			 Agriculture for Administration</header><text>Section 218(b) of the Department
			 of Agriculture Reorganization Act of 1994 (7 U.S.C. 6918(b)) is amended—</text>
					<subparagraph id="id3F731D0C8D9842D6A453F48D157F1B79"><enum>(A)</enum><text>by striking
			 <quote>subsection (a)</quote> and inserting <quote>subsection

			 Secretary for Communications and Information</header><text>Section 103(a)(2) of
			 the National Telecommunications and Information Administration Organization Act
			 (47 U.S.C. 902(a)(2)) is amended by striking <quote>, by and with the advice

			 L. Boren National Security Education Act of 1991 (50 U.S.C. 1903(b)(7)) is
			 amended by striking <quote>by and with the advice and consent of the
			 Senate,</quote>.</text>
				</paragraph></subsection><subsection id="id4C865CC4E72F4DCA8E949D67A09589B8"><enum>(d)</enum><header>Department of
			 Education</header>
				<paragraph id="ID94467113F6154DD1B3D0432DCBA2B080"><enum>(1)</enum><header>Assistant
			 Secretary for Legislation and Congressional Affairs and Assistant Secretary for
			 Management</header><text>Section 202(e) of the Department of Education
			 Organization Act (20 U.S.C. 3412(e)) is amended by inserting after the first
			 sentence the following: <quote>Notwithstanding the previous sentence, the
			 appointments of individuals to serve as the Assistant Secretary for Legislation
			 and Congressional Affairs and the Assistant Secretary for Management shall not
			 be subject to the advice and consent of the Senate.</quote>.</text>
				</paragraph><paragraph id="idD6220E3F68244636882C24CAF3E31300"><enum>(2)</enum><header>Commissioner,
			 Rehabilitation Services Administration</header><text>Section 3(a) of the
			 Rehabilitation Act of 1973 (29 U.S.C. 702(a)) is amended by striking <quote>by
			 and with the advice and consent of the Senate</quote>.</text>
				</paragraph><paragraph id="idA58EC040997C4DE99CE3FA024E5FA430"><enum>(3)</enum><header>Commissioner,
			 Education Statistics</header><text>Section 117(b) of the Education Sciences
			 Reform Act of 2002 (20 U.S.C. 9517(b)) is amended by striking <quote>, by and
			 with the advice and consent of the Senate,</quote>.</text>
				</paragraph></subsection><subsection id="ID0A28C1F8BE3F4040A73ABA57963AFD7C"><enum>(e)</enum><header>Department of
			 Energy</header><text>Section 203(a) of the Department of Energy Organization
			 Act (42 U.S.C. 7133(a)) is amended in the first sentence by striking
			 <quote>Senate;</quote> and inserting <quote>Senate (except that the Assistant
			 Secretary for Congressional and Intergovernmental Affairs of the Department may
			 be appointed by the President without the advice and consent of the
			 Senate);</quote>.</text>
			</subsection><subsection id="id0A525138035C474FAB9C24960B9AEAB2"><enum>(f)</enum><header>Department of
			 Health and Human Services</header>
				<paragraph id="id66682B719ADC48F2A89EB39500049B06"><enum>(1)</enum><header>Assistant
			 Secretary for Public Affairs</header><text>Notwithstanding any other provision
			 of law, the appointment of an individual to serve as the Assistant Secretary
			 for Public Affairs within the Department of Health and Human Services shall not
			 be subject to the advice and consent of the Senate.</text>
				</paragraph><paragraph id="id20885E673E4F47C9BE65717DB6FAC103"><enum>(2)</enum><header>Assistant
			 Secretary for Legislation</header><text>Notwithstanding any other provision of
			 law, the appointment of an individual to serve as the Assistant Secretary for
			 Legislation within the Department of Health and Human Services shall not be
			 subject to the advice and consent of the Senate.</text>

			 is established the Working Group on Streamlining Paperwork for Executive
			 Nominations (in this section referred to as the <quote>Working
			 Group</quote>).</text>
			</subsection><subsection id="ID72664CA8B4684A54AD73C527866BF3AF"><enum>(b)</enum><header>Membership</header>
