			 and Security Act of 2007 (42 U.S.C. 17212(a)) is amended—</text>

			 (13), by striking <quote>; and</quote> and inserting a semicolon;</text>

			 (14), by striking the period at the end and inserting <quote>; and</quote>;
			 and</text>

			 end the following:</text>

				data to industry stakeholders as public information through published interface
				definitions, standards, and demonstration projects; and</text>
						</subparagraph><subparagraph id="idF7F7DC83AA1D437A995CA8A33288F110" indent="up1"><enum>(C)</enum><text>develop incentives for industry to
				comply with the
				standards.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="ID9d96e4ebbb94429eb1ad5169ad60174f"><enum>3.</enum><header>Test
			 facilities</header><text display-inline="no-display-inline">Section 633 of the
			 Energy Independence and Security Act of 2007 (42 U.S.C. 17212) is amended by
			 adding at the end the following:</text>

				<subsection id="id1E052B56EA864FE991D193896AD66397"><enum>(c)</enum><header>Test
				facilities</header>
					<paragraph id="ID068ddc0fed1341108e415d68d5946e45"><enum>(1)</enum><header>In
				general</header><text>In carrying out this section, not later than 180 days
				after the date of enactment of this subsection, the Secretary shall award
				competitive grants to support
				<deleted-phrase committee-id="SSEG00" reported-display-style="strikethrough">3</deleted-phrase><added-phrase committee-id="SSEG00" reported-display-style="italic">4</added-phrase> or more
				geographically dispersed marine and hydrokinetic renewable energy technology
				research, development, and demonstration test facilities for the demonstration
				of multiple technologies in actual
				<deleted-phrase committee-id="SSEG00" reported-display-style="strikethrough">operating
				environments</deleted-phrase><added-phrase committee-id="SSEG00" reported-display-style="italic">operating marine environments (including
				industry demonstrations)</added-phrase>.</text>
					</paragraph><paragraph changed="added" committee-id="SSEG00" id="ID5574e03d672e44a0b41747b6de0d10ce" reported-display-style="italic"><enum>(2)</enum><header>Preference</header><text>In
				awarding competitive grants under this subsection, the Secretary shall give
				preference to existing marine and hydrokinetic testing facilities and existing
				Centers established under section 634.</text>
					</paragraph><paragraph id="idF1D359B3F0824C75BBDD894C5DC7E620"><enum><deleted-phrase committee-id="SSEG00" reported-display-style="strikethrough">(2)</deleted-phrase><added-phrase committee-id="SSEG00" reported-display-style="italic">(3)</added-phrase></enum><header>Facilities</header><text>Grants
				under this subsection may support—</text>
						<subparagraph id="id392B6920C75B4B55938A20D5059B266E"><enum>(A)</enum><text>modification of
				an existing facility (including a Center established under section 634);
				or</text>
						</subparagraph><subparagraph id="id2185005704EA432E8EBDD2237E914C0B"><enum>(B)</enum><text>construction of a
				new test facility.</text>
						</subparagraph></paragraph><paragraph id="IDcf15ad60a7364838b698db677610cd2a"><enum><deleted-phrase committee-id="SSEG00" reported-display-style="strikethrough">(3)</deleted-phrase><added-phrase committee-id="SSEG00" reported-display-style="italic">(4)</added-phrase></enum><header>Program
				objectives</header><text>In awarding grants under this subsection, the
				Secretary shall provide for the demonstration of—</text>
						<subparagraph id="IDa1101355496f4770bfcfc244bbb9ec6d"><enum>(A)</enum><text>a variety of
				technologies at each test facility;</text>
						</subparagraph><subparagraph id="ID6773370e96134107ba5603e07e1007e9"><enum>(B)</enum><text>a variety of
				technologies among all of the test facilities established; and</text>
