal design for learning; and</text>
							</subclause></clause><clause commented="no" id="IDdf88e2231d7247088c292f6d9a564af5"><enum>(iii)</enum><text>ensure that
			 local educational agencies in the State have leveraged and are effectively
			 leveraging the resources needed to implement effective literacy instruction,
			 and have the capacity to implement literacy initiatives effectively;</text>
						</clause><clause commented="no" id="IDbee1c98314554834a9620a057dd2397c"><enum>(iv)</enum><text>continually
			 coordinate and align the activities assisted under this section and sections 9
			 and 10 with reading, writing, and other literacy resources and programs across
			 the State and locally that serve children and students and their families and
			 promote literacy instruction and learning, including strengthening partnerships
			 among schools, libraries, local youth-serving agencies, and programs, in order
			 to improve literacy for all children and youth; and</text>
						</clause><clause commented="no" id="IDe75546268d0c4c748c68884975f1df90"><enum>(v)</enum><text>ensure that funds
			 provided under this section are awarded in a manner that will provide services
			 to all grade levels, including proportionally to middle schools and high
			 schools.</text>
						</clause></subparagraph><subparagraph commented="no" id="IDdfefbb41972b40359d57192a50cd059f"><enum>(C)</enum><header>Key data
			 metrics</header><text>A description of the key data metrics that will be used
			 and reported annually under section 12(b)(1)(E), which shall include progress
			 in meeting the annual objectives established pursuant to section
			 1111(b)(2)(C)(v) of the Elementary and Secondary Education Act of 1965 (20
			 U.S.C. 6311(b)(2)(C)(v)) for students in grades 3 through 12.</text>
					</subparagraph><subparagraph commented="no" id="IDd520ac09d8af464e9ff25839b2fceccb"><enum>(D)</enum><header>National
			 evaluation</header><text>An assurance that the State educational agency, and
			 any eligible entity receiving a subgrant from the State educational agency
			 under section 9 or 10, will, if requested, participate in the national
			 evaluation under section 11.</text>
					</subparagraph><subparagraph commented="no" id="ID7f90cfc27b634695b14f79fd3ae4ddb2"><enum>(E)</enum><header>Literacy
			 programs</header><text>An assurance that the State educational agency will use
			 implementation grant funds under this section for literacy programs as
			 follows:</text>
						<clause commented="no" id="IDfd9b7b35b30345569bcf59b1ff51f23f"><enum>(i)</enum><header>Learners from
			 birth through kindergarten entry</header><text>Not less than 10 percent of such
			 grant funds shall be used for State and local programs and activities
			 pertaining to learners from birth through kindergarten entry.</text>
						</clause><clause commented="no" id="ID87dd0818806e4e40985290a3dc4d006c"><enum>(ii)</enum><header>Students in
			 kindergarten through grade 5</header><text>Not less than 40 percent of such
			 implementation grant funds shall be used for State and local programs and
			 activities allocated equitably among the grades of kindergarten through grade
			 5.</text>
						</clause><clause commented="no" id="ID20012a61df924f088a621ade8174c51b"><enum>(iii)</enum><header>Students in
			 grades 6 through 12</header><text>Not less than 40 percent of such
			 implementation grant funds shall be used for State and local programs and
			 activities, allocated equitably among grades 6 through 12.</text>
						</clause><clause commented="no" id="ID27dec659a16a4a0f96a1d3f6f65d4142"><enum>(iv)</enum><header>State
			 activities</header><text>Not more than 10 percent of such implementation grant
			 funds shall be used for the State activities described in section 8.</text>
						</clause></subparagraph><subparagraph commented="no" id="IDe7c8c970c2634fa2a4256ef9b3db1983"><enum>(F)</enum><header>Priority</header><text>An
			 assurance that the State educational agency shall give priority to awarding a
			 subgrant to an eligible entity—</text>
						<clause commented="no" id="idB00393E055654F1DA8F030026A9E3EEF"><enum>(i)</enum><text>under section 9
			 based on the number or percentage of children younger than the age of
			 kindergarten entry and the number of students from birth through 17 who
			 are—</text>
							<subclause commented="no" id="id83E57A54EA2D4332B24969BF25690DC1"><enum>(I)</enum><text>served by the
			 eligible entity; and</text>
							</subclause><subclause commented="no" id="id411EE65D962D445289758C31D147548A"><enum>(II)</enum><text>from families
			 with income below the poverty line, based on the most recent satisfactory data
			 provided to the Secretary by the Bureau of the Census for determining
			 eligibility under section 1124(c)(1)(A) of the Elementary and Secondary
			 Education Act of 1965 (20 U.S.C. 6333(c)(1)(A)); and</text>
							</subclause></clause><clause commented="no" id="id8CA77A3DDD304B2A9411E198B8A1562C"><enum>(ii)</enum><text>under section 10
			 based on—</text>
							<subclause commented="no" id="id3F26B5F026434CF08F64AF32809BE42F"><enum>(I)</enum><text>the number or
			 percentage described in clause (i); and</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="IDd156686ba065487e8b361afc3feb870c"><enum>(II)</enum><text>the number or
			 percentage of students served by the eligible entity that are reading and
			 writing below grade level according to State assessments.</text>
							</subclause></clause></subparagraph></paragraph></subsection><subsection commented="no" id="ID027a63852a34459689d331730c1da379"><enum>(c)</enum><header>Approval of
			 applications</header>
				<paragraph commented="no" id="id9728BA5904724AEF89F37F5E9BCF50AD"><enum>(1)</enum><header>In
			 general</header><text>The Secretary, in consultation with the peer review panel
			 established under paragraph (2), shall evaluate State educational agency
			 applications under subsection (b) based on the responsiveness of the
			 applications to the application requirements under such subsection.</text>
				</paragraph><paragraph commented="no" id="id2399007F6E9147A0AAC1D10325F95AA6"><enum>(2)</enum><header>Peer
			 review</header><text>The Secretary shall convene a peer review panel in
			 accordance with section 5(c) to evaluate applications for each implementation
			 grant awarded to a State educational agency under this section.</text>
				</paragraph><paragraph id="ID1e1bbbbafe3c401db445c663e6aee24f"><enum>(3)</enum><header>Early
			 learning</header><text>In order for a State educational agency’s application
			 under this section to be approved by the Secretary, the application shall
			 contain an assurance that the State agencies responsible for administering
			 early childhood education programs and services, including the State agency
			 responsible for administering child care programs and the State Advisory
			 Council on Early Childhood Education and Care established under section 642B(b)
			 of the Head Start Act (42 U.S.C. 9837b(b)), approves of, and will be
			 extensively consulted in the implementation of related activities and services
			 consistent with section 9 with respect to, the early learning portion of the
			 application.</text>
				</paragraph></subsection></section><section id="IDe713a44fcb574a87926db54a4a7adaa0"><enum>8.</enum><header>State
			 activities</header>
			<subsection commented="no" id="IDb7a230607878434c91ede5591046f69c"><enum>(a)</enum><header>Required
