		<section commented="no" display-inline="no-display-inline" id="H5C0FF9083EA843238931ACA0CF5D26B5" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>All Students Achieving through Reform
			 Act of 2011</short-title></quote> or <quote><short-title>All-STAR Act of 2011</short-title></quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="id9161C33827D749AE88E7A280C4353602" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Charter school expansion and
			 replication</header>
			<subsection commented="no" display-inline="no-display-inline" id="idF52D11A52BD74DA1802396CDAF16CEA9"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subpart 1 of part B of title V of the
			 Elementary and Secondary Education Act of 1965 (20 U.S.C. 7221 et seq.) is
			 amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="idF9C81AAFBF0443C2B92653F574DD41AD"><enum>(1)</enum><text display-inline="yes-display-inline">by striking section 5211;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idB37D798B273647D6A3BB84585AE87D03"><enum>(2)</enum><text display-inline="yes-display-inline">by redesignating section 5210 as section
			 5211; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idCB33B60FE763452E84BC194F9DFC78F7"><enum>(3)</enum><text display-inline="yes-display-inline">by inserting after section 5209 the
			 following:</text>
					<quoted-block display-inline="no-display-inline" id="id5F83F62AE0474BF3800C8C58B562E8D6" style="OLC">
						<section commented="no" display-inline="no-display-inline" id="id50CD83F7CDA9465A8605C575819FF112"><enum>5210.</enum><header>Charter
				school expansion and replication</header>
							<subsection commented="no" display-inline="no-display-inline" id="id643B8110A1194983A63A545D1E87226F"><enum>(a)</enum><header display-inline="yes-display-inline">Purpose</header><text display-inline="yes-display-inline">It is the purpose of this section to
				support State efforts to expand and replicate high-quality public charter
				schools to enable such schools to serve additional students, with a priority to
				serve those students who attend identified schools or schools with a low
				graduation rate.</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="H6F5D4190E09C4C38ACCE895207CB2D88"><enum>(b)</enum><header display-inline="yes-display-inline">Support for proven charter schools and
				increasing the supply of high-Quality charter schools</header>
								<paragraph commented="no" display-inline="no-display-inline" id="HE64207D69A4644C095613D2E59131B32"><enum>(1)</enum><header display-inline="yes-display-inline">Grants authorized</header><text display-inline="yes-display-inline">From the amounts appropriated under section
				5200 for any fiscal year, the Secretary shall award grants, on a competitive
				basis, to eligible entities to enable the eligible entities to make subgrants
				to eligible public charter schools under subsection (e)(1) and carry out the
				other activities described in subsection (e), in order to allow the eligible
				public charter schools to serve additional students through the expansion and
				replication of such schools.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H091CBB1994424F66A9F3A81C70002628"><enum>(2)</enum><header display-inline="yes-display-inline">Amount of grants</header><text display-inline="yes-display-inline">In determining the grant amount to be
				awarded under this subsection to an eligible entity, the Secretary shall
				consider—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="H6715AC9C49454FAEA68366154DD98B32"><enum>(A)</enum><text display-inline="yes-display-inline">the number of eligible public charter
				schools under the jurisdiction or in the service area of the eligible entity
				that are operating;</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H3CB9D9F281304898802AD8EAC1A09CA7"><enum>(B)</enum><text display-inline="yes-display-inline">the number of openings for new students
				that could be created in such schools with such grant;</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H1ECC907899E340D08EBF35582F64FE77"><enum>(C)</enum><text display-inline="yes-display-inline">the number of students eligible for free or
				reduced price lunches under the Richard B. Russell National School Lunch Act
				(42 U.S.C. 1751 et seq.) who are on waiting lists for charter schools under the
				jurisdiction or in the service area of the eligible entity, and other
				information with respect to charter schools in such jurisdiction or service
				area that suggest the interest of parents in charter school enrollment for
				their children;</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HA7FDE9A74C1B4667A9D91BE4C72C0CCC"><enum>(D)</enum><text display-inline="yes-display-inline">the number of students attending identified
				schools or schools with a low graduation rate in the State or area where an
				eligible entity intends to replicate or expand eligible public charter schools;
				and</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H4A57A6590CA74F6BAC0AE60571A3B3E2"><enum>(E)</enum><text display-inline="yes-display-inline">the success of the eligible entity in
				overseeing public charter schools and the likelihood of continued or increased
				success because of the grant under this section.</text>
									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HDB41FB84A98F4BCEB0205610A0B5F943"><enum>(3)</enum><header display-inline="yes-display-inline">Duration of grants</header><text display-inline="yes-display-inline">A grant under this section shall be for a
				period of not more than 3 years, except that an eligible entity receiving such
				grant may, at the discretion of the Secretary, continue to expend grant funds
				after the end of the grant period. An eligible entity that has received a grant
				under this section may receive subsequent grants under this section.</text>
								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HB266FC9E146A44CE90E2F809E5C57D7C"><enum>(c)</enum><header display-inline="yes-display-inline">Application requirements</header>
								<paragraph commented="no" display-inline="no-display-inline" id="H6B1749D6E6CF440A99EA76EBAD7ED332"><enum>(1)</enum><header display-inline="yes-display-inline">Application requirements</header><text display-inline="yes-display-inline">To be considered for a grant under this
				section, an eligible entity shall submit an application to the Secretary at
				such time, in such manner, and containing such information as the Secretary may
				require.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H196FDFEBBFAF48A1B734E1245712409C"><enum>(2)</enum><header display-inline="yes-display-inline">Contents</header><text display-inline="yes-display-inline">The application described in paragraph (1)
				shall include, at a minimum, the following:</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="H1AB475C846734C608B3748FA991135C3"><enum>(A)</enum><header display-inline="yes-display-inline">Record of success</header><text display-inline="yes-display-inline">Documentation of the record of success of
				the eligible entity in overseeing or operating public charter schools,
				including—</text>
										<clause commented="no" display-inline="no-display-inline" id="HA6A09178FEAF447C97FE2306A0D69875"><enum>(i)</enum><text display-inline="yes-display-inline">the performance of the students of such
				public charter schools on the student academic assessments described in section
				1111(b)(3) of the State where such school is located (including a measurement
				of the students' average academic longitudinal growth at each such school, if
				such measurement is required by a Federal or State law applicable to the
				entity), disaggregated by—</text>
											<subclause commented="no" display-inline="no-display-inline" id="HA4ECFFEE1D8F45049863F38D3A72564B"><enum>(I)</enum><text display-inline="yes-display-inline">economic disadvantage;</text>
