		<section id="id2B44E4F4E3454EC3A0FD1544765E50FC" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Economic Development Revitalization
			 Act of 2011</short-title></quote>.</text>
		</section><section id="idB4CD0299DEE548AA8337BD7C6DCC9C15"><enum>2.</enum><header>Findings and
			 declarations</header><text display-inline="no-display-inline">Section 2 of the
			 Public Works and Economic Development Act of 1965 (42 U.S.C. 3121) is
			 amended—</text>
			<paragraph id="idA053961F66E2453F8157071E02760B7B"><enum>(1)</enum><text>in subsection
			 (a)(3)(C), by inserting <quote>, including the location of information
			 technology and manufacturing jobs in the United States</quote> after
			 <quote>investment</quote>; and</text>
			</paragraph><paragraph id="id702794CE607348549DF3D53A39AA09FA"><enum>(2)</enum><text>in subsection
			 (b), by striking paragraph (3) and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="id751F302A84A649A683CB26805A6DD95A" style="OLC">
					<paragraph id="IDac059511d6bf459cbe5bf69b5151eeb0"><enum>(3)</enum><text>whether suffering
				from long-term distress or a sudden economic dislocation, distressed
				communities should be encouraged to promote innovation and entrepreneurship,
				including, as appropriate, the support of the formation of business incubators
				in economically distressed areas, so as to help regions to create higher-skill,
				higher-wage jobs and foster the participation of those regions in the global
				marketplace;
				and</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="idCC759505B3F24761AFAF6FCE4AE63ADE"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 3(8) of the Public Works and
			 Economic Development Act of 1965 (42 U.S.C. 3122(8)) is amended—</text>
			<paragraph id="ID82e565f3e98b4300bde05842e2b4da79"><enum>(1)</enum><text>in subparagraph
			 (C), by striking <quote>and</quote> at the end;</text>
			</paragraph><paragraph id="IDbf43cbc1f43f4fc9a0a193a3164ce5e3"><enum>(2)</enum><text>in subparagraph
			 (D), by striking the period at the end and inserting <quote>; and</quote>;
			 and</text>
			</paragraph><paragraph id="ID17e6bd814a0c457a91ccd2dae6c742f3"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
				<quoted-block display-inline="no-display-inline" id="idC173215995F94E12942104C71AFE2916" style="OLC">
					<subparagraph id="ID1d51594266564b048b0d559186b71e82"><enum>(E)</enum><text>the Southeast
				Crescent Regional Commission established by section 15301(a)(1) of title 40,

					</subparagraph><subparagraph id="ID362297456e8a4843b900bee3f0c5694e"><enum>(F)</enum><text>the Northern
				Border Regional Commission established by section 15301(a)(3) of title 40,
				United States Code; and</text>
					</subparagraph><subparagraph id="ID90028ddcc71745eead92a6d12285ec33"><enum>(G)</enum><text>the Southwest
				Border Regional Commission established by section 15301(a)(2) of title 40,
				United States
				Code.</text>
					</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="ID74e408f9ab31479381583d7308dba84c"><enum>4.</enum><header>Economic
			 development partnerships</header><text display-inline="no-display-inline">Section 101 of the Public Works and Economic
			 Development Act of 1965 (42 U.S.C. 3131) is amended—</text>
			<paragraph id="ID858189ac0313415683e76b94f9540b25"><enum>(1)</enum><text>in subsection
			 (b)—</text>
				<subparagraph id="IDc1c11ea557c54229b8bf41147649c6cb"><enum>(A)</enum><text>in the matter
			 preceding paragraph (1), by inserting <quote>economic development districts,
			 university centers,</quote> after <quote>multi-State regional
			 organizations,</quote>;</text>
				</subparagraph><subparagraph id="ID8d7b2110e49444569a9c669e0bc98d5d"><enum>(B)</enum><text>by striking
			 paragraph (2) and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="idDA0FC3B75D844C619610BF1F7AE38729" style="OLC">
						<paragraph id="ID81bc751f2ba84864aa247963b314eb05"><enum>(2)</enum><text>encourage and
				support public-private partnerships for the formation and improvement of
				regional economic development strategies that sustain and promote innovation
				and entrepreneurship that is critical to economic competitiveness across the
				United States; and</text>
						</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</subparagraph><subparagraph id="ID2a532e503a634dcc803c022a9073423e"><enum>(C)</enum><text>in paragraph (3),
			 by inserting <quote>, innovation, entrepreneurship, beneficial
			 development,</quote> after <quote>infrastructure</quote>; and</text>
				</subparagraph></paragraph><paragraph id="ID5800f0b43acc43c3bb16ec48f6d88f93"><enum>(2)</enum><text>in subsection
			 (c), by inserting <quote>(including economic development districts)</quote>
			 after <quote>local government agencies</quote>.</text>
