				carry out a program of teleconsultation for the provision of remote mental
				health and traumatic brain injury assessments in facilities of the Department
				that are not otherwise able to provide such assessments without contracting
				with third party providers or reimbursing providers through a fee basis
				system.</text>
									</paragraph><paragraph changed="added" committee-id="SSVA00" id="id2CAC29A3931D460BB753A1CBA83B5749" indent="up1" reported-display-style="italic"><enum>(2)</enum><text>The Secretary shall, in
				consultation with appropriate professional societies, promulgate technical and
				clinical care standards for the use of teleconsultation services within
				facilities of the Department.</text>
									</paragraph></subsection><subsection id="ID486b354ad0f84a5197f5f917cf2b5ebe"><enum>(b)</enum><header>Teleconsultation
				defined</header><text>In this section, the term <term>teleconsultation</term>
				means the use by a health care specialist of telecommunications to assist
				another health care provider in rendering a diagnosis or
				treatment.</text>

			 telemedicine</header><text>The Secretary of Veterans Affairs shall offer
			 medical residents opportunities in training in telemedicine to the extent such
			 facilities offering residency programs have and utilize telemedicine and shall
			 make such opportunities available consistent with standards established by the
			 Accreditation Council for Graduate Medical Education for medical residency
			 programs.</text>
				</subsection><subsection id="idE42E14F7A2E3447DA8A64FA9E67C5BFF"><enum>(c)</enum><header>Enhancement of
			 VERA</header>
					<paragraph id="ID6109635ef5dd486cb3587f8a46e0004a"><enum>(1)</enum><header>Incentives for
			 provision of teleconsultation, teleretinal imaging, telemedicine, and
			 telehealth services</header>
						<subparagraph id="id97A4A41150014DD683A805A36C46EA56"><enum><added-phrase committee-id="SSVA00" reported-display-style="italic">(A)</added-phrase></enum><header>In
			 general</header><text>The Secretary of Veterans Affairs shall modify the
			 Veterans Equitable Resource Allocation (VERA) system to include
			 teleconsultation, teleretinal imaging, telemedicine, and telehealth
			 coordination services.</text>
						</subparagraph><subparagraph id="id4899F77F70D842AD91E18083AD598007"><enum>(B)</enum><header>Assessment</header><text>Not
			 later than one year after the date on which the Secretary modifies the Veterans
			 Equitable Resource Allocation system as required by subparagraph (A), the
			 Secretary shall assess—</text>
							<clause id="id04C471598A1048EF840C24A1F4E7E2B5"><enum><added-phrase committee-id="SSVA00" reported-display-style="italic">(i)</added-phrase></enum><text>the effect of
			 such modification on the utilization of teleconsultation, teleretinal imaging,
			 telemedicine, and telehealth coordination services; and</text>
							</clause><clause id="idC1089421D3FD4B77BF8DD0C9939E5089"><enum><added-phrase committee-id="SSVA00" reported-display-style="italic">(ii)</added-phrase></enum><text>whether
			 additional incentives are required to promote the utilization of such services
			 throughout the Department of Veterans Affairs.</text>
							</clause></subparagraph></paragraph><paragraph id="id9E14BB986BCD4BC294DA21A531FCC025"><enum>(2)</enum><header>Inclusion of
			 telemedicine visits in workload reporting</header><text>The Secretary shall
			 modify the Veterans Equitable Resource Allocation system to require the
			 inclusion of all telemedicine visits in the calculation of facility
			 workload.</text>
					</paragraph></subsection><subsection id="id862C61135EB844AB9B9329E958D29264"><enum>(d)</enum><header>Definitions</header><text>In
			 this section:</text>
					<paragraph id="id21B182BC277743B2ACAADD9422386821"><enum>(1)</enum><header>Teleconsultation</header><text>The
			 term <term>teleconsultation</term> has the meaning given such term in section
			 1709 of title 38, United States Code, as added by subsection (a).</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDdfe9cae7c2e24965b26c2c1c128b5ad3"><enum>(2)</enum><header>Telehealth</header><text>The
			 term <term>telehealth</term> means the use of telecommunications to collect
			 patient data remotely and send data to a monitoring station for
			 interpretation.</text>
					</paragraph><paragraph id="IDd1f88d7c4aa34c628207c37e70a4671a"><enum>(3)</enum><header>Telemedicine</header><text>The
			 term <term>telemedicine</term> means the use by a health care provider of
			 telecommunications to assist in the diagnosis or treatment of a patient's
			 medical condition.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idE1AFFF02D6FE4D60BB5A96A3DA266F2B"><enum>(4)</enum><header>Teleretinal
			 imaging</header><text>The term <term>teleretinal imaging</term> means the use
			 by a health care specialist of telecommunications, digital retinal imaging, and
			 remote image interpretation to provide eye care.</text>
					</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="idE636EA7F19684D5F997B9EA6821A9C9A"><enum>103.</enum><header>Payments and
			 allowances for beneficiary travel in connection with veterans receiving care
			 from Vet Centers</header>
				<subsection commented="no" display-inline="no-display-inline" id="id8247F52E264A460C95DA065229F55198"><enum>(a)</enum><header>Clarification of
			 existing authority</header><text>The Secretary of Veterans Affairs may pay the
			 actual necessary expense of travel or an allowance for travel to or from a Vet
			 Center under section 111(a) of title 38, United States Code.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="idD90B31B9B44845539A8FA6237EC41719"><enum>(b)</enum><header>Report</header>
					<paragraph commented="no" display-inline="no-display-inline" id="id8A864C93FA2A4F67BC494F36466275FB"><enum><added-phrase committee-id="SSVA00" reported-display-style="italic">(1)</added-phrase></enum><header>In
			 general</header><text>Not later than one year after the date of the enactment
			 of this Act, the Secretary shall submit to Congress a report on the feasibility
			 and advisability of paying the actual necessary expenses of travel or
			 allowances for travel to or from Vet Centers under such section.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id680FBC5471C5454BB8DAEEA7619DF4CB"><enum>(2)</enum><header>Elements</header><text>The
			 report required by paragraph (1) shall include the following:</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="id1B3DA23F5EF640FC9EB357B219DFC0DC"><enum>(A)</enum><text>A description of the
			 veterans who benefit from payment as described in subsection (a).</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idB52A96C049C2433783422879EB42485D"><enum>(B)</enum><text>A description of any
			 impediments to the Secretary in paying such expenses or allowances.</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id49AD4E3D9A494F2B87EF0C8DFBCA6D40"><enum>(C)</enum><text>A description of any
			 impediments encountered by veterans in receiving such payments.</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id92024C745F6A4B658174B3A3432765D5"><enum>(D)</enum><text>An assessment of the
			 feasibility and advisability of paying such expenses or allowances.</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id87F1746EFBF04E3D86F3F873E2B5F0BC"><enum>(E)</enum><text>Such recommendations for
			 legislative or administrative action as the Secretary considers appropriate
			 with respect to the payment of such expenses or allowances.</text>
						</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id468453AE4FC94EC3B61D9518EB06D203"><enum><added-phrase committee-id="SSVA00" reported-display-style="italic">(c)</added-phrase></enum><header>Authorization
			 of appropriations</header><text>There is authorized to be appropriated to the
			 Secretary such sums as may be necessary to pay expenses and allowances as
			 described in subsection (a) during the one-year period beginning on the date of
			 the enactment of this Act.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="id61CDD03C74884BDF99A1D4C7E4573ABA"><enum>(d)</enum><header>Vet Center
			 defined</header><text>In this section, the term <term>Vet Center</term> means a
			 center for readjustment counseling and related mental health services for
			 veterans under section 1712A of such title.</text>
				</subsection></section><section id="HD48CE33F34934118B9004E5A5D7C0571"><enum>104.</enum><header>Use of service dogs on
			 property of the Department of Veterans Affairs</header><text display-inline="no-display-inline">Section 1714 is amended by adding at the end
			 the following new subsection:</text>
				<quoted-block changed="added" committee-id="SSVA00" display-inline="no-display-inline" id="H0F77C4A562714959BBBEFCF8DAAE96EB" reported-display-style="italic" style="USC">
					<subsection id="HCC8C26D611034CBA9C46E45A0459452C"><enum>(e)</enum><paragraph commented="no" display-inline="yes-display-inline" id="idB2E0C9EF54074D25815AE354F88AE6E0"><enum>(1)</enum><text display-inline="yes-display-inline">Subject to paragraph (3), the Secretary
				shall admit service animals described in paragraph (2) to any building or
				property of the Department on the same terms and conditions, and subject to the
				same regulations, as otherwise generally govern the admission of the public to
				such buildings or properties.</text>
						</paragraph><paragraph changed="added" committee-id="SSVA00" id="idC2ADFA6C6AEF44508BF898F283591401" indent="up1" reported-display-style="italic"><enum>(2)</enum><text>The service animals
				described in this paragraph are service dogs provided under subsection (c) and
				other guide dogs or service animals that accompany individuals with
				disabilities and that are especially trained and educated to accompany such
				individuals.</text>
						</paragraph><paragraph changed="added" committee-id="SSVA00" id="id2E6416AB5E944AF9B22DB16CCBE47995" indent="up1" reported-display-style="italic"><enum>(3)</enum><text display-inline="yes-display-inline">The Secretary may prohibit service animals
				described in paragraph (2) from running free in or roaming buildings or
				properties described in paragraph (1) and may require such service animals to
				adorn guiding harnesses or leashes and be under the control of an individual at
				all times while in such buildings or on such
				properties.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="HDDF33F9D835042EBB174458718999DFF"><enum>105.</enum><header>Rehabilitative
			 services for veterans with traumatic brain injury</header>
				<subsection id="HC65488CCEA184133989E60474726FE1B"><enum>(a)</enum><header>Rehabilitation services
			 in plans for rehabilitation and reintegration</header><text>Section 1710C is
			 amended—</text>
					<paragraph id="HA6ACD3B4D3D74D45B89BF8115F922DAC"><enum>(1)</enum><text>in subsection (a)(1), by
			 inserting before the semicolon the following: <quote>with the goal of
			 maximizing the individual’s independence</quote>;</text>
					</paragraph><paragraph id="H59453C5878CC4494803C0FEFC3B7F29B"><enum>(2)</enum><text>in subsection (b)—</text>
						<subparagraph id="H952219DF323547DA9FC449EB1F4890DE"><enum>(A)</enum><text>in paragraph (1)—</text>
							<clause id="H79C20626288546A9ACAB6B0E3A7C4505"><enum>(i)</enum><text>by inserting <quote>(and
			 sustaining improvement in)</quote> after <quote>improving</quote>; and</text>
							</clause><clause id="HA756C9BEDC5C4F618ABD94669F50CCE2"><enum>(ii)</enum><text>by inserting
			 <quote>behavioral,</quote> after <quote>cognitive,</quote>;</text>
							</clause></subparagraph><subparagraph id="H2867B1A6E1584786900F7453F70C405B"><enum>(B)</enum><text>in paragraph (2), by
			 inserting <quote>rehabilitative services and</quote> before
			 <quote>rehabilitative components</quote>; and</text>
						</subparagraph><subparagraph id="HBD2A96BA096E491C988BE9EDE8136C69"><enum>(C)</enum><text>in paragraph (3)—</text>
							<clause id="HD4266B2F9AFA4CDFA78000D51938C547"><enum>(i)</enum><text>by striking
			 <quote>treatments</quote> the first place it appears and inserting
			 <quote>services</quote>; and</text>
							</clause><clause id="HEC201C2687D342AF883621C79857E05C"><enum>(ii)</enum><text>by striking
			 <quote>treatments and</quote> the second place it appears; and</text>
							</clause></subparagraph></paragraph><paragraph id="HEAB11ADEC4DD45AE9DEF0A4398F84FB4"><enum>(3)</enum><text>by adding at the end the
			 following new subsection:</text>

				as such term is defined in section 1701 of this title;</text>
								</paragraph><paragraph id="H984D056EB1C243D38AB0A824A5578FE3"><enum>(2)</enum><text>treatment and services
				(which may be of ongoing duration) to sustain, and prevent loss of, functional
				gains that have been achieved; and</text>
								</paragraph><paragraph id="id499B65C34BA741769CE11AB09C916BF6"><enum>(3)</enum><text>any other rehabilitative
				services or supports that may contribute to maximizing an individual's
				independence.</text>
								</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection id="H0EB6F6C27B0B47B18F3C1A89E741A144"><enum>(b)</enum><header>Rehabilitation services
			 in comprehensive program for long-Term rehabilitation</header><text>Section
			 1710D(a) is amended—</text>
					<paragraph id="H03698B1ABF054C11AF78DFD5A6568AB5"><enum>(1)</enum><text>by inserting <quote>and
			 rehabilitative services (as defined in section 1710C of this title)</quote>
			 after <quote>long-term care</quote>; and</text>
					</paragraph><paragraph id="HCF8C56A71190453FBD8879A4FA7C4292"><enum>(2)</enum><text>by striking
			 <quote>treatment</quote>.</text>
					</paragraph></subsection><subsection id="HE7A32589B83E4400886A5DFF269AF2A2"><enum>(c)</enum><header>Rehabilitation services
			 in authority for cooperative agreements for use of non-Department facilities
			 for rehabilitation</header><text>Section 1710E(a) is amended by inserting
			 <quote>, including rehabilitative services (as defined in section 1710C of this
			 title),</quote> after <quote>medical services</quote>.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="id3B4F30E3D02C4C49A17D8B241AB1A45A"><enum>(d)</enum><header>Technical
			 amendment</header><text>Section 1710C(c)(2)(S) is amended by striking

				</subsection></section><section commented="no" display-inline="no-display-inline" id="id6321ECC1F71E4F7BBEB629F8045E7A13" section-type="subsequent-section"><enum>106.</enum><header display-inline="yes-display-inline">Centers of excellence for rural health
			 research, education, and clinical activities</header>
				<subsection commented="no" display-inline="no-display-inline" id="id87FF042FA08A449ABFBEAF9E6EB82622"><enum>(a)</enum><header display-inline="yes-display-inline">Centers of excellence</header>
					<paragraph commented="no" display-inline="no-display-inline" id="idC1902CB4FE9F47628D61E530F9AC996B"><enum><added-phrase committee-id="SSVA00" reported-display-style="italic">(1)</added-phrase></enum><header>In
			 general</header><text display-inline="yes-display-inline">Subchapter II of
			 chapter 73 is amended by adding at the end the following new section:</text>

