			 maintenance reform</header>
			<section id="idBA4CE557DAFC4567ACDF9789A0279FB5"><enum>101.</enum><header>Purpose</header><text display-inline="no-display-inline">The purpose of this title is to establish a
			 harbor maintenance block grant program to provide the maximum flexibility to
			 each State to carry out harbor maintenance and deepening projects in the
			 State.</text>
			</section><section id="id10473B9DBCE544B6BDA67220811CDDF8"><enum>102.</enum><header>Definitions</header><text display-inline="no-display-inline">Except as otherwise specifically provided,
			 in this title:</text>
				<paragraph id="id11B7C537D5374495971F85F62FD1C8E0"><enum>(1)</enum><header>Harbor
			 maintenance</header><text>The term <term>harbor maintenance</term> means any
			 project directly related to the operations and maintenance of a harbor,
			 including additional development of a harbor.</text>
				</paragraph><paragraph id="id48B8949712F14B2E845925A4F109922F"><enum>(2)</enum><header>Lead
			 agency</header><text>The term <term>lead agency</term> means the agency
			 designated under section 106(a).</text>
				</paragraph><paragraph id="id5D998875A0AF466AA543F9AFFADF69AF"><enum>(3)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of the Army, acting through the
			 Chief of Engineers.</text>
				</paragraph><paragraph id="ID914346B62C5D497EA7E427F09091F8FA"><enum>(4)</enum><header>State</header><text>The
			 term <term>State</term> means—</text>
					<subparagraph id="ID1AA0C8024B5B488EA17F81A36FBC1821"><enum>(A)</enum><text>a State;</text>
					</subparagraph><subparagraph id="ID792A8B98FE9C42679797E3F1D68FC25F"><enum>(B)</enum><text>the District of
			 Columbia;</text>
					</subparagraph><subparagraph id="ID28D43A31F3264D79A65D4436F400AF2F"><enum>(C)</enum><text>the Commonwealth
			 of Puerto Rico; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID4912258B462B4AAD8DC29F5610699D3D"><enum>(D)</enum><text>any other
			 territory or possession of the United States.</text>
					</subparagraph></paragraph></section><section id="idBA27586FA0ED4874B3A0435597211016"><enum>103.</enum><header>Funding</header><text display-inline="no-display-inline">The harbor maintenance block grant program
			 established under section 104 shall be funded from the State Harbor Maintenance
			 Block Grant Account established under section 9505 of the Internal Revenue Code
			 of 1986.</text>
			</section><section id="idA756CCDA7D144B6D8BA333E9CB40F3CC"><enum>104.</enum><header>Establishment
			 of harbor maintenance block grant program</header><text display-inline="no-display-inline">The Secretary shall establish a program to
			 make grants to States in accordance with this title to carry out harbor
			 maintenance and deepening projects located in participating States in
			 accordance with the priorities determined by each participating State,
			 including operations and maintenance, investigations, site infrastructure
			 improvements, and new construction projects at harbors.</text>
			</section><section id="id9DEC43A9C13E44308DB8299ECE106672"><enum>105.</enum><header>Reports</header>
				<subsection id="id26411C1620F8409EABB807D103730EE7"><enum>(a)</enum><header>In
			 general</header><text>To be eligible to receive and expend amounts for a fiscal
			 year under this title, a State shall prepare and submit to the Secretary a
			 report describing the activities that the State intends to carry out using
			 amounts received under this title, including information on the types of
			 activities to be carried out.</text>
				</subsection><subsection id="idE1A2EB91565A42499D2F6839BD6B3C08"><enum>(b)</enum><header>Availability
			 and comment</header><text>A report under subsection (a) shall be made public
			 within the State in such a manner as to facilitate comment by any person
			 (including any Federal or other public agency) during the development of the
			 report and after the completion of the report.</text>
				</subsection><subsection id="id7BFB199EB9064960A1E6A018ED1C0F34"><enum>(c)</enum><header>Revision</header>
					<paragraph id="id1D5BA0DE8CD94190983E11E682E37906"><enum>(1)</enum><header>In
			 general</header><text>The report shall be revised throughout the year as may be
			 necessary to reflect substantial changes in the activities assisted using
			 amounts provided under this title.</text>
