		<official-title>To amend the Animal Welfare Act to provide further
		  protection for puppies.</official-title>

		<section id="HAD791AD252FF468AA1B700189BFE85CC" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Puppy Uniform Protection and Safety
			 Act</short-title></quote>.</text>
		</section><section id="H7251223E7330427B9307001727E9A54"><enum>2.</enum><header>Protection of
			 puppies under the Animal Welfare Act</header>
			<subsection id="HB9FFD26636424D87BFCC2D09488EC035"><enum>(a)</enum><header>High volume
			 retail breeder defined</header><text>Section 2 of the Animal Welfare Act (7
			 U.S.C. 2132) is amended—</text>
				<paragraph id="HEA5716E49E7E4691857809D91360EC89"><enum>(1)</enum><text>in subsection (l),
			 by striking <quote>research.</quote> and inserting
			 <quote>research;</quote>;</text>
				</paragraph><paragraph id="H1E0036D35E8649478DBD96F37373C653"><enum>(2)</enum><text>in subsection (m),
			 by striking <quote>members.</quote> and inserting
			 <quote>members;</quote>;</text>
				</paragraph><paragraph id="H93F33CEB3DAC48BBA8147EF6FAF6E69"><enum>(3)</enum><text>in
			 subsection (n), by striking <quote>section 13(b); and</quote> and inserting
			 <quote>section 13(b);</quote>;</text>
				</paragraph><paragraph id="HF5FD4072044C48FBB7226888BFBD3E66"><enum>(4)</enum><text>in subsection (o),
			 by striking <quote>experimentation.</quote> and inserting
			 <quote>experimentation; and</quote>; and</text>
				</paragraph><paragraph id="H22A6505FC55B490F90DAE708657086B3"><enum>(5)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block id="H18B0B27D652D4C47936C466842D2F01C" style="OLC">
						<subsection id="HF64B06C943444028A1DE355CB201F01B"><enum>(p)</enum><header>High Volume
				Retail Breeder</header>
							<paragraph id="id07A7745610024B00BBEAF8DE5D584522"><enum>(1)</enum><header>Definitions</header><text>In
				this subsection:</text>
								<subparagraph id="idC1F949BA0DBC4CCF9EF388915B3C6FF7"><enum>(A)</enum><header>Breeding female
				dog</header><text>The term <term>breeding female dog</term> means an intact
				female dog aged 4 months or older.</text>
								</subparagraph><subparagraph id="idA8378365334249A98F48D3BBF2B02291"><enum>(B)</enum><header>High volume
				retail breeder</header><text display-inline="yes-display-inline">The term
				<term>high volume retail breeder</term> means a person who, in commerce, for
				compensation or profit—</text>
									<clause id="idF4ED0278C1BE457EAF314740E22E4096"><enum>(i)</enum><text display-inline="yes-display-inline">has an ownership interest in or custody of
				1 or more breeding female dogs; and</text>
									</clause><clause id="idAA5EA3E058D04EEBA375F4B973445966"><enum>(ii)</enum><text>sells or offers
				for sale, via any means of conveyance (including the Internet, telephone, or
				newspaper), more than 50 of the offspring of such breeding female dogs for use
				as pets in any 1-year period.</text>
									</clause></subparagraph></paragraph><paragraph id="idA334AC2DEF7A4570AA789F5303BED2DA"><enum>(2)</enum><header>Relationship to
				dealers</header>
								<subparagraph id="id9690CBB954744993BF75504C139CFA99"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">For purposes of this
				Act, a high volume retail breeder shall be considered to be a dealer and
				subject to all provisions of this Act applicable to a dealer.</text>
								</subparagraph><subparagraph id="idC59E187648E64ADF81464E875915310D"><enum>(B)</enum><header>Exception</header><text display-inline="yes-display-inline">The retail pet store exemption in
				subsection (f)(i) shall not apply to a high volume retail
				breeder.</text>
								</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="idE45671548CE84CBF8A0A1B7EC17904AA"><enum>(b)</enum><header>Licenses</header><text>Section
			 3 of the Animal Welfare Act (7 U.S.C. 2133) is amended—</text>
				<paragraph id="id375C59230ECA4E01B4CA0BE3251D5561"><enum>(1)</enum><text>by striking
