		<official-title display="yes">To amend the Solid Waste Disposal Act to
		  direct the Administrator of the Environmental Protection Agency to establish a
		  hazardous waste electronic manifest system.</official-title>

		<section commented="no" display-inline="no-display-inline" id="HD055364ACFCF4FB390ACBD63F9DDEC00" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Hazardous Waste Electronic Manifest
			 Establishment Act</short-title></quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="H9DF6F567CC504372874B37500EBE265D" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Hazardous waste electronic manifest
			 system</header>
			<subsection commented="no" display-inline="no-display-inline" id="H9A96B8DB0CD04824B5A406D6F904F46F"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subtitle C of the Solid Waste Disposal Act
			 (42 U.S.C. 6921 et seq.) is amended by adding at the end the following:</text>

					<section commented="no" display-inline="no-display-inline" id="HE2D108657A4E4147A9988945ABC4E3D0" section-type="subsequent-section"><enum>3024.</enum><header display-inline="yes-display-inline">Hazardous waste electronic manifest
				system</header>
						<subsection commented="no" display-inline="no-display-inline" id="H4E01C99BC81042BBB15F0B31C539E8E9"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section:</text>
							<paragraph commented="no" display-inline="no-display-inline" id="H2A1A165029C249D4AFB779DBB3139529"><enum>(1)</enum><header display-inline="yes-display-inline">Board</header><text display-inline="yes-display-inline">The term <term>Board</term> means the
				Hazardous Waste Electronic Manifest System Advisory Board established under
				subsection (f).</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HCEDA0DE04E80412E92C18BA8879F0CCF"><enum>(2)</enum><header display-inline="yes-display-inline">Fund</header><text display-inline="yes-display-inline">The term <term>Fund</term> means the
				Hazardous Waste Electronic Manifest System Fund established by subsection
				(d).</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H91FA394BF6CE464FB011D775BA8C35B4"><enum>(3)</enum><header display-inline="yes-display-inline">Person</header><text display-inline="yes-display-inline">The term <term>person</term> includes an
				individual, corporation (including a Government corporation), company,
				association, firm, partnership, society, joint stock company, trust,
				municipality, commission, Federal agency, State, political subdivision of a
				State, or interstate body.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD579A01DA4A7454BBD674F7B602B1357"><enum>(4)</enum><header display-inline="yes-display-inline">System</header><text display-inline="yes-display-inline">The term <term>system</term> means the
				hazardous waste electronic manifest system established under subsection
				(b).</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HFC5144E043D74CA4A0057DC67DE5CDA8"><enum>(5)</enum><header display-inline="yes-display-inline">User</header><text display-inline="yes-display-inline">The term <term>user</term> means a
				hazardous waste generator, a hazardous waste transporter, an owner or operator
				of a hazardous waste treatment, storage, recycling, or disposal facility, or
				any other person that—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="H388FC314751E457EB8EFCDA3D94D99C0"><enum>(A)</enum><text display-inline="yes-display-inline">is required to use a manifest to comply
				with any Federal or State requirement to track the shipment, transportation,
				and receipt of hazardous waste or other material that is shipped from the site
				of generation to an off-site facility for treatment, storage, disposal, or
				recycling; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HE892CDA9E0E04B39ABDE277FCFF1D914"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="H039CCF386CEC4D2CBF52DB7BE8C5EFA6"><enum>(i)</enum><text display-inline="yes-display-inline">elects to use the system to complete and
				transmit an electronic manifest format; or</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="HE39CEDA30D504E988DDB21D2E4428DF5" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">submits to the system for data processing
				purposes a paper copy of the manifest (or data from such a paper copy), in
				accordance with such regulations as the Administrator may promulgate to require
				such a submission.</text>
									</clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HF98AA3F71ABD4185A5C85BC09676646F"><enum>(b)</enum><header display-inline="yes-display-inline">Establishment</header><text display-inline="yes-display-inline">Not later than 3 years after the date of
				enactment of this section, the Administrator shall establish a hazardous waste
				electronic manifest system that may be used by any user.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="H34380DCBB2E44A398B9CFEFA6A5C25DB"><enum>(c)</enum><header display-inline="yes-display-inline">User fees</header>