						</subparagraph><subparagraph id="IDe03b84e67be24b3b8d99eefb0c4a9e65"><enum>(C)</enum><text>technologies on a
				variety of scales.</text>
						</subparagraph></paragraph><paragraph id="IDf1b72dd44f154b9781016241c27a51b5"><enum><deleted-phrase committee-id="SSEG00" reported-display-style="strikethrough">(4)</deleted-phrase><added-phrase committee-id="SSEG00" reported-display-style="italic">(5)</added-phrase></enum><header>Activities</header><text>Each
				test facility established under this subsection shall—</text>
						<subparagraph id="IDfc38ecb7d3c74b969ba0af85b0dc06cc"><enum>(A)</enum><text>provide
				infrastructure and resources for the evaluation and technical viability testing
				of marine and hydrokinetic renewable energy technologies; and</text>
						</subparagraph><subparagraph id="IDd90659c612784da48c0e0119547f77dd"><enum>(B)</enum><text>conduct and
				support research, development, and demonstration activities with respect to
				marine and hydrokinetic renewable energy technologies.</text>
						</subparagraph></paragraph><paragraph id="IDee18ff74e0f742feac4ebb9ddbd72f54"><enum><deleted-phrase committee-id="SSEG00" reported-display-style="strikethrough">(5)</deleted-phrase><added-phrase committee-id="SSEG00" reported-display-style="italic">(6)</added-phrase></enum><header>Eligibility</header><text>To
				be eligible for a grant under this subsection, an applicant for a grant
				shall—</text>
						<subparagraph id="id53F8E1C2C81C4D1CAE551F4A60B078E0"><enum>(A)</enum><text>be—</text>
							<clause id="id448282823E834D5F9AEA597C2A983BE0"><enum>(i)</enum><text>a
				nonprofit institution;</text>
							</clause><clause id="idBE5CD027327F48E5B6586CCFB4472C3C"><enum>(ii)</enum><text>a State or local
				government;</text>
							</clause><clause id="idE86C3D676C694EC4B90E6A414FFDB287"><enum>(iii)</enum><text>an institution
				of higher education;</text>
							</clause><clause changed="deleted" committee-id="SSEG00" id="idE3A5588521F9430D9289C7204573F6FE" reported-display-style="strikethrough"><enum>(iv)</enum><text>a National
				Laboratory; or</text>
							</clause><clause changed="deleted" committee-id="SSEG00" id="id61F4B30836E4421FB65F1C9B06346D4D" reported-display-style="strikethrough"><enum>(v)</enum><text>a Center
				established under section 634; and</text>
							</clause><clause changed="added" committee-id="SSEG00" id="idEB64F3462A644928A5333505E323EDA0" reported-display-style="italic"><enum>(iv)</enum><text>a university
				consortium;</text>
							</clause><clause changed="added" committee-id="SSEG00" id="id02FA1CD421F6462F8857DF364FCA8C2B" reported-display-style="italic"><enum>(v)</enum><text>a National Laboratory;
				or</text>
							</clause><clause changed="added" committee-id="SSEG00" id="id6CBB2113388F44ACB9CDD4FD4A8C72C8" reported-display-style="italic"><enum>(vi)</enum><text>a Center established
				under section 634; and</text>
							</clause></subparagraph><subparagraph id="idB17CCAD194BD40E19ADF0A6C4EA0FF37"><enum>(B)</enum><text>demonstrate to
				the satisfaction of the Secretary the ability and intention to—</text>
							<clause id="ID549b1caa0f0648b5a384a61d889c8df9"><enum>(i)</enum><text>combine expertise
				from relevant academic fields, including fields relating to—</text>
								<subclause id="id297AF1A714214FDA8EA664B2A5ECE9BA"><enum>(I)</enum><text>the
				environment;</text>
								</subclause><subclause id="idDAEDC13CF794429CB14FBD75B0E7C3F8"><enum>(II)</enum><text>marine
				<added-phrase reported-display-style="italic">and riverine</added-phrase>
				sciences;</text>
								</subclause><subclause changed="deleted" committee-id="SSEG00" id="id21EF8729556D4F9798ECD45D4380ED95" reported-display-style="strikethrough"><enum>(III)</enum><text>energy;
				and</text>
								</subclause><subclause changed="deleted" committee-id="SSEG00" id="id7AB087BD1B0B491EB5C2AC860FDC65DC" reported-display-style="strikethrough"><enum>(IV)</enum><text>electrical,
