		<official-title>To provide an amnesty period during which veterans and
		  their family members can register certain firearms in the National Firearms
		  Registration and Transfer Record, and for other purposes.</official-title>

		<section id="HFB7BA041197F46F0A6A0FC0C69C8B8AE" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Veterans’ Heritage Firearms Act of
			 2011</short-title></quote>.</text>
		</section><section id="H5E4C9C04E3A141E0A5B0286B0FDDFE8B"><enum>2.</enum><header>Amnesty period
			 for veterans to register qualifying firearms</header>
			<subsection id="H7255FAEB65C54746A131823324458845"><enum>(a)</enum><header>Definitions</header><text>In
			 this section:</text>
				<paragraph id="HF40A60C7A53642BB8E4456F50EA01D85"><enum>(1)</enum><header>Amnesty
			 period</header><text>The term <term>amnesty period</term> means the 90-day
			 period beginning on the date that is 90 days after the date of enactment of
			 this Act.</text>
				</paragraph><paragraph id="H6E523C55BC8146D6BBB7456B88A39CBA"><enum>(2)</enum><header>Applicable
			 veteran</header><text>The term <term>applicable veteran</term> means, with
			 respect to a firearm, the veteran referred to in paragraph (7)(A) with respect
			 to the firearm.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H496A53E00539473D9A1134CF23DC9E45"><enum>(3)</enum><header>Continental
			 united states</header><text>The term <term>continental United
			 States</term>—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="idD348A4F72AA44D1589CBFB537D7F870E"><enum>(A)</enum><text>means the several
			 States and the District of Columbia; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2A68649058C3485494A5DF9A1733F5B6"><enum>(B)</enum><text>does not include
			 Alaska or Hawaii.</text>
					</subparagraph></paragraph><paragraph id="HF0B827D2937D479CBED03CF2E3A41457"><enum>(4)</enum><header>Family</header>
					<subparagraph id="H1FD939EA96D74252A00E58C3B9DD8737"><enum>(A)</enum><header>In
			 general</header><text>The term <term>family</term> means, with respect to a
			 veteran—</text>
						<clause id="idC149B7F91AC84DEE998834F02CAC2451"><enum>(i)</enum><text>a
			 grandparent of the veteran;</text>
						</clause><clause id="id8AB612BF05C241EDB390AC45E11F5F20"><enum>(ii)</enum><text>the spouse of
			 the veteran;</text>
						</clause><clause id="idBDEA0DDCA8B742E79683C742DCB46BDF"><enum>(iii)</enum><text>a
			 lineal descendant of a grandparent described in clause (i); and</text>
						</clause><clause id="id3902948A03944683BB259C9CD8EDD36A"><enum>(iv)</enum><text>the spouse of a
			 lineal descendant described in clause (iv).</text>
						</clause></subparagraph><subparagraph id="H7165159F1C4B4B3782196F5B01E3D9DF"><enum>(B)</enum><header>Special
			 rules</header><text display-inline="yes-display-inline">For purposes of
			 subparagraph (A)—</text>
						<clause id="H66531E0493204B80BD6FCD53A37F8051"><enum>(i)</enum><text>a
			 spouse of an individual who is legally separated from the individual under a
			 decree of divorce or separate maintenance shall be deemed to be the spouse of
			 the individual; and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="H28FA144D7F154CF7825DEC8A15732023"><enum>(ii)</enum><text>an individual
			 shall be deemed to be a lineal descendant of a grandparent of a veteran if the
			 individual is—</text>
							<subclause id="ID5a98cfaad86f4e70ac8b618063fe1356"><enum>(I)</enum><text>the biological
			 child of an individual who is the spouse of a lineal descendant of the
			 grandparent;</text>
							</subclause><subclause id="ID9d18fc4fdf6d4e1cb6bcbf0920c6aa43"><enum>(II)</enum><text>adopted by a
			 lineal descendant of the grandparent; or</text>
							</subclause><subclause id="id7A641625D78140C89FB27B4388B18A80"><enum>(III)</enum><text>a lineal