								<subsection commented="no" display-inline="no-display-inline" id="id898B0996D0FF4F14ADCAB96CB4D73027"><enum><added-phrase committee-id="SSVA00" reported-display-style="italic">(a)</added-phrase></enum><header display-inline="yes-display-inline">Establishment</header><text>The Secretary
				shall, through the Director of the Office of Rural Health, establish and
				operate centers of excellence for rural health research, education, and
				clinical activities.</text>
								</subsection><subsection commented="no" display-inline="no-display-inline" id="id55F1D4E296104FC2AA534131BDB97EEB"><enum>(b)</enum><header>Activities</header><text>Each
				center established and operated under subsection (a) shall carry out one or
				more of the following:</text>
									<paragraph id="ID788d413fb48e4d19b04c7e0b5c22adc5"><enum>(1)</enum><text>Collaboration with the
				Office of Research and Development of the Veterans Health Administration on
				research relating to the furnishing of health services in rural areas.</text>
									</paragraph><paragraph id="ID9fa9eb932a0a47d3b2202801af60ac13"><enum>(2)</enum><text>Development of specific
				models to be used by the Department in furnishing health services to veterans
				in rural areas.</text>
									</paragraph><paragraph id="ID0f263356ce4b46f2a1e1fb718dfc0825"><enum>(3)</enum><text>Provision of education
				and training for health care professionals of the Department on the furnishing
				of health services to veterans in rural areas.</text>
									</paragraph><paragraph id="IDdfd906b9f3314d9689bdf7018ccae094"><enum>(4)</enum><text>Development and
				implementation of innovative clinical activities and systems of care for the
				Department for the furnishing of health services to veterans in rural
				areas.</text>
									</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id759A668566A5461F8D8CFAE1062B776C"><enum>(c)</enum><header>Designation</header><text>The
				Secretary may designate a rural health resource of the Office of Rural Health
				as a center of excellence for purposes of this section, including a rural
				health resource center described in section 7308(d) of this title, if such
				resource or center engages in one or more of the activities described in
				subsection (b).</text>
								</subsection><subsection id="ID00cfad23cc4a454eb60ddbe10c902c01"><enum><added-phrase committee-id="SSVA00" reported-display-style="italic">(d)</added-phrase></enum><header>Funding</header><text>Activities
				of clinical and scientific investigation at each center operated under this
				section shall be eligible to compete for the award of funding from funds
				appropriated for the Medical and Prosthetics Research
				Account.</text>
								</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0F0E322169C944399CFF15252C0B9A77"><enum><added-phrase committee-id="SSVA00" reported-display-style="italic">(2)</added-phrase></enum><header display-inline="yes-display-inline">Clerical amendment</header><text display-inline="yes-display-inline">The table of sections at the beginning of

				health resource centers that serve as satellite offices for the Office.</text>
							</paragraph><paragraph changed="added" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="id36335E7D859A40CDBD1F9CF7B4FD390A" indent="up1" reported-display-style="italic"><enum>(2)</enum><text display-inline="yes-display-inline">The veterans rural health resource centers
				have purposes as follows:</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="id26EB676B8C8E4C119B76D65F68636AB3"><enum>(A)</enum><text display-inline="yes-display-inline">To improve the understanding of the Office
				of the challenges faced by veterans living in rural areas.</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id63628F908AB54A96BF7D41F3E3DE4559"><enum>(B)</enum><text display-inline="yes-display-inline">To identify disparities in the availability
				of health care to veterans living in rural areas.</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id75690524A449471A8C421AA141B55820"><enum>(C)</enum><text display-inline="yes-display-inline">To formulate practices or programs to
				enhance the delivery of health care to veterans living in rural areas.</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1495E3957CD04F78B8CE2F2DA868A72E"><enum>(D)</enum><text display-inline="yes-display-inline">To develop special practices and products
				for the benefit of veterans living in rural areas and for implementation of
				such practices and products in the Department
				systemwide.</text>
								</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="idB52D238E019146D49F3129735563D7E3"><enum>(c)</enum><header>Designation of
			 Department of Veterans Affairs medical center in Fargo, North Dakota, as a
			 center of excellence for rural health research, education, and clinical
			 activities</header><text>In consideration of ongoing initiatives through the
			 Office of Rural Health located at the University of North Dakota and the
			 Department of Veterans Affairs medical center in Fargo, North Dakota, such
			 medical center shall be designated under section 7330B(c) of title 38, United
			 States Code, as added by subsection (a), as a center of excellence for rural
			 health research, education, and clinical activities.</text>
				</subsection></section><section commented="no" display-inline="no-display-inline" id="id318CDA8714694645A413DCB9B6C8959F"><enum>107.</enum><header>Provision of
			 chiropractic services to veterans enrolled in health care system of Department
			 of Veterans Affairs</header>
				<subsection id="IDed30ce38c9fb4df7a68e4571132b3ad8"><enum>(a)</enum><header>Comprehensive policy on
			 chiropractic services</header>
					<paragraph id="idF1E0985ADBF64D73A6CFDE358D51B73D"><enum>(1)</enum><header>In
			 general</header><text>Not later than June 1, 2012, the Secretary of Veterans
			 Affairs shall develop and implement a comprehensive policy on the provision of
			 chiropractic services provided at the expense of the Department of Veterans
			 Affairs to veterans enrolled in the health care system of the
			 Department.</text>
					</paragraph><paragraph id="IDf88d62d826ec4f9b9ad0b87b5aacd9a1"><enum>(2)</enum><header>Scope of
			 Policy</header><text>The policy required by paragraph (1) shall cover each of
			 the following:</text>
						<subparagraph id="IDa7cf1502b4c440d292f15ce2184bb042"><enum>(A)</enum><text>The Department-wide
			 protocols governing referrals for chiropractic services.</text>
						</subparagraph><subparagraph id="IDe4c8fd68038147aab26c6216c69f6086"><enum>(B)</enum><text>The Department-wide
			 protocols governing direct access to chiropractic services.</text>
						</subparagraph><subparagraph id="ID8dc70b802bf94bc6a205508bfcf864e9"><enum>(C)</enum><text>The Department-wide
			 protocols governing the scope of practice of chiropractic practitioners.</text>
						</subparagraph><subparagraph id="ID9376de3ab353477d8db6ee0910954a07"><enum>(D)</enum><text>The definition of
			 chiropractic services to be provided.</text>
						</subparagraph><subparagraph id="ID5b91147290bc411caa70665004f93cf8"><enum>(E)</enum><text>The assurance of prompt
			 and appropriate chiropractic services by the Department, system-wide, when
			 medically appropriate.</text>
						</subparagraph><subparagraph id="ID6e9bac550e944fc8aa1bacc8fa03c4df"><enum>(F)</enum><text>Department programs of
			 education and training for health care personnel of the Department regarding
			 the benefits of chiropractic services.</text>
						</subparagraph><subparagraph id="IDb98c3031c6ab4484aa9353360c7c63e1"><enum>(G)</enum><text>Department programs of
			 patient education for veterans suffering from back pain and related
			 disorders.</text>
						</subparagraph></paragraph><paragraph id="ID32297642f9004404a5a3df6d86cf1895"><enum>(3)</enum><header>Updates</header><text>The
			 Secretary shall revise the policy required by paragraph (1) on a periodic basis
			 in accordance with experience and evolving best practice guidelines.</text>
					</paragraph><paragraph id="IDa0b1ac0708274543b5b1b0733fe3f28a"><enum>(4)</enum><header>Consultation</header><text>The
			 Secretary shall develop the policy required by paragraph (1), and revise such
			 policy under paragraph (3), in consultation with veterans service organizations
			 and other organizations with expertise regarding the benefits of chiropractic
			 services.</text>
					</paragraph></subsection><subsection id="IDfc1d912d9682469aa71eab22bf56331d"><enum>(b)</enum><header>Locations for provision
			 of chiropractic services</header><text>In carrying out the policy required by
			 subsection (a), the Secretary shall provide chiropractic services at—</text>
					<paragraph id="id80BD322844DF4F24B69E5B022B681110"><enum>(1)</enum><text>not less than two
			 locations in each Veterans Integrated Service Network (VISN); and</text>
					</paragraph><paragraph id="id053192F8C17F4B9689A80250BA0D0A97"><enum>(2)</enum><text>such locations as the
			 Secretary considers appropriate based on the Secretary's assessment of demand
			 for chiropractic services provided by the Department, including consideration
			 of the following:</text>
						<subparagraph id="idC2A00CC65BA742A480D662B0B210C6AE"><enum>(A)</enum><text>The average time a
			 veteran seeking chiropractic services from the Department is required to wait
			 for such services.</text>
						</subparagraph><subparagraph id="id5BAF8D6EB11D4E81833B7AD919E5FEBD"><enum>(B)</enum><text>Rates of fee-based
			 care.</text>
						</subparagraph><subparagraph id="id53DEEFC015FB4E5B97480DB300E652B5"><enum>(C)</enum><text>Such other considerations
			 as the Secretary considers appropriate.</text>
						</subparagraph></paragraph></subsection><subsection id="ID4d5808dcc87c4ee18b23805e497ddfaf"><enum>(c)</enum><header>Annual Report</header>
					<paragraph id="ID5c71e19ac3184f8d977a3c3e96e2eeab"><enum>(1)</enum><header>In
			 general</header><text>Not later than 180 days after the date of the completion
			 and initial implementation of the policy required by subsection (a)(1) and on
			 October 1 of every fiscal year thereafter through fiscal year 2020, the
			 Secretary shall submit to the Committee on Veterans' Affairs of the Senate and
			 the Committee on Veterans' Affairs of the House of Representatives a report on
			 the implementation of the policy required by subsection (a)(1).</text>
					</paragraph><paragraph id="ID82441878723b401180582d20930ae552"><enum>(2)</enum><header>Elements</header><text>The
			 report required by paragraph (1) shall include the following:</text>
						<subparagraph id="ID2134b8b44b344c4e8331e6379b0902f6"><enum>(A)</enum><text>A description of the
			 policy developed and implemented under paragraph (1) of subsection (a) and any
			 revisions to such policy under paragraph (3) of such subsection.</text>
						</subparagraph><subparagraph id="ID7bc58e55c0b940f89a399797feddc107"><enum>(B)</enum><text>A description of the
			 performance measures used to determine the effectiveness of such policy in
			 improving the availability of chiropractic services for veterans
			 system-wide.</text>
						</subparagraph><subparagraph id="IDbfe06e52352e4f00bc31c69b3ccede7f"><enum>(C)</enum><text>An assessment of the
			 adequacy of Department chiropractic services based on a survey of patients
			 managed in Department clinics.</text>
						</subparagraph><subparagraph id="IDd6928c792f794354bc7b4a918630e497"><enum>(D)</enum><text>An assessment of the
			 training provided to Department health care personnel with respect to the
			 benefits of chiropractic services and the appropriate referral of patients for
			 chiropractic services.</text>
						</subparagraph><subparagraph id="ID92417fc289b1417d9c2aafda2e2d2897"><enum>(E)</enum><text>An assessment of the
			 patient pain care education programs of the Department.</text>
						</subparagraph><subparagraph id="ID05e26dc055f64120857c5bc03fed4745"><enum>(F)</enum><text>The number of episodes of
			 chiropractic services (including referrals for chiropractic services to
			 non-Department providers) granted in the preceding fiscal year, disaggregated
			 by facility.</text>
						</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDd03403f9eb8043f0bf938cee22b7094a"><enum>(d)</enum><header>Veterans Service
			 Organization defined</header><text>In this section, the term <term>veterans
			 service organization</term> means any organization recognized by the Secretary
			 for the representation of veterans under section 5902 of title 38, United
			 States Code.</text>
				</subsection></section><section id="IDb2a0955e7f7a4f689a7a4e26aba047b7"><enum>108.</enum><header>Reimbursement rate for
			 ambulance services</header><text display-inline="no-display-inline">Section
			 111(b)(3) is amended by adding at the end the following new
			 subparagraph:</text>
				<quoted-block changed="added" committee-id="SSVA00" display-inline="no-display-inline" id="id4434870541E34E8A8348454B3FA87678" reported-display-style="italic" style="OLC">
					<subparagraph id="ID8a8f4aef7b38409585a594dc8cc0e955" indent="up2"><enum>(C)</enum><text>In the case of
				transportation of a person under subparagraph (B) by ambulance, the Secretary
				may pay the provider of the transportation the lesser of the actual charge for
				the transportation or the amount determined by the fee schedule established
				under section 1834(l) of the Social Security Act (42 U.S.C. 1395m(l)) unless
				the Secretary has entered into a contract for that transportation with the
				provider.</text>
					</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="idD17C18E8E88141EEA46B7DE83422CB2E"><enum>109.</enum><header>Increased flexibility
			 in establishing payment rates for nursing home care provided by State
			 homes</header>
				<subsection id="id1CEE05392FDC4427B5211B13945B529B"><enum>(a)</enum><header>In
			 general</header><text>Section 1745(a) is amended—</text>
					<paragraph id="id91E7736B3F194E19B34EEA898BBE9982"><enum>(1)</enum><text>in paragraph (1), by
			 striking <quote>The Secretary shall pay each State home for nursing home care
			 at the rate determined under paragraph (2)</quote> and inserting <quote>The
			 Secretary shall enter into a contract (or agreement under section 1720(c)(1) of
			 this title) with each State home for payment by the Secretary for nursing home
			 care provided in the home</quote>; and</text>
					</paragraph><paragraph id="idDF71A85B8F5C420FB66431B5F1AE897B"><enum>(2)</enum><text>by striking paragraph (2)
			 and inserting the following new paragraph (2):</text>
						<quoted-block changed="added" committee-id="SSVA00" display-inline="no-display-inline" id="idE396A2312D8B44EF9AF90EC42AF3B472" reported-display-style="italic" style="OLC">
							<paragraph id="id06FC4397905A4E0DB98CB8EB8398B748" indent="up1"><enum>(2)</enum><text>Payment under each
				contract (or agreement) between the Secretary and a State home under paragraph
				(1) shall be based on a methodology, developed by the Secretary in consultation
				with the State home, to adequately reimburse the State home for the care
				provided by the State home under the contract (or
				agreement).</text>
							</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection id="id7949F731F6F04892AE65F80D04BDE175"><enum>(b)</enum><header>Effective
			 date</header><text>The amendment made by subsection (a) shall apply to care
			 provided on or after January 1, 2012.</text>
				</subsection></section><section id="ID7fac946c93fc4d64be273003b2d100fc"><enum>110.</enum><header>Access to State
			 prescription monitoring programs</header>
				<subsection id="id9BDA7FCDF7064501A9FC975D9C513A92"><enum>(a)</enum><header>Exception with respect
			 to confidential nature of claims</header><text>Section 5701 is amended by
			 adding at the end the following new subsection:</text>
					<quoted-block changed="added" committee-id="SSVA00" display-inline="no-display-inline" id="id93CF29C6F2D1489F8916E713E42C2F20" reported-display-style="italic" style="OLC">
						<subsection id="IDc6574288c5fb4714983ef806e8892e44"><enum>(l)</enum><text>Under regulations the
				Secretary shall prescribe, the Secretary may disclose information about a
				veteran or the dependent of a veteran to a State controlled substance
				monitoring program, including a program approved by the Secretary of Health and
				Human Services under section 399O of the Public Health Service Act (42 U.S.C.
				280g–3), to the extent necessary to prevent misuse and diversion of
				prescription
				medicines.</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="idF34630016FD140DA9FE17D36FEA29907"><enum>(b)</enum><header>Exception with respect
			 to confidentiality of certain medical records</header><text>Section 7332(b)(2)
			 is amended by adding at the end the following new subparagraph:</text>
					<quoted-block changed="added" committee-id="SSVA00" display-inline="no-display-inline" id="idB289CC014C8049BF8D9FB155D94D6C82" reported-display-style="italic" style="OLC">
						<subparagraph id="id0F1BC76EE0D44951B6C0AA0D8F45F5A8" indent="up1"><enum>(G)</enum><text>To a State controlled