					</paragraph><paragraph id="idBF5CC1C9295B45E892B772749C42F956"><enum>(2)</enum><header>Availability
			 and comment</header><text>Any revision in the report shall be subject to
			 subsection (b).</text>
					</paragraph></subsection><subsection id="idECC332110B0B452EBF5945C67DD5BE8A"><enum>(d)</enum><header>No additional
			 reports</header><text>The Secretary may not impose any reporting requirements
			 on States to carry out this title that are in addition to the reports
			 specifically required under this title.</text>
				</subsection></section><section id="idA50DA358CD5B4CAEBD90E7CED10845CB"><enum>106.</enum><header>Lead
			 agency</header>
				<subsection id="idB10918AD888B43FAA136CB12DAFCC69B"><enum>(a)</enum><header>Designation</header><text>The
			 chief executive officer of a State that seeks to receive a grant under this
			 title shall designate, in an application submitted to the Secretary under
			 section 107, an appropriate State agency that complies with subsection (b) to
			 act as the lead agency for the State.</text>
				</subsection><subsection id="idD869EA0076934FCAB57EBDA82E128770"><enum>(b)</enum><header>Duties</header>
					<paragraph id="id8DFD1BEDA76144C4A1FE9A975311130F"><enum>(1)</enum><header>In
			 general</header><text>The lead agency shall—</text>
						<subparagraph id="id6DB037DFD709497D91476C8EE051E410"><enum>(A)</enum><text>administer,
			 directly or through other State agencies, the financial assistance received
			 under this title by the State;</text>
						</subparagraph><subparagraph id="idCB33F49C56C24ED58707A4532E9614E8"><enum>(B)</enum><text>develop the State
			 plan to be submitted to the Secretary under section 107(a)(2);</text>
						</subparagraph><subparagraph id="idEB02F224AB854F3594CFF24B64ACF30B"><enum>(C)</enum><text>in conjunction
			 with the development of the State plan, hold at least 1 hearing in the State to
			 provide to the public an opportunity to comment on the State plan; and</text>
						</subparagraph><subparagraph id="id586D884D246148E3888917EA52539387"><enum>(D)</enum><text>coordinate the
			 implementation of harbor maintenance projects under this title with applicable
			 Federal, State, and local agencies.</text>
						</subparagraph></paragraph><paragraph id="id3B94D7A3CC8E44F39E05D589F2D2B2FC"><enum>(2)</enum><header>Development of
			 plan</header><text>In the development of the State plan described in paragraph
			 (1)(B), the lead agency shall consult with appropriate representatives of units
			 of general purpose local government on issues relating to the State
			 plan.</text>
					</paragraph></subsection></section><section id="id76EC134975934ADD9B76E6E551819A7E"><enum>107.</enum><header>Application
			 and plan</header>
				<subsection id="id7FE35562CFF1485480E999B9DBA7CFBC"><enum>(a)</enum><header>Application</header><text>To
			 be eligible to receive assistance under this title, a State shall prepare and
			 submit to the Secretary an application at such time, in such manner, and
			 containing such information as the Secretary shall by rule require,
			 including—</text>
					<paragraph id="idF42910E40B6A4342B2507F7135B18C95"><enum>(1)</enum><text>an assurance that
			 the State will comply with the requirements of this title; and</text>
					</paragraph><paragraph id="idFF459FD5019C4CBE95D017E3BB303459"><enum>(2)</enum><text>a State plan that
			 meets the requirements of subsection (b).</text>
					</paragraph></subsection><subsection id="id4182D7FD620F49A5AC2F6D90102774B6"><enum>(b)</enum><header>Requirements of
			 a plan</header>
					<paragraph id="id4088505BB1804ECBBF48A258604079CB"><enum>(1)</enum><header>Lead
			 agency</header><text>The State plan shall identify the lead agency.</text>
					</paragraph><paragraph id="id53150E15FCE0465F9EECCE80FE6786A5"><enum>(2)</enum><header>Use of block
			 grant funds</header><text>The State plan shall provide that the State shall use
			 the amounts provided to the State for each fiscal year under this title to
			 carry out harbor maintenance and deepening projects.</text>
					</paragraph></subsection><subsection id="id9046223B406A40D98766BE029F845F2B"><enum>(c)</enum><header>Approval of
			 application</header><text>The Secretary shall approve an application that
			 satisfies the requirements of this section.</text>
