		<official-title>To establish expanded learning time initiatives, and for
		  other purposes.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Time for Innovation Matters in
			 Education Act of 2011</short-title></quote>.</text>
		</section><section id="ID5b070ed8a83648819e1f590da6162273"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text>
			<paragraph id="ID8c3208323b964211b55421af5b4428a3"><enum>(1)</enum><text>Although the
			 demands of our global society have grown and expectations of our students and
			 schools have risen, the time allotted for students and teachers to reach these
			 standards has remained the same for decades.</text>
			</paragraph><paragraph id="ID0ca414997936407ab756b43279bde502"><enum>(2)</enum><text>The
			 near-universal school calendar, consisting of 180 6-hour days, has not changed
			 since the school calendar was designed to meet the needs of farms and factories
			 in the early 20th century.</text>
			</paragraph><paragraph id="ID6ee7c059fd0949fdac569e1f1b3579bd"><enum>(3)</enum><text>According to the
			 Programme for International Student Assessment (PISA), which measures how well
			 students from more than 70 economies are prepared to meet the challenges they
			 may encounter in the future, students in the United States have maintained a
			 status quo for nearly 1 decade, while the mathematics and reading ratings of
			 students from other high-performing nations surpass the ratings of students in
			 the United States.</text>
			</paragraph><paragraph id="ID94a960d40eb5421d80061108ab052166"><enum>(4)</enum><text>Quality expanded
			 learning programs, which provide students with more than 300 additional school
			 hours per year, have demonstrated success in improving student academic
			 performance across the United States.</text>
			</paragraph><paragraph id="ID53d59edf9efa469cb4857dcdfd22d221"><enum>(5)</enum><text>Expanded learning
			 time initiatives can address the diverse academic needs and interests of
			 students and modernize public schools to help students develop 21st century
			 learning skills and prepare all students for life-long success.</text>
			</paragraph><paragraph id="IDd41341f33410487c92f6fef4e3031743"><enum>(6)</enum><text>As of the date of
			 enactment of this Act, most expanded learning opportunities are offered through
			 charter schools or schools with independent organizational structures, but
			 expanded learning time could positively impact all public school students, from
			 prekindergarten through grade 12.</text>
			</paragraph></section><section id="IDd66430d4a45345859ec01006b747fbe8"><enum>3.</enum><header>Purposes</header><text display-inline="no-display-inline">The purposes of this Act are—</text>
			<paragraph id="ID4fd551c64bc94611968f724f82af4d85"><enum>(1)</enum><text>to increase
			 opportunities for students in high-need schools to participate in expanded
			 learning time initiatives, including expanded school days, expanded school
			 weeks, or expanded school years, in order to increase student academic
			 achievement and student engagement and success in schools, by—</text>
				<subparagraph id="ID3db8ee976a634ea585a3e445bad25924"><enum>(A)</enum><text>providing
			 students with more in-depth and rigorous learning opportunities in reading or
			 language arts, mathematics, science, history and civics, and other core
			 academic subjects;</text>
				</subparagraph><subparagraph id="IDe36d5138a9814a0c85f0c7b177f60b92"><enum>(B)</enum><text>providing
			 students with more time for additional subjects and enrichment activities that
			 contribute to a well-rounded education, which may include music and the arts,
			 physical education, service-learning, and experiential and work-based learning
			 opportunities (such as community service, learning apprenticeships,
			 internships, and job shadowing); and</text>
				</subparagraph><subparagraph id="ID3c0f10bd0c3a4273a162a32d8b38dcde"><enum>(C)</enum><text>providing
			 teachers with increased opportunities to work collaboratively, and to
			 participate in common planning, within and across grades and subjects, to
			 improve instruction;</text>
				</subparagraph></paragraph><paragraph id="IDca29e0195a42454283320e6f39802720"><enum>(2)</enum><text>to improve
			 teaching and learning by using expanded learning, including school redesign,
			 to—</text>
				<subparagraph id="IDf89ae951053f40729360912dd1fa5e8c"><enum>(A)</enum><text>create a seamless
			 program or curriculum with regular and expanded teaching and learning
			 opportunities within a school program that is comprehensively redesigned for
			 students and teachers; and</text>
				</subparagraph><subparagraph id="IDfcc456d1b9944803a134a20ad02fdabd"><enum>(B)</enum><text>improve access to
			 instructional supports for academically struggling students;</text>
				</subparagraph></paragraph><paragraph id="ID4b2e29f976f94bd08aaead0925109ee8"><enum>(3)</enum><text>to encourage
			 States, local educational agencies, and schools to develop high-quality,
			 innovative, replicable, and sustainable initiatives to expand learning time,
			 including using school redesign; and</text>
			</paragraph><paragraph id="ID43d5ce7af47246e6820f38173873f785"><enum>(4)</enum><text>to create
			 partnerships between schools and local educational agencies, and external
			 organizations such as community-based organizations, institutions of higher
			 education, community learning centers, cultural organizations, and health and
			 mental health agencies to provide expanded learning opportunities for
			 students.</text>
			</paragraph></section><section id="ID74c35ea0e13545a19aa8b4aaa65a6f0d"><enum>4.</enum><header>Definitions and
			 references</header>
			<subsection id="ID622688ce25684e4eab65e83016bfb24a"><enum>(a)</enum><header>Definitions</header><text>In
			 this Act:</text>
				<paragraph id="ID8fb205bbea6b41e0bc623eefc973bb9c"><enum>(1)</enum><header>Elementary and
			 secondary education Act terms</header><text>The terms <term>community-based
			 organization</term>, <term>core academic subjects</term>, <term>elementary
			 school</term>, <term>highly qualified</term>, <term>institution of higher
			 education</term>, <term>local educational agency</term>, <term>other
			 staff</term>, <term>parent</term>, <term>professional development</term>,
			 <term>secondary school</term>, <term>Secretary</term>, <term>State</term>, and
			 <term>State educational agency</term> have the meanings given the terms in
			 section 9101 of the Elementary and Secondary Education Act of 1965 (20 U.S.C.