				</subsection></section><section id="id03FD6DA5CB9B4A889B181743F555A2F5"><enum>111.</enum><header>Improvements for
			 recovery and collection of amounts for Department of Veterans Affairs Medical
			 Care Collections Fund</header>
				<subsection id="id3C210C82D445410791FAD0F66A5AD7C5"><enum>(a)</enum><header>Development and
			 implementation of plan for recovery and collection</header>
					<paragraph id="idDC3E8E7748EA40DEA19AE180585A4EA3"><enum>(1)</enum><header>In
			 general</header><text>Not later than 180 days after the date of the enactment
			 of this Act, the Secretary of Veterans Affairs shall develop and implement a
			 plan to ensure the recovery and collection of amounts under the provisions of
			 law described in section 1729A(b) of title 38, United States Code, for deposit
			 in the Department of Veterans Affairs Medical Care Collections Fund.</text>
					</paragraph><paragraph id="id9E6AD0744B5544B7BFBA49513824BC14"><enum>(2)</enum><header>Elements</header><text>The
			 plan required by paragraph (1) shall include the following:</text>
						<subparagraph id="IDe709fd4dfc62415b88f9e7ec5fb8676a"><enum>(A)</enum><text>An effective process to
			 identify billable fee claims.</text>
						</subparagraph><subparagraph id="IDc972bb09e9b84ce9a8d20b47c29935b7"><enum>(B)</enum><text>Effective and practicable
			 policies and procedures that ensure recovery and collection of amounts
			 described in section 1729A(b) of such title.</text>
						</subparagraph><subparagraph id="IDec5646b1f78c41e5bfab26a81e48ccad"><enum>(C)</enum><text>The training of employees
			 of the Department, on or before December 1, 2011, who are responsible for the
			 recovery or collection of such amounts to enable such employees to comply with
			 the process required by subparagraph (A) and the policies and procedures
			 required by subparagraph (B).</text>
						</subparagraph><subparagraph id="ID13780fe3b266401dbf177096fee87caf"><enum>(D)</enum><text>Fee revenue goals for the
			 Department.</text>
						</subparagraph><subparagraph id="ID1c8bd813aa4b40bd85b0c0f19f206ab1"><enum>(E)</enum><text>An effective monitoring
			 system to ensure achievement of goals described in subparagraph (D) and
			 compliance with the policies and procedures described in subparagraph
			 (B).</text>
						</subparagraph></paragraph></subsection><subsection id="idD03FFB807A89478D8FA347F93B8CE0B4"><enum>(b)</enum><header>Monitoring of third
			 party collections</header><text>The Secretary shall monitor the recovery and
			 collection of amounts from third parties (as defined in section 1729(i) of such
			 title) for deposit in such fund.</text>
				</subsection></section></title><title changed="added" committee-id="SSVA00" id="id0D8CFD0D12B14996950D8AEF51883264" reported-display-style="italic"><enum>II</enum><header>Homeless veterans
			 matters</header>
			<section commented="no" display-inline="no-display-inline" id="id79AEF2B0584A4CE0A98A79CF50E0C23B" section-type="subsequent-section"><enum>201.</enum><header display-inline="yes-display-inline">Enhancement of comprehensive service
			 programs</header>
				<subsection commented="no" display-inline="no-display-inline" id="idB3FD47991FC74709A71DB4C64C646EE7"><enum>(a)</enum><header display-inline="yes-display-inline">Enhancement of grants</header><text display-inline="yes-display-inline">Section 2011 is amended—</text>

				from an entity that seeks a grant under this section to carry out a project
				described in subsection (b)(1)(A) solely on the basis that the entity proposes
				to use funding from other private or public sources, if the entity demonstrates
				that a private nonprofit organization will provide oversight and site control
				for the project.</text>
									</subparagraph><subparagraph changed="added" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="idA1A5A388E50D4D7AB977C0F1DE9CA7A1" indent="up1" reported-display-style="italic"><enum>(B)</enum><text display-inline="yes-display-inline">In this paragraph, the term <term>private
				nonprofit organization</term> means the following:</text>
										<clause commented="no" display-inline="no-display-inline" id="idB3B907378E7B4312AE8B472486E3F646"><enum>(i)</enum><text display-inline="yes-display-inline">An incorporated private institution,
				organization, or foundation—</text>
											<subclause commented="no" display-inline="no-display-inline" id="idFA0B6ADE9A344C409D768531E38D894F"><enum>(I)</enum><text display-inline="yes-display-inline">that has received, or has temporary
				clearance to receive, tax-exempt status under paragraph (2), (3), or (19) of
				section 501(c) of the Internal Revenue Code of 1986;</text>
											</subclause><subclause commented="no" display-inline="no-display-inline" id="id6B0F54F21AD64DF4B9BF98652DF89496"><enum>(II)</enum><text display-inline="yes-display-inline">for which no part of the net earnings of
				the institution, organization, or foundation inures to the benefit of any
				member, founder, or contributor of the institution, organization, or
				foundation; and</text>
											</subclause><subclause commented="no" display-inline="no-display-inline" id="id1F5B3265D0D04387B15B92475ECEA780"><enum>(III)</enum><text display-inline="yes-display-inline">that the Secretary determines is
				financially responsible.</text>
											</subclause></clause><clause commented="no" display-inline="no-display-inline" id="id7F7F004C8D004211B519EB249C1624AC"><enum>(ii)</enum><text display-inline="yes-display-inline">A for-profit limited partnership or limited
				liability company, the sole general partner or manager of which is an
				organization that is described by subclauses (I) through (III) of clause
				(i).</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="idEE08B7C7C1CD4E328D4B47F2E4576C8E"><enum>(iii)</enum><text display-inline="yes-display-inline">A corporation wholly owned and controlled
				by an organization that is described by subclauses (I) through (III) of clause
				(i).</text>
										</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idD282653C003E4AA381D58CE9817E62D5"><enum>(b)</enum><header display-inline="yes-display-inline">Grant and per diem payments</header>
					<paragraph commented="no" display-inline="no-display-inline" id="id8278663A08B04D3A88CECC4422A9E546"><enum>(1)</enum><header display-inline="yes-display-inline">Study and development of fiscal controls
			 and payment method</header><text display-inline="yes-display-inline">Not later
			 than one year after the date of the enactment of this Act, the Secretary of
			 Veterans Affairs shall—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="id301CDE957E7B41C3B73E4492B986DDD4"><enum>(A)</enum><text display-inline="yes-display-inline">complete a study of all matters relating to
			 the method used by the Secretary to make per diem payments under section
			 2012(a) of title 38, United States Code, including changes anticipated by the
			 Secretary in the cost of furnishing services to homeless veterans and
			 accounting for costs of providing such services in various geographic
			 areas;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1159F86CE2524D3CB32201A1AB84882A"><enum>(B)</enum><text display-inline="yes-display-inline">develop more effective and efficient
			 procedures for fiscal control and fund accounting by recipients of grants under
			 sections 2011, 2012, and 2061 of such title; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idB888224D9B8843B5AD980D37F78C7B1F"><enum>(C)</enum><text display-inline="yes-display-inline">develop a more effective and efficient
			 method for adequately reimbursing recipients of grants under section 2011 of
			 such title for services furnished to homeless veterans.</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6341ABBFC574433AAE37F57217062DE0"><enum>(2)</enum><header display-inline="yes-display-inline">Consideration</header><text display-inline="yes-display-inline">In developing the method required by
			 paragraph (1)(C), the Secretary may consider payments and grants received by
			 recipients of grants described in such paragraph from other departments and
			 agencies of Federal and local governments and from private entities.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idE1AC62EC597F4D23921688A657488C17"><enum>(3)</enum><header display-inline="yes-display-inline">Report</header><text display-inline="yes-display-inline">Not later than one year after the date of
			 the enactment of this Act, the Secretary shall submit to Congress a report
			 on—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="idA76B078A3E9347A4AA6494B11C0B1C56"><enum>(A)</enum><text display-inline="yes-display-inline">the findings of the Secretary with respect
			 to the study required by subparagraph (A) of paragraph (1);</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idF09D4F7A6F04441FA0C9F0C2C7F9B4A2"><enum>(B)</enum><text display-inline="yes-display-inline">the methods developed under subparagraphs
			 (B) and (C) of such paragraph; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4A2B0080F64444F69F8C92FBA44E5839"><enum>(C)</enum><text display-inline="yes-display-inline">any recommendations of the Secretary for
			 revising the method described in subparagraph (A) of such paragraph and any
			 legislative action the Secretary considers necessary to implement such
			 method.</text>
						</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idA676550361DE4B6F883430FC3CC49609"><enum>(c)</enum><header display-inline="yes-display-inline">Authorization of
			 appropriations</header><text display-inline="yes-display-inline">Section 2013

					</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id24EEBBF3FC434E8FB42625F2914DECC2" section-type="subsequent-section"><enum>203.</enum><header>Modification of
			 authority for provision of treatment and rehabilitation to certain veterans to
			 include provision of treatment and rehabilitation to homeless veterans who are
			 not seriously mentally ill</header><text display-inline="no-display-inline">Section 2031(a) is amended in the matter
			 before paragraph (1) by striking <quote>, including</quote> and inserting
			 <quote>and to</quote>.</text>
			</section><section commented="no" display-inline="no-display-inline" id="idF445A71B6F93431BB025B66BD9C8B1F4" section-type="subsequent-section"><enum>204.</enum><header display-inline="yes-display-inline">Plan to end veteran homelessness</header>
				<subsection commented="no" display-inline="no-display-inline" id="id9EDB03569C1040998E8E1A58AE28AD8C"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than one year after the date of
			 the enactment of this Act, the Secretary of Veterans Affairs shall submit to
			 Congress a comprehensive plan to end homelessness among veterans.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="id3022AB608BF54BADB5D4D76B02217BEB"><enum>(b)</enum><header>Elements</header><text display-inline="yes-display-inline">The plan required by subsection (a) shall
			 include the following:</text>
					<paragraph commented="no" display-inline="no-display-inline" id="idD4893CB669184C7F92CDE7D744271B0F"><enum>(1)</enum><text display-inline="yes-display-inline">An analysis of programs of the Department
			 of Veterans Affairs and other departments and agencies of the Federal
			 Government that are designed to prevent homelessness among veterans and assist
			 veterans who are homeless.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2967309D4B6644C1BDAEF420DC1C71AE"><enum>(2)</enum><text display-inline="yes-display-inline">An evaluation of whether and how
			 coordination between the programs described in paragraph (1) would contribute
			 to ending homelessness among veterans.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1670832D1A8B4E60A0911CAF166562D2"><enum>(3)</enum><text display-inline="yes-display-inline">Recommendations for improving the programs
			 described in paragraph (1), enhancing coordination between such programs, or
			 eliminating programs that are no longer effective.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id577A55998CE74DCBBDB721CEB846B3D3"><enum>(4)</enum><text display-inline="yes-display-inline">Recommendations for new programs to prevent
			 and end homelessness among veterans, including an estimate of the cost of such
			 programs.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id39E5A95AF8E84EEFBBD341579439F2F8"><enum>(5)</enum><text display-inline="yes-display-inline">A timeline for implementing the plan,
			 including milestones to track the implementation of the plan.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idEBCB251AEAD940B7AE9EB136DFD0FA56"><enum>(6)</enum><text>Benchmarks to measure the
			 effectiveness of the plan and the efforts of the Secretary to implement the
			 plan.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idB3012355CEF14EFCB1CEAE686499B25E"><enum>(7)</enum><text display-inline="yes-display-inline">Such other matters as the Secretary
			 considers necessary.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id7F3F6B6D736B472E87C885AE7E2D1EBB"><enum>(c)</enum><header display-inline="yes-display-inline">Consideration of veterans located in rural
			 areas</header><text display-inline="yes-display-inline">The analysis,
			 evaluation, and recommendations included in the report required by subsection
			 (a) shall include consideration of the circumstances and requirements that are
			 unique to veterans located in rural areas.</text>
				</subsection></section><section commented="no" display-inline="no-display-inline" id="id21DC61F141474C4AA1B72E13CE2E84F0"><enum>205.</enum><header>Extension of certain
			 authorities relating to homeless veterans</header>
				<subsection commented="no" display-inline="no-display-inline" id="idB7CDE1A80A54405E9A5D122D79A972E7"><enum>(a)</enum><header>Health care for

