		  Financial Protection with a 5-person Commission, to bring the Bureau into the
		  regular appropriations process, and for other purposes.</official-title>

		<section id="H39CF9F6FB9914FD79F62A87AEEF32074" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Responsible Consumer Financial
			 Protection Regulations Act of 2011</short-title></quote>.</text>
		</section><section id="HD401FBC13737417CABB9605FACB8AF4F"><enum>2.</enum><header>Establishment of
			 the Commission</header><text display-inline="no-display-inline">Section 1011 of
			 the Consumer Financial Protection Act of 2010 (12 U.S.C. 5491) is
			 amended—</text>
			<paragraph id="H5EF3EECACB8A477FB045275FDDBA2E4A"><enum>(1)</enum><text>by striking
			 subsections (b), (c), and (d);</text>
			</paragraph><paragraph id="H8C9760D235554EADB8C9FB3E8D8C139D"><enum>(2)</enum><text>by redesignating
			 subsection (e) as subsection (j); and</text>
			</paragraph><paragraph id="H116F34D5B777478BA6AF542F05AE3DE5"><enum>(3)</enum><text>by inserting after
			 subsection (a) the following new subsections:</text>
				<quoted-block display-inline="no-display-inline" id="H229E49ACAA3940D5A21DBB2BB8F28274" style="OLC">
					<subsection id="HCF4E6AED150848BB8CE1A2603824DDF5"><enum>(b)</enum><header>Establishment of
				the Commission</header>
						<paragraph id="H3A1F8E4F42914DFE9009D71F3249400D"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">There is hereby
				established a commission (hereafter in this title referred to as the
				<quote>Commission</quote>) that shall serve as the head of the Bureau.</text>
						</paragraph><paragraph id="HBD22E2DA1DD14FD58D79E3E9C9132C85"><enum>(2)</enum><header>Authority to
				prescribe regulations</header><text>The Commission may prescribe such
				regulations and issue such orders in accordance with this title as the
				Commission may determine to be necessary for carrying out this title and all
				other laws within the jurisdiction of the Commission, and shall exercise any
				authorities granted under this title and all other laws within the jurisdiction
				of the Commission.</text>
						</paragraph></subsection><subsection id="H5D6AD538B00244889E039A2BC4A15053"><enum>(c)</enum><header>Composition of
				the Commission</header>
						<paragraph id="H6AB9FEC1C63C499F81AABF63954E0B83"><enum>(1)</enum><header>In
				general</header><text>The Commission shall be composed of 5 members, who shall
				be appointed by the President, by and with the advice and consent of the
				Senate, from among individuals who—</text>
							<subparagraph id="H71747F228D2E4EDB9960F129168D6E58"><enum>(A)</enum><text>are citizens of
				the United States; and</text>
							</subparagraph><subparagraph id="H63141D2CEE82465E92C6A99E0465E929"><enum>(B)</enum><text>have strong
				competencies and experiences related to consumer financial protection.</text>
							</subparagraph></paragraph><paragraph id="HC3DAAE326CE34B73BEA5F22D6FBCD38D"><enum>(2)</enum><header>Staggering</header><text>The
				members of the Commission shall serve staggered terms, which initially shall be
				established by the President for terms of 1, 2, 4, and 5 years,
				respectively.</text>
						</paragraph><paragraph id="HEBD45BD2526C422EA889F8850A0122C0"><enum>(3)</enum><header>Terms</header>
							<subparagraph id="H26AF37E6EA8045FBAA207F98DD8B207D"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">Each member of the
				Commission, including the Chair, shall serve for a term of 5 years.</text>
							</subparagraph><subparagraph id="HEF5BFB7212D647A1898B65817CF6C7F6"><enum>(B)</enum><header>Removal for
				cause</header><text>The President may remove any member of the Commission only
				for inefficiency, neglect of duty, or malfeasance in office.</text>
							</subparagraph><subparagraph id="H212C4920E7834A04BF76DD40A2FDB5A7"><enum>(C)</enum><header>Vacancies</header><text>Any
				member of the Commission appointed to fill a vacancy occurring before the
				expiration of the term to which the predecessor of that member was appointed
				(including the Chair) shall be appointed only for the remainder of the
				term.</text>
							</subparagraph><subparagraph id="H2975AC92D8D04698AE424791FD3FEC0F"><enum>(D)</enum><header>Continuation of
				service</header><text>Each member of the Commission may continue to serve after
				the expiration of the term of office to which that member was appointed until a
				successor has been appointed by the President and confirmed by the Senate,
				except that a member may not continue to serve more than 1 year after the date
				on which the term of that member would otherwise expire.</text>
							</subparagraph><subparagraph id="H892102673AE94CC6BC29BA4C63DDD077"><enum>(E)</enum><header>Other employment
				prohibited</header><text>No member of the Commission shall engage in any other
				business, vocation, or employment during the term of service of that member on
				the Commission.</text>
							</subparagraph></paragraph></subsection><subsection display-inline="no-display-inline" id="H93559F50434B4938830EE4654F8CBE57"><enum>(d)</enum><header>Affiliation</header><text>With
				respect to members appointed pursuant to subsection (c), not more than 3 shall
				be members of any one political party.</text>
					</subsection><subsection id="HCA810D6773244E47AF49A04A5C8E8E91"><enum>(e)</enum><header>Chair of the
				Commission</header>
						<paragraph id="HFD6824EA3A424761ACBE42B32CCB37D4"><enum>(1)</enum><header>Appointment</header><text display-inline="yes-display-inline">The Chair of the Commission shall be
				appointed by the President from among the members of the Commission.</text>
						</paragraph><paragraph id="H5416D3FE98C243159C8407ADCCEF285B"><enum>(2)</enum><header>Authority</header><text display-inline="yes-display-inline">The Chair shall be the principal executive