							<paragraph commented="no" display-inline="no-display-inline" id="H697302921EB44E238C50F6A3B2FC791C"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">In accordance with paragraph (4), the
				Administrator may impose on users such reasonable service fees as the
				Administrator determines to be necessary to pay costs incurred in developing,
				operating, maintaining, and upgrading the system, including any costs incurred
				in collecting and processing data from any paper manifest submitted to the
				system after the date on which the system enters operation.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HB3FA8FB4815B4D5FBCF3BF1F24FE986A"><enum>(2)</enum><header display-inline="yes-display-inline">Collection of fees</header><text display-inline="yes-display-inline">The Administrator shall—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="H50B59259891240779C3547043756A907"><enum>(A)</enum><text display-inline="yes-display-inline">collect the fees described in paragraph (1)
				from the users in advance of, or as reimbursement for, the provision by the
				Administrator of system-related services; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H410BC4061CA24AEC99CDC55265471866"><enum>(B)</enum><text display-inline="yes-display-inline">deposit the fees in the Fund.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H5F921E9507874C3ABE065A4A9FCCD344"><enum>(3)</enum><header display-inline="yes-display-inline">Fee structure</header>
								<subparagraph commented="no" display-inline="no-display-inline" id="H76CE2E84C8E74507A0819B49E865914E"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Administrator, in consultation with
				information technology vendors, shall determine through the contract award
				process described in subsection (e) the fee structure that is necessary to
				recover the full cost to the Administrator of providing system-related
				services, including—</text>
									<clause commented="no" display-inline="no-display-inline" id="HDE19E6C2C1514558876A2210D21768BB"><enum>(i)</enum><text display-inline="yes-display-inline">contractor costs relating to—</text>
										<subclause commented="no" display-inline="no-display-inline" id="H91D0E2E038804CAAABA25DB90F490B0C"><enum>(I)</enum><text display-inline="yes-display-inline">materials and supplies;</text>
										</subclause><subclause commented="no" display-inline="no-display-inline" id="H9FED8DF757CD40DD9DF2790F6550DD03"><enum>(II)</enum><text display-inline="yes-display-inline">contracting and consulting;</text>
										</subclause><subclause commented="no" display-inline="no-display-inline" id="HACC79EB4DA6C4F2AA2FB57B09E448DFE"><enum>(III)</enum><text display-inline="yes-display-inline">overhead;</text>
										</subclause><subclause commented="no" display-inline="no-display-inline" id="HF7DD99A279274C32967E2BF8AD9082D0"><enum>(IV)</enum><text display-inline="yes-display-inline">information technology (including costs of
				hardware, software, and related services);</text>
										</subclause><subclause commented="no" display-inline="no-display-inline" id="H240FFA0587FE416BA05DB3CF08AF340B"><enum>(V)</enum><text display-inline="yes-display-inline">information management;</text>
										</subclause><subclause commented="no" display-inline="no-display-inline" id="HCFF5D7BAB35C4CF2A29FE85823C0F528"><enum>(VI)</enum><text display-inline="yes-display-inline">collection of service fees;</text>
										</subclause><subclause commented="no" display-inline="no-display-inline" id="H247B5F290E0047E49FD6EA4286CE39ED"><enum>(VII)</enum><text display-inline="yes-display-inline">reporting and accounting; and</text>
										</subclause><subclause commented="no" display-inline="no-display-inline" id="HEA4EE219D317439784CE5C2CDC4EBBA4"><enum>(VIII)</enum><text display-inline="yes-display-inline">project management; and</text>
										</subclause></clause><clause commented="no" display-inline="no-display-inline" id="HC41C368DC4934BD4920335DB69F0A174"><enum>(ii)</enum><text display-inline="yes-display-inline">costs of employment of direct and indirect
				Government personnel dedicated to establishing, managing, and maintaining the
				system.</text>
									</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H264CEFEFE3B846A984A0E0BA2D09D4C5"><enum>(B)</enum><header display-inline="yes-display-inline">Adjustments in fee amount</header>
									<clause commented="no" display-inline="no-display-inline" id="H582771B27CBC408F8DE1283723B5D829"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Administrator, in consultation with the
				Board, shall increase or decrease the amount of a service fee determined under
				the fee structure described in subparagraph (A) to a level that will—</text>