				<paragraph id="ID33D32B163B914F78AF90CAE0814B6274"><enum>(1)</enum><header>Composition</header><text>The
			 Working Group shall be composed of—</text>
					<subparagraph id="ID101C97BCE3AA4A09849F8C95FBC05967"><enum>(A)</enum><text>the chairperson
			 who shall be—</text>
						<clause id="id21EC03C60A6F46C18D0B67C3943A06BE"><enum>(i)</enum><text>except as provided
			 under clause (ii), the Director of the Office of Presidential Personnel;
			 or</text>
						</clause><clause id="idF6D69F4DC149410BAB429632B4ED3E1B"><enum>(ii)</enum><text>a Federal officer
			 designated by the President;</text>
						</clause></subparagraph><subparagraph id="IDB980C667FD924A9083D5C6E05A00CD0A"><enum>(B)</enum><text>representatives

			 paperwork required for executive nominations</header>
				<paragraph id="id7DEC7508BD6D402D8DB18649AA6ED314"><enum>(1)</enum><header>In
			 general</header><text>Not later than 90 days after the date of enactment of
			 this Act, the Working Group shall conduct a study and submit a report on the
			 streamlining of paperwork required for executive nominations to—</text>
					<subparagraph id="idDC57429FC34041D6A5E3D130034C0C97"><enum>(A)</enum><text>the
			 President;</text>
					</subparagraph><subparagraph id="id4A780617911C4DE0B8229B4219CFF2EC"><enum>(B)</enum><text>the Committee on
			 Homeland Security and Governmental Affairs of the Senate; and</text>
					</subparagraph><subparagraph id="idABED8C71FE3F496493D5FB4D945A79B1"><enum>(C)</enum><text>the Committee on
			 Rules and Administration of the Senate.</text>
					</subparagraph></paragraph><paragraph id="ID3466c26687894b988e15f9774e6d6bf5"><enum>(2)</enum><header>Consultation
			 with Committees of the Senate</header><text>In conducting the study under this
			 section, the Working Group shall consult with the chairperson and ranking
			 member of the committees referred to under paragraph (1) (B) and (C).</text>
				</paragraph><paragraph id="idC708DEF3274341FAA249BDCD88091EB9"><enum>(3)</enum><header>Contents</header>
					<subparagraph id="idC5C2181FC2AC421FB2DA4DA3ABD598DD"><enum>(A)</enum><header>In
			 general</header><text>The report submitted under this section shall
			 include—</text>
						<clause id="id37DB4415D57A4EC3AF97BA2B062DF6FB"><enum>(i)</enum><text>recommendations
			 for the streamlining of paperwork required for executive nominations;
			 and</text>
						</clause><clause id="idD22501CE1B9A451DB2A61746937D0A6B"><enum>(ii)</enum><text>a detailed plan
			 for the creation and implementation of an electronic system for collecting and
			 distributing background information from potential and actual Presidential
			 nominees for positions which require appointment by and with the advice and
			 consent of the Senate.</text>
						</clause></subparagraph><subparagraph id="id0C3A0CB7961D4A1DBE5988B1E6160C50"><enum>(B)</enum><header>Electronic
			 system</header><text>The electronic system described under subparagraph (A)(ii)
			 shall—</text>
						<clause id="id90CA9ECC750B4554849336A00E22E04E"><enum>(i)</enum><text>provide
			 for—</text>
							<subclause id="id970C8C1CFFBF4A4EAB11C92DCD5B2A29"><enum>(I)</enum><text>less burden on
			 potential nominees for positions which require appointment by and with the
			 advice and consent of the Senate;</text>
							</subclause><subclause id="id97C904EEBBC9454C8BE3F0D2E878BAD1"><enum>(II)</enum><text>faster delivery
			 of background information to Congress, the White House, the Federal Bureau of
			 Investigation, Diplomatic Security, and the Office of Government Ethics;
			 and</text>
							</subclause><subclause id="idE6820FB8C5C149AEBDC87E448E036BF4"><enum>(III)</enum><text>fewer errors of
			 omission; and</text>
							</subclause></clause><clause id="idD46EDFFBB56940418CB1A05DBD588FE6"><enum>(ii)</enum><text>ensure the
			 existence and operation of a single, searchable form which shall be known as a