			 descendant of an individual described in subclause (I) or (II).</text>
							</subclause></clause></subparagraph></paragraph><paragraph id="HF9A82D3B4BE94C7AA9849D51D2434E57"><enum>(5)</enum><header>Firearm</header><text>The
			 term <term>firearm</term>—</text>
					<subparagraph id="id6505CEB72BC141369E136BDF35F01420"><enum>(A)</enum><text>has the meaning
			 given the term in section 5845 of the Internal Revenue Code of 1986; and</text>
					</subparagraph><subparagraph id="id53615111CBA24630A9DC726ACA5E20E4"><enum>(B)</enum><text>does not
			 include—</text>
						<clause id="HF234BC230B4B424C8A922A9489E14E79"><enum>(i)</enum><text>any
			 device described in section 5845(f)(1) of the Internal Revenue Code of 1986;
			 or</text>
						</clause><clause id="H6DAB6F7F9DC1429CA9290D3F4BD10FEA"><enum>(ii)</enum><text>any
			 combination of parts—</text>
							<subclause id="H809E5C80FCD442CB93E186DCD5C6970A"><enum>(I)</enum><text>designed or
			 intended for use in converting any device into a device described in clause
			 (i); or</text>
							</subclause><subclause id="HCB30D6E419FA40F28CEEC8D43230DCB9"><enum>(II)</enum><text>from which a
			 device described in clause (i) may be readily assembled.</text>
							</subclause></clause></subparagraph></paragraph><paragraph id="idC12D79EE64004D3AA3C8CCDE5C5076D7"><enum>(6)</enum><header>National
			 Firearms Registration and Transfer Record</header><text>The term <term>National
			 Firearms Registration and Transfer Record</term> means the National Firearms
			 Registration and Transfer Record established under section 5841 of the Internal
			 Revenue Code of 1986.</text>
				</paragraph><paragraph id="H5CC6D24ACF454B10A7AC35A53A373C2F"><enum>(7)</enum><header>Qualifying
			 firearm</header>
					<subparagraph id="idDC899DEEEAAB4CFC8A303486CD01DEAA"><enum>(A)</enum><header>In
			 general</header><text>The term <term>qualifying firearm</term> means any
			 firearm that was acquired—</text>
						<clause id="HC0F49C43E671493781A70C49593803EC"><enum>(i)</enum><text>before October 31,
			 1968; and</text>
						</clause><clause id="H279DEC72E3C64B92B6039E47183F5948"><enum>(ii)</enum><text>by
			 a veteran, while the veteran was—</text>
							<subclause id="id6B362805ECDB42BFAEB149BC25415727"><enum>(I)</enum><text>a member of the
			 Armed Forces; and</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="id4B1578CEDFF94DF0851EB9E359829581"><enum>(II)</enum><text>stationed
			 outside the continental United States.</text>
							</subclause></clause></subparagraph><subparagraph id="H5A4AD129DCC34494858E6159CC066F1D"><enum>(B)</enum><header>Presumption of
			 validity</header><text>In the absence of clear and convincing evidence to the
			 contrary, the Attorney General shall accept as true and accurate any affidavit,
			 document, or other evidence submitted by an individual to establish that a
			 firearm meets the requirements of subparagraph (A).</text>
					</subparagraph></paragraph><paragraph id="H63C78234D0BF45AB94D947FE3575F6D3"><enum>(8)</enum><header>Veteran</header><text>The
			 term <term>veteran</term> has the meaning given that term in section 101(2) of
			 title 38, United States Code.</text>
				</paragraph></subsection><subsection id="HFD632C4220C84EC98528774685670646"><enum>(b)</enum><header>Registration</header><text>Subject
			 to such regulations as the Attorney General may prescribe, during the amnesty
			 period an applicable veteran or a member of the family of the applicable
			 veteran who owns and possesses a qualifying firearm may register the qualifying
			 firearm in the National Firearms Registration and Transfer Record.</text>
			</subsection><subsection id="H5344C2CBD4DE4BBFA817C4F21B6854FD"><enum>(c)</enum><header>Hearings</header><text>If