			 7801).</text>
				</paragraph><paragraph id="id1093BAB8428B4675B9D5368002C2399F"><enum>(2)</enum><header>Community
			 learning center</header><text>The term <term>community learning center</term>
			 means a community learning center, as defined in section 4201(b) of the
			 Elementary and Secondary Education Act of 1965 (20 U.S.C. 7171(b)), that
			 receives assistance under part B of title IV of such Act.</text>
				</paragraph><paragraph id="ID04aa9ecde4be44a1b50eddfe1d9471e9"><enum>(3)</enum><header>Eligible
			 entity</header><text>The term <term>eligible entity</term> means—</text>
					<subparagraph id="ID91f4ae5b9f094627bd8cc7ba2590ea24"><enum>(A)</enum><text>1 or more local
			 educational agencies; or</text>
					</subparagraph><subparagraph id="ID5262a6204faa45e0ab09e11989b2b337"><enum>(B)</enum><text>a partnership
			 that includes 1 or more local educational agencies and 1 or more of the
			 following:</text>
						<clause commented="no" id="ID5bc39dbb43264a2fb3f1a95ace67fa6a"><enum>(i)</enum><text>A nonprofit
			 community-based organization, such as—</text>
							<subclause commented="no" id="id9B7DF1DD9EDF4E0484ED1FD48C4A47C6"><enum>(I)</enum><text>an organization
			 with demonstrated experience in expanding learning opportunities and helping
			 schools redesign their educational programs to better meet student needs;
			 or</text>
							</subclause><subclause commented="no" id="id0937341A5C26459EB6D2AE0D12F8E9FC"><enum>(II)</enum><text>an organization
			 focused on alternative learning or dropout prevention.</text>
							</subclause></clause><clause commented="no" id="ID6cdfb3ee33794c849c158fbf9d0412fe"><enum>(ii)</enum><text>An institution
			 of higher education.</text>
						</clause><clause commented="no" id="ID540133ab09f642cfb075bc8470fbe3bf"><enum>(iii)</enum><text>A community
			 learning center.</text>
						</clause><clause commented="no" id="id60CFE74A26BD4627AB3216ED0919EEC0"><enum>(iv)</enum><text>An entity that
			 is carrying out an after-school program.</text>
						</clause><clause commented="no" id="ID37d3b4bd0fc845c19749c8ef3000a5c7"><enum>(v)</enum><text>A public or
			 nonprofit entity.</text>
						</clause></subparagraph></paragraph><paragraph id="IDdc190a25d070468cadc5cdf489f21959"><enum>(4)</enum><header>Expanded
			 learning time initiative</header><text>The term <term>expanded learning time
			 initiative</term> means a program that—</text>
					<subparagraph id="IDf10f1d0efc37413b8543a699d02ff016"><enum>(A)</enum><text>uses an expanded
			 school day, expanded school week, or expanded school year schedule, that
			 increases the total number of school hours for the school year at a school by
			 not less than 300 hours (which shall include hours in which a student is
			 engaged in academic activities, experiential learning, work-based learning, and
			 enrichment, but shall not include hours in which a student is engaged in sports
			 or employment activities)—</text>
						<clause id="ID482a6e427c334dbf9f1df78559d1ca5e"><enum>(i)</enum><text>compared to the
			 school year that is standard for the local educational agency serving the
			 school, for schools of the comparable level (elementary school, middle school,
			 or high school, as defined under applicable State law); or</text>
						</clause><clause id="ID77b5ba08a6d746718d927f0de44e53a3"><enum>(ii)</enum><text>in
			 the case of a charter school that is its own local educational agency, compared
			 to the school year that is standard for local educational agencies in the
			 surrounding area, for schools of the comparable level;</text>
						</clause></subparagraph><subparagraph id="IDd635897caa26457e826c9e010b994284"><enum>(B)</enum><text>uses the expanded
			 learning time involved to redesign the school's program in a manner that
			 includes additional time—</text>
						<clause id="IDbfb9edbfd3354ace96c0142177783073"><enum>(i)</enum><text>for
			 academic work, and to support innovation in teaching, to improve the
			 proficiency of participating students (particularly struggling students) in
			 reading or language arts, mathematics, science, history and civics, and other
			 core academic subjects;</text>
						</clause><clause id="IDdc891fd5b9ba4aa6a0723d2a08dbb9ba"><enum>(ii)</enum><text>to
			 advance student learning for all students, including those who already meet or
			 exceed student academic achievement standards, as measured by State academic
			 assessments required under section 1111(b)(3) of the Elementary and Secondary
			 Education Act of 1965 (20 U.S.C. 6311(b)(3));</text>
						</clause><clause id="ID7e86b57f25ad43f88a8b14d54827e099"><enum>(iii)</enum><text>for additional
			 subjects and enrichment activities that contribute to a well-rounded education,
			 which may include music and the arts, physical education, service-learning, and
			 experiential and work-based learning opportunities (such as community service,
			 learning apprenticeships, internships, and job shadowing); and</text>
						</clause><clause id="ID3a73f16c300146e3be65381a3c571d67"><enum>(iv)</enum><text>for teachers for
			 collaboration, and common planning, within and across grades and subjects;
			 and</text>
						</clause></subparagraph><subparagraph id="ID52f7eb98c9ea45da841358d0391a9de9"><enum>(C)</enum><text>will expand
			 learning time for all students in all grade levels in the school, except
			 that—</text>
						<clause commented="no" id="ID1ec9e6fa89b64556b01f8a2bb5741494"><enum>(i)</enum><text>the program shall
			 not require secondary schools to have all students on campus at all times;
			 and</text>
						</clause><clause commented="no" id="ID75d7cd612f104cb499d7f921e4a7d1de"><enum>(ii)</enum><text>a school that
			 includes an on-site prekindergarten-level program may choose whether or not to
			 expand the learning time of such program, however, if the school decides to
			 provide expanded learning time for prekindergarten, the school must do so for
			 all students enrolled in prekindergarten at the school.</text>
						</clause></subparagraph></paragraph><paragraph id="IDea6f1959991a45a280bc0941c9cb6781"><enum>(5)</enum><header>Expanded
			 learning time school</header><text>The term <term>expanded learning time
			 school</term> means a school that has implemented an expanded learning time
			 initiative using funds received under this Act.</text>
				</paragraph><paragraph id="ID2b6ef156f2ba40f98fc587e4c673add2"><enum>(6)</enum><header>Graduation
			 rate</header><text>The term <term>graduation rate</term> means a graduation
			 rate as defined in section 1111(b)(2)(C)(vi) of the Elementary and Secondary
			 Education Act of 1965 (20 U.S.C. 6311(b)(2)(C)(vi)) and clarified by section
			 200.19(b) of title 34, Code of Federal Regulations, or any corresponding
			 similar regulation or ruling.</text>
				</paragraph><paragraph id="IDe28aef54c565489a8dc3ec10a87c2aac"><enum>(7)</enum><header>High-need
			 school</header>
					<subparagraph id="IDe3b1450d2d9248c38663f46a95049bc8"><enum>(A)</enum><header>In
			 general</header><text>The term <term>high-need school</term> means—</text>
						<clause id="ID86c3296832cd44459fefda6ff5be92d2"><enum>(i)</enum><text>a
			 public elementary school or secondary school at which 50 percent or more of the
			 students are low-income students; or</text>
						</clause><clause id="IDf5fcdcbc09ed4788b1437df1e6ad6260"><enum>(ii)</enum><text>a
			 high school with a graduation rate of less than 75 percent.</text>
						</clause></subparagraph></paragraph><paragraph id="ID009a14ef0c0848fba7e958cde02b3a94"><enum>(8)</enum><header>High
			 school</header><text>The term <term>high school</term> means a public high
			 school, as defined under applicable State law.</text>
				</paragraph><paragraph id="IDafcda0eae55e49479985ad4933e8e679"><enum>(9)</enum><header>Low-income
			 student</header><text>The term <term>low-income student</term> means a student
			 who is eligible to be counted under 1 of the measures of poverty described in
			 section 1113(a)(5) of the Elementary and Secondary Education Act of 1965 (20
			 U.S.C. 6313(a)(5)).</text>
				</paragraph><paragraph id="ID47c702e7b6e24ada828e5b7545750b76"><enum>(10)</enum><header>Redesign</header><text>The