			</paragraph></section><section id="ID553d6d43da8444d7bde863d8ea5aea7b"><enum>5.</enum><header>Encouragement of
			 certain coordination</header><text display-inline="no-display-inline">Section
			 102 of the Public Works and Economic Development Act of 1965 (42 U.S.C. 3132)
			 is amended—</text>
			<paragraph id="idA961B50938FB4D8F8737D94AFEA8BC25"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>In accordance
			 with</quote> and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="idF89922A174D14EEF88B6C66E96297EA6" style="OLC">
					<subsection id="id5D8E255853D8409DA710911765200B34"><enum>(a)</enum><header>In
				general</header><text>In accordance
				with</text>
					</subsection><after-quoted-block>;

			</paragraph><paragraph id="idB2270BBED290486EB036A9CC96BDB12B"><enum>(2)</enum><text>by adding at the
			 end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id2F8B0F9BCBE5494F8797F8173AF1D2B1" style="OLC">
					<subsection id="idEEEEECED371D4908B60E5C3A859C4A32"><enum>(b)</enum><header>Governmental
				cooperation</header>
						<paragraph id="idF2B8EAE4CCB74B6B876A8B9970CB1474"><enum>(1)</enum><header>In
				general</header><text>The Secretary is authorized and encouraged to consult and
				cooperate with other agencies, including representatives of the Federal
				Government, State and local governments, and consortia of governmental
				organizations, that can assist in addressing challenges and capitalize on
				opportunities that require intergovernmental coordination.</text>
						</paragraph><paragraph id="id559B07C8FA524BDEB6ABE80EF42B2016"><enum>(2)</enum><header>Labor</header><text>In
				carrying out paragraph (1), the Secretary shall cooperate with the Secretary of
				Labor to support economic and workforce development strategies and the
				promotion of regional innovation
				clusters.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="IDea7abaaa0f0c467baac552741792e01b"><enum>6.</enum><header>Additional
			 support for enterprise development organizations within the public works
			 program</header><text display-inline="no-display-inline">Section 201(a) of the
			 Public Works and Economic Development Act of 1965 (42 U.S.C. 3141) is
			 amended—</text>
			<paragraph id="IDd988e2e2c7f24d339c3fcc1da54cc4fd"><enum>(1)</enum><text>in paragraph (1),
			 by striking <quote>and</quote> at the end;</text>
			</paragraph><paragraph id="id4173D3264DDD413390B18DC9EEC97C5D"><enum>(2)</enum><text>in paragraph (2),
			 by striking the period at the end and inserting <quote>; and</quote>;
			 and</text>
			</paragraph><paragraph id="IDe85d4ba28d78467ca84fa2d5860a634c"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
				<quoted-block display-inline="no-display-inline" id="idF5CC069A9CAA45A08154B33D3752B25B" style="OLC">
					<paragraph id="IDeced28c5d54e438ea038057e097776c8"><enum>(3)</enum><text>other activities
				the conduct of which the Secretary determines would be necessary or useful to
				support the establishment and operation of those facilities on an ongoing
				basis, including—</text>
						<subparagraph id="id2C3EC1F9776A4E1F80F7BEB5C4380C06"><enum>(A)</enum><text>related planning,
				technical assistance, and business development assistance to enable the
				recipient to bring together regional assets and encourage entrepreneurial
				development; and</text>
						</subparagraph><subparagraph id="id1BFD2BE24465447C840D8BB10D9D1519"><enum>(B)</enum><text>to the extent
				needed to support entrepreneurial development, revolving loan funds pursuant to
				section
				209.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="IDfdcfa27b45dd405f91e0e4bbec7a8f81"><enum>7.</enum><header>Grants for
			 planning and grants for administrative expenses</header><text display-inline="no-display-inline">Section 203 of the Public Works and Economic
			 Development Act of 1965 (42 U.S.C. 3143) is amended—</text>
			<paragraph id="ID2d12968b9bb9442db6002bf9cf89a7b7"><enum>(1)</enum><text>in subsection
			 (b)—</text>
				<subparagraph id="IDb36b8cb1480449b7887d11f3af892013"><enum>(A)</enum><text>in paragraph (3),
			 by striking <quote>and</quote> at the end; and</text>
				</subparagraph><subparagraph id="ID38b365c9a9264b14aac9de760ed9c9a6"><enum>(B)</enum><text>by striking
			 paragraph (4) and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="id1360DF07551C43AE9D9292CF2BAC3513" style="OLC">
						<paragraph id="IDa99cd0936ead4260b351102e72a9f8e1"><enum>(4)</enum><text>formulating and
				implementing an economic development program that includes systematic efforts
				to reduce unemployment and increase incomes by fostering innovation and
				entrepreneurship;</text>
						</paragraph><paragraph id="IDa82f9b2e9c174273b3a990436d3e65a7"><enum>(5)</enum><text>fostering
				regional collaboration among local jurisdictions and organizations; and</text>