			 the Attorney General determines that an individual may not register a firearm
			 under subsection (b) during the amnesty period, the Attorney General, on the
			 request of the individual, shall—</text>
				<paragraph id="HD1740F838E824EB2AEF86F1C351C0607"><enum>(1)</enum><text>provide the
			 individual any evidence on which the decision by the Attorney General is based;
			 and</text>
				</paragraph><paragraph id="H45DDFB8545F54144B56240149275E2B5"><enum>(2)</enum><text>promptly hold a
			 hearing to review the determination.</text>
				</paragraph></subsection><subsection id="H340EA67C1FC749F594547C3F273728AA"><enum>(d)</enum><header>Limited
			 immunity</header>
				<paragraph id="H3E9FE497DDD2496FB80D5B2614DDA2DD"><enum>(1)</enum><header>Criminal
			 liability under title 18</header><text>An individual who registers a qualifying
			 firearm under subsection (b)—</text>
					<subparagraph id="H235A3D1A3DEC4DE488AE78C5D6C4FBD5"><enum>(A)</enum><text>shall be treated,
			 for purposes of subsections (a)(3) and (o) of section 922 of title 18, United
			 States Code, as having lawfully acquired and possessed the qualifying firearm
			 before the date of the enactment of chapter 44 of such title and of each
			 provision of such chapter; and</text>
					</subparagraph><subparagraph id="HF89E686737F24A2F92D66DE2A37CBD12"><enum>(B)</enum><text>shall not be
			 liable for any violation of such chapter that—</text>
						<clause id="H79575C15D16845DBA62F43ECF0CACA32"><enum>(i)</enum><text>is
			 based solely on the ownership, possession, transportation, importation, or
			 alteration of the qualifying firearm by the individual; and</text>
						</clause><clause id="HFE59F8779A3446FD9690DB9E406A680C"><enum>(ii)</enum><text>occurred at or
			 before the time at which the individual registered the qualifying
			 firearm.</text>
						</clause></subparagraph></paragraph><paragraph id="H3EB4EC7007F640A69236439AFC3605F4"><enum>(2)</enum><header>Criminal
			 liability under Internal Revenue Code</header><text>Except as provided in
			 paragraph (3), an individual who registers a qualifying firearm under
			 subsection (b) shall not be liable for a violation of chapter 53 or 75 of the
			 Internal Revenue Code of 1986 with respect to the qualifying firearm that
			 occurred at or before the time at which the individual registered the
			 qualifying firearm.</text>
				</paragraph><paragraph id="H9018E6842738491CB0B2B95074F77ABC"><enum>(3)</enum><header>Transfer tax
			 liability</header><text>Paragraph (2) shall not affect the liability of any
			 individual for any transfer tax imposed under section 5811 of the Internal
			 Revenue Code of 1986.</text>
				</paragraph><paragraph id="HCF6558AD00CF41E5A2FD605A36B8240A"><enum>(4)</enum><header>Attempts to
			 register</header><text>In the case of an applicable veteran or a member of the
			 family of the applicable veteran who attempts to register a qualifying firearm
			 in the National Firearms Registration and Transfer Record at a time other than
			 during the amnesty period, paragraphs (1), (2), and (3) shall apply with
			 respect to the individual if the individual surrenders the qualifying firearm
			 to a law enforcement agency not later than 30 days after notification by the
			 Attorney General of potential criminal liability for continued possession of
			 the qualifying firearm.</text>
				</paragraph></subsection><subsection id="HE0CD1615DF1C4150A473F2A75CBF1442"><enum>(e)</enum><header>Forfeiture</header><text>A
			 qualifying firearm registered under subsection (b) shall not be subject to
			 seizure or forfeiture under chapter 53 or 75 of the Internal Revenue Code of
			 1986 or chapter 44 of title 18, United States Code, for a violation of any such