			 term <term>redesign</term>, used with respect to a school or school program,
			 means a process to significantly reconfigure a school's or program's schedule
			 in a manner that more effectively utilizes students and teachers' time,
			 including providing additional time—</text>
					<subparagraph id="IDc0bc42f56d5740e4a7080ce1f32329fa"><enum>(A)</enum><text>for academic work
			 and to support innovation in the teaching of core academic subjects;</text>
					</subparagraph><subparagraph id="IDc0b4c2ebbde14f18a2575be7983736d7"><enum>(B)</enum><text>for teachers to
			 collaborate and conduct common planning; and</text>
					</subparagraph><subparagraph id="ID19c25c3d7fd842128cf09ede57255d19"><enum>(C)</enum><text>for innovative
			 approaches to providing academic, experiential, and work-based learning
			 opportunities.</text>
					</subparagraph></paragraph></subsection><subsection id="ID76edb21eeaee4ddfb2af393445c9309f"><enum>(b)</enum><header>References</header><text>In
			 this Act—</text>
				<paragraph id="IDa437b2b46b5942f699e6b40aa62aaa2a"><enum>(1)</enum><text>a reference to a
			 school day, school week, or school year includes a reference to a combination
			 thereof; and</text>
				</paragraph><paragraph id="ID15ed64da55e54f2088c4e5ba8080a3e9"><enum>(2)</enum><text>a reference to a
			 school day, school week, or school year program (or schedule) includes a
			 reference to a combination thereof.</text>
				</paragraph></subsection></section><section id="IDc0a117a9602c4f989def737267cef35a"><enum>5.</enum><header>Program
			 authorized</header>
			<subsection id="IDcc7b3297b9a44532966227eff2542b0b"><enum>(a)</enum><header>Grants to State
			 educational agencies</header><text>From the amount appropriated under section
			 12, the Secretary is authorized to award grants on a competitive basis under
			 section 6 to State educational agencies having applications approved pursuant
			 to section 6(c) to enable such agencies to award subgrants on a competitive
			 basis to eligible entities as described in sections 7 and 8.</text>
			</subsection><subsection id="ID897d43803cf545ba8ef39691f8369dcd"><enum>(b)</enum><header>Reservation</header><text>From
			 the amount made available under this Act for each fiscal year, the Secretary
			 may reserve—</text>
				<paragraph id="IDd150dd053abd43158b69de42477c6d75"><enum>(1)</enum><text>3 percent of the
			 amount to carry out the activities described in section 10; and</text>
				</paragraph><paragraph id="ID96ff32d436ae476f81ed80ebbbe0261a"><enum>(2)</enum><text>from the
			 remainder—</text>
					<subparagraph id="ID5cbbbfb6293b49ef81d0c0033b473203"><enum>(A)</enum><text>not more than 20
			 percent of the remainder to award grants under section 9; and</text>
					</subparagraph><subparagraph id="IDcff5e2a2692f40d892a96d756cba5c1e"><enum>(B)</enum><text>not more than
			 $1,000,000 to carry out the review of applications for, selection of recipients
			 of, and distribution of, grants to State educational agencies and eligible
			 entities under sections 6 and 9.</text>
					</subparagraph></paragraph></subsection></section><section id="IDf78b8c5214ac4193a8fac37f99a9c035"><enum>6.</enum><header>Grants to State
			 educational agencies</header>
			<subsection id="ID1b7a814bad7e48759e98de7afd0a4bcb"><enum>(a)</enum><header>Grants</header>
				<paragraph id="ID4a5002aa1bf14e19971b821207d6ff48"><enum>(1)</enum><header>In
			 general</header><text>The Secretary is authorized to award grants to State
			 educational agencies on a competitive basis to assist the agencies in
			 developing State expanded learning time grant programs in accordance with this
			 Act, which shall involve awarding subgrants on a competitive basis to eligible
			 entities in accordance with this Act, to plan and implement expanded learning
			 time initiatives in high-need schools.</text>
				</paragraph><paragraph id="ID26b2db015ccc468fa7bce10ef3117b81"><enum>(2)</enum><header>Distribution</header><text>The
			 Secretary shall ensure that grants awarded under this section and section 9 are
			 distributed to State educational agencies and eligible entities from diverse
			 geographical regions.</text>
				</paragraph></subsection><subsection id="ID64957b7002ee4d898d4b85976c230411"><enum>(b)</enum><header>Duration</header><text>The
			 Secretary shall award grants described in subsection (a) for an initial period
			 of not more than 4 years, and shall renew a State educational agency's grant
			 for an additional period of not more than 2 years if the Secretary finds that
			 the State educational agency is achieving the objectives of the grant and has
			 shown improvement against baseline data on the performance indicators described
			 in subsection (d)(4).</text>
			</subsection><subsection id="IDf157b26343a94dd8a72c1479f7b482f6"><enum>(c)</enum><header>Applications</header><text>Each
			 State educational agency desiring to receive a grant under this section shall
			 submit an application to the Secretary at such time, in such manner, and
			 accompanied by such information as the Secretary may require. At a minimum,
			 each State educational agency application shall include—</text>
				<paragraph id="ID6b5f54ad4f8d4a55b1f790d6c2fa186d"><enum>(1)</enum><text>a description of
			 how the State educational agency will use grant funds under this
			 section;</text>
				</paragraph><paragraph id="IDa5fc5e4355344c3b9795d098eacd17d9"><enum>(2)</enum><text>a description of
			 the peer review process and selection criteria the State educational agency
			 will use to evaluate applications from, and select, eligible entities to
			 receive expanded learning time planning and implementation subgrants, which
			 shall include—</text>
					<subparagraph id="idA460292481244831A7C323203AF5C96C"><enum>(A)</enum><text>a description of
			 how the State educational agency will assess the capacity of eligible entities
			 to plan and implement high-quality expanded learning time initiatives;
			 and</text>
					</subparagraph><subparagraph id="idEECE7CFFCC154167BBE084D693B56AD5"><enum>(B)</enum><text>a description of
			 how the State educational agency will prioritize applications from eligible
			 entities that meet the requirements of section 7(f);</text>
					</subparagraph></paragraph><paragraph id="IDfae7f8bff983416f84236816a84392f5"><enum>(3)</enum><text>a description of
			 the process the State educational agency will use to encourage local
			 educational agencies and schools, especially local educational agencies and
			 schools with a high percentage of low-income students, to implement expanded
			 learning time initiatives;</text>
				</paragraph><paragraph id="IDd6ced30311bb4eb19e17af6e20f5a1cb"><enum>(4)</enum><text>a description of
			 how the State educational agency will provide, or has provided, technical
			 assistance and support to eligible entities, local educational agencies, and
			 schools receiving funds through the State educational agency under this Act, in
			 implementing expanded learning time initiatives, including—</text>
					<subparagraph id="ID8eac7330a3fc49edb293b0dbfadc294a"><enum>(A)</enum><text>assisting local
			 educational agencies in identifying potential partners that are external
			 organizations with demonstrated experience in expanding learning opportunities
			 and helping schools redesign their educational programs to better meet student
			 needs; and</text>
					</subparagraph><subparagraph id="IDa55389de71864f89b307e1e08c53e37b"><enum>(B)</enum><text>assisting
			 eligible entities, local educational agencies, and schools in collecting,
			 reviewing, and analyzing data on student academic achievement;</text>
					</subparagraph></paragraph><paragraph commented="no" id="IDf50abe3357194310b7415c194b6b8703"><enum>(5)</enum><text>a description of
			 how the State educational agency will use the expanded learning time grant
			 program, and lessons learned from such program—</text>
					<subparagraph commented="no" id="id5311D6224F804D9C92F029DAD3CB033A"><enum>(A)</enum><text>to improve
			 schools that have not made adequate yearly progress under section 1111(b)(2) of