				mechanical, and civil engineering; and</text>
								</subclause></clause><clause id="ID4224bea13e32482b820141876b4f8b0b"><enum><deleted-phrase committee-id="SSEG00" reported-display-style="strikethrough">(ii)</deleted-phrase></enum><text><deleted-phrase committee-id="SSEG00" reported-display-style="strikethrough">partner with other
				entities that </deleted-phrase></text>
								<subclause changed="added" committee-id="SSEG00" id="id3D76ECF4D4DB4D51A0A0E20AABA4B124" reported-display-style="italic"><enum>(III)</enum><text>energy;</text>
								</subclause><subclause changed="added" committee-id="SSEG00" id="idC54EED1A0E9F436F8EC53C475E434CA7" reported-display-style="italic"><enum>(IV)</enum><text>ocean engineering;
				and</text>
								</subclause><subclause changed="added" committee-id="SSEG00" id="id4C7674590B23408AB7630C3D0909216A" reported-display-style="italic"><enum>(V)</enum><text>electrical, mechanical,
				and civil engineering; and</text>
								</subclause></clause><clause id="id3E7A9FDCBBB4403EAC525C0AE574E9AD"><enum><added-phrase committee-id="SSEG00" reported-display-style="italic">(ii)</added-phrase></enum><text><added-phrase committee-id="SSEG00" reported-display-style="italic">partner with other
				entities (including industry) that</added-phrase> have expertise in advancing
				marine and hydrokinetic renewable energy
				technologies.</text>
							</clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="IDfbafc0cd1bfe4d25841974e54ca5e608"><enum>4.</enum><header>National Marine
			 and Hydrokinetic Renewable Energy Research, Development, and Demonstration
			 Centers</header><text display-inline="no-display-inline">Section 634 of the
			 Energy Independence and Security Act of 2007 (42 U.S.C. 17213) is
			 amended—</text>
			<paragraph id="idA21958C8E91B4E43895A024B48EB8B61"><enum>(1)</enum><text>in the section
			 heading, by inserting <quote><header-in-text level="section" style="OLC">and
			 Hydrokinetic</header-in-text></quote> after <quote><header-in-text level="section" style="OLC">Marine</header-in-text></quote>;</text>
			</paragraph><paragraph id="IDaf0adc8026394c9bbd4df4a8663a86ed"><enum>(2)</enum><text>in the first
			 sentence of subsection (a), by inserting <quote>and Hydrokinetic</quote> after
			 <quote>Marine</quote>; and</text>
			</paragraph><paragraph id="ID04c623d8817541c29cf01a96b2cb30a6"><enum>(3)</enum><text>by striking
			 subsection (b) and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="id824420941B044939A5232E143617DFC2" style="OLC">
					<subsection id="IDe7087efd26744fb18d4827da8da4740e"><enum>(b)</enum><header>Purposes</header><text>The
				Centers—</text>
						<paragraph id="idB5A419F8A21D47288CE7454B2D6D3A4E"><enum>(1)</enum><text>shall—</text>
							<subparagraph id="id97E69A38F9284D498F7F0941FA221F24"><enum>(A)</enum><text>advance research,
				development, demonstration, and commercial application of marine and
				hydrokinetic renewable energy technologies; and</text>
							</subparagraph><subparagraph id="ID6299cfa6b7804449b7384002fffdfec5"><enum>(B)</enum><text>serve as
				information clearinghouses for the marine and hydrokinetic renewable energy
				industry by collecting and disseminating information on best practices in all
				areas relating to developing and managing marine and hydrokinetic renewable
				energy technologies; and</text>
							</subparagraph></paragraph><paragraph id="IDe5c39f4aff204491a7e4c28c97a8d515"><enum>(2)</enum><text>may serve as
				technology test facilities established under section
				633(c).</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="id7D02BCD4E0504608AB766ED8557735A5"><enum>5.</enum><header>Marine-based
			 energy device verification program</header><text display-inline="no-display-inline">The Energy Independence and Security Act of