			 <quote>Smart Form</quote> and shall—</text>
							<subclause id="ID0bcf0b03f551482da8f9688ca2cd8423"><enum>(I)</enum><text>be free to a
			 nominee and easy to use;</text>
							</subclause><subclause id="ID045609e54b1f45c38cd65ac8bfba428a"><enum>(II)</enum><text>make it possible
			 for the nominee to answer all vetting questions one way, at a single
			 time;</text>
							</subclause><subclause id="IDe201763a05344be88543e76681ee0716"><enum>(III)</enum><text>secure the
			 information provided by a nominee;</text>
							</subclause><subclause id="ID48159508217a450fa111132fa72fa401"><enum>(IV)</enum><text>allow for
			 multiple submissions over time, but always in the format requested by the
			 vetting agency or entity;</text>
							</subclause><subclause id="ID89906efaea194551960ceb7b38584a1f"><enum>(V)</enum><text>be compatible
			 across different computer platforms;</text>
							</subclause><subclause id="ID161846e9b1834743ad7bbcb4cba50998"><enum>(VI)</enum><text>make it possible
			 to easily add, modify, or subtract vetting questions;</text>
							</subclause><subclause id="ID1e81309c0e7e4444a4fd44490966ed00"><enum>(VII)</enum><text>allow error
			 checking; and</text>
							</subclause><subclause id="IDe9e3cd05262049b9993bd9b0817fe6a7"><enum>(VIII)</enum><text>allow the user
			 to track the progress of a nominee in providing the required
			 information.</text>
							</subclause></clause></subparagraph></paragraph></subsection><subsection id="ID9ccca6f71dbe4d95865f9f287e2bccb5"><enum>(d)</enum><header>Review of
			 background investigation requirements</header>
				<paragraph id="ID9d8fc35847534d78aa9704f72511c4be"><enum>(1)</enum><header>In
			 general</header><text>The Working Group shall conduct a review of the impact of
			 background investigation requirements on the appointments process.</text>
				</paragraph><paragraph id="id405042E9FAF8401C9D8751B4816A81EA"><enum>(2)</enum><header>Conduct of
			 review</header><text>In conducting the review, the Working Group shall—</text>
					<subparagraph id="ID59e3d6d130f240548765a1888cb3def6"><enum>(A)</enum><text>assess the
			 feasibility of using personnel other than Federal Bureau of Investigation
			 personnel, in appropriate circumstances, to conduct background investigations
			 of individuals under consideration for positions appointed by the President, by
			 and with the advice and consent of the Senate; and</text>
					</subparagraph><subparagraph id="IDad6969f6505f4a1ea08952fa9addbab3"><enum>(B)</enum><text>consider the
			 extent to which the scope of the background investigation conducted for an
			 individual under consideration for a position appointed by the President, by
			 and with the advice and consent of the Senate, should be varied depending on
			 the nature of the position for which the individual is being considered.</text>
					</subparagraph></paragraph><paragraph id="IDc1f667d5ca6e4860a8b8f813ed59515a"><enum>(3)</enum><header>Report</header><text>Not
			 later than 270 days after the date of enactment of this Act, the Working Group
			 shall submit a report of the findings of the review under this subsection
			 to—</text>
					<subparagraph id="ID6d91282d57da4290ac7897c1e7fc11d5"><enum>(A)</enum><text>the
			 President;</text>
					</subparagraph><subparagraph id="IDdfd116e25e3345d88015b6c8d15b3f32"><enum>(B)</enum><text>the Committee on
			 Homeland Security and Governmental Affairs of the Senate; and</text>
					</subparagraph><subparagraph id="IDda6900086ebe44cfbf310ef59330c90c"><enum>(C)</enum><text>the Committee on
			 Rules and Administration of the Senate.</text>
					</subparagraph></paragraph></subsection><subsection id="id7250D313AFD74A42992A4DB52E0D8E20"><enum>(e)</enum><header>Personnel
			 matters</header>
				<paragraph id="IDCA2295CEA479416BA3A8D2E7CC117416"><enum>(1)</enum><header>Compensation of
			 members</header>
