		<official-title>To allow the Administrator of the Small Business
		  Administration to create or save jobs by providing interest relief on certain
		  outstanding disaster loans relating to damage caused by the 2005 Gulf Coast
		  hurricanes or the 2008 Gulf Coast hurricanes.</official-title>

		<section id="id021DDAFC829743D081CB4BAC0A97DB1E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Southeast Hurricanes Small Business
			 Disaster Relief Act of 2011</short-title></quote>.</text>
		</section><section id="id5290E89C89B3492A890BFB7E6A2D1F2A"><enum>2.</enum><header>Southeast
			 Hurricanes Small Business Disaster Relief Program</header>
			<subsection id="id6B2F62F1969D4AADA19E2BD259929DF2"><enum>(a)</enum><header>In
			 general</header><text>Section 12086 of the Food, Conservation, and Energy Act
			 of 2008 (Public Law 110–234; 122 Stat. 1422) is amended to read as
			 follows:</text>
				<quoted-block display-inline="no-display-inline" id="id52EAEDD816DA4AE8A8507BDB7E56DDD8" style="OLC">
					<section id="id392BF3F7C33B4CCAAE108F145C7C2421"><enum>12086.</enum><header>Southeast
				Hurricanes Small Business Disaster Relief Program</header>
						<subsection id="idDF02F75587214E6798F847F79BA5364D"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="idA0CE8336F30B4635B32C0A4C7743B456"><enum>(1)</enum><text>the term
				<term>covered area</term> means an area in the State of Louisiana, the State of
				Mississippi, the State of Alabama, or the State of Texas for which the
				President declared a major disaster relating to Hurricane Katrina of 2005,
				Hurricane Rita of 2005, Hurricane Gustav of 2008, or Hurricane Ike of
				2008;</text>
							</paragraph><paragraph id="idA24BAC1F82F647FBB4094E569760987C"><enum>(2)</enum><text display-inline="yes-display-inline">the term <term>covered disaster loan</term>
				means a loan—</text>
								<subparagraph id="idDA2E886796DA41EA8679F85870AEF209"><enum>(A)</enum><text>made under
				section 7(b) of the Small Business Act (15 U.S.C. 636(b));</text>
								</subparagraph><subparagraph id="idA24162EBA8F54A949046F57576208851"><enum>(B)</enum><text>for damage or
				injury caused by Hurricane Katrina of 2005, Hurricane Rita of 2005, Hurricane
				Gustav of 2008, or Hurricane Ike of 2008; and</text>
								</subparagraph><subparagraph id="idA09B26770572407AA41B5BA6B4B7645E"><enum>(C)</enum><text>made to a
				business located in a covered area;</text>
								</subparagraph></paragraph><paragraph id="ID94955446756b4a7499f86af8d8b87898"><enum>(3)</enum><text>the term
				<term>Deepwater Horizon oil spill</term> means the blowout and explosion of the
				mobile offshore drilling unit Deepwater Horizon that occurred on April 20,
				2010, and resulting hydrocarbon releases into the environment; and</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id06DC34875F1A46C6B95BC85C883EFA97"><enum>(4)</enum><text>the term
				<term>program</term> means the Southeast Hurricanes Small Business Disaster
				Relief Program established under subsection (b).</text>
							</paragraph></subsection><subsection id="idDA37DBDD59CE49F7B3148FB0CC228311"><enum>(b)</enum><header>Program
				established</header><text>Subject to the availability of appropriations, the
				Administrator shall establish a Southeast Hurricanes Small Business Disaster
				Relief Program, under which the Administrator may waive payment of interest by
				a business on a covered disaster loan—</text>
							<paragraph id="id84561F541CB5464C87B4042AD37AA13F"><enum>(1)</enum><text>for not more than
				3 years; and</text>
							</paragraph><paragraph id="id8167CCA588C44011ACFC0B990C6E9FD0"><enum>(2)</enum><text>in a total amount
				of not more than $15,000.</text>
							</paragraph></subsection><subsection id="idCEB3C0CA3DC94B06AC8AA39C7091FC64"><enum>(c)</enum><header>Priority of
				applications</header><text>The Administrator shall, to the extent practicable,
				give priority to an application for a waiver of payment of interest under the
				program by a small business concern—</text>
							<paragraph id="idE07574387B0D44DB80ED3389BCFADDD9"><enum>(1)</enum><text>with not more
				than 50 employees;</text>
							</paragraph><paragraph id="IDab9a4b2abc5545459f668b98e90a443a"><enum>(2)</enum><text>that demonstrates
				substantial economic injury as a result of the Deepwater Horizon oil spill;
				or</text>
							</paragraph><paragraph id="id9DED10D2DD9743FA93B3B8BDD011FD15"><enum>(3)</enum><text>that resumed
				business operations—</text>
								<subparagraph id="id52F80E305E074B3B9076E6672CC5E5B7"><enum>(A)</enum><text>during the period
				beginning on September 1, 2005 and ending on October 1, 2006 in a covered area
				relating to Hurricane Katrina of 2005 or Hurricane Rita of 2005; or</text>
								</subparagraph><subparagraph id="id25CA73D91FB44BC6AA8F77905C0AE66B"><enum>(B)</enum><text>during the period
				beginning on September 1, 2008 and ending on January 1, 2009 in a covered area
				relating to Hurricane Gustav of 2008 or Hurricane Ike of 2008.</text>
								</subparagraph></paragraph></subsection><subsection id="ID289d1041dca949c18e76be8bb94db36f"><enum>(d)</enum><header>Reimbursement
				by responsible party</header><text display-inline="yes-display-inline">The
				Administrator may present a claim to the responsible party (as defined in
				section 1001 of the Oil Pollution Act of 1990 (33 U.S.C. 2701)) for costs and
				expenses described in section 1012(a)(5) of the Oil Pollution Act of 1990 (33
				U.S.C. 2712(a)(5)) relating to a waiver of interest under this section for a
				business suffering a substantial economic injury as a result of the Deepwater
				Horizon oil spill in accordance with section 1013 of the Oil Pollution Act of
				1990 (33 U.S.C. 2713).</text>
						</subsection><subsection id="id2DCD1957E2A74C239C9A74B4B0C18FE8"><enum>(e)</enum><header>Authorization
				of appropriations</header><text display-inline="yes-display-inline">There are
				authorized to be appropriated to the Administrator such sums as may be
				necessary to carry out the program.</text>
						</subsection><subsection id="idF1E134F571D3417697DC844D9767892B"><enum>(f)</enum><header>Termination of
				program</header><text>The Administrator may not approve an application under
				the program after March 31,
				2012.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="idF24BCF3E743A43A1B78816D4B7CF340F"><enum>(b)</enum><header>Savings
			 clause</header><text>A loan refinanced under section 12086 of the Food,
			 Conservation, and Energy Act of 2008 (Public Law 110–234; 122 Stat. 1422)
			 before the date of enactment of this Act shall remain in full force and effect
			 under the terms, and for the duration, of the loan (including any option to
			 defer repayment).</text>
			</subsection><subsection id="id7AA0E1FFAC8F4C2F86F29C953A274FBD"><enum>(c)</enum><header>Technical and
			 conforming amendment</header><text>The table of contents in section 1(b) of the
			 Food, Conservation, and Energy Act of 2008 (Public Law 110–234; 122 Stat. 933)
			 is amended by striking the item relating to section 12086 and inserting the
			 following:</text>