						</paragraph><paragraph id="ID07844156d42c43b7a859ec1b038f7cb4"><enum>(6)</enum><text>facilitating a
				stakeholder process that assists the community or region in creating an
				economic development vision that takes into account local and regional assets
				(including natural, social, community, and geographical resources) and global
				economic change.</text>
						</paragraph><after-quoted-block>;
				</after-quoted-block></quoted-block>
				</subparagraph></paragraph><paragraph id="ID58413a7560b84edbb862bd03fee1b678"><enum>(2)</enum><text>in subsection
			 (d)—</text>
				<subparagraph id="id916771BF27E0407CAD51E4C47D93363F"><enum>(A)</enum><text>in paragraph
			 (4)—</text>
					<clause id="ID008766c765a84c81830124c8da1d8b04"><enum>(i)</enum><text>in
			 subparagraph (E), by striking <quote>and</quote> at the end;</text>
					</clause><clause id="IDfb421f10e66146609eb4cb8ccc2a8b63"><enum>(ii)</enum><text>in
			 subparagraph (F), by striking the period at the end and inserting <quote>;
			 and</quote>; and</text>
					</clause><clause id="ID8ad0501fee0947cca716c3b7686a7d28"><enum>(iii)</enum><text>by adding at
			 the end the following:</text>
						<quoted-block display-inline="no-display-inline" id="idBB1B4B46899043CFA3A532B16E21B12B" style="OLC">
							<subparagraph commented="no" id="ID9b48091cd5ad4197995396ab99ed9e22"><enum>(G)</enum><text>support
				development practices that—</text>
								<clause commented="no" id="id0A5E0EA5D52F4DFC8AFEF5E3FCDFC84C"><enum>(i)</enum><text>enhance energy
				and water efficiency;</text>
								</clause><clause commented="no" id="id8FBA402B7FA54A99A7EC278766C29EB2"><enum>(ii)</enum><text>reduce the
				dependence of the United States on foreign oil; and</text>
								</clause><clause commented="no" id="idD91A8CDD4E354BD1BD40C608D81F04B4"><enum>(iii)</enum><text>encourage
				efficient coordination and leveraging of public and private
				investments.</text>
								</clause></subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</clause></subparagraph><subparagraph id="IDd4e3cef1128d44108a7d89add62d00ba"><enum>(B)</enum><text>in paragraph (5),
			 by striking <quote>subsection shall</quote> and all that follows through the
			 end of the paragraph and inserting the following: “subsection shall—</text>
					<quoted-block display-inline="no-display-inline" id="id5E003532153949DDBB78548BE56476C9" style="OLC">
						<subparagraph id="ID5c102287a5b2406e9b693e70102ef227"><enum>(A)</enum><text>submit to the
				Secretary an annual report on the planning process assisted under this
				subsection; and</text>
						</subparagraph><subparagraph id="ID7f571b45ede4447aa415608ee0740c1d"><enum>(B)</enum><text>provide a copy of
				each annual report to each economic development district within the
				State.</text>
						</subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</subparagraph></paragraph><paragraph id="ID6d313f00a56e40da88654c7c19ca2069"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
				<quoted-block display-inline="no-display-inline" id="idE8DE179402864517AD03CB2455C0D03C" style="OLC">
					<subsection id="ID0df64bd53192464f9261d18f9abde2fa"><enum>(e)</enum><header>Additional
				amounts To address severe need</header><text>In determining the amount of funds
				to provide a recipient for planning assistance under this section, the
				Secretary shall take into account those recipients located in regions that
				are—</text>
						<paragraph id="idA6279EDC1D07448DB6FDFF015D6D8278"><enum>(1)</enum><text>eligible for an
				investment rate of 80 percent or higher; or</text>
						</paragraph><paragraph id="id33C1C98F8D1044C4836FC289E090D1A2"><enum>(2)</enum><text>experiencing
				severe need due to long-term economic deterioration or sudden and severe
				economic distress.</text>
						</paragraph></subsection><subsection id="ID715376dc4a164b01a1ec8917fb17e2e4"><enum>(f)</enum><header>Encouraging
				planning assistance on a broader regional scale</header><text>In order to
				encourage district organizations to develop regional economic competitiveness
				strategies on a broader basis in collaboration with other district
				organizations and entities outside the confines of a single economic
				development district, the Secretary may increase—</text>
						<paragraph id="id9C562301AC0945DC9D18ECEBA1C63D10"><enum>(1)</enum><text>the Federal share
				otherwise applicable to the recipients; or</text>
						</paragraph><paragraph id="id2713E004F4F54910A86730289AC12B0A"><enum>(2)</enum><text>the amount of
				Federal assistance to the
				recipients.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="ID5cb5c6549a9a417b878c84bbbb742693"><enum>8.</enum><header>Cost
			 sharing</header>
			<subsection id="ID6fd64cb6d58e47dfa4d57f845970f313"><enum>(a)</enum><header>Federal
