			 <quote><short-title>Presidential Appointment Efficiency
			 and Streamlining Act of 2011</short-title></quote>.</text>

			 Senate approval</header>
			<subsection commented="no" display-inline="no-display-inline" id="idb547df32-e3eb-4d63-8d4f-f2be9545dead"><enum>(a)</enum><header display-inline="yes-display-inline">Agriculture</header>
				<paragraph commented="no" display-inline="no-display-inline" id="id01d4b37d-0dbd-47ad-8004-64f11f4fb525"><enum>(1)</enum><header display-inline="yes-display-inline">Assistant Secretary of Agriculture for
			 Administration</header><text display-inline="yes-display-inline">Section 218(b)
			 of the Department of Agriculture Reorganization Act of 1994 (7 U.S.C. 6918(b))
			 is amended—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="idB1340A1A4B3B4C47863BB5629C3BB2CC"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>subsection (a)</quote>
			 and inserting <quote>paragraph (1) or (3) of subsection (a)</quote>;</text>

			 States Code, is amended by striking <quote>16</quote> and inserting
			 <quote>14</quote>.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID88a698b367be4b42a9fbfea33a90d10f"><enum>(B)</enum><header display-inline="yes-display-inline">Administration of reduction</header><text display-inline="yes-display-inline">The Assistant Secretary of Defense
			 positions eliminated in accordance with the reduction in numbers required by
			 the amendment made by subparagraph (A) shall be—</text>
						<clause commented="no" display-inline="no-display-inline" id="IDea7e4d5632d946e792203a6a18d1c9ff"><enum>(i)</enum><text display-inline="yes-display-inline">the Assistant Secretary of Defense for
			 Networks and Information Integration; and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="ID9b65004d7b354fd6809366576809e53e"><enum>(ii)</enum><text display-inline="yes-display-inline">the Assistant Secretary of Defense for
			 Public Affairs.</text>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID7eebd18383d24b8b9a9ba260435eba20"><enum>(C)</enum><header display-inline="yes-display-inline">Continued service of
			 incumbents</header><text display-inline="yes-display-inline">Notwithstanding
			 the requirements of this paragraph, any individual serving in a position
			 described under subparagraph (B) on the date of the enactment of this Act may
			 continue to serve in such position without regard to the limitation imposed by
			 the amendment in subparagraph (A).</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID63b74790bb98411aba6d76331655f9da"><enum>(D)</enum><header display-inline="yes-display-inline">Plan for successor positions</header><text display-inline="yes-display-inline">Not later than 180 days after the date of
			 the enactment of this Act, the Secretary of Defense shall report to the
			 congressional defense committees on his plan for successor positions, not
			 subject to Senate confirmation, for the positions eliminated in accordance with
			 the requirements of this paragraph.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id39378309-9929-4bde-b33d-7876c941b3ac"><enum>(2)</enum><header display-inline="yes-display-inline">Members of National Security Education
			 Board</header><text display-inline="yes-display-inline">Section 803(b)(7) of
			 the David L. Boren National Security Education Act of 1991 (50 U.S.C.
			 1903(b)(7)) is amended by striking <quote>by and with the advice and consent of
			 the Senate,</quote>.</text>

			 Census</header>
			<subsection commented="no" display-inline="no-display-inline" id="id2504612DB99649E5B4F68EA8F140A927"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 21 of the title 13, United States
			 Code, is amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="id4E88D2C1FFB44070B775848999CD1687" style="USC">
					<section commented="no" display-inline="no-display-inline" id="id46F25E5A26E448E5A2ADE77017A31D86" section-type="subsequent-section"><enum>21.</enum><header display-inline="yes-display-inline">Director of the Census; duties</header>
						<subsection commented="no" display-inline="no-display-inline" id="id46DE3458C6174E40BFB8089E407C11DD"><enum>(a)</enum><header display-inline="yes-display-inline">Appointment</header>
							<paragraph commented="no" display-inline="no-display-inline" id="idA547D9A8236C409B92AC950981486911"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Bureau shall be headed by a Director of
				the Census, appointed by the President, by and with the advice and consent of
				the Senate, without regard to political affiliation.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id89FFA243A4634674B75D90DE81782916"><enum>(2)</enum><header display-inline="yes-display-inline">Qualifications</header><text display-inline="yes-display-inline">Such appointment shall be made from
				individuals who have a demonstrated ability in managing large organizations and
				experience in the collection, analysis, and use of statistical data.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id34F3366D385044FBA8E6714B7A8BC4DF"><enum>(b)</enum><header display-inline="yes-display-inline">Term of office</header>
							<paragraph commented="no" display-inline="no-display-inline" id="id2CEB9D036B1D4D1DAFC4C8F2998439D7"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The term of office of the Director shall be
				5 years, and shall begin on January 1, 2012, and every fifth year thereafter.
