		<section id="idE44D6E30D3764041842DC40A7C2393CD" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Medicare Data Access for Transparency
			 and Accountability Act</short-title></quote>.</text>
		</section><section id="idDBF70AB6EBC94835B63344125F7D09F5"><enum>2.</enum><header>Public
			 availability of medicare claims data</header>
			<subsection id="idC4151E187E694485BCE73F35E96B9166"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 1128J of the
			 Social Security Act (42 U.S.C. 1320a–7k) is amended by adding at the end the
			 following new subsection:</text>
				<quoted-block display-inline="no-display-inline" id="id29369587456F40A48B37FBD70939E0FA" style="OLC">
					<subsection id="idC1D439A34FF94611AF8BD51125680EF1"><enum>(f)</enum><header>Public
				availability of medicare claims data</header>
						<paragraph id="id1D065529FA794B9CBA2E4D8415EB02A3"><enum>(1)</enum><header>In
				general</header><text>The Secretary shall, to the extent consistent with
				applicable information, privacy, security, and disclosure laws, including the
				regulations promulgated under the Health Insurance Portability and
				Accountability Act of 1996 and section 552a of title 5, United States Code,
				make available to the public claims and payment data of the Department of
				Health and Human Services related to title XVIII, including data on payments
				made to any provider of services or supplier under such title.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id94E73177057A4997A649E1F3AB7934C9"><enum>(2)</enum><header>Implementation</header>
							<subparagraph commented="no" display-inline="no-display-inline" id="id28E44CDBDED14A9B9E902F1534570738"><enum>(A)</enum><header>In
				general</header><text>Not later than December 31, 2012, the Secretary shall
				promulgate regulations to carry out this subsection.</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8AB413BC15F34213A4B067136FC9698F"><enum>(B)</enum><header>Requirements</header><text>The
				regulations promulgated under subparagraph (A) shall ensure that—</text>
								<clause commented="no" display-inline="no-display-inline" id="id5FACE62A753F4D9AA309147F5FD0F5AD"><enum>(i)</enum><text>the data
				described in paragraph (1) is made available to the public through a searchable
				database that the public can access at no cost;</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="id80430D7FF54542BCB7B040037090FDB2"><enum>(ii)</enum><text>such
				database—</text>
									<subclause commented="no" display-inline="no-display-inline" id="id2C55A90ABCBC4D288C7EAFD66E3104F1"><enum>(I)</enum><text>includes the
				amount paid to each provider of services or supplier under title XVIII, the
				items or services for which such payment was made, and the location of the
				provider of services or supplier;</text>
									</subclause><subclause commented="no" display-inline="no-display-inline" id="idF5F3E894DB034C4DAB3C3A33C1AAB4D7"><enum>(II)</enum><text>is organized
				based on the specialty or the type of provider of services or supplier
				involved;</text>
									</subclause><subclause commented="no" display-inline="no-display-inline" id="id3DC80BBBBF47441C9CE95BA936B9AB69"><enum>(III)</enum><text>is searchable
				based on the type of items or services furnished; and</text>
									</subclause><subclause commented="no" display-inline="no-display-inline" id="id101CEA26D73B473BB674130E6E84BBC2"><enum>(IV)</enum><text>includes a
				disclaimer that the aggregate data in the database does not reflect on the
				quality of the items or services furnished or of the provider of services or
				supplier who furnished the items or services; and</text>
									</subclause></clause><clause commented="no" display-inline="no-display-inline" id="id8ABB37B196B54C26A1CADC3F0578577D"><enum>(iii)</enum><text>each provider
				of services or supplier in the database is identified by a unique identifier
				that is available to the public (such as the National Provider Identifier of
				the provider of services or supplier).</text>
								</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1D6CBB3F6758475B86DB3D0FE9BBFBC9"><enum>(C)</enum><header>Scope of
				data</header><text>The database shall include data for fiscal year 2012, and
				each year fiscal year
				thereafter.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="S1"><enum>(b)</enum><header>Information not exempt under
			 the Freedom of Information Act</header><text display-inline="yes-display-inline">The term <term>personnel and medical files
			 and similar files the disclosure of which would constitute a clearly
			 unwarranted invasion of personal privacy</term>, as used in section 552(b)(6)
			 of title 5, United States Code, does not include the information required to be
			 made available to the public under section 1128J(f) of the Social Security Act,
			 as added by subsection (a).</text>
			</subsection></section></legis-body>
