				likelihood that such an inspection would assist in confirming the security
				measures in place and further the validation

			 Participants</header><text>Section 215(b) of the SAFE Port Act (6 U.S.C.
			 965(b)) is amended—</text>

			 <quote>and</quote> at the end of paragraph (2);</text>

			 (c)—</text>
					<subparagraph id="id52D02446C17A4220A09CFE571679B3EF"><enum>(A)</enum><text>in paragraph (3),
			 by striking <quote>and</quote> at the end;</text>
					</subparagraph><subparagraph id="id5C133031FC8A45EB8339AE452198ECC4"><enum>(B)</enum><text>in paragraph (4),
			 by striking <quote>and</quote> at the end;</text>

					</subparagraph></paragraph><paragraph id="id854B28A2E70945828A16B0FB2366149F"><enum>(2)</enum><text>by striking
			 subsection (d) and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="id8AB63A36A3B74CCFB323E5BE4B64CAFA" style="OLC">
						<subsection id="id5392400B8BA644A1987F1644BF338EB4"><enum>(d)</enum><header>Private sector
				information sharing on security threats</header>
							<paragraph id="idD46E1A4089D74E2CB388DF4559A6DDA6"><enum>(1)</enum><header>In
				general</header><text>The Secretary shall establish a program to promote
				sharing information with Tier 3 participants and other private entities
				regarding—</text>
								<subparagraph id="id7386E7E33E2C44B382D153A1BD5C30A3"><enum>(A)</enum><text>potential
				vulnerabilities, attacks, and exploitations of the international supply chain;
				and</text>
								</subparagraph><subparagraph id="id95D61A9DCDBF44A98DC9F4E0D39AFFE5"><enum>(B)</enum><text>means and methods
				of preventing, responding to, and mitigating consequences from the
				vulnerabilities, attacks, and exploitations described in subparagraph
				(A).</text>
								</subparagraph></paragraph><paragraph id="id4CD3735CF6DA4D14AB5DE6BBCF381B05"><enum>(2)</enum><header>Contents</header><text>The
				program established under paragraph (1) shall include—</text>
								<subparagraph id="id1D73D26ECFFF41D6A046E578D557E423"><enum>(A)</enum><text>the creation of
				classified and unclassified means of accessing information that may be used by
				appropriately cleared personnel and that will provide, as appropriate, ongoing
				situational awareness of the security of the international supply chain;
				and</text>
								</subparagraph><subparagraph id="ID0650c9fcd23e4f52ab6d8b299eb066bd"><enum>(B)</enum><text>the creation of
				guidelines to establish a mechanism by which owners and operators of
				international supply chain infrastructure may report actual or potential
				security
				breaches.</text>
								</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection></section><section id="id14D3BB70B92F47E59269EA857BB1880E"><enum>4.</enum><header>Recognition of
			 other countries’ trusted shipper programs</header><text display-inline="no-display-inline">Section 218 of the
			 <short-title>SAFE Port Act</short-title> (6 U.S.C. 968) is
			 amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="id30A9EA04FAD4440A8AF8D8BCC3D51EB1" style="OLC">
				<subsection id="id4EB8F07EA17042818CBDE6E4AB0D4E62"><enum>(j)</enum><header>Recognition of
				other countries’ trusted shipper programs</header><text display-inline="yes-display-inline">Not later than 30 days before entering into
				an arrangement between the United States and a foreign government providing for
				mutual recognition of supply chain security programs, which may result in the
				awarding of benefits described in section 214, 215, or 216 of the SAFE Port
				Act, the Secretary of Homeland Security shall—</text>
					<paragraph id="id8F64A2E2C8A94671BB8F1AC9899EB0C7"><enum>(1)</enum><text display-inline="yes-display-inline">notify Congress of the proposed terms of
				such arrangement; and</text>
					</paragraph><paragraph id="idB7108EF3AF89403B84FDF602ABE494D4"><enum>(2)</enum><text display-inline="yes-display-inline">determine, in consultation with the
				Commissioner that the foreign government’s supply chain security program
				provides an equivalent level of supply chain security as provided by the
				Customs-Trade Partnership Against
				Terrorism.</text>
					</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="id5F34AE2E00704E61A5C3F2ACC959C8AB"><enum>5.</enum><header>Secure Freight
			 Initiative</header><text display-inline="no-display-inline">Section 232(b) of
			 the <short-title>SAFE Port Act</short-title> (6 U.S.C.
			 982(b)) is amended—</text>
			<paragraph id="id4DD240C6AC1A45848620696EFD4FFAD0"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1), by striking <quote>A
