		<official-title display="yes">To require the Attorney General to consult
		  with appropriate officials within the executive branch prior to making the
		  decision to try an unprivileged enemy belligerent in Federal civilian
		  court.</official-title>

	<legis-body display-enacting-clause="yes-display-enacting-clause" style="OLC">
		<section id="id0FB43F065BC143CB914F4A3C23AC7DE6" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Securing Terrorist Intelligence
			 Act</short-title></quote>.</text>
		</section><section id="id87D212F454E842FB9983838EFA52C73F"><enum>2.</enum><header>Consultation
			 requirement</header>
			<subsection commented="no" display-inline="no-display-inline" id="ID1a1d5f9c6ab24b9fafe4ab2f5e43bd05"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subject to subsection (b), no action shall
			 be taken by the Attorney General, or any officer or employee of the Department
			 of Justice, to—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="ID9eff9538bf7b45dab48a77e828126549"><enum>(1)</enum><text display-inline="yes-display-inline">initiate a custodial interrogation of;
			 or</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID71e75c66f574404ebc596e6068c1ff72"><enum>(2)</enum><text display-inline="yes-display-inline">file a civilian criminal complaint,
			 information, or indictment against;</text>
				</paragraph><continuation-text commented="no" continuation-text-level="subsection">any foreign person detained by the
			 United States Government because they may have engaged in conduct constituting
			 an act of war against the United States, terrorism, or material support to
			 terrorists, or activities in preparation therefor.</continuation-text></subsection><subsection commented="no" display-inline="no-display-inline" id="IDd897cec2599d4908b3e3859312ab5e44"><enum>(b)</enum><header display-inline="yes-display-inline">Consultation</header>
				<paragraph commented="no" display-inline="no-display-inline" id="ID5a2c0b4f6c664e849eab8f36be7eb329"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subject to paragraph (2), the Attorney
			 General shall consult with the Director of National Intelligence, the Director
			 of the National Counterterrorism Center, the Secretary of Homeland Security,
			 and the Secretary of Defense prior to taking any action identified in
			 subsection (a).</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID90bea1ee9b584c689fb9921cc2286494"><enum>(2)</enum><header display-inline="yes-display-inline">Presidential direction</header><text display-inline="yes-display-inline">If, following consultation under paragraph
			 (1), the Director of National Intelligence, the Director of the National
			 Counterterrorism Center, the Secretary of Homeland Security, or the Secretary
			 of Defense believe that any action identified in subsection (a) and proposed by
			 the Attorney General may prevent the collection of intelligence related to
			 terrorism or threats of violence against the United States or its citizens, the
			 Attorney General may not initiate such action without specific direction from
			 the President.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDafd7a2f369dd4d909d296a1b43586307"><enum>(c)</enum><header display-inline="yes-display-inline">Annual report</header><text display-inline="yes-display-inline">The Attorney General shall report annually
			 to appropriate committees of jurisdiction regarding the number of occasions on
			 which direction was sought from the President under subsection (b)(2) and the
			 number of times, on those occasions, that the President directed actions
			 identified in section (a) against such foreign person.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="IDde116ce09a534e41bd40af9c577c45c8"><enum>(d)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section:</text>
				<paragraph commented="no" display-inline="no-display-inline" id="ID7b940c1a2eea4e059978e738dd949e91"><enum>(1)</enum><header display-inline="yes-display-inline">Appropriate committees of
			 jurisdiction</header><text display-inline="yes-display-inline">The term
			 <term>appropriate committees of jurisdiction</term> shall include—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="ID9add5ad0790b4c11bfe7b93e2e86b984"><enum>(A)</enum><text display-inline="yes-display-inline">the Committee on Homeland Security and
			 Governmental Affairs of the Senate;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID401e96c017a74b07bd59a7a96804401e"><enum>(B)</enum><text display-inline="yes-display-inline">the Committee on Homeland Security of the
			 House of Representatives;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID3f71d2a337ef41699c0d520b2bdc9362"><enum>(C)</enum><text display-inline="yes-display-inline">the Select Committee on Intelligence of the
			 Senate;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDba6be418b21a4a73b2f9baba4c636b28"><enum>(D)</enum><text display-inline="yes-display-inline">the Permanent Select Committee on
			 Intelligence of the House of Representatives; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDc256a1dbfb0c4af391b3aea32a6498e1"><enum>(E)</enum><text display-inline="yes-display-inline">the Committees on Armed Services and
			 Judiciary of the Senate and the Committees on Armed Services and Judiciary of
			 the House of Representatives.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDb761ae34be39461f895dd5fc47f34352"><enum>(2)</enum><header display-inline="yes-display-inline">Act of war, terrorism, material support to
			 terrorists</header><text display-inline="yes-display-inline">The terms
			 <term>act of war</term>, <term>terrorism</term>, and <term>material support to
			 terrorists</term> shall have the meanings given such terms in title 18, United
			 States Code.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID7a2e2bcbcc1d4b9aa4c99f0c23231eff"><enum>(e)</enum><header display-inline="yes-display-inline">Savings
			 clause</header><text display-inline="yes-display-inline">Nothing in this
			 section shall prevent the Attorney General, or any officer or employee of the
			 Department of Justice, from apprehending or detaining an individual as
			 authorized by the Constitution or laws of the United States except to the
			 extent that activities incident to such apprehension or detention are
			 specifically identified in subsection (a).</text>