					<subparagraph id="id696E1366575149A9B7A4210E05FFC365"><enum>(A)</enum><header>Federal officers
			 and employees</header><text>Each member of the Working Group who is a Federal
			 officer or employee shall serve without compensation in addition to that
			 received for their services as a Federal officer or employee.</text>
					</subparagraph><subparagraph id="id971B5457A4BD4502959945B059DECEAD"><enum>(B)</enum><header>Members not
			 Federal officers and employees</header><text>Each member of the Working Group
			 who is not a Federal officer or employee shall not be compensated for services
			 performed for the Working Group.</text>
					</subparagraph></paragraph><paragraph id="IDE3A4396C8D04410B9AE66A178AF6D924"><enum>(2)</enum><header>Travel
			 expenses</header><text>The members of the Working Group shall be allowed travel
			 expenses, including per diem in lieu of subsistence, at rates authorized for
			 employees of agencies under subchapter I of chapter 57 of title 5, United
			 States Code, while away from their homes or regular places of business in the
			 performance of services for the Working Group.</text>
				</paragraph><paragraph id="IDB00DA1156EDA4BBF89990CAA9FC0A03B"><enum>(3)</enum><header>Staff</header>
					<subparagraph id="id1316CA8B0487419182D7126C684A2E0D"><enum>(A)</enum><header>In
			 general</header><text>The President may designate Federal officers and
			 employees to provide support services for the Working Group.</text>
					</subparagraph><subparagraph id="ID7F7DD010BD8E4726B1D5367A4FE1E1D4"><enum>(B)</enum><header>Detail of
			 Federal employees</header><text>Any Federal employee may be detailed to the
			 Working Group without reimbursement, and such detail shall be without
			 interruption or loss of civil service status or privilege.</text>
					</subparagraph></paragraph></subsection><subsection id="ID89ffce1b49cb40909f0919361f747f55"><enum>(f)</enum><header>Non-Applicability
			 of Federal Advisory Committee Act</header><text>The Federal Advisory Committee
			 Act (5 U.S.C. App.) shall not apply to the Working Group established under this
			 section.</text>
			</subsection><subsection id="IDAF25BE3C96E54611B2CB62BDEEE9F2CF"><enum>(g)</enum><header>Termination of
			 the Working Group</header><text display-inline="yes-display-inline">The Working
			 Group shall terminate 60 days after the date on which the Working Group submits
			 the latter of the 2 reports under this section.</text>
			</subsection></section><section changed="deleted" committee-id="SSGA00" id="id997ECFA70E6D4F6290CE3369135F8F88" reported-display-style="strikethrough"><enum>4.</enum><header>Effective
			 date</header><text display-inline="no-display-inline">The amendments made by
			 this Act shall take effect 60 days after the date of enactment of this Act and
			 apply to appointments made on and after that effective date, including any
			 nomination pending in the Senate on that date.</text>

				developments, to appraise programs and activities of the Government in the
				light of the policy declared in section 2, and to formulate and recommend
				national economic policy to promote full employment, production, and purchasing
				power under free competitive enterprise.</text>

				the Census, appointed by the President, by and with the advice and consent of

				individuals who have a demonstrated ability in managing large organizations and
				experience in the collection, analysis, and use of statistical data.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id34F3366D385044FBA8E6714B7A8BC4DF"><enum>(b)</enum><header display-inline="yes-display-inline">Term of office</header>
							<paragraph commented="no" display-inline="no-display-inline" id="id2CEB9D036B1D4D1DAFC4C8F2998439D7"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The term of office of the Director shall be
				5 years, and shall begin on January 1, 2012, and every fifth year thereafter.