				An individual may not serve more than 2 full terms as Director.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id65F9A50933B74E8E8C086F5023F701EF"><enum>(2)</enum><header display-inline="yes-display-inline">Vacancies</header><text display-inline="yes-display-inline">Any individual appointed to fill a vacancy
				in such position, occurring before the expiration of the term for which such
				individual's predecessor was appointed, shall be appointed for the remainder of
				that term. The Director may serve after the end of the Director's term until
				reappointed or until a successor has been appointed, but in no event longer
				than 1 year after the end of such term.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3A51A7CADE06405CB21EB48A59AFEB25"><enum>(3)</enum><header display-inline="yes-display-inline">Removal</header><text display-inline="yes-display-inline">An individual serving as Director may be
				removed from office by the President. The President shall communicate in
				writing the reasons for any such removal to both Houses of Congress not later
				than 60 days before the removal.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID08421d97b81346d7b2a388012421445c"><enum>(4)</enum><header display-inline="yes-display-inline">Personnel actions</header><text display-inline="yes-display-inline">Except as provided under paragraph (3),
				nothing in this subsection shall prohibit a personnel action otherwise
				authorized by law with respect to the Director of the Census, other than
				removal.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id65034E9B7B3849FA9B48A386D8DB5C4A"><enum>(c)</enum><header display-inline="yes-display-inline">Duties</header><text display-inline="yes-display-inline">The Director shall perform such duties as
				may be imposed upon the Director by law, regulations, or orders of the
				Secretary.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="id8177BC83E02144EE991BD8A865503471"><enum>(b)</enum><header display-inline="yes-display-inline">Transition rules</header>
				<paragraph commented="no" display-inline="no-display-inline" id="idE6646F8C5EA74B3BB3E942E272230015"><enum>(1)</enum><header display-inline="yes-display-inline">Appointment of initial
			 Director</header><text display-inline="yes-display-inline">The initial Director
			 of the Bureau of the Census shall be appointed in accordance with the
			 provisions of section 21(a) of title 13, United States Code, as amended by
			 subsection (a).</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id54FB2454285D4504BA7D1B447734CDCB"><enum>(2)</enum><header display-inline="yes-display-inline">Interim role of current Director of the
			 Census after date of enactment</header><text display-inline="yes-display-inline">If, as of January 1, 2012, the initial
			 Director of the Bureau of the Census has not taken office, the officer serving
			 on December 31, 2011, as Director of the Census (or Acting Director of the
			 Census, if applicable) in the Department of Commerce—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="id997162EF81C84502A433523377787E4C"><enum>(A)</enum><text display-inline="yes-display-inline">shall serve as the Director of the Bureau
			 of the Census; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idD54B370666D543C4BEAE5B1D924D5A8C"><enum>(B)</enum><text display-inline="yes-display-inline">shall assume the powers and duties of such
			 Director for one term beginning January 1, 2012, as described in section 21(b)
			 of such title, as so amended.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idDB768A31C21D4DAAB9FD809CA5DA9CF8"><enum>(c)</enum><header display-inline="yes-display-inline">Technical and conforming
			 amendments</header><text display-inline="yes-display-inline">Not later than
			 January 1, 2012, the Secretary of Commerce, in consultation with the Director
			 of the Census, shall submit to each House of the Congress draft legislation
			 containing any technical and conforming amendments to title 13, United States
			 Code, and any other provisions which may be necessary to carry out the purposes
			 of this section.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="id6df7ac02-3b28-44b9-8f43-492122527243" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Working Group on streamlining paperwork for
			 executive nominations</header>
			<subsection commented="no" display-inline="no-display-inline" id="ida906748f-1621-48b5-927c-30f829b3c6b0"><enum>(a)</enum><header display-inline="yes-display-inline">Establishment</header><text display-inline="yes-display-inline">There is established the Working Group on
			 Streamlining Paperwork for Executive Nominations (in this section referred to
			 as the <quote>Working Group</quote>).</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="id5836f413-b215-4b0b-91df-f0ad9d222ad0"><enum>(b)</enum><header display-inline="yes-display-inline">Membership</header>