				</subsection></section><section id="id59F39ACF30D34680841B2C9BF700A3AB"><enum>108.</enum><header>Effect on
			 environmental laws</header><text display-inline="no-display-inline">Nothing in
			 this title affects, alters, or modifies any provisions of applicable Federal
			 environmental laws (including regulations).</text>
			</section><section id="id8F45B8F69E5E49CABA4B6826DCFDEACC"><enum>109.</enum><header>Administration
			 and enforcement</header>
				<subsection id="id12E7753E02B2459D80F52FDC35989388"><enum>(a)</enum><header>Administration</header><text>The
			 Secretary shall—</text>
					<paragraph id="id40A099B0380D49998DCF1A10999E418D"><enum>(1)</enum><text>coordinate all
			 activities of the Department of Defense relating to harbor maintenance
			 activities, and, to the maximum extent practicable, coordinate the activities
			 with similar activities of other Federal entities; and</text>
					</paragraph><paragraph id="id09F26E1C57584540AB34B3553C3026A5"><enum>(2)</enum><text>provide technical
			 assistance to assist States in carrying out this title, including assistance on
			 a reimbursable basis.</text>
					</paragraph></subsection><subsection id="id2F5CAA560F2C4CE2810121A7F26A541F"><enum>(b)</enum><header>Enforcement</header>
					<paragraph id="idD634CCA0FA2A4A64B44E1986904BCC4B"><enum>(1)</enum><header>Review of
			 compliance with State plan</header><text>The Secretary shall—</text>
						<subparagraph id="idE0E693B38DA44F5AB893504D81C1AB63"><enum>(A)</enum><text>review and
			 monitor State compliance with—</text>
							<clause id="id3C439A020630430483F3C88982BB0C37"><enum>(i)</enum><text>this title;
			 and</text>
							</clause><clause id="id57E9DA8BC56C40D885876B8CA1838F57"><enum>(ii)</enum><text>the plan
			 approved under section 107(c) for the State; and</text>
							</clause></subparagraph><subparagraph id="id8FA140E0B52D45CDAB398C910CFD4E07"><enum>(B)</enum><text>have the power to
			 terminate payments to the State in accordance with paragraph (2).</text>
						</subparagraph></paragraph><paragraph id="id952371CDAA6C4B7791C09176916AB15F"><enum>(2)</enum><header>Noncompliance</header>
						<subparagraph id="id678A7E6B983C4B079C380E2D4DA8A562"><enum>(A)</enum><header>In
			 general</header>
							<clause id="id5FD7350AD10E4668B7FBD06F6E1B249E"><enum>(i)</enum><header>Application</header><text>This
			 subparagraph applies if the Secretary, after reasonable notice to a State and
			 opportunity for a hearing, finds that—</text>
								<subclause id="id2CEFCBCB6F16485ABD69552910E8D404"><enum>(I)</enum><text>there has been a
			 failure by the State to comply substantially with any provision or requirement
			 set forth in the plan approved under section 107(c) for the State in a manner
			 that constitutes fraud or abuse; or</text>
								</subclause><subclause id="id6D30909C98E6458ABE173B7CDA3E4340"><enum>(II)</enum><text>in the operation
			 of any program or activity for which assistance is provided under this title,
			 there is a failure by the State to comply substantially with any provision of
			 this title in a manner that constitutes fraud or abuse.</text>
								</subclause></clause><clause id="id2A79E42CD8CD4EE0A6D120D177BA6473"><enum>(ii)</enum><header>Notice</header><text>If
			 the Secretary makes the finding described in subclause (I) or (II) of clause
			 (i), the Secretary shall notify the State of the finding and that no further
			 payments will be made to the State under this title (or, in the case of
			 noncompliance in the operation of a program or activity, that no further
			 payments to the State will be made with respect to the program or activity)
			 until the Secretary is satisfied that there is no longer any such failure to
			 comply or that the noncompliance will be promptly corrected.</text>
							</clause></subparagraph><subparagraph id="id619C1BACC420480997CF05D7DEA798A0"><enum>(B)</enum><header>Additional
			 sanctions</header><text>In the case of a finding of noncompliance made pursuant
			 to subparagraph (A), the Secretary may, in addition to imposing the sanctions
			 described in subparagraph (A), impose other appropriate sanctions, including
			 recoupment of funds improperly expended for purposes prohibited or not
			 authorized by this title, and disqualification from the receipt of financial
			 assistance under this title.</text>
