		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Economic Espionage Penalty
			 Enhancement Act</short-title></quote>.</text>
		</section><section id="id72E6860B63AE403F80AE2AB97A57F5A3"><enum>2.</enum><header>Amendment to
			 title 18</header><text display-inline="no-display-inline">Section 1831(a) of
			 title 18, United States Code, is amended by striking <quote>15 years</quote>
			 and inserting <quote>20 years</quote>.</text>
		</section><section changed="deleted" committee-id="SSJU00" id="id300FFE686F2A439E8AB51452A885F0CA" reported-display-style="strikethrough"><enum>3.</enum><header>Directive to
			 Sentencing Commission</header><text display-inline="no-display-inline">Pursuant
			 to its authority under section 994(p) of title 28, United States Code, the
			 United States Sentencing Commission shall—</text>
			<paragraph id="id977E39F44670495088320D07838C5573"><enum>(1)</enum><text display-inline="yes-display-inline">review its guidelines and policy relating
			 to a two-level enhancement for economic espionage; and</text>
			</paragraph><paragraph id="idD2DA3B71D4A04673BC7FB6C9A01B269E"><enum>(2)</enum><text>as a part of such
			 review consider amending such guidelines to—</text>
				<subparagraph id="IDed6574ee98514d87b0f5623180ccbbf7"><enum>(A)</enum><text>apply the
			 two-level enhancement to the simple misappropriation of a trade secret;</text>
				</subparagraph><subparagraph id="IDc3e99c240bd9406c8815b63f2287a3ea"><enum>(B)</enum><text>apply an
			 additional two-level enhancement if the defendant transmits or attempts to
			 transmit the stolen trade secret outside of the United States and an additional
			 three-level enhancement if the defendant instead commits economic espionage
			 (i.e., he/she knew or intended that the offense would benefit a foreign
			 government, foreign instrumentality, or foreign agent); and</text>
				</subparagraph><subparagraph id="ID2104157ae9984cf4877c72615b1b7572"><enum>(C)</enum><text>provide when a
			 defendant transmits trade secrets outside of the United States or commits
			 economic espionage, that the defendant should face a minimum offense
			 level.</text>
				</subparagraph></paragraph></section><section changed="added" committee-id="SSJU00" id="ID2a2a721197464820af968acc8b0fade8" reported-display-style="italic"><enum>3.</enum><header>Directive to the United
			 States Sentencing Commission</header>
			<subsection id="ID9263d64a8ad443e68191553e8244c2d9"><enum>(a)</enum><header>In
			 general</header><text>Pursuant to its authority under section 994(p) of title
			 28, United States Code, the United States Sentencing Commission shall review
			 and, if appropriate, amend the Federal sentencing guidelines and policy
			 statements applicable to persons convicted of offenses relating to the
			 transmission or attempted transmission of a stolen trade secret outside of the
			 United States or economic espionage, in order to reflect the intent of Congress
			 that penalties for such offenses under the Federal sentencing guidelines and
			 policy statements appropriately, reflect the seriousness of these offenses,
			 account for the potential and actual harm caused by these offenses, and provide
			 adequate deterrence against such offenses.</text>
			</subsection><subsection id="ID9136d6b82bc44f39a6327ff71a3445e9"><enum>(b)</enum><header>Requirements</header><text>In
			 carrying out this section, the United States Sentencing Commission
			 shall―</text>
				<paragraph id="ID2f5a691f22dc4f9387a4b86a9b01130f"><enum>(1)</enum><text>consider the extent to
			 which the Federal sentencing guidelines and policy statements appropriately
			 account for the simple misappropriation of a trade secret, including the
			 sufficiency of the existing enhancement for these offenses to address the
			 seriousness of this conduct;</text>
				</paragraph><paragraph id="ID534cd005e5c94554a2da3d1d33c5c0b9"><enum>(2)</enum><text>consider additional
			 enhancements in the Federal sentencing guidelines and policy statements to
			 account for—</text>
					<subparagraph id="id86545D83855046628388C04519A14956"><enum>(A)</enum><text>the transmission or
			 attempted transmission of a stolen trade secret outside of the United States;
			 and</text>
					</subparagraph><subparagraph id="IDb5ec1ca2cb2e4727ad61c8c2d6a22a4d"><enum>(B)</enum><text>the transmission or
			 attempted transmission of a stolen trade secret outside of the United States
			 that is committed or attempted to be committed for the benefit of a foreign
			 government, foreign instrumentality, or foreign agent;</text>
					</subparagraph></paragraph><paragraph id="IDf0ce795c986f4981a7332a7e90466030"><enum>(3)</enum><text>consider establishing a
			 minimum offense level under the Federal sentencing guidelines and policy
			 statements for offenses relating to the transmission or attempted transmission
			 of a stolen trade secret outside of the United States;</text>
				</paragraph><paragraph id="IDc4cf47a19a8c45beb0fa9cde1d62a84c"><enum>(4)</enum><text>ensure the Federal
			 sentencing guidelines and policy statements reflect the seriousness nature of
			 these offenses and the need to deter such conduct;</text>
				</paragraph><paragraph id="IDb22aac15588e4decb71b377fa4ab6b4f"><enum>(5)</enum><text>ensure reasonable
			 consistency with other relevant directives, Federal sentencing guidelines and
			 policy statements, and any Federal statutes;</text>
				</paragraph><paragraph id="ID9320d3b5a3644db094b3d8dd11fdd03e"><enum>(6)</enum><text>make any necessary
			 conforming changes to the Federal sentencing guidelines and policy statements;
			 and</text>
				</paragraph><paragraph id="IDead78dc9180a4349a07632168967e7e9"><enum>(7)</enum><text>ensure that the Federal
			 sentencing guidelines adequately meet the purposes of sentencing as set forth
			 in section 3553(a)(2) of title 18, United States Code.</text>
				</paragraph></subsection><subsection commented="no" id="ID5c65b2dbba594ef58b15190e50bc7b2d"><enum>(c)</enum><header>Consultation</header><text>In
			 carrying out the review required under this section, the Commission shall
			 consult with individuals or groups representing owners of trade secrets, law
			 enforcement, victims of economic espionage offenses, the United States
			 Department of State, the United States Department of Homeland Security, and the
			 United States Trade Representative.</text>
			</subsection><subsection commented="no" id="id2D3CDCAF021746B0A5DBE965E42F1112"><enum>(d)</enum><header>Review</header><text>Not
			 later than 180 days after the date of enactment of this Act, the Commission
			 shall—</text>
				<paragraph id="ID7af1375a988042969ed7066fff1be004"><enum>(1)</enum><text>complete its
			 consideration and review under this section; and</text>
				</paragraph><paragraph id="ID3d9741da17dd4baa8452ee6afd84d099"><enum>(2)</enum><text>if it chooses not to
			 adopt any of the specific recommendations made under this section, issue a
			 report explaining why it has not adopted the recommendations.</text>
				</paragraph></subsection></section></legis-body>