			 container</quote> and inserting <quote>Except as provided under paragraph (10),
			 a container</quote>; and</text>
			</paragraph><paragraph id="id5F286FD8491242FD8FEEC269D2B0788D"><enum>(2)</enum><text>by adding at the
			 end the following:</text>
				<quoted-block display-inline="no-display-inline" id="idE9CD505943B14E32B606378D0BAA65FF" style="OLC">
					<paragraph id="id08C6A8067B9E4AFA8B351DED51141D05"><enum>(10)</enum><header>Waiver</header><text>The
				Secretary may waive the application of paragraph (1) if the Secretary certifies
				to Congress that—</text>
						<subparagraph id="id4E65B7458A414023BFBCE0372A9BCC44"><enum>(A)</enum><text>C–TPAT
				revalidations are occurring at least once every 4 years;</text>
						</subparagraph><subparagraph id="idB7AAE72D202D4F2780BE331BB0BFF8B5"><enum>(B)</enum><text>the Container
				Security Initiative has been implemented and is in operation at all high-risk
				foreign ports;</text>
						</subparagraph><subparagraph id="id063DD1471E194476B17575339C4BD171"><enum>(C)</enum><text>100 percent of
				cargo containers originating outside the United States undergo a screening to
				identify high-risk containers;</text>
						</subparagraph><subparagraph id="id4E8FFDFE16ED4361AFF04CE899C5CABE"><enum>(D)</enum><text>100 percent of
				the containers that have been identified as high-risk are scanned or searched
				before entering the United States; and</text>
						</subparagraph><subparagraph id="id40E29D8DB03D47F385937B42FE1CB19C"><enum>(E)</enum><text>the additional
				data elements required to be submitted to the Department under section 203 to
				identify high-risk cargo have improved the capabilities of the Automated
				Targeting System, based on empirical evidence of seizures of illegal narcotics
				and dangerous
				materials.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="ID6b1244ca77834c918bdf835537d99878"><enum>6.</enum><header>Strengthening
			 America’s Waterway Watch Program</header>
			<subsection id="IDd91649f86f4c4d748203480ab4639858"><enum>(a)</enum><header>Immunity</header>
				<paragraph id="ID388b04bf9b6140bb960f43df65232b70"><enum>(1)</enum><header>Immunity for
			 reports of suspected terrorist activity or suspicious behavior and
			 response</header>
					<subparagraph id="ID6aadc104333443d0a7c0fa068cd7fea8"><enum>(A)</enum><header>In
			 general</header><text>Any individual who, in good faith and based on
			 objectively reasonable suspicion, makes, or causes to be made, a voluntary
			 report of covered activity to an authorized official shall be immune from civil
			 liability under Federal, State, and local law for such report.</text>
					</subparagraph><subparagraph id="ID5fab28ca2d6f491cb75fdd55978e0194"><enum>(B)</enum><header>False
			 reports</header><text>Subparagraph (A) shall not apply to any report
			 that—</text>
						<clause id="IDe5eefc69ef5e4c5fb7806c161943bad9"><enum>(i)</enum><text>the
			 individual knew to be false; or</text>
						</clause><clause id="IDa504d02880a74dc6a6db8a904acc0899"><enum>(ii)</enum><text>was made with
			 reckless disregard for the truth at the time that individual made the
			 report.</text>
						</clause></subparagraph></paragraph><paragraph id="IDca79ada22a6c4528b0917796cb45744d"><enum>(2)</enum><header>Immunity for
			 response</header>
					<subparagraph id="ID30d8d7d5b61249049e4607dd2035e4cd"><enum>(A)</enum><header>In
			 general</header><text>Any authorized official who observes, or receives a
			 report of, a covered activity and takes reasonable action in good faith to
			 respond to such activity shall have qualified immunity from civil liability for
			 such action, consistent with the applicable law of the relevant jurisdiction.
			 An authorized official not entitled to assert the defense of qualified immunity
			 shall be immune from civil liability under Federal, State, and local law if
			 such authorized official takes reasonable action, in good faith, to respond to
			 the reported activity.</text>
					</subparagraph><subparagraph id="ID823b43ee98ea42778668fd457d513692"><enum>(B)</enum><header>Savings
			 provision</header><text>Nothing in this paragraph may be construed to—</text>
						<clause id="ID0e7ea7f1129a4b46ac3c8623a89fc738"><enum>(i)</enum><text>affect the
			 ability of any authorized official to assert any defense, privilege, or
			 immunity that would otherwise be available under applicable law; or</text>
						</clause><clause id="ID0427ab86cbab4aba8b85994c096855ab"><enum>(ii)</enum><text>affect any such