			 2007 (42 U.S.C. 17211 et seq.) is amended—</text>
			<paragraph id="id98CA425BC7A346FCB5B5DF4F1093363C"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating sections 635 and 636 (42
			 U.S.C. 17214, 17215) as sections 638 and 639, respectively; and</text>
			</paragraph><paragraph id="idBD901B29A21447E09FFDDE5FA8F0C717"><enum>(2)</enum><text>by inserting
			 after section 634 (42 U.S.C. 17213) the following:</text>
				<quoted-block display-inline="no-display-inline" id="id588966029C204D03B40855973F250F1D" style="OLC">
					<section commented="no" id="HEC325A8594F744689548897CA6922527"><enum>635.</enum><header>Marine-based
				energy device verification program</header>
						<subsection id="HAD14EAB0CBA544C48156BFB5FC377600"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Secretary shall establish a
				marine-based energy device verification program to provide a bridge from the
				marine and hydrokinetic renewable energy capture device design and development
				efforts underway across the industry to commercial deployment of marine and
				hydrokinetic renewable energy devices.</text>
						</subsection><subsection id="HA839CF8EFA034DBAB24B12A4FBF698A9"><enum>(b)</enum><header>Purposes</header><text display-inline="yes-display-inline">The purposes of the program are to fund,
				facilitate the development and installation of, and evaluate marine and
				hydrokinetic renewable energy projects, in partnership with Federally Funded
				Research and Development Centers, and in conjunction with
				<added-phrase committee-id="SSEG00" reported-display-style="italic">Centers
				established under section 634,</added-phrase> universities and other
				institutions of higher education, private business entities, and other
				appropriate organizations, in order—</text>
							<paragraph id="H833829C683EA419384684C95D7DB69E5"><enum>(1)</enum><text>to increase marine
				and hydrokinetic renewable energy experience; and</text>
							</paragraph><paragraph id="HBD1EB891BE1745AF801555FF39ABB8E7"><enum>(2)</enum><text>to build and
				operate enough candidate devices to obtain statistically significant operating
				and maintenance data.</text>
							</paragraph></subsection><subsection id="HAF0287A3EC9C48AD9C00DDB8338C59EB"><enum>(c)</enum><header>Objectives</header><text display-inline="yes-display-inline">The objectives of the program shall
				include—</text>
							<paragraph id="H6ECFA7024FD64BB0B0B57090856A175"><enum>(1)</enum><text>verifying the
				performance, reliability, maintainability, and cost of new marine and
				hydrokinetic renewable energy device designs and system components in an
				operating environment;</text>
							</paragraph><paragraph id="HA64839687C71403CB4D5510150EC9B01"><enum>(2)</enum><text>providing States,
				regulators, utilities, and other stakeholders with a valid opportunity to test
				and evaluate marine and hydrokinetic renewable energy technology in new
				areas;</text>
							</paragraph><paragraph id="HFA00159734BE4C9DB0AE30800E01766"><enum>(3)</enum><text>documenting and
				communicating the experience from those projects for the benefit of utilities,
				independent power producers, other nonutility generators, device suppliers, and
				others in the marine and hydrokinetic renewable energy development community;
				and</text>
							</paragraph><paragraph id="id54DFF8DCE65940CFBE06C349F7839E82"><enum>(4)</enum><text>resolving
				environmental issues through robust characterization, reliable impact
				prediction, effective monitoring, development, and use of adaptive management,
				and informing engineering design to improve environmental
				performance.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="id28E1B60596724BCCA9A65345F5175C27"><enum>6.</enum><header>Adaptive
