			 technology prize</header>
			<subsection id="ID4e9a01bce68f43e9aee025e811425417"><enum>(a)</enum><header>Findings</header><text>Congress
			 finds that—</text>
				<paragraph id="ID232bfd734d8643c1bc28c027428739e1"><enum>(1)</enum><text>flue gases from
			 coal-fired electric generating facilities typically have carbon dioxide
			 concentrations of approximately 17 percent by volume;</text>
				</paragraph><paragraph id="ID48697ced731c4d86891a8b041dc58915"><enum>(2)</enum><text>it is possible to
			 separate carbon dioxide from dilute sources and even the atmosphere, which has
			 a carbon dioxide concentration of 0.038 percent, but substantial advances in
			 research and technology will be necessary to provide the separation in an
			 economical manner;</text>
				</paragraph><paragraph id="IDcd5764477a814d42a3f0985be4e3e77c"><enum>(3)</enum><text>developing
			 practical separations of carbon dioxide from dilute sources is important to the
			 future development of energy technology;</text>
				</paragraph><paragraph id="id85005229518D499D9F67313339605E18"><enum>(4)</enum><text>economical onsite
			 separation of atmospheric carbon dioxide can help leverage the use of carbon
			 dioxide in energy applications such as enhanced oil recovery and enhanced
			 geothermal systems at remote sites; and</text>
				</paragraph><paragraph id="ID3261e502639a40b4ab610db598e79a79"><enum>(5)</enum><text>authorizing the
			 Secretary of Energy to provide a technology prize for separation of carbon
			 dioxide from dilute sources can provide the impetus for developing the novel
			 technologies that will be needed in the future as part of the national energy
			 system of the United States.</text>
				</paragraph></subsection><subsection id="ID069e9af609d447d2a4aea349b1802019"><enum>(b)</enum><header>Purpose</header><text>It
			 is the purpose of this section to provide incentives to encourage the
			 development and implementation of technology to capture carbon dioxide from
			 dilute sources on a significant scale using direct air capture
			 technologies.</text>
			</subsection><subsection id="id8C0C551A32304132BDDA46C7DE09D137"><enum>(c)</enum><header>Carbon dioxide
			 capture technology prize</header><text display-inline="yes-display-inline">Section 1008 of the Energy Policy Act of
			 2005 (42 U.S.C. 16396) is amended by adding at the end the following:</text>

					<subsection commented="no" display-inline="no-display-inline" id="id9F05FB06BEC448278C9EB4E0674A85C4"><enum>(g)</enum><header display-inline="yes-display-inline">Carbon dioxide capture technology
				prize</header>
						<paragraph id="IDbc25144d49924f689d38af48962ed527"><enum>(1)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this subsection:</text>
							<subparagraph id="IDbc295c7de0b5460297947ab13c5afa3b"><enum>(A)</enum><header>Board</header><text>The
				term <term>Board</term> means the Carbon Dioxide Capture Technology Advisory
				Board established by paragraph (6).</text>
							</subparagraph><subparagraph id="ID5b8ac6b022944d399622d942240d52ca"><enum>(B)</enum><header>Dilute</header><text>The
				term <term>dilute</term> means a concentration of less than 1 percent by
				volume.</text>
							</subparagraph><subparagraph id="ID76b768fbb1da4fdfbfb0d71146dee682"><enum>(C)</enum><header>Intellectual
				property</header><text>The term <term>intellectual property</term>
				means—</text>
								<clause id="ID254600a3a9af46a7a6d2ba444ade265d"><enum>(i)</enum><text>an invention that
				is patentable under title 35, United States Code; and</text>
								</clause><clause id="ID7399f6611ea747ed8dd38bf239f682e0"><enum>(ii)</enum><text>any patent on an
				invention described in clause (i).</text>
								</clause></subparagraph><subparagraph id="IDddc9f0a3728c4f27b5c50e392f75a225"><enum>(D)</enum><header>Secretary</header><text>The
				term <term>Secretary</term> means the Secretary of Energy or designee, in
				consultation with the Board.</text>