			 activities</header><text>A State educational agency shall use funds made
			 available under section 5(a)(2)(A) and described in section 7(b)(2)(E)(iv) to
			 carry out the activities proposed in a State's plan consistent with section
			 7(b)(2), including the following activities:</text>
				<paragraph commented="no" id="id918765B8DC78464F95906C6464AFDA42"><enum>(1)</enum><header>Carrying out
			 assurances and activities in application</header><text>Carrying out the
			 assurances and activities provided in the State application under section
			 7(b)(2).</text>
				</paragraph><paragraph id="ID7ed04e65c39243379e0e63c6f57ff2eb"><enum>(2)</enum><header>Technical
			 assistance</header><text>In consultation with the State literacy leadership
			 team, providing technical assistance or engaging qualified providers to provide
			 technical assistance to eligible entities to enable the eligible entities to
			 design and implement a literacy program under sections 9 and 10.</text>
				</paragraph><paragraph id="ID366814f80e6a4164824b3af13165e3ed"><enum>(3)</enum><header>Preservice
			 coursework review</header><text>Continuing to consult with the State literacy
			 leadership team and continuing to coordinate with institutions of higher
			 education in the State—</text>
					<subparagraph id="idF0F4E4A5A8C7471992D1825DA15F157E"><enum>(A)</enum><text>in order to
			 provide recommendations to strengthen and enhance preservice courses for
			 students preparing, at institutions of higher education in the State, to teach
			 children from birth through grade 12 in explicit, systematic, and intensive
			 instruction in evidence-based literacy methods; and</text>
					</subparagraph><subparagraph id="id979EE986233B4AF7A3EB3345DFA91EA5"><enum>(B)</enum><text>by following up
			 reviews completed by the State literacy leadership team with recommendations to
			 ensure that such institutions offer courses that meet the highest
			 standards.</text>
					</subparagraph></paragraph><paragraph id="IDa39c1672db5b44ce8103e62100d2cb90"><enum>(4)</enum><header>State licensure
			 and certification recommendations</header><text>Reviewing and updating, in
			 collaboration with teachers, statewide educational and professional
			 organizations representing teachers, and statewide educational and professional
			 organizations representing institutions of higher education, State licensure
			 and certification standards in the area of literacy instruction in early
			 childhood education through grade 12.</text>
				</paragraph><paragraph id="IDff83b640424e4227ae714e2547b8c9c7"><enum>(5)</enum><header>Effective
			 practices</header><text>Making publicly available, including on the State
			 educational agency's website, information on promising instructional practices
			 to improve student literacy achievement.</text>
				</paragraph></subsection><subsection id="ID233f25abbd7341298bfb037e47782815"><enum>(b)</enum><header>Permissive
			 activities</header><text>After carrying out activities described in subsection
			 (a), a State educational agency may use remaining funds made available under
			 section 5(a)(2)(A) and described in section 7(b)(2)(E)(iv) to carry out 1 or
			 more of the following activities:</text>
				<paragraph id="ID6b593c8bd76e4e1bb0bdc323c2fc52c6"><enum>(1)</enum><header>Data systems
			 training</header><text>Training the personnel of eligible entities to use data
			 systems that track student literacy achievement.</text>
				</paragraph><paragraph id="ID2ad9649026924b6693015d68acecc8e3"><enum>(2)</enum><header>Literacy coach
			 training</header><text>Developing literacy coach training programs and training
			 literacy coaches.</text>
				</paragraph><paragraph id="IDd6c3735f348146f2bb21c8aeec22638b"><enum>(3)</enum><header>Public
			 support</header><text>Building public support among local educational agency
			 personnel, early childhood education programs, and the community for
			 comprehensive literacy instruction for children and students from birth through
			 grade 12.</text>
				</paragraph></subsection></section><section id="ID57311513679b4144b18a236897e0aaa7"><enum>9.</enum><header>Subgrants to
			 eligible entities in support of birth through kindergarten entry
			 literacy</header>
			<subsection id="ID6b9bb18b969f4e88a6a343532d2c38f5"><enum>(a)</enum><header>Subgrants</header><text>A
			 State educational agency, in consultation with the State agencies responsible
			 for administering early childhood education programs and services, including
			 the State agency responsible for administering child care programs and the
			 State Advisory Council on Early Childhood Education and Care established under
			 section 642B(b) of the Head Start Act (42 U.S.C. 9837b(b)), shall use
			 implementation grant funds provided under section 5(a)(2)(B) to award
			 subgrants, on a competitive basis, to eligible entities to enable the eligible
			 entities to support high-quality early literacy initiatives for children from
			 birth through kindergarten entry.</text>
			</subsection><subsection id="ID14c98ff8724e40b1b368ab3ae279e68c"><enum>(b)</enum><header>Sufficient size
			 and scope</header><text>Each subgrant awarded under this section shall be of
			 sufficient size and scope to allow the eligible entity to carry out
			 high-quality early literacy initiatives for children from birth through
			 kindergarten entry.</text>
			</subsection><subsection id="id723E7FED23474E13B38BC03F1F998D04"><enum>(c)</enum><header>Local
			 applications</header><text>An eligible entity desiring to receive a subgrant
			 under this section shall submit an application to the State educational agency,
			 at such time, in such manner, and containing such information as the State
			 educational agency may require. Such application shall include a description
			 of—</text>
				<paragraph id="id428D5AAA13774F01AED6BCB7205BBC63"><enum>(1)</enum><text>how the subgrant
			 funds will be used to enhance the language and literacy aspects of school
			 readiness of children, from birth through kindergarten entry, in early
			 childhood education programs, including an analysis of the data used to
			 identify how funds will be used to improve language and literacy;</text>
				</paragraph><paragraph id="ID351da7b147ac4bc795eb794166f867fb"><enum>(2)</enum><text>the programs
			 assisted under the subgrant, including demographic and socioeconomic
			 information on the children enrolled in the programs;</text>
				</paragraph><paragraph id="ID967bce2af58743fcb18bfd6950e2e369"><enum>(3)</enum><text>a budget for the
			 eligible entity that projects the cost of developing and implementing literacy
			 initiatives to carry out the activities described in subsection (e);</text>
				</paragraph><paragraph id="idC0329FED05294C359AF9B58ABA45B41B"><enum>(4)</enum><text>how, if the
			 eligible entity is requesting a planning period, the eligible entity will use
			 that planning period to prepare for successful implementation of a plan to
			 support the development of learning and literacy consistent with the purposes
			 of this Act;</text>
				</paragraph><paragraph id="id729D4EA1A05244018224AC38FC5AD427"><enum>(5)</enum><text>the literacy
			 initiatives, if any, in place and how these initiatives will be coordinated and
			 integrated with activities supported under this section;</text>
				</paragraph><paragraph id="ID15cff86283fc4b498ccb487b27145d5f"><enum>(6)</enum><text>how the subgrant