			 share</header><text>Section 204(a) of the Public Works and Economic Development
			 Act of 1965 (42 U.S.C. 3144(a)) is amended by striking <quote>shall not
			 exceed—</quote> and all that follows through the end of the subsection and
			 inserting <quote>shall not exceed 50 percent, except as otherwise expressly
			 provided in this Act.</quote>.</text>
			</subsection><subsection id="IDfaf3b316112e4715b43ac84d8071b035"><enum>(b)</enum><header>Increase in
			 Federal share</header><text>Section 204(c) of the Public Works and Economic
			 Development Act of 1965 (42 U.S.C. 3144(c)) is amended—</text>
				<paragraph id="IDdd53c81b734d4a43a613443999a16444"><enum>(1)</enum><text>by redesignating
			 paragraphs (1) through (3) as paragraphs (2) through (4), respectively;</text>
				</paragraph><paragraph id="ID7ceda4524b414441ab06be994b837362"><enum>(2)</enum><text>by inserting
			 before paragraph (2) (as redesignated by paragraph (1)) the following:</text>
					<quoted-block display-inline="no-display-inline" id="idBD25CFBECAB943AF8082FB9542C06FF8" style="OLC">
						<paragraph id="IDd069b052a2894601a1aef41459e39578"><enum>(1)</enum><header>Relative needs
				of an area</header>
							<subparagraph id="ID23ca1a478983431a9401ef6967488e21"><enum>(A)</enum><header>150-Percent
				higher unemployment rate</header><text>In the case of a grant made in an area
				for which the 24-month unemployment rate is at least 150 percent of the
				national average or the per capita income is not more than 70 percent of the
				national average, the Secretary may increase the Federal share above the
				percentage specified in subsection (a) up to 60 percent of the cost of the
				project.</text>
							</subparagraph><subparagraph id="ID96f3390537db476a95ea4a7afbb78bfa"><enum>(B)</enum><header>175-Percent
				higher unemployment rate</header><text>In the case of a grant made in an area
				for which the 24-month unemployment rate is at least 175 percent of the
				national average or the per capita income is not more than 60 percent of the
				national average, the Secretary may increase the Federal share above the
				percentage specified in subsection (a) up to 70 percent of the cost of the
				project.</text>
							</subparagraph><subparagraph id="ID979d5038dd02414e8788c6fc030c3516"><enum>(C)</enum><header>200-Percent
				higher unemployment rate</header><text>In the case of a grant made in an area
				for which the 24-month unemployment rate is at least 200 percent of the
				national average or the per capita income is not more than 50 percent of the
				national average, the Secretary may increase the Federal share above the
				percentage specified in subsection (a) up to 80 percent of the cost of the
				project.</text>
							</subparagraph><subparagraph id="IDf0d1d242455a44b6a160583f35341b77"><enum>(D)</enum><header>Additional
				criteria</header><text>The Secretary may establish eligibility criteria in
				addition to the criteria described in this paragraph to address areas impacted
				by severe outmigration, sudden and severe economic dislocations, and other
				economic circumstances, on the condition that a Federal share established for
				such eligibility criteria shall not exceed 80
				percent.</text>
							</subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
				</paragraph><paragraph id="IDacd48d6fa9e4415188f5315a8d7f473d"><enum>(3)</enum><text>in paragraph (2)
			 (as redesignated by paragraph (1))—</text>
					<subparagraph id="IDaf851656af4e4329bd1a5eb43d0bde37"><enum>(A)</enum><text>by striking
			 <quote>may</quote> and inserting <quote>shall</quote>; and</text>
					</subparagraph><subparagraph id="ID7c813fefdec04039b54745896d4f3a6c"><enum>(B)</enum><text>by inserting
			 <quote>to 75 percent of the cost of the project, and may increase</quote> after
			 <quote>subsection (a)</quote>; and</text>
					</subparagraph></paragraph><paragraph id="IDcb7b3051712843329b0c744bd3239f07"><enum>(4)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="id1485626952A64FD9BCC5A198307A0443" style="OLC">
						<paragraph id="IDd573fdf0d5084f1787c8cc125d2783d1"><enum>(5)</enum><header>Federally
				declared disaster areas</header><text>In the case of a grant for an area with
				respect to which a major disaster or emergency has been declared under the
				Robert T. Stafford Disaster Relief and Emergency Assistance Act (42 U.S.C. 5121
				et seq.) during the 18-month period ending on the date on which the Federal
				share is determined, the Secretary may increase the Federal share above the
				percentage specified in subsection (a) up to 100 percent of the cost of the
				project.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection></section><section id="ID6d321a7283624573a148dd2c7a128a52"><enum>9.</enum><header>Grants for