											</subclause><subclause commented="no" display-inline="no-display-inline" id="H82F50F1564EA45218DD55B232CD2A177"><enum>(II)</enum><text display-inline="yes-display-inline">race and ethnicity;</text>
											</subclause><subclause commented="no" display-inline="no-display-inline" id="HCD91E390256343CFB237D90BC1F0BDAC"><enum>(III)</enum><text display-inline="yes-display-inline">disability status; and</text>
											</subclause><subclause commented="no" display-inline="no-display-inline" id="H17527BE5BCA34E6E8EA09BE7DA7B2FDB"><enum>(IV)</enum><text display-inline="yes-display-inline">status as a student with limited English
				proficiency;</text>
											</subclause></clause><clause commented="no" display-inline="no-display-inline" id="HCD02DC5C48834951B892FB662969CDA5"><enum>(ii)</enum><text display-inline="yes-display-inline">the status of such schools under section
				1116 in making adequate yearly progress or as identified schools;</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="id7A95CA42C6FD41BAA72DC45431C42E43"><enum>(iii)</enum><text display-inline="yes-display-inline">documentation of demonstrated success by
				such public charter schools in closing historic achievement gaps between groups
				of students; and</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="H00A35E3670354388BE7F12487D98A547"><enum>(iv)</enum><text display-inline="yes-display-inline">in the case of such public charter schools
				that are secondary schools, the graduation rates and rates of student
				acceptance, enrollment, and persistence in institutions of higher education,
				where possible.</text>
										</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H30EC55D917054DA6A8DA7E79510A4791"><enum>(B)</enum><header display-inline="yes-display-inline">Plan</header><text display-inline="yes-display-inline">A plan for—</text>
										<clause commented="no" display-inline="no-display-inline" id="HF47CD3C2FB6A455CA834862B501BB60A"><enum>(i)</enum><text display-inline="yes-display-inline">replicating and expanding eligible public
				charter schools operated or overseen by the eligible entity;</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="HEF211E0F25AF4B9EBA87325993C321CE"><enum>(ii)</enum><text display-inline="yes-display-inline">identifying eligible public charter
				schools, or networks of eligible public charter schools, to receive subgrants
				under this section;</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="HEAD6859DCF1B44CD851C87912BFE50DF"><enum>(iii)</enum><text display-inline="yes-display-inline">increasing the number of openings in
				eligible public charter schools for students attending identified schools and
				schools with a low graduation rate;</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="H319BE49D63B94F3682A05C3698461991"><enum>(iv)</enum><text display-inline="yes-display-inline">ensuring that eligible public charter
				schools receiving a subgrant under this section enroll students through a
				random lottery for admission, unless the charter school is using the subgrant
				to expand the school to serve additional grades, in which case such school may
				reserve seats in the additional grades for—</text>
											<subclause commented="no" display-inline="no-display-inline" id="H0E42AE336A8541B1B46EC93351542716"><enum>(I)</enum><text display-inline="yes-display-inline">each student enrolled in the grade
				preceding each such additional grade;</text>
											</subclause><subclause commented="no" display-inline="no-display-inline" id="H7831CF9B4C3341C2AE4612CF8F22C4D2"><enum>(II)</enum><text display-inline="yes-display-inline">siblings of students enrolled in the
				charter school, if such siblings desire to enroll in such grade; and</text>
											</subclause><subclause commented="no" display-inline="no-display-inline" id="id426C774AE6CA4DF8ACF94A0A0611AD39"><enum>(III)</enum><text display-inline="yes-display-inline">children of the charter school's founders,
				staff, or employees;</text>
											</subclause></clause><clause commented="no" display-inline="no-display-inline" id="H48A1807BE79E41489E861A71D12E26FC"><enum>(v)</enum><subclause commented="no" display-inline="yes-display-inline" id="id622F74B919044182B0320E5E0A165D05"><enum>(I)</enum><text display-inline="yes-display-inline">in the case of an eligible entity described
				in subparagraph (A) or (C) of subsection (k)(4), the manner in which the
				eligible entity will work with identified schools and schools with a low
				graduation rate that are eligible to enroll students in a public charter school
				receiving a subgrant under this section and that are under the eligible
				entity's jurisdiction, and the local educational agencies serving such schools,
				to—</text>
												<item commented="no" display-inline="no-display-inline" id="HC7EAB76CFF3F47F6AAE0A38931860735" indent="up1"><enum>(aa)</enum><text display-inline="yes-display-inline">engage in community outreach, provide
				information in a language that the parents can understand, and communicate with
				parents of students at identified schools and schools with a low graduation
				rate who are eligible to attend a public charter school receiving a subgrant
				under this section about the opportunity to enroll in or transfer to such
				school, in a manner consistent with section 444 of the General Education
				Provisions Act (commonly known as the <quote>Family Educational Rights and
				Privacy Act of 1974</quote>); and</text>
												</item><item commented="no" display-inline="no-display-inline" id="HD750CBB925BF4D089D930CA35FD16172" indent="up1"><enum>(bb)</enum><text display-inline="yes-display-inline">ensure that a student can transfer to an
				eligible public charter school if the public charter school such student was
				attending in the previous school year is no longer an eligible public charter
				school; and</text>
												</item></subclause><subclause commented="no" display-inline="no-display-inline" id="id56B02B289FE04E24A4B8CD6F9B295569" indent="up1"><enum>(II)</enum><text display-inline="yes-display-inline">in the case of an eligible entity described
				in subparagraph (B) or (D) of subsection (k)(4), the manner in which the
				eligible entity will work with the local educational agency to carry out the
				activities described in items (aa) and (bb) of subclause (I);</text>
											</subclause></clause><clause commented="no" display-inline="no-display-inline" id="HC2CF07DD9F144A5B80D87E16BC482B7B"><enum>(vi)</enum><text display-inline="yes-display-inline">disseminating to public schools under the
				jurisdiction or in the service area of the eligible entity, in a manner
				consistent with section 444 of the General Education Provisions Act (commonly
				known as the <quote>Family Educational Rights and Privacy Act of 1974</quote>),
				the best practices, programs, or strategies learned by awarding subgrants to
				eligible public charter schools under this section, with particular emphasis on
				the best practices with respect to—</text>
											<subclause commented="no" display-inline="no-display-inline" id="H5CCFB07C1A2B4B39A3406B3FDB3E7A86"><enum>(I)</enum><text display-inline="yes-display-inline">focusing on closing the achievement gap;
				or</text>
											</subclause><subclause commented="no" display-inline="no-display-inline" id="H587DE0EBD9DB4FAB93CA32E12A232D2D"><enum>(II)</enum><text display-inline="yes-display-inline">successfully addressing the education needs
				of low-income students; and</text>
											</subclause></clause><clause id="IDef10c744ac9b4b2ebe5000208612e0d7"><enum>(vii)</enum><text>in the case of
				an eligible entity described in subsection (k)(4)(D)—</text>