			 defense, privilege, or immunity.</text>
						</clause></subparagraph></paragraph><paragraph id="IDe23865040ce94e91b50d83e8e57a7fbd"><enum>(3)</enum><header>Attorney fees
			 and costs</header><text>Any individual or authorized official granted immunity
			 from civil liability under this section shall be entitled to recover from the
			 plaintiff all reasonable costs and attorney fees.</text>
				</paragraph><paragraph commented="no" id="id4F8362702FEB446D8BB77143D0067DAA"><enum>(4)</enum><header>Exemption for
			 FOIA</header><text>A report regarding a covered activity made under this
			 section shall not be subject to disclosure under section 552 of title 5, United
			 States Code (commonly referred to as the Freedom of Information Act).</text>
				</paragraph></subsection><subsection id="IDcb4880c92982467187f64197a728304d"><enum>(b)</enum><header>Report</header><text>In
			 accordance with section 801 of the Coast Guard Authorization Act of 2010
			 (Public Law 111–281; 124 Stat. 2989), the Secretary shall submit a report that
			 describes the coordination of the America's Waterway Watch Program and similar
			 critical infrastructure suspicious activity reporting programs within the
			 Department of Homeland Security. In addition to submitting the report to the
			 Committee on Commerce of the Senate and the Committee on Homeland Security of
			 the House of Representatives, the Secretary shall submit the report to the
			 Committee on Homeland Security and Governmental Affairs of the Senate.</text>
			</subsection><subsection id="ID6b150eee83c54b1ba193f0c6159af9bc"><enum>(c)</enum><header>Definitions</header><text>In
			 this section:</text>
				<paragraph id="IDc041e6db16fd499998104b0c3be3495f"><enum>(1)</enum><header>Act of
			 terrorism</header><text>The term <term>act of terrorism</term> has the meaning
			 given the term in section 3077 of title 18, United States Code.</text>
				</paragraph><paragraph id="IDaf235e1890364e29a5357201250bb4a8"><enum>(2)</enum><header>Authorized
			 official</header><text>The term <term>authorized official</term> means—</text>
					<subparagraph id="ID2689fab2a570490dbf7180aa2b6a6a9a"><enum>(A)</enum><text>any employee or
			 agent of a vessel, facility, port, or waterway or other person with
			 responsibilities relating to the security of such systems;</text>
					</subparagraph><subparagraph id="IDe47f743e1da84587a2b853b2fb3d954b"><enum>(B)</enum><text>any officer,
			 employee, or agent of the Department of Homeland Security, the Department of
			 Transportation, or the Department of Justice with responsibilities relating to
			 the security of vessels, facilities, ports, or waterways; and</text>
					</subparagraph><subparagraph id="ID1ed488ed07e649e1adfe5989e86adb84"><enum>(C)</enum><text>any Federal,
			 State, or local law enforcement officer.</text>
					</subparagraph></paragraph><paragraph id="ID0294947c9f1e45ea9f7e9e2148ad8961"><enum>(3)</enum><header>Covered
			 activity</header><text>The term <term>covered activity</term> means any
			 suspicious transaction, activity, or occurrence that—</text>
					<subparagraph id="ID9ecf3c499fe24ef9a83262f4c53ac74c"><enum>(A)</enum><text>involves, or is
			 directed against, a vessel, facility, port, or waterway; and</text>
					</subparagraph><subparagraph id="IDe9a74033deac4d689c331f8457e72cfb"><enum>(B)</enum><text>indicates that an
			 individual may be preparing to engage, or is engaging, in a violation of law
			 relating to—</text>
						<clause id="ID331ad1ba937e4ed596606e371ee0c2b9"><enum>(i)</enum><text>a
			 threat to a vessel, facility, port, or waterway; or</text>
						</clause><clause id="ID8e5ecdc773754f7eadb08921a55425c9"><enum>(ii)</enum><text>an
			 act of terrorism.</text>
						</clause></subparagraph></paragraph><paragraph id="IDc7dc4084465a4716bf128a16c573133d"><enum>(4)</enum><header>Facility</header><text>The
			 term <term>facility</term> has the meaning given the term in section 70101(2)
			 of title 46, United States Code.</text>
				</paragraph></subsection></section><section id="ID6a496dce72494aca96577ef6dbe2b701"><enum>7.</enum><header>Port security
			 grant program management</header>
			<subsection id="id6CEAA0A289CB4CED914BA69AE92373B9"><enum>(a)</enum><header>Determination
			 of applications</header><text>Section 70107(g) of title 46, United States Code,
			 is amended—</text>
				<paragraph id="id09A3C02786904E1DA69B13B0789AD9E6"><enum>(1)</enum><text>by striking “Any
			 entity” and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="idB380220DD527427982F87E98A062D334" style="OLC">