				An individual may not serve more than 2 full terms as Director.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id65F9A50933B74E8E8C086F5023F701EF"><enum>(2)</enum><header display-inline="yes-display-inline">Vacancies</header><text display-inline="yes-display-inline">Any individual appointed to fill a vacancy
				in such position, occurring before the expiration of the term for which such
				individual's predecessor was appointed, shall be appointed for the remainder of
				that term. The Director may serve after the end of the Director's term until
				reappointed or until a successor has been appointed, but in no event longer
				than 1 year after the end of such term.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3A51A7CADE06405CB21EB48A59AFEB25"><enum>(3)</enum><header display-inline="yes-display-inline">Removal</header><text display-inline="yes-display-inline">An individual serving as Director may be
				removed from office by the President. The President shall communicate in
				writing the reasons for any such removal to both Houses of Congress not later
				than 60 days before the removal.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id65034E9B7B3849FA9B48A386D8DB5C4A"><enum>(c)</enum><header>Duties</header><text display-inline="yes-display-inline">The Director shall perform such duties as
				may be imposed upon the Director by law, regulations, or orders of the
				Secretary.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="id8177BC83E02144EE991BD8A865503471"><enum>(b)</enum><header display-inline="yes-display-inline">Transition rules</header>
				<paragraph commented="no" display-inline="no-display-inline" id="idE6646F8C5EA74B3BB3E942E272230015"><enum>(1)</enum><header display-inline="yes-display-inline">Appointment of initial
			 Director</header><text display-inline="yes-display-inline">The initial Director
			 of the Bureau of the Census shall be appointed in accordance with the
			 provisions of section 21(a) of title 13, United States Code, as amended by
			 subsection (a).</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id54FB2454285D4504BA7D1B447734CDCB"><enum>(2)</enum><header display-inline="yes-display-inline">Interim role of current Director of the
			 Census after date of enactment</header><text display-inline="yes-display-inline">If, as of January 1, 2012, the initial
			 Director of the Bureau of the Census has not taken office, the officer serving
			 on December 31, 2011, as Director of the Census (or Acting Director of the
			 Census, if applicable) in the Department of Commerce—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="id997162EF81C84502A433523377787E4C"><enum>(A)</enum><text display-inline="yes-display-inline">shall serve as the Director of the Bureau
			 of the Census; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idD54B370666D543C4BEAE5B1D924D5A8C"><enum>(B)</enum><text display-inline="yes-display-inline">shall assume the powers and duties of such
			 Director for one term beginning January 1, 2012, as described in section 21(b)
			 of such title, as so amended.</text>

			 January 1, 2012, the Secretary of Commerce, in consultation with the Director
			 of the Census, shall submit to each House of the Congress draft legislation
			 containing any technical and conforming amendments to title 13, United States
			 Code, and any other provisions which may be necessary to carry out the purposes
			 of this section.</text>
			</subsection></section><section changed="added" committee-id="SSGA00" id="id6df7ac02-3b28-44b9-8f43-492122527243" reported-display-style="italic"><enum>4.</enum><header>Working Group on
			 streamlining paperwork for executive nominations</header>
			<subsection id="ida906748f-1621-48b5-927c-30f829b3c6b0"><enum>(a)</enum><header>Establishment</header><text>There
			 is established the Working Group on Streamlining Paperwork for Executive
			 Nominations (in this section referred to as the <quote>Working
			 Group</quote>).</text>
			</subsection><subsection id="id5836f413-b215-4b0b-91df-f0ad9d222ad0"><enum>(b)</enum><header>Membership</header>
				<paragraph id="id30835fdf-7b82-41b7-8286-958ed939b14a"><enum>(1)</enum><header>Composition</header><text>The