						</subparagraph><subparagraph id="id4E130DDF71E847E5896F0C5DB56B763B"><enum>(C)</enum><header>Notice</header><text>The
			 notice required under subparagraph (A) shall include specific identification of
			 any additional sanction being imposed under subparagraph (B).</text>
						</subparagraph></paragraph><paragraph id="id69BC90A2D198482EA25C67477FC4CC90"><enum>(3)</enum><header>Procedures</header><text>The
			 Secretary shall establish by regulation procedures for—</text>
						<subparagraph id="idE65B859CA9D346E4A6CFD27B6E49C0B5"><enum>(A)</enum><text>receiving,
			 processing, and determining the validity of complaints concerning any failure
			 of a State to comply with the State plan or any requirement of this title;
			 and</text>
						</subparagraph><subparagraph id="idAE68BADA32DC4E22ACF551AF15E15E2C"><enum>(B)</enum><text>imposing
			 sanctions under this section.</text>
						</subparagraph></paragraph></subsection></section><section id="id2BE081F408FF4E47B27F22E88794C506"><enum>110.</enum><header>Payments</header>
				<subsection id="idD1DC4A2F2D2748CFA0283DAD4ECFD69C"><enum>(a)</enum><header>In
			 General</header>
					<paragraph id="id2AF1639DE992471CB1606B0CADF19192"><enum>(1)</enum><header>Payments</header><text>A
			 State that has an application approved by the Secretary under section 107(c)
			 shall be entitled to a payment under this section for each fiscal year in an
			 amount that is equal to the allotment of the State under section 113 for the
			 fiscal year.</text>
					</paragraph><paragraph id="id288C896DFBF0485A85E764B3E1A0EB4A"><enum>(2)</enum><header>State
			 entitlement</header><text>Subject to the availability of funds under section
			 103, this title—</text>
						<subparagraph id="id390B18D375D5489D8BFA3311EBFC4F7C"><enum>(A)</enum><text>constitutes
			 budget authority in advance of appropriations Acts; and</text>
						</subparagraph><subparagraph id="id319C253242FE456DBF53769A308EDFA6"><enum>(B)</enum><text>represents the
			 obligation of the Federal Government to provide for the payment to States of
			 the amount described in paragraph (1).</text>
						</subparagraph></paragraph></subsection><subsection id="id0EFF112021124815B35FF6E97666A40D"><enum>(b)</enum><header>Method of
			 payment</header>
					<paragraph id="idEB0AED14997441B1827AFC980CF641C0"><enum>(1)</enum><header>In
			 general</header><text>Subject to paragraph (2), the Secretary may make payments
			 to a State in installments, in advance, or by way of reimbursement, with
			 necessary adjustments on account of overpayments or underpayments, as the
			 Secretary may determine.</text>
					</paragraph><paragraph id="idC68F037CED994DEB87AED9B2E1D36286"><enum>(2)</enum><header>Limitation</header><text>The
			 Secretary may not make the payments in a manner that prevents the State from
			 complying with section 107.</text>
					</paragraph></subsection></section><section id="id0CEB432DB680492BBC1B14EFEB1C7284"><enum>111.</enum><header>Audits</header>
				<subsection id="id7771D21B976A4629A091FDCACC32EA95"><enum>(a)</enum><header>Requirement</header><text>After
			 the close of each program period covered by an application approved under
			 section 107(c), a State shall audit—</text>
					<paragraph id="id4981E24DF2444E1595D9BF262AA2B4C9"><enum>(1)</enum><text>the expenditures
			 of the State during the program period from amounts received under this title;
			 and</text>
					</paragraph><paragraph id="id7C9ECF0E7F5C42C2835803653C424F84"><enum>(2)</enum><text>the maintenance
			 by the State of unexpended amounts received by the State under this
			 title.</text>
					</paragraph></subsection><subsection id="idE9CAF67EB4F942F588B8880E17118E2F"><enum>(b)</enum><header>Independent
			 Auditor</header><text>An audit under this section shall be conducted—</text>
					<paragraph id="id7130B978786148F0A0890014F5C199BC"><enum>(1)</enum><text>by an entity that
			 is independent of any agency administering activities that receive assistance
			 under this title; and</text>
					</paragraph><paragraph id="idE27031AEF5354DCEBFC00E3B0B8D2DF7"><enum>(2)</enum><text>in accordance
			 with generally accepted auditing principles.</text>
					</paragraph></subsection><subsection id="id7D9694BBACFA4C5E878AF5F4061AC2D8"><enum>(c)</enum><header>Submission</header><text>Not