											<subclause id="id9C40FDAAB34442AB83CAF3FB6BFE8F27"><enum>(I)</enum><text>supporting the
				short-term and long-term success of the proposed project, by—</text>
												<item id="id672B89B1610A427895DBA01DAC63BA97"><enum>(aa)</enum><text>developing a
				multi-year financial and operating model for the eligible entity; and</text>
												</item><item id="idA480B860C37A4649A5C3496999A413D9"><enum>(bb)</enum><text>including, with
				the plan, evidence of the demonstrated commitment of current partners, as of
				the time of the application, for the proposed project and of broad support from
				stakeholders critical to the project's long-term success;</text>
												</item></subclause><subclause id="IDb44dbb70ebef48f08bceb60867b0c319"><enum>(II)</enum><text>closing public
				charter schools that do not meet acceptable standards of performance;
				and</text>
											</subclause><subclause id="IDc16e3e693c2c43c2a7ee3de3e3c00702"><enum>(III)</enum><text>achieving the
				objectives of the proposed project on time and within budget, which shall
				include the use of clearly defined responsibilities, timelines, and milestones
				for accomplishing project tasks.</text>
											</subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H9C87568270FE4F998AA7F048FABC6D80"><enum>(C)</enum><header display-inline="yes-display-inline">Charter school information</header><text display-inline="yes-display-inline">The number of—</text>
										<clause commented="no" display-inline="no-display-inline" id="HA3D7C593F7304698BCA91CB308177B85"><enum>(i)</enum><text display-inline="yes-display-inline">eligible public charter schools that are
				operating in the State in which the eligible entity intends to award subgrants
				under this section;</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="H97DF1436D414454DB52B00FF69EC481C"><enum>(ii)</enum><text display-inline="yes-display-inline">public charter schools approved to open or
				likely to open during the grant period in such State;</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="HB0E33AD33C074FADB51400B9D34BA090"><enum>(iii)</enum><text display-inline="yes-display-inline">available openings in eligible public
				charter schools in such State that could be created through the replication or
				expansion of such schools if the grant is awarded to the eligible
				entity;</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="HFC0450B394BE476BAD7B42778E5FC16E"><enum>(iv)</enum><text display-inline="yes-display-inline">students on public charter school waiting
				lists (if such lists are available) in—</text>
											<subclause commented="no" display-inline="no-display-inline" id="H041AAC242D2942AE90833753317F8466"><enum>(I)</enum><text display-inline="yes-display-inline">the State in which the eligible entity
				intends to award subgrants under this section; and</text>
											</subclause><subclause commented="no" display-inline="no-display-inline" id="H49629B7B96DB4B9898CE06AC5D6F7DFD"><enum>(II)</enum><text display-inline="yes-display-inline">each local educational agency serving an
				eligible public charter school that may receive a subgrant under this section
				from the eligible entity; and</text>
											</subclause></clause><clause commented="no" display-inline="no-display-inline" id="HB09846340D1846F2AE0B6FC3706D233F"><enum>(v)</enum><text display-inline="yes-display-inline">students, and the percentage of students,
				in a local educational agency who are attending eligible public charter schools
				that may receive a subgrant under this section from the eligible entity.</text>
										</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H9C513E9D783F4D2FA593D6C1FAAC0325"><enum>(D)</enum><header display-inline="yes-display-inline">Traditional public school
				information</header><text display-inline="yes-display-inline">In the case of an
				eligible entity described in subparagraph (A) or (C) of subsection (k)(4), a
				list of the following schools under the jurisdiction of the eligible entity,
				including the name and location of each such school, the number and percentage
				of students under the jurisdiction of the eligible entity who are attending
				such school, and such demographic and socioeconomic information as the
				Secretary may require:</text>
										<clause commented="no" display-inline="no-display-inline" id="HF5EAE940F9244A19B260F191A3BE10BD"><enum>(i)</enum><text display-inline="yes-display-inline">Identified schools.</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="HBE684F8E21CC44F29EB7E112DF004FA1"><enum>(ii)</enum><text display-inline="yes-display-inline">Schools with a low graduation rate.</text>
										</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H92A69321217841409847BCA4DDA35B7C"><enum>(E)</enum><header display-inline="yes-display-inline">Assurance</header><text display-inline="yes-display-inline">In the case of an eligible entity described
				in subsection (k)(4)(A), an assurance that the eligible entity will include in
				the notifications provided under section 1116(c)(6) to parents of each student
				enrolled in a school served by a local educational agency identified for school
				improvement or corrective action under paragraph (1) or (7) of section 1116(c),
				information (in a language that the parents can understand) about the eligible
				public charter schools receiving subgrants under this section.</text>
									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idD135162E1DFE4C4CAE38532776F4045B"><enum>(3)</enum><header>Modifications</header><text display-inline="yes-display-inline">The Secretary may modify or waive any
				information requirement under paragraph (2)(C) for an eligible entity that
				demonstrates that the eligible entity cannot reasonably obtain the
				information.</text>
								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H761FD3F42A6740619529E19C9F6CC8D0"><enum>(d)</enum><header display-inline="yes-display-inline">Priorities for awarding grants</header>
								<paragraph commented="no" display-inline="no-display-inline" id="id2018FA4F8BED42988E7EF00972F435D6"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">In awarding grants under this section, the
				Secretary shall give priority to an eligible entity that—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="H07DB240BB1DE4887A59DBF614F868DCA"><enum>(A)</enum><text display-inline="yes-display-inline">serves or plans to serve a large percentage
				of low-income students from identified schools or public schools with a low
				graduation rate;</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H125226CD1E0C45A0A834567EFF33863B"><enum>(B)</enum><text display-inline="yes-display-inline">oversees or plans to oversee one or more
				eligible public charter schools;</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H7FC047E111534BA7B5EADCFED24006F1"><enum>(C)</enum><text display-inline="yes-display-inline">provides evidence of effective monitoring
				of the academic success of students who attend public charter schools under the
				jurisdiction of the eligible entity;</text>
									</subparagraph><subparagraph id="IDba938c82b348479c8d40152d7704fefc"><enum>(D)</enum><text>has established
				goals, objectives, and outcomes for the proposed project that are clearly
				specified, measurable, and attainable;</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id20B6F4A845B347D2990BD1819AA12CB9"><enum>(E)</enum><text display-inline="yes-display-inline">in the case of an eligible entity that is a
				local educational agency under State law, has a cooperative agreement under
				section 1116(b)(11); and</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H7A9331F47D0A427AAD2951644F609355"><enum>(F)</enum><text display-inline="yes-display-inline">is under the jurisdiction of, or plans to