				general</header><text>Any entity</text>

				</paragraph><paragraph id="idB53F52B581C742AD8A2B4B4D339F92B6"><enum>(2)</enum><text>by adding at the
			 end the following:</text>

				any other provision of law, the Secretary shall, not later than 60 days after
				the date on which an applicant submits a complete application for a grant under
				this section, either approve or disapprove the
				application.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="ID1f6138e9b421491bb5609c945dbc4efb"><enum>(b)</enum><header>Administration
			 of cost share determinations</header><text>Section 70107(c)(2) of title 46,
			 United States Code, is amended by inserting after subparagraph (C) the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="idC9D8F69B6047440997CA8AA0FA09FFE1" style="OLC">
					<subparagraph id="ID1ce1086cb7d841feb2624446b97e4a05"><enum>(D)</enum><header>Cost share
				determinations</header><text>Notwithstanding any other provision of law, not
				later than 60 days after the date on which an applicant submits a complete
				application for a matching requirement (other than a project specified in
				paragraph (1)), the Secretary shall either approve or disapprove the
				application.</text>
					</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="ID963315c4a3b74f148b6edb690ec50879"><enum>(c)</enum><header>Administration
			 of extensions</header><text>Section 70107(i) of title 46, United States Code,
			 is amended by inserting after paragraph (4) the following:</text>
				<quoted-block display-inline="no-display-inline" id="id877E88AFD6E54A619D24B5BB52B9D39B" style="OLC">
					<paragraph id="IDcb730033117a46cba593bbb8c7c11beb"><enum>(5)</enum><header>Extension
				determinations</header><text>Notwithstanding any other provision of law, not
				later than 60 days after the date on which an applicant submits a complete
				application for a grant extension, the Secretary shall either approve or
				disapprove the
				application.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="id0C69021FD2F348198458852BD1AB89C2"><enum>(d)</enum><header>Authorization
			 of appropriations</header><text>Section 70107(l) of title 46, United States
			 Code, is amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="id0CE9834B21CE44059CD009C1C06905D5" style="OLC">
					<subsection id="idBCE3C662EABC4C049541DAB060532119"><enum>(l)</enum><header>Authorization
				of appropriations</header><text>There are authorized to be appropriated
				$300,000,000 for each of the fiscal years 2011 through 2016 to carry out this
				section.</text>