							</subparagraph></paragraph><paragraph id="ID39a75bd51c7542d388d20e694c40f400"><enum>(2)</enum><header>Authority</header><text>Not
				later than 1 year after the date of enactment of this subsection, as part of
				the program carried out under this section, the Secretary shall establish and
				award competitive technology financial awards for carbon dioxide capture from
				media in which the concentration of carbon dioxide is dilute.</text>
						</paragraph><paragraph id="ID87a6c8fa76b8494eb87067bae28552e0"><enum>(3)</enum><header>Duties</header><text>In
				carrying out this subsection, the Secretary shall—</text>
							<subparagraph id="ID1f7ba42afe12478fa244ba50267995de"><enum>(A)</enum><text>subject to
				paragraph (4), develop specific requirements for—</text>
								<clause id="IDa3540b50975548ea9ef8048c37500c60"><enum>(i)</enum><text>the competition
				process;</text>
								</clause><clause id="IDc78b6aada3fc4dd8b8e50d569cdef785"><enum>(ii)</enum><text>minimum
				performance standards for qualifying projects; and</text>
								</clause><clause id="ID77b9202f404642ffa508d9cd0abe397b"><enum>(iii)</enum><text>monitoring and
				verification procedures for approved projects;</text>
								</clause></subparagraph><subparagraph id="ID60fb72d6d4ca41f49f0db734130b9243"><enum>(B)</enum><text>establish minimum
				levels for the capture of carbon dioxide from a dilute medium that are required
				to be achieved to qualify for a financial award described in subparagraph
				(C);</text>
							</subparagraph><subparagraph id="ID42841f44f1e34d1d864aa923403b121f"><enum>(C)</enum><text>offer financial
				awards for—</text>
								<clause id="ID7d7e0d25ffcb4d539c52556181176483"><enum>(i)</enum><text>a design for a
				promising capture technology;</text>
								</clause><clause id="ID2a536a1c0f7548b7b4cc865a0e6b4c93"><enum>(ii)</enum><text>a successful
				bench-scale demonstration of a capture technology;</text>
								</clause><clause id="ID9fcb6f5da90348dabeac01248aabf878"><enum>(iii)</enum><text>a design for a
				technology described in clause (i) that will—</text>
									<subclause id="ID1fbb63feabef437eb48b3b6b62cfbd63"><enum>(I)</enum><text>be operated on a
				demonstration scale; and</text>
									</subclause><subclause id="ID9bc9c0cc5a5a4cafb39cd7b731db07b1"><enum>(II)</enum><text>achieve
				significant reduction in the level of carbon dioxide; and</text>
									</subclause></clause><clause id="IDc913dc4613fe4d939f0766a63ea2333f"><enum>(iv)</enum><text>an operational
				capture technology on a commercial scale that meets the minimum levels
				described in subparagraph (B); and</text>
								</clause></subparagraph><subparagraph id="IDb3f947a839564384a6a4c8f15256baa7"><enum>(D)</enum><text>submit to
				Congress—</text>
								<clause id="ID420f8cce4ee74f858372aa9738e82c34"><enum>(i)</enum><text>an annual report
				that describes the progress made by the Board and recipients of financial
				awards under this subsection in achieving the demonstration goals established
				under subparagraph (C); and</text>
								</clause><clause id="ID54307f2332e2474e9678d7d3340888cd"><enum>(ii)</enum><text>not later than 1
				year after the date of enactment of this subsection, a report that describes
				the levels of funding that are necessary to achieve the purposes of this
				subsection.</text>
								</clause></subparagraph></paragraph><paragraph id="ID110547b745394e14881b42c3e94a5f3a"><enum>(4)</enum><header>Public
				participation</header><text>In carrying out paragraph (3)(A), the Board
				shall—</text>
							<subparagraph id="ID1058094ae10c4bf587564516015ab4f7"><enum>(A)</enum><text>provide notice of
				and, for a period of at least 60 days, an opportunity for public comment on,
				any draft or proposed version of the requirements described in paragraph
				(3)(A); and</text>
							</subparagraph><subparagraph id="ID9fb58835f22744c390e24e89dee03df7"><enum>(B)</enum><text>take into account