				<paragraph commented="no" display-inline="no-display-inline" id="id30835fdf-7b82-41b7-8286-958ed939b14a"><enum>(1)</enum><header display-inline="yes-display-inline">Composition</header><text display-inline="yes-display-inline">The Working Group shall be composed
			 of—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="iddf3ffdd3-f8a1-4da8-a73a-4446177e22c5"><enum>(A)</enum><text display-inline="yes-display-inline">the chairperson who shall be—</text>
						<clause commented="no" display-inline="no-display-inline" id="id944af167-3149-4605-a512-831ccf29c7c9"><enum>(i)</enum><text display-inline="yes-display-inline">except as provided under clause (ii), the
			 Director of the Office of Presidential Personnel; or</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="id83364c59-05a2-4290-867f-fc165af56170"><enum>(ii)</enum><text display-inline="yes-display-inline">a Federal officer designated by the
			 President;</text>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4ecdb7d2-e7da-4718-91e3-023ca968d7f3"><enum>(B)</enum><text display-inline="yes-display-inline">representatives designated by the President
			 from—</text>
						<clause commented="no" display-inline="no-display-inline" id="id2db26217-e70d-4150-af53-56fd2c810880"><enum>(i)</enum><text display-inline="yes-display-inline">the Office of Personnel Management;</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="id717d5f24-8234-4294-8f5a-745485e5791a"><enum>(ii)</enum><text display-inline="yes-display-inline">the Office of Government Ethics; and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="id2e9b9143-b9ea-46aa-ba35-7de7ece94445"><enum>(iii)</enum><text display-inline="yes-display-inline">the Federal Bureau of Investigation;
			 and</text>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idbcedae9a-e2b8-4712-a10b-b9d1d5979615"><enum>(C)</enum><text display-inline="yes-display-inline">individuals appointed by the chairperson of
			 the Working Group who have experience and expertise relating to the Working
			 Group, including—</text>
						<clause commented="no" display-inline="no-display-inline" id="ide2e3229c-0f20-4e26-92a4-78827f610158"><enum>(i)</enum><text display-inline="yes-display-inline">individuals from other relevant Federal
			 agencies; and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="idc69634f3-e445-43e4-b30e-031a274667ec"><enum>(ii)</enum><text display-inline="yes-display-inline">individuals with relevant experience from
			 previous presidential administrations.</text>
						</clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id14c80ca4-989f-4da3-ad12-11539b8df974"><enum>(c)</enum><header display-inline="yes-display-inline">Streamlining of paperwork required for
			 executive nominations</header>
				<paragraph commented="no" display-inline="no-display-inline" id="id8914ec12-5fb9-4aa6-b8d7-947c3302ca0a"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 90 days after the date of
			 enactment of this Act, the Working Group shall conduct a study and submit a
			 report on the streamlining of paperwork required for executive nominations
			 to—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="id45c93d36-6580-45cf-acf2-31ada84f1291"><enum>(A)</enum><text display-inline="yes-display-inline">the President;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc6740b6b-025c-41fb-93d4-794e605708b6"><enum>(B)</enum><text display-inline="yes-display-inline">the Committee on Homeland Security and
			 Governmental Affairs of the Senate; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id094c9f34-abe4-4e36-b2d7-9913c3102d44"><enum>(C)</enum><text display-inline="yes-display-inline">the Committee on Rules and Administration
			 of the Senate.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8ed547b6-dc07-4091-8cfa-3f344015afe8"><enum>(2)</enum><header display-inline="yes-display-inline">Consultation with Committees of the
			 Senate</header><text display-inline="yes-display-inline">In conducting the
			 study under this section, the Working Group shall consult with the chairperson
			 and ranking member of the committees referred to under paragraph (1) (B) and
			 (C).</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id76d061a4-82e3-4d1d-9989-788efa99ebf7"><enum>(3)</enum><header display-inline="yes-display-inline">Contents</header>
					<subparagraph commented="no" display-inline="no-display-inline" id="idcc004b5f-91f3-4b24-9f06-671d9c2a929f"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The report submitted under this section
			 shall include—</text>
						<clause commented="no" display-inline="no-display-inline" id="id89d7bc1a-a9a5-4da7-add1-7a8577f08390"><enum>(i)</enum><text display-inline="yes-display-inline">recommendations for the streamlining of
			 paperwork required for executive nominations; and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="id343e3692-4278-4698-9aa1-dada5a54b25e"><enum>(ii)</enum><text display-inline="yes-display-inline">a detailed plan for the creation and