			</section><section id="idED359B79A86E4A0BA72A62F098692DBB"><enum>209.</enum><header>Collaboration in
			 provision of case management services to homeless veterans in supported housing
			 program</header>
				<subsection id="ID77e5d5b8f3db4ec99124ee17b095c8a4"><enum>(a)</enum><header>In
			 general</header><text>The Secretary of Veterans Affairs shall consider entering
			 into contracts or agreements, under sections 513 and 8153 of title 38, United
			 States Code, with eligible entities to collaborate with the Secretary in the
			 provision of case management services to covered veterans as part of the
			 supported housing program carried out under section 8(o)(19) of the United
			 States Housing Act of 1937 (42 U.S.C. 1437f(o)(19)) to ensure that the homeless
			 veterans facing the most significant difficulties in obtaining suitable housing
			 receive the assistance they require to obtain such housing.</text>
				</subsection><subsection id="id9F69707AFD8A4CBDA5A73BC7B73A169D"><enum>(b)</enum><header>Covered
			 veterans</header><text>For purposes of this section, a covered veteran is any
			 veteran who—</text>
					<paragraph id="idEBF0CEFC0EA04CC3AF4ECBF5C6E752C5"><enum>(1)</enum><text>is eligible to receive a
			 housing voucher under such section 8(o)(19);</text>
					</paragraph><paragraph id="id5A83074E14E0423FB5479A1443AD5AF6"><enum>(2)</enum><text>requires the assistance
			 of a case manager in obtaining suitable housing with such voucher; and</text>
					</paragraph><paragraph id="id26E045AC521C460FA6D6CC79F437CD0E"><enum>(3)</enum><text>is having difficulty
			 obtaining the amount of such assistance the veteran requires, including
			 because—</text>
						<subparagraph id="id1DDD0843F78A485FBB60D400F8459CF4"><enum>(A)</enum><text>the veteran resides in an
			 area that has a shortage of low-income housing and because of such shortage the
			 veteran requires more assistance from a case manager than the Secretary
			 otherwise provides;</text>
						</subparagraph><subparagraph id="idB0093EEA9312456797926D0199BC9D6B"><enum>(B)</enum><text>the location in which the
			 veteran resides is located at such distance from facilities of the Department
			 of Veterans Affairs as makes the provision of case management services by the
			 Secretary to such veteran impractical; or</text>
						</subparagraph><subparagraph id="id10023F2D20CE471BAF581B30EC502DFC"><enum>(C)</enum><text>the veteran resides in an
			 area where veterans who receive case management services from the Secretary
			 under such section have a significantly lower average rate of successfully
			 obtaining suitable housing than the average rate of successfully obtaining
			 suitable housing for all veterans receiving such services.</text>
						</subparagraph></paragraph></subsection><subsection id="ID2169ebb6b9b1494293520d0cf83b598a"><enum>(c)</enum><header>Eligible
			 entities</header><text>For purposes of this section, an eligible entity is any
			 State or local government agency, tribal organization (as such term is defined
			 in section 4 of the Indian Self Determination and Education Assistance Act (25
			 U.S.C. 450b)), or nonprofit organization that—</text>
					<paragraph id="id84FCC381E5E24C73AE990F7CEA98FD5F"><enum>(1)</enum><text>under a contract or
			 agreement described in subsection (a), agrees—</text>
						<subparagraph id="ID179fd730b49a413ab7f3d008abf7e069"><enum>(A)</enum><text>to ensure access to case
			 management services by covered veterans on an as-needed basis;</text>
						</subparagraph><subparagraph id="IDa88efd17956c4f2aa57ad9c49320a046"><enum>(B)</enum><text>to maintain referral
			 networks for covered veterans for purposes of assisting covered veterans in
			 demonstrating eligibility for assistance and additional services under
			 entitlement and assistance programs available for covered veterans, and to
			 otherwise aid covered veterans in obtaining such assistance and
			 services;</text>
						</subparagraph><subparagraph id="ID391f7369ea27492c8ad8c04b2a7f3f57"><enum>(C)</enum><text>to ensure the
			 confidentiality of records maintained by the entity on covered veterans
			 receiving services through the supported housing program described in
			 subsection (a);</text>
						</subparagraph><subparagraph id="ID62f2e12560fd4ba0ba7b9ec501ac09fb"><enum>(D)</enum><text>to establish such
			 procedures for fiscal control and fund accounting as the Secretary of Veterans
			 Affairs considers appropriate to ensure proper disbursement and accounting of
			 funds under a contract or agreement entered into by the entity as described in
			 subsection (a);</text>
						</subparagraph><subparagraph id="IDe002810ed06342c1b3866b2389ecba00"><enum>(E)</enum><text>to submit to the
			 Secretary each year, in such form and such manner as the Secretary may require,
			 a report on the collaboration undertaken by the entity under a contract or
			 agreement described in such subsection during the most recent fiscal year,
			 including a description of, for the year covered by the report—</text>
							<clause id="ID80452b59c0c84ffea16de27a752838fc"><enum>(i)</enum><text>the services and
			 assistance provided to covered veterans as part of such collaboration;</text>
							</clause><clause id="id21F21544324B4D838A7DE0CAE16832E1"><enum>(ii)</enum><text>the process by which
			 covered veterans were referred to the entity for such services and
			 assistance;</text>
							</clause><clause id="ID2d8ff335c83544a784bc61508376add1"><enum>(iii)</enum><text>the specific goals
			 jointly set by the entity and the Secretary for the provision of such services
			 and assistance and whether the entity achieved such goals; and</text>
							</clause><clause id="id33C54E56B572492D9AC607201A04EEED"><enum>(iv)</enum><text>the average length of
			 time taken by a covered veteran who received such services and assistance to
			 successfully obtain suitable housing and the average retention rate of such a
			 veteran in such housing; and</text>
							</clause></subparagraph><subparagraph id="IDd7b18bb20149406594a6d47dea753904"><enum>(F)</enum><text>to meet such other
			 requirements as the Secretary considers appropriate for purposes of providing
			 assistance to covered veterans in obtaining suitable housing; and</text>
						</subparagraph></paragraph><paragraph id="ID46ef1f97db53471e80803e8b761cedce"><enum>(2)</enum><text>has demonstrated
			 experience in—</text>
						<subparagraph id="ID9b0cb9af558b4658bb395f2fa63616be"><enum>(A)</enum><text>identifying and serving
			 homeless veterans, especially those who have the greatest difficulty obtaining
			 suitable housing;</text>
						</subparagraph><subparagraph id="ID19f8d8e952294dfe9e47481b29454d8f"><enum>(B)</enum><text>working collaboratively
			 with the Department of Veterans Affairs or the Department of Housing and Urban
			 Development;</text>
						</subparagraph><subparagraph id="ID507eba9f65c14e46adcfbba7f429ca20"><enum>(C)</enum><text>conducting outreach to,
			 and maintaining relationships with, landlords to encourage and facilitate
			 participation by landlords in supported housing programs similar to the
			 supported housing program described in subsection (a);</text>
						</subparagraph><subparagraph id="ID764189c6c2f9415c824b63688466c091"><enum>(D)</enum><text>mediating disputes
			 between landlords and veterans receiving assistance under such supported
			 housing program; and</text>
						</subparagraph><subparagraph id="ID197ab780876c4285a3806bb5c860bb6a"><enum>(E)</enum><text>carrying out such other
			 activities as the Secretary of Veterans Affairs considers appropriate.</text>
						</subparagraph></paragraph></subsection><subsection id="idAE779886A76E45BE8311AA16E0FE51D5"><enum>(d)</enum><header>Consultation</header><text>In
			 considering entering into contracts or agreements as described in subsection
			 (a), the Secretary of Veterans Affairs shall consult with—</text>
					<paragraph id="idB6EC3FA87C73467FBBEAF3B8F361580C"><enum>(1)</enum><text>the Secretary of Housing
			 and Urban Development; and</text>
					</paragraph><paragraph id="idE33DCE76B6DF416A894D441C829087A4"><enum>(2)</enum><text>third parties that
			 provide services as part of the Department of Housing and Urban Development
			 continuum of care.</text>
					</paragraph></subsection><subsection id="id7A4D77C9D3294486942AB13119350F56"><enum>(e)</enum><header>Technical assistance
			 for collaborating entities</header>
					<paragraph id="idF29BC85AA2D44DB49209EA0E17840A60"><enum>(1)</enum><header>In
			 general</header><text>The Secretary may provide training and technical
			 assistance to entities with whom the Secretary collaborates in the provision of
			 case management services to veterans as part of the supported housing program
			 described in subsection (a).</text>
					</paragraph><paragraph id="id00ED4C45E20343F99D09CAE474E9B305"><enum>(2)</enum><header>Grants</header><text>The
			 Secretary may provide training and technical assistance under paragraph (1)
			 through the award of grants or contracts to appropriate public and nonprofit
			 private entities.</text>
					</paragraph><paragraph id="id151F12FB77A4461880DB15A10708CBE6"><enum>(3)</enum><header>Funding</header><text>From
			 amounts appropriated or otherwise made available to the Secretary in the
			 Medical Services account in a year, $500,000 shall be available to the
			 Secretary in that year to carry out this subsection.</text>
					</paragraph></subsection><subsection id="ID9a46a118cc0a45f2b9d19aa9da775667"><enum>(f)</enum><header>Annual report</header>
					<paragraph id="IDa4d399d0fa06494bb7b16c0a3a8927d0"><enum>(1)</enum><header>In
			 general</header><text>Not later than 545 days after the date of the enactment
			 of this Act and not less frequently than once each year thereafter, the
			 Secretary of Veterans Affairs shall submit to Congress a report on the
			 collaboration between the Secretary and eligible entities in the provision of
			 case management services as described in subsection (a) during the most
			 recently completed fiscal year.</text>
					</paragraph><paragraph id="ID2b687d33a0d14d25a0af284652345c77"><enum>(2)</enum><header>Elements</header><text>Each
			 report required by paragraph (1) shall include, for the period covered by the
			 report, the following:</text>
						<subparagraph id="id1351466F377B4D98AACEEE8879D4CE2D"><enum>(A)</enum><text>A discussion of each case
			 in which a contract or agreement described in subsection (a) was considered by
			 the Secretary, including a description of whether or not and why the Secretary
			 chose or did not choose to enter into such contract or agreement.</text>
						</subparagraph><subparagraph id="ID9b935d66ac2b4a51b83d52428d142e36"><enum>(B)</enum><text>The number and types of
			 eligible entities with whom the Secretary has entered into a contract or
			 agreement as described in subsection (a).</text>
						</subparagraph><subparagraph id="IDafd50ac7bd4c479d98afcbd8a3a81df4"><enum>(C)</enum><text>A description of the
			 geographic regions in which such entities provide case management services as
			 described in such subsection.</text>
						</subparagraph><subparagraph id="ID3f4d35648a4a4ceab680c2d622a5578a"><enum>(D)</enum><text>A description of the
			 number and types of covered veterans who received case management services from
			 such entities under such contracts or agreements.</text>
						</subparagraph><subparagraph id="idE9D7025226FB4485A2D29075AA9E683B"><enum>(E)</enum><text>An assessment of the
			 performance of each eligible entity with whom the Secretary entered into a
			 contract or agreement as described in subsection (a).</text>
						</subparagraph><subparagraph id="ID2c4f41d6d3384055afc7d8ef53aec41e"><enum>(F)</enum><text>An assessment of the
			 benefits to covered veterans of such contracts and agreements.</text>
						</subparagraph><subparagraph id="id0733A4331A5E4B29B2FEB664FF91EEEA"><enum>(G)</enum><text>A discussion of the
			 benefits of increasing the ratio of case managers to recipients of vouchers
			 under the supported housing program described in such subsection to veterans
			 who reside in rural areas.</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5E685B4B902D44329413F4B073DEF749"><enum>(H)</enum><text>Such recommendations for
			 legislative or administrative action as the Secretary considers appropriate for
			 the improvement of collaboration in the provision of case management services
			 under such supported housing program.</text>
						</subparagraph></paragraph></subsection></section></title><title changed="added" committee-id="SSVA00" id="id617E12C9415544AFAD0A45D9E6525979" reported-display-style="italic"><enum>III</enum><header>Housing

			</section><section id="idB07D110A4E1F4184B36DC4F67F9A1EA3"><enum>302.</enum><header>Extended period of
			 protections for members of uniformed services relating to mortgages, mortgage
			 foreclosure, and eviction</header>
				<subsection id="idEE2A2E48906C462DAD184BD6D8FAA03E"><enum>(a)</enum><header>Stay of proceedings and
			 period of adjustment of obligations relating to real or personal
			 property</header><text>Section 303(b) of the Servicemembers Civil Relief Act
			 (50 U.S.C. App. 533(b)) is amended by striking <quote>within 9 months</quote>

				</subsection><subsection id="idE05A534CDA7540D3A30018F43E096C8E"><enum>(c)</enum><header>Report</header>
					<paragraph id="ID3d5ee837cbff482a8cb4c062a90fa3af"><enum>(1)</enum><header>In
			 general</header><text>Not later than 540 days after the date of the enactment
			 of this Act, the Comptroller General of the United States shall submit to
			 Congress a report on the protections provided under section 303 of such Act (50
			 U.S.C. App 533) during the five-year period ending on the date of the enactment
			 of this Act.</text>
					</paragraph><paragraph id="IDcba0e39a1c7142f1b27711e728ea7387"><enum>(2)</enum><header>Elements</header><text>The
			 report required by paragraph (1) shall include, for the period described in
			 such paragraph, the following:</text>
						<subparagraph id="ID4fad08df6a3d4c109385a506a1be7073"><enum>(A)</enum><text>An assessment of the
			 effects of such section on the long-term financial well-being of servicemembers
			 and their families.</text>
						</subparagraph><subparagraph id="id3A4243E8725842C4A9F902390207D4E2"><enum>(B)</enum><text>The number of
			 servicemembers who faced foreclosure during a 90-day period, 270-day period, or
			 365-day period beginning on the date on which the servicemembers completed a
			 period of military service.</text>
						</subparagraph><subparagraph id="idC6788D40BF9747ACAB7F67BEC2FC656E"><enum>(C)</enum><text>The number of
			 servicemembers who applied for a stay or adjustment under subsection (b) of
			 such section.</text>
						</subparagraph><subparagraph id="idF2D4E451FC4C4B279F5F03276A621EF2"><enum>(D)</enum><text>A description and
			 assessment of the effect of applying for a stay or adjustment under such
			 subsection on the financial well-being of the servicemembers who applied for
			 such a stay or adjustment.</text>
						</subparagraph><subparagraph id="IDaa7e076d3e0c4952a16767b34076a6e0"><enum>(E)</enum><text>An assessment of the
			 Secretary of Defense's partnerships with public and private sector entities and
			 recommendations on how the Secretary should modify such partnerships to improve
			 financial education and counseling for servicemembers in order to assist them
			 in achieving long-term financial stability.</text>
						</subparagraph></paragraph><paragraph id="id3F6C54979FDA422EB3A62DE111ABDC89"><enum>(3)</enum><header>Period of military
			 service and servicemember defined</header><text>In this subsection, the terms
			 <term>period of military service</term> and <term>servicemember</term> have the
			 meanings given such terms in section 101 of such Act (50 U.S.C. App.
			 511).</text>
					</paragraph></subsection></section><section id="id96392BA403BD4DD9892BEBCC1279F945"><enum>303.</enum><header>Occupancy of property
			 by dependent child of veteran for purposes of meeting occupancy requirement for
			 Department of Veterans Affairs housing loans</header><text display-inline="no-display-inline">Paragraph (2) of section 3704(c) is amended
			 to read as follows:</text>
				<quoted-block changed="added" committee-id="SSVA00" display-inline="no-display-inline" id="id7F6DBC7D60234C6BB8364C52B48B12C7" reported-display-style="italic" style="OLC">
					<paragraph id="ID032b0cc007da4bf482b223be3e46d345" indent="up1"><enum>(2)</enum><text>In any case in which a
				veteran is in active-duty status as a member of the Armed Forces and is unable
				to occupy a property because of such status, the occupancy requirements of this
				chapter shall be considered to be satisfied if—</text>
						<subparagraph id="ID10eaf677c54443efad76d5cb2cead545"><enum>(A)</enum><text>the spouse of the veteran
				occupies or intends to occupy the property as a home and the spouse makes the
				certification required by paragraph (1) of this subsection; or</text>
						</subparagraph><subparagraph id="ID30d2040fb74447c2920e90dcf8c995c0"><enum>(B)</enum><text>a dependent child of the
				veteran occupies or will occupy the property as a home and the veteran’s
				attorney-in-fact or legal guardian of the dependent child makes the
				certification required by paragraph (1) of this
				subsection.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="ID5708627783924bca80e476898e7d413c"><enum>304.</enum><header>Waiver of loan fee for
			 individuals with disability ratings issued during pre-discharge
			 programs</header><text display-inline="no-display-inline">Paragraph (2) of
			 section 3729(c) is amended to read as follows:</text>