			 Working Group shall be composed of—</text>
					<subparagraph id="iddf3ffdd3-f8a1-4da8-a73a-4446177e22c5"><enum>(A)</enum><text>the chairperson who shall
			 be—</text>
						<clause id="id944af167-3149-4605-a512-831ccf29c7c9"><enum>(i)</enum><text>except as provided under
			 clause (ii), the Director of the Office of Presidential Personnel; or</text>
						</clause><clause id="id83364c59-05a2-4290-867f-fc165af56170"><enum>(ii)</enum><text>a Federal officer
			 designated by the President;</text>
						</clause></subparagraph><subparagraph id="id4ecdb7d2-e7da-4718-91e3-023ca968d7f3"><enum>(B)</enum><text>representatives
			 designated by the President from—</text>
						<clause id="id2db26217-e70d-4150-af53-56fd2c810880"><enum>(i)</enum><text>the Office of Personnel
			 Management;</text>
						</clause><clause id="id717d5f24-8234-4294-8f5a-745485e5791a"><enum>(ii)</enum><text>the Office of Government
			 Ethics; and</text>
						</clause><clause id="id2e9b9143-b9ea-46aa-ba35-7de7ece94445"><enum>(iii)</enum><text>the Federal Bureau of
			 Investigation; and</text>
						</clause></subparagraph><subparagraph id="idbcedae9a-e2b8-4712-a10b-b9d1d5979615"><enum>(C)</enum><text>individuals appointed by
			 the chairperson of the Working Group who have experience and expertise relating
			 to the Working Group, including—</text>
						<clause id="ide2e3229c-0f20-4e26-92a4-78827f610158"><enum>(i)</enum><text>individuals from other
			 relevant Federal agencies; and</text>
						</clause><clause id="idc69634f3-e445-43e4-b30e-031a274667ec"><enum>(ii)</enum><text>individuals with
			 relevant experience from previous presidential administrations.</text>
						</clause></subparagraph></paragraph></subsection><subsection id="id14c80ca4-989f-4da3-ad12-11539b8df974"><enum>(c)</enum><header>Streamlining of
			 paperwork required for executive nominations</header>
				<paragraph id="id8914ec12-5fb9-4aa6-b8d7-947c3302ca0a"><enum>(1)</enum><header>In
			 general</header><text>Not later than 90 days after the date of enactment of
			 this Act, the Working Group shall conduct a study and submit a report on the
			 streamlining of paperwork required for executive nominations to—</text>
					<subparagraph id="id45c93d36-6580-45cf-acf2-31ada84f1291"><enum>(A)</enum><text>the President;</text>
					</subparagraph><subparagraph id="idc6740b6b-025c-41fb-93d4-794e605708b6"><enum>(B)</enum><text>the Committee on Homeland
			 Security and Governmental Affairs of the Senate; and</text>
					</subparagraph><subparagraph id="id094c9f34-abe4-4e36-b2d7-9913c3102d44"><enum>(C)</enum><text>the Committee on Rules
			 and Administration of the Senate.</text>
					</subparagraph></paragraph><paragraph id="id8ed547b6-dc07-4091-8cfa-3f344015afe8"><enum>(2)</enum><header>Consultation with
			 Committees of the Senate</header><text>In conducting the study under this
			 section, the Working Group shall consult with the chairperson and ranking
			 member of the committees referred to under paragraph (1) (B) and (C).</text>
				</paragraph><paragraph id="id76d061a4-82e3-4d1d-9989-788efa99ebf7"><enum>(3)</enum><header>Contents</header>
					<subparagraph id="idcc004b5f-91f3-4b24-9f06-671d9c2a929f"><enum>(A)</enum><header>In
			 general</header><text>The report submitted under this section shall
			 include—</text>
						<clause id="id89d7bc1a-a9a5-4da7-add1-7a8577f08390"><enum>(i)</enum><text>recommendations for the
			 streamlining of paperwork required for executive nominations; and</text>
						</clause><clause id="id343e3692-4278-4698-9aa1-dada5a54b25e"><enum>(ii)</enum><text>a detailed plan for the
			 creation and implementation of an electronic system for collecting and
			 distributing background information from potential and actual Presidential
			 nominees for positions which require appointment by and with the advice and
			 consent of the Senate.</text>
						</clause></subparagraph><subparagraph id="id911d7126-c2bb-4303-82ae-d40895530682"><enum>(B)</enum><header>Electronic
			 system</header><text>The electronic system described under subparagraph (A)(ii)
			 shall—</text>
						<clause id="idf653bb81-64cb-4b14-9cff-e614977ca672"><enum>(i)</enum><text>provide for—</text>