			 funds will be used to prepare and provide ongoing assistance to staff in the
			 programs, through high-quality professional development;</text>
				</paragraph><paragraph id="IDfa6230066b1346f2b7fbebd0877f331c"><enum>(7)</enum><text>how the subgrant
			 funds will be used to provide services, incorporate activities, and select and
			 use literacy instructional materials that meet the diverse developmental and
			 linguistic needs of children, including English language learners and children
			 with disabilities and developmental delays, and that are based on
			 scientifically valid research on child development and learning for children
			 from birth through kindergarten entry;</text>
				</paragraph><paragraph id="ID29c3116137f04de7a7b5bac2157b2096"><enum>(8)</enum><text>how the subgrant
			 funds will be used to provide screening assessments, diagnostic assessments,
			 classroom-based instructional assessments, and assessments of developmental
			 progress;</text>
				</paragraph><paragraph id="ID0e05265b8b694fdfb2129494d7706864"><enum>(9)</enum><text>how families and
			 caregivers will be involved, as appropriate, in supporting their children's
			 literacy development, instruction, and assessment;</text>
				</paragraph><paragraph id="ID34a3108762784209a4472c8643ac01f5"><enum>(10)</enum><text>how the subgrant
			 funds will be used to help children, particularly children experiencing
			 difficulty with oral and written language, to make the transition from early
			 childhood education to formal classroom instruction;</text>
				</paragraph><paragraph id="ID12f6dd50182b46a6b7ca6b9674f41f5a"><enum>(11)</enum><text>how the
			 activities assisted under the subgrant will be coordinated with literacy
			 instruction at the kindergarten through grade 5 level;</text>
				</paragraph><paragraph id="IDee96eebe343944058964fb6ae06770c8"><enum>(12)</enum><text>how the subgrant
			 funds will be used—</text>
					<subparagraph id="id193586E4D66F41419AAFBBDBC98E3C57"><enum>(A)</enum><text>to evaluate the
			 success of the activities assisted under the subgrant in enhancing the early
			 language and literacy development of children from birth through kindergarten
			 entry; and</text>
					</subparagraph><subparagraph id="id0E10E3E694604B579CC1B4C1AEF21211"><enum>(B)</enum><text>to evaluate data
			 for program improvement; and</text>
					</subparagraph></paragraph><paragraph id="ID05fc7267e4fa4808b76ba4b74b56dfac"><enum>(13)</enum><text>such other
			 information as the State educational agency may require.</text>
				</paragraph></subsection><subsection id="ID601e3fb2c37947c59ed915a7f6c903cc"><enum>(d)</enum><header>Approval of
			 local applications</header><text>The State educational agency, in consultation
			 with the State agencies responsible for administering early childhood education
			 programs, including the State agency responsible for administering child care
			 programs and the State Advisory Council on Early Childhood Education and Care
			 established under section 642B(b) of the Head Start Act (42 U.S.C. 9837b(b)),
			 shall—</text>
				<paragraph id="ID89e3d85134084eba894cfb77ad8ec578"><enum>(1)</enum><text>select
			 applications for funding under this section based on the quality of the
			 applications submitted, including the relationship between literacy activities
			 proposed and the research base or data supporting such activities, as
			 appropriate, and the recommendations of—</text>
					<subparagraph id="id0F69610FF4B24B32904E1F91AC490602"><enum>(A)</enum><text>the State
			 literacy leadership team; and</text>
					</subparagraph><subparagraph id="id546F64ECFC594C9A8E42DC062693D77D"><enum>(B)</enum><text>other experts in
			 the area of early literacy; and</text>
					</subparagraph></paragraph><paragraph id="ID092e53dd9e2c4a908a97540b93adff26"><enum>(2)</enum><text>place priority
			 for funding programs based on the criteria in section 7(b)(2)(F).</text>
				</paragraph></subsection><subsection id="ID8a5d29ff8e6e44ff9e632f9519d787d9"><enum>(e)</enum><header>Local uses of
			 funds</header>
				<paragraph id="idBCDA87199EC24AF5A7B8B6860860438D"><enum>(1)</enum><header>In
			 general</header><text>An eligible entity that receives a subgrant under this
			 section shall use the subgrant funds consistent with the application proposed
			 in subsection (c) to carry out the following activities:</text>
					<subparagraph id="ID091cd3ae9cbe4080b6fe49b6f24c34c5"><enum>(A)</enum><header>Early childhood
			 education programs</header><text>Enhancing and improving early childhood
			 education programs to ensure that children in such programs are provided with
			 high-quality oral language and literature- and print-rich environments in which
			 to develop early literacy skills.</text>
					</subparagraph><subparagraph id="IDe54c0ad046d446d396fa12939e57f58c"><enum>(B)</enum><header>Professional
			 development</header><text>Providing high-quality professional
			 development.</text>
					</subparagraph><subparagraph id="IDb78da4c71ca24cd3897d8f1cdb437e39"><enum>(C)</enum><header>Screening
			 assessments and other measures</header><text>Acquiring, providing training for,
			 and implementing screening assessments, diagnostic assessments, and
			 classroom-based instructional assessments.</text>
					</subparagraph><subparagraph id="ID2b73740f3aaa4b66a296bf8d85e3f32a"><enum>(D)</enum><header>Multitier
			 system of support</header><text>Selecting, developing, and implementing a
			 multitier system of support.</text>
					</subparagraph><subparagraph id="ID1f1be539d25244ef8357e843b2dc8e98"><enum>(E)</enum><header>Integrating</header><text>Integrating
			 research-based instructional materials, activities, tools, and measures into
			 the programs offered by the eligible entity to improve development of early
			 learning language and literacy skills.</text>
					</subparagraph><subparagraph id="id5D3B3C3C118A46ECA175C1AD5040D792"><enum>(F)</enum><header>Training</header><text>Training
			 providers and personnel to support, develop, and administer high-quality early
			 learning literacy initiatives that—</text>
						<clause id="id6896451E97084C78A2796A5805806D50"><enum>(i)</enum><text>utilize
			 data—</text>
							<subclause id="id5B27EDA935C64D67BD6F9430F06F980B"><enum>(I)</enum><text>to inform
			 instructional design; and</text>
							</subclause><subclause id="id1213DEA2DFED4415834B514347A657F2"><enum>(II)</enum><text>to assess
			 literacy needs; and</text>
							</subclause></clause><clause id="id9CE8DFF0C1764E4FA66E710632BD54B3"><enum>(ii)</enum><text>provide time and
			 support for personnel to meet to plan literacy instruction.</text>
						</clause></subparagraph><subparagraph id="ID2835c2b304114f22967e979106e71947"><enum>(G)</enum><header>Family literacy
			 services</header><text>Providing for family literacy services, as appropriate,
			 and partnering with families to support their child’s learning.</text>
					</subparagraph><subparagraph id="ID7f7793c167264568895ce7203e2b809a"><enum>(H)</enum><header>Data</header><text>Annually
			 collecting, summarizing, and reporting to the State educational agency
			 data—</text>
						<clause id="IDbb3134ab0b5944d2ac8e6b2713eac431"><enum>(i)</enum><text>to
			 document and monitor, for the purpose of improving or increasing early literacy
			 and language skills development pursuant to activities carried out under this
			 section;</text>
						</clause><clause id="IDa1b9abf9a7f446a09e86198da8d60c8d"><enum>(ii)</enum><text>to