			 the Elementary and Secondary Education Act of 1965 (20 U.S.C. 6311(b)(2)) for 2
			 or more consecutive years; and</text>
					</subparagraph><subparagraph commented="no" id="id71B20013656D491C90353AC234BC4AC3"><enum>(B)</enum><text>to improve
			 student academic achievement at such schools;</text>
					</subparagraph></paragraph><paragraph id="IDedd1fc9d757e41e3b5870943e197a360"><enum>(6)</enum><text>a description of
			 how the State educational agency will evaluate, on a regular basis, activities
			 carried out by eligible entities receiving funds through the State educational
			 agency under this Act;</text>
				</paragraph><paragraph commented="no" id="ID0858de55783f46e097ac939f32977dbe"><enum>(7)</enum><text>a description of
			 how the State educational agency will collect, analyze, and disseminate, to
			 local educational agencies and other schools within the State, information on
			 best practices learned from schools receiving funding under this Act, including
			 best practices for—</text>
					<subparagraph commented="no" id="id222CD33AF8FC4E90B7FF8773DF045CB0"><enum>(A)</enum><text>improving schools
			 that have not made adequate yearly progress under section 1111(b)(2) of the
			 Elementary and Secondary Education Act of 1965 (20 U.S.C. 6311(b)(2)) for 2 or
			 more years; and</text>
					</subparagraph><subparagraph commented="no" id="id7C5EEE27992B458581EF04E7CFD58E7C"><enum>(B)</enum><text>improving student
			 academic achievement at such schools;</text>
					</subparagraph></paragraph><paragraph id="ID4e36129e786448788900cdba364f03db"><enum>(8)</enum><text>an assurance that
			 the State educational agency, and any eligible entity receiving funds through
			 the State educational agency under this Act, will, if requested, participate in
			 the evaluation described in section 10(b)(3); and</text>
				</paragraph><paragraph commented="no" id="IDb75fbb33d68e402a957f24dcaba68dee"><enum>(9)</enum><text>information
			 identifying the per-pupil funding amount range the State will use to establish
			 the correct amount of subgrants that will be awarded to local educational
			 agencies under section 8(c).</text>
				</paragraph></subsection><subsection id="ID0b25b4636de44f96a31f808c5ed192f5"><enum>(d)</enum><header>Authorized
			 activities</header>
				<paragraph id="ID66bb611c1ccb4633bf12c26466df0430"><enum>(1)</enum><header>Distribution</header><text>A
			 State educational agency that receives a grant under this section—</text>
					<subparagraph id="IDe614b13c4a3e4fcf935e54228aeb3671"><enum>(A)</enum><text>may reserve not
			 more than 10 percent of the grant funds to carry out the activities described
			 in paragraphs (2) through (4); and</text>
					</subparagraph><subparagraph id="ID32ca9b54f4b8436ea247316a545a503d"><enum>(B)</enum><text>shall use an
			 amount consisting of not less than 90 percent of the grant funds to award
			 subgrants, on a competitive basis, to eligible entities under section 7 or
			 section 8 to enable the eligible entities to carry out the authorized
			 activities described in section 7(e) or 8(f), except that not more than 10
			 percent of that amount shall be used for subgrants under section 7.</text>
					</subparagraph></paragraph><paragraph id="IDbe1f7b63b3f545b6b82308f3089727e3"><enum>(2)</enum><header>State-level
			 planning and administration</header><text>A State educational agency that
			 receives a grant under this section may use grant funds reserved under
			 paragraph (1)(A) for planning and administration, including—</text>
					<subparagraph id="ID9bf42ac8565b495fb82ed37198172add"><enum>(A)</enum><text>evaluating
			 applications from eligible entities;</text>
					</subparagraph><subparagraph id="IDc9c721e7ca3b465bbac9d3deeb8339b7"><enum>(B)</enum><text>administering the
			 distribution of subgrants to eligible entities; and</text>
					</subparagraph><subparagraph id="IDad88a37b3a5f4d55af91e539b3624091"><enum>(C)</enum><text>assessing and
			 evaluating, on a regular basis, activities carried out by eligible entities
			 receiving funds through the State educational agency under this Act.</text>
					</subparagraph></paragraph><paragraph id="ID34d14293d8fc4e8ea53a93e449c9874b"><enum>(3)</enum><header>Technical
			 assistance for eligible entities</header><text>A State educational agency that
			 receives a grant under this section may use grant funds reserved under
			 paragraph (1)(A) for technical assistance, including—</text>
					<subparagraph id="IDc3a2b95013964216b49d18f7a34782be"><enum>(A)</enum><text>assisting
			 eligible entities in planning and implementing expanded learning time
			 initiatives, including assisting local educational agencies in identifying
			 potential partners that are external organizations with demonstrated experience
			 in expanding learning opportunities and helping schools redesign their
			 educational programs to better meet student needs;</text>
					</subparagraph><subparagraph id="ID72e5fc2db3a44f039afb11a5e9621056"><enum>(B)</enum><text>implementing a
			 program of professional development for teachers and administrators, in schools
			 that receive funding under this Act, that prepares teachers and administrators
			 to implement the authorized activities described in section 8(f); and</text>
					</subparagraph><subparagraph id="IDc6b9356633e0441aada33e8ed330c0cd"><enum>(C)</enum><text>identifying best
			 practices for using expanded learning time to improve student academic
			 achievement in schools that have not made adequate yearly progress under
			 section 1111(b)(2) of the Elementary and Secondary Education Act of 1965 (20
			 U.S.C. 6311(b)(2)) for 2 or more years, and providing technical assistance to
			 local educational agencies in using such best practices to implement expanded
			 learning time in such schools.</text>
					</subparagraph></paragraph><paragraph id="ID365c9b8efd0c468fb8be5aad04f6ac51"><enum>(4)</enum><header>Evaluation and
			 reporting</header><text>A State educational agency that receives a grant under
			 this section shall annually prepare and submit to the Secretary a report that
			 contains all reports submitted by eligible entities under section 8(g), and
			 provide an evaluation of progress made by eligible entities in improving the
			 following (disaggregated by the student subgroups described in section
			 1111(b)(2)(C)(v)(II) of the Elementary and Secondary Education Act of
			 1965):</text>
					<subparagraph id="ID3d100644ae79473181610e6a174abfce"><enum>(A)</enum><text>student academic
			 achievement and growth, as measured by State academic assessments required
			 under section 1111(b)(3) of the Elementary and Secondary Education Act of
			 1965;</text>
					</subparagraph><subparagraph id="ID2c070736f98c4debba2a4fd338ca04d7"><enum>(B)</enum><text>for high
			 schools—</text>
						<clause id="idABBA2C7EF7124D77B8867BD83A74E3F2"><enum>(i)</enum><text>graduation
			 rates;</text>
						</clause><clause id="id98E387C27A4E4678AA9C98C0F6517714"><enum>(ii)</enum><text>rates of student
			 enrollment in an institution of higher education (as defined under section
			 101(a) of the Higher Education Act of 1965) within 16 months of receiving a
			 regular high school diploma; and</text>
						</clause><clause id="id511508B893E0416BB79AAD118AFBCA35"><enum>(iii)</enum><text>rates of
			 remediation and credit accumulation of students who enroll in a public
			 institution of higher education (as defined in section 101(a) of the Higher
			 Education Act of 1965) within the State;</text>
						</clause></subparagraph><subparagraph id="IDe1524a334ab948029a62433ade641e59"><enum>(C)</enum><text>performance on a
			 set of comprehensive school performance indicators, which—</text>
						<clause id="idAFD6179D56164A1ABEB3777CE7583553"><enum>(i)</enum><text>shall
			 include—</text>
							<subclause id="IDa901f6291c894773bb241ecd6b5ba68e"><enum>(I)</enum><text>student
			 attendance;</text>
							</subclause><subclause id="ID9b57e89d20614df5badaf4e2a2fd3844"><enum>(II)</enum><text>as appropriate,
			 rate of earned on-time promotion from grade to grade;</text>
							</subclause><subclause id="ID98e16bea04da47f48f47f2174c80497c"><enum>(III)</enum><text>percentage of