				public comments received in developing the final version of those
				requirements.</text>
							</subparagraph></paragraph><paragraph id="ID30b7e0db707e40809a93af240649878b"><enum>(5)</enum><header>Peer
				review</header><text>No financial awards may be provided under this subsection
				until the proposal for which the award is sought has been peer reviewed in
				accordance with such standards for peer review as are established by the
				Secretary.</text>
						</paragraph><paragraph id="ID622f13172733435fa54f5510e44a767b"><enum>(6)</enum><header>Carbon Dioxide
				Capture Technology Advisory Board</header>
							<subparagraph id="ID42b83a5f0d844a8392a5e3c1487ec1ed"><enum>(A)</enum><header>Establishment</header><text>There
				is established an advisory board to be known as the <quote>Carbon Dioxide
				Capture Technology Advisory Board</quote>.</text>
							</subparagraph><subparagraph id="IDcccd021e358248cb9c8eaa2801e27300"><enum>(B)</enum><header>Composition</header><text>The
				Board shall be composed of 9 members appointed by the President, by and with
				the advice and consent of the Senate, who shall provide expertise in—</text>
								<clause id="ID92dc4f1879ec4401b3401041d01412e5"><enum>(i)</enum><text>climate
				science;</text>
								</clause><clause id="ID8c85b7940b9945418ec882b0fbd1e7c6"><enum>(ii)</enum><text>physics;</text>
								</clause><clause id="ID9d7134445f7e4f4690580b88aa4998aa"><enum>(iii)</enum><text>chemistry;</text>
								</clause><clause id="ID14ecea8b80b94c1c954b67c31d8c9c6a"><enum>(iv)</enum><text>biology;</text>
								</clause><clause id="ID560041fac07d4c28a04253c6f1759eee"><enum>(v)</enum><text>engineering;</text>
								</clause><clause id="IDbe5f05d9f7934bebbdffd6e8932d8e01"><enum>(vi)</enum><text>economics;</text>
								</clause><clause id="IDa40f9b1e77514b699efe7f854124fd12"><enum>(vii)</enum><text>business
				management; and</text>
								</clause><clause id="ID2d4c6cc7e92b4fe085192ec1a20d91ef"><enum>(viii)</enum><text>such other
				disciplines as the Secretary determines to be necessary to achieve the purposes
				of this subsection.</text>
								</clause></subparagraph><subparagraph id="ID45aab12fa875461880f3ae8c346554b4"><enum>(C)</enum><header>Term;
				vacancies</header>
								<clause id="IDa457efb87cb242438d1e1efc4a70263e"><enum>(i)</enum><header>Term</header><text>A
				member of the Board shall serve for a term of 6 years.</text>
								</clause><clause id="ID075e2c4bfd10414e8fb2b34e4f948abf"><enum>(ii)</enum><header>Vacancies</header><text>A
				vacancy on the Board—</text>
									<subclause id="ID7959ab8b93294905ab248a717e63676f"><enum>(I)</enum><text>shall not affect
				the powers of the Board; and</text>
									</subclause><subclause id="ID1b7b3c35928d4f3e80227b89b181d442"><enum>(II)</enum><text>shall be filled
				in the same manner as the original appointment was made.</text>
									</subclause></clause></subparagraph><subparagraph id="ID633fe5f36e694cc89cca980f7c43b1b8"><enum>(D)</enum><header>Initial
				meeting</header><text>Not later than 30 days after the date on which all
				members of the Board have been appointed, the Board shall hold the initial
				meeting of the Board.</text>
							</subparagraph><subparagraph id="ID5d3d6b4ef29b48d0aefce52621f3dc3c"><enum>(E)</enum><header>Meetings</header><text>The
				Board shall meet at the call of the Chairperson.</text>
							</subparagraph><subparagraph id="ID41184a4f371b43f7ba0fea24a2413169"><enum>(F)</enum><header>Quorum</header><text>A
				majority of the members of the Board shall constitute a quorum, but a lesser
				number of members may hold hearings.</text>
							</subparagraph><subparagraph id="IDbd9747467ced45f086159a6b5f03221e"><enum>(G)</enum><header>Chairperson and
				vice chairperson</header><text>The Board shall select a Chairperson and Vice
				Chairperson from among the members of the Board.</text>