			 stimulate and accelerate improvement by identifying the programs served by the
			 eligible entity that produce significant gains in skills development;
			 and</text>
						</clause><clause id="ID9289981b7f5b4f0d91e96973057d3c5a"><enum>(iii)</enum><text>for all
			 subgroups of students and categories of students, including students described
			 in section 1111(b)(2)(C)(v)(II) of the Elementary and Secondary Education Act
			 of 1965 (20 U.S.C. 6311(b)(2)(C)(v)(II)), in a manner that—</text>
							<subclause id="idEAB1DCCD59A944E4A7FD9D68CDE6EDB8"><enum>(I)</enum><text>utilizes a
			 variety of data; and</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="idF7FBF37F6E4A4BBCAAD9ED3CE1DC4820"><enum>(II)</enum><text>is consistent
			 across the State.</text>
							</subclause></clause></subparagraph></paragraph><paragraph id="IDdd27aad4d514408c97666ccac726ca78"><enum>(2)</enum><header>Curricula and
			 assessment materials limitation</header><text>Each eligible entity that
			 receives a subgrant under this section shall not use more than 10 percent of
			 the subgrant funds to purchase curricula and assessment materials.</text>
				</paragraph></subsection><subsection id="IDe638e45f771e44d4a57967720b5d3d9f"><enum>(f)</enum><header>Prohibition</header><text>The
			 use of assessment items and data on any assessment authorized under this
			 section to provide rewards or sanctions for individual children, early
			 childhood educators, teachers, program directors, or principals is
			 prohibited.</text>
			</subsection></section><section id="IDbcfdba5165d94ba5902a187d83fe28ff"><enum>10.</enum><header>Subgrants to
			 local educational agencies in support of kindergarten through grade 12
			 literacy</header>
			<subsection id="IDbe6f50fb63414ad282e82851c6e32ee0"><enum>(a)</enum><header>Subgrants to
			 local educational agencies</header>
				<paragraph id="ID79107bd34e494514ac25fd8cb42f5604"><enum>(1)</enum><header>Subgrants</header><text>A
			 State educational agency shall use the implementation grant funds provided
			 under section 5(a)(2)(C) to award subgrants, on a competitive basis, to
			 eligible entities to enable the eligible entities to carry out the authorized
			 activities described in subsections (b) and (c).</text>
				</paragraph><paragraph id="IDed5241ed2f6d432c891caae28390d5c7"><enum>(2)</enum><header>Sufficient size
			 and scope</header><text>A State educational agency shall award subgrants under
			 this section of sufficient size and scope to allow the eligible entities to
			 carry out high-quality literacy initiatives in each grade level for which the
			 subgrant funds are provided.</text>
				</paragraph><paragraph id="IDc04707ffbf3f4500bd97cd6b8fcd041a"><enum>(3)</enum><header>Local
			 applications</header><text>An eligible entity desiring to receive a subgrant
			 under this section shall submit an application to the State educational agency
			 at such time, in such manner, and containing such information as the State
			 educational agency may require. Such application shall include, for each school
			 that the eligible entity identifies as participating in a subgrant program
			 under this section, the following information:</text>
					<subparagraph id="ID9cc353904ded430ca2114c075a738178"><enum>(A)</enum><header>Capacity
			 survey</header><text>A description of the eligible entity’s capacity survey
			 conducted to identify how subgrant funds will be used to inform and improve
			 literacy instruction at the school.</text>
					</subparagraph><subparagraph id="ID2a77efe3d49f4f5b90c56cea0046838b"><enum>(B)</enum><header>Professional
			 development</header><text>How the school, local educational agency, or a
			 provider of high-quality professional development will provide ongoing
			 high-quality professional development to all teachers (including early
			 childhood educators), principals, and other school leaders served by the school
			 (including early childhood program administrators).</text>
					</subparagraph><subparagraph id="IDd33506c329304e028b29db49070eb280"><enum>(C)</enum><header>Interventions</header><text>How
			 the school will identify students in need of literacy interventions or other
			 support services and provide appropriate scientifically valid instructional
			 interventions or other support services which may include extended learning
			 time for struggling students.</text>
					</subparagraph><subparagraph id="ID7d713196413a4ad4a0c62c3d958c1919"><enum>(D)</enum><header>Budget</header><text>A
			 budget for the school that projects the cost of developing and implementing
			 literacy initiatives to carry out the activities described in subsections (b)
			 and (c), as applicable.</text>
					</subparagraph><subparagraph id="ID56d1b31395cb4facad076d331d158300"><enum>(E)</enum><header>Integration</header><text>An
			 explanation of how the school will integrate literacy instruction into core
			 academic subjects.</text>
					</subparagraph><subparagraph id="IDc3353b77c4cd45959ac3a7a359f26eb5"><enum>(F)</enum><header>Coordination</header><text>A
			 description of how the school will coordinate literacy instruction with early
			 childhood education and after-school programs and activities in the area served
			 by the local educational agency, such as library programs.</text>
					</subparagraph><subparagraph id="IDe53330edb8934d38a337ef486dc69020"><enum>(G)</enum><header>Assessments</header><text>A
			 description of the assessments that will be used in an assessment system to
			 improve literacy instruction and track student literacy progress.</text>
					</subparagraph><subparagraph id="ID147afa18cdff4337b2459a8c6a7a7f0b"><enum>(H)</enum><header>Families and
			 caregivers</header><text>A description of how families and caregivers will be
			 involved in supporting their children’s literacy instruction and
			 assessment.</text>
					</subparagraph><subparagraph id="ID8315145767b14f45a4e71f07dc9a77b0"><enum>(I)</enum><header>Planning
			 period</header><text>A description of how, if an eligible entity is requesting
			 a planning period, the eligible entity will use that planning period to prepare
			 for successful implementation of a plan to support the development of learning
			 and literacy consistent with the purposes of this Act.</text>
					</subparagraph><subparagraph id="ID37ab5ab26e5c4846a18780ac44d3559b"><enum>(J)</enum><header>Initiatives</header><text>A
			 description of the literacy initiatives, if any, in place and how these
			 initiatives will be coordinated and integrated with activities supported under
			 this section.</text>
					</subparagraph><subparagraph id="ID4df980e13fa14ce48adb36957eed3411"><enum>(K)</enum><header>Participation
			 in evaluation</header><text>An assurance that the eligible entity will, if
			 requested, participate in the national evaluation described in section
			 11.</text>
					</subparagraph></paragraph></subsection><subsection id="ID42506669a7934cea9d6817388a5cd354"><enum>(b)</enum><header>Local uses of
			 funds for kindergarten through grade 5</header><text>An eligible entity that
			 receives a subgrant under this section shall use the subgrant funds to carry
			 out the following activities pertaining to students in kindergarten through
			 grade 5:</text>
				<paragraph id="id474CDA07B3354CEFB9B0FDF1F5110E4D"><enum>(1)</enum><header>Literacy
			 plan</header><text>Developing and implementing a literacy plan across content
			 areas that—</text>
					<subparagraph id="id2CE2909DE50448F183CD67C7BEBD6156"><enum>(A)</enum><text>serves the needs