			 implementation of an electronic system for collecting and distributing
			 background information from potential and actual Presidential nominees for
			 positions which require appointment by and with the advice and consent of the
			 Senate.</text>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id911d7126-c2bb-4303-82ae-d40895530682"><enum>(B)</enum><header display-inline="yes-display-inline">Electronic system</header><text display-inline="yes-display-inline">The electronic system described under
			 subparagraph (A)(ii) shall—</text>
						<clause commented="no" display-inline="no-display-inline" id="idf653bb81-64cb-4b14-9cff-e614977ca672"><enum>(i)</enum><text display-inline="yes-display-inline">provide for—</text>
							<subclause commented="no" display-inline="no-display-inline" id="idcf1c9fff-803d-436d-bb9a-e6db459b7edb"><enum>(I)</enum><text display-inline="yes-display-inline">less burden on potential nominees for
			 positions which require appointment by and with the advice and consent of the
			 Senate;</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="id05984970-9af0-454b-b2a3-1c33fb9e330a"><enum>(II)</enum><text display-inline="yes-display-inline">faster delivery of background information
			 to Congress, the White House, the Federal Bureau of Investigation, Diplomatic
			 Security, and the Office of Government Ethics; and</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="id1e622fea-e8b3-4b98-999c-0202928082af"><enum>(III)</enum><text display-inline="yes-display-inline">fewer errors of omission; and</text>
							</subclause></clause><clause commented="no" display-inline="no-display-inline" id="id69682a9f-7fd4-46ea-80e5-2532d9d5e8e1"><enum>(ii)</enum><text display-inline="yes-display-inline">ensure the existence and operation of a
			 single, searchable form which shall be known as a <quote>Smart Form</quote> and
			 shall—</text>
							<subclause commented="no" display-inline="no-display-inline" id="id704717d4-7c55-4611-a4a9-6ac9c7a40982"><enum>(I)</enum><text display-inline="yes-display-inline">be free to a nominee and easy to
			 use;</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="idc14bb776-6f2b-4fe8-a6cc-eeac752c63ed"><enum>(II)</enum><text display-inline="yes-display-inline">make it possible for the nominee to answer
			 all vetting questions one way, at a single time;</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="id020f1566-d30b-416c-83ff-ffb44dbaf48d"><enum>(III)</enum><text display-inline="yes-display-inline">secure the information provided by a
			 nominee;</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="id1be30ead-3dfc-403c-9ff1-e98e2b9c9f21"><enum>(IV)</enum><text display-inline="yes-display-inline">allow for multiple submissions over time,
			 but always in the format requested by the vetting agency or entity;</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="id3bbcbddc-eee8-4443-96c0-551190dc65d4"><enum>(V)</enum><text display-inline="yes-display-inline">be compatible across different computer
			 platforms;</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="idccde2356-9e4f-4f75-922b-31e75770e8e2"><enum>(VI)</enum><text display-inline="yes-display-inline">make it possible to easily add, modify, or
			 subtract vetting questions;</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="id3d884e29-8643-49ec-a181-884d8cd690d3"><enum>(VII)</enum><text display-inline="yes-display-inline">allow error checking; and</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="idd8071279-13eb-4c92-a123-435266a2f4f6"><enum>(VIII)</enum><text display-inline="yes-display-inline">allow the user to track the progress of a
			 nominee in providing the required information.</text>
							</subclause></clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idd216a65d-c035-4495-98fc-418eccf29bb3"><enum>(d)</enum><header display-inline="yes-display-inline">Review of background investigation
			 requirements</header>
				<paragraph commented="no" display-inline="no-display-inline" id="id1e1b2132-c0f7-47d4-96a5-490051f918ad"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Working Group shall conduct a review of
			 the impact of background investigation requirements on the appointments
			 process.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6f0d1ce8-1dbe-495f-a16a-2bdc31a5f227"><enum>(2)</enum><header display-inline="yes-display-inline">Conduct of review</header><text display-inline="yes-display-inline">In conducting the review, the Working Group
			 shall—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="id9b13b326-72ea-4bfe-9db7-8bad1c498cc1"><enum>(A)</enum><text display-inline="yes-display-inline">assess the feasibility of using personnel
			 other than Federal Bureau of Investigation personnel, in appropriate
			 circumstances, to conduct background investigations of individuals under