										<subclause commented="no" display-inline="no-display-inline" id="H5A9E0FF1E582418994E59F3FC0655010"><enum>(I)</enum><text display-inline="yes-display-inline">result in the collection of an aggregate
				amount for deposit in the Fund that is sufficient and not more than reasonably
				necessary to cover current and projected system-related costs (including any
				necessary system upgrades); and</text>
										</subclause><subclause commented="no" display-inline="no-display-inline" id="H02F34CA9EEAC4381A376DA1BF89A0D52"><enum>(II)</enum><text display-inline="yes-display-inline">minimize, to the maximum extent
				practicable, the accumulation of unused amounts in the Fund.</text>
										</subclause></clause><clause commented="no" display-inline="no-display-inline" id="H50109FD763544A6EAD5A7BAC58DEA72C"><enum>(ii)</enum><header display-inline="yes-display-inline">Exception for initial period of
				operation</header><text display-inline="yes-display-inline">The requirement
				described in clause (i)(II) shall not apply to any additional fees that
				accumulate in the Fund, in an amount that does not exceed $2,000,000, during
				the 3-year period beginning on the date on which the system enters
				operation.</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="H4B2A8EC094634BD2953FFC26894D3E0E"><enum>(iii)</enum><header display-inline="yes-display-inline">Timing of adjustments</header><text display-inline="yes-display-inline">Adjustments to service fees described in
				clause (i) shall be made—</text>
										<subclause commented="no" display-inline="no-display-inline" id="H91ECEEB5D4CF4552B27D8A6E3586E4ED"><enum>(I)</enum><text display-inline="yes-display-inline">initially, at the time at which initial
				development costs of the system have been recovered by the Administrator such
				that the service fee may be reduced to reflect the elimination of the system
				development component of the fee; and</text>
										</subclause><subclause commented="no" display-inline="no-display-inline" id="H4E0DED52AB3743D3B1BA4BB436259C9D"><enum>(II)</enum><text display-inline="yes-display-inline">periodically thereafter, upon receipt and
				acceptance of the findings of any annual accounting or auditing report under
				subsection (d)(3), if the report discloses a significant disparity for a fiscal
				year between the funds collected from service fees under this subsection for
				the fiscal year and expenditures made for the fiscal year to provide
				system-related services.</text>
										</subclause></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HDD3C62ED918841618EF740ED57B9D13A"><enum>(4)</enum><header display-inline="yes-display-inline">Crediting and availability of
				fees</header><text display-inline="yes-display-inline">Fees authorized under
				this section shall be collected and available for obligation only to the extent
				and in the amount provided in advance in appropriations Acts.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H12075C83E8BD4B47825FDBB549336463"><enum>(d)</enum><header display-inline="yes-display-inline">Hazardous Waste Electronic Manifest System
				Fund</header>
							<paragraph commented="no" display-inline="no-display-inline" id="H6913B6E401434CA78B4CB556079669EA"><enum>(1)</enum><header display-inline="yes-display-inline">Establishment</header><text display-inline="yes-display-inline">There is established in the Treasury of the
				United States a revolving fund, to be known as the <quote>Hazardous Waste
				Electronic Manifest System Fund</quote>, consisting of such amounts as are
				deposited in the Fund under subsection (c)(2)(B).</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC811028B64F6468C8B435634044557B4"><enum>(2)</enum><header display-inline="yes-display-inline">Expenditures from Fund</header>
								<subparagraph commented="no" display-inline="no-display-inline" id="H399A73DC001F40D68924F78187624E8B"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Only to the extent provided in advance in
				appropriations Acts, on request by the Administrator, the Secretary of the
				Treasury shall transfer from the Fund to the Administrator amounts appropriated
				to pay costs incurred in developing, operating, maintaining, and upgrading the
				system under subsection (c).</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H6BB8532CE50D4518BD5B69748ADBE92A"><enum>(B)</enum><header display-inline="yes-display-inline">Use of funds by Administrator</header><text display-inline="yes-display-inline">Fees collected by the Administrator and
				deposited in the Fund under this section shall be available to the
				Administrator subject to appropriations Acts for use in accordance with this
				section without fiscal year limitation.</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H5A7B9BDC154B4CDAA54950241C87A184"><enum>(C)</enum><header display-inline="yes-display-inline">Oversight of Funds</header><text display-inline="yes-display-inline">The Administrator shall carry out all