							<subclause id="idcf1c9fff-803d-436d-bb9a-e6db459b7edb"><enum>(I)</enum><text>less burden on potential
			 nominees for positions which require appointment by and with the advice and
			 consent of the Senate;</text>
							</subclause><subclause id="id05984970-9af0-454b-b2a3-1c33fb9e330a"><enum>(II)</enum><text>faster delivery of
			 background information to Congress, the White House, the Federal Bureau of
			 Investigation, Diplomatic Security, and the Office of Government Ethics;
			 and</text>
							</subclause><subclause id="id1e622fea-e8b3-4b98-999c-0202928082af"><enum>(III)</enum><text>fewer errors of
			 omission; and</text>
							</subclause></clause><clause id="id69682a9f-7fd4-46ea-80e5-2532d9d5e8e1"><enum>(ii)</enum><text>ensure the existence and
			 operation of a single, searchable form which shall be known as a <quote>Smart
			 Form</quote> and shall—</text>
							<subclause id="id704717d4-7c55-4611-a4a9-6ac9c7a40982"><enum>(I)</enum><text>be free to a nominee and
			 easy to use;</text>
							</subclause><subclause id="idc14bb776-6f2b-4fe8-a6cc-eeac752c63ed"><enum>(II)</enum><text>make it possible for the
			 nominee to answer all vetting questions one way, at a single time;</text>
							</subclause><subclause id="id020f1566-d30b-416c-83ff-ffb44dbaf48d"><enum>(III)</enum><text>secure the information
			 provided by a nominee;</text>
							</subclause><subclause id="id1be30ead-3dfc-403c-9ff1-e98e2b9c9f21"><enum>(IV)</enum><text>allow for multiple
			 submissions over time, but always in the format requested by the vetting agency
			 or entity;</text>
							</subclause><subclause id="id3bbcbddc-eee8-4443-96c0-551190dc65d4"><enum>(V)</enum><text>be compatible across
			 different computer platforms;</text>
							</subclause><subclause id="idccde2356-9e4f-4f75-922b-31e75770e8e2"><enum>(VI)</enum><text>make it possible to
			 easily add, modify, or subtract vetting questions;</text>
							</subclause><subclause id="id3d884e29-8643-49ec-a181-884d8cd690d3"><enum>(VII)</enum><text>allow error checking;
			 and</text>
							</subclause><subclause id="idd8071279-13eb-4c92-a123-435266a2f4f6"><enum>(VIII)</enum><text>allow the user to
			 track the progress of a nominee in providing the required information.</text>
							</subclause></clause></subparagraph></paragraph></subsection><subsection id="idd216a65d-c035-4495-98fc-418eccf29bb3"><enum>(d)</enum><header>Review of background
			 investigation requirements</header>
				<paragraph id="id1e1b2132-c0f7-47d4-96a5-490051f918ad"><enum>(1)</enum><header>In
			 general</header><text>The Working Group shall conduct a review of the impact of
			 background investigation requirements on the appointments process.</text>
				</paragraph><paragraph id="id6f0d1ce8-1dbe-495f-a16a-2bdc31a5f227"><enum>(2)</enum><header>Conduct of
			 review</header><text>In conducting the review, the Working Group shall—</text>
					<subparagraph id="id9b13b326-72ea-4bfe-9db7-8bad1c498cc1"><enum>(A)</enum><text>assess the feasibility of
			 using personnel other than Federal Bureau of Investigation personnel, in
			 appropriate circumstances, to conduct background investigations of individuals
			 under consideration for positions appointed by the President, by and with the
			 advice and consent of the Senate; and</text>
					</subparagraph><subparagraph id="id64b2a7d0-ee9a-49eb-a311-ce35775ba329"><enum>(B)</enum><text>consider the extent to
			 which the scope of the background investigation conducted for an individual
			 under consideration for a position appointed by the President, by and with the
			 advice and consent of the Senate, should be varied depending on the nature of
			 the position for which the individual is being considered.</text>
					</subparagraph></paragraph><paragraph id="id199a9e66-4ff9-4223-9244-2d1c5f76b21f"><enum>(3)</enum><header>Report</header><text>Not
			 later than 270 days after the date of enactment of this Act, the Working Group
			 shall submit a report of the findings of the review under this subsection
			 to—</text>
					<subparagraph id="idd45d9f92-1523-44ae-b0fc-0407a33025fe"><enum>(A)</enum><text>the President;</text>
					</subparagraph><subparagraph id="idbd0cc74a-e7c7-4c65-9b06-26f4731061ad"><enum>(B)</enum><text>the Committee on Homeland