				without regard to whether an effective date of the award of compensation is

						</subparagraph><subparagraph changed="added" committee-id="SSVA00" id="id9FFF66485B2C40868D5E891A65BD2482" indent="up1" reported-display-style="italic"><enum>(B)</enum><text>A veteran described in
				this subparagraph is a veteran who is rated eligible to receive
				compensation—</text>
							<clause id="ID4a9b05a516cc4c4098c6187c5ae6cb15"><enum>(i)</enum><text>as the result of a
				pre-discharge disability examination and rating; or</text>
							</clause><clause id="ID6b34e6dcaadd4e01a9c91f6c3dd56e01"><enum>(ii)</enum><text>based on a pre-discharge
				review of existing medical evidence (including service medical and treatment
				records) that results in the issuance of a memorandum
				rating.</text>
							</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section commented="no" display-inline="no-display-inline" id="idFFC8B1C296054EA9A6632213FB976A21" section-type="subsequent-section"><enum>305.</enum><header display-inline="yes-display-inline">Improvements to assistance for disabled
			 veterans residing in housing owned by a family member</header>
				<subsection commented="no" display-inline="no-display-inline" id="id6B1D410E9DBE4913964BB58CCA0402A9"><enum>(a)</enum><header display-inline="yes-display-inline">Increased assistance</header><text display-inline="yes-display-inline">Subsection (b) of section 2102A is
			 amended—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="idB770410832934490B0314E650D8F3B9D"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1), by striking

			 eligibility for specially adapted housing assistance for veterans with vision
			 impairment</header>
				<subsection commented="no" display-inline="no-display-inline" id="id80650BE044CF4A72B676B0BC05D2BC34"><enum><added-phrase committee-id="SSVA00" reported-display-style="italic">(a)</added-phrase></enum><header>In
			 general</header><text display-inline="yes-display-inline">Paragraph (2) of
			 section 2101(b) is amended to read as follows:</text>

				veteran is described in this paragraph if the veteran is entitled to
				compensation under chapter 11 of this title for a service-connected disability
				that meets any of the following criteria:</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="idF3E0BEFDE4A04099A439D340C42A7D50"><enum>(A)</enum><text>The
				disability is due to blindness in both eyes, having central visual acuity of
				20/200 or less in the better eye with the use of a standard correcting lens.
				For the purposes of this subparagraph, an eye with a limitation in the fields
				of vision such that the widest diameter of the visual field subtends an angle
				no greater than 20 degrees shall be considered as having a central visual
				acuity of 20/200 or less.</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id20CA52146B4F4F448722D7DEB9C12848"><enum>(B)</enum><text>A
				permanent and total disability that includes the anatomical loss or loss of use
				of both hands.</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idBCB355B9856940BFB33000E7A19F0C90"><enum>(C)</enum><text>A
				permanent and total disability that is due to a severe burn injury (as so
				determined).</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="idB214EDB6B5144AAC9968B57E0B56E6D4"><enum><added-phrase committee-id="SSVA00" reported-display-style="italic">(b)</added-phrase></enum><header>Effective

				apply with respect to claims filed after September 30,

			 month of death benefit for surviving spouses of veterans who die while entitled
			 to compensation or pension</header>
				<subsection id="IDfb450b943060471f83bdcb5b8494a248"><enum>(a)</enum><header>Surviving spouse
			 benefit for month of veteran's death</header><text>Subsections (a) and (b) of
			 section 5310 are amended to read as follows:</text>

				surviving spouse of a veteran is entitled to a benefit for the month of the
				veteran's death if—</text>
								<subparagraph changed="added" committee-id="SSVA00" id="id67B0F29AFE474A9E933C5B1551321C9E" indent="up1" reported-display-style="italic"><enum>(A)</enum><text>at the time of the
				veteran's death, the veteran was receiving compensation or pension under
				chapter 11 or 15 of this title; or</text>
								</subparagraph><subparagraph changed="added" committee-id="SSVA00" id="idB69B284AB5C74E058C62B206D0E47BB0" indent="up1" reported-display-style="italic"><enum>(B)</enum><text>the veteran is determined
				for purposes of section 5121 or 5121A of this title as having been entitled to
				receive compensation or pension under chapter 11 or 15 of this title for the
				month of the veteran's death.</text>
								</subparagraph></paragraph><paragraph changed="added" committee-id="SSVA00" id="id40A3B95389E546DEA2FFA3669B52A263" indent="up1" reported-display-style="italic"><enum>(2)</enum><text>The amount of the benefit
				under paragraph (1) is the amount that the veteran would have received under
				chapter 11 or 15 of this title, as the case may be, for the month of the
				veteran's death had the veteran not died.</text>
							</paragraph></subsection><subsection id="ID3143cb7e52c24366a5852e0550beaccb"><enum>(b)</enum><header>Claims pending
				adjudication</header><text>If a claim for entitlement to compensation or
				additional compensation under chapter 11 of this title or pension or additional
				pension under chapter 15 of this title is pending at the time of a veteran's
				death and the check or other payment issued to the veteran's surviving spouse
				under subsection (a) is less than the amount of the benefit the veteran would
				have been entitled to for the month of death pursuant to the adjudication of
				the pending claim, an amount equal to the difference between the amount to
				which the veteran would have been entitled to receive under chapter 11 or 15 of
				this title for the month of the veteran's death had the veteran not died and
				the amount of the check or other payment issued to the surviving spouse shall
				be treated in the same manner as an accrued benefit under section 5121 of this
				title.</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="IDcdafc80cb0d0486c96bb7238ec9b47b5"><enum>(b)</enum><header>Month of death benefit
			 exempt from delayed commencement of payment</header><text>Section 5111(c)(1) is
			 amended by striking <quote>apply to</quote> and all that follows through
			 <quote>death occurred</quote> and inserting the following: <quote>not apply to
			 payments made pursuant to section 5310 of this title</quote>.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="IDa2dadabecff749cba043c434ee57182a"><enum>(c)</enum><header>Effective
			 date</header><text>The amendments made by this section shall take effect on the
			 date of the enactment of this Act, and shall apply with respect to deaths that
			 occur on or after that date.</text>
				</subsection></section><section commented="no" display-inline="no-display-inline" id="idb51221bb-4773-4f3f-8e01-3696321ee9cb" section-type="subsequent-section"><enum>404.</enum><header display-inline="yes-display-inline">Automatic waiver of agency of original
			 jurisdiction review of new evidence</header>
				<subsection commented="no" display-inline="no-display-inline" id="id4c54c3a5-0c7b-4773-99e7-0935f66faa15"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 7105 is amended by adding at the
			 end the following new subsection:</text>
					<quoted-block changed="added" committee-id="SSVA00" display-inline="no-display-inline" id="id59a31da6-ab1e-4815-896a-e70435cde374" reported-display-style="italic" style="OLC">
						<subsection commented="no" display-inline="no-display-inline" id="id4d974299-b8d4-4555-a7a0-3b173e453246"><enum>(e)</enum><paragraph commented="no" display-inline="yes-display-inline" id="id027848D72906419D9EB7C47A66C527E1"><enum>(1)</enum><text display-inline="yes-display-inline">If, either at the time or after the agency
				of original jurisdiction receives a substantive appeal, the claimant or the
				claimant's representative, if any, submits evidence to either the agency of
				original jurisdiction or the Board of Veterans' Appeals for consideration in
				connection with the issue or issues with which disagreement has been expressed,
				such evidence shall be subject to initial review by the Board unless the
				claimant or the claimant's representative, as the case may be, requests in
				writing that the agency of original jurisdiction initially review such
				evidence.</text>
							</paragraph><paragraph changed="added" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="id16E2F6AEAC2D4A1AB943635A16A34CC9" indent="up1" reported-display-style="italic"><enum>(2)</enum><text display-inline="yes-display-inline">A request for review of evidence under
				paragraph (1) shall accompany the submittal of the
				evidence.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="id8874b258-eccf-49f3-ac21-d870457921de"><enum>(b)</enum><header display-inline="yes-display-inline">Effective
			 date</header><text display-inline="yes-display-inline">Subsection (e) of such
			 section, as added by subsection (a), shall take effect on the date that is 180
			 days after the date of the enactment of this Act, and shall apply with respect
			 to claims for which a substantive appeal is filed on or after the date that is
			 180 days after the date of the enactment of this Act.</text>
				</subsection></section></title><title changed="added" committee-id="SSVA00" id="idAD76C1334C1042D8A22F9566B06F0294" reported-display-style="italic"><enum>V</enum><header>Memorial, burial, and
			 cemetery matters</header>
			<section commented="no" display-inline="no-display-inline" id="id3D7DA18412AE4E4A9C36E169B526CE2A"><enum>501.</enum><header>Prohibition on
			 disruptions of funerals of members or former members of the Armed
			 Forces</header>
				<subsection id="id6EC9E447BC704B8CAAC5DC04F9F3210C"><enum>(a)</enum><header>Purpose and
			 authority</header>
					<paragraph id="idE7429EF0686B4522B291DCA4E4BF96F6"><enum>(1)</enum><header>Purpose</header><text>The
			 purpose of this section is to provide necessary and proper support for the
			 recruitment and retention of the Armed Forces and militia employed in the
			 service of the United States by protecting the dignity of the service of the
			 members of such Forces and militia, and by protecting the privacy of their
			 immediate family members and other attendees during funeral services for such
			 members.</text>
					</paragraph><paragraph id="id2BE0224223444934889BD4E5F335CA5B"><enum>(2)</enum><header>Constitutional
			 authority</header><text>Congress finds that this section is a necessary and
			 proper exercise of its powers under the Constitution, article I, section 8,
			 paragraphs 1, 12, 13, 14, 16 and 18, to provide for the common defense, raise
			 and support armies, provide and maintain a navy, make rules for the government
			 and regulation of the land and naval forces, and provide for organizing and
			 governing such part of the militia as may be employed in the service of the
			 United States.</text>
					</paragraph></subsection><subsection id="idE1F0ECEC8F684FCC856825B510766F8C"><enum>(b)</enum><header>Amendment to title
			 18</header><text>Section 1388 of title 18, United States Code, is amended to
			 read as follows:</text>
					<quoted-block changed="added" committee-id="SSVA00" display-inline="no-display-inline" id="idB5C29881FE56421EABC74AED8294C87C" reported-display-style="italic" style="USC">
						<section id="IDd723edaa346d49e890a4f9a8395c807d"><enum>1388.</enum><header>Prohibition on
				disruptions of funerals of members or former members of the Armed
				Forces</header>
							<subsection id="ID30ed6f5c08964ae38178d46b29b10d35"><enum>(a)</enum><header>Prohibition</header><text>For
				any funeral of a member or former member of the Armed Forces that is not
				located at a cemetery under the control of the National Cemetery Administration
				or part of Arlington National Cemetery, it shall be unlawful for any person to
				engage in an activity during the period beginning 120 minutes before and ending
				120 minutes after such funeral, any part of which activity—</text>
								<paragraph id="IDac01442aa1d24b89bd89152c9aad730b"><enum>(1)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id1000EC55926D46BDAD01B60558E5778B"><enum>(A)</enum><text>takes place within the
				boundaries of the location of such funeral or takes place within 300 feet of
				the point of the intersection between—</text>
										<clause changed="added" committee-id="SSVA00" id="id7C93DCB341B64E0E9AABEEEAFDBBFA57" indent="up1" reported-display-style="italic"><enum>(i)</enum><text>the boundary of the
				location of such funeral; and</text>
										</clause><clause changed="added" committee-id="SSVA00" id="idEC516C9B3F5B4797A9651F1447F1B383" indent="up1" reported-display-style="italic"><enum>(ii)</enum><text>a road, pathway, or
				other route of ingress to or egress from the location of such funeral;
				and</text>
										</clause></subparagraph><subparagraph changed="added" committee-id="SSVA00" id="id25F270AB954A45C995E105AEB36C1C28" indent="up1" reported-display-style="italic"><enum>(B)</enum><text>includes any individual
				willfully making or assisting in the making of any noise or diversion—</text>
										<clause id="id3DE3857C3DC24856B0FC68E392B6B67F"><enum>(i)</enum><text>that is not part of such
				funeral and that disturbs or tends to disturb the peace or good order of such
				funeral; and</text>
										</clause><clause id="idC69DF25EBDE6428DA110D7B51CED6AB5"><enum>(ii)</enum><text>with the intent of
				disturbing the peace or good order of such funeral;</text>
										</clause></subparagraph></paragraph><paragraph id="ID8c465d0d765b46d09bd6421c9dfa7c59"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idA045DF0AE01E4E599DAD407758EA6642"><enum>(A)</enum><text>is within 500 feet of
				the boundary of the location of such funeral; and</text>
									</subparagraph><subparagraph changed="added" committee-id="SSVA00" id="id0865C643D5AB49278E3A417EBBA1C640" indent="up1" reported-display-style="italic"><enum>(B)</enum><text>includes any
				individual—</text>
										<clause id="id61BC0024529A46B896F224D14D3BE967"><enum>(i)</enum><text>willfully and without
				proper authorization impeding or tending to impede the access to or egress from
				such location; and</text>
										</clause><clause id="idAA780BA846624188A917460BE4262071"><enum>(ii)</enum><text>with the intent to
				impede the access to or egress from such location; or</text>
										</clause></subparagraph></paragraph><paragraph id="ID72bb81b0730b4bc6aaac5c93004a1eb3"><enum>(3)</enum><text>is on or near the
				boundary of the residence, home, or domicile of any surviving member of the
				deceased person's immediate family and includes any individual willfully making
				or assisting in the making of any noise or diversion—</text>
									<subparagraph id="id039F1E7CB189437592E688D9CF4951BE"><enum>(A)</enum><text>that disturbs or tends to
				disturb the peace of the persons located at such location; and</text>
									</subparagraph><subparagraph id="id41171584141049599120116BC38828D7"><enum>(B)</enum><text>with the intent of
				disturbing such peace.</text>
									</subparagraph></paragraph></subsection><subsection id="IDae85ea66c66f44b185f3f48f9e3f6e3c"><enum>(b)</enum><header>Penalty</header><text>Any
				person who violates subsection (a) shall be fined under this title or
				imprisoned for not more than 1 year, or both.</text>
							</subsection><subsection id="ID00228f58a5614610a41dc2894745a905"><enum>(c)</enum><header>Civil remedies</header>
								<paragraph id="ID3a912e8ad1e04376813749f37a8f47d1"><enum>(1)</enum><header>District
				courts</header><text>The district courts of the United States shall have
				jurisdiction—</text>
									<subparagraph id="id2CE5A30DF8484114A549F0F78D7E320A"><enum>(A)</enum><text>to prevent and restrain
				violations of this section; and</text>
									</subparagraph><subparagraph id="id7B69DF9EF94C42EBB25D99EA73A7BA15"><enum>(B)</enum><text>for the adjudication of
				any claims for relief under this section.</text>
									</subparagraph></paragraph><paragraph id="IDc0d49742888e417489df373708556c4f"><enum>(2)</enum><header>Attorney
				general</header><text>The Attorney General may institute proceedings under this
				section.</text>
								</paragraph><paragraph id="ID2d4a99ff91f74e1d82217c8f19a39687"><enum>(3)</enum><header>Claims</header><text>Any
				person, including a surviving member of the deceased person's immediate family,
				who suffers injury as a result of conduct that violates this section
				may—</text>
									<subparagraph id="id5D8AFB224D3444FAA70EA98C9A14FD35"><enum>(A)</enum><text>sue therefor in any
				appropriate United States district court or in any court of competent
				jurisdiction; and</text>
									</subparagraph><subparagraph id="idA7CF5B89DD4349E7858A832880D801C0"><enum>(B)</enum><text>recover damages as
				provided in subsection (d) and the cost of the suit, including reasonable
				attorneys’ fees.</text>
									</subparagraph></paragraph><paragraph id="ID24898e9af6c545a38da0da22ff4909d3"><enum>(4)</enum><header>Estoppel</header><text>A
				final judgment or decree rendered in favor of the United States in any criminal
				proceeding brought by the United States under this section shall estop the
				defendant from denying the essential allegations of the criminal offense in any
				subsequent civil proceeding brought by a person or by the United States.</text>
								</paragraph></subsection><subsection id="ID22835c1308764a0d8079871945a2d364"><enum>(d)</enum><header>Actual and statutory
				damages</header>
								<paragraph id="ID49a539d635564a2fb5bd2b4a8a7c6a1f"><enum>(1)</enum><header>In
				general</header><text>In addition to any penalty imposed under subsection (b),
				a violator of this section is liable in an action under subsection (c) for
				actual or statutory damages as provided in this subsection.</text>
								</paragraph><paragraph id="ID69916f6021a44441b9f1e971d3a8979b"><enum>(2)</enum><header>Actions by private
				persons</header><text>A person bringing an action under subsection (c)(3) may
				elect, at any time before final judgment is rendered, to recover the actual
				damages suffered by him or her as a result of the violation or, instead of
				actual damages, an award of statutory damages for each violation involved in
				the action.</text>
								</paragraph><paragraph id="ID31ced91bd7f64995812c362cb28b553d"><enum>(3)</enum><header>Actions by Attorney
				General</header><text>In any action under subsection (c)(2), the Attorney
				General is entitled to recover an award of statutory damages for each violation
				involved in the action notwithstanding any recovery under subsection
				(c)(3).</text>
								</paragraph><paragraph id="ID9c13b0bab62c4963875fbf5edf8abb3c"><enum>(4)</enum><header>Statutory
				damages</header><text>A court may award, as the court considers just, statutory
				damages in a sum of not less than $25,000 or more than $50,000 per
				violation.</text>
								</paragraph></subsection><subsection id="id71FDF03E5F414A38953F50D86C665490"><enum>(e)</enum><header>Rebuttable
				presumption</header><text>It shall be a rebuttable presumption that the
				violation was committed willfully for purposes of determining relief under this
				section if the violator, or a person acting in concert with the violator, did
				not have reasonable grounds to believe, either from the attention or publicity
				sought by the violator or other circumstance, that the conduct of such violator
				or person would not disturb or tend to disturb the peace or good order of such
				funeral, impede or tend to impede the access to or egress from such funeral, or
				disturb or tend to disturb the peace of any surviving member of the deceased
				person's immediate family who may be found on or near the residence, home, or
				domicile of the deceased person's immediate family on the date of the service
				or ceremony.</text>
							</subsection><subsection id="ID1fd7abcdd1da4560a27d4ea5bd49a6f1"><enum>(f)</enum><header>Definitions</header><text>In
				this section—</text>
								<paragraph id="id431E1CC427E744249B1E2BF8D904A0A9"><enum>(1)</enum><text>the term <term>Armed
				Forces</term> has the meaning given the term in section 101 of title 10 and
				includes members and former members of the National Guard who were employed in
				the service of the United States; and</text>
								</paragraph><paragraph id="idBC99DF03300E4119B58413C445959E75"><enum>(2)</enum><text>the term <term>immediate
				family</term> means, with respect to a person, the immediate family members of
				such person, as such term is defined in section 115 of this
				title.</text>
								</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="id7B97ED4EED304723B43CE71A1DFFFF3C"><enum>(c)</enum><header>Amendment to title
			 38</header>
					<paragraph id="id6A9D66716D2B40FDA636C7B8A365D0BF"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 2413 is
			 amended to read as follows:</text>
						<quoted-block changed="added" committee-id="SSVA00" display-inline="no-display-inline" id="id6F8066BCBEFC436697C2611921967896" reported-display-style="italic" style="USC">
							<section id="id985D8D2C74874A5781D54077BF6DB2AE"><enum>2413.</enum><header>Prohibition on
				certain demonstrations and disruptions at cemeteries under control of the
				National Cemetery Administration and at Arlington National Cemetery</header>
								<subsection id="idDF49309D70744D94AEE809E738DCC3D8"><enum>(a)</enum><header>Prohibition</header><text>It
				shall be unlawful for any person—</text>
									<paragraph id="id1B9CDDD16BEC4C4E8CF76AA64CACEDCA"><enum>(1)</enum><text>to carry out a
				demonstration on the property of a cemetery under the control of the National
				Cemetery Administration or on the property of Arlington National Cemetery
				unless the demonstration has been approved by the cemetery superintendent or
				the director of the property on which the cemetery is located; or</text>
									</paragraph><paragraph id="idAAC1496C9CD74A5F87D2A9925D8F78EF"><enum>(2)</enum><text>with respect to such a
				cemetery, to engage in a demonstration during the period beginning 120 minutes
				before and ending 120 minutes after a funeral, memorial service, or ceremony is
				held, any part of which demonstration—</text>
										<subparagraph id="id5A8B5EFF73BB4B3EAE990C296A8B5F2D"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="id3DEC1524299548058C3495E8FA129D17"><enum>(i)</enum><text>takes place within the
				boundaries of such cemetery or takes place within 300 feet of the point of the
				intersection between—</text>
												<subclause changed="added" committee-id="SSVA00" id="id0C345094D67C4618BB91ECD3966156E8" indent="up1" reported-display-style="italic"><enum>(I)</enum><text>the boundary of such
				cemetery; and</text>
												</subclause><subclause changed="added" committee-id="SSVA00" id="id616925B33FA8478F8B3719A75F0119D1" indent="up1" reported-display-style="italic"><enum>(II)</enum><text>a road, pathway, or
				other route of ingress to or egress from such cemetery; and</text>
												</subclause></clause><clause changed="added" committee-id="SSVA00" id="id37475EF0D3724559BBC85821229A5C69" indent="up1" reported-display-style="italic"><enum>(ii)</enum><text>includes any individual
				willfully making or assisting in the making of any noise or diversion—</text>
												<subclause id="id9C730733D265493E80F02BA9FEA9BC0E"><enum><added-phrase committee-id="SSVA00" reported-display-style="italic">(I)</added-phrase></enum><text>that is not part
				of such funeral, memorial service, or ceremony and that disturbs or tends to
				disturb the peace or good order of such funeral, memorial service, or ceremony;
				and</text>
												</subclause><subclause id="id7E8BB0B9625A4576BABB06740A7319D3"><enum>(II)</enum><text>with the intent of
				disturbing the peace or good order of such funeral, memorial service, or
				ceremony; or</text>
												</subclause></clause></subparagraph><subparagraph id="id366B113738C34ADE82C3896076584139"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="idD91718C7D61F47FF86831CC0F4C956F6"><enum>(i)</enum><text>is within 500 feet of
				the boundary of such cemetery; and</text>
											</clause><clause changed="added" committee-id="SSVA00" id="id3110F730764C499BA0A0822D5B2B8271" indent="up1" reported-display-style="italic"><enum>(ii)</enum><text>includes any
				individual—</text>
												<subclause id="id107A94E3777047EAB5DA88F2D114C584"><enum><added-phrase committee-id="SSVA00" reported-display-style="italic">(I)</added-phrase></enum><text>willfully and
				without proper authorization impeding or tending to impede the access to or
				egress from such cemetery; and</text>
												</subclause><subclause id="id4C0DD1832AE74DA19B470637E69DE28F"><enum>(II)</enum><text>with the intent to
				impede the access to or egress from such cemetery.</text>
												</subclause></clause></subparagraph></paragraph></subsection><subsection id="id1291EEDC9FFA413DA14CC3AADC45C651"><enum>(b)</enum><header>Penalty</header><text>Any
				person who violates subsection (a) shall be fined under title 18 or imprisoned
				for not more than one year, or both.</text>
								</subsection><subsection id="idA6476D309FC4409B81DB9FD12FC7AFD9"><enum>(c)</enum><header>Civil
				remedies</header><paragraph commented="no" display-inline="yes-display-inline" id="id6B7AA906A0644039868303B4424F16EB"><enum>(1)</enum><text>The district courts of
				the United States shall have jurisdiction—</text>
										<subparagraph changed="added" committee-id="SSVA00" id="idCF6821C430704891A39BAAD48A3C8B4A" indent="up1" reported-display-style="italic"><enum>(A)</enum><text>to prevent and restrain

