		<official-title>To amend the Indian Gaming Regulatory Act to modify a
		  provision relating to gaming on land acquired after October 17,
		  1988.</official-title>

		<section id="id4DE3E2A3F8E44159BF34A34052AEA38B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Tribal Gaming Eligibility
			 Act</short-title></quote>.</text>
		</section><section id="id622017D1D761488CBC9208C2772ACDFB" section-type="subsequent-section"><enum>2.</enum><header>Gaming on land
			 acquired after October 17, 1988</header><text display-inline="no-display-inline">Section 20 of the Indian Gaming Regulatory
			 Act (25 U.S.C. 2719) is amended—</text>
			<paragraph id="idCDEDA63413D340DBA9A454D521DDFEB4"><enum>(1)</enum><text>by striking the
			 section designation and heading and all that follows through <quote>(a)
			 Except</quote> and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="idB263B296DA2A433EACACC0915F60AEDF" style="OLC">
					<section id="id993B386CE2F747A3A0D5E6EF1D8BEB8C"><enum>20.</enum><header>Gaming on land
				acquired after October 17, 1988</header>
						<subsection id="id31219B6895A240F3AE3584C223B207DD"><enum>(a)</enum><header>In
				general</header><text>Except</text>
						</subsection></section><after-quoted-block>;
				and</after-quoted-block></quoted-block>
			</paragraph><paragraph id="id767FE6EDB8734225853F6277A6E7C129"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (b)—</text>
				<subparagraph id="idB068143787BF429181F04548C25AD79C"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (1)(B), in the matter
			 preceding clause (i), by inserting <quote>subject to paragraph (2),</quote>
			 before <quote>lands are taken</quote>;</text>
				</subparagraph><subparagraph id="id0BA7EA46E96944C78B2DEC720489B5A7"><enum>(B)</enum><text>by redesignating
			 paragraphs (2) and (3) as paragraphs (3) and (4), respectively;</text>
				</subparagraph><subparagraph id="idF5D61399A0884D9EB7DB6EAB773FFE69"><enum>(C)</enum><text>by inserting
			 after paragraph (1) the following:</text>
					<quoted-block display-inline="no-display-inline" id="idAA646057637341C0961A5BBB6A0F88AF" style="OLC">
						<paragraph id="idDDF80CFFB3B14F1081530CC345FA4161"><enum>(2)</enum><header>Applicability
				to certain land</header>
							<subparagraph id="id095BD6DE8E1F4E7AB712CF0C8DBCBBF9"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">Except as provided in
				subparagraph (D), effective beginning on the date of enactment of the
				<short-title>Tribal Gaming Eligibility Act</short-title>,
				in addition to any other requirements under applicable Federal law, gaming
				conducted pursuant to an exception under paragraph (1)(B) shall not be
				conducted on land taken into trust after October 17, 1988, by the United States
				for the benefit of an Indian tribe unless the Secretary determines, on the date
				the land is taken into trust, that the Indian tribe—</text>
								<clause id="ID92ba066058684c4e9491d411e5a6910e"><enum>(i)</enum><text>has received a
				written determination by the Secretary that the land is eligible to be used for
				gaming under this section; and</text>
								</clause><clause id="id5FBB6E9FE2744A8C9DB27F4B78EFD08E"><enum>(ii)</enum><text>demonstrates—</text>
									<subclause id="idAD1ABAEEC74147D888CB034007843351"><enum>(I)</enum><text>in accordance
				with subparagraph (B), a substantial, direct, modern connection to the land
				taken into trust, as of October 17, 1988; and</text>
									</subclause><subclause id="idAB81591A624645D9BCB81FB1DE9904BC"><enum>(II)</enum><text>in accordance
				with subparagraph (C), a substantial, direct, aboriginal connection to the land
				taken into trust.</text>
									</subclause></clause></subparagraph><subparagraph id="id48B461E617A246EFA2C55398C38B94EB"><enum>(B)</enum><header>Substantial,
				direct, modern connection</header><text>In making a determination under
				subparagraph (A)(ii)(I) that an Indian tribe demonstrates a substantial,
				direct, modern connection to land taken into trust as of October 17, 1988, the
				Secretary shall certify that—</text>
								<clause id="id6D281734C5B547D5BA10FEA258739DB4"><enum>(i)</enum><text>if the Indian
				tribe has a reservation—</text>
									<subclause id="ID3e153fe524ee4ce69329f81048eee21e"><enum>(I)</enum><text>the land is