			 later than 30 days after the completion of an audit under this section, the
			 State shall submit a copy of the audit to the legislature of the State and to
			 the Secretary.</text>
				</subsection><subsection id="id4382627B44524BADAB8BA4988B7690C8"><enum>(d)</enum><header>Repayment of
			 amounts</header>
					<paragraph id="id3437F5115E6446C381F2E1949EE26BBC"><enum>(1)</enum><header>In
			 general</header><text>Except as provided in paragraph (2), each State shall
			 repay to the United States any amounts made available to the State under this
			 title and determined through an audit under this section—</text>
						<subparagraph id="id8590B5038B544B3C86C5161F4AA79DD3"><enum>(A)</enum><text>to have been
			 expended in a manner that constitutes fraud or abuse; or</text>
						</subparagraph><subparagraph id="idEF6E75945698414DAB2C23B9815340C6"><enum>(B)</enum><text>to remain
			 unexpended as a result of fraud or abuse.</text>
						</subparagraph></paragraph><paragraph id="id6F6A9BE8F4C245F79619655F3A457EA0"><enum>(2)</enum><header>Offset to
			 amounts</header><text>As an alternative to requiring repayment of amounts under
			 paragraph (1), the Secretary may offset the amounts required to be repaid
			 against any other amounts to which the State is or may be entitled under this
			 title.</text>
					</paragraph></subsection></section><section id="id86C143986A334A78857DB5F7E7ECD34F"><enum>112.</enum><header>Report by
			 Secretary</header><text display-inline="no-display-inline">Not later than 60
			 days after the date of enactment of this Act, and annually thereafter, the
			 Secretary shall submit to the appropriate committees of Congress a report that
			 contains—</text>
				<paragraph id="id95B43CC1952947AB8058A7F8BBDD6A25"><enum>(1)</enum><text display-inline="yes-display-inline">a summary and analysis of the data and
			 information provided to the Secretary in the State audits submitted under
			 section 111; and</text>
				</paragraph><paragraph id="id6F61546BE0284FAC97E04C7B362EFB17"><enum>(2)</enum><text display-inline="yes-display-inline">an assessment, and if appropriate,
			 recommendations for Congress concerning efforts that should be undertaken to
			 improve harbor maintenance in the United States.</text>
				</paragraph></section><section id="id09D39962945846059BDB72C1D46B304E"><enum>113.</enum><header>Allotments</header>
				<subsection id="idB7CB01C31E214185981DF6A176268891"><enum>(a)</enum><header>In
			 general</header><text>For each fiscal year, the Secretary shall allot to each
			 participating State an amount that is equal to the proportion that—</text>
					<paragraph id="idBFD6135A379340E7B6E38BABCE2396C1"><enum>(1)</enum><text>the amounts
			 collected in the State for deposit in the State Harbor Maintenance Block Grant
			 Account for that fiscal year in accordance with section 9505 of the Internal
			 Revenue Code of 1986; bears to</text>
					</paragraph><paragraph id="idDA4BB88B756E419189CFA4B7DBFEA861"><enum>(2)</enum><text>the total amount
			 of funds in the State Harbor Maintenance Block Grant Account in that fiscal
			 year.</text>
					</paragraph></subsection><subsection id="id4DBF9F171C764B3796CD432FE0FDED83"><enum>(b)</enum><header>Insufficient
			 funds</header><text>If the Secretary finds that the total amount of allotments
			 to which States would otherwise be entitled for a fiscal year under subsection
			 (a) will exceed the amount of funds available to provide the allotments for the
			 fiscal year, the Secretary shall reduce the allotments made to States under
			 this subsection, on a pro rata basis, to the extent necessary to allot under
			 this subsection a total amount that is equal to the funds that will be made
			 available.</text>
				</subsection></section><section id="idDC0EAF7D588845958118C16292FFA60C"><enum>114.</enum><header>Amendments to
			 Internal Revenue Code of 1986</header>
				<subsection id="id0657E25C684443CEA4FAB4D370187EBE"><enum>(a)</enum><header>In
			 general</header><text>Subsection (c) of section 9505 of the Internal Revenue
			 Code of 1986 is amended by striking <quote>Amounts</quote> and inserting
			 <quote>Except as provided in subsection (d), amounts</quote>.</text>
				</subsection><subsection id="id8B9FB1A66948433999A2820246BCBF07"><enum>(b)</enum><header>State block
			 grants</header><text>Section 9505 of the Internal Revenue Code of 1986 is