			 consideration for positions appointed by the President, by and with the advice
			 and consent of the Senate; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id64b2a7d0-ee9a-49eb-a311-ce35775ba329"><enum>(B)</enum><text display-inline="yes-display-inline">consider the extent to which the scope of
			 the background investigation conducted for an individual under consideration
			 for a position appointed by the President, by and with the advice and consent
			 of the Senate, should be varied depending on the nature of the position for
			 which the individual is being considered.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id199a9e66-4ff9-4223-9244-2d1c5f76b21f"><enum>(3)</enum><header display-inline="yes-display-inline">Report</header><text display-inline="yes-display-inline">Not later than 270 days after the date of
			 enactment of this Act, the Working Group shall submit a report of the findings
			 of the review under this subsection to—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="idd45d9f92-1523-44ae-b0fc-0407a33025fe"><enum>(A)</enum><text display-inline="yes-display-inline">the President;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idbd0cc74a-e7c7-4c65-9b06-26f4731061ad"><enum>(B)</enum><text display-inline="yes-display-inline">the Committee on Homeland Security and
			 Governmental Affairs of the Senate; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb458ec73-dcd5-44b0-aaf3-d868c6af6f88"><enum>(C)</enum><text display-inline="yes-display-inline">the Committee on Rules and Administration
			 of the Senate.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id2ecec2cd-7467-41af-bb3d-2c83febe4ac8"><enum>(e)</enum><header display-inline="yes-display-inline">Personnel matters</header>
				<paragraph commented="no" display-inline="no-display-inline" id="idc591559a-f2f6-4129-98c5-aa724e6964e1"><enum>(1)</enum><header display-inline="yes-display-inline">Compensation of members</header>
					<subparagraph commented="no" display-inline="no-display-inline" id="idfc1372ea-61eb-49cb-9a09-e99a568dd9ad"><enum>(A)</enum><header display-inline="yes-display-inline">Federal officers and
			 employees</header><text display-inline="yes-display-inline">Each member of the
			 Working Group who is a Federal officer or employee shall serve without
			 compensation in addition to that received for their services as a Federal
			 officer or employee.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6578a646-701f-416a-a76e-035d723c1755"><enum>(B)</enum><header display-inline="yes-display-inline">Members not Federal officers and
			 employees</header><text display-inline="yes-display-inline">Each member of the
			 Working Group who is not a Federal officer or employee shall not be compensated
			 for services performed for the Working Group.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id14ade38f-2b9a-412b-90d7-fd7ce95a3073"><enum>(2)</enum><header display-inline="yes-display-inline">Travel expenses</header><text display-inline="yes-display-inline">The members of the Working Group shall be
			 allowed travel expenses, including per diem in lieu of subsistence, at rates
			 authorized for employees of agencies under subchapter I of chapter 57 of title
			 5, United States Code, while away from their homes or regular places of
			 business in the performance of services for the Working Group.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7762f1ae-266f-4a0d-9654-b86e991df998"><enum>(3)</enum><header display-inline="yes-display-inline">Staff</header>
					<subparagraph commented="no" display-inline="no-display-inline" id="ida313b22e-cc23-4bcd-9785-e067512f6677"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The President may designate Federal
			 officers and employees to provide support services for the Working
			 Group.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idcf8648de-5cb2-426a-a028-72d5b0c975df"><enum>(B)</enum><header display-inline="yes-display-inline">Detail of Federal employees</header><text display-inline="yes-display-inline">Any Federal employee may be detailed to the
			 Working Group without reimbursement, and such detail shall be without
			 interruption or loss of civil service status or privilege.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idfaa79392-ac5b-421f-bf95-43b04257e082"><enum>(f)</enum><header display-inline="yes-display-inline">Non-Applicability of Federal Advisory
			 Committee Act</header><text display-inline="yes-display-inline">The Federal
			 Advisory Committee Act (5 U.S.C. App.) shall not apply to the Working Group
			 established under this section.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="idd714140b-7c29-438a-8f34-ae738e5e57e1"><enum>(g)</enum><header display-inline="yes-display-inline">Termination of the Working
			 Group</header><text display-inline="yes-display-inline">The Working Group shall