				award subgrants under this section in, a State that—</text>
										<clause commented="no" display-inline="no-display-inline" id="H13961DD1458F46E78565B46B00143AA8"><enum>(i)</enum><text display-inline="yes-display-inline">ensures that all public charter schools
				(including such schools served by a local educational agency and such schools
				considered to be a local educational agency under State law) receive, in a
				timely manner, the Federal, State, and local funds to which such schools are
				entitled under applicable law;</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="HCCE9EEB95BE642219DAEFD60598F200"><enum>(ii)</enum><text display-inline="yes-display-inline">does not have a cap that restricts the
				growth of public charter schools in the State;</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="H99C3FB9B674242C080D52D846CC0EC29"><enum>(iii)</enum><text display-inline="yes-display-inline">provides funding (such as capital aid
				distributed through a formula or access to revenue generated bonds, and
				including funding for school facilities) on a per-pupil basis to public charter
				schools commensurate with the amount of funding (including funding for school
				facilities) provided to traditional public schools;</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="H696B6B58573949D6BF7387F355584D3F"><enum>(iv)</enum><text display-inline="yes-display-inline">provides strong evidence of support for
				public charter schools and has in place innovative policies that support
				academically successful charter school growth;</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="H141A07EECB2B4A9785481C7E86C297E2"><enum>(v)</enum><text display-inline="yes-display-inline">authorizes public charter schools to offer
				early childhood education programs, including prekindergarten, in accordance
				with State law;</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="idACA01F18AF3F4737929B36AEB97B87F8"><enum>(vi)</enum><text>authorizes or
				allows public charter schools to serve as school food authorities;</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="HF7EEB95486644961906BD3B076A3DC7C"><enum>(vii)</enum><text display-inline="yes-display-inline">ensures that each public charter school in
				the State—</text>
											<subclause commented="no" display-inline="no-display-inline" id="H5A2538D22AEF491A8447F23E59E3F299"><enum>(I)</enum><text display-inline="yes-display-inline">has a high degree of autonomy over the
				public charter school’s budget and expenditures;</text>
											</subclause><subclause commented="no" display-inline="no-display-inline" id="H76AF027F94364C79B4FA798A80100C73"><enum>(II)</enum><text display-inline="yes-display-inline">has a written performance contract with an
				authorized public chartering agency that ensures that the school has an
				independent governing board with a high degree of autonomy; and</text>
											</subclause><subclause commented="no" display-inline="no-display-inline" id="HE0DC75D117AC42C1B181BA4EF74BD760"><enum>(III)</enum><text display-inline="yes-display-inline">in the case of an eligible public charter
				school receiving a subgrant under this section, amends its charter to reflect
				the growth activities described in subsection (e);</text>
											</subclause></clause><clause commented="no" display-inline="no-display-inline" id="H22CCDB9C7B504C06BDBD46DE77F9A918"><enum>(viii)</enum><text display-inline="yes-display-inline">has an appeals process for the denial of an
				application for a public charter school;</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="H75F99919831F495480B7713762B7859D"><enum>(ix)</enum><text display-inline="yes-display-inline">provides that an authorized public
				chartering agency that is not a local educational agency, such as a State
				chartering board, is available for each individual or entity seeking to operate
				a public charter school pursuant to such State law;</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="HB8AFFF910700495DBBDA5E7D514CFF0A"><enum>(x)</enum><text display-inline="yes-display-inline">allows any public charter school to be a
				local educational agency in accordance with State law;</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="H8E746E69384541869B3AB6ECB3A3ED52"><enum>(xi)</enum><text display-inline="yes-display-inline">ensures that each authorized public
				chartering agency in the State submits annual reports to the State educational
				agency, and makes such reports available to the public, on the performance of
				the schools authorized or approved by such public chartering agency, which
				reports shall include—</text>
											<subclause commented="no" display-inline="no-display-inline" id="H2057AE31362B4AFC8DAEB07ED38D0AF0"><enum>(I)</enum><text display-inline="yes-display-inline">the authorized public chartering agency’s
				strategic plan for authorizing or approving public charter schools and any
				progress toward achieving the objectives of the strategic plan;</text>
											</subclause><subclause commented="no" display-inline="no-display-inline" id="HE8092FD5A7B54206A96B524A0BD9C02F"><enum>(II)</enum><text display-inline="yes-display-inline">the authorized public chartering agency’s
				policies for authorizing or approving public charter schools, including how
				such policies examine a school’s—</text>
												<item commented="no" display-inline="no-display-inline" id="HD8A19306C44349AE98129D44534F20E2"><enum>(aa)</enum><text display-inline="yes-display-inline">financial plan and policies, including
				financial controls and audit requirements;</text>
												</item><item commented="no" display-inline="no-display-inline" id="HB63525FDF2714F34A18D9E7615A8E60B"><enum>(bb)</enum><text display-inline="yes-display-inline">plan for identifying and successfully (in
				compliance with all applicable laws and regulations) serving students with
				disabilities, students who are English language learners, students who are
				academically behind their peers, and gifted students; and</text>
												</item><item commented="no" display-inline="no-display-inline" id="H87ED72E398C3425DB5B1216D01A71922"><enum>(cc)</enum><text display-inline="yes-display-inline">capacity and capability to successfully
				launch and subsequently operate a public charter school, including the
				backgrounds of the individuals applying to the agency to operate such school
				and any record of such individuals operating a school;</text>
												</item></subclause><subclause commented="no" display-inline="no-display-inline" id="H44AF6870CAAC4464963D38379BA2FF75"><enum>(III)</enum><text display-inline="yes-display-inline">the authorized public chartering agency’s
				policies for renewing, not renewing, and revoking a public charter school's
				charter, including the role of student academic achievement in such
				decisions;</text>
											</subclause><subclause commented="no" display-inline="no-display-inline" id="H8BA93BD1CDE14CA1BC23FCAB9615B073"><enum>(IV)</enum><text display-inline="yes-display-inline">the authorized public chartering agency’s
				transparent, timely, and effective process for closing down academically
				unsuccessful public charter schools;</text>
											</subclause><subclause commented="no" display-inline="no-display-inline" id="HC899F04E06BF4CA2A7CC0237994C5B37"><enum>(V)</enum><text display-inline="yes-display-inline">the academic performance of each operating
				public charter school authorized or approved by the authorized public
				chartering agency, including the information reported by the State in the State
				annual report card under section 1111(h)(1)(C) for such school;</text>
											</subclause><subclause commented="no" display-inline="no-display-inline" id="HD51721948268447280F7D7D0587DAFA4"><enum>(VI)</enum><text display-inline="yes-display-inline">the status of the authorized public