			 amended by adding at the end the following new subsection:</text>
					<quoted-block act-name="" id="id7E0F8C7546504115845954E7D0E659AD" style="OLC">
						<subsection id="id13726E03B84F4D1CA059CEA4826594F5"><enum>(d)</enum><header>Establishment
				of State block grant account</header>
							<paragraph id="id99F8B633C8C548EEB711B6F0995CCC45"><enum>(1)</enum><header>Creation of
				account</header><text>There is established in the Harbor Maintenance Trust Fund
				a separate account to be known as the <quote>State Harbor Maintenance Block
				Grant Account</quote> consisting of such amounts as may be transferred or
				credited to the State Harbor Maintenance Block Grant Account as provided in
				this section or section 9602(b).</text>
							</paragraph><paragraph id="idEEB9352ADD3F41A18A90CCCA4E898967"><enum>(2)</enum><header>Transfers to
				State Harbor Maintenance Block Grant Account</header><text>The Secretary shall
				transfer to the State Harbor Maintenance Block Grant Account the electing State
				amount of the amounts appropriated to the Harbor Maintenance Trust Fund under
				subsection (b).</text>
							</paragraph><paragraph id="id5C619A183CF744319F011685F6ADA10D"><enum>(3)</enum><header>Expenditures
				from Account</header><text>Except as provided in paragraph (4), amounts in the
				State Harbor Maintenance Block Grant Account shall be available for making
				expenditures to fund the harbor maintenance block grant program authorized by
				the <short-title>Corps of Engineers Reform Act of
				2011</short-title>. The Secretary shall, from time to time, transfer such
				amounts to such accounts as are identified by the Secretary of the Army, acting
				through the Chief of Engineers, for the purpose of making such
				expenditures.</text>
							</paragraph><paragraph id="id500BE5A79D7540E38EF0DFEDFE9BD3AC"><enum>(4)</enum><header>Limitations</header>
								<subparagraph id="id1E56A8BFAC254985A79DB7A94F766CB1"><enum>(A)</enum><header>Non-electing
				States</header><text>Amounts in the State Harbor Maintenance Block Grant
				Account shall not be used for making any payment to a State, or for making
				expenditures within a State, unless such State is an electing State.</text>
								</subparagraph><subparagraph id="id48F44A2AFB4E46BAA444D90EE06431B0"><enum>(B)</enum><header>Reservation of
				administrative costs</header>
									<clause id="idF515112AF6C54338B236433190E8767C"><enum>(i)</enum><header>In
				general</header><text>The expenditures under subsection (c)(3) shall be borne
				by the State Harbor Maintenance Block Grant Account and the General Account in
				proportion to the respective amounts of the revenues transferred under this
				section to the State Harbor Maintenance Block Grant Account and the General
				Account (after the application of paragraph (2)).</text>
									</clause><clause id="id1BF96932019742C5BE2FECDC3AEB9BEA"><enum>(ii)</enum><header>Reservation</header><text>The
				amounts required to bear the State Harbor Maintenance Block Grant Account's
				share of the expenditures under clause (i) shall be reserved for such purpose
				and shall not be used to make any other expenditures.</text>
									</clause><clause id="id34A1C903835F4822B99923280E1C42DA"><enum>(iii)</enum><header>General
				Account</header><text>For purposes of this subparagraph, the term <term>General
				Account</term> means the portion of the Harbor Maintenance Trust Fund which is
				not the State Harbor Maintenance Block Grant Account.</text>
									</clause></subparagraph></paragraph><paragraph id="idCBED22ED458641228DC99B6A96EF12DC"><enum>(5)</enum><header>Definitions</header><text>For
				purposes of this subsection—</text>
								<subparagraph id="id5204850372AF4A87B3E4E98D4C13D2C4"><enum>(A)</enum><header>Electing State
				amount</header><text>The term <term>electing State amount</term> means the
				portion of the amounts appropriated to the Harbor Maintenance Trust Fund under
				subsection (b) which is equivalent to the taxes received in the Treasury under
				section 4461 which are collected from ports in electing States.</text>
								</subparagraph><subparagraph id="idDC714C9EB0994E90B7FCF683FB2223D1"><enum>(B)</enum><header>Electing
				State</header><text>The term <term>electing State</term> means a State that has