			 students failing a credit-bearing mathematics, reading or language arts, or
			 science course, or failing 2 or more courses in any subjects; and</text>
							</subclause><subclause id="IDee1c943329754763b9653937e1d675cf"><enum>(IV)</enum><text>for high
			 schools, the percentage of students taking a curriculum that prepares students
			 for postsecondary education; and</text>
							</subclause></clause><clause id="ID294aea321d0c4eef8f14dec335bf4b14"><enum>(ii)</enum><text>for high
			 schools, may include student rates of attainment of an associate or
			 baccalaureate degree within 4, 5, and 6 years.</text>
						</clause></subparagraph></paragraph></subsection><subsection id="ID92a2ae0b169342f0a0beadd9152df686"><enum>(e)</enum><header>Match</header>
				<paragraph id="IDdb641a51a2604d4bab272962028d06bd"><enum>(1)</enum><header>In
			 general</header><text>Each State educational agency that receives a grant under
			 this section shall provide matching funds to carry out the activities supported
			 by the grant in an amount not less than—</text>
					<subparagraph id="ID79f00f66b09247839573fb826c98ddc5"><enum>(A)</enum><text>for the first
			 year of an initial grant under this section, 10 percent of the cost of the
			 activities;</text>
					</subparagraph><subparagraph id="IDb18c7e2b82d448c8a2ac2088645d6e5d"><enum>(B)</enum><text>for the second
			 year of such a grant, 20 percent of the cost of the activities;</text>
					</subparagraph><subparagraph id="ID35bd6813f97947f3968f22ddd1f5f9ff"><enum>(C)</enum><text>for the third
			 year of such grant, or the first year of a subsequent grant under this section,
			 25 percent of the cost of the activities; and</text>
					</subparagraph><subparagraph id="ID07b07961b22a45eaabb9467fc6188e47"><enum>(D)</enum><text>for the second or
			 any succeeding year of such subsequent grant, 30 percent of the cost of the
			 activities.</text>
					</subparagraph></paragraph><paragraph id="ID74f7a7018aa04981a7f33f7e4e8d3e2d"><enum>(2)</enum><header>Matching
			 funds</header><text>The State educational agency may provide the matching funds
			 in cash or in kind, fairly evaluated, including plant, equipment, or services,
			 but may not provide more than 50 percent of the matching funds in kind. The
			 State educational agency may provide the matching funds from State, local, or
			 private sources.</text>
				</paragraph></subsection><subsection id="ID3d5389aaa49a45768281e8c5d79c3bf5"><enum>(f)</enum><header>Supplement not
			 supplant</header><text>Funds used to make grants under this Act shall be used
			 to supplement and not supplant other Federal, State, and local public funds
			 expended to plan or implement expanded learning time initiatives.</text>
			</subsection></section><section id="ID9bd346d6712246278ab53a8572f68bf0"><enum>7.</enum><header>Expanded
			 learning time planning subgrants</header>
			<subsection id="ID3eef931c28c4452898c4e52c350be6bb"><enum>(a)</enum><header>Subgrants
			 authorized</header><text>A State educational agency receiving a grant under
			 section 6 is authorized to award expanded learning time planning subgrants, on
			 a competitive basis, to eligible entities.</text>
			</subsection><subsection id="IDf0e0f0669c3a4fb2b06f3deb210b59d8"><enum>(b)</enum><header>Duration</header><text>The
			 State educational agency shall award each subgrant described in subsection (a)
			 for a period of not more than 1 year. Such grants shall be nonrenewable.</text>
			</subsection><subsection id="ID0b0b3de3d23c4d6893add9c32db3b99e"><enum>(c)</enum><header>Subgrant
			 amount</header><text>The State educational agency shall award each subgrant
			 described in subsection (a) in an amount that is not less than $15,000 and not
			 more than $60,000.</text>
			</subsection><subsection id="IDea4f213dc6f34cec89a45acaac60b273"><enum>(d)</enum><header>Applications</header><text>Each
			 eligible entity desiring to receive an expanded learning time planning subgrant
			 pursuant to this section shall submit an application to the State educational
			 agency at such time and in such manner as the agency may require. At a minimum,
			 the eligible entity's application shall include—</text>
				<paragraph id="ID890f0ead3a3642f69160863807ca7b06"><enum>(1)</enum><text>a description of
			 the eligible entity's proposal to establish expanded learning time initiatives,
			 including school redesign, at high-need schools served by the eligible
			 entity;</text>
				</paragraph><paragraph id="ID66239b60509f423f8bf4657e5f6dfb4b"><enum>(2)</enum><text>information
			 identifying the number of high-need schools the eligible entity proposes to
			 serve using funds made available under this Act, and a description of the
			 process, considerations, and criteria the eligible entity will use to select
			 schools to implement the expanded learning time initiatives—</text>
					<subparagraph id="ID5f4b9684c10042e4b443c38bae9f6ce5"><enum>(A)</enum><text>which
			 considerations shall include the percentage of low-income students attending
			 each school; and</text>
					</subparagraph><subparagraph id="IDb1914706716647769551de69ab053ed2"><enum>(B)</enum><text>which criteria
			 shall include the local educational agency's determination of the capacity of
			 each school to implement successfully a proposed expanded learning time
			 initiative;</text>
					</subparagraph></paragraph><paragraph id="ID0052689ecb5d4687b6a9f8aa838b8f29"><enum>(3)</enum><text>a description of
			 the process by which the eligible entity will ensure the meaningful involvement
			 of teachers, teacher organizations, parents, and community-based organizations
			 in the development of the expanded learning time initiatives;</text>
				</paragraph><paragraph id="IDe7e25f742fb94a0c9be405def412f0e0"><enum>(4)</enum><text>a description of
			 how the local educational agency involved and participating high-need schools
			 will work with external organizations that comprise the eligible entity
			 involved, and any other external organizations as applicable (such as a
			 community-based organization, an institution of higher education, a community
			 learning center, an entity carrying out an after-school program, or an
			 organization that will provide students with internships and work-based
			 learning opportunities) to develop and implement expanded learning time
			 initiatives;</text>
				</paragraph><paragraph id="IDd9337e5f3c6b4bbdb605acdb279dc5bf"><enum>(5)</enum><text>an assurance that
			 the eligible entity has the infrastructure in place to collect the data
			 necessary for an evaluation of the impact of the expanded learning time
			 initiatives on student academic achievement, graduation rates, and indicators
			 described in section 6(d)(4), to be submitted in the report described in
			 section 8(g); and</text>
				</paragraph><paragraph id="ID8522c10e4c4a472a9038d70a410d94ad"><enum>(6)</enum><text>an assurance that
			 each participating local educational agency will use the subgrant period to
			 negotiate and reach an agreement with the recognized representatives of the
			 employees of each participating high-need school served by the agency or, where
			 there is no such representative, with the employees of each participating
			 high-need school served by the agency.</text>
				</paragraph></subsection><subsection id="ID45630eba740c4523b54491a23440b63c"><enum>(e)</enum><header>Authorized
			 activities</header><text>An eligible entity receiving a subgrant under this
			 section shall use the subgrant funds to develop a detailed plan to implement
			 expanded learning time initiatives at high-need schools served by the eligible
			 entity, as specified in this section.</text>
			</subsection><subsection id="ID0671a55ad2484a48a50ed22c7e2d2756"><enum>(f)</enum><header>Priority</header><text>In
			 awarding subgrants under this section, a State educational agency shall give
			 priority to an application from an eligible entity that—</text>
				<paragraph id="ID84be7d5a1ea640f4891a50fa6359a820"><enum>(1)</enum><text>serves a high
			 percentage of students eligible to be counted under section 1124(c)(1)(A) of
			 the Elementary and Secondary Education Act of 1965 (20 U.S.C.