				officer of the Bureau, and shall exercise all of the executive and
				administrative functions of the Bureau, including with respect to—</text>
							<subparagraph id="H081430DABBE749FAA36F464CF4B90C74"><enum>(A)</enum><text display-inline="yes-display-inline">the appointment and supervision of
				personnel employed under the Bureau (other than personnel employed regularly
				and full time in the immediate offices of members of the Commission other than
				the Chair);</text>
							</subparagraph><subparagraph id="HB01CD39EB092467C972E6AD0819541D1"><enum>(B)</enum><text display-inline="yes-display-inline">the distribution of business among
				personnel appointed and supervised by the Chair and among administrative units
				of the Bureau; and</text>
							</subparagraph><subparagraph id="HB4D0FC60262040C48EAA0FC7E5393F46"><enum>(C)</enum><text>the use and
				expenditure of funds.</text>
							</subparagraph></paragraph><paragraph id="HF0AA0FBEF9074B029F0CB5892F668EE6"><enum>(3)</enum><header>Limitation</header><text>In
				carrying out any of the functions of the Chair under this subsection, the Chair
				shall be governed by general policies of the Commission and by such regulatory
				decisions, findings, and determinations as the Commission may by law be
				authorized to make.</text>
						</paragraph><paragraph id="HA53147EE11FC4FFCBB04F6F4BF5A8A94"><enum>(4)</enum><header>Requests or
				estimates related to appropriations</header><text>Requests or estimates for
				regular, supplemental, or deficiency appropriations on behalf of the Commission
				may not be submitted by the Chair without the prior approval of the
				Commission.</text>
						</paragraph></subsection><subsection display-inline="no-display-inline" id="H89D6E51DCC7848709C0058F7296059A1"><enum>(f)</enum><header>No impairment by
				reason of vacancies</header><text display-inline="yes-display-inline">No
				vacancy in the membership of the Commission shall impair the right of the
				remaining members of the Commission to exercise all the powers of the
				Commission. Three members of the Commission shall constitute a quorum for the
				transaction of business, except that if there are only 3 members serving on the
				Commission because of vacancies in the membership of the Commission, 2 members
				of the Commission shall constitute a quorum for the transaction of business. If
				there are only 2 members serving on the Commission because of vacancies in the
				membership of the Commission, 2 members shall constitute a quorum for the
				6-month period beginning on the date of the vacancy which caused the number of
				Commission members to decline to 2.</text>
					</subsection><subsection id="H3D9A92D8BB50414590492E116ACE65A9"><enum>(g)</enum><header>Seal</header><text>The
				Commission shall have an official seal.</text>
					</subsection><subsection id="H8E4D47786D004695BCF6590DD1ACB81D"><enum>(h)</enum><header>Compensation</header>
						<paragraph id="H81A06ECDBD404DD1812E7ACD4B969EFD"><enum>(1)</enum><header>Chair</header><text>The
				Chair shall receive compensation at the rate prescribed for level I of the
				Executive Schedule under section 5313 of title 5, United States Code.</text>
						</paragraph><paragraph id="H5ED891489D394E32868B301816CD6CD6"><enum>(2)</enum><header>Other members of
				the Commission</header><text>The 4 members of the Commission other than the
				Chair shall each receive compensation at the rate prescribed for level II of
				the Executive Schedule under section 5314 of title 5, United States
				Code.</text>
						</paragraph></subsection><subsection id="HD403A24830E44E9FA32A198EC6860815"><enum>(i)</enum><header>Initial quorum
				established</header><text>During any time period prior to the date of
				confirmation of at least 2 members of the Commission, one member of the
				Commission shall constitute a quorum for the transaction of business. Following
				the confirmation of at least 2 additional commissioners, the quorum
				requirements of subsection (f) shall
				apply.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="H266A0E3D2A2E4364B7FFFB15D49CD204"><enum>3.</enum><header>Bringing the
			 Bureau into the regular appropriations process</header><text display-inline="no-display-inline">Section 1017 of the Consumer Financial
			 Protection Act of 2010 (12 U.S.C. 5497) is amended—</text>
			<paragraph id="H8C47649DA33C46F583618A9820EDCF22"><enum>(1)</enum><text>in subsection
			 (a)—</text>
				<subparagraph id="H2DB9BA04E041422BBCD61EBA75BCFFF1"><enum>(A)</enum><text>by amending the
			 heading of such subsection to read as follows: <quote><header-in-text level="subsection" style="OLC">Budget, financial management, and
			 audit.—</header-in-text></quote>;</text>
				</subparagraph><subparagraph id="HA2F3245F09044BC4B26F7D3E5FC4F731"><enum>(B)</enum><text>by striking
			 paragraphs (1), (2), and (3);</text>
				</subparagraph><subparagraph id="H14F8D2951578497F9B2A9568EFCDF53E"><enum>(C)</enum><text>by redesignating
			 paragraphs (4) and (5) as paragraphs (1) and (2), respectively; and</text>
				</subparagraph><subparagraph id="HAF2E8C0A3FB8491FA9DC448A624E8B46"><enum>(D)</enum><text>by striking
			 subparagraphs (E) and (F) of paragraph (1), as so redesignated;</text>
				</subparagraph></paragraph><paragraph id="H3A0C076EBA7742BA979EFD9993F2BC0B"><enum>(2)</enum><text>by striking
			 subsections (b), (c), and (d);</text>
			</paragraph><paragraph id="H46A9267A4A1C45918D5BAE028763EF18"><enum>(3)</enum><text>by redesignating
			 subsection (e) as subsection (b); and</text>
			</paragraph><paragraph id="H4917FFE133C84DDAA15BD9D522A2E41A"><enum>(4)</enum><text>in subsection (b),
			 as so redesignated—</text>