				located within a 25-mile radius of the tribal headquarters or other tribal
				governmental facilities of the Indian tribe on the reservation;</text>
									</subclause><subclause id="ID01702c23b98f47039f013d6c551457d4"><enum>(II)</enum><text>the Indian tribe
				has demonstrated a temporal connection to, or routine presence on, the land
				during the period beginning on October 17, 1988, and ending on the date of the
				certification; and</text>
									</subclause><subclause id="ID2f480cff3ec04d3b9641be08f26e6ea5"><enum>(III)</enum><text>the Indian
				tribe has not been recognized or restored to Federal recognition status during
				the 5-year period preceding the date of the certification; or</text>
									</subclause></clause><clause id="id04A2CCFDBDE14BB48AE4C8255DDDF3AE"><enum>(ii)</enum><text>if the Indian
				tribe does not have a reservation—</text>
									<subclause id="ID58ea3259c5414fd3b1ba80b0bb7421cb"><enum>(I)</enum><text>the land is
				located within a 25-mile radius of an area in which a significant number of
				members of the Indian tribe reside;</text>
									</subclause><subclause id="IDfeeefb00c69b40fcb46b1adf09f21b44"><enum>(II)</enum><text>the Indian tribe
				has demonstrated a temporal connection to, or routine presence on, the land
				during the period beginning on October 17, 1988, and ending on the date of the
				certification; and</text>
									</subclause><subclause id="IDfa279855318f46379007eb67afe75eb2"><enum>(III)</enum><item commented="no" display-inline="yes-display-inline" id="id6DF8F89C60824000938AA9AF28624B96"><enum>(aa)</enum><text>the land was included
				in the first-submitted request of the Indian tribe for newly acquired land
				since the date on which the Indian tribe was recognized or restored to Federal
				recognition; or</text>
										</item><item id="ID1629f5a78cdf4db3919d0b0fc7012c07" indent="up1"><enum>(bb)</enum><subitem commented="no" display-inline="yes-display-inline" id="id1B89EEFE0353438AA4A20BDA0E65B77E"><enum>(AA)</enum><text>the application to
				take the land into trust was received by the Secretary during the 5-year period
				beginning on the date on which the Indian tribe was recognized or restored to
				Federal recognition; and</text>
											</subitem><subitem id="id504C2C0E0A92400894024129829DF985" indent="up1"><enum>(BB)</enum><text>the Indian tribe is not conducting
				any gaming activity on any other land.</text>
											</subitem></item></subclause></clause></subparagraph><subparagraph id="IDc4117243e14044f896f1170320022344"><enum>(C)</enum><header>Substantial,
				direct, aboriginal connection</header><text>In making a determination under
				subparagraph (A)(ii)(II) that an Indian tribe demonstrates a substantial,
				direct, aboriginal connection to land, the Secretary shall take into
				consideration some or all of the following factors:</text>
								<clause id="ID87f90d8b2dad4103a35bac04f48bfb89"><enum>(i)</enum><text>The historical
				presence of the Indian tribe on the land, including any land to which the
				Indian tribe was relocated pursuant to the forcible removal of tribal members
				from land as a result of acts of violence, an Act of Congress, a Federal or
				State administrative action, or a judicial order.</text>
								</clause><clause id="IDd5d07605991e4e36bf0f16577f537000"><enum>(ii)</enum><text>Whether the
				membership of the tribe can demonstrate lineal descendent or cultural
				affiliation, in accordance with section 10.14 of title 43, Code of Federal
				Regulations (or a successor regulation).</text>
								</clause><clause id="ID06f921e6a8ed44989161b3a838bc0e27"><enum>(iii)</enum><text>The area in
				which the unique language of the Indian tribe has been used.</text>
								</clause><clause id="IDdd4788644c51432aba523df879c88723"><enum>(iv)</enum><text>The proximity of
				the land to culturally significant sites of the Indian tribe.</text>
								</clause><clause id="ID0248da07a46b4e2ba878c6c5b8a3aeff"><enum>(v)</enum><text>The forcible
				removal of tribal members from land as a result of acts of violence, an Act of
				Congress, a Federal or State administrative action, or a judicial order.</text>
								</clause><clause id="ID311d62ea8f98449dbae6adf94b79bb89"><enum>(vi)</enum><text>Other factors