				elected (by submission of the application required under section 107 of the
				<short-title>Corps of Engineers Reform Act of
				2011</short-title>) to participate in the harbor maintenance block grant
				program authorized by the <short-title>Corps of Engineers
				Reform Act of 2011</short-title>.</text>
								</subparagraph></paragraph><paragraph id="idABDF574945E9447EA0AAD761EAA88CDC"><enum>(6)</enum><header>Coordination
				with Trust Fund expenditures</header><text>Expenditures under paragraphs (1)
				and (2) of subsection (c) shall not be made to, or for projects located within,
				any State which is an electing
				State.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="id7042C03AF4794A2CBDF0B1289FD891D3"><enum>(c)</enum><header>Effective
			 date</header><text>The amendments made by this section shall apply to amounts
			 appropriated or transferred to the Harbor Maintenance Trust Fund under section
			 9505 of the Internal Revenue Code of 1986 after the date of the enactment of
			 this Act.</text>
				</subsection></section></title><title id="id40C61591C0BE42B2A3F3A9A50CE2EDFE"><enum>II</enum><header>Water resources
			 development</header>
			<section id="id5678350CBA194D30A97AB5892EA63B7A"><enum>201.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text>
				<paragraph id="id8E585B2F887B493C8342264C6D3378D0"><enum>(1)</enum><header>Commission</header><text>The
			 term <term>Commission</term> means the Water Resources Commission established
			 by section 203.</text>
				</paragraph><paragraph id="idAEB9E10F75514AE0AAEFB6A0E0A35E23"><enum>(2)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of the Army, acting through the
			 Chief of Engineers.</text>
				</paragraph></section><section id="idD4FDE0A71B804EABBDD998AA2CE3D8AF"><enum>202.</enum><header>Corps
			 transparency</header>
				<subsection id="idD8175F068AF740F5A0A9F8ABD079C1A9"><enum>(a)</enum><header>Annual
			 publication of authorized projects</header>
					<paragraph id="idEC103F4F6E8D4B06A525028C6ED7A010"><enum>(1)</enum><header>In
			 general</header><text>The Secretary shall publish annually a list describing
			 each authorized water resources project of the Corps of Engineers in the
			 Federal Register and on a publically available website.</text>
					</paragraph><paragraph id="idE212451ED722466AA61A1D418A4F2448"><enum>(2)</enum><header>Contents</header><text>For
			 each authorized water resources project, the list described in paragraph (1)
			 shall include—</text>
						<subparagraph id="id72783EEE1DD8461EBC52485C27D86B57"><enum>(A)</enum><text>the date on which
			 the water resources project was authorized; and</text>
						</subparagraph><subparagraph id="id806F4E55B6764F0384DB3E0D44B6FFF2"><enum>(B)</enum><text>the amount of
			 Federal funds, if any, provided to the water resources project during the 5
			 years immediately preceding the date on which the list described in paragraph
			 (1) is published.</text>
						</subparagraph></paragraph><paragraph id="idAF978698EC944195826A3313C7F674F5"><enum>(3)</enum><header>Report to
			 Congress</header><text>The Secretary shall submit the list described in
			 paragraph (1) to—</text>
						<subparagraph id="id9083D6D75E1A452AAA0B5A153B0A871A"><enum>(A)</enum><text>the Committees on
			 Environment and Public Works and Appropriations of the Senate; and</text>
						</subparagraph><subparagraph id="id7BC3A0D1D8EA4AE49C15DE5AD83CB166"><enum>(B)</enum><text>the Committees on
			 Transportation and Infrastructure and Appropriations of the House of
			 Representatives.</text>
						</subparagraph></paragraph></subsection><subsection id="idCAF9FF09A9204991B3902E67CD952C13"><enum>(b)</enum><header>Publication of
			 deauthorized projects</header>
					<paragraph id="id08259A22BF054DBFB1488A5867F3D501"><enum>(1)</enum><header>In
			 general</header><text>Not later than 90 days after date of the enactment of
			 this Act, the Secretary shall publish a list describing each water resources
			 study or project of the Corps of Engineers that is no longer authorized.</text>
					</paragraph><paragraph id="id73A2BC090FC34A76BAF4D5612EB79F12"><enum>(2)</enum><header>Contents</header><text>For
			 each water resources study or project described in paragraph (1), the list
			 described in paragraph (1) shall include—</text>
