			 <quote><short-title>Sunshine in Litigation Act of
			 2011</short-title></quote>.</text>

			 protective orders and sealing of cases and settlements</header>
			<subsection commented="no" display-inline="no-display-inline" id="id77fd14e8-07a6-4c54-bc01-e863c7ee175c"><enum>(a)</enum><header>In
			 general</header><text>Chapter 111 of title 28, United States Code, is amended
			 by adding at the end the following:</text>
				<quoted-block changed="deleted" committee-id="SSJU00" id="id017151b3-5aa6-47c9-8e7d-44ef91f04e4f" reported-display-style="strikethrough" style="USC">
					<section id="id2e46da06-190a-419f-b99c-60d62ea0c8a0"><enum>1660.</enum><header>Restrictions
				on protective orders and sealing of cases and settlements</header>
						<subsection id="id262b117f-5341-4c4c-b9fa-d177a3cf3bd8"><enum>(a)</enum><paragraph commented="no" display-inline="yes-display-inline" id="id390bd736-857b-45b8-aa16-d13f406afeba"><enum>(1)</enum><text>In any civil action
				in which the pleadings state facts that are relevant to the protection of
				public health or safety, a court shall not enter, by stipulation or otherwise,
				an order otherwise authorized under rule 26(c) of the Federal Rules of Civil
				Procedure restricting the disclosure of information obtained through discovery,
				an order approving a settlement agreement that would restrict the disclosure of
				such information, or an order restricting access to court records unless in
				connection with such order the court has first made independent findings of
				fact that—</text>
								<subparagraph changed="deleted" committee-id="SSJU00" id="id1625a9ef-7acb-4c71-82cc-716628dd2b6b" indent="up1" reported-display-style="strikethrough"><enum>(A)</enum><text>such order would
				not restrict the disclosure of information which is relevant to the protection
				of public health or safety; or</text>
								</subparagraph><subparagraph changed="deleted" committee-id="SSJU00" id="id5df9a1ab-77c1-4c9f-941e-74c3e0e8cd5b" indent="up1" reported-display-style="strikethrough"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="idb534095f-181c-45fd-82ae-7c239bdcb5c2"><enum>(i)</enum><text>the public interest
				in the disclosure of past, present, or potential health or safety hazards is
				outweighed by a specific and substantial interest in maintaining the
				confidentiality of the information or records in question; and</text>
									</clause><clause changed="deleted" committee-id="SSJU00" id="id73573b70-4614-445d-961c-2a4124e374df" indent="up1" reported-display-style="strikethrough"><enum>(ii)</enum><text>the requested
				order is no broader than necessary to protect the confidentiality interest
				asserted.</text>
									</clause></subparagraph></paragraph><paragraph changed="deleted" committee-id="SSJU00" id="iddeca0d08-db55-4a31-8ff6-908362d33d5d" indent="up1" reported-display-style="strikethrough"><enum>(2)</enum><text>No order entered
				as a result of the operation paragraph (1), other than an order approving a
				settlement agreement, may continue in effect after the entry of final judgment,
				unless at the time of, or after, such entry the court makes a separate finding
				of fact that the requirements of paragraph (1) continue to be met.</text>
							</paragraph><paragraph changed="deleted" committee-id="SSJU00" id="idb9a13b57-ad7d-4a17-becc-3ac6a363bad2" indent="up1" reported-display-style="strikethrough"><enum>(3)</enum><text>The party who is
				the proponent for the entry of an order, as provided under this section, shall
				have the burden of proof in obtaining such an order.</text>
							</paragraph><paragraph changed="deleted" committee-id="SSJU00" id="id0c4335f8-af91-4f5b-b57d-497cac906f78" indent="up1" reported-display-style="strikethrough"><enum>(4)</enum><text>This section shall
				apply even if an order under paragraph (1) is requested—</text>
								<subparagraph id="id611d07dd-df89-4739-a1b8-4aeee3f69835"><enum>(A)</enum><text>by motion pursuant
				to rule 26(c) of the Federal Rules of Civil Procedure; or</text>
								</subparagraph><subparagraph id="id5ed8a846-e51d-40e7-ae11-f69b7527c832"><enum>(B)</enum><text>by application
				pursuant to the stipulation of the parties.</text>
								</subparagraph></paragraph><paragraph changed="deleted" committee-id="SSJU00" id="idb8e15699-d99b-4ddc-926c-653d2edb9989" indent="up1" reported-display-style="strikethrough"><enum>(5)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id8732e85c-cbe2-4665-9878-138170c55317"><enum>(A)</enum><text>The provisions of
				this section shall not constitute grounds for the withholding of information in
				discovery that is otherwise discoverable under rule 26 of the Federal Rules of
				Civil Procedure.</text>
								</subparagraph><subparagraph changed="deleted" committee-id="SSJU00" id="ID53161fad1bc54b42a198c0130315eee0" indent="up1" reported-display-style="strikethrough"><enum>(B)</enum><text>A court shall not