				necessary measures to ensure that amounts in the Fund are used only to carry
				out the goals of establishing, operating, maintaining, upgrading, managing,
				supporting, and overseeing the system.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HEEE71C1FACBE439EA004383F509ADA53"><enum>(3)</enum><header display-inline="yes-display-inline">Accounting and auditing</header>
								<subparagraph commented="no" display-inline="no-display-inline" id="H4541D0822539443AA48C9F3E3358F9A4"><enum>(A)</enum><header display-inline="yes-display-inline">Accounting</header><text display-inline="yes-display-inline">For each 2-fiscal-year period, the
				Administrator shall prepare and submit to the Committee on Environment and
				Public Works and the Committee on Appropriations of the Senate and the
				Committee on Energy and Commerce and the Committee on Appropriations of the
				House of Representatives a report that includes—</text>
									<clause commented="no" display-inline="no-display-inline" id="HE814380CCB9F49A4AC015436A3D18C00"><enum>(i)</enum><text display-inline="yes-display-inline">an accounting of the fees paid to the
				Administrator under subsection (c) and disbursed from the Fund for the period
				covered by the report, as reflected by financial statements provided in
				accordance with—</text>
										<subclause commented="no" display-inline="no-display-inline" id="H17AA53569952402A93D81F667BA7DB20"><enum>(I)</enum><text display-inline="yes-display-inline">the Chief Financial Officers Act of 1990
				(Public Law 101–576; 104 Stat. 2838) and amendments made by that Act;
				and</text>
										</subclause><subclause commented="no" display-inline="no-display-inline" id="HB00A9C092A0C4A3DA93F65DEC319DF7D"><enum>(II)</enum><text display-inline="yes-display-inline">the Government Management Reform Act of
				1994 (Public Law 103–356; 108 Stat. 3410) and amendments made by that Act;
				and</text>
										</subclause></clause><clause commented="no" display-inline="no-display-inline" id="H4CA2205EF28B43AC98D6B9D9A0AAF8B4"><enum>(ii)</enum><text display-inline="yes-display-inline">an accounting describing actual
				expenditures from the Fund for the period covered by the report for costs
				described in subsection (c)(1).</text>
									</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H31C66F7975CE409FBF9CC2487855B5A0"><enum>(B)</enum><header display-inline="yes-display-inline">Auditing</header>
									<clause commented="no" display-inline="no-display-inline" id="H9C3C132A6CFE41F88AD500120ABE1ECB"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">For the purpose of section 3515(c) of title
				31, United States Code, the Fund shall be considered a component of an
				Executive agency.</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="H9524FF9DB8CB4497A940046D773B2ABA"><enum>(ii)</enum><header display-inline="yes-display-inline">Components of audit</header><text display-inline="yes-display-inline">The annual audit required in accordance
				with sections 3515(b) and 3521 of title 31, United States Code, of the
				financial statements of activities carried out using amounts from the Fund
				shall include an analysis of—</text>
										<subclause commented="no" display-inline="no-display-inline" id="HBBBC16EA79FA4C968D776C45EB7B59A4"><enum>(I)</enum><text display-inline="yes-display-inline">the fees collected and disbursed under this
				section;</text>
										</subclause><subclause commented="no" display-inline="no-display-inline" id="H48FD4D5EDA7C4CCDA0ECEA230820568C"><enum>(II)</enum><text display-inline="yes-display-inline">the reasonableness of the fee structure in
				place as of the date of the audit to meet current and projected costs of the
				system;</text>
										</subclause><subclause commented="no" display-inline="no-display-inline" id="HAC1100E2F1E14E8A963F59983B69B8AB"><enum>(III)</enum><text display-inline="yes-display-inline">the level of use of the system by users;
				and</text>
										</subclause><subclause commented="no" display-inline="no-display-inline" id="HF8C007FD6946460085C23A7E1F136584"><enum>(IV)</enum><text display-inline="yes-display-inline">the success to date of the system in
				operating on a self-sustaining basis and improving the efficiency of tracking
				waste shipments and transmitting waste shipment data.</text>
										</subclause></clause><clause commented="no" display-inline="no-display-inline" id="H2DF5A78F81E94F7FA0953D517FF68F6D"><enum>(iii)</enum><header display-inline="yes-display-inline">Federal responsibility</header><text display-inline="yes-display-inline">The Inspector General of the Environmental
				Protection Agency shall—</text>
										<subclause commented="no" display-inline="no-display-inline" id="HB93BE4FBFB694BEDA5D65BFD9D9ED5D0"><enum>(I)</enum><text display-inline="yes-display-inline">conduct the annual audit described in