			 of all students, including children with disabilities and English language
			 learners, especially the students who are reading or writing below grade
			 level;</text>
					</subparagraph><subparagraph id="id8F975B0D0C664211B47C807915187967"><enum>(B)</enum><text>provides
			 intensive, supplemental, accelerated, and explicit intervention and support in
			 reading and writing for students whose literacy skills are below grade level;
			 and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id956BDCD3BFBF4DF5AE12D4194C629E77"><enum>(C)</enum><text>supports
			 activities that are provided primarily during the regular school day but which
			 may be augmented by after-school and out-of-school time instruction.</text>
					</subparagraph></paragraph><paragraph id="IDa9e836edac27467da4f73557cd745b33"><enum>(2)</enum><header>Assessments</header><text>Acquiring,
			 providing training for, selecting, and administering assessments, and managing,
			 monitoring, and planning instruction based on the assessment data.</text>
				</paragraph><paragraph id="ID001c5f2965a849668c0694886d026663"><enum>(3)</enum><header>Professional
			 development</header><text>Providing high quality professional
			 development.</text>
				</paragraph><paragraph id="IDb6c21085b2bb42659c92c85c7e38aa63"><enum>(4)</enum><header>Training</header><text>Training
			 principals, pupil services personnel, and other school district personnel to
			 support, develop, administer, and evaluate high-quality kindergarten through
			 grade 5 literacy initiatives that—</text>
					<subparagraph id="ID01f44636e33146e1ac2eaa79eb4d1ef9"><enum>(A)</enum><text>utilize
			 data—</text>
						<clause id="ID8119c00077f241a4a2f7c4db8c1ea11b"><enum>(i)</enum><text>to
			 inform instructional decisions; and</text>
						</clause><clause id="ID08e7299ea3f94a9780f304b514ef145c"><enum>(ii)</enum><text>to
			 assess professional development needs; and</text>
						</clause></subparagraph><subparagraph id="IDb6e30f4f5b2f46718289828dd392abb0"><enum>(B)</enum><text>provide time and
			 support for teachers to meet to plan literacy instruction.</text>
					</subparagraph></paragraph></subsection><subsection id="ID9f149ae0f9d84277a63db4be3b7c4968"><enum>(c)</enum><header>Local uses of
			 funds for grades 6 through 12</header>
				<paragraph id="ID56d90491e7c94d8ca7d242faffcddf93"><enum>(1)</enum><header>Required
			 uses</header><text>An eligible entity that receives a subgrant under this
			 section shall use subgrant funds to carry out the following activities
			 pertaining to students in grades 6 through 12:</text>
					<subparagraph id="ID8a834f61e1e940dbb2ecbba8867267ad"><enum>(A)</enum><header>Literacy
			 plan</header><text>Developing and implementing a literacy plan across content
			 areas that—</text>
						<clause id="idD2D86C0FB1E24D479773434E14A6F73C"><enum>(i)</enum><text>serves the needs
			 of all students, including children with disabilities and English language
			 learners, especially students who are reading or writing below grade
			 level;</text>
						</clause><clause id="id1922C206C68144F3AE8D456D5A87E4F1"><enum>(ii)</enum><text>provides
			 intensive, supplemental, accelerated, and explicit intervention and support in
			 reading and writing for students whose literacy skills are below grade level;
			 and</text>
						</clause><clause id="id69883EB3C37C4F18BBC99D577B48DF6E"><enum>(iii)</enum><text>supports
			 activities that are provided primarily during the regular school day but which
			 may be augmented by after-school and out-of-school time instruction.</text>
						</clause></subparagraph><subparagraph commented="no" id="idECA81D1F951B46C3B530857B83C268DB"><enum>(B)</enum><header>Assessments</header><text>Acquiring,
			 providing training for, selecting and administering assessments, and managing,
			 monitoring, and planning instruction based on the assessment data.</text>
					</subparagraph><subparagraph id="ID2ea6a4f9c79e4a6b996a13b6badbbe5e"><enum>(C)</enum><header>Professional
			 development</header><text>Providing high-quality professional
			 development.</text>
					</subparagraph><subparagraph id="IDef621a94d76946d8ac46ebc757b6fe61"><enum>(D)</enum><header>Training</header><text>Training
			 principals, pupil service personnel, and other school leaders to support,
			 develop, administer, and evaluate high-quality adolescent literacy initiatives
			 that—</text>
						<clause id="IDcea1c48f8e3846679b02b5b2de00c31b"><enum>(i)</enum><text>utilize
			 data—</text>
							<subclause id="ID91c106df8d2f41fa83d0bcbd9f341fdf"><enum>(I)</enum><text>to inform
			 instructional decisions and allow for personalization of instruction based on
			 student need; and</text>
							</subclause><subclause id="ID93c0b94a4ceb4d6f8e9a2075b9a80127"><enum>(II)</enum><text>to assess
			 professional development needs;</text>
							</subclause></clause><clause id="IDa034bc8adb4a43f182662500f86c357f"><enum>(ii)</enum><text>assess the
			 quality of adolescent literacy instruction in core academic subjects, and
			 career and technical education subjects where such career and technical
			 education subjects provide for the integration of core academic
			 subjects;</text>
						</clause><clause id="ID3241406caf534d2fa4ae8ab82d1f0fcb"><enum>(iii)</enum><text>provide time
			 for teachers to meet to plan research-based adolescent literacy instruction in
			 core academic subjects, and career and technical education subjects where such
			 career and technical education subjects provide for the integration of core
			 academic subjects; and</text>
						</clause><clause id="ID5d962909de3b483788a1587122de2fe9"><enum>(iv)</enum><text>include explicit
			 instruction in discipline-specific thinking and how to read and interpret
			 discipline-specific text structures and features.</text>
						</clause></subparagraph><subparagraph id="ID3d447e473f2d4d81af0e7f2e91390ba3"><enum>(E)</enum><header>Data</header><text>Annually
			 collecting, summarizing, and reporting to the State educational agency,
			 data—</text>
						<clause id="ID03a86b6e21844594a95db13870d3db4e"><enum>(i)</enum><text>to
			 document and monitor, for the purpose of improving practice, the improvements
			 or increases in student reading and writing pursuant to activities carried out
			 under this section;</text>
						</clause><clause id="IDeca24e6c28554f18951e3a87b4f9412b"><enum>(ii)</enum><text>to
			 stimulate and accelerate improvement by identifying the schools that produce
			 significant gains in literacy achievement; and</text>
						</clause><clause id="IDbcf89ce451004c02aeb7aa0f6c3a14f3"><enum>(iii)</enum><text>for all
			 students and categories of students, including students described in section
			 1111(b)(2)(C)(v)(II) of the Elementary and Secondary Education Act of 1965 (20
			 U.S.C. 6311(b)(2)(C)(v)(II)), in a manner that utilizes a variety of data and
			 that is consistent across the State.</text>
						</clause></subparagraph></paragraph><paragraph id="IDf41f80493dbe41cd8444a33819b9dffb"><enum>(2)</enum><header>Limitation to
			 certain schools</header><text>An eligible entity receiving a subgrant under
			 this section shall, in distributing subgrant funds under this subsection,
			 provide the subgrant funds only to schools, including public charter schools,
			 that have the highest percentages or numbers of children counted under section
			 1124(c) of the Elementary and Secondary Education Act of 1965 (20 U.S.C.