			 chapter with respect to the qualifying firearm that occurred at or before the
			 time at which the individual registered the firearm.</text>
			</subsection><subsection id="H816FA1F5D1E54227A87BB6E5EACC7421"><enum>(f)</enum><header>Notice; forms;
			 mailbox rule</header>
				<paragraph id="H08A6701E2CC848D98517068B1B8BC8A8"><enum>(1)</enum><header>Notice of
			 amnesty period</header><text>The Attorney General shall provide clear printed
			 notices providing information regarding the amnesty period and registering a
			 qualifying firearm during the period. To the extent feasible, the Attorney
			 General shall ensure that the notices are posted in post offices, law
			 enforcement buildings, buildings of the Department of Veterans Affairs, and
			 businesses of licensed firearms dealers.</text>
				</paragraph><paragraph id="H525113EC6F0044079D66A541F07103FB"><enum>(2)</enum><header>Forms</header><text>The
			 Attorney General shall make available any forms necessary for registering a
			 firearm in the National Firearms Registration and Transfer Record. To the
			 extent feasible, the Attorney General shall make such forms available in the
			 locations referred to in paragraph (1) and through the website of the Bureau of
			 Alcohol, Tobacco, Firearms, and Explosives.</text>
				</paragraph><paragraph id="H31A3A731AB6E4EEAA2DCA03C2B7D09C0"><enum>(3)</enum><header>Mailbox
			 rule</header><text>For purposes of this section, the Attorney General shall
			 treat any form that is postmarked during the amnesty period as being received
			 during the amnesty period.</text>
				</paragraph></subsection></section><section id="H33D13C31D6E64BA2AC6B74DBB51F52F6"><enum>3.</enum><header>Transfer of
			 firearms to museums</header>
			<subsection id="HB398CF8920C94806AEC8E2032CE1E331"><enum>(a)</enum><header>Transfer of
			 forfeited curio or relic firearms to museums</header>
				<paragraph id="id10652A643E934338ACA952AA93813AF7"><enum>(1)</enum><header>Definitions</header><text>In
			 this subsection:</text>
					<subparagraph id="HF5CA98FFB0B449D28CE8BE38C64294AA"><enum>(A)</enum><header>Curio or relic
			 firearm</header><text>The term <term>curio or relic firearm</term> means any
			 firearm (as defined in section 2(a)(5)) that is treated as a curio or relic
			 under chapter 44 of title 18, United States Code.</text>
					</subparagraph><subparagraph id="H80944B0B20F241939CC90CC4ADF0A027"><enum>(B)</enum><header>Qualified
			 museum</header><text>The term <term>qualified museum</term> means—</text>
						<clause id="H5F5152C572CC4DEFA813A73CA5A482B2"><enum>(i)</enum><text>any
			 museum owned or operated by the Federal Government or a State or local
			 government; and</text>
						</clause><clause id="H056E9109A79945AA91E3458982CCD1C3"><enum>(ii)</enum><text>any
			 museum that—</text>
							<subclause id="HD84C1496FD344FBCB229267F0E9FA3FA"><enum>(I)</enum><text>is open to the
			 public;</text>
							</subclause><subclause id="HF4F1825BE11E43A8A7CA67C92D989C7E"><enum>(II)</enum><text>is incorporated
			 as a nonprofit corporation under applicable State law;</text>
							</subclause><subclause id="HA614E761753A42AD9440EBA488B77B02"><enum>(III)</enum><text>may possess a
			 firearm in the collection of the museum under the laws of the State in which
			 the collection is displayed;</text>
							</subclause><subclause id="HCE57D874BF5A413EACF356E1C435A1CB"><enum>(IV)</enum><text>holds a license
			 under chapter 44 of title 18, United States Code, as a collector of curios or
			 relics; and</text>
							</subclause><subclause id="H59A7E21E57CA4D2E8AC4EE1095885199"><enum>(V)</enum><text>certifies to the
			 Attorney General that—</text>
								<item id="HC578A973826A43179E4EB66B9DF5472B"><enum>(aa)</enum><text>the