				chartering agency’s charter school portfolio, by identifying all charter
				schools served by the public chartering agency in each of the following
				categories: approved (but not yet open), operating, renewed, transferred,
				revoked, not renewed, voluntarily closed, or never opened;</text>
											</subclause><subclause commented="no" display-inline="no-display-inline" id="H39C07E8AC1F74F358CD8D090DA79E4EE"><enum>(VII)</enum><text>the authorizing
				functions provided by the authorized public chartering agency to the public
				charter schools under its purview, including such agency's operating costs and
				expenses as detailed through annual auditing of financial statements that
				conform with general accepted accounting principles; and</text>
											</subclause><subclause commented="no" display-inline="no-display-inline" id="HCEF8685448E24187B6C6537AB5CF37FA"><enum>(VIII)</enum><text display-inline="yes-display-inline">the services purchased (such as accounting,
				transportation, and data management and analysis) from the authorized public
				chartering agency by the public charter schools authorized or approved by such
				agency, including an itemized accounting of the actual costs of such services;
				and</text>
											</subclause></clause><clause commented="no" display-inline="no-display-inline" id="H7C50E70BDD2547BEAC71C1B5D5E65D06"><enum>(xii)</enum><text display-inline="yes-display-inline">has or will have (within 1 year after
				receiving a grant under this section) a State policy and process for overseeing
				and reviewing the effectiveness and quality of the State’s authorized public
				chartering agencies, including—</text>
											<subclause commented="no" display-inline="no-display-inline" id="H7144561D521B465390CEE1027867B9DA"><enum>(I)</enum><text display-inline="yes-display-inline">a process for reviewing and evaluating the
				performance of the authorized public chartering agencies in authorizing or
				approving public charter schools, including a process that enables the
				authorized public chartering agencies to respond to any State concerns;
				and</text>
											</subclause><subclause commented="no" display-inline="no-display-inline" id="HBD068D4FC0E74A25A043B89200E32CCC"><enum>(II)</enum><text display-inline="yes-display-inline">any other necessary policies to ensure
				effective charter school authorizing in the State in accordance with the
				principles of quality charter school authorizing, as determined by the State in
				consultation with the charter school community and stakeholders.</text>
											</subclause></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2E2B65CB3ABA45F8A9AADA4B0412515B"><enum>(2)</enum><header display-inline="yes-display-inline">Special rule</header><text display-inline="yes-display-inline">In awarding grants under this section, the
				Secretary may determine how the priorities described in paragraph (1) will
				apply to the different types of eligible entities defined in subsection
				(k)(4).</text>
								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HC6CDC9FB9A1B4252A58927039BF50C1E"><enum>(e)</enum><header display-inline="yes-display-inline">Use of funds</header><text display-inline="yes-display-inline">An eligible entity receiving a grant under
				this section shall use the grant funds for the following:</text>
								<paragraph commented="no" display-inline="no-display-inline" id="H153916CD374641389CB9356BE6717DF3"><enum>(1)</enum><header display-inline="yes-display-inline">Subgrants</header>
									<subparagraph commented="no" display-inline="no-display-inline" id="HC8E3706FB5FC457A96082EC74B7E697E"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">To award subgrants, in such amount as the
				eligible entity determines is appropriate, to eligible public charter schools
				to replicate or expand such schools.</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H73EB528069614046A80432B8EFC7AE22"><enum>(B)</enum><header display-inline="yes-display-inline">Application</header><text display-inline="yes-display-inline">An eligible public charter school desiring
				to receive a subgrant under this subsection shall submit an application to the
				eligible entity at such time, in such manner, and containing such information
				as the eligible entity may require.</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HA09EE6AAA2C54E32906E221E1A980BAA"><enum>(C)</enum><header display-inline="yes-display-inline">Uses of funds</header><text display-inline="yes-display-inline">An eligible public charter school receiving
				a subgrant under this subsection shall use the subgrant funds to provide for an
				increase in the school’s enrollment of students through the replication or
				expansion of the school, which may include use of funds to—</text>
										<clause commented="no" display-inline="no-display-inline" id="HC95B95AEA77A4C6994797B91A4DFE680"><enum>(i)</enum><text display-inline="yes-display-inline">support the physical expansion of school
				buildings, including financing the development of new buildings and campuses to
				meet increased enrollment needs;</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="H789A488DED294D94A25615E4C6E9F7E7"><enum>(ii)</enum><text display-inline="yes-display-inline">pay costs associated with hiring additional
				teachers to serve additional students;</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="H4955EE052B9441BD93A5B7D1B8558590"><enum>(iii)</enum><text display-inline="yes-display-inline">provide transportation to additional
				students to and from the school, including providing transportation to students
				who transfer to the school under a cooperative agreement established under
				section 1116(b)(11);</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="H9CF5E692C06848D7B4450A6641B6E3B7"><enum>(iv)</enum><text display-inline="yes-display-inline">purchase instructional materials, implement
				teacher and principal professional development programs, and hire additional
				non-teaching staff; and</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="HFDC6AC401D8440319641F4F5D3E58048"><enum>(v)</enum><text display-inline="yes-display-inline">support any necessary activities associated
				with the school carrying out the purposes of this section.</text>
										</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H38A58D962FFD4800B95355C593411050"><enum>(D)</enum><header display-inline="yes-display-inline">Priority</header><text display-inline="yes-display-inline">In awarding subgrants under this
				subsection, an eligible entity shall give priority to an eligible public
				charter school—</text>
										<clause commented="no" display-inline="no-display-inline" id="idAD811543D4604002B3FB9D5DCFE833F9"><enum>(i)</enum><text display-inline="yes-display-inline">that has significantly closed any
				achievement gap on the State academic assessments described in section
				1111(b)(3) among the groups of students described in section 1111(b)(2)(C)(v)
				by improving scores;</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="H5D6458C9B94247ED9C73D4F6EF5A1227"><enum>(ii)</enum><text display-inline="yes-display-inline">that—</text>
											<subclause commented="no" display-inline="no-display-inline" id="id53227E7A7CF04C05B712590F79480BC8"><enum>(I)</enum><item commented="no" display-inline="yes-display-inline" id="idA26F682D646B42EAA2DA7834B9854A08"><enum>(aa)</enum><text display-inline="yes-display-inline">ranks in at least the top 25th percentile
				of the schools in the State, as ranked by the percentage of students in the
				proficient or advanced level of achievement on the State academic assessments
				in mathematics and reading or language arts described in section 1111(b)(3);