				that demonstrate a temporal presence of the Indian tribe on the land prior to
				the first interactions of the Indian tribe with nonnative individuals, the
				Federal Government, or any other sovereign entity.</text>
								</clause></subparagraph><subparagraph id="id200F952FE1D04DD2B777C3C867ADBD9B"><enum>(D)</enum><header>Exceptions</header>
								<clause id="id9F594EA2BBD04746830E362212BE4096"><enum>(i)</enum><header>In
				general</header><text>Subparagraphs (A) through (C) shall not apply—</text>
									<subclause id="ID83a66e3c08404f7ebf7ead8e8ef1983f"><enum>(I)</enum><text>to any land on
				which gaming regulated by this Act will not take place;</text>
									</subclause><subclause id="idF9C28AD2ED2E4BFB963186288B004CEA"><enum>(II)</enum><text>to any land
				located within, or contiguous to, the boundaries of the reservation of an
				Indian tribe, as of October 17, 1988;</text>
									</subclause><subclause id="id8187F7DE5F4E496FABD5AAAEDDB687C3"><enum>(III)</enum><text>if—</text>
										<item id="id5404B02AC8B44121941393E88510AE31"><enum>(aa)</enum><text>the relevant
				Indian tribe did not have a reservation on October 17, 1988; and</text>
										</item><item id="idE99306DEBEB749DCB8BFF4BAA9267854"><enum>(bb)</enum><text>the land is
				located—</text>
											<subitem id="id48AD823CB82543BB8E901BDC9B333E77"><enum>(AA)</enum><text>in the State of
				Oklahoma and within the boundaries of the former reservation of the Indian
				tribe, as defined by the Secretary, or contiguous to other land held in trust
				or restricted status by the United States for the Indian tribe in the State of
				Oklahoma; or</text>
											</subitem><subitem id="id18F199ECC8584695BCE4E319B66B10BE"><enum>(BB)</enum><text>in a State other
				than Oklahoma and within the last recognized reservation of the Indian tribe in
				any State in which the Indian tribe is presently located; or</text>
											</subitem></item></subclause><subclause id="ID85d0d0928a424d36bf063ec6f35f3041"><enum>(IV)</enum><text>if the relevant
				Indian tribe has—</text>
										<item id="idCE20FCA369694E9590A46B7AB1AE2C42"><enum>(aa)</enum><text>taken land into
				trust during the period beginning on October 17, 1988, and ending on the date
				of enactment of the <short-title>Tribal Gaming Eligibility
				Act</short-title>; and</text>
										</item><item id="id33328AA27D924ACFA3D17F682E9A6052"><enum>(bb)</enum><text>has received a
				written determination by the Secretary that the land is eligible to be used for
				gaming under this section.</text>
										</item></subclause></clause><clause id="idC4BBF14935544A8793EB0AF5DAA70BD5"><enum>(ii)</enum><header>Certain
				decisions</header>
									<subclause id="idB248CF87A8774E7DBADA13A3E69F17D5"><enum>(I)</enum><header>In
				general</header><text>Subject to subclause (II), subparagraphs (A) through (C)
				shall not apply to a final agency decision issued before the date of enactment
				of the <short-title>Tribal Gaming Eligibility
				Act</short-title>.</text>
									</subclause><subclause id="id5E55BDAE7C6D44DCAAEB5B324CD44476"><enum>(II)</enum><header>Pending
				applications</header><text>Subparagraphs (A) through (C) shall apply to an
				application that is pending, but for which a final agency decision has not been
				made, as of the date of enactment of the <short-title>Tribal Gaming Eligibility Act</short-title>.</text>
									</subclause></clause></subparagraph><subparagraph id="id607517B2E94D4D1D88D83A11F4C6B54C"><enum>(E)</enum><header>Administration</header><text>An
				action under this paragraph shall be considered a final administrative action
				for purposes of subchapter II of chapter 5, and chapter 7, of title 5, United
				States Code (commonly known as the <quote><act-name>Administrative Procedure
				Act</act-name></quote>).</text>
							</subparagraph></paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</subparagraph><subparagraph id="id75449BE33C01400CAC9F6055C0F8273B"><enum>(D)</enum><text>in paragraph (4)
			 (as redesignated by subparagraph (B)), by striking <quote>paragraph
			 (2)(B)</quote> and inserting <quote>paragraph (3)(B),</quote>.</text>
				</subparagraph></paragraph></section></legis-body>