				approve any party’s stipulation or request to stipulate to an order that would
				violate this section.</text>
								</subparagraph></paragraph></subsection><subsection id="idbaeb4f3c-333d-457e-b7c9-a0a48a5c3d70"><enum>(b)</enum><paragraph commented="no" display-inline="yes-display-inline" id="id4f0273e1-f6ff-4a9e-bfc8-1de0d2d3805e"><enum>(1)</enum><text>In any civil action
				in which the pleadings state facts that are relevant to the protection of
				public health or safety, a court shall not approve or enforce any provision of
				an agreement between or among parties, or approve or enforce an order entered
				as a result of the operation of subsection (a)(1), to the extent that such
				provision or such order prohibits or otherwise restricts a party from
				disclosing any information relevant to such civil action to any Federal or
				State agency with authority to enforce laws regulating an activity relating to
				such information.</text>
							</paragraph><paragraph changed="deleted" committee-id="SSJU00" id="id129fc54a-9f61-4568-8bfc-f17e9e8f983f" indent="up1" reported-display-style="strikethrough"><enum>(2)</enum><text>Any such
				information disclosed to a Federal or State agency shall be confidential to the
				extent provided by law.</text>
							</paragraph></subsection><subsection id="id58465900-ae84-4fac-acbc-bdbd58b8195e"><enum>(c)</enum><paragraph commented="no" display-inline="yes-display-inline" id="id334640b4-7249-4991-9713-d627bec0e298"><enum>(1)</enum><text>Subject to
				paragraph (2), a court shall not enforce any provision of a settlement
				agreement described under subsection (a)(1) between or among parties that
				prohibits 1 or more parties from—</text>
								<subparagraph changed="deleted" committee-id="SSJU00" id="id7c448895-b53e-4764-8682-dfee3b314f95" indent="up1" reported-display-style="strikethrough"><enum>(A)</enum><text>disclosing the
				fact that such settlement was reached or the terms of such settlement, other
				than the amount of money paid; or</text>
								</subparagraph><subparagraph changed="deleted" committee-id="SSJU00" id="id38ba930f-9b0a-4dc0-a6be-1f50784a1055" indent="up1" reported-display-style="strikethrough"><enum>(B)</enum><text>discussing a civil
				action, or evidence produced in the civil action, that involves matters
				relevant to the protection of public health or safety.</text>
								</subparagraph></paragraph><paragraph changed="deleted" committee-id="SSJU00" id="id54c9c6a5-caa4-4c28-8f4e-8c019609c4f1" indent="up1" reported-display-style="strikethrough"><enum>(2)</enum><text>Paragraph (1)
				applies unless the court has made independent findings of fact that—</text>
								<subparagraph id="id3324F4E0346D4A2C9D981A6487893D1A"><enum>(A)</enum><text>the public
				interest in the disclosure of past, present, or potential public health or
				safety hazards is outweighed by a specific and substantial interest in
				maintaining the confidentiality of the information or records in question;
				and</text>
								</subparagraph><subparagraph id="id162FD305810044979A05FBA10E0E4524"><enum>(B)</enum><text>the requested
				order is no broader than necessary to protect the confidentiality interest
				asserted.</text>
								</subparagraph></paragraph></subsection><subsection id="idA5561587BF7249B0BAA9735AEF26783C"><enum>(d)</enum><text>When weighing the
				interest in maintaining confidentiality under this section, there shall be a
				rebuttable presumption that the interest in protecting personally identifiable
				information relating to financial, health or other similar information of an
				individual outweighs the public interest in disclosure.</text>
						</subsection><subsection id="idD6FF0D9AC7F547599C3B8802B157505E"><enum>(e)</enum><text>Nothing in this
				section shall be construed to permit, require, or authorize the disclosure of
				classified information (as defined under section 1 of the Classified
				Information Procedures Act (18 U.S.C.
				App.)).</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="idc6a60dc6-ac67-4828-90d3-48d3b467060d"><enum>(b)</enum><header>Technical and
			 conforming amendment</header><text>The table of sections for chapter 111 of
			 title 28, United States Code, is amended by adding after the item relating to
			 section 1659 the following:</text>

			 date</header><text display-inline="no-display-inline">The amendments made by
			 this Act shall—</text>
			<paragraph id="id166b7325-78ec-4e70-9cd5-1bf476367ed2"><enum>(1)</enum><text>take effect 30
			 days after the date of enactment of this Act; and</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc2629257-3255-4860-bd0f-61d0bd41cbae"><enum>(2)</enum><text>apply only to
			 orders entered in civil actions or agreements entered into on or after such
			 date.</text>