			 Security and Governmental Affairs of the Senate; and</text>
					</subparagraph><subparagraph id="idb458ec73-dcd5-44b0-aaf3-d868c6af6f88"><enum>(C)</enum><text>the Committee on Rules
			 and Administration of the Senate.</text>
					</subparagraph></paragraph></subsection><subsection id="id2ecec2cd-7467-41af-bb3d-2c83febe4ac8"><enum>(e)</enum><header>Personnel
			 matters</header>
				<paragraph id="idc591559a-f2f6-4129-98c5-aa724e6964e1"><enum>(1)</enum><header>Compensation of
			 members</header>
					<subparagraph id="idfc1372ea-61eb-49cb-9a09-e99a568dd9ad"><enum>(A)</enum><header>Federal officers and
			 employees</header><text>Each member of the Working Group who is a Federal
			 officer or employee shall serve without compensation in addition to that
			 received for their services as a Federal officer or employee.</text>
					</subparagraph><subparagraph id="id6578a646-701f-416a-a76e-035d723c1755"><enum>(B)</enum><header>Members not Federal
			 officers and employees</header><text>Each member of the Working Group who is
			 not a Federal officer or employee shall not be compensated for services
			 performed for the Working Group.</text>
					</subparagraph></paragraph><paragraph id="id14ade38f-2b9a-412b-90d7-fd7ce95a3073"><enum>(2)</enum><header>Travel
			 expenses</header><text>The members of the Working Group shall be allowed travel
			 expenses, including per diem in lieu of subsistence, at rates authorized for
			 employees of agencies under subchapter I of chapter 57 of title 5, United
			 States Code, while away from their homes or regular places of business in the
			 performance of services for the Working Group.</text>
				</paragraph><paragraph id="id7762f1ae-266f-4a0d-9654-b86e991df998"><enum>(3)</enum><header>Staff</header>
					<subparagraph id="ida313b22e-cc23-4bcd-9785-e067512f6677"><enum>(A)</enum><header>In
			 general</header><text>The President may designate Federal officers and
			 employees to provide support services for the Working Group.</text>
					</subparagraph><subparagraph id="idcf8648de-5cb2-426a-a028-72d5b0c975df"><enum>(B)</enum><header>Detail of Federal
			 employees</header><text>Any Federal employee may be detailed to the Working
			 Group without reimbursement, and such detail shall be without interruption or
			 loss of civil service status or privilege.</text>
					</subparagraph></paragraph></subsection><subsection id="idfaa79392-ac5b-421f-bf95-43b04257e082"><enum>(f)</enum><header>Non-Applicability of
			 Federal Advisory Committee Act</header><text>The Federal Advisory Committee Act
			 (5 U.S.C. App.) shall not apply to the Working Group established under this
			 section.</text>
			</subsection><subsection id="idd714140b-7c29-438a-8f34-ae738e5e57e1"><enum>(g)</enum><header>Termination of the
			 Working Group</header><text display-inline="yes-display-inline">The Working
			 Group shall terminate 60 days after the date on which the Working Group submits
			 the latter of the 2 reports under this section.</text>
			</subsection></section><section changed="added" commented="no" committee-id="SSGA00" display-inline="no-display-inline" id="ida8bba8e1-448e-41bb-b9fa-6efb8c7afff6" reported-display-style="italic" section-type="subsequent-section"><enum>5.</enum><header>Effective
			 date</header>
			<subsection commented="no" display-inline="no-display-inline" id="id415D6171B5044AE19FE59669BE3349F6"><enum><added-phrase committee-id="SSGA00" reported-display-style="italic">(a)</added-phrase></enum><header>Presidential
			 appointments not subject to Senate approval</header><text display-inline="yes-display-inline">The amendments made by section 2 shall take
			 effect 60 days after the date of enactment of this Act and apply to
			 appointments made on and after that effective date, including any nomination
			 pending in the Senate on that date.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="idFF46EF157B484795BA6CA36BD0CB1FE1"><enum>(b)</enum><header>Director of the Census
			 and Working Group</header><text>The provisions of sections 3 and 4 (including
			 any amendments made by those sections) shall take effect on the date of
			 enactment of this Act.</text>