			 paragraphs (1), (2), and (3) and inserting the following:</text>

				2012.</text>
							</subparagraph></paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H00B00BFAD57C4A5FAD89BD65BC7C0694"><enum>(B)</enum><text>by redesignating
			 paragraph (4) as paragraph (2).</text>

			 amendments</header>

			 general</header><text>Except as provided under paragraph (1), the Consumer
			 Financial Protection Act of 2010 (12 U.S.C. 5481 et seq.) is amended—</text>

			 Dodd-Frank Wall Street Reform and Consumer Protection Act, is amended—</text>
				<paragraph id="H533E47E2ACC84DC2936A811AFF2F21CB"><enum>(1)</enum><text>by striking
			 <quote>The Director of the Bureau of Consumer Financial Protection (hereafter
			 in this section referred to as the <quote>Director</quote>)</quote> and
			 inserting <quote>The Bureau of Consumer Financial Protection</quote>;
			 and</text>
				</paragraph><paragraph id="H745A398337E34A22B96C72A2B511862C"><enum>(2)</enum><text>by striking
			 <quote>Director</quote> each place such term appears and inserting
			 <quote>Bureau</quote>.</text>
				</paragraph></subsection><subsection id="H92EFC2E5556B4FB3A1D0EF99330F7700"><enum>(k)</enum><header>S.A.F.E.
			 Mortgage Licensing Act of 2008</header><text display-inline="yes-display-inline">The S.A.F.E. Mortgage Licensing Act of 2008
			 (12 U.S.C. 5101), as amended by section 1100 of the Consumer Financial
			 Protection Act of 2010, is amended—</text>
				<paragraph id="HA0C9A6DE7498431395E970DF0577E377"><enum>(1)</enum><text>by striking
			 <quote>Director</quote> each place such term appears, other than where such
			 term is used in the context of the Director of the Office of Thrift
			 Supervision, and inserting <quote>Bureau</quote>; and</text>
				</paragraph><paragraph id="H9B6B90FE41C24BA0AECE2DEFF15AEFEC"><enum>(2)</enum><text>in section 1503,
			 by striking paragraph (10).</text>
				</paragraph></subsection><subsection id="H147154A51B384EAFBBD39BF363C4E8E0"><enum>(l)</enum><header>Title 44, United
			 States Code</header><text display-inline="yes-display-inline">Section 3513(c)
			 of title 44, United States Code, as amended by section 1100D(b) of the Consumer
			 Financial Protection Act of 2010, is amended by striking <quote>Director of the
			 Bureau</quote> and inserting <quote>Bureau</quote>.</text>