			 training, research, and technical assistance</header><text display-inline="no-display-inline">Section 207(a) of the Public Works and
			 Economic Development Act of 1965 (42 U.S.C. 3147(a)) is amended—</text>
			<paragraph id="id260E2D74FCB94A1E8A25A73FEA5C6C30"><enum>(1)</enum><text>in paragraph (1),
			 by striking <quote>or underemployment</quote> and inserting <quote>,
			 outmigration, or underemployment, or in assisting in the location of
			 information technology and manufacturing jobs in the United States</quote>;
			 and</text>
			</paragraph><paragraph id="IDff9c1cf773bc4730aa6bba4fda5936b1"><enum>(2)</enum><text>in paragraph
			 (2)—</text>
				<subparagraph id="IDb20d9724d4c34e15a29ca961839f4e06"><enum>(A)</enum><text>in subparagraph
			 (H), by striking <quote>and</quote> at the end;</text>
				</subparagraph><subparagraph id="ID059602eecdb6472ca2843d29b76f5f1e"><enum>(B)</enum><text>by redesignating
			 subparagraph (I) as subparagraph (J); and</text>
				</subparagraph><subparagraph id="ID1f5eaa1404304cbb9d61bf627742c6bd"><enum>(C)</enum><text>by inserting
			 after subparagraph (H) the following:</text>
					<quoted-block display-inline="no-display-inline" id="id7680824DB42449A28266CB468B7BA50D" style="OLC">
						<subparagraph id="ID20dfcacb5461466d914ef0f0302777f1"><enum>(I)</enum><text>a peer exchange
				program to promote industry-leading practices and innovations relating to the
				organizational development, program delivery, and regional initiatives of
				economic development districts;
				and</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</subparagraph></paragraph></section><section id="IDe27b463a453c4f59beef03f495d9d55f"><enum>10.</enum><header>Enhancement of
			 recipient flexibility to deal with project assets</header>
			<subsection id="id2A35C38BCBAF4F42B7CEE5C0EE3D6C61"><enum>(a)</enum><header>Particular
			 community assistance</header><text>Section 209(c) of the Public Works and
			 Economic Development Act of 1965 (42 U.S.C. 3149(c)) is amended—</text>

			 paragraphs (2) through (4) as paragraphs (3) through (5), respectively;</text>

			 after paragraph (1) the following:</text>

				in subparagraph (A) are—</text>
								<clause id="ID284e1a4881194c6485d31ddd84ce051b"><enum>(i)</enum><text>the public;
				and</text>
								</clause><clause id="IDdad3980edccd4b86af2ad8333f1ec574"><enum>(ii)</enum><text>in particular,
				revolving loan fund grantees, national experts, and employees of Federal
				agencies with knowledge of international, national, regional, and statewide
				trends, innovations, and noteworthy practices relating to business development
				finance, including public and private lending and technical assistance
				intermediaries.</text>
								</clause></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
				</paragraph><paragraph id="IDc4ab011278bb46958e863ac422a9e0fe"><enum>(3)</enum><text>in subparagraph
			 (A) of paragraph (5) (as redesignated by paragraph (1)), by striking

				a recipient determines that a revolving loan fund established using assistance
				provided under this section is no longer needed, or that the recipient could
				make better use of the assistance in light of the current economic development
				needs of the recipient if the assistance was made available to carry out any
				other project that meets the requirements of this Act, the recipient may submit
				to the Secretary a request to approve the conversion of the assistance.</text>
							</subparagraph><subparagraph id="ID92e06b9201cb43bcb416ed5255750797"><enum>(B)</enum><header>Methods of
				conversion</header><text>A recipient request to convert assistance that is
				approved under subparagraph (A) may accomplish the conversion by—</text>
								<clause id="ID2c82d16294ca4403bd0cfff5a460c892"><enum>(i)</enum><text>selling to a
				third party any assets of the applicable revolving loan fund; or</text>
								</clause><clause id="IDcacb51bbb5364a4d98add3f038234505"><enum>(ii)</enum><text>retaining
				repayments of principal and interest amounts on loans provided through the
				applicable revolving loan fund.</text>
								</clause></subparagraph><subparagraph id="IDecb35787701642c99a43b98f4555cf94"><enum>(C)</enum><header>Requirements</header>
								<clause id="ID01f96b30235a43a785bd9567f2bf5c78"><enum>(i)</enum><header>Sale</header>
									<subclause id="ID58d292765ab94369867bcb5f205c2a25"><enum>(I)</enum><header>In
				general</header><text>Subject to subclause (II), a recipient shall use the net
				proceeds from a sale of assets under subparagraph (B)(i) to pay any portion of
				the costs of 1 or more projects that meet the requirements of this Act.</text>
									</subclause><subclause id="IDa8876f32853b40d49d60925bacd553d0"><enum>(II)</enum><header>Treatment</header><text>For
				purposes of subclause (I), a project described in that subclause shall be