			 6333(c)) after carrying out the activities described in this subsection and
			 subsection (b).</text>
				</paragraph></subsection><subsection id="IDd410063865b84d93aab17bacb3311a3d"><enum>(d)</enum><header>Allowable
			 uses</header><text>An eligible entity that receives a subgrant under this
			 section may use remaining subgrant funds to carry out the following activities
			 pertaining to learners in kindergarten through grade 12:</text>
				<paragraph id="ID4c748974410a4c01aef0885a2cc3a3a1"><enum>(1)</enum><header>Planning</header><text>Providing
			 a planning period of not more than 1 year for the eligible entity to establish
			 the elements necessary for successful implementation of a literacy program for
			 kindergarten through grade 12.</text>
				</paragraph><paragraph id="IDa97db89e90ae44a69827afe19fe75638"><enum>(2)</enum><header>Literacy
			 coaches</header><text>Recruiting, placing, training, and compensating literacy
			 coaches.</text>
				</paragraph><paragraph id="id1A30D49E0D4045818D5E1EB352A8BD77"><enum>(3)</enum><header>Connecting
			 learning opportunities</header><text>Connecting out-of-school learning
			 opportunities to in-school learning in order to improve the literacy
			 achievement of the students.</text>
				</paragraph><paragraph id="ID9c8dc62a6a6d49a9a44b0202929989dc"><enum>(4)</enum><header>Training</header><text>Training
			 families and caregivers to support the improvement of adolescent
			 literacy.</text>
				</paragraph><paragraph id="IDf6c1503f706e4b75a3a25eae16d4a86b"><enum>(5)</enum><header>Multitier
			 system of support</header><text>Providing for a multitier system of
			 support.</text>
				</paragraph><paragraph id="ID1e1d217519114984b101457a3bcf7a81"><enum>(6)</enum><header>School literacy
			 leadership team</header><text>Forming a school literacy leadership team to help
			 implement, assess, and identify necessary changes to the literacy initiatives
			 in 1 or more schools to ensure success.</text>
				</paragraph><paragraph id="IDbdbd52a74ed24ff0a557f3f35f918f53"><enum>(7)</enum><header>Literacy-rich
			 environment</header><text>Providing high-quality, literacy-rich environments
			 that engage students with materials and experiences at the students' reading
			 and writing levels.</text>
				</paragraph><paragraph id="id01270618AC1C411AA89BDC5CC8D3FA1D"><enum>(8)</enum><header>Planning among
			 teachers and other staff</header><text>Providing time for teachers to meet with
			 school librarians and other building staff to plan literacy instruction, as
			 appropriate.</text>
				</paragraph></subsection></section><section id="ID0a97d5215def499494af582f6d19c39f"><enum>11.</enum><header>National
			 evaluation, information dissemination, and technical assistance</header>
			<subsection id="ID9d7eeead46f2460c91824d4ec5d4a2ee"><enum>(a)</enum><header>National
			 evaluation</header>
				<paragraph id="ID5b8468edcdcb408d800c5cb79293f263"><enum>(1)</enum><header>In
			 general</header><text>From funds reserved under paragraph (1)(A) or (2)(A)(iii)
			 of section 5(b), the Secretary shall enter into a contract with an organization
			 independent of the Department of Education for a 5-year national evaluation of
			 the grant and subgrant programs assisted under this Act. Such evaluation shall
			 include scientifically valid research that applies rigorous and systematic
			 procedures to obtain valid knowledge relevant to the implementation and effect
			 of the programs.</text>
				</paragraph><paragraph id="ID442987fbd6e7488a87c875589b33f582"><enum>(2)</enum><header>Contents of
			 evaluation</header><text>The evaluation described in this subsection shall
			 include an analysis of each of the following:</text>
					<subparagraph id="IDa55a94d55aae4960b506dc1c698d1f77"><enum>(A)</enum><header>Impact</header><text>The
			 impact of the implementation of literacy initiatives and practices supported
			 under this Act on promoting the appropriate development of young children in
			 the precursors to literacy and increasing student academic outcomes, including
			 student literacy development in reading and writing, and speaking (as
			 appropriate), grade promotion, and graduation to the extent predictable.</text>
					</subparagraph><subparagraph id="ID4ca96e8b666046b4aebdfbf6816f1706"><enum>(B)</enum><header>Implementation
			 of core features</header><text>The fidelity of implementation of core program
			 features, such as coherence of program across grades, quality of technical
			 assistance, State and school district leadership, professional development for
			 teachers and administrators, use of quality materials and pedagogy, and use of
			 assessment.</text>
					</subparagraph><subparagraph id="IDdf0ab8b16fa4467195808db00759dfb4"><enum>(C)</enum><header>Student
			 academic outcomes</header><text>The relationship between implementation of core
			 features, and student academic outcomes.</text>
					</subparagraph><subparagraph id="ID93295290bf3c46988e3ce065afe7e985"><enum>(D)</enum><header>Other
			 inquiries</header><text>Other inquiries as designated by the Secretary, such
			 as—</text>
						<clause id="ID3fda56eeb12d4e1e9f46130c2b436d0c"><enum>(i)</enum><text>the
			 core functions of literacy initiatives that have demonstrated the greatest
			 impact on student literacy achievement, especially among students reading below
			 grade level;</text>
						</clause><clause id="ID7048d3ae1c7b46e785c95fc0c43bb8af"><enum>(ii)</enum><text>effective
			 strategies to integrate State and local standards, curricula, assessments, and
			 interventions to improve literacy;</text>
						</clause><clause id="ID84505167142d4b55a126a34bbad45eb9"><enum>(iii)</enum><text>the types of
			 literacy activities and professional development that most effectively improve
			 the early reading, writing, and language skills of children from birth through
			 kindergarten entry;</text>
						</clause><clause id="ID4db3040f3af6457b80e690404afaf2fe"><enum>(iv)</enum><text>the impact of
			 adolescent literacy initiatives on student motivation, engagement, and
			 participation in adolescent literacy activities;</text>