			<subsection commented="no" display-inline="no-display-inline" id="id7644b7ed-7902-40bd-93de-fe351557f3b3"><enum>(a)</enum><header>In
			 general</header><text>Chapter 111 of title 28, United States Code, is amended
			 by adding at the end the following:</text>

					<section id="id4ea0e2a6-07eb-410d-9ea9-33ae41d25f14"><enum>1660.</enum><header>Restrictions on
				protective orders and sealing of cases and settlements</header>
						<subsection id="id8c0309d0-c652-4743-b9f2-66da5dcaac9a"><enum>(a)</enum><paragraph commented="no" display-inline="yes-display-inline" id="idb4425e22-611d-4452-aef1-1f819aa3bf01"><enum>(1)</enum><text>Except as provided
				under subsection (e), in any civil action in which the pleadings state facts
				that are relevant to the protection of public health or safety, a court shall
				not enter, by stipulation or otherwise, an order otherwise authorized under
				rule 26(c) of the Federal Rules of Civil Procedure restricting the disclosure
				of information obtained through discovery, an order approving a settlement
				agreement that would restrict the disclosure of such information, or an order
				restricting access to court records unless in connection with such order the
				court has first made independent findings of fact that—</text>
								<subparagraph changed="added" committee-id="SSJU00" id="id6ae50562-39fe-41a6-ba6f-c0fb8622846c" indent="up1" reported-display-style="italic"><enum>(A)</enum><text>such order would not
				restrict the disclosure of information which is relevant to the protection of
				public health or safety; or</text>
								</subparagraph><subparagraph changed="added" committee-id="SSJU00" id="id3fc3f663-2ac3-48a1-a688-078e89061717" indent="up1" reported-display-style="italic"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="id1ccc9623-cf11-43fb-99e2-a777a7327e83"><enum>(i)</enum><text>the public interest
				in the disclosure of past, present, or potential health or safety hazards is
				outweighed by a specific and substantial interest in maintaining the
				confidentiality of the information or records in question; and</text>
									</clause><clause changed="added" committee-id="SSJU00" id="id1e3cde15-2c96-4cee-b7e2-cde680c91ca0" indent="up1" reported-display-style="italic"><enum>(ii)</enum><text>the requested order is
				no broader than necessary to protect the confidentiality interest
				asserted.</text>
									</clause></subparagraph></paragraph><paragraph changed="added" committee-id="SSJU00" id="idf82bf5ab-a991-4eb9-9ef0-6a56b23f21ed" indent="up1" reported-display-style="italic"><enum>(2)</enum><text>No order entered as a
				result of the operation paragraph (1), other than an order approving a
				settlement agreement, may continue in effect after the entry of final judgment,
				unless at the time of, or after, such entry the court makes a separate finding
				of fact that the requirements of paragraph (1) continue to be met.</text>

								<subparagraph id="id5886be7f-b8c4-4e13-835b-e1e2ae56e71a"><enum>(A)</enum><text>by motion pursuant to

								</subparagraph><subparagraph id="ide85c6a5d-8dbb-4b45-b3d2-6b45461f014b"><enum>(B)</enum><text>by application pursuant

								</subparagraph></paragraph><paragraph changed="added" committee-id="SSJU00" id="id646c6246-6117-4c2c-b3d9-8c9c45c10343" indent="up1" reported-display-style="italic"><enum>(5)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id418dca6d-dfa4-4775-bd93-8fed2a02b15e"><enum>(A)</enum><text>The provisions of