			 <quote>The Secretary</quote> and inserting <quote>(a)
			 <header-in-text level="subsection" style="OLC">In general</header-in-text>.—The
			 Secretary</quote>;</text>
				</paragraph><paragraph id="id5DF4FCFB103549F88400DBEF7825E64C"><enum>(2)</enum><text>in subsection (a)
			 (as so designated), in the second proviso of the first sentence, by inserting
			 <quote>(other than a high volume retail breeder)</quote> after <quote>any
			 retail pet store or other person</quote>; and</text>
				</paragraph><paragraph id="id515C2E65D9B240419C543C0545178EEE"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="id7EA62608B7C8411B946C67A88298BE42" style="OLC">
						<subsection id="id9DE49F7E13F8471D803EC85F83AF466F"><enum>(b)</enum><header>Dealers</header><text>A
				dealer (including a high volume retail breeder) applying for a license under
				subsection (a) (including annual renewals) shall include on the license
				application the total number of dogs exempted from exercise on the premises of
				the dealer in the preceding year by a licensed veterinarian under section
				13(j)(2).</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="ID7713049ce7324a72b015658bbdc01a92"><enum>(c)</enum><header>Exercise
			 requirements</header><text>Section 13 of the Animal Welfare Act (7 U.S.C. 2143)
			 is amended—</text>
				<paragraph id="ID4ba374ecb5aa4134b97ad65c2499f212"><enum>(1)</enum><text>by redesignating
			 subsections (g) and (h) as subsections (h) and (i), respectively;</text>
				</paragraph><paragraph id="IDf0e85c67b8244c49aa8c923ee8b91612"><enum>(2)</enum><text>by redesignating
			 the second subsection (f) (as redesignated by section 1752(a)(1) of Public Law
			 99–198 (99 Stat. 1645)) as subsection (g); and</text>
				</paragraph><paragraph id="IDb9b68a15480c404cb283bee99cf4cbb1"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="id583FA63C68D64D9EAF66A1EFD76C7FAD" style="OLC">
						<subsection id="IDbbc4b91d54da4ed48e461ecf91bfa685"><enum>(j)</enum><header>Exercise
				requirements</header>
							<paragraph id="idB2AC47DC05704C4CAF877DE6CDF3FACF"><enum>(1)</enum><header>In
				general</header><text>Not later than 1 year after the date of enactment of this
				subsection, the Secretary shall promulgate standards covering dealers that
				include requirements for the exercise of dogs at facilities owned or operated
				by a dealer, including exercise regulations that ensure that—</text>
								<subparagraph id="ID20e63a3756484a05953ded7fd995692f"><enum>(A)</enum><text>each dog that is
				at least 12 weeks old (other than a female dog with unweaned puppies) has daily
				access to exercise that—</text>
									<clause id="id348EAF462E6046FAB1E696E34588F815"><enum>(i)</enum><text>allows the
				dog—</text>
										<subclause id="id2520AA4888A7409BA20E025F8F70BBF0"><enum>(I)</enum><text>to move
				sufficiently to develop or maintain normal muscle tone and mass as appropriate
				for the age, breed, sex, and reproductive status of the dog; and</text>
										</subclause><subclause id="idA061B346AB814F18AC4F25B0F95D0401"><enum>(II)</enum><text>the ability to
				achieve a running stride; and</text>
										</subclause></clause><clause id="id5570F1BC74B1448598E7AC82E0F794A5"><enum>(ii)</enum><text>is not a forced
				activity (other than a forced activity used for veterinary treatment) or other
				physical activity that is repetitive, restrictive of other activities,
				solitary, and goal-oriented;</text>
									</clause></subparagraph><subparagraph id="idA6D4BAC2E260483CAAC73601D8D266D5"><enum>(B)</enum><text>the provided area
				for exercise—</text>
									<clause id="id623A021C233E47A882C11669CA2E010F"><enum>(i)</enum><text>is separate from
				the primary enclosure if the primary enclosure does not provide sufficient
				space to achieve a running stride;</text>
									</clause><clause id="id27E37894CC784BFA9BADFDFD758FDDFC"><enum>(ii)</enum><text>has flooring