							</subparagraph><subparagraph id="ID95a47c21d61c4db6b7b46c6223e4199a"><enum>(H)</enum><header>Compensation</header><text>Each
				member of the Board may be compensated at not to exceed the daily equivalent of
				the annual rate of basic pay in effect for a position at level V of the
				Executive Schedule for each day during which the member is engaged in the
				actual performance of the duties of the Board.</text>
							</subparagraph><subparagraph id="ID1564fc369edf44e9abbedf82ec363059"><enum>(I)</enum><header>Duties</header><text>The
				Board shall advise the Secretary on carrying out the duties of the Secretary
				under this subsection.</text>
							</subparagraph></paragraph><paragraph id="IDd772e56157c543d2807b812417f700ff"><enum>(7)</enum><header>Intellectual
				property</header>
							<subparagraph id="ID214b5bcc0d2648eaa7b79917a5af7380"><enum>(A)</enum><header>In
				general</header><text>As a condition of receiving a financial award under this
				subsection, an applicant shall agree to vest the intellectual property of the
				applicant derived from the technology in 1 or more entities that are
				incorporated in the United States.</text>
							</subparagraph><subparagraph id="IDd8e1c74077dd439291cb88cc6c189aa3"><enum>(B)</enum><header>Reservation of
				license</header><text>The United States—</text>
								<clause id="ID8eb9a8fdfba1407f98dac072716c4a2d"><enum>(i)</enum><text>may reserve a
				nonexclusive, nontransferable, irrevocable, paid-up license, to have practiced
				for or on behalf of the United States, in connection with any intellectual
				property described in subparagraph (A); but</text>
								</clause><clause id="ID57bdb963906e4a069d8474a47906c59a"><enum>(ii)</enum><text>shall not, in the
				exercise of a license reserved under clause (i), publicly disclose proprietary
				information relating to the license.</text>
								</clause></subparagraph><subparagraph id="ID66d4c281640e46ba9777280e85f82c32"><enum>(C)</enum><header>Transfer of
				title</header><text>Title to any intellectual property described in
				subparagraph (A) shall not be transferred or passed, except to an entity that
				is incorporated in the United States, until the expiration of the first patent
				obtained in connection with the intellectual property.</text>
							</subparagraph></paragraph><paragraph id="ID3c1a3889acbf47aa9aa82a293b4786f2"><enum>(8)</enum><header>Authorization of
				appropriations</header><text display-inline="yes-display-inline">There are
				authorized to be appropriated to carry out this subsection such sums as are
				necessary.</text>
						</paragraph><paragraph id="IDe1154cb5435d4c25a062b74caa293812"><enum>(9)</enum><header>Termination of
				authority</header><text display-inline="yes-display-inline">The Board and all
				authority provided under this subsection shall terminate on December 31,
				2020.</text>

			 Prize Act of 2011</short-title></quote>.</text>

			 purpose</header>
			<subsection id="id3c3c3d42-423b-46c0-9eaf-aedab4c79d40"><enum>(a)</enum><header>Findings</header><text>Congress
			 finds that—</text>
				<paragraph id="id112fad73-c548-40a4-990b-f57304fb9ff7"><enum>(1)</enum><text>flue gases from
			 coal-fired electric generating facilities typically have carbon dioxide
			 concentrations of approximately 17 percent by volume;</text>
				</paragraph><paragraph id="id65cb5db1-f5d3-468d-946b-61bfea0c877f"><enum>(2)</enum><text>it is possible to
			 separate carbon dioxide from dilute sources and even the atmosphere, which has
			 a carbon dioxide concentration of 0.038 percent, but substantial advances in
			 research and technology will be necessary to provide the separation in an
			 economical manner;</text>
				</paragraph><paragraph id="idd936a3ec-8f0f-4ebe-a8aa-bcb38d592364"><enum>(3)</enum><text>developing practical
			 separations of carbon dioxide from dilute sources is important to the future
			 development of energy technology;</text>