						</clause><clause id="id56F1FF6799DE4283B25C6A0343450878"><enum>(v)</enum><text>the
			 relationship between students’ literacy achievement and secondary schools'
			 success, including improving graduation rates; and</text>
						</clause><clause id="id20B29FE9B76B43CD88498969B047A8B8"><enum>(vi)</enum><text>effective
			 strategies to integrate school and public library programs to improve
			 literacy.</text>
						</clause></subparagraph></paragraph><paragraph id="ID48812f8e8d4c467b8c21c6e26ea8671b"><enum>(3)</enum><header>Program
			 improvement</header><text>The findings of the evaluation conducted under this
			 subsection shall be—</text>
					<subparagraph id="id544D1ACEBF944F30B4C4DCCD9CE74BFE"><enum>(A)</enum><text>provided to State
			 educational agencies and grant recipients for use in program
			 improvement;</text>
					</subparagraph><subparagraph id="idF0671EA9B1C7454C8AAD9AAEE35F927A"><enum>(B)</enum><text>made publicly
			 available, including on the Department's website; and</text>
					</subparagraph><subparagraph id="id53CBE921DC9C40F493667EAC951C765F"><enum>(C)</enum><text>submitted to the
			 Committee on Health, Education, Labor, and Pensions of the Senate and the
			 Committee on Education and the Workforce of the House of
			 Representatives.</text>
					</subparagraph></paragraph></subsection><subsection id="ID60f0110f388949f1b17b2fa36693fe3c"><enum>(b)</enum><header>Information
			 dissemination and technical assistance</header>
				<paragraph id="IDb2e8b8ff977942d98f4d890a7e1cedb3"><enum>(1)</enum><header>In
			 general</header><text>From amounts reserved under paragraph (1)(A) or
			 (2)(A)(iii) of section 5(b) for a fiscal year, the Secretary, in collaboration
			 with the regional educational laboratories established under section 174 of the
			 Education Sciences Reform Act of 2002 (20 U.S.C. 9564), the comprehensive
			 centers established under section 203 of the Educational Technical Assistance
			 Act of 2002 (20 U.S.C. 9602), and the Director of the National Institute of
			 Child Health and Human Development, shall distribute information on literacy
			 instruction, including best practices and model programs identified in the
			 evaluation, other inquiries described in subsection (a)(2)(D), or related
			 Federal studies of literacy activities and provide technical assistance in
			 order to assist States and local educational agencies in improving literacy
			 instruction and learning.</text>
				</paragraph><paragraph id="IDf9d817c987414879ad25ce100b551b24"><enum>(2)</enum><header>Dissemination
			 and coordination</header><text>The Secretary shall disseminate the information
			 described in paragraph (1) to—</text>
					<subparagraph id="id3C64216ADBBF4B7CA38EBB90A3CCD459"><enum>(A)</enum><text>recipients of
			 Federal financial assistance under this Act, the Head Start Act, the
			 Individuals with Disabilities Education Act (20 U.S.C. 1400 et seq.), and the
			 Adult Education and Family Literacy Act (20 U.S.C. 9201 et seq.); and</text>
					</subparagraph><subparagraph id="IDe775bb25dda74382a3de8debb9d90026"><enum>(B)</enum><text>each
			 Bureau-funded school (as defined in section 1141 of the Education Amendments of
			 1978 (25 U.S.C. 2021)).</text>
					</subparagraph></paragraph><paragraph id="IDfcdf9440364e426dae17e31ae93fbdaf"><enum>(3)</enum><header>Use of
			 networks</header><text>In carrying out this subsection, the Secretary shall, to
			 the extent practicable, use information and dissemination networks developed
			 and maintained through other public and private entities.</text>
				</paragraph></subsection></section><section id="ID8d9c751fc9f449f882c5e9ca6db901f4"><enum>12.</enum><header>Consequences of
			 insufficient progress, reporting requirements, and conflicts of
			 interest</header>
			<subsection id="id05F51AC11A6C4FD5ABED13D36F1E26A7"><enum>(a)</enum><header>Consequences of
			 insufficient progress</header>
				<paragraph id="ID194ea53a5c4f4ecd820a95d1997b704f"><enum>(1)</enum><header>Consequences
			 for grant recipients</header><text>If the Secretary determines that a State
			 educational agency receiving an award under section 5(b) or an eligible entity
			 receiving a subgrant under section 9 or 10 is not making significant progress
			 in meeting the purposes of this Act and the key metrics identified by the State
			 educational agency under section 7(b)(2)(C) after the submission of a report
			 described in subsection (b), then the Secretary may withhold, in whole or in
			 part, further payments under this Act in accordance with section 455 of the
			 General Education Provisions Act (20 U.S.C. 1234d) or take such other action
			 authorized by law as the Secretary determines necessary, including providing
			 technical assistance upon request of the State educational agency or eligible
			 entity, respectively.</text>
				</paragraph><paragraph id="IDa8332de5fa124aa6925b23a1af818750"><enum>(2)</enum><header>Consequences
			 for subgrant recipients</header>
					<subparagraph id="idD7709F6746084C0F886A0693B08D6762"><enum>(A)</enum><header>In
			 general</header><text>A State educational agency receiving an award under
			 section 5(b) may refuse to award subgrant funds to an eligible entity under
			 section 9 or 10 if the State educational agency finds that the eligible entity
			 is not making significant progress in meeting the purposes of this Act,
			 after—</text>
						<clause id="IDb917f9e3090c49fcaebd35759225338a"><enum>(i)</enum><text>affording the
			 eligible entity notice, a period for correction, and an opportunity for a
			 hearing; and</text>
						</clause><clause id="ID23fbdd1c4c814ea797c93c4dbb2c9ae9"><enum>(ii)</enum><text>providing
			 technical assistance to the eligible entity.</text>
						</clause></subparagraph><subparagraph id="id9E7E844DF2654CB6A6333825DC5D8A75"><enum>(B)</enum><header>Funds
			 available</header><text>Subgrant funds not awarded under subparagraph (A) shall
			 be redirected to an eligible entity serving similar children and students in
			 the same area or region as the eligible entity not awarded the subgrant funds,
			 to the greatest extent practicable.</text>