										</subparagraph></paragraph><paragraph changed="added" committee-id="SSVA00" id="id9FBD6F4222754A908E32F984BDFE1EC6" indent="up1" reported-display-style="italic"><enum>(2)</enum><text>The Attorney General of
				the United States may institute proceedings under this section.</text>
									</paragraph><paragraph changed="added" committee-id="SSVA00" id="idD2CF7337697A42C6ABC55414650ACF29" indent="up1" reported-display-style="italic"><enum>(3)</enum><text>Any person, including a
				surviving member of the deceased person's immediate family, who suffers injury
				as a result of conduct that violates this section may—</text>
										<subparagraph id="id7EB18CDFFDFC43D38302A979875ED77D"><enum>(A)</enum><text>sue therefor in any
				appropriate United States district court or in any court of competent
				jurisdiction; and</text>
										</subparagraph><subparagraph id="idCE06305EA8C84DC0B7C04022619BBB5D"><enum>(B)</enum><text>recover damages as
				provided in subsection (d) and the cost of the suit, including reasonable
				attorneys’ fees.</text>
										</subparagraph></paragraph><paragraph changed="added" committee-id="SSVA00" id="id02760BBD2CE843768AD66E79F776DF18" indent="up1" reported-display-style="italic"><enum>(4)</enum><text>A final judgment or
				decree rendered in favor of the United States in any criminal proceeding
				brought by the United States under this section shall estop the defendant from
				denying the essential allegations of the criminal offense in any subsequent
				civil proceeding brought by a person or by the United States.</text>

									</paragraph><paragraph changed="added" committee-id="SSVA00" id="idD5ECC40424284283BDD39B8C80AB0E88" indent="up1" reported-display-style="italic"><enum>(4)</enum><text>A court may award, as the

									</paragraph><paragraph id="idDC870FBE6801477A92152AAE32FF81F1"><enum>(2)</enum><text>impede or tend to impede
				the access to or egress from such funeral, memorial service, or
				ceremony.</text>
									</paragraph></subsection><subsection id="ID04008bd131ad428b9be8c5ffdb451cf4"><enum>(f)</enum><header>Definitions</header><text>In
				this section—</text>
									<paragraph id="id00013C03AF284AAB8E823A77FDA70DA4"><enum>(1)</enum><text>the term
				<term>demonstration</term> includes—</text>
										<subparagraph id="IDde02a527611e4ff8b5b13d533be1338d"><enum>(A)</enum><text>any picketing or similar
				conduct;</text>
										</subparagraph><subparagraph id="IDe45449c493524c47aee37632b85a1579"><enum>(B)</enum><text>any oration, speech, use
				of sound amplification equipment or device, or similar conduct that is not part
				of a funeral, memorial service, or ceremony;</text>
										</subparagraph><subparagraph id="IDb9a5359ac31b4913924a714d986db633"><enum>(C)</enum><text>the display of any
				placard, banner, flag, or similar device, unless such a display is part of a
				funeral, memorial service, or ceremony; and</text>
										</subparagraph><subparagraph id="IDc6bac8cc597c4c419a6335afce14ae3c"><enum>(D)</enum><text>the distribution of any
				handbill, pamphlet, leaflet, or other written or printed matter other than a
				program distributed as part of a funeral, memorial service, or ceremony;
				and</text>
										</subparagraph></paragraph><paragraph id="id206599A149304A748BC67CE37EB959BF"><enum>(2)</enum><text>the term <term>immediate
				family</term> means, with respect to a person, the immediate family members of
				such person, as such term is defined in section 115 of title
				18.</text>
									</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph><paragraph id="id0CA169DE34B94B9B9516ACDA321BA298"><enum>(2)</enum><header>Clerical
			 amendment</header><text>The table of sections at the beginning of chapter 24 is
			 amended by striking the item relating to section 2413 and inserting the

				one gravesite may be provided at Arlington National Cemetery to a veteran or
				member of the Armed Forces who is eligible for interment or inurnment at such
				cemetery.</text>
								</paragraph><paragraph changed="added" committee-id="SSVA00" id="idC30D504E7FD44A55B338586E41A0C806" indent="up1" reported-display-style="italic"><enum>(2)</enum><text>The Secretary of the Army
				may waive the prohibition in paragraph (1) as the Secretary of the Army
				considers appropriate.</text>
								</paragraph></subsection><subsection id="idB8D6173CADCB42EEA44DF3C47EBFB24C"><enum>(b)</enum><header>Prohibition against
				reservation of gravesites</header><text>A gravesite at Arlington National
				Cemetery may not be reserved for an individual before the death of such
				individual.</text>
							</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="idE858AF5C50324371873D06F0DFBE9F44"><enum>(b)</enum><header>Clerical
			 amendment</header><text>The table of sections at the beginning of such chapter