			 6333(c)(1)(A));</text>
				</paragraph><paragraph id="IDdcc1c40043b1488aae7619fff55af792"><enum>(2)</enum><text>includes a
			 nonprofit community-based organization with a demonstrated record of success in
			 expanding learning opportunities or helping schools redesign their educational
			 programs to better meet student needs;</text>
				</paragraph><paragraph id="ID3611c6dd2d04465a97140fd17953a5cd"><enum>(3)</enum><text>has identified a
			 coordinator at each high-need school that will participate in the expanded
			 learning time initiative to support the integration and alignment of community
			 partners for the school, and the programming of such partners, throughout the
			 expanded school day, week, or year;</text>
				</paragraph><paragraph id="ID1adabe3c7296429380018a8c6ee3d828"><enum>(4)</enum><text>will require each
			 high-need school that will participate in the expanded learning time initiative
			 to have a partnership agreement, signed by representatives of the school and
			 all community partners that will be part of the initiative, that—</text>
					<subparagraph id="IDc8290eae750f4d3ab4352f7dc6d930bc"><enum>(A)</enum><text>shows commitment
			 from teachers, school leaders, and the staff of community partners to work
			 collaboratively to implement the expanded learning time initiative;</text>
					</subparagraph><subparagraph id="IDd676eaa83e2d4e2485e515e8ed0b3fa1"><enum>(B)</enum><text>sets clear
			 expectations, including measurable goals for all community partners; and</text>
					</subparagraph><subparagraph id="id0E0C6BDE9C8E4B559C3A1F5DD9470DFF"><enum>(C)</enum><text>shows that staff
			 from all community partners are committed to collecting and reporting to the
			 school relevant data about the participation, performance, and outcomes of
			 expanded learning time programs in order to monitor progress toward achieving
			 such goals, and that the school is committed to sharing information with the
			 community partners, as necessary and appropriate, to assist the community
			 partners in meeting such goals; and</text>
					</subparagraph></paragraph><paragraph id="id1D3959539A13492F89A60A03F7E0688D"><enum>(5)</enum><text>will coordinate
			 funds received under this Act with other Federal, State, local, or private
			 sources of funding in order to implement high-quality expanded learning time
			 initiatives in participating schools.</text>
				</paragraph></subsection></section><section id="IDced47b68746c4a9f87cac25009dc2335"><enum>8.</enum><header>Expanded
			 learning time implementation subgrants</header>
			<subsection id="ID507a87ede3734ffa906365cc00fee623"><enum>(a)</enum><header>Subgrants
			 authorized</header><text>A State educational agency receiving a grant under
			 section 6 is authorized to award expanded learning time implementation
			 subgrants, on a competitive basis, to eligible entities that have received
			 subgrants pursuant to section 7.</text>
			</subsection><subsection id="ID664d7b30af174527acb4ef4b84bddf78"><enum>(b)</enum><header>Duration</header><text>The
			 State educational agency shall award each subgrant described in subsection (a)
			 for an initial period of not more than 3 years, and shall renew such subgrant
			 for an additional period of not more than 2 years if the State educational
			 agency finds that the eligible entity is achieving the objectives of the
			 subgrant and has shown improvement against baseline data on the performance
			 indicators described in section 6(d)(4).</text>
			</subsection><subsection id="ID6e2d9d2801f0470db8b6456e348fb7af"><enum>(c)</enum><header>Subgrant
			 amount</header><text>In awarding a subgrant described in subsection (a) to an
			 eligible entity, a State educational agency shall determine the amount of the
			 subgrant by taking into account the number of students expected to participate
			 in the expanded learning time initiatives involved, as specified in the
			 application submitted by the eligible entity under subsection (d), and the
			 approximate per student cost of implementing a high-quality expanded learning
			 time initiative.</text>
			</subsection><subsection id="ID4a1da46919814a839363b0391bdd909d"><enum>(d)</enum><header>Applications</header><text>Each
			 eligible entity desiring to receive an expanded learning time implementation
			 subgrant pursuant to this section shall submit an application to the State
			 educational agency at such time and in such manner as the agency may require.
			 At a minimum, the eligible entity's application shall include—</text>
				<paragraph id="ID5eb7e984afd549948616adf079092ab2"><enum>(1)</enum><text>an identification
			 and description of each high-need school (selected in accordance with the
			 process, considerations, and criteria described in section 7(d)(2)) that will
			 receive funding from the eligible entity to participate in an expanded learning
			 time initiative, including—</text>
					<subparagraph id="id72D354E102834B5D849F6E0C3FBB6363"><enum>(A)</enum><text>the number of
			 students that will be served through the initiative at the school; and</text>
					</subparagraph><subparagraph id="id43820003F1EA4FED90B3833C316A15D6"><enum>(B)</enum><text>student academic
			 achievement, demographic, and socioeconomic data for students at the
			 school;</text>
					</subparagraph></paragraph><paragraph id="IDbbc727c0d00f42a4858fb12325693357"><enum>(2)</enum><text>a description of
			 how the eligible entity will implement at each such school an expanded learning
			 time initiative that involves an expanded school day, expanded school week, or
			 expanded school year schedule, and school redesign at each such school
			 consistent with section 4(a)(4)(A), which description shall include—</text>
					<subparagraph id="IDf8782feafb5c47478257b943d6e16813"><enum>(A)</enum><text>a description of
			 how the expanded learning time schedule will expand learning time by not less
			 than 300 hours, consistent with section 4(a)(4); and</text>
					</subparagraph><subparagraph id="ID2050937f37f24589aca98b02f524bb98"><enum>(B)</enum><text>a description of
			 how the eligible entity will meet each of the other requirements of the
			 definition in section 4(a)(4);</text>
					</subparagraph></paragraph><paragraph id="ID626e7bef7f1847a3b702f381221ea516"><enum>(3)</enum><text>a description of
			 the plan the eligible entity will use to evaluate, on an annual basis, the
			 impact of each expanded learning time initiative, based on measures of student
			 academic achievement, student engagement and success, and other appropriate
			 measures;</text>
				</paragraph><paragraph id="ID18575696b6774055b24366a3946c0f92"><enum>(4)</enum><text>a description of
			 the additional subjects and enrichment activities that will be offered at each
			 such school that contribute to a well-rounded education;</text>
				</paragraph><paragraph id="IDf2d76d08ee0946099b618c72a3825c4b"><enum>(5)</enum><text>a comprehensive
			 plan, developed in collaboration with teachers and, as appropriate, other
			 staff, for professional development at each such school that includes a
			 description of intended changes in teaching practices and curriculum delivery
			 that will result in improved student academic achievement and student
			 engagement and success;</text>
				</paragraph><paragraph id="IDc9e03ab868d5406298aac5c73441b9cd"><enum>(6)</enum><text>a description of
			 how the eligible entity will use the expanded learning time initiatives, and
			 lessons learned from such initiatives, to improve student academic achievement
			 in schools that have not made adequate yearly progress under section 1111(b)(2)
			 of the Elementary and Secondary Education Act of 1965 (20 U.S.C. 6311(b)(2))
			 for 2 or more consecutive years;</text>
				</paragraph><paragraph id="IDd5c950a7bab84a2f9bdf7856d445f5e1"><enum>(7)</enum><text>evidence of an
			 agreement reached between each participating local educational agency and the
			 exclusive recognized representative of the employees of each participating
			 high-need school served by the agency, for employees to work the expanded
			 learning time schedules involved, or if there is no such representative,
			 evidence of an agreement supported by at least <fraction>2/3</fraction> of the
			 employees of each participating high-need school served by the local
			 educational agency, to work the expanded learning time schedules
			 involved;</text>
				</paragraph><paragraph id="ID77be35e268434cf3b6ea88c4ce580699"><enum>(8)</enum><text>a description of
			 how the local educational agency involved and participating high-need schools
			 will work with external organizations that comprise the eligible entity
			 involved, and any other external organizations as applicable (such as a
			 community-based organization, an institution of higher education, a community
			 learning center, an entity carrying out an after-school program, or an