				</paragraph><paragraph id="id69f32b95-db04-49d9-b346-88e564ebb52d"><enum>(4)</enum><text>economical onsite
			 separation of atmospheric carbon dioxide can help leverage the use of carbon
			 dioxide in energy applications such as enhanced oil recovery and enhanced
			 geothermal systems at remote sites; and</text>
				</paragraph><paragraph id="id0c424fc1-496e-4144-8243-d9611efc2ffb"><enum>(5)</enum><text>authorizing the Secretary
			 of Energy to provide a technology prize for separation of carbon dioxide from
			 dilute sources can provide the impetus for developing the novel technologies
			 that will be needed in the future as part of the national energy system of the
			 United States.</text>
				</paragraph></subsection><subsection id="id58dc7a9f-421d-4e07-b611-bf0cfaf85825"><enum>(b)</enum><header>Purpose</header><text>The
			 purpose of this Act is to provide incentives to encourage the development and
			 implementation of technology to capture carbon dioxide from dilute sources on a
			 significant scale using direct air capture technologies.</text>
			</subsection></section><section changed="added" committee-id="SSEG00" id="idD7985F33BFE84388B43C2FA8A24209B2" reported-display-style="italic"><enum>3.</enum><header>Carbon dioxide capture
			 technology prize</header><text display-inline="no-display-inline">Section 703
			 of the Energy Independence and Security Act of 2007 (42 U.S.C. 17251) is
			 amended—</text>
			<paragraph id="idCE01D976FA834847BF5B11FF672787C3"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating subsection (b) as
			 subsection (c);</text>
			</paragraph><paragraph id="id81B3EBE634F84D559B5AA98341F33F3E"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after subsection (a) the
			 following:</text>

							<subparagraph id="id92f73266-9313-47ba-b05a-a53fe1a4472c"><enum>(A)</enum><header>Board</header><text>The
				term <term>Board</term> means the Carbon Dioxide Capture Technology Advisory
				Board established by paragraph (6).</text>
							</subparagraph><subparagraph id="idaa014ff7-53d6-46e5-ad3a-6ede3c1dc385"><enum>(B)</enum><header>Dilute</header><text>The
				term <term>dilute</term> means a concentration of less than 1 percent by
				volume.</text>
							</subparagraph><subparagraph id="id3022b4de-959d-4afd-910f-0d83e21a94a0"><enum>(C)</enum><header>Intellectual
				property</header><text>The term <term>intellectual property</term>
				means—</text>
								<clause id="id717840b1-db8b-49fc-9179-1fe60697177b"><enum>(i)</enum><text>an invention that is
				patentable under title 35, United States Code; and</text>
								</clause><clause id="iddd6aa269-e2b0-4352-bb84-1548f7f53f19"><enum>(ii)</enum><text>any patent on an
				invention described in clause (i).</text>
								</clause></subparagraph><subparagraph id="id62781015-11ef-4413-b748-edf58601c652"><enum>(D)</enum><header>Secretary</header><text>The
				term <term>Secretary</term> means the Secretary of Energy or designee, in
				consultation with the Board.</text>
							</subparagraph></paragraph><paragraph id="id416c4980-425d-4e0d-a28c-ef7dd927f58e"><enum>(2)</enum><header>Authority</header><text>Not
				later than 1 year after the date of enactment of the
				<short-title>Carbon Dioxide Capture Technology Prize Act
				of 2011</short-title>, as part of the program carried out under this section,
				the Secretary shall establish and award competitive technology financial awards

				carrying out this subsection, the Secretary shall—</text>
							<subparagraph id="idd4233454-519c-44eb-8a92-ae3bdb2ad671"><enum>(A)</enum><text>subject to paragraph (4),
				develop specific requirements for—</text>
								<clause id="idea81068a-25b6-42e1-8dd8-cec399a02d94"><enum>(i)</enum><text>the competition
				process;</text>
								</clause><clause id="id97eaea4f-0b13-4e9a-a99a-7c58e2a6ce8f"><enum>(ii)</enum><text>minimum performance
				standards for qualifying projects; and</text>
