		  State of Texas, and for other purposes.</official-title>

		<section id="HF3BCC67DFC56446AB3F2F437DE2AAD38" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Waco Mammoth National Monument
			 Establishment Act of 2011</short-title></quote>.</text>
		</section><section id="H11104291C32A4D91A9DCE2D7A3383DE0" section-type="subsequent-section"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text>
			<paragraph id="HDDA110811A414419A7361F7C13887C60"><enum>(1)</enum><text display-inline="yes-display-inline">the Waco Mammoth Site area is located near
			 the confluence of the Brazos River and the Bosque River in Central Texas, near
			 the city of Waco;</text>
			</paragraph><paragraph id="HB4DADEE6BB3B4DD09973DF9110CB4086"><enum>(2)</enum><text display-inline="yes-display-inline">after the discovery of bones emerging from
			 eroding creek banks leading to the uncovering of portions of 5 mammoths, Baylor
			 University began investigating the site in 1978;</text>
			</paragraph><paragraph id="H54D1C21D5F264AE89DF3D6A54B770D9D"><enum>(3)</enum><text display-inline="yes-display-inline">several additional mammoth remains have
			 been uncovered making the site the largest known concentration of mammoths
			 dying from the same event;</text>
			</paragraph><paragraph id="HEBB10B3690FE4AD7A75CEC146F1349DD"><enum>(4)</enum><text display-inline="yes-display-inline">the mammoth discoveries have received
			 international attention; and</text>
			</paragraph><paragraph id="H789AAC663B1A4463A30B4D3D9EBAEBC1"><enum>(5)</enum><text display-inline="yes-display-inline">Baylor University and the city of Waco,
			 Texas, have been working together—</text>
				<subparagraph id="H976ED811B10243BDA1909ADF2F3755E6"><enum>(A)</enum><text display-inline="yes-display-inline">to protect the site; and</text>
				</subparagraph><subparagraph id="H679204050DEF4E6DB6231EF04CBF9608"><enum>(B)</enum><text display-inline="yes-display-inline">to develop further research and educational
			 opportunities at the site.</text>
				</subparagraph></paragraph></section><section id="H2610ED45C19744249737C2F5F39DE305"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="HF63F2303E1DC408C9875AF7BBBCCD19B"><enum>(1)</enum><header>City</header><text>The
			 term <quote>City</quote> means the city of Waco, Texas.</text>
			</paragraph><paragraph id="H0332E206FF5E46A699A1931FCC77E639"><enum>(2)</enum><header>Management
			 plan</header><text>The term <quote>management plan</quote> means the management
			 plan for the Monument prepared under section 5(c)(1).</text>
			</paragraph><paragraph id="H50316EBF810F4935B33369F7B75F0D31"><enum>(3)</enum><header>Map</header><text display-inline="yes-display-inline">The term <quote>map</quote> means the map
			 entitled <quote>Proposed Boundary Waco-Mammoth National Monument</quote>,
			 numbered T21/80,000, and dated April 2009.</text>
			</paragraph><paragraph id="HB58C22C5A9F14E94A97D91B82EE70046"><enum>(4)</enum><header>Monument</header><text display-inline="yes-display-inline">The term <quote>Monument</quote> means the
			 Waco Mammoth National Monument established by section 4(a).</text>
			</paragraph><paragraph id="HAEBF56C9470A417ABE1EEA99230EC23C"><enum>(5)</enum><header>Secretary</header><text display-inline="yes-display-inline">The term <quote>Secretary</quote> means the
			 Secretary of the Interior.</text>
			</paragraph><paragraph id="H2CD7E749EA8843B58B7E851D71E84BFC"><enum>(6)</enum><header>State</header><text>The
			 term <quote>State</quote> means the State of Texas.</text>
			</paragraph><paragraph id="H35BC05CA4B554D728439C097332882A1"><enum>(7)</enum><header>University</header><text>The
			 term <quote>University</quote> means Baylor University in the State.</text>
			</paragraph></section><section id="HCF73D0E70669418B83EE1C611CB05926"><enum>4.</enum><header>Waco Mammoth
			 National Monument, Texas</header>
			<subsection id="H713327EDE58F451D90798F1854CE6A44"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">There is established in the State, as a
			 unit of the National Park System, the Waco Mammoth National Monument, as
			 generally depicted on the map.</text>
			</subsection><subsection id="HD39B80692D61401B9CBACD8978C9573E"><enum>(b)</enum><header>Availability of
			 map</header><text display-inline="yes-display-inline">The map shall be on file
			 and available for public inspection in the appropriate offices of the National
			 Park Service.</text>
			</subsection></section><section id="HFC81826E3C47455C8C3E05F581AE7290"><enum>5.</enum><header>Administration of
			 monument</header>
			<subsection id="H4E91D592DCB244869676E9625B45FDFC"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Secretary shall
			 administer the Monument in accordance with—</text>
				<paragraph id="HD05DE3CCC22142A7AE7FA662F4FC7B2D"><enum>(1)</enum><text display-inline="yes-display-inline">this Act; and</text>
				</paragraph><paragraph id="HAC4B573AE72B494881077BCE70BECEC3"><enum>(2)</enum><text display-inline="yes-display-inline">any cooperative agreements entered into
			 under subsection (b)(1).</text>
				</paragraph></subsection><subsection id="H27D811DDA68D43E28A0BB6154D6446D8"><enum>(b)</enum><header>Authorities of
			 Secretary</header>
				<paragraph id="H76678F897909494FA61C881C4A3B0BA1"><enum>(1)</enum><header>Cooperative
			 Agreements</header><text display-inline="yes-display-inline">The Secretary may