			 organization that will provide students with internships and work-based
			 learning opportunities) to implement expanded learning time initiatives,
			 including a description of the specific roles and responsibilities of such
			 external organizations;</text>
				</paragraph><paragraph id="IDf2f70490e9ca49d49ad34ce961e3b6ea"><enum>(9)</enum><text>a description of
			 the process by which the eligible entity ensured the meaningful involvement of
			 teachers, teacher organizations, where applicable, administrators, parents, and
			 community-based organizations in the development (including the design) of the
			 expanded learning time initiatives;</text>
				</paragraph><paragraph id="IDbfcfa4d9aba84a969d63581dd3637d28"><enum>(10)</enum><text>an assurance
			 that the eligible entity will work with a community learning center, or an
			 entity carrying out an after-school program, where appropriate, to provide
			 after-school programs for students participating in the expanded learning time
			 initiatives after the conclusion of the school day; and</text>
				</paragraph><paragraph id="ID5e93f8ae07ba49ebae7d16216fff8456"><enum>(11)</enum><text>an assurance
			 that the eligible entity will report to the State educational agency all data
			 necessary for the State educational agency's report, under section
			 6(d)(4).</text>
				</paragraph></subsection><subsection id="IDc488985d04dd4c9a9ba97e05c4a91c5b"><enum>(e)</enum><header>Priority</header><text>In
			 awarding subgrants under this section, a State educational agency shall give
			 priority to an application from an eligible entity that meets the criteria
			 described in section 7(f).</text>
			</subsection><subsection id="IDc4e6847132bf418b90f0ad8594e8c304"><enum>(f)</enum><header>Authorized
			 activities</header><text>An eligible entity receiving a subgrant under this
			 section shall use the subgrant funds to implement high-quality expanded
			 learning time initiatives, at high-need schools served by such eligible entity,
			 that are consistent with section 4(a)(4).</text>
			</subsection><subsection id="ID9f9f5bc224464351a4b2f3a5ac3e2326"><enum>(g)</enum><header>Reports by
			 eligible entities</header><text>Each eligible entity receiving a subgrant under
			 this section for expanded learning time initiatives shall, not later than 1
			 year after the first day of the first school year in which the expanded
			 learning time initiatives were implemented, prepare and submit to the State
			 educational agency a report—</text>
				<paragraph id="IDf4354b6dfe9f40fba5b516a488954120"><enum>(1)</enum><text>containing a
			 detailed description of the expanded learning time initiatives carried
			 out;</text>
				</paragraph><paragraph id="ID977cb272914948c4a644bbb7d24a0996"><enum>(2)</enum><text>regarding the
			 technical assistance the eligible entity provided to expanded learning time
			 schools;</text>
				</paragraph><paragraph id="IDb1afbef3189f47d6a9622e2a55c8f10a"><enum>(3)</enum><text>for each expanded
			 learning time school—</text>
					<subparagraph id="ID52aeda5857f64861bcb31816fa53cda9"><enum>(A)</enum><text>regarding the
			 budget for, and actual expenses associated with carrying out, the expanded
			 learning time initiatives in the first school year; and</text>
					</subparagraph><subparagraph id="ID1ec273c745464685a1dca25b3e4cea6e"><enum>(B)</enum><text>regarding the
			 amount of time by which the school day, school week, or school year, was
			 expanded in the school; and</text>
					</subparagraph></paragraph><paragraph id="ID5d08c2e0a3ac4846b4ee15f28992997e"><enum>(4)</enum><text>containing
			 information on the impact of the expanded learning time initiatives,
			 including—</text>
					<subparagraph id="id9670D897F1284234A61F50C525D247CD"><enum>(A)</enum><text>data on student
			 academic achievement and growth as measured by State academic assessments
			 required under section 1111(b)(3) of the Elementary and Secondary Education Act
			 of 1965 (20 U.S.C. 6311(b)(3));</text>
					</subparagraph><subparagraph id="idF06BDAE507FA4FB78349717F66B2F609"><enum>(B)</enum><text>graduation rates;
			 and</text>
					</subparagraph><subparagraph id="id393E89215F174656B1548C4E83B119AB"><enum>(C)</enum><text>indicators
			 described in section 6(d)(4).</text>
					</subparagraph></paragraph></subsection><subsection id="IDe5f45969463247f188a11191ef7edf72"><enum>(h)</enum><header>Publication and
			 availability of report summaries</header><text>The Secretary shall publish and
			 make widely available to the public, including through a website or other
			 means, a summary of the eligible entity reports received under section 6(d)(4)
			 and subsection (g).</text>
			</subsection></section><section id="ID82bf9fd64f6d49b4a992b4a4c63fe3e5"><enum>9.</enum><header>Grants to
			 eligible entities</header>
			<subsection id="ID8863d13f307d4caaacb2593ee6a5b194"><enum>(a)</enum><header>In
			 general</header><text>The Secretary may award a grant under this section to an
			 eligible entity that serves 1 or more areas within 1 or more States.</text>
			</subsection><subsection id="ID92313d9bf6ee4d349c1773b88e6f70d2"><enum>(b)</enum><header>Planning and
			 implementation grants</header><text>The Secretary may award a planning grant
			 under subsection (a), to the eligible entity, to carry out the activities
			 described in section 7(e). In the case of an eligible entity that has received
			 a planning grant under subsection (a), the Secretary may award an
			 implementation grant under subsection (a) to the eligible entity, to carry out
			 the activities described in section 8(f).</text>
			</subsection><subsection id="ID5026ef836f7e4dd98fc8a6d1ae0d3a6c"><enum>(c)</enum><header>Applications</header>
				<paragraph id="id3C864A9A0674480D875FCA11BB4A8F82"><enum>(1)</enum><header>In
			 General</header><text>To be qualified to receive a grant under subsection (a),
			 an eligible entity shall submit to the Secretary an application that contains
			 the following:</text>
					<subparagraph id="id674F29E7F5454FEAA904508890BADA91"><enum>(A)</enum><text>If the
			 application is for a planning grant—</text>
						<clause id="id97A4B674C4864AF1832D6C429AC0D419"><enum>(i)</enum><text>information
			 describing how the entity will undertake the activities described in section
			 6(c)(7); and</text>
						</clause><clause id="id70E3DF8FC2C54BB6B241BD24C9B33ABB"><enum>(ii)</enum><text>the information
			 described in section 7(d).</text>
						</clause></subparagraph><subparagraph id="id94777019C8F84C869FBF80A045EBA3FD"><enum>(B)</enum><text>If the
			 application is for an implementation grant, the information described in
			 section 8(d), other than paragraph (11) of that section.</text>
					</subparagraph></paragraph><paragraph id="id5B3FC81F60BC4F58BB4245134B056044"><enum>(2)</enum><header>Priority</header><text>In
			 determining whether to award a grant under subsection (a) to an eligible
			 entity, the Secretary shall give priority to an eligible entity that meets the
			 criteria described in section 7(f).</text>
				</paragraph></subsection><subsection id="ID084c2812ff6547dd9750b616f48aeb70"><enum>(d)</enum><header>Period;
			 amount</header><text>The subgrant period and amount described in subsections
			 (b) and (c) of section 7 or 8, as appropriate, shall apply to the grant.</text>
			</subsection><subsection id="IDd19798a681aa48f2915077017971cc32"><enum>(e)</enum><header>Authorities;
			 responsibilities</header><text>The eligible entity shall have the same
			 authorities and responsibilities under this Act as an eligible entity that
			 receives a subgrant under section 7 or 8, as appropriate. In carrying out the
			 report responsibilities described in section 8(g), the eligible entity shall
			 submit the reports to the Secretary.</text>
			</subsection><subsection id="IDe92618cf5bb749a293022b01abffa37c"><enum>(f)</enum><header>Match</header>
				<paragraph id="ID5e07fdc1e65740979e10cc51b3b7fe88"><enum>(1)</enum><header>In
			 general</header><text>Each eligible entity that receives an implementation
			 grant under this section shall comply with the matching requirements described
			 in section 6(e)(1), except that references in that section to a grant under
			 section 6 shall be considered to be references to an implementation grant under
			 this section.</text>
				</paragraph><paragraph id="ID8967c07c0cf3499ab87b0eccda631709"><enum>(2)</enum><header>Matching
			 funds</header><text>The eligible entity may provide the matching funds in cash
			 or in kind, fairly evaluated, including plant, equipment, or services, but may
			 not provide more than 50 percent of the matching funds in kind. The eligible
			 entity may provide the matching funds from State, local, or private sources, or
			 Federal sources under the Elementary and Secondary Education Act of 1965 (20
			 U.S.C. 6301 et seq.).</text>
				</paragraph></subsection></section><section id="ID16098a26944548f8882415bfe57bbede"><enum>10.</enum><header>National