				</subsection><subsection id="id8B82E9A5CDEF4401A41FEABA543277E5"><enum>(c)</enum><header>Applicability</header>
					<paragraph id="id9266CAA244F24220AB9982ECB65FFD04"><enum>(1)</enum><header>In
			 general</header><text>Except as provided in paragraph (2), section 2410A of
			 title 38, United States Code, as added by subsection (a), shall apply with
			 respect to all interments at Arlington National Cemetery after the date of the
			 enactment of this Act.</text>
					</paragraph><paragraph id="idBBC29E47A92A443397B43ED48772FB0B"><enum>(2)</enum><header>Exception</header><text>Subsection
			 (b) of such section, as so added, shall not apply with respect to the interment
			 of an individual for whom a request for a reserved gravesite was approved by
			 the Secretary of the Army before January 1, 1962.</text>
					</paragraph></subsection><subsection id="id711267D7708D40EF8B6353655E9D6926"><enum>(d)</enum><header>Report</header>
					<paragraph id="idCF319E6F366B40E39BBBA38FB02A4B8B"><enum>(1)</enum><header>In
			 general</header><text>Not later than 180 days after the date of the enactment
			 of this Act, the Secretary of the Army shall submit to Congress a report on
			 reservations made for interment at Arlington National Cemetery.</text>
					</paragraph><paragraph id="idBD693788D1C74D549A5F2165F282558B"><enum>(2)</enum><header>Elements</header><text>The
			 report required by paragraph (1) shall include the following:</text>
						<subparagraph id="ID66806298e8b24dbe847cef07e51f1a56"><enum>(A)</enum><text>The number of requests
			 for reservation of a gravesite at Arlington National Cemetery that were
			 submitted to the Secretary of the Army before January 1, 1962.</text>
						</subparagraph><subparagraph id="id96EB8776DE744EF280E465EE740C2F17"><enum>(B)</enum><text>The number of gravesites
			 at such cemetery that, on the day before the date of the enactment of this Act,
			 were reserved in response to such requests.</text>
						</subparagraph><subparagraph id="id0783EF02425B433DBEA43F5CBC0CF362"><enum>(C)</enum><text>The number of such
			 gravesites that, on the day before the date of the enactment of this Act, were
			 unoccupied.</text>
						</subparagraph><subparagraph id="idE16054D4A86A46009BA1A91249C85486"><enum>(D)</enum><text>A list of all
			 reservations for gravesites at such cemetery that were extended by individuals
			 responsible for management of such cemetery in response to requests for such
			 reservations made on or after January 1, 1962.</text>
						</subparagraph><subparagraph id="IDe8705410f27c41ecab229d97341e8629"><enum>(E)</enum><text>A description of the
			 measures that the Secretary is taking to improve the accountability and
			 transparency of the management of gravesite reservations at Arlington National
			 Cemetery.</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idD6C428ACC6C140D0853EB9B76FEAD4BF"><enum>(F)</enum><text>Such recommendations as
			 the Secretary may have for legislative action as the Secretary considers
			 necessary to improve such accountability and transparency.</text>
						</subparagraph></paragraph></subsection></section><section id="IDf7a60b0484324b55a6e9c2ccba6f26c0"><enum>503.</enum><header>Expansion of
			 eligibility for presidential memorial certificates to persons who died in the

			 projects authorized in sections 601, 602, and 603 may only be carried out
			 using—</text>

			 fiscal year 2012 pursuant to the authorization of appropriations in subsection
			 (a) of this section;</text>

			 title 38, United States Code, is amended by adding at the end the following new
			 subparagraph:</text>

			 veterans affected by natural disasters</header>
				<subsection id="idBA6DBD00A5F148C7933FAF53F0132944"><enum>(a)</enum><header>Additional grants for
			 disabled veterans for specially adapted housing</header>
					<paragraph id="id14044E934BF941C4ABF06EC32DBC33BC"><enum>(1)</enum><header>In
			 general</header><text>Chapter 21 is amended by adding at the end the following
			 new section:</text>

								<subsection id="idEF0C3DFDF4874530876BBDF21BAB2DE7"><enum>(a)</enum><header>In
				general</header><text>Notwithstanding the provisions of section 2102 of this
				title, the Secretary may award a grant to a veteran whose home was previously
				adapted with assistance of a grant under this chapter in the event the adapted
				home which was being used and occupied by the veteran was destroyed or
				substantially damaged in a natural or other disaster, as determined by the
				Secretary.</text>
								</subsection><subsection id="id67365AA0CE0942CBA7D441730F0E959C"><enum>(b)</enum><header>Use of
				funds</header><text>A grant awarded under subsection (a) shall be available to
				acquire a suitable housing unit with special fixtures or moveable facilities
				made necessary by the veteran's disability, and necessary land therefor.</text>
								</subsection><subsection id="id89F2BBB59B9F43E2BA786235E00384C3"><enum>(c)</enum><header>Limitations</header><text>The
				amount of the grant awarded under subsection (a) may not exceed the lesser
				of—</text>
									<paragraph id="idDEC967E7416A4A0895B8CD720A783EE5"><enum>(1)</enum><text>the reasonable cost, as
				determined by the Secretary, of repairing or replacing the damaged or destroyed
				home in excess of the available insurance coverage on such home; or</text>
									</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id55AF2ACAA86B4854A18F0C419C462B18"><enum>(2)</enum><text>the maximum grant amount
				to which the veteran would have been entitled under subsection (a) or (b) of
				section 2102 of this title had the veteran not obtained the prior
				grant.</text>
									</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph><paragraph id="id6C11BEB2C5E6493E866E504ECA584CA2"><enum>(2)</enum><header>Clerical
			 amendment</header><text display-inline="yes-display-inline">The table of
			 sections at the beginning of such chapter is amended by inserting after the
			 item relating to section 2108 the following new item:</text>

					<paragraph id="idD5A5F2DE69DF42338933768D1E97B2BC"><enum>(1)</enum><text>by inserting
			 <quote>(A)</quote> before <quote>In</quote>; and</text>
					</paragraph><paragraph id="id6711ADF5615F41AFA8F5A73E584583BB"><enum>(2)</enum><text>by adding at the end the
			 following new subparagraph:</text>
						<quoted-block changed="added" committee-id="SSVA00" display-inline="no-display-inline" id="id834E6F9161AC4171B4818A8BE5880764" reported-display-style="italic" style="OLC">
							<subparagraph id="id8E44700069054108A42FB2CEF3128AA9" indent="up2"><enum>(B)</enum><text>In any case in which the
				Secretary determines that a veteran described in subparagraph (A) has been
				displaced as the result of a natural or other disaster while being paid a
				subsistence allowance under that subparagraph, as determined by the Secretary,
				the Secretary may extend the payment of a subsistence allowance under such
				subparagraph for up to an additional two months while the veteran is
				satisfactorily following a program of employment services described in such
				subparagraph.</text>
							</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection id="id515BC9BBC7D04F9CB263E4364C029FB6"><enum>(c)</enum><header>Waiver of limitation on
			 program of independent living services and assistance</header><text>Section
			 3120(e) is amended—</text>
					<paragraph id="id9D8BFC1A48DA449B9DCEFD77C2EAD7C8"><enum>(1)</enum><text>by inserting
			 <quote>(1)</quote> before <quote>Programs</quote>; and</text>
					</paragraph><paragraph id="id071D6E8AA215464290F275CA7933A348"><enum>(2)</enum><text>by adding at the end the
			 following new paragraph:</text>
						<quoted-block changed="added" committee-id="SSVA00" display-inline="no-display-inline" id="idDA5B9A180CE44F979F7ACA6DD21CBC07" reported-display-style="italic" style="OLC">
							<paragraph id="id55A2F84B912E40DCADC8020D542130C9" indent="up1"><enum>(2)</enum><text>The limitation in
				paragraph (1) shall not apply in any case in which the Secretary determines
				that a veteran described in subsection (b) has been displaced as the result of,
				or has otherwise been adversely affected in the areas covered by, a natural or
				other disaster, as determined by the
				Secretary.</text>
							</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection id="idFACB28B66D8349A0B875400296681DC1"><enum>(d)</enum><header>Covenants and liens
			 created by public entities in response to disaster-Relief
			 assistance</header><text>Paragraph (3) of section 3703(d) is amended to read as
			 follows:</text>
					<quoted-block changed="added" committee-id="SSVA00" display-inline="no-display-inline" id="id00B5CBA478794618A3646DE3FD72A95C" reported-display-style="italic" style="OLC">
						<paragraph id="ID7d69a6e80c0847bbaff63507dfa90120" indent="up1"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idB4BF62106ACE4CBABD287360E76D8295"><enum>(A)</enum><text>Any real estate housing
				loan (other than for repairs, alterations, or improvements) shall be secured by
				a first lien on the realty. In determining whether a loan is so secured, the
				Secretary may either disregard or allow for subordination to a superior lien
				created by a duly recorded covenant running with the realty in favor of either
				of the following:</text>
								<clause changed="added" committee-id="SSVA00" id="IDc6b3a7378b3f4fa491cdfec038a0713f" indent="up1" reported-display-style="italic"><enum>(i)</enum><text>A public entity that has
				provided or will provide assistance in response to a major disaster as
				determined by the President under the Robert T. Stafford Disaster Relief and
				Emergency Assistance Act (42 U.S.C. 5121 et seq.).</text>
								</clause><clause changed="added" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="ID861b78cb27a243c6ba4dd7a6539515e2" indent="up1" reported-display-style="italic"><enum>(ii)</enum><text>A
				private entity to secure an obligation to such entity for the homeowner's share
				of the costs of the management, operation, or maintenance of property,
				services, or programs within and for the benefit of the development or
				community in which the veteran's realty is located, if the Secretary determines
				that the interests of the veteran borrower and of the Government will not be
				prejudiced by the operation of such covenant.</text>
								</clause></subparagraph><subparagraph changed="added" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="id94688607AF0843A9B5C5BA652C684A42" indent="up1" reported-display-style="italic"><enum>(B)</enum><text>With
				respect to any superior lien described in subparagraph (A) created after June
				6, 1969, the Secretary's determination under clause (ii) of such subparagraph
				shall have been made prior to the recordation of the
				covenant.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="id69C511EAFCC14D68BAF9790B2837F3B5"><enum>(e)</enum><header>Automobiles and other
			 conveyances for certain disabled veterans and members of the Armed
			 Forces</header><text>Section 3903(a) is amended—</text>
					<paragraph id="id29633306C77C4467A97544EC7960352A"><enum>(1)</enum><text>by striking
			 <quote>No</quote> and inserting <quote>(1) Except as provided in paragraph (2),
			 no</quote>; and</text>
					</paragraph><paragraph id="idB48843A6DE494A098DDECACDE5DFF697"><enum>(2)</enum><text>by adding at the end the
			 following new paragraph:</text>