				clause (ii); and</text>
										</subclause><subclause commented="no" display-inline="no-display-inline" id="H3CB53F65AC3E47359F7BCDE7DEB4F3B8"><enum>(II)</enum><text display-inline="yes-display-inline">submit to the Administrator a report that
				describes the findings and recommendations of the Inspector General resulting
				from the audit.</text>
										</subclause></clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HF255D859E8214CCAA17F46A7BBB73D27"><enum>(e)</enum><header display-inline="yes-display-inline">Contracts</header>
							<paragraph commented="no" display-inline="no-display-inline" id="H17C6144E00AB49DCBD09F5FB0989935D"><enum>(1)</enum><header display-inline="yes-display-inline">Authority to Enter Into Contracts Funded by
				Service Fees</header><text display-inline="yes-display-inline">After
				consultation with the Secretary of Transportation, the Administrator may enter
				into 1 or more information technology contracts with entities determined to be
				appropriate by the Administrator (referred to in this subsection as
				<term>contractors</term>) for the provision of system-related services.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC86525BAA4E54AE3B763856FB1AC5C7A"><enum>(2)</enum><header display-inline="yes-display-inline">Term of contract</header><text display-inline="yes-display-inline">A contract awarded under this subsection
				shall have a term of not more than 10 years.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H6E43F0B6770C41FBB11A241C89811891"><enum>(3)</enum><header display-inline="yes-display-inline">Achievement of goals</header><text display-inline="yes-display-inline">The Administrator shall ensure, to the
				maximum extent practicable, that a contract awarded under this
				subsection—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="H579B5EC805944D6DB3C03765EDDEB1FF"><enum>(A)</enum><text display-inline="yes-display-inline">is performance-based;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HDB504E3BDBD94FF4866CD70D85FBCA1A"><enum>(B)</enum><text display-inline="yes-display-inline">identifies objective outcomes; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HAB37F5FD89944BF8A1DB1689A3022717"><enum>(C)</enum><text display-inline="yes-display-inline">contains performance standards that may be
				used to measure achievement and goals to evaluate the success of a contractor
				in performing under the contract and the right of the contractor to payment for
				services under the contract, taking into consideration that a primary measure
				of successful performance shall be the development of a hazardous waste
				electronic manifest system that—</text>
									<clause commented="no" display-inline="no-display-inline" id="H5340C1EB833D4CD38299D3A57A9314A9"><enum>(i)</enum><text display-inline="yes-display-inline">meets the needs of the user community
				(including States that rely on data contained in manifests);</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="H3BED06BB196B46BAA12B7F81B0BB4745"><enum>(ii)</enum><text display-inline="yes-display-inline">attracts sufficient user participation and
				service fee revenues to ensure the viability of the system;</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="H0FD991101C404B349E0069510E9CA23C"><enum>(iii)</enum><text display-inline="yes-display-inline">decreases the administrative burden on the
				user community; and</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="HE3109D8F747A4D9FAE56FA12193B8478"><enum>(iv)</enum><text display-inline="yes-display-inline">provides the waste receipt data applicable
				to the biennial reports required by section 3002(a)(6).</text>
									</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H73BEC55C961C452D99056B7E970AD006"><enum>(4)</enum><header display-inline="yes-display-inline">Payment structure</header><text display-inline="yes-display-inline">Each contract awarded under this subsection
				shall include a provision that specifies—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="H4C1A368D6A874888A524724586C48C3A"><enum>(A)</enum><text display-inline="yes-display-inline">the service fee structure of the contractor
				that will form the basis for payments to the contractor; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HB792623FEDB046C9BC43F2D0A3A61A62"><enum>(B)</enum><text display-inline="yes-display-inline">the fixed-share ratio of monthly service
				fee revenues from which the Administrator shall reimburse the contractor for
				system-related development, operation, and maintenance costs.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H3571ED9C7CF3418CA4240A455B34E5EB"><enum>(5)</enum><header display-inline="yes-display-inline">Cancellation and termination</header>
								<subparagraph commented="no" display-inline="no-display-inline" id="H75489E171F554A4C98082EEC8E1D0BCE"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">If the Administrator determines that