				considered to be eligible under section 301.</text>
									</subclause></clause><clause id="ID09bbbb513d0d4a4fbeb2c6b4a16907ec"><enum>(ii)</enum><header>Retention of
				repayments</header><text>Retention by a recipient of any repayment under
				subparagraph (B)(ii) shall be carried out in accordance with a strategic reuse
				plan approved by the Secretary that provides for the increase of capital over
				time until sufficient amounts (including interest earned on the amounts) are
				accumulated to fund other projects that meet the requirements of this
				Act.</text>
								</clause></subparagraph><subparagraph id="ID53da7bf68a7444e1a0a3cd3ad3c11323"><enum>(D)</enum><header>Terms and
				conditions</header><text>The Secretary may require such terms and conditions
				regarding a proposed conversion of the use of assistance under this paragraph
				as the Secretary determines to be appropriate.</text>
							</subparagraph><subparagraph id="IDc800e58bc9b14f27bf5968949d00955a"><enum>(E)</enum><header>Expediency
				requirement</header><text>The Secretary shall ensure that any assistance
				intended to be converted for use pursuant to this paragraph is used in an
				expeditious manner.</text>
							</subparagraph></paragraph><paragraph id="IDa99c2f1b471f44cb8793f69b925dc8f8"><enum>(7)</enum><header>Program
				administration</header><text>The Secretary may allocate not more than 2 percent
				of the amounts made available for grants under this section for the development
				and maintenance of an automated tracking and monitoring system to ensure the
				proper operation and financial integrity of the revolving loan program
				established under this
				section.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection></section><section id="ID13ed72304f2a4ad4ad40487e8536bc5b"><enum>11.</enum><header>Renewable
			 energy program</header><text display-inline="no-display-inline">Section 218 of
			 the Public Works and Economic Development Act of 1965 (42 U.S.C. 3154d) is
			 amended—</text>
			<paragraph id="IDe13a5efebb084ab1808da5e7125c3e77"><enum>(1)</enum><text>by striking
			 subsection (a) and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="id5EF546A2B0D14194B45938C9E3EA47FD" style="OLC">

				the comprehensive economic development strategy of the economic development

				implementing economic development activities in the economic development

				economic development research, planning, implementation, and advisory functions
				identified in the comprehensive economic development strategy; and</text>

				development and implementation of the comprehensive economic development
				strategy with other Federal, State, local, and private organizations.</text>

				economic development district may elect to enter into contracts for services to
				accomplish the activities described in paragraph
				(1).</text>

			 Works and Economic Development Act of 1965 (42 U.S.C. 3211 et seq.) is amended
			 by adding at the end the following:</text>

				of best efforts</header>
						<paragraph id="IDe7321cebbefd41739d4c3a4efe04945b"><enum>(1)</enum><header>Establishment</header><text>To
				carry out the purposes of this Act, before providing investment assistance for
				a construction project under this Act, the Secretary shall establish the
				expected period during which the recipient of the assistance shall make best
				efforts to achieve the economic development objectives of the
				assistance.</text>
						</paragraph><paragraph id="ID57696e791c814c6e858b065e942e8515"><enum>(2)</enum><header>Treatment of
				property</header><text>To obtain the best efforts of a recipient during the
				period established under paragraph (1), during that period—</text>
							<subparagraph id="IDf260820f0cf1457787c300fae0d786bd"><enum>(A)</enum><text>any property that
				is acquired or improved, in whole or in part, using investment assistance under
				this Act shall be held in trust by the recipient for the benefit of the
				project; and</text>
							</subparagraph><subparagraph id="IDc8684f8defa347c2936261377ecc403e"><enum>(B)</enum><text>the Secretary
				shall retain an undivided equitable reversionary interest in the
				property.</text>
							</subparagraph></paragraph><paragraph id="IDfb5c51b49cc64342abb57069cddfef14"><enum>(3)</enum><header>Termination of
				Federal interest</header>
							<subparagraph id="IDf1cb2aa3a74247aba1c346543df6237a"><enum>(A)</enum><header>In
				general</header><text>Beginning on the date on which the Secretary determines
				that a recipient has fulfilled the obligations of the recipient for the
				applicable period under paragraph (1), taking into consideration the economic
				conditions existing during that period, the Secretary may terminate the
				reversionary interest of the Secretary in any applicable property under