								</clause><clause id="idcfc66d15-d33e-42e5-bd24-72f7c79b6286"><enum>(iii)</enum><text>monitoring and
				verification procedures for approved projects;</text>
								</clause></subparagraph><subparagraph id="id05f59b9d-0cc8-473c-a6ff-de752e652788"><enum>(B)</enum><text>establish minimum levels
				for the capture of carbon dioxide from a dilute medium that are required to be
				achieved to qualify for a financial award described in subparagraph (C);
				and</text>
							</subparagraph><subparagraph id="id299bfafd-f6e6-43ee-9032-5d659c2e1bf3"><enum>(C)</enum><text>offer financial awards
				for—</text>
								<clause id="idaf217d8c-2486-4632-bf71-301d89f8a507"><enum>(i)</enum><text>a design for a promising
				capture technology;</text>
								</clause><clause id="idbbf090d0-c418-4f87-b119-1320a60d7369"><enum>(ii)</enum><text>a successful bench-scale
				demonstration of a capture technology;</text>
								</clause><clause id="idfd5c86ad-7c15-4a86-97c8-e55612e39601"><enum>(iii)</enum><text>a design for a
				technology described in clause (i) that will—</text>
									<subclause id="id0e04aaeb-8f29-4687-97b5-b2350366ac8a"><enum>(I)</enum><text>be operated on a
				demonstration scale; and</text>
									</subclause><subclause id="id5b72726a-0e02-431c-9260-10a05ce013c8"><enum>(II)</enum><text>achieve significant
				reduction in the level of carbon dioxide; and</text>
									</subclause></clause><clause id="idbe9c2005-b6a6-4c5a-95a1-075090de7d39"><enum>(iv)</enum><text>an operational capture
				technology on a commercial scale that meets the minimum levels described in
				subparagraph (B).</text>
								</clause></subparagraph></paragraph><paragraph id="id97ca2f76-1fdf-46f1-a349-a21082f7477a"><enum>(4)</enum><header>Public
				participation</header><text>In carrying out paragraph (3)(A), the Board
				shall—</text>
							<subparagraph id="idaca2a617-4752-439b-8cb4-8f4111ae0dc5"><enum>(A)</enum><text>provide notice of and,
				for a period of at least 60 days, an opportunity for public comment on, any
				draft or proposed version of the requirements described in paragraph (3)(A);
				and</text>
							</subparagraph><subparagraph id="idc54c87f7-e80d-4c8a-a105-6012a4596a74"><enum>(B)</enum><text>take into account public
				comments received in developing the final version of those requirements.</text>
							</subparagraph></paragraph><paragraph id="idb73ce311-c349-48dc-8c45-01597a046987"><enum>(5)</enum><header>Peer
				review</header><text>No financial awards may be provided under this subsection
				until the proposal for which the award is sought has been peer reviewed in
				accordance with such standards for peer review as are established by the
				Secretary.</text>
						</paragraph><paragraph id="ide181e102-9b27-443b-9588-7c59e5c154e8"><enum>(6)</enum><header>Carbon Dioxide Capture
				Technology Advisory Board</header>
							<subparagraph id="id806e57a2-fb2f-46ec-a891-5486e306d447"><enum>(A)</enum><header>Establishment</header><text>There
				is established an advisory board to be known as the <quote>Carbon Dioxide
				Capture Technology Advisory Board</quote>.</text>
							</subparagraph><subparagraph id="idfcc3f0c0-ea18-4a0e-90b6-a5093e0495eb"><enum>(B)</enum><header>Composition</header><text>The
				Board shall be composed of 7 members appointed by the President that provide
				expertise in—</text>
								<clause id="id50fd7a12-43a6-4baf-85de-7e7730956ddb"><enum>(i)</enum><text>climate science;</text>
								</clause><clause id="id9793a9f0-020c-4afa-84a1-3c2bb1cc2a80"><enum>(ii)</enum><text>physics;</text>
								</clause><clause id="id7ad91aa5-9b17-48f1-b2d9-4afd4190c6e3"><enum>(iii)</enum><text>chemistry;</text>
								</clause><clause id="idb22a1abb-6064-4854-ba8c-6c65c1a19227"><enum>(iv)</enum><text>biology;</text>
								</clause><clause id="idc8f17b97-d9e4-4efa-b380-4ce0e4b53d9a"><enum>(v)</enum><text>engineering;</text>
								</clause><clause id="idfcab1fb5-5ecc-4322-8fb6-68cf8bb42ed5"><enum>(vi)</enum><text>economics;</text>