				sufficient funds are not made available for the continuation in a subsequent
				fiscal year of a contract entered into under this subsection, the Administrator
				may cancel or terminate the contract.</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H5147105110414656BC19C150A9F76A12"><enum>(B)</enum><header display-inline="yes-display-inline">Negotiation of amounts</header><text display-inline="yes-display-inline">The amount payable in the event of
				cancellation or termination of a contract entered into under this subsection
				shall be negotiated with the contractor at the time at which the contract is
				awarded.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H87CDA6CC598142CC961D5499F758D650"><enum>(6)</enum><header display-inline="yes-display-inline">No effect on ownership</header><text display-inline="yes-display-inline">Regardless of whether the Administrator
				enters into a contract under this subsection, the system shall be owned by the
				Federal Government.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H4C0026E260A6443DA3122792BF39FD18"><enum>(f)</enum><header display-inline="yes-display-inline">Hazardous Waste Electronic Manifest System
				Advisory Board</header>
							<paragraph commented="no" display-inline="no-display-inline" id="HF0A9E084CACC4D47A6025AE4F3BEA0F0"><enum>(1)</enum><header display-inline="yes-display-inline">Establishment</header><text display-inline="yes-display-inline">Not later than 3 years after the date of
				enactment of this section, the Administrator shall establish a board to be
				known as the <quote>Hazardous Waste Electronic Manifest System Advisory
				Board</quote>.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H70BB895C7CE04CA4A30A75BD489A62C9"><enum>(2)</enum><header display-inline="yes-display-inline">Composition</header><text display-inline="yes-display-inline">The Board shall be composed of 9 members,
				of which—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="HDFF5CC5576EA4E8D8400DCE7A45BA98D"><enum>(A)</enum><text display-inline="yes-display-inline">1 member shall be the Administrator (or a
				designee), who shall serve as Chairperson of the Board; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H6A3752B0EEE747F68C588B3A9A38B71B"><enum>(B)</enum><text display-inline="yes-display-inline">8 members shall be individuals appointed by
				the Administrator—</text>
									<clause commented="no" display-inline="no-display-inline" id="HFA650F48680246FF8DB3FCA0DB6B8255"><enum>(i)</enum><text display-inline="yes-display-inline">at least 2 of whom shall have expertise in
				information technology;</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="H1B724623E8A046438009C46B9174F5AA"><enum>(ii)</enum><text display-inline="yes-display-inline">at least 3 of whom shall have experience in
				using or represent users of the manifest system to track the transportation of
				hazardous waste under this subtitle (or an equivalent State program);
				and</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="HA4673632918947DC98405458880718F0"><enum>(iii)</enum><text display-inline="yes-display-inline">at least 3 of whom shall be a State
				representative responsible for processing those manifests.</text>
									</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HA671C9227E9240FEB421D37083F0A139"><enum>(3)</enum><header display-inline="yes-display-inline">Duties</header><text display-inline="yes-display-inline">The Board shall meet annually to discuss,
				evaluate the effectiveness of, and provide recommendations to the Administrator
				relating to, the system.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H3C592CEF856348629BF00759AE12C175"><enum>(g)</enum><header display-inline="yes-display-inline">Regulations</header>
							<paragraph commented="no" display-inline="no-display-inline" id="HCC3CC123C4FC4765B0C919353241AEF1"><enum>(1)</enum><header display-inline="yes-display-inline">Promulgation</header>
								<subparagraph commented="no" display-inline="no-display-inline" id="H0A44819C47AC4100939BEF7166456482"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of
				enactment of this section, after consultation with the Secretary of
				Transportation, the Administrator shall promulgate regulations to carry out
				this section.</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H39A7332DF08A463C824186DF7912AA4A"><enum>(B)</enum><header display-inline="yes-display-inline">Inclusions</header><text display-inline="yes-display-inline">The regulations promulgated pursuant to
				subparagraph (A) may include such requirements as the Administrator determines
				to be necessary to facilitate the transition from the use of paper manifests to
				the use of electronic manifests, or to accommodate the processing of data from
				paper manifests in the electronic manifest system, including a requirement that