			 enter into cooperative management agreements with the University and the City,
			 in accordance with section 3(<italic>l</italic>) of Public Law 91–383 (16
			 U.S.C. 1a–2(<italic>l</italic>)).</text>
				</paragraph><paragraph id="HF1AB235C43624170A550EB2715F42C1B"><enum>(2)</enum><header>Acquisition of
			 land</header><text display-inline="yes-display-inline">The Secretary may
			 acquire by donation from the City any land or interest in land owned by the
			 City within the proposed boundary of the Monument.</text>
				</paragraph></subsection><subsection id="H3751B67E3D6740A49FB460AAB4169C20"><enum>(c)</enum><header>General
			 Management plan</header>
				<paragraph id="HCFC4ED45BE80405D8A26C4F1B8A3FD06"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Not later than 3
			 years after the date of enactment of this Act, the Secretary, in consultation
			 with the University and the City, shall complete a general management plan for
			 the Monument.</text>
				</paragraph><paragraph id="H91734DAD04644F87A2D8E43CE1ABDD39"><enum>(2)</enum><header>Inclusions</header><text display-inline="yes-display-inline">The management plan shall include, at a
			 minimum—</text>
					<subparagraph id="H744CE70807B74C03AE15AE2689E6ABCF"><enum>(A)</enum><text display-inline="yes-display-inline">measures for the preservation of the
			 resources of the Monument;</text>
					</subparagraph><subparagraph id="H0F31A442A75F4FE8B0465D72F2A1A1C3"><enum>(B)</enum><text display-inline="yes-display-inline">requirements for the type and extent of
			 development and use of the Monument;</text>
					</subparagraph><subparagraph id="HCF42580459594553BE2FB116C32FC2C1"><enum>(C)</enum><text display-inline="yes-display-inline">identification of the capacity of the
			 Monument for accommodating visitors; and</text>
					</subparagraph><subparagraph id="HE30B93F83B174E5C8173E5820E8D027D"><enum>(D)</enum><text display-inline="yes-display-inline">opportunities for involvement by the
			 University, City, State, and other local and national entities in—</text>
						<clause id="H4D32DB2D0F8246C5A8CF240C6620A9E2"><enum>(i)</enum><text display-inline="yes-display-inline">developing educational programs for the
			 Monument; and</text>
						</clause><clause id="HBE2153B9B8B847C7BD88527B52B64056"><enum>(ii)</enum><text display-inline="yes-display-inline">developing and supporting the
			 Monument.</text>
						</clause></subparagraph></paragraph></subsection><subsection id="H02B1824F906048A99D7C912CC205B22A"><enum>(d)</enum><header>Prohibition of
			 use of Federal funds</header><text>No Federal funds may be used to pay the
			 costs of—</text>
				<paragraph id="HDD44ABCA8D964291B11126C6E4EC3ABA"><enum>(1)</enum><text>carrying out a
			 cooperative agreement under subsection (b)(1);</text>
				</paragraph><paragraph id="H54181C8298BA4762A7F82EC3DD992F96"><enum>(2)</enum><text>acquiring land for
			 inclusion in the Monument under subsection (b)(2);</text>
				</paragraph><paragraph id="H60C45BA0257C46798750363DFE7947DE"><enum>(3)</enum><text>developing a
			 visitor center for the Monument;</text>
				</paragraph><paragraph id="H6A8CB678F77D44A7A9B107A8F2CA7AB6"><enum>(4)</enum><text>operating or
			 maintaining the Monument;</text>
				</paragraph><paragraph id="HE46173C643DD407D93442F57FBA4A661"><enum>(5)</enum><text>constructing
			 exhibits for the Monument; or</text>
				</paragraph><paragraph id="H6715813058AE46F296688A4F85582B8C"><enum>(6)</enum><text>developing the
			 general management plan under subsection (c).</text>
				</paragraph></subsection><subsection id="H38F864D1C85B4693BC05569B42234080"><enum>(e)</enum><header>Use of
			 non-Federal funds</header><text>Non-Federal funds may be used to pay any costs
			 that may be incurred by the Secretary or the National Park Service in carrying
			 out this section.</text>
			</subsection><subsection id="HD2EC222778C54966B8542776D7DDBE97"><enum>(f)</enum><header>Effect on
			 eligibility for financial assistance</header><text>Nothing in this Act affects
			 the eligibility of the Monument for Federal grants or other forms of financial
			 assistance that the Monument would have been eligible to apply for had National
			 Park System status not been conferred to the Monument under this Act.</text>
			</subsection><subsection id="H209A58008F5F430A9E107E442ACA03F5"><enum>(g)</enum><header>Termination of
			 national park system status</header>
				<paragraph id="H1A43AC4002E543C49080C207CF0C23C4"><enum>(1)</enum><header>In
			 general</header><text>Designation of the Monument as a unit of the National
			 Park System shall terminate if the Secretary determines that Federal funds are
			 required to operate and maintain the Monument.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H3B8130093E33419E827FE549DE8E1F77"><enum>(2)</enum><header>Reversion</header><text>If
			 the designation of the Monument as a unit of the National Park System is
			 terminated under paragraph (1), any land acquired by the Secretary from the
			 City under subsection (b)(2) shall revert to the City.</text>
				</paragraph></subsection></section><section id="H479C70B2730B4C949224CA78824A4DBA"><enum>6.</enum><header>No
			 buffer zones</header><text display-inline="no-display-inline">Nothing in this
			 Act, the establishment of the Monument, or the management plan shall be
			 construed to create buffer zones outside of the Monument.</text>