								</clause><clause id="idb88a6fe0-3739-40b5-8f48-021e92001fba"><enum>(vii)</enum><text>business management;
				and</text>
								</clause><clause id="idb1a27288-cad3-4254-86cd-806112ba42ca"><enum>(viii)</enum><text>such other disciplines
				as the Secretary determines to be necessary to achieve the purposes of this
				subsection.</text>
								</clause></subparagraph><subparagraph id="id34dc257f-815d-432e-a6c9-061e62193d6f"><enum>(C)</enum><header>Initial
				meeting</header><text>Not later than 30 days after the date on which all
				members of the Board have been appointed, the Board shall hold the initial
				meeting of the Board.</text>
							</subparagraph><subparagraph id="id803d83fd-c65e-48e9-8456-e72d616ff740"><enum>(D)</enum><header>Meetings</header><text>The
				Board shall meet at the call of the Chairperson.</text>
							</subparagraph><subparagraph id="idca7f2788-4b2f-4381-ab61-503d81a34545"><enum>(E)</enum><header>Quorum</header><text>A
				majority of the members of the Board shall constitute a quorum, but a lesser
				number of members may hold hearings.</text>
							</subparagraph><subparagraph id="id1292a236-4295-4c65-bcdb-e2878271e177"><enum>(F)</enum><header>Chairperson and vice
				chairperson</header><text>The Board shall select a Chairperson and Vice
				Chairperson from among the members of the Board.</text>
							</subparagraph><subparagraph id="idf06009d5-6667-4ce2-92fd-f2c6edcd693c"><enum>(G)</enum><header>Duties</header><text>The
				Board shall advise the Secretary on carrying out the duties of the Secretary
				under this subsection.</text>
							</subparagraph></paragraph><paragraph id="idf91710a4-b228-45b4-a91e-0faa48a3acab"><enum>(7)</enum><header>Intellectual
				property</header>
							<subparagraph id="id478f0fbd-5b6e-45a6-bfd3-909c9a11c11f"><enum>(A)</enum><header>In
				general</header><text>As a condition of receiving a financial award under this
				subsection, an applicant shall agree to vest the intellectual property of the
				applicant derived from the technology in 1 or more entities that are
				incorporated in the United States.</text>
							</subparagraph><subparagraph id="id41826c7c-5446-436f-8c00-3cdc006cb64d"><enum>(B)</enum><header>Reservation of
				license</header><text>The United States—</text>
								<clause id="id6f572f52-3ffa-4b52-bc0e-2d5344a9216a"><enum>(i)</enum><text>may reserve a
				nonexclusive, nontransferable, irrevocable, paid-up license, to have practiced
				for or on behalf of the United States, in connection with any intellectual
				property described in subparagraph (A); but</text>
								</clause><clause id="id31f8e202-5947-4b14-91c6-cc475285264e"><enum>(ii)</enum><text>shall not, in the
				exercise of a license reserved under clause (i), publicly disclose proprietary
				information relating to the license.</text>
								</clause></subparagraph><subparagraph id="id7006cd44-7ea4-4261-a148-0bdfa800c53c"><enum>(C)</enum><header>Transfer of
				title</header><text>Title to any intellectual property described in
				subparagraph (A) shall not be transferred or passed, except to an entity that
				is incorporated in the United States, until the expiration of the first patent
				obtained in connection with the intellectual property.</text>
							</subparagraph></paragraph><paragraph id="idfa4d4e43-32f2-49ca-af1e-9b1908448b41"><enum>(8)</enum><header>Termination of
				authority</header><text display-inline="yes-display-inline">The Board and all
				authority provided under this subsection shall terminate on the date that is 5
				years after the date of enactment of the <short-title>Carbon Dioxide Capture Technology Prize Act of
				2011</short-title>.</text>
						</paragraph></subsection><after-quoted-block>;
				and</after-quoted-block></quoted-block>
			</paragraph><paragraph id="idD7772330F28841CDA5961D97E9847C19"><enum>(3)</enum><text>in subsection (c) (as
			 redesignated by paragraph (1))—</text>
