		<official-title>To require congressional approval before implementation
		  of certain agency actions, and for other purposes.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Agency Overreach Moratorium Act
			 </short-title></quote>.</text>
		</section><section id="idB49E9A7BA279428CA22D3361F249F602"><enum>2.</enum><header>Prohibition on
			 retroactive withdrawal of certain permits</header><text display-inline="no-display-inline">Unless approved by an Act of Congress, the
			 head of a Federal agency shall not—</text>
			<paragraph id="IDef102e2d7a624dc19a70a94cf07bdf9a"><enum>(1)</enum><text>retroactively
			 withdraw any permit issued for Federal land or any area of the outer
			 Continental Shelf that would have been used—</text>
				<subparagraph id="idDEC1CD3A3B094C5E956DCD00DBC19633"><enum>(A)</enum><text>to produce or
			 harvest a domestic natural resource; or</text>
				</subparagraph><subparagraph id="id753875BBCCDA4DF3B0ECEA331305494B"><enum>(B)</enum><text>to create 1 or
			 more jobs; or</text>
				</subparagraph></paragraph><paragraph id="ID16edac65511c40048d84a381db072e1d"><enum>(2)</enum><text>issue a
			 designation under any law that would restrict or prohibit access to domestic
			 natural resources on Federal land or any area of the outer Continental
			 Shelf.</text>
			</paragraph></section><section id="H8314380FA88B484AA5D00486A188D0A4"><enum>3.</enum><header>Congressional
			 approval of designation of national monuments</header><text display-inline="no-display-inline">Section 2 of the Act of June 8, 1906
			 (commonly known as the <quote>Antiquities Act of 1906</quote>) (16 U.S.C. 431)
			 is amended—</text>
			<paragraph id="H1CEEF5F122644601A26494BE8BEB7529"><enum>(1)</enum><text>by striking
			 <quote><header-in-text level="section" style="traditional">Sec.
			 2.</header-in-text> That the President</quote> and inserting the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="id7F4FE2C8B1CE4C35B6831737073A9422" style="OLC">
					<section id="idAE48707927BD46BBB73CB3EE61524D6C"><enum>2.</enum><header>Designation of
				national monuments</header>
						<subsection id="id2A186F27CB4C4456BE7FF0F44D427015"><enum>(a)</enum><header>In
				general</header><text display-inline="yes-display-inline">Subject to the
				requirements of this section, the
				President</text>
						</subsection></section><after-quoted-block>;</after-quoted-block></quoted-block>
			</paragraph><paragraph commented="no" id="HA15F9D3FBC28487C9938C56C305C89E0"><enum>(2)</enum><text>by striking
			 <quote><italic>Provided</italic>, That when such objects are situated
			 upon</quote> and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="id0A07BCDF9DC946188ECB2EFB9781AFCD" style="OLC">
					<subsection commented="no" id="id9F1C483A6E72463FA3A88618FAFC0FB4"><enum>(b)</enum><header>Relinquishment
				of private claims</header><text>In cases in which an object described in
				subsection (a) is located on</text>
					</subsection><after-quoted-block>;
				and</after-quoted-block></quoted-block>
			</paragraph><paragraph commented="no" id="idAD9CA470D0344F6DB6E01936550E3228"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id52EBAD1FF5FD4124B7B4C473A2F74977" style="OLC">
					<subsection commented="no" id="idBD220B86775F40A19F3BD4A7BCAEE8FF"><enum>(c)</enum><header>Congressional
				approval of proclamation</header><text>A proclamation issued under subsection
				(a) shall not be implemented until the proclamation is approved by an Act of
				Congress.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="id50FE4D16219946E58617046EF374FB45"><enum>4.</enum><header>Economic
			 analysis by Secretary of Commerce required</header><text display-inline="no-display-inline">The head of a Federal agency shall not take
			 any action that modifies the authority of the Federal agency with respect to
			 issuing permits for natural resource development on Federal land or making
			 designations of Federal land under any law until the date on which the
			 Secretary of Commerce completes, and submits to Congress, an economic analysis
			 to determine—</text>
			<paragraph id="id9B63CE7E57C64CEFB363066CEE9501F3"><enum>(1)</enum><text display-inline="yes-display-inline">whether the proposed agency action has the
			 potential to reduce revenue to the Treasury; and</text>
			</paragraph><paragraph id="idF1F6DCBDE02A481DA226849CF45925C0"><enum>(2)</enum><text display-inline="yes-display-inline">the potential impact of the proposed agency
			 action on property rights and existing contracts.</text>