				or</text>
												</item><item commented="no" display-inline="no-display-inline" id="idE1EF657C0B6C4A6D8D9C1CE643D7DB84" indent="up1"><enum>(bb)</enum><text display-inline="yes-display-inline">has an average student score on an
				examination (chosen by the Secretary) that is at least in the 60th percentile
				in reading and at least in the 75th percentile in mathematics; and</text>
												</item></subclause><subclause commented="no" display-inline="no-display-inline" id="H33D018C7652B40758D605165A55FFF25"><enum>(II)</enum><text display-inline="yes-display-inline">serves a high-need student population and
				is eligible to participate in a schoolwide program under section 1114, with
				additional priority given to schools that serve, as compared to other schools
				that have submitted an application under this subsection—</text>
												<item commented="no" display-inline="no-display-inline" id="idA66480FF158847C4BF677E7058CD09BC"><enum>(aa)</enum><text display-inline="yes-display-inline">a greater percentage of low-income
				students; and</text>
												</item><item commented="no" display-inline="no-display-inline" id="id5CB147EADA644B9DBDD9FBDB8464F92B"><enum>(bb)</enum><text display-inline="yes-display-inline">a greater percentage of not less than 2
				groups of students described in section 1111(b)(2)(C)(v)(II); and</text>
												</item></subclause></clause><clause commented="no" display-inline="no-display-inline" id="H6B0F91492B12482883ACF6DC8E8E5745"><enum>(iii)</enum><text display-inline="yes-display-inline">that meets the criteria described in clause
				(i) and serves low-income students who have transferred to such school under a
				cooperative agreement described in section 1116(b)(11).</text>
										</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HFFCE386EF5164FA68DBB8868446C0391"><enum>(E)</enum><header display-inline="yes-display-inline">Duration of subgrant</header><text display-inline="yes-display-inline">A subgrant under this subsection shall be
				awarded for a period of not more than 3 years, except that an eligible public
				charter school receiving a subgrant under this subsection may, at the
				discretion of the eligible entity, continue to expend subgrant funds after the
				end of the subgrant period.</text>
									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HA783E4D5E6EF4B7D9883BDA77ADF9BB"><enum>(2)</enum><header display-inline="yes-display-inline">Facility financing and revolving loan
				fund</header><text display-inline="yes-display-inline">An eligible entity may
				use not more than 25 percent of the amount of the grant funds received under
				this section to establish a reserve account described in subsection (f) to
				facilitate public charter school facility acquisition and development
				by—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="H296CFE191F2D47AAA1E0DBCDC9681291"><enum>(A)</enum><text display-inline="yes-display-inline">conducting credit enhancement initiatives
				(as referred to in subpart 2) in support of the development of facilities for
				eligible public charter schools serving students;</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HB4AEB341AA6B42608DED43573F589D4"><enum>(B)</enum><text display-inline="yes-display-inline">establishing a revolving loan fund for use
				by an eligible public charter school receiving a subgrant under this subsection
				from the eligible entity under such terms as may be determined by the eligible
				entity to allow such school to expand to serve additional students;</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H59C2C6FD365B4B338D5F93BCEE743312"><enum>(C)</enum><text display-inline="yes-display-inline">facilitating, through direct expenditure or
				financing, the acquisition or development of public charter school buildings by
				the eligible entity or an eligible public charter school receiving a subgrant
				under this subsection from the eligible entity, which may be used as both
				permanent locations for eligible public charter schools or incubators for
				growing charter schools; or</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H6742B61A29304DF8B6FCAB8F1E77AAAB"><enum>(D)</enum><text display-inline="yes-display-inline">establishing a partnership with 1 or more
				community development financial institutions (as defined in section 103 of the
				Community Development Banking and Financial Institutions Act of 1994 (12 U.S.C.
				4702)) or other mission-based financial institutions to carry out the
				activities described in subparagraphs (A), (B), and (C).</text>
									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H24414AAD10DF4636B4AC6A3F8AF579D"><enum>(3)</enum><header display-inline="yes-display-inline">Administrative tasks, dissemination
				activities, and outreach</header>
									<subparagraph commented="no" display-inline="no-display-inline" id="H4545A74C36CA49A5A9B9F9AF1CC44E6F"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">An eligible entity may use not more than
				7.5 percent of the grant funds awarded under this section to cover
				administrative tasks, dissemination activities, and outreach.</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H2B69DCB314DB452ABA06EADEDCBFE6E7"><enum>(B)</enum><header display-inline="yes-display-inline">Nonprofit assistance</header><text display-inline="yes-display-inline">In carrying out the administrative tasks,
				dissemination activities, and outreach described in subparagraph (A), an
				eligible entity may contract with an organization described in section
				501(c)(3) of the Internal Revenue Code of 1986 (26 U.S.C. 501(c)(3)) and exempt
				from tax under section 501(a) of such Code (26 U.S.C. 501(a)).</text>
									</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H6B7E6D6588DD4DB2AA3FE97383A9C0DB"><enum>(f)</enum><header display-inline="yes-display-inline">Reserve Account</header>
								<paragraph commented="no" display-inline="no-display-inline" id="H956D40B24A754DDBA408F39300626411"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">To assist eligible entities in the
				development of new public charter school buildings or facilities for eligible
				public charter schools, an eligible entity receiving a grant under this section
				may, in accordance with State and local law, directly or indirectly, alone or
				in collaboration with others, deposit the amount of funds described in
				subsection (e)(2) in a reserve account established and maintained by the
				eligible entity.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H4AE6BC234B7C412181933B7C3DD88900"><enum>(2)</enum><header display-inline="yes-display-inline">Investment</header><text display-inline="yes-display-inline">Funds received under this section and
				deposited in the reserve account established under this subsection shall be
				invested in obligations issued or guaranteed by the United States or a State,
				or in other similarly low-risk securities.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HAFABF31BFC30493BB564CC7900C59554"><enum>(3)</enum><header display-inline="yes-display-inline">Reinvestment of earnings</header><text display-inline="yes-display-inline">Any earnings on funds received under this
				subsection shall be deposited in the reserve account established under this
				section and used in accordance with the purpose described in subsection
				(a).</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H5AF8940105B04070816CB8BB1F1FB5DB"><enum>(4)</enum><header display-inline="yes-display-inline">Recovery of funds</header>
									<subparagraph commented="no" display-inline="no-display-inline" id="H07C8A6B2DA544F359FF254FF1FFA2458"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary, in accordance with chapter
				37 of title 31, United States Code, shall collect—</text>