				users of paper manifests submit to the system copies of the paper manifests for
				data processing purposes.</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HA7AF422149AA4D479BF111486B6A14A2"><enum>(C)</enum><header display-inline="yes-display-inline">Requirements</header><text display-inline="yes-display-inline">The regulations promulgated pursuant to
				subparagraph (A) shall ensure that each electronic manifest provides, to the
				same extent as paper manifests under applicable Federal and State law,
				for—</text>
									<clause commented="no" display-inline="no-display-inline" id="H79013C401BBE44FD88815CE9C5460A28"><enum>(i)</enum><text display-inline="yes-display-inline">the ability to track and maintain legal
				accountability of—</text>
										<subclause commented="no" display-inline="no-display-inline" id="HAFC861F3470A48699E714886E7BE0890"><enum>(I)</enum><text display-inline="yes-display-inline">the person that certifies that the
				information provided in the manifest is accurately described; and</text>
										</subclause><subclause commented="no" display-inline="no-display-inline" id="HE31DB1348BAC4EB9AAB053533F4F966E"><enum>(II)</enum><text display-inline="yes-display-inline">the person that acknowledges receipt of the
				manifest;</text>
										</subclause></clause><clause commented="no" display-inline="no-display-inline" id="HA3E4207EE2D64B53BF4F96626122EDDB"><enum>(ii)</enum><text display-inline="yes-display-inline">if the manifest is electronically
				submitted, State authority to access paper printout copies of the manifest from
				the system; and</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="HF083DA5EF1324238A3228A3DA4DB88DB"><enum>(iii)</enum><text display-inline="yes-display-inline">access to all publicly available
				information contained in the manifest.</text>
									</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H26BC9A88C19049F8A5FAE15231EA1EC2"><enum>(2)</enum><header display-inline="yes-display-inline">Effective date of regulations</header><text display-inline="yes-display-inline">Any regulation promulgated by the
				Administrator under paragraph (1) and in accordance with section 3003 relating
				to electronic manifesting of hazardous waste shall take effect in each State as
				of the effective date specified in the regulation.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H263E8651F07E443D8204EDC9FCA26835"><enum>(3)</enum><header display-inline="yes-display-inline">Administration</header><text display-inline="yes-display-inline">The Administrator shall carry out
				regulations promulgated under this subsection in each State unless the State
				program is fully authorized to carry out such regulations in lieu of the
				Administrator.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H5CF1260B9F9E4696BFD5DB740228D27D"><enum>(h)</enum><header display-inline="yes-display-inline">Requirement of compliance with respect to
				certain States</header><text display-inline="yes-display-inline">In any case in
				which the State in which waste is generated, or the State in which waste will
				be transported to a designated facility, requires that the waste be tracked
				through a hazardous waste manifest, the designated facility that receives the
				waste shall, regardless of the State in which the facility is located—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="H6C4F606FFD0547619861459A6194FA94"><enum>(1)</enum><text display-inline="yes-display-inline">complete the facility portion of the
				applicable manifest;</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H5C3AB8BC5B664377A46A8CA1F3151900"><enum>(2)</enum><text display-inline="yes-display-inline">sign and date the facility certification;
				and</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H8C9373C13DAF4BF6AEFD5FECAB4ABC5A"><enum>(3)</enum><text display-inline="yes-display-inline">submit to the system a final copy of the
				manifest for data processing purposes.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HB895D070A359487CAA2A48FB6025286D"><enum>(i)</enum><header display-inline="yes-display-inline">Authorization for start-up
				activities</header><text display-inline="yes-display-inline">There are
				authorized to be appropriated $2,000,000 for each of fiscal years 2013 through
				2015 for start-up activities to carry out this section, to be offset by
				collection of user fees under subsection (c) such that all such appropriated
				funds are offset by fees as provided in subsection
				(c).</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="H7BAA84110DC148EABF745F2E326A0096"><enum>(b)</enum><header display-inline="yes-display-inline">Conforming amendment</header><text display-inline="yes-display-inline">The table of contents of the Solid Waste
			 Disposal Act (42 U.S.C. 6901) is amended by inserting at the end of the items
			 relating to subtitle C the following:</text>