					</subparagraph></paragraph></subsection><subsection id="ID86911b06fd104893b04f4af37b9bd48c"><enum>(b)</enum><header>Reporting
			 requirements</header>
				<paragraph id="IDd4da750110634225994faf116c710c29"><enum>(1)</enum><header>State
			 educational agency reports</header><text>Each State educational agency
			 receiving an award under section 5(b) shall report annually to the Secretary
			 regarding the State educational agency’s progress in addressing the purposes of
			 this Act. Such report shall include, at a minimum, a description of—</text>
					<subparagraph id="ID43e22947398f4a0b808736f4b4becdc0"><enum>(A)</enum><text>the professional
			 development activities provided under the award, including types of activities
			 and entities involved in providing professional development to classroom
			 teachers and other program staff, such as school librarians;</text>
					</subparagraph><subparagraph id="IDbfc330b8121d405ca267c91a2bfdabb2"><enum>(B)</enum><text>the instruction,
			 strategies, activities, curricula, materials, and assessments used in the
			 programs funded under the award;</text>
					</subparagraph><subparagraph id="IDe753aad7c3fc4c20aeb849da9a104c2b"><enum>(C)</enum><clause commented="no" display-inline="yes-display-inline" id="idBC368C423588468EB5C241FC1B8F9D53"><enum>(i)</enum><text>the types of programs
			 and, for children from birth to kindergarten entry, program settings, funded
			 under the award; and</text>
						</clause><clause id="id5A7D7FF301EB4D62BD7BD56319420FA2" indent="up1"><enum>(ii)</enum><text>the ages and demographic
			 information that is not individually identifiable of children served by the
			 programs funded under the award;</text>
						</clause></subparagraph><subparagraph id="ID5da6ccf4d5204037859ccb1e4fcc461c"><enum>(D)</enum><text>the experience
			 and qualifications of the program staff who provide literacy instruction under
			 the programs funded under the award, including the experience and
			 qualifications of those staff working with children with disabilities or
			 developmental delays and with English language learners and children from birth
			 to kindergarten entry;</text>
					</subparagraph><subparagraph id="id49EFE9152D7044C3882F075D9A538900"><enum>(E)</enum><text>key data metrics
			 identified under section 7(b)(2)(C) used for literacy initiatives;</text>
					</subparagraph><subparagraph id="IDd53f527bb17b460e9a790c4654e0e9d7"><enum>(F)</enum><text>student
			 performance on relevant program metrics, as identified in the State education
			 agency’s implementation plan under section 7(b)(2)(C), such as—</text>
						<clause id="IDf23b755c88c946d8b3cbb05a77f03c5e"><enum>(i)</enum><text>the
			 number and percentage of children reading and writing on grade level by the end
			 of grade 3;</text>
						</clause><clause id="IDfe628d364b904b829b7650cc89824562"><enum>(ii)</enum><text>the percent of
			 students served under the award who receive special education services;
			 and</text>
						</clause><clause id="ID1366646e26d34048b796fd9b31223b9e"><enum>(iii)</enum><text>the instruction
			 and activities delivered to at-risk students served under the award; and</text>
						</clause></subparagraph><subparagraph id="IDf08ea657b4b84b948281c7d94ee254d9"><enum>(G)</enum><text>the outcomes of
			 programs and activities provided under the award.</text>
					</subparagraph></paragraph><paragraph id="id8846D708706948029AE07832C891054D"><enum>(2)</enum><header>Eligible entity
			 reports</header><text>Each eligible entity receiving a subgrant under section 9
			 or 10 shall report annually to the State educational agency regarding the
			 eligible entity's progress in addressing the purposes of this Act. Such report
			 shall include, at a minimum, a description of—</text>
					<subparagraph id="id2CB9D9767D624DEDAEC9F0276BC36CDD"><enum>(A)</enum><text>how the subgrant
			 funds were used;</text>
					</subparagraph><subparagraph id="idD578F9D2BC4E4C039DB067C39FED9091"><enum>(B)</enum><text>the degree of
			 appropriate developmental progress or literacy achievement growth of students,
			 disaggregated by the categories described in section 1111(b)(2)(C)(v)(II) of
			 the Elementary and Secondary Education Act of 1965 (20 U.S.C.
			 6311(b)(2)(C)(v)(II)); and</text>
					</subparagraph><subparagraph id="id9836E6FFEE9A42EBA2C716FDE91DA533"><enum>(C)</enum><text>the results of an
			 external evaluation, if the Secretary determines applicable.</text>
					</subparagraph></paragraph></subsection><subsection id="idD0ACB16D39C14932951556557FD34247"><enum>(c)</enum><header>Conflicts of
			 interest</header><text>The Secretary shall ensure that each member of the peer
			 review panel described in section 5(c) and each member of a State literacy
			 leadership team participating in a program or activity assisted under this Act
			 does not stand to benefit financially from a grant or subgrant awarded under
			 this Act.</text>
			</subsection></section><section id="ID96633d2defb44f1b8542db88523e6778"><enum>13.</enum><header>Rules of
			 construction</header>
			<subsection id="ID3281f8e85bd042a48cf743aecec49ba4"><enum>(a)</enum><header>Student
			 eligibility</header><text>Nothing in this Act shall be construed to prohibit
			 students eligible for assistance under title I or III of the Elementary and
			 Secondary Education Act of 1965 (20 U.S.C. 6301 et seq., 6801 et seq.) or
			 students eligible for assistance under the Individuals with Disabilities
			 Education Act (20 U.S.C. 1400 et seq.) from receiving literacy instruction and
			 intervention under this Act.</text>
			</subsection><subsection id="ID604597c727a9455485717ea4c7eccfbc"><enum>(b)</enum><header>IDEA
			 evaluation</header><text>The screening assessments, diagnostic assessments, and
			 formative assessments of reading and writing authorized under this Act shall
			 not be construed to constitute an evaluation required under the Individuals
			 with Disabilities Education Act (20 U.S.C. 1400 et seq.).</text>
			</subsection></section><section id="IDf4d6940bdad54639a828fd6f80b73ada"><enum>14.</enum><header>Authorization