				paragraph (2)(B).</text>
							</subparagraph><subparagraph id="ID533587aa00c64ff1a0ea87b247790db4"><enum>(B)</enum><header>Alternative
				method of termination</header>
								<clause id="IDb207cb4017a04914a7c8f85636b07dfd"><enum>(i)</enum><header>In
				general</header><text>On a determination by a recipient that the economic
				development needs of the recipient have changed during the period beginning on
				the date on which investment assistance for a construction project is provided
				under this Act and ending on the expiration of the expected period established
				for the project under paragraph (1), the recipient may submit to the Secretary
				a request to terminate the reversionary interest of the Secretary in property
				of the project under paragraph (2)(B) before the date described in subparagraph
				(A).</text>
								</clause><clause id="IDed18d57e238745a78145405fcf68c33a"><enum>(ii)</enum><header>Approval</header><text>The
				Secretary may approve a request of a recipient under clause (i) if—</text>
									<subclause id="ID4dfc284585294a3d9eb77ab273f881a5"><enum>(I)</enum><text>in any case in
				which the request is submitted during the 10-year period beginning on the date
				on which assistance is initially provided under this Act for the applicable
				project, the recipient repays to the Secretary an amount equal to 100 percent
				of the fair market value of the pro rata Federal share of the project;
				or</text>
									</subclause><subclause id="ID0bbe9c45b1074300b77f0a8bfa58fb57"><enum>(II)</enum><text>in any case in
				which the request is submitted after the expiration of the 10-year period
				described in subclause (I), the recipient repays to the Secretary an amount
				equal to the fair market value of the pro rata Federal share of the project as
				if that value had been amortized over the period established under paragraph
				(1), based on a straight-line depreciation of the project throughout the
				estimated useful life of the project.</text>
									</subclause></clause></subparagraph></paragraph></subsection><subsection id="IDee39418b8b31436da9580a3972066fe7"><enum>(b)</enum><header>Terms and
				conditions</header><text>The Secretary may establish such terms and conditions
				under this section as the Secretary determines to be appropriate, including by
				extending the period of a reversionary interest of the Secretary under
				subsection (a)(2)(B) in any case in which the Secretary determines that the
				performance of a recipient is unsatisfactory.</text>
					</subsection><subsection id="IDf1c18e6df6e1492aa81e1ba794a806f5"><enum>(c)</enum><header>Previously
				extended assistance</header><text>With respect to any recipient to which the
				term of provision of assistance was extended under this Act before the date of
				enactment of this section, the Secretary may approve a request of the recipient
				under subsection (a) in accordance with the requirements of this section to
				ensure uniform administration of this Act, notwithstanding any estimated useful
				life period that otherwise relates to the assistance.</text>
					</subsection><subsection id="ID3bf513bf630d425787e195b71faf0308"><enum>(d)</enum><header>Conversion of
				use</header><text>If a recipient of assistance under this Act demonstrates to
				the Secretary that the intended use of the project for which assistance was
				provided under this Act no longer represents the best use of the property used
				for the project, the Secretary may approve a request by the recipient to
				convert the property to a different use for the remainder of the term of the
				Federal interest in the property, subject to the condition that the new use
				shall be consistent with the purposes of this Act.</text>
					</subsection><subsection id="ID3da5d1dd2e244ea291a7b9ac0883b502"><enum>(e)</enum><header>Status of
				authority</header><text>The authority of the Secretary under this section is in
				addition to any authority of the Secretary pursuant to any law or grant
				agreement in effect on the date of enactment of this
				section.</text>
					</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="ID24a36df3615a421b8a520fbb14cc44ae"><enum>19.</enum><header>Extension of
			 authorization of appropriations</header><text display-inline="no-display-inline">Section 701(a) of the Public Works and
			 Economic Development Act of 1965 (42 U.S.C. 3231(a)) is amended by striking
			 <quote>expended—</quote> and all that follows through paragraph (5) and
			 inserting <quote>expended, $500,000,000 for each of fiscal years 2011 through
			 2015.</quote>.</text>
		</section><section id="IDbc9d58f93d984d3a9af35c91168cbb10"><enum>20.</enum><header>Funding for