			 museum is not engaged in the trade or business of buying or selling curio or
			 relic firearms;</text>
								</item><item id="HA672161EE2E24CE3A63EB1B980E7D90F"><enum>(bb)</enum><text>with
			 respect to the transfer of any curio or relic firearm under paragraph (2), the
			 museum is not requesting the transfer of the curio or relic firearm for purpose
			 of sale; and</text>
								</item><item commented="no" display-inline="no-display-inline" id="HF22EB9FAAB2A46C993EB54C22E29A465"><enum>(cc)</enum><text>the museum shall,
			 not later than 90 days after the museum ceases operations, file an application
			 pursuant to chapter 53 of the Internal Revenue Code of 1986 to transfer any
			 machinegun transferred to the museum under paragraph (2) to an entity or person
			 who may lawfully possess the machinegun under section 922(o) of title 18,
			 United States Code, or abandon the machinegun to Federal, State, or local law
			 enforcement authorities.</text>
								</item></subclause></clause></subparagraph></paragraph><paragraph id="HFAB270FF6E7948DD9963CD666DDAF386"><enum>(2)</enum><header>Transfer</header><text>The
			 Attorney General shall transfer each curio or relic firearm that is forfeited
			 to the United States to the first qualified museum that submits a request for
			 the curio or relic firearm in such form and manner as the Attorney General may
			 specify.</text>
				</paragraph><paragraph id="H717CD9274270474EB3083A89B9D6BF3D"><enum>(3)</enum><header>Destruction of
			 forfeited curio or relic firearms prohibited</header><text>The Attorney General
			 shall not destroy any curio or relic firearm that is forfeited to the United
			 States until the end of the 5-year period beginning on the date of the
			 forfeiture.</text>
				</paragraph><paragraph id="H63DB2E3D34E147F6BAB4E1D9BB424C2C"><enum>(4)</enum><header>Catalogue of
			 curio or relic firearms</header><text>With respect to each curio or relic
			 firearm that is available to be transferred to a qualified museum under
			 paragraph (2), the Attorney General shall, not later than 60 days after the
			 date of the forfeiture of the curio or relic firearm, publish information which
			 identifies the curio or relic firearm (including a picture) on the website of
			 the Bureau of Alcohol, Tobacco, Firearms, and Explosives. The information shall
			 be available to the public without cost and without restriction.</text>
				</paragraph><paragraph id="HADB154454D7941CD84FF8877D5A17D4B"><enum>(5)</enum><header>Registration of
			 curio or relic firearms</header><text>Any curio or relic firearm transferred
			 under paragraph (2) to a qualified museum shall be registered to the transferee
			 in the National Firearms Registration and Transfer Record.</text>
				</paragraph></subsection><subsection id="HB39A2876A4C046A68AF4D96272A234D7"><enum>(b)</enum><header>Transfer of
			 machineguns to museums</header><text>Section 922(o)(2) of title 18, United
			 States Code, is amended—</text>
				<paragraph id="H629D9B854BAC42AC9021BE5AA78E432E"><enum>(1)</enum><text>in subparagraph
			 (A), by striking <quote>or</quote> at the end;</text>
				</paragraph><paragraph id="H373A7C8709DA46A99F8A0A63FF912578"><enum>(2)</enum><text>by redesignating
			 subparagraph (B) as subparagraph (C); and</text>
				</paragraph><paragraph id="HF7E33E0603B341AA890A8F24946FB138"><enum>(3)</enum><text>by inserting after
			 subparagraph (A) the following:</text>
					<quoted-block id="HB3CFA6C0BF394E6FA542D683E5A93FC8" style="OLC">
						<subparagraph id="H968C9CAA95C4427B9D2F73383180DD3E"><enum>(B)</enum><text>a transfer to or
				by, or possession by, a museum that is open to the public and incorporated as a
				nonprofit corporation under applicable State law;
				or</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