										<clause commented="no" display-inline="no-display-inline" id="HDC376347C5FA41DF8CAFA6B295A41A64"><enum>(i)</enum><text display-inline="yes-display-inline">all funds in a reserve account established
				by an eligible entity under this subsection if the Secretary determines, not
				earlier than 2 years after the date the eligible entity first received funds
				under this section, that the eligible entity has failed to make substantial
				progress carrying out the purpose described in paragraph (1); or</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="H9760A498E7F845DFAFC081A0A8BA4906"><enum>(ii)</enum><text display-inline="yes-display-inline">all or a portion of the funds in a reserve
				account established by an eligible entity under this subsection if the
				Secretary determines that the eligible entity has permanently ceased to use all
				or a portion of funds in such account to accomplish the purpose described in
				paragraph (1).</text>
										</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HBEC97082A5944BE20035DE649C334992"><enum>(B)</enum><header display-inline="yes-display-inline">Exercise of authority</header><text display-inline="yes-display-inline">The Secretary shall not exercise the
				authority provided under subparagraph (A) to collect from any eligible entity
				any funds that are being properly used to achieve such purpose.</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H5DBF91A47FE749AD88B418BEF3E4CDED"><enum>(C)</enum><header display-inline="yes-display-inline">Procedures</header><text display-inline="yes-display-inline">Sections 451, 452, and 458 of the General
				Education Provisions Act shall apply to the recovery of funds under
				subparagraph (A).</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H13EBCBAAE4B4434F93F3F70428FD8EA7"><enum>(D)</enum><header display-inline="yes-display-inline">Construction</header><text display-inline="yes-display-inline">This paragraph shall not be construed to
				impair or affect the authority of the Secretary to recover funds under part D
				of the General Education Provisions Act.</text>
									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H01DBCC63EC5843159B89E357A5AC6C3B"><enum>(5)</enum><header display-inline="yes-display-inline">Reallocation</header><text display-inline="yes-display-inline">Any funds collected by the Secretary under
				paragraph (4) shall be awarded to eligible entities receiving grants under this
				section in the next fiscal year.</text>
								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H35A831F72F6947B2B3CCA060CC8CCFAD"><enum>(g)</enum><header display-inline="yes-display-inline">Financial responsibility</header><text display-inline="yes-display-inline">The financial records of each eligible
				entity and eligible public charter school receiving a grant or subgrant,
				respectively, under this section shall be maintained in accordance with
				generally accepted accounting principles and shall be subject to an annual
				audit by an independent public accountant.</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="HD35F92D8040346D480702194C79398A3"><enum>(h)</enum><header display-inline="yes-display-inline">National evaluation</header>
								<paragraph commented="no" display-inline="no-display-inline" id="H5AEE5691C03843B08664AA2446C381EF"><enum>(1)</enum><header display-inline="yes-display-inline">National evaluation</header><text display-inline="yes-display-inline">From the amounts appropriated under section
				5200, the Secretary shall conduct an independent, comprehensive, and
				scientifically sound evaluation, by grant or contract and using the highest
				quality research design available, of the impact of the activities carried out
				under this section on—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="id13D0CE0F33B3437D8DF879E2C303A703"><enum>(A)</enum><text>student
				achievement, including State standardized assessment scores and, if available,
				student academic longitudinal growth (as described in subsection (c)(2)(A)(i))
				based on such assessments; and</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idEF73A195E90E4D1081BEE88B7FC0BC64"><enum>(B)</enum><text display-inline="yes-display-inline">other areas, as determined by the
				Secretary.</text>
									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H3E22B95F0D964351A4DECB2CE62541D"><enum>(2)</enum><header display-inline="yes-display-inline">Report</header><text display-inline="yes-display-inline">Not later than 4 years after the date of
				the enactment of the <short-title>All Students Achieving
				through Reform Act of 2011</short-title>, and biannually thereafter, the
				Secretary shall submit to Congress a report on the results of the evaluation
				described in paragraph (1).</text>
								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H8CCDC0AC1CE34742810E3A21B81AFF2D"><enum>(i)</enum><header display-inline="yes-display-inline">Reports</header><text display-inline="yes-display-inline">Each eligible entity receiving a grant
				under this section shall prepare and submit to the Secretary the
				following:</text>
								<paragraph commented="no" display-inline="no-display-inline" id="HE660E1073DC14F3290C6F08986F40C69"><enum>(1)</enum><header display-inline="yes-display-inline">Report</header><text display-inline="yes-display-inline">A report that contains such information as
				the Secretary may require concerning use of the grant funds by the eligible
				entity, including the academic achievement of the students attending eligible
				public charter schools as a result of the grant. Such report shall be submitted
				before the end of the 3-year period beginning on the date of enactment of the
				<short-title>All Students Achieving through Reform Act of
				2011</short-title> and every 2 years thereafter.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HA19A5C125FB74217A28D28F0820C4940"><enum>(2)</enum><header display-inline="yes-display-inline">Performance information</header><text display-inline="yes-display-inline">Such performance information as the
				Secretary may require for the national evaluation conducted under subsection
				(h)(1).</text>
								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idAD3F3914E70847928F1112EA8B37F22F"><enum>(j)</enum><header display-inline="yes-display-inline">Inapplicability</header><text display-inline="yes-display-inline">The provisions of sections 5201 through
				5209 shall not apply to the program under this section.</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="H49ECD0917AD9450BAA9FACDB34808FD5"><enum>(k)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section:</text>
								<paragraph commented="no" display-inline="no-display-inline" id="HC7FA9FAEFE7D45ED9D86B9D5E8AFE837"><enum>(1)</enum><header display-inline="yes-display-inline">Adequate yearly progress</header><text display-inline="yes-display-inline">The term <quote>adequate yearly
				progress</quote> has the meaning given such term in a State’s plan in
				accordance with section 1111(b)(2)(C).</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HEF1189D24D3944FF9132FC11511D7DD1"><enum>(2)</enum><header display-inline="yes-display-inline">Administrative tasks, dissemination
				activities, and outreach</header><text display-inline="yes-display-inline">The
				term <quote>administrative tasks, dissemination activities, and
				outreach</quote> includes costs and activities associated with—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="HB2138E67851E4327A03AD5C7BC4B4864"><enum>(A)</enum><text display-inline="yes-display-inline">recruiting and selecting students to attend
				eligible public charter schools;</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H3E799FCCA7724B38A8FFE103751231D6"><enum>(B)</enum><text display-inline="yes-display-inline">outreach to parents of students enrolled in