			 terminate 60 days after the date on which the Working Group submits the latter
			 of the 2 reports under this section.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="idD6BA1F69CB654E3EAB6865AE883DF38D" section-type="subsequent-section"><enum>5.</enum><header display-inline="yes-display-inline">Report on Presidentially appointed
			 positions</header>
			<subsection commented="no" display-inline="no-display-inline" id="id95897922363D4879BD19C14496D06A33"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="idC6838C6122834D73B47FA6E35A2EA3CE"><enum>(1)</enum><text display-inline="yes-display-inline">the term <term>agency</term> means an
			 Executive agency defined under section 105 of title 5, United States Code;
			 and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5CF5243F062840D5AB12928575882C7B"><enum>(2)</enum><text display-inline="yes-display-inline">the term <term>covered position</term>
			 means a position in an agency that requires appointment by the President
			 without the advice and consent of the Senate.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idA5C1C259DB574BEBA6054AD51E757881"><enum>(b)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of
			 enactment of this Act, the Government Accountability Office shall conduct a
			 study and submit a report on covered positions to Congress and the
			 President.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="id4F6FF19CFFFB4AADAB2C5D1FBFDC349A"><enum>(c)</enum><header display-inline="yes-display-inline">Contents</header><text display-inline="yes-display-inline">The report submitted under this section
			 shall include—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="idBFF03A0407B44A98B8DD9264F6D03A0C"><enum>(1)</enum><text display-inline="yes-display-inline">a determination of the number of covered
			 positions in each agency;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idCE1BCFD3613D4676B5C831F4D0B61BF0"><enum>(2)</enum><text display-inline="yes-display-inline">an evaluation of whether maintaining the
			 total number of covered positions is necessary;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idDB058DDCB0E94C768536FD1BE4DDA971"><enum>(3)</enum><text display-inline="yes-display-inline">an evaluation of the benefits and
			 disadvantages of—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="id20C6F5C6CED842EF966509E6E6EAA3BD"><enum>(A)</enum><text display-inline="yes-display-inline">eliminating certain covered
			 positions;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idDC39CFE4F2C8441F89924F8BEDDAD4FB"><enum>(B)</enum><text display-inline="yes-display-inline">converting certain covered positions to
			 career positions or positions in the Senior Executive Service that are not
			 career reserved positions; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id18FE0236D6AF4EC4AA472EAE9534A4FD"><enum>(C)</enum><text display-inline="yes-display-inline">converting any categories of covered
			 positions to career positions;</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC98915A3FBCF4D68B7F7D0707030D728"><enum>(4)</enum><text display-inline="yes-display-inline">the identification of—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="id7D48428FB9DE416484AEFAC0AA12A655"><enum>(A)</enum><text display-inline="yes-display-inline">covered positions described under paragraph
			 (3)(A) and (B); and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id927A518569534F07AFAC9F5B86EB088B"><enum>(B)</enum><text display-inline="yes-display-inline">categories of covered positions described
			 under paragraph (3)(C); and</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3AE9009F7ED54249A82E017D5B553697"><enum>(5)</enum><text display-inline="yes-display-inline">any other recommendations relating to
			 covered positions.</text>
				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="ida8bba8e1-448e-41bb-b9fa-6efb8c7afff6" section-type="subsequent-section"><enum>6.</enum><header display-inline="yes-display-inline">Effective date</header>
			<subsection commented="no" display-inline="no-display-inline" id="id415D6171B5044AE19FE59669BE3349F6"><enum>(a)</enum><header display-inline="yes-display-inline">Presidential appointments not subject to
			 Senate approval</header><text display-inline="yes-display-inline">The
			 amendments made by section 2 shall take effect 60 days after the date of
			 enactment of this Act and apply to appointments made on and after that
			 effective date, including any nomination pending in the Senate on that
			 date.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="idFF46EF157B484795BA6CA36BD0CB1FE1"><enum>(b)</enum><header display-inline="yes-display-inline">Director of the Census and Working
			 Group</header><text display-inline="yes-display-inline">The provisions of
			 sections 3 and 4 (including any amendments made by those sections) shall take
			 effect on the date of enactment of this Act.</text>