				that—</text>
										<subclause id="idDBBA562E036D47F2999BB58AC245ECD2"><enum>(I)</enum><text>is sufficient to
				allow for the type of activity described in subparagraph (A); and</text>
										</subclause><subclause id="id1D324748C79146C6A7FF927E8C2DB079"><enum>(II)</enum><item commented="no" display-inline="yes-display-inline" id="id35FB22E1B2E540D68649F0C360745159"><enum>(aa)</enum><text>is solid flooring;
				or</text>
											</item><item id="id49E39A9ACEB8470FAAFD0E7231438C15" indent="up1"><enum>(bb)</enum><text>is nonsolid, nonwire flooring, if the
				nonsolid, nonwire flooring—</text>
												<subitem id="id5A36E0423B8A4AB6AFF5E9261B4F5CF5"><enum>(AA)</enum><text>is safe for the breed, size, and age of
				the dog;</text>
												</subitem><subitem id="id3EAA3A4B2405426FAFFD2AC5CAFF4DFB"><enum>(BB)</enum><text>is free from protruding sharp edges;
				and</text>
												</subitem><subitem id="idDD1AE0F274C248B5B1702C94DE0E73F1"><enum>(CC)</enum><text>is designed so that the paw of the dog is
				unable to extend through or become caught in the flooring;</text>
												</subitem></item></subclause></clause><clause id="idA884BA8CFD684119B0EA0EFB8A20062A"><enum>(iii)</enum><text>is cleaned at
				least once each day;</text>
									</clause><clause id="idEF23A33FF5C447D8B2F3DE59C4D8CBB3"><enum>(iv)</enum><text>is free of
				infestation by pests or vermin; and</text>
									</clause><clause id="idF79C8DB5C8464009AD0AA8D55508B275"><enum>(v)</enum><text>is designed in a
				manner to prevent escape of the dogs.</text>
									</clause></subparagraph></paragraph><paragraph id="ID47a96dd366464d3ba3d522f76a6f2be2"><enum>(2)</enum><header>Exemption</header>
								<subparagraph id="id99ED013EE593493D9FB963B39355F660"><enum>(A)</enum><header>In
				general</header><text>If a licensed veterinarian determines that a dog should
				not exercise because of the health, condition, or well-being of the dog, this
				subsection shall not apply to that dog.</text>
								</subparagraph><subparagraph id="id3A0E2C05DE7E482EB2C1732887F43A6E"><enum>(B)</enum><header>Documentation</header><text>A
				determination described in subparagraph (A) shall be—</text>
									<clause id="id11E7A8FF02F1409A9E8824B9AA02D8A7"><enum>(i)</enum><text>documented by the
				veterinarian;</text>
									</clause><clause id="idC0A591317252498DA15700BADDF295D8"><enum>(ii)</enum><text>subject to
				review and approval by the Secretary; and</text>
									</clause><clause id="id154158631BA3437BB8EB89674AC2B550"><enum>(iii)</enum><text>unless the
				basis for the determination is a permanent condition, reviewed and updated at
				least once every 30 days by the veterinarian.</text>
									</clause></subparagraph><subparagraph id="idE377E5B74B1F4B56BD9D01DB960CC96C"><enum>(C)</enum><header>Reports</header><text>A
				determination described in subparagraph (A) shall be maintained by the
				dealer.</text>
								</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection></section><section id="H0CF2165FDE0C4749B5838F9C37BB6991"><enum>3.</enum><header>Regulations</header><text display-inline="no-display-inline">Not later than 1 year after the date of
			 enactment of this Act, the Secretary of Agriculture shall promulgate any
			 regulations that the Secretary determines to be necessary to implement this Act
			 and the amendments made by this Act.</text>
		</section><section id="H3D2C75728C1A423B8FFF34BEB2AE99EC"><enum>4.</enum><header>Effect on State
			 law</header><text display-inline="no-display-inline">Nothing in this Act or the
			 amendments made by this Act preempt any law (including a regulation) of a
			 State, or a political subdivision of a State, containing requirements that
			 provide equivalent or greater protection for animals than the requirements of
			 this Act or the amendments made by this Act.</text>