			 management and environmental grant program</header><text display-inline="no-display-inline">The Energy Independence and Security Act of
			 2007 (42 U.S.C. 17211 et seq.) (as amended by section 5) is amended by
			 inserting after section 635 the following:</text>
			<quoted-block display-inline="no-display-inline" id="idCF0AF6B1DBCD4CF4A53F25E1CB398EB2" style="OLC">
				<section id="H36B90584917F49CCA7844BADA7B679EA"><enum>636.</enum><header>Adaptive
				management and environmental grant program</header>
					<subsection id="HA0A4D025615148ACA5D9F2892F96343D"><enum>(a)</enum><header>Findings</header><text>Congress
				finds that—</text>
						<paragraph id="H86CA616B395A4B08949DC39D59F2433F"><enum>(1)</enum><text>the use of marine
				and hydrokinetic renewable energy technologies can reduce contributions to
				global warming;</text>
						</paragraph><paragraph id="id8C07244CE9454E3C86F8B546F99134AC"><enum>(2)</enum><text>marine and
				hydrokinetic renewable energy technologies can be produced domestically;</text>
						</paragraph><paragraph id="HCAC8A7F84FE9402EAC35DAD6D651892F"><enum>(3)</enum><text>marine and
				hydrokinetic renewable energy is a nascent industry; and</text>
						</paragraph><paragraph id="H1A357A4B0C5B48A49319D4B2CB76DAB8"><enum>(4)</enum><text>the United States
				must work to promote new renewable energy technologies that reduce
				contributions to global warming gases and improve domestic energy
				production.</text>
						</paragraph></subsection><subsection id="H67A26F87EB4F4123801326ED930539F3"><enum>(b)</enum><header>Grant
				program</header>
						<paragraph id="id95BE1F4AE0944A20822D79DB2AB3FE8C"><enum>(1)</enum><header>In
				general</header><text>As soon as practicable after the date of enactment of
				this subsection, the Secretary shall establish a program under which the
				Secretary shall award grants to eligible entities—</text>
							<subparagraph id="idC8DA3A6E12FD465BB6F582AD3C0E26B7"><enum>(A)</enum><text>to advance the
				development of marine and hydrokinetic renewable energy;</text>
							</subparagraph><subparagraph id="ID0562fc96633842c098897af3763aaefc"><enum>(B)</enum><text>to help fund the
				costs of environmental analysis affecting the deployment of marine hydrokinetic
				devices;</text>
							</subparagraph><subparagraph id="idE24179A12D8E444EB4DC29FFBDAB576C"><enum>(C)</enum><text>to help enable
				the eligible entities—</text>
								<clause id="idE34B3630421F4D368BB2ED8A27AF832A"><enum>(i)</enum><text>to gather and
				collect the types of environmental data that are required when working in a
				public resource (including the waterways and oceans of the United States);
				and</text>
								</clause><clause id="idE45B80F4FB25435ABD75651670C80B2C"><enum>(ii)</enum><text>to monitor the
				impacts of demonstration projects and make the resulting information available
				for widespread dissemination to aid future projects; and</text>
								</clause></subparagraph><subparagraph id="idCF5E72F22A9C43D1BA8A8DA127A769A4"><enum>(D)</enum><text>to help fund the
				cost of advancing renewable marine and hydrokinetic technologies in ocean and
				riverine environments from demonstration projects to development and
				deployment.</text>
							</subparagraph></paragraph><paragraph id="id0E0C3674E8DF460A8007531C8822118B"><enum>(2)</enum><header>Application</header><text>To
				be eligible to receive a grant under this paragraph, an entity shall submit to
				the Secretary an application at such time, in such manner, and containing such

		</section><section id="idDBBCF18B3C9A4C339E38799AEBC0F31D"><enum>7.</enum><header>Administration</header><text display-inline="no-display-inline">The Energy Independence and Security Act of
			 2007 (42 U.S.C. 17211 et seq.) (as amended by section 6) is amended by
			 inserting after section 636 the following:</text>

