		<official-title>To improve the H–2A agricultural worker program for use
		  by dairy workers, sheepherders, and goat herders, and for other
		  purposes.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>H–2A Improvement
			 Act</short-title></quote>.</text>
		</section><section commented="no" id="id8A9C3CC4DEE742B699A39B7CFF1A75B6"><enum>2.</enum><header>Nonimmigrant
			 status for dairy workers, sheepherders, and goat herders</header><text display-inline="no-display-inline">Section 101(a)(15)(H)(ii)(a) of the
			 Immigration and Nationality Act (8 U.S.C. 1101(a)(15)(H)(ii)(a)) is amended by
			 inserting <quote>who is coming temporarily to the United States to perform
			 agricultural labor or services as a dairy worker, sheepherder, or goat herder,
			 or</quote> after <quote>abandoning</quote>.</text>
		</section><section id="id1A117E47DE2249559DAEA2927E99C1D0"><enum>3.</enum><header>Special rules
			 for aliens employed as dairy workers, sheepherders, or goat
			 herders</header><text display-inline="no-display-inline">Section 218 of the
			 Immigration and Nationality Act (8 U.S.C. 1188) is amended—</text>
			<paragraph id="idEA21E95E8A0740CD9A34F3DD6BF04236"><enum>(1)</enum><text>by redesignating
			 subsections (h) and (i) as subsections (i) and (j), respectively; and</text>
			</paragraph><paragraph id="id2AFD7F197EDC4900B1A5C4B84D27CA14"><enum>(2)</enum><text>by inserting
			 after subsection (g) the following:</text>
				<quoted-block display-inline="no-display-inline" id="id34664454C0614BF3A18C6231DC7447B9" style="OLC">
					<subsection id="IDBADFE02C58AB4EB791412C5F143AF0E0"><enum>(h)</enum><header>Special rules
				for aliens employed as dairy workers, sheepherders, or goat herders</header>
						<paragraph id="idF1650B53DA5747389A17F97E56812851"><enum>(1)</enum><header>In
				general</header><text>Notwithstanding any other provision of this Act, an alien
				admitted as a nonimmigrant under section 101(a)(15)(H)(ii)(a) for employment as
				a dairy worker, sheepherder, or goat herder—</text>
							<subparagraph id="IDBFB791EBC9DF426D9A638DDE8D627C2B"><enum>(A)</enum><text>may be admitted
				for an initial period of 3 years; and</text>
							</subparagraph><subparagraph id="IDFB560815F98E4B0DB07F8839DEEE97D1"><enum>(B)</enum><text>subject to
				paragraph (3)(E), may have such initial period of admission extended for an
				additional period of up to 3 years.</text>
							</subparagraph></paragraph><paragraph id="ID163c935d5a174077aa1cb9f56b1839b8"><enum>(2)</enum><header>Exemption from
				temporary or seasonal requirement</header><text>Not withstanding section
				101(a)(15)(H)(ii)(a), an employer filing a petition to employ H–2A workers in
				positions as dairy workers, sheepherders, or goat herders shall not be required
				to show that such positions are of a seasonal or temporary nature.</text>
						</paragraph><paragraph id="IDC4407AD20A004224A4EE02B52CAA998F"><enum>(3)</enum><header>Adjustment to
				lawful permanent resident status</header>
							<subparagraph id="IDD01914598E984D2FB89194AC1C75D176"><enum>(A)</enum><header>Eligible
				alien</header><text>In this paragraph, the term <term>eligible alien</term>
				means an alien who—</text>
								<clause id="IDD2FD93ED905F4375B034828499919930"><enum>(i)</enum><text>has H–2A worker
				status based on employment as a dairy worker, sheepherder, or goat
				herder;</text>
								</clause><clause id="IDB86476429EA8485BAF2E8ACAE8161534"><enum>(ii)</enum><text>has maintained
				such status in the United States for a not fewer than 33 of the preceding 36
				months; and</text>
								</clause><clause id="IDB86016267FC94471B2FACDB0F0DD39D0"><enum>(iii)</enum><text>is seeking to
				receive an immigrant visa under section 203(b)(3)(A)(iii).</text>
								</clause></subparagraph><subparagraph id="IDE765631652BB4091858174F51075D567"><enum>(B)</enum><header>Classification
				petition</header><text>A petition under section 204 for classification of an
				eligible alien under section 203(b)(3)(A)(iii) may be filed by—</text>
								<clause id="ID2E0958192FB14D4E9E5341AD35876CBE"><enum>(i)</enum><text>the alien’s
				employer on behalf of the eligible alien; or</text>
								</clause><clause id="ID2F3A62893D6441B8851DBFDA9499B33E"><enum>(ii)</enum><text>the eligible
				alien.</text>
								</clause></subparagraph><subparagraph id="ID07AADC2FA7E94554AE91F068270BE9E7"><enum>(C)</enum><header>No labor
				certification required</header><text>Notwithstanding section 203(b)(3)(C), no
				determination under section 212(a)(5)(A) is required with respect to an
				immigrant visa under section 203(b)(3)(A)(iii) for an eligible alien.</text>
							</subparagraph><subparagraph id="IDBB26A5E1A19445EF8371A1B45FEB250A"><enum>(D)</enum><header>Effect of
				petition</header><text>The filing of a petition described in subparagraph (B)
				or an application for adjustment of status based on a petition described in
				subparagraph (B) shall not be a basis for denying—</text>
								<clause id="idB5AADB9EAF5E4BEF85F3F04145549540"><enum>(i)</enum><text>another petition
				to employ H–2A workers;</text>
								</clause><clause id="id8C8ADD9F4DEC4CF885F8D3453353B6E6"><enum>(ii)</enum><text>an extension of
				nonimmigrant status for a H–2A worker;</text>
								</clause><clause id="idF20DDCED0CCD44829F414DF218D58EF9"><enum>(iii)</enum><text>admission of an
				alien as an H–2A worker;</text>
								</clause><clause id="id6A83F8962E314DFBB686B6D274154230"><enum>(iv)</enum><text>a request for a
				visa for an H–2A worker;</text>
								</clause><clause id="id4436EE0AD1244ABEB41E454661062424"><enum>(v)</enum><text>a
				request from an alien to modify the alien's immigration status to or from
				status as an H–2A worker; or</text>
								</clause><clause id="idE1457CE13A044183BA2C276163016F01"><enum>(vi)</enum><text>a request made
				for an H–2A worker to extend such worker's stay in the United States.</text>
								</clause></subparagraph><subparagraph id="ID971759E40BA64681B5A94A7E40FB255F"><enum>(E)</enum><header>Extension of
				stay</header><text>The Secretary of Homeland Security shall extend the stay of
				an eligible alien having a pending or approved petition described in
				subparagraph (B) in 1-year increments until a final determination is made on
				the alien’s eligibility for adjustment of status to that of an alien lawfully
				admitted for permanent residence.</text>
							</subparagraph><subparagraph id="ID948E2DEA002B4AE5A97395408F08D320"><enum>(F)</enum><header>Construction</header><text>Nothing
				in this paragraph may be construed to prevent an eligible alien from seeking
				adjustment of status in accordance with any other provision of
				law.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