							</paragraph><paragraph changed="added" committee-id="SSJU00" id="id94a5a755-e00f-4239-872d-deddcc5ed82e" indent="up1" reported-display-style="italic"><enum>(2)</enum><text>Any such information
				disclosed to a Federal or State agency shall be confidential to the extent
				provided by law.</text>
							</paragraph></subsection><subsection id="idc597290c-93cc-4047-84fc-3f0b4cf73269"><enum>(c)</enum><paragraph commented="no" display-inline="yes-display-inline" id="id8dc6a456-df95-4831-a554-ce6c6754ae3a"><enum>(1)</enum><text>Subject to
				paragraph (2), a court shall not enforce any provision of a settlement
				agreement described under subsection (a)(1) between or among parties that
				prohibits 1 or more parties from—</text>
								<subparagraph changed="added" committee-id="SSJU00" id="id4b10671f-c03f-4f65-9ec5-348a18978b72" indent="up1" reported-display-style="italic"><enum>(A)</enum><text>disclosing the fact that
				such settlement was reached or the terms of such settlement, other than the
				amount of money paid; or</text>
								</subparagraph><subparagraph changed="added" committee-id="SSJU00" id="id49d727b7-ff15-4ed8-be86-d34eb5244c1b" indent="up1" reported-display-style="italic"><enum>(B)</enum><text>discussing a civil
				action, or evidence produced in the civil action, that involves matters
				relevant to the protection of public health or safety.</text>
								</subparagraph></paragraph><paragraph changed="added" committee-id="SSJU00" id="id8f19bcc6-88f5-4c2a-b3ca-46b7fae5a22b" indent="up1" reported-display-style="italic"><enum>(2)</enum><text>Paragraph (1) applies
				unless the court has made independent findings of fact that—</text>
								<subparagraph id="id6c6eb0b2-adbc-4fdb-b80c-df0e3997e78c"><enum>(A)</enum><text>the public interest in
				the disclosure of past, present, or potential public health or safety hazards
				is outweighed by a specific and substantial interest in maintaining the
				confidentiality of the information or records in question; and</text>
								</subparagraph><subparagraph id="id3a54045d-ce86-4753-aeca-a9cb082540ab"><enum>(B)</enum><text>the requested order is no
				broader than necessary to protect the confidentiality interest asserted.</text>
								</subparagraph></paragraph></subsection><subsection id="id9c86e4a4-4be6-4c98-ba05-b808ba881ab0"><enum>(d)</enum><text>When weighing the
				interest in maintaining confidentiality under this section, there shall be a
				rebuttable presumption that the interest in protecting personally identifiable
				information relating to financial, health or other similar information of an
				individual outweighs the public interest in disclosure.</text>
						</subsection><subsection id="idE76A9BC646A44A97A1084826E05DC927"><enum>(e)</enum><text>Nothing in this
				section—</text>
							<paragraph id="id05C8C77BA5E5480CB273BEEC206EDB3E"><enum>(1)</enum><text>shall prohibit a court
				from entering an order that would restrict the disclosure of information, or an
				order restricting access to court records, if in either instance such order is
				necessary to protect from public disclosure—</text>
								<subparagraph id="idE86C1B93C68A408AB766E13B7FA0D638"><enum>(A)</enum><text>information classified
				under criteria established by an Executive order to be kept secret in the
				interest of national defense or foreign policy; or</text>
								</subparagraph><subparagraph id="id5FAA6F31DB944D1DAFEEBB9B686A6110"><enum>(B)</enum><text>intelligence sources and
				methods; or</text>
								</subparagraph></paragraph><paragraph id="id68D8878E1D794B37B273C6E6E93ABBFB"><enum>(2)</enum><text>shall be construed to
				permit, require, or authorize the disclosure of information that—</text>
								<subparagraph id="id46167530CB5F46079BFDEAB211598825"><enum>(A)</enum><text>is classified under
				criteria established by an Executive order to be kept secret in the interest of
				national defense or foreign policy; or</text>
								</subparagraph><subparagraph id="id77EE2773938D412B93E3DCEE63DD2747"><enum>(B)</enum><text>reveals intelligence
				sources and
				methods.</text>
								</subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="id9d7872ee-cbea-4e05-85d5-01c62f592438"><enum>(b)</enum><header>Technical and

			 application</header><text display-inline="no-display-inline">The amendments
			 made by this Act shall—</text>
			<paragraph id="idffd5adf7-74a6-44d4-8ff8-df08d9f9f6b0"><enum>(1)</enum><text>take effect 30 days after
			 the date of enactment of this Act;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd6d8896c-e256-4802-98d5-c3276f796344"><enum>(2)</enum><text>apply only to orders
			 entered in civil actions or agreements entered into on or after the effective
			 date of this Act; and</text>
			</paragraph><paragraph commented="no" id="ID27932844745647acac34222be5c2df82"><enum>(3)</enum><text>not provide a basis for
			 the—</text>
				<subparagraph commented="no" id="id7F0E588732E840D5828011A49048D4E4"><enum>(A)</enum><text>granting of a motion to