			 grants for planning and grants for administrative expenses</header><text display-inline="no-display-inline">Section 704 of the Public Works and Economic
			 Development Act of 1965 (42 U.S.C. 3234) is amended to read as follows:</text>
			<quoted-block display-inline="no-display-inline" id="id6FEA3E1DA5C44DD1A0B98F5174C47153" style="OLC">
				<section id="ID57064abb885e43c1809ce12fd68c16a5"><enum>704.</enum><header>Funding for
				grants for planning and grants for administrative expenses</header>
					<subsection id="IDd5d82152e1a741d2820785a07cd3dc56"><enum>(a)</enum><header>In
				general</header><text>Subject to subsection (b), of the amounts made available
				under section 701 for each fiscal year, there shall be made available to
				provide grants under section 203 an amount equal to not less than the lesser
				of—</text>
						<paragraph id="idAFC1815FF7F54317BBF17873CAD898BC"><enum>(1)</enum><text>12 percent;
				and</text>
						</paragraph><paragraph id="idF02CF825EC0541E9A021437589B128E1"><enum>(2)</enum><text>$31,000,000.</text>
						</paragraph></subsection><subsection id="ID522f837cb2c34b9eae579c907f8573d1"><enum>(b)</enum><header>Subject to
				total appropriations</header><text>For any fiscal year, the amount made
				available pursuant to subsection (a) shall be increased to—</text>
						<paragraph id="IDd3e1da523a884e3391cadf55af5af754"><enum>(1)</enum><text>if the total
				amount made available under section 701(a) for the fiscal year is equal to or
				greater than $291,000,000, an amount equal to the greater of—</text>
							<subparagraph id="id3FCA56598F294B3C93C39E4B9843C964"><enum>(A)</enum><text>$32,000,000;
				and</text>
							</subparagraph><subparagraph id="id5F90CD99BEFE4FB1BF1E4182D8FBA6EA"><enum>(B)</enum><text>11 percent of the
				total amount made available under section 701(a) for the fiscal year;</text>
							</subparagraph></paragraph><paragraph id="ID0e239a18f9d3496e9cb50f1896b2f1c8"><enum>(2)</enum><text>if the total
				amount made available under section 701(a) for the fiscal year is equal to or
				greater than $330,000,000, an amount equal to the greater of—</text>
							<subparagraph id="id65BC9E0F08D94658A3B419C5F51DC2DA"><enum>(A)</enum><text>$33,000,000;
				and</text>
							</subparagraph><subparagraph id="id99A0ADED1A3F4EBBA9C537E7D7D17383"><enum>(B)</enum><text>10 percent of the
				total amount made available under section 701(a) for the fiscal year;</text>
							</subparagraph></paragraph><paragraph id="IDfbe370fcb2af40e5bad4fed5980f056f"><enum>(3)</enum><text>if the total
				amount made available under section 701(a) for the fiscal year is equal to or
				greater than $340,000,000, an amount equal to the greater of—</text>
							<subparagraph id="idF0EC5719AFC54DB49117E2B5061D1319"><enum>(A)</enum><text>$34,000,000;
				and</text>
							</subparagraph><subparagraph id="id7958E9C44E9B4CC89068AF030E20751C"><enum>(B)</enum><text>10 percent of the
				total amount made available under section 701(a) for the fiscal year; or</text>
							</subparagraph></paragraph><paragraph id="IDd1137991c0614e23b3b492b4bc21e4e5"><enum>(4)</enum><text>if the total
				amount made available under section 701(a) for the fiscal year is equal to or
				greater than $350,000,000, an amount equal to the greater of—</text>
							<subparagraph id="id9A270C3E77BF4A76ADF02D59739C46E9"><enum>(A)</enum><text>$35,000,000;
				and</text>
							</subparagraph><subparagraph id="id01DF345A8D3D45939896A25FCAB9F003"><enum>(B)</enum><text>10 percent of the
				total amount made available under section 701(a) for the fiscal
				year.</text>
							</subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section changed="added" id="id36E1AD2ED3874CAE9034CAF74D1C9F76" reported-display-style="italic"><enum>21.</enum><header>Report on duplicative
			 programs</header><text display-inline="no-display-inline">Not later than 90
			 days after the date of enactment of this Act, the Government Accountability
			 Office shall submit to the Committee on Environment and Public Works of the
			 Senate a report that describes a list of the specific programs and portions of
			 specific programs of other Federal agencies that are duplicative of programs or
			 portions of programs administered by the Economic Development Administration,
			 including the programs or portions of programs carried out by—</text>
			<paragraph id="id5677508E72CB41E2B3EFAAC16E804A32"><enum>(1)</enum><text display-inline="yes-display-inline">the Department of Housing and Urban
			 Development;</text>
			</paragraph><paragraph id="idC9D38B19DFE54D86AF82E361B814245F"><enum>(2)</enum><text display-inline="yes-display-inline">the Department of Agriculture; and</text>
			</paragraph><paragraph id="idB7A34DD068134B658ECD2FF91354D75F"><enum>(3)</enum><text display-inline="yes-display-inline">the Small Business Administration.</text>