				<section id="IDe41cb931cd3f4d81a01b5b794105cb81"><enum>637.</enum><header>Administration</header>
					<subsection id="ID7edca24b44574a2498ef3e2c26e7a6cc"><enum>(a)</enum><header>In
				general</header><text>In carrying out this subtitle, the Secretary
				shall—</text>
						<paragraph id="id95B2BEBC5C4B4860A27A848E10B845BC"><enum>(1)</enum><text>coordinate and
				avoid duplication of activities across programs of the Department and other
				applicable Federal agencies, including the National Laboratories;</text>
						</paragraph><paragraph id="ID033b28dbc6ba49f7bbefb0e453c013b9"><enum>(2)</enum><text>collaborate with
				(as applicable)—</text>
							<subparagraph id="id6BA4CB31D34B4D738B68BFE399318AF8"><enum>(A)</enum><text>industry;</text>
							</subparagraph><subparagraph id="id1168469A43DB4D619F71FE0C4284CE8A"><enum>(B)</enum><text>stakeholders;</text>
							</subparagraph><subparagraph id="id52005D54706D4A67A9D0AF38B88DF65B"><enum>(C)</enum><text>other Federal
				agencies, including the National Laboratories;</text>
							</subparagraph><subparagraph id="id062C51BE8E9F4E46A84E58D2AD9E0F54"><enum>(D)</enum><text>academic
				institutions; and</text>
							</subparagraph><subparagraph id="id74743AC3C2184DBEBB190C8B7BE22B37"><enum>(E)</enum><text>international
				bodies with relevant scientific expertise; and</text>
							</subparagraph></paragraph><paragraph id="ID6791ff8f87ca490dba37c6b5556be731"><enum>(3)</enum><text>obtain from the
				recipient of assistance and make available to the public, through Web sites,
				reports, and databases of the Department, any research, development,
				demonstration, and commercial application information produced with respect to
				supported technology, including information obtained after the completion of
				supported activities, except to the extent that the information is protected
				from disclosure under section 552(b) of title 5, United States Code.</text>
						</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDdf595169bd47451596563ed3a8eae1ca"><enum>(b)</enum><header>Reports</header><text>Not
				later than 1 year after the date of enactment of this section and at least once
				every 2 years thereafter, the Secretary shall submit to Congress a report on
				findings and activities conducted under this
				subtitle.</text>
					</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>

				the amount authorized to be appropriated for each fiscal year under subsection
				(a), $75,000,000 shall be derived for each fiscal year from the amount
				authorized for energy-intensive industries efficiency programs under section
				452(f) of the Energy Independence and Security Act of 2007 (42 U.S.C. 17111(f))
				for each of fiscal years 2012 through 2015.</text>
					</subsection><subsection id="id44BBC95E6D8D4929B4C448FD0C371FFD"><enum>(c)</enum><header>Renewable energy
				funds</header><text>No funds shall be appropriated under this section for
				activities that are receiving funds under section 931(a)(2)(E)(i) of the Energy
				Policy Act of 2005 (42 U.S.C.
				16231(a)(2)(E)(i)).</text>

			 inserting <quote>2011</quote>.</text>

				of—</text>
									<subclause id="IDd230840e550c48fda18baad17746b7c3"><enum>(I)</enum><text>a lake tap (but not a
				perched alpine lake); or</text>
									</subclause><subclause id="id446CED620C544D2998366AF65F1EAC59"><enum>(II)</enum><text>a run-of-river screened
				at the point of diversion; and</text>
									</subclause></clause></subparagraph><subparagraph id="ID07a6ccbb8e8f4ccbbf414c13fbd4037e"><enum>(B)</enum><text>has a nameplate capacity
				rating of a wattage that is not more than 15
				megawatts.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="idB364A25A08D54DBB9F71B2BEABC82AC2"><enum>(c)</enum><header>Renewable energy
			 construction grants</header><text>Section 803(b) of the Energy Independence and
