		<official-title display="yes">To authorize the Architect of the Capitol
		  to establish battery recharging stations for privately owned vehicles in
		  parking areas under the jurisdiction of the Senate at no net cost to the
		  Federal Government.</official-title>

	<legis-body display-enacting-clause="yes-display-enacting-clause" style="OLC">
		<section commented="no" display-inline="no-display-inline" id="S1" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Battery recharging stations for privately
			 owned vehicles in parking areas under the jurisdiction of the Senate at no net
			 cost to the Federal Government</header>
			<subsection commented="no" display-inline="no-display-inline" id="id0DC523D40659437D99134B16E7D647E5"><enum>(a)</enum><header display-inline="yes-display-inline">Definition</header><text display-inline="yes-display-inline">In this Act, the term <term>covered
			 employee</term> means—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="id710B3E07A29A4440B9D9D382C96E49AA"><enum>(1)</enum><text display-inline="yes-display-inline">an employee whose pay is disbursed by the
			 Secretary of the Senate; or</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id09DB2014CECD4C9BB2DD99CBEFE1AD07"><enum>(2)</enum><text display-inline="yes-display-inline">any other individual who is authorized to
			 park in any parking area under the jurisdiction of the Senate on Capitol
			 Grounds.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id706DA83CFCF942838B3777EBF427B973"><enum>(b)</enum><header display-inline="yes-display-inline">Authority</header>
				<paragraph commented="no" display-inline="no-display-inline" id="id7E27EBB8DA754DC4B09CEE9482F8532B"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subject to paragraph (3), funds
			 appropriated to the Architect of the Capitol under the heading
			 <quote><header-in-text level="appropriations-intermediate" style="appropriations">Capitol Power Plant</header-in-text></quote> under the
			 heading <quote><header-in-text level="appropriations-major" style="appropriations">Architect of the Capitol</header-in-text></quote> in any
			 fiscal year are available to construct, operate, and maintain on a reimbursable
			 basis battery recharging stations in parking areas under the jurisdiction of
			 the Senate on Capitol Grounds for use by privately owned vehicles used by
			 Senators or covered employees.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id41CED4C5E1E34CA09E71E2F73D1A193B"><enum>(2)</enum><header display-inline="yes-display-inline">Vendors authorized</header><text display-inline="yes-display-inline">In carrying out paragraph (1), the
			 Architect of the Capitol may use 1 or more vendors on a commission
			 basis.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6E2E44820C014EE4B40C568CAEDBFCB2"><enum>(3)</enum><header display-inline="yes-display-inline">Approval of construction</header><text display-inline="yes-display-inline">The Architect of the Capitol may construct
			 or direct the construction of battery recharging stations described under
			 paragraph (1) after—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="idE20E51E4A78B4F4292F3E9DD26D9D85A"><enum>(A)</enum><text display-inline="yes-display-inline">submission of written notice detailing the
			 numbers and locations of the battery recharging stations to the Committee on
			 Rules and Administration of the Senate; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7A19BFF67462424B9C81388B348250E0"><enum>(B)</enum><text display-inline="yes-display-inline">approval by that Committee.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idC01D8C26764D4BB7BB5A3751E5EC915E"><enum>(c)</enum><header display-inline="yes-display-inline">Fees and charges</header>
				<paragraph commented="no" display-inline="no-display-inline" id="IDd637ffc4cf1745d98e293b7b1c2eb374"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subject to paragraph (2), the Architect of
			 the Capitol shall charge fees or charges for electricity provided to Senators
			 and covered employees sufficient to cover the costs to the Architect of the
			 Capitol to carry out this section, including costs to any vendors or other
			 costs associated with maintaining the battery recharging stations.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idD2D4DC98E42C44CAAC23BBC63458F25B"><enum>(2)</enum><header display-inline="yes-display-inline">Approval of fees or charges</header><text display-inline="yes-display-inline">The Architect of the Capitol may establish
			 and adjust fees or charges under paragraph (1) after—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="idF284EBD34F484492B93F260FA73B9B30"><enum>(A)</enum><text display-inline="yes-display-inline">submission of written notice detailing the
			 amount of the fee or charge to be established or adjusted to the Committee on
			 Rules and Administration of the Senate; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8BE25D06019041E6B2C7DA400A6AFB4B"><enum>(B)</enum><text display-inline="yes-display-inline">approval by that Committee.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idDD5CC1B3BCC64098B21B6DDF43F414D9"><enum>(d)</enum><header display-inline="yes-display-inline">Deposit and availability of fees, charges,
			 and commissions</header><text display-inline="yes-display-inline">Any fees,
			 charges, or commissions collected by the Architect of the Capitol under this
			 section shall be—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="id5083C19670784772994B5AC73CC9E1D5"><enum>(1)</enum><text display-inline="yes-display-inline">deposited in the Treasury to the credit of
			 the appropriations account described under subsection (b); and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idAD8CFAE042054C169B16AC748E614900"><enum>(2)</enum><text display-inline="yes-display-inline">available for obligation without further
			 appropriation during—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="id9D9B5FE031004C35B6E4F657FC043CE3"><enum>(A)</enum><text display-inline="yes-display-inline">the fiscal year collected; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8EFAECDDE02743CDA500B75E432219FA"><enum>(B)</enum><text display-inline="yes-display-inline">the fiscal year following the fiscal year
			 collected.</text>
					</subparagraph></paragraph></subsection><subsection id="idD988E454EEF244FCA2BD39EF984B0E80"><enum>(e)</enum><header>Reports</header>
				<paragraph id="idB2F57D4A0A4E4E96804B226E4D44287B"><enum>(1)</enum><header>In
			 general</header><text>Not later than 30 days after the end of each fiscal year,
			 the Architect of the Capitol shall submit a report on the financial
			 administration and cost recovery of activities under this section with respect
			 to that fiscal year to the Committee on Rules and Administration of the
			 Senate.</text>
				</paragraph><paragraph id="id26056D4797D14620B89A21DC7FEC507D"><enum>(2)</enum><header>Avoiding
			 subsidy</header>
					<subparagraph id="idE0A824C3E108428284C2DF8B910EDD78"><enum>(A)</enum><header>Determination</header><text>Not
			 later than 3 years after the date of enactment of this Act and every 3 years
			 thereafter, the Architect of the Capitol shall submit a report to the Committee
			 on Rules and Administration of the Senate determining whether Senators and
			 covered employees using battery charging stations as authorized by this Act are
			 receiving a subsidy from the taxpayers.</text>
					</subparagraph><subparagraph id="idCC2086D15B29404AB5394C571829C022"><enum>(B)</enum><header>Modification of
			 rates and fees</header><text>If a determination is made under subparagraph (A)
			 that a subsidy is being received, the Architect of the Capital shall submit a
			 plan to the Committee on Rules and Administration of the Senate on how to
			 update the program to ensure no subsidy is being received. If the committee
			 does not act on the plan within 60 days, the Architect of the Capitol shall
			 take appropriate steps to increase rates or fees to ensure reimbursement for
			 the cost of the program consistent with an appropriate schedule for
			 amortization, to be charged to those using the charging stations.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id8CB17DF0D64849DF91524B7A9B56D7C1"><enum>(f)</enum><header display-inline="yes-display-inline">Effective
			 date</header><text display-inline="yes-display-inline">This Act shall apply
			 with respect to fiscal year 2011 and each fiscal year thereafter.</text>