			 activities</header>
			<subsection id="ID24046ccca20a47ba9f1c2f5032a41be7"><enum>(a)</enum><header>Technical
			 assistance and support</header>
				<paragraph id="ID208fb653f39244bdb3498a12b66a3bd9"><enum>(1)</enum><header>In
			 general</header><text>The Secretary is authorized to provide, directly or by
			 entering into a contract with an independent organization, technical assistance
			 to State educational agencies, eligible entities, including eligible entities
			 receiving grants under section 9, local educational agencies, and schools in
			 developing and implementing expanded learning time initiatives under this
			 Act.</text>
				</paragraph><paragraph id="ID8f23a3838c14421f9dfe71ac83c87369"><enum>(2)</enum><header>Provision of
			 assistance</header><text>The Secretary or such organization shall provide
			 technical assistance that shall include—</text>
					<subparagraph id="ID60ff30ca46594fe58b646c9f2880f07c"><enum>(A)</enum><text>assisting State
			 educational agencies (and eligible entities receiving grants under section 9,
			 at the election of the Secretary) with developing expanded learning time
			 initiatives; and</text>
					</subparagraph><subparagraph id="IDf6c8752f20124857a6c36704facaf2c9"><enum>(B)</enum><text>identifying and
			 disseminating information about eligible entities, local educational agencies,
			 and schools that have effectively planned and implemented expanded learning
			 time initiatives, including schools that have implemented such initiatives to
			 improve student academic achievement in schools that previously had not made
			 adequate yearly progress under section 1111(b)(2) of the Elementary and
			 Secondary Education Act of 1965 (20 U.S.C. 6311(b)(2)) for 2 or more
			 years.</text>
					</subparagraph></paragraph></subsection><subsection id="IDb1c977d826144126af045ad594e2f1fc"><enum>(b)</enum><header>Evaluation and
			 dissemination</header>
				<paragraph id="ID2d3f3a4d56424a9fa4258645a7ba0c08"><enum>(1)</enum><header>In
			 general</header><text>The Secretary shall enter into a contract with an
			 independent organization with expertise in school improvement, program
			 evaluation, and measurement (such as an institution of higher education or
			 other research organization) to assist with the provision of the technical
			 assistance, and conduct the evaluation and analyses, described in this
			 subsection.</text>
				</paragraph><paragraph id="ID03c5cbd0bd3447f2aa7bbe6f33b5cca4"><enum>(2)</enum><header>Technical
			 assistance on data collection and measures</header>
					<subparagraph id="ID0b3e48a661e04c7d83921ef5e300cd81"><enum>(A)</enum><header>In
			 general</header><text>The independent organization shall provide technical
			 assistance to State educational agencies and eligible entities receiving funds
			 under this Act with data collection and analysis of—</text>
						<clause id="IDddae8339f2dc436391b893b3ccf991ba"><enum>(i)</enum><text>measures of
			 student academic achievement and student engagement and success, including the
			 indicators and other measures described in section 6(d)(4);</text>
						</clause><clause id="ID1df411b1ec6c47899fdb7bc59c739e71"><enum>(ii)</enum><text>measures of
			 teacher collaboration and common planning; and</text>
						</clause><clause id="ID775c9ef91a664eb0b76542e02ac2fd9b"><enum>(iii)</enum><text>detailed
			 measures of the amount of time devoted to core academic subjects and additional
			 subjects and enrichment activities.</text>
						</clause></subparagraph><subparagraph id="IDf826253811de459a82a57bc13088ddbf"><enum>(B)</enum><header>Special rule
			 for eligible entities receiving grants under Section 9</header><text>If an
			 eligible entity receives a grant under section 9, the eligible entity shall
			 establish measures in lieu of the measures described in subparagraph (A) to
			 assess the success of the eligible entity and schools receiving funds through
			 the eligible entity under this Act.</text>
					</subparagraph></paragraph><paragraph id="IDcc96afaf31de4e08bac55fcf9e577c01"><enum>(3)</enum><header>Report</header>
					<subparagraph id="IDc46b974965564007bbcc4e58c65e253c"><enum>(A)</enum><header>In
			 general</header><text>The independent organization shall prepare a report that
			 shall include the evaluation described in subparagraph (B), including the
			 analyses described in subparagraph (C), and the analyses described in
			 subparagraph (D).</text>
					</subparagraph><subparagraph id="IDebab304db7fc4f31b580ee704c9ca736"><enum>(B)</enum><header>Evaluation</header><text>The
			 independent organization shall conduct an evaluation of the impact and
			 implementation of the program funded under this Act, which evaluation shall
			 rely in part on the reports prepared by States under section 6(d)(4) and
			 eligible entities pursuant to section 8(g) (including reports described in
			 section 9(e)).</text>
					</subparagraph><subparagraph id="ID8359ac5f07ca47b0a8fb7220af608940"><enum>(C)</enum><header>Contents</header><text>In
			 conducting the evaluation, the independent organization shall conduct an
			 analysis of the impact of the expanded learning time initiatives funded under
			 this Act, by analyzing data on the measures described in paragraph (2) and
			 other appropriate measures for students participating in expanded learning time
			 initiatives in all expanded learning time schools, with results from that
			 analysis disaggregated by expanded school day, expanded school week, or
			 expanded school year program, as appropriate.</text>
					</subparagraph><subparagraph id="ID873f5c8dd4304e58822fae27e58dd697"><enum>(D)</enum><header>Analyses</header><text>The
			 independent organization shall conduct—</text>
						<clause id="IDb721d5e2659446b6a57a99c9ba72374d"><enum>(i)</enum><text>a
			 comparative analysis of how variation in school design, instructional
			 practices, and other conditions influence the success of the implementation of
			 the expanded learning time initiatives;</text>
						</clause><clause id="ID23665e9a692e4efaac25070d21249a7b"><enum>(ii)</enum><text>a
			 comparative analysis of the conditions and activities that impact the planning
			 and implementation of the expanded learning time initiatives, including—</text>
							<subclause id="id0227C2E01A434CD1B89A8A6CAFF805F1"><enum>(I)</enum><text>teaching and
			 leadership practices at a school;</text>
							</subclause><subclause id="id87BAE6A640D64C4C878E25AD8E83704B"><enum>(II)</enum><text>student and
			 teacher schedules;</text>
							</subclause><subclause id="id938744865459419AA58119F99A4B1A8F"><enum>(III)</enum><text>the additional
			 costs of operating an expanded learning time school;</text>
							</subclause><subclause id="id80B5FD6AB4AC4437AD88AE19C6A08365"><enum>(IV)</enum><text>how the
			 additional school hours required for the initiative involved are used to
			 enhance teaching and learning; and</text>
							</subclause><subclause id="idC0030D0153D6460BA0824CDD0FAF8057"><enum>(V)</enum><text>how external
			 organizations are utilized for the initiative;</text>
							</subclause></clause><clause id="ID65b6ea52cd67457ea734e7a5904819e5"><enum>(iii)</enum><text>an analysis of
			 the similarities and differences in the ways in which schools implemented an
			 expanded school day, expanded school week, or expanded school year schedule;
			 and</text>
						</clause><clause id="IDc9b6cd91e4ad404791d79e5ea5c685e2"><enum>(iv)</enum><text>any other
			 analysis requested by the Secretary.</text>
						</clause></subparagraph></paragraph><paragraph id="ID53c4e8aa459342808aadff403cf36b2c"><enum>(4)</enum><header>Dissemination</header><text>The
			 independent organization shall submit the report described in paragraph (3) to
			 Congress and the Secretary, and disseminate the report to the general public.
			 The Secretary shall ensure that the report described in paragraph (3) is
			 provided to eligible entities and local educational agencies on a periodic
			 basis for use in improving initiatives.</text>
				</paragraph></subsection></section><section id="ID6b3cadabee094deb8c901284269ffbb1"><enum>11.</enum><header>Construction</header><text display-inline="no-display-inline">Nothing in this Act shall be construed to
			 alter or otherwise affect the rights, remedies, and procedures afforded to the
			 employees of local educational agencies under Federal, State, or local law
			 (including applicable regulations or court orders) or under the terms of
			 collective bargaining agreements, memoranda of understanding, or other
			 agreements between such employees and their employers.</text>
		</section><section id="ID1143cfd03b5c427aa5624b744b2b0636"><enum>12.</enum><header>Authorization
			 of appropriations</header><text display-inline="no-display-inline">There are
			 authorized to be appropriated to carry out this Act such sums as may be
			 necessary.</text>