							<paragraph id="id300EE4CED2EE449A964875A3E2BA8BDE" indent="up1"><enum>(2)</enum><text>The Secretary may provide
				or assist in providing an eligible person with a second automobile or other
				conveyance under this chapter if—</text>
								<subparagraph id="idFC49ED3CD2534166A4C95D1E0368B193"><enum>(A)</enum><text>the Secretary receives
				satisfactory evidence that the automobile or other conveyance previously
				purchased with assistance under this chapter was destroyed—</text>
									<clause id="id97FA226C782D42E5BF18BBD08EE702A4"><enum>(i)</enum><text>as a result of a natural
				or other disaster, as determined by the Secretary; and</text>
									</clause><clause id="idBA7EED11668D46F8BEEE204FBD5D7017"><enum>(ii)</enum><text>through no fault of the
				eligible person; and</text>
									</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idFCAC4040DFCA4CE098D6B9F9CFC5494D"><enum>(B)</enum><text>the
				eligible person does not otherwise receive from a property insurer compensation
				for the
				loss.</text>
								</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection id="id0BD4A6685F3C45D3BF878C83D0326FA0"><enum><added-phrase committee-id="SSVA00" reported-display-style="italic">(f)</added-phrase></enum><header>Annual
			 report</header>
					<paragraph id="idDF9A49EB00694BC8AF8363E9463FFD97"><enum><added-phrase committee-id="SSVA00" reported-display-style="italic">(1)</added-phrase></enum><header>In
			 general</header><text>Each year, the Secretary of Veterans Affairs shall submit
			 to Congress a report on the assistance provided or action taken by the
			 Secretary in the last fiscal year pursuant to the authorities added by the
			 amendments made by this section.</text>
					</paragraph><paragraph id="idCFC517D805EB4902B160B01A3557439C"><enum>(2)</enum><header>Elements</header><text>Each
			 report submitted under paragraph (1) shall include the following for the fiscal
			 year covered by the report:</text>
						<subparagraph id="idC6268BFF5E4D4736BB389127610E2FAB"><enum><added-phrase committee-id="SSVA00" reported-display-style="italic">(A)</added-phrase></enum><text>A description of
			 each natural disaster for which assistance was provided or action was taken as
			 described in paragraph (1).</text>
						</subparagraph><subparagraph id="idCAB84A0DBB7A409CA1CB87AA51FBBEDF"><enum>(B)</enum><text>The number of cases or
			 individuals, as the case may be, in which or to whom the Secretary provided
			 assistance or took action as described in paragraph (1).</text>
						</subparagraph><subparagraph id="id530CDFD26426490C85F3FEF3FA34BBA9"><enum>(C)</enum><text>For each such case or
			 individual, a description of the type or amount of assistance or action taken,
			 as the case may be.</text>
						</subparagraph></paragraph></subsection></section><section id="id4856EA51619E458FA1322C940FF526A4"><enum>702.</enum><header>Aggregate amount of
			 educational assistance available to individuals who receive both survivors' and
			 dependents educational assistance and other veterans and related educational
			 assistance</header>
				<subsection id="idF7FA1983E9504AEDB738BFF37CE918CD"><enum>(a)</enum><header>Aggregate amount
			 available</header><text>Section 3695 is amended—</text>
					<paragraph id="id30F11373024646509CDF2964920FBF54"><enum>(1)</enum><text>in subsection (a)(4), by
			 striking <quote>35,</quote>; and</text>
					</paragraph><paragraph id="id1FCFE476772D4234A620A743FAE256EF"><enum>(2)</enum><text>by adding at the end the
			 following new subsection:</text>
						<quoted-block changed="added" committee-id="SSVA00" display-inline="no-display-inline" id="id5E939FB6CFD34398AAFDF5AFF336E94A" reported-display-style="italic" style="OLC">
							<subsection id="idF908309D7446443B9AA45F83057B1613"><enum>(c)</enum><text>The aggregate period for
				which any person may receive assistance under chapter 35 of this title, on the
				one hand, and any of the provisions of law referred to in subsection (a), on
				the other hand, may not exceed 81 months (or the part-time equivalent
				thereof).</text>
							</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection id="id16BA3E4DE6DB41CD95C2B3148DB80241"><enum>(b)</enum><header>Applicability</header><text>The
			 amendment made by subsection (a) shall take effect on October 1, 2011, and
			 shall not operate to revive any entitlement to assistance under chapter 35 of
			 title 38, United States Code, or the provisions of law referred to in section
			 3695(a) of such title, as in effect on the day before such date, that was
			 terminated by reason of the operation of section 3695(a) of such title, as so
			 in effect, before such date.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="idF68828F5F0044511A1D2CEC4EB30CD53"><enum>(c)</enum><header>Revival of entitlement
			 reduced by prior utilization of chapter 35 assistance</header>
					<paragraph commented="no" display-inline="no-display-inline" id="idD6C8FD5E14FA44B18AC0097E727D0D04"><enum>(1)</enum><header>In
			 general</header><text>Subject to paragraph (2), in the case of an individual
			 whose period of entitlement to assistance under a provision of law referred to
			 in section 3695(a) of title 38, United States Code (other than chapter 35 of
			 such title), as in effect on September 30, 2011, was reduced under such section
			 3695(a), as so in effect, by reason of the utilization of entitlement to
			 assistance under chapter 35 of such title before October 1, 2011, the period of
			 entitlement to assistance of such individual under such provision shall be
			 determined without regard to any entitlement so utilized by the individual
			 under chapter 35 of such title.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idDFF85BDE530B466FA178B19E5BF867D6"><enum>(2)</enum><header>Limitation</header><text>The
			 maximum period of entitlement to assistance of an individual under paragraph
			 (1) may not exceed 81 months.</text>
					</paragraph></subsection></section><section id="H484E02CD28434C4BBCAAC1E3D72C6630" section-type="subsequent-section"><enum>703.</enum><header>Department of
			 Veterans Affairs enforcement penalties for misrepresentation of a business
			 concern as a small business concern owned and controlled by veterans or as a
			 small business concern owned and controlled by service-disabled
			 veterans</header><text display-inline="no-display-inline">Subsection (g) of
			 section 8127 is amended—</text>
				<paragraph id="H40BA68E227164E5DA9C61A440E7EF000"><enum>(1)</enum><text>by striking <quote>Any
			 business</quote> and inserting <quote>(1) Any business</quote>;</text>
				</paragraph><paragraph id="H6E9A4EF8D41C4807B344F035EE8A27D2"><enum>(2)</enum><text>in paragraph (1), as so
			 designated—</text>
					<subparagraph id="idBFDFEC6E17164126B078CF07D1BF3D75"><enum>(A)</enum><text>by inserting
			 <quote>deliberately</quote> before <quote>misrepresented</quote>; and</text>
					</subparagraph><subparagraph id="id5259C7F0D23B437390DF7D148378516E"><enum><added-phrase committee-id="SSVA00" reported-display-style="italic">(B)</added-phrase></enum><text>by striking
			 <quote>a reasonable period of time, as determined by the Secretary</quote> and
			 inserting <quote>a period of not less than five years</quote>; and</text>
					</subparagraph></paragraph><paragraph id="H91F6114755F04DB9B1294555B422F699"><enum>(3)</enum><text>by adding at the end the
			 following new paragraphs:</text>
					<quoted-block changed="added" committee-id="SSVA00" display-inline="no-display-inline" id="HEE8F167C481E470F95E4A5B37D87D165" reported-display-style="italic" style="USC">
						<paragraph id="H00FA7A1BF8D34CC48AB96DFB96E83DB8" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">In the case of a debarment under paragraph
				(1), the Secretary shall commence debarment action against the business concern
				by not later than 30 days after determining that the concern misrepresented the
				status of the concern as described in paragraph (1) and shall complete
				debarment actions against such concern by not later than 90 days after such
				determination.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H9F05A323E3274BF7BBDB6F71B3B3C07E" indent="up1"><enum>(3)</enum><text>The
				debarment of a business concern under paragraph (1) includes the debarment of
				all principals in the business concern for a period of not less than five
				years.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></section><section commented="no" display-inline="no-display-inline" id="id0DB34699D5604220B5C949555042BE00" section-type="subsequent-section"><enum>704.</enum><header display-inline="yes-display-inline">Authority for certain persons to sign
			 claims filed with Secretary of Veterans Affairs on behalf of claimants</header>
				<subsection commented="no" display-inline="no-display-inline" id="id60659B62E62B4D18AE9B51B6EF935AE8"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 5101 is amended—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="id703D0E812E05410389CB6342D9D7E504"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="id7C85102343D5442ABCDA1C78A5F3C97C"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>A specific</quote> and
			 inserting <quote>(1) A specific</quote>; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5756098DA8134DBF8D9555FD6450C6E8"><enum>(B)</enum><text display-inline="yes-display-inline">by adding at the end the following new
			 paragraph:</text>
							<quoted-block changed="added" committee-id="SSVA00" display-inline="no-display-inline" id="idBA4D63C975FC46758F4A98C0625D1208" reported-display-style="italic" style="OLC">
								<paragraph commented="no" display-inline="no-display-inline" id="idA91E809FF2E54DA4B6F8CB9C06D43F7C" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">If an individual has not attained the age
				of 18 years, is mentally incompetent, or is physically unable to sign a form, a
				form filed under paragraph (1) for the individual may be signed by a
				court-appointed representative, a person who is responsible for the care of the
				individual, including a spouse or other relative, or an attorney in fact or
				agent authorized to act on behalf of the individual under a durable power of
				attorney. If the individual is in the care of an institution, the manager or
				principal officer of the institution may sign the
				form.</text>
								</paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6CA5C386A9B74376A210A541F0844DD5"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (c)—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="id9B99A8B00CA248E5B49C34F929825469"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (1)—</text>
							<clause commented="no" display-inline="no-display-inline" id="idDB50CD5BBB8547DEBB34CE419ED7963E"><enum>(i)</enum><text display-inline="yes-display-inline">by inserting <quote>, signs a form on
			 behalf of an individual to apply for,</quote> after <quote>who applies
			 for</quote>; and</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="id62440D5B252547838CB287A05EA64C4C"><enum>(ii)</enum><text display-inline="yes-display-inline">by inserting <quote>, or TIN in the case
			 that the person is not an individual,</quote> after <quote>of such
			 person</quote>; and</text>
							</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idFBB76DCB0FBC4B4284B0762C0457BC58"><enum>(B)</enum><text display-inline="yes-display-inline">in paragraph (2), by inserting <quote>or
			 TIN</quote> after <quote>social security number</quote> each place it appears;
			 and</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idE22D8B53A38748808D8B434248C3D7CD"><enum>(3)</enum><text display-inline="yes-display-inline">by adding at the end the following new
			 subsection:</text>
						<quoted-block changed="added" committee-id="SSVA00" display-inline="no-display-inline" id="id5423A406C1164DE6B9D36A96590260C0" reported-display-style="italic" style="OLC">
							<subsection commented="no" display-inline="no-display-inline" id="id2103771BD4D94BFC91404252D33EA96B"><enum>(d)</enum><text display-inline="yes-display-inline">In this section:</text>
								<paragraph commented="no" display-inline="no-display-inline" id="idF4F5CE70F8A5480CBDBB62794991980F"><enum>(1)</enum><text display-inline="yes-display-inline">The term <term>mentally incompetent</term>
				with respect to an individual means that the individual lacks the mental
				capacity—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="id59BFAAF90C7943BEAB03B51EDB574A93"><enum>(A)</enum><text display-inline="yes-display-inline">to provide substantially accurate
				information needed to complete a form; or</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idA43B7A0E67E94A0A9AB92C2B10800A4E"><enum>(B)</enum><text display-inline="yes-display-inline">to certify that the statements made on a
				form are true and complete.</text>
									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idFDDF59E53115409CA5C1FA8DEE93BC16"><enum>(2)</enum><text display-inline="yes-display-inline">The term <term>TIN</term> has the meaning
				given the term in section 7701(a)(41) of the Internal Revenue Code of
				1986.</text>
								</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id26A9B82EDF3F4C6DB488AFC0802CA4FD"><enum>(b)</enum><header display-inline="yes-display-inline">Applicability</header><text display-inline="yes-display-inline">The amendments made by subsection (a) shall
			 apply with respect to claims filed on or after the date of the enactment of
			 this Act.</text>
				</subsection></section><section commented="no" display-inline="no-display-inline" id="id0D744881262348C88F80C4631CC341D9" section-type="subsequent-section"><enum>705.</enum><header display-inline="yes-display-inline">Improvement of process for filing jointly
			 for social security and dependency and indemnity compensation</header><text display-inline="no-display-inline">Section 5105 is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="idCC4B6B838C644E5FA44D306772D3154F"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="id96C9459CD6BE4DF297D582F311A43477"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>shall</quote> the first
			 place it appears and inserting <quote>may</quote>; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idACB39B8374A2414C8DF4E180876498C9"><enum>(B)</enum><text display-inline="yes-display-inline">by striking <quote>Each such form</quote>
			 and inserting <quote>Such forms</quote>; and</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2063644A5BFC4F3483932F9A824E8FB9"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (b), by striking <quote>on
			 such a form</quote> and inserting <quote>on any document indicating an intent
			 to apply for survivor benefits</quote>.</text>
				</paragraph></section><section id="idF4C296D849F1420EA6B3BB01586CAE1D"><enum>706.</enum><header>Parity between
			 part-time and full-time students under employee incentive scholarship
			 program</header><text display-inline="no-display-inline">Section 7675(b)(1) is
			 amended by striking subparagraph (E) and inserting the following new
			 subparagraph (E):</text>
				<quoted-block changed="added" committee-id="SSVA00" display-inline="no-display-inline" id="idCFB906AEB0014379B7780A9BE0EBE27C" reported-display-style="italic" style="OLC">
					<subparagraph id="id1A99DBCDFF664B349AF8A381FFADC435" indent="up1"><enum>(E)</enum><text>In the case of a
				participant who is employed as an employee of the Department while enrolled in
				the course of training being pursued by the participant, the participant fails
				to maintain employment as a Department employee during such course of
				training.</text>
					</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section commented="no" display-inline="no-display-inline" id="id8AEE624B21C54007A226A3CF17CA9951" section-type="subsequent-section"><enum>707.</enum><header>Report on
			 pay-for-performance compensation under health care services contracts</header>
				<subsection id="ID652b6a0c0de749609da39363c545c9d4"><enum>(a)</enum><header>In
			 general</header><text>Not later than 180 days after the date of the enactment
			 of this Act, the Secretary of Veterans Affairs shall submit to the Committee on
			 Veterans' Affairs of the Senate and the Committee on Veterans' Affairs of the
			 House of Representatives a report on the use by the Department of Veterans
			 Affairs of pay-for-performance compensation mechanisms in the provision of
			 health care services in contracts which compensate contractors of the
			 Department for the provision of health care services through community based
			 outpatient clinics.</text>
				</subsection><subsection id="id430DF4BE7F1B4FDF818BDD285ECD40DB"><enum>(b)</enum><header>Elements</header><text>The
			 report required by subsection (a) shall include the following:</text>
					<paragraph id="id5FCDD18F1A7D4AB1840955E8A3AB9C61"><enum>(1)</enum><text>An assessment of the
			 feasibility and advisability of utilizing pay-for-performance compensation
			 mechanisms in the provision of health care services by the Department in
			 contracts described in subsection (a).</text>
					</paragraph><paragraph id="ID96b49fad27be452ab9fe71ccd4b934a3"><enum>(2)</enum><text>The number of community
			 based outpatient clinics of the Department that were operating under a
			 pay-for-performance compensation mechanism in the provision of health care
			 services on the day before the date of the enactment of this Act and the impact
			 such mechanisms have had with respect to—</text>
						<subparagraph id="ID47921604cd16471bad148f172ec6521c"><enum>(A)</enum><text>providing incentives for
			 community based outpatient clinics to provide high quality health care;
			 and</text>
						</subparagraph><subparagraph id="ID275615dfc0bb438b8570d148d3dd7698"><enum>(B)</enum><text>providing incentives to
			 better assure patient satisfaction.</text>
						</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID23fd986c37064f879d4b31863123e334"><enum>(c)</enum><header>Incorporation of views
			 and experiences of private health care systems</header><text>In meeting the
			 requirements of this section the Secretary shall incorporate the views and
			 experiences of representatives of at least two private health care systems that
			 have utilized pay-for-performance compensation mechanisms in the operation of
			 medical clinics to ascertain whether such mechanisms have had an effect on the
			 delivery of quality, timely, medical care in the private sector.</text>
				</subsection></section><section id="IDd5eda32d3cd549e2ae06f18271fe3cb4"><enum><added-phrase committee-id="SSVA00" reported-display-style="italic">708.</added-phrase></enum><header>Extension of
			 authority to obtain information from Secretary of Treasury and Commissioner of
			 Social Security for income verification purposes</header><text display-inline="no-display-inline">Section 5317(g) is amended by striking
			 <quote>September 30, 2011</quote> and inserting <quote>September 30,
			 2013</quote>.</text>
			</section><section commented="no" display-inline="no-display-inline" id="ID6f9f8e69f92d4026a949527fa92e2799" section-type="subsequent-section"><enum>709.</enum><header>Extension of
			 authority for regional office of Department of Veterans Affairs in Republic of
			 the Philippines</header><text display-inline="no-display-inline">Section 315(b)
			 is amended by striking <quote>December 31, 2011</quote> and inserting
			 <quote>December 31, 2012</quote>.</text>
			</section><section id="id43A0B97AAA6C4288AC2A24F193F8ED3A"><enum>710.</enum><header>Report on
			 establishment of a Polytrauma Rehabilitation Center or Polytrauma Network Site
			 of the Department of Veterans Affairs in the northern Rockies or
			 Dakotas</header>
				<subsection id="idF2C521713E254B3A98012FD3E789CC18"><enum>(a)</enum><header>In
			 general</header><text>Not later than 180 days after the date of the enactment
			 of this Act, the Secretary of Veterans Affairs shall submit to Congress a
			 report on the feasibility and advisability of establishing a Polytrauma
			 Rehabilitation Center or Polytrauma Network Site for the Department of Veterans
			 Affairs in the northern Rockies or the Dakotas. One of the locations evaluated
			 as a potential location for the Polytrauma Rehabilitation Center or Polytrauma
			 Network Site, as the case may be, shall be the Fort Harrison Department of
			 Veterans Affairs hospital in Lewis and Clark County, Montana.</text>
				</subsection><subsection id="id1DCC4DC151A64CCFB643B0EC9CA3DD26"><enum>(b)</enum><header>Requirements</header><text>The
			 report required by this subsection shall include the following:</text>
					<paragraph id="idE023281EDA094DE0BE84EDE89001CCCF"><enum>(1)</enum><text>An assessment of the
			 adequacy of existing Department of Veterans Affairs facilities in the northern
			 Rockies and the Dakotas to address matters that are otherwise addressed by
			 Polytrauma Rehabilitation Centers and Polytrauma Network Sites.</text>
					</paragraph><paragraph id="id1943BAA4B20D409D8FFCF57CA8EE6AB2"><enum>(2)</enum><text>A comparative assessment
			 of the effectiveness of rehabilitation programs for individuals with traumatic
			 brain injuries in urban areas with the effectiveness of such programs for
			 individuals with traumatic brain injuries in rural and frontier
			 communities.</text>
					</paragraph><paragraph id="id26F92E94D48246FE9D6C36360D0E4384"><enum>(3)</enum><text>An assessment whether the
			 low cost of living in the northern Rockies and the Dakotas could reduce the
			 financial stress faced by veterans receiving care for traumatic brain injury
			 and their families and thereby improve the effectiveness of such care.</text>
					</paragraph><paragraph id="id0957A8BE46264C1EBF0853B31D589B0F"><enum>(4)</enum><text>An assessment whether
			 therapies that can prevent or remediate the development of secondary neurologic
			 conditions related to traumatic brain injury can be interrupted by stress
			 caused by living in an urban area.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id72D38379880A4B7F82AF5D2D5A218991"><enum>(c)</enum><header>Consultation</header><text>The
			 Secretary shall consult with appropriate State and local government agencies in
			 the northern Rockies and the Dakotas in preparing the report required by
			 subsection (a).</text>
				</subsection></section><section commented="no" display-inline="no-display-inline" id="id13E0B24FF791411F93CAFB4EF7BD8A7E"><enum><added-phrase committee-id="SSVA00" reported-display-style="italic">711.</added-phrase></enum><header>Modification
			 of loan guaranty fee for certain initial loans</header><text display-inline="no-display-inline">Section 3729(b)(2)(A) is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="id5A3C64AD2B344895B28B3A6E4F097E16"><enum><added-phrase committee-id="SSVA00" reported-display-style="italic">(1)</added-phrase></enum><text>by striking
			 clauses (i) and (ii);</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id29FB2BEE8AFE407C9D841F85A93B8BF7"><enum>(2)</enum><text>by redesignating clause