				identified schools or schools with low graduation rates;</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H02F4F0AD1E044645B9956F8552286A53"><enum>(C)</enum><text display-inline="yes-display-inline">providing information to such parents and
				school officials at such schools regarding eligible public charter schools
				receiving subgrants under this section;</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HFC61604DE0D44501AC062A45BE6DD805"><enum>(D)</enum><text display-inline="yes-display-inline">necessary oversight of the grant program
				under this section; and</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id058C1066A80C4442A39EDAE02AA4CEC6"><enum>(E)</enum><text display-inline="yes-display-inline">initiatives and activities to disseminate
				the best practices, programs, or strategies learned in eligible public charter
				schools to other public schools operating in the State where the eligible
				entity intends to award subgrants under this section.</text>
									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7B06718A3A514F4BB60EA40EAEF6E0AD"><enum>(3)</enum><header display-inline="yes-display-inline">Charter
				school</header><text display-inline="yes-display-inline">The term <term>charter
				school</term> means—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="id9F37A4FC4EEB45E3ABF0BA9217EB0009"><enum>(A)</enum><text display-inline="yes-display-inline">a charter school, as defined in section
				5211(1); or</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idD672CA1436124DB39EA18F7B1D0C7001"><enum>(B)</enum><text display-inline="yes-display-inline">a school that meets the requirements of
				such section, except for subparagraph (D) of the section, and provides
				prekindergarten or adult education services.</text>
									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HB0E287A013AD4E12B43B53B77706321A"><enum>(4)</enum><header display-inline="yes-display-inline">Eligible entity</header><text display-inline="yes-display-inline">The term <quote>eligible entity</quote>
				means—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="HE485F026A6E7499C9080B7ECD24075DC"><enum>(A)</enum><text display-inline="yes-display-inline">a State educational agency;</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HD13B0CCB36CB48FA876834BC37C01F10"><enum>(B)</enum><text display-inline="yes-display-inline">an authorized public chartering
				agency;</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H450A953545C44C308ED22242B6A4C831"><enum>(C)</enum><text display-inline="yes-display-inline">a local educational agency that has
				authorized or is planning to authorize a public charter school; or</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id65FA438D52A5492CA4AD4069D306B17F"><enum>(D)</enum><text display-inline="yes-display-inline">an organization, including a nonprofit
				charter management organization, that has an organizational mission and record
				of success supporting the replication and expansion of high-quality charter
				schools and is—</text>
										<clause commented="no" display-inline="no-display-inline" id="HAAE5FA659D974238951CA4998FF4457E"><enum>(i)</enum><text display-inline="yes-display-inline">described in section 501(c)(3) of the
				Internal Revenue Code of 1986 (26 U.S.C. 501(c)(3)); and</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="H1AEA1EFDEFC0470200A9A96BF19DC45E"><enum>(ii)</enum><text display-inline="yes-display-inline">exempt from tax under section 501(a) of
				such Code (26 U.S.C. 501(a)).</text>
										</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HA680787668CC407499F8D94F044580E5"><enum>(5)</enum><header display-inline="yes-display-inline">Eligible public charter
				school</header><text display-inline="yes-display-inline">The term
				<quote>eligible public charter school</quote> means a charter school, including
				a public charter school that is being developed by a developer, that—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="H62E772790A2041BDBA4AD769B10A4002"><enum>(A)</enum><text display-inline="yes-display-inline">has made adequate yearly progress for 2 of
				the last 3 consecutive school years; and</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HD90AF7F35AEB4C46AAF13E97F68EC59F"><enum>(B)</enum><text display-inline="yes-display-inline">in the case of a public charter school that
				is a secondary school, has, for the most recent school year for which data is
				available, met or exceeded the graduation rate required by the State in order
				to make adequate yearly progress for such year.</text>
									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H237421F61B16400596D85C9750F03D18"><enum>(6)</enum><header display-inline="yes-display-inline">Graduation rate</header><text display-inline="yes-display-inline">The term <quote>graduation rate</quote> has
				the meaning given the term in section 1111(b)(2)(C)(vi), as clarified in
				section 200.19(b)(1) of title 34, Code of Federal Regulations.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HA4F679499D0149E78D94A1BCDAB08D20"><enum>(7)</enum><header display-inline="yes-display-inline">Identified school</header><text display-inline="yes-display-inline">The term <quote>identified school</quote>
				means a school identified for school improvement, corrective action, or
				restructuring under paragraph (1), (7), or (8) of section 1116(b).</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HB7FF19DA8FF14E119B3B4B4506351435"><enum>(8)</enum><header display-inline="yes-display-inline">Local educational agency</header><text display-inline="yes-display-inline">The term <quote>local educational
				agency</quote> includes any charter school that is a local educational agency,
				as determined by State law.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H36853EA2FA364681A2B3E104F8C0C1FE"><enum>(9)</enum><header display-inline="yes-display-inline">Low-income student</header><text display-inline="yes-display-inline">The term <quote>low-income student</quote>
				means a student eligible for free or reduced price lunches under the Richard B.
				Russell National School Lunch Act (42 U.S.C. 1751 et seq.).</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idCE469F61A5F447AE88F46342A590C95F"><enum>(10)</enum><header>School food
				authority</header><text>The term <term>school food authority</term> has the
				meaning given the term in section 250.3 of title 7, Code of Federal Regulations
				(or any corresponding similar regulation or ruling).</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HDFB5408D6E3947B4981101304C86A66F"><enum>(11)</enum><header display-inline="yes-display-inline">School year</header><text display-inline="yes-display-inline">The term <quote>school year</quote> has the
				meaning given such term in section 12(d) of the Richard B. Russell National
				School Lunch Act (42 U.S.C. 1760(d)).</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H4885E9D5B50843ADB952C3AE3A2316AB"><enum>(12)</enum><header display-inline="yes-display-inline">Traditional public school</header><text display-inline="yes-display-inline">The term <quote>traditional public
				school</quote> does not include any charter school, as defined in section
				5211.</text>
								</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idCEBFE13BE8904841A7456BD227C47D90"><enum>(b)</enum><header display-inline="yes-display-inline">Authorization of
			 appropriations</header><text display-inline="yes-display-inline">Part B of
			 title V of the Elementary and Secondary Education Act of 1965 (20 U.S.C. 7221
			 et seq.) is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="idFBBE6A4E47AA4BDE851BC4944EFD8A41"><enum>(1)</enum><text display-inline="yes-display-inline">by striking section 5231; and</text>