						<subparagraph id="idEF3131B6EA1B48ACAF14DFEDDE8CC481"><enum>(A)</enum><text>the date on which
			 the water resources study or project was authorized; and</text>
						</subparagraph><subparagraph id="idD912162E7A454BFA91E1E87951AA0DD8"><enum>(B)</enum><text>the amount of
			 Federal funds, if any, provided to the water resources study or project for the
			 5 years immediately following the date on which that study or project was
			 authorized.</text>
						</subparagraph></paragraph><paragraph id="idC7F152011C1C47B7BAE8CD3336EE2E49"><enum>(3)</enum><header>Report to
			 Congress</header><text>The Secretary shall submit the list described in
			 paragraph (1) to—</text>
						<subparagraph id="idCA0BD6726F8B4BC39A9EE31053A6C128"><enum>(A)</enum><text>the Committees on
			 Environment and Public Works and Appropriations of the Senate; and</text>
						</subparagraph><subparagraph id="id74CA0822580F420D9B5663459FFE947B"><enum>(B)</enum><text>the Committees on
			 Transportation and Infrastructure and Appropriations of the House of
			 Representatives.</text>
						</subparagraph></paragraph></subsection></section><section id="ID59d51477f996478c8c4c4af46f1e6e30" section-type="subsequent-section"><enum>203.</enum><header>Water Resources
			 Commission</header>
				<subsection id="id75DDF8ACB1F74833B5CFFE9C20C9F528"><enum>(a)</enum><header>Establishment
			 of Commission</header>
					<paragraph id="ID35ccb32b4ff648939ceb52bf99769af3"><enum>(1)</enum><header>Establishment</header><text>There
			 is established a commission, to be known as the <quote>Water Resources
			 Commission</quote>, to prioritize water resources projects in the United
			 States.</text>
					</paragraph><paragraph id="IDf00996b13fc74deca9b8e84ee790f0e9"><enum>(2)</enum><header>Membership</header>
						<subparagraph id="IDe81a2b79951c41a0913d0d31315749bf"><enum>(A)</enum><header>Composition</header>
							<clause id="idD534633EBB634D7784B8AB016FEA248A"><enum>(i)</enum><header>In
			 general</header><text>The Commission shall be composed of 11 members, of
			 whom—</text>
								<subclause id="ID8ebd666a7c364fbdb1ffc0fde08193c4"><enum>(I)</enum><text>1 member shall be
			 appointed by the President;</text>
								</subclause><subclause id="IDf8ce347860214e00a451528fa47c99d4"><enum>(II)</enum><text>1 member shall
			 be appointed by the Speaker of the House of Representatives;</text>
								</subclause><subclause id="ID83dd4c52ec2940ebaf470964f9d32368"><enum>(III)</enum><text>1 member shall
			 be appointed by the majority leader of the Senate; and</text>
								</subclause><subclause id="IDf025b5c38c2c4a3ab2d0d6288b812196"><enum>(IV)</enum><text>8 members shall
			 be appointed in accordance with clause (ii) by the Speaker of the House of
			 Representatives and the majority leader of the Senate, in consultation with the
			 minority leader of the House of Representatives and the minority leader of the
			 Senate.</text>
								</subclause></clause><clause id="id9BBE391213EA473C9D7D1A7C2A718F5B"><enum>(ii)</enum><header>Restrictions</header>
								<subclause id="id3997C4BB378F4DD1874B751EDE8930D4"><enum>(I)</enum><header>In
			 general</header><text>Subject to subclause (II), each of the 8 members
			 appointed under clause (i)(IV) shall represent 1 of the following Corps of
			 Engineers geographical divisions:</text>
									<item id="id9E9F258AF9044F1FB2F6D5520DA01FDF"><enum>(aa)</enum><text>Great Lakes
			 &amp; Ohio River Division.</text>
									</item><item id="idB8F32DC877C84D7C97733B487E3D9426"><enum>(bb)</enum><text>Mississippi
			 Valley Division.</text>
									</item><item id="idA2992AEAE33345D0A899AF4C788C764F"><enum>(cc)</enum><text>North Atlantic
			 Division.</text>
									</item><item id="id3BD9F56B3A58419483C3C43057962AC5"><enum>(dd)</enum><text>Northwestern
			 Division.</text>
									</item><item id="idBDF7C6D6F81745308236DC6C181FD782"><enum>(ee)</enum><text>Pacific Ocean
			 Division.</text>
									</item><item id="id5219CB880E0449F29858A46205AED47B"><enum>(ff)</enum><text>South Atlantic
			 Division.</text>
									</item><item id="id925A91AC3E34439CA56C878916458A8E"><enum>(gg)</enum><text>South Pacific
			 Division.</text>
									</item><item id="idCD8834FA865B4E178C3BD49A15363505"><enum>(hh)</enum><text>Southwestern
			 Division.</text>
									</item></subclause><subclause id="ID734bc9ef35c7436a9fb706898f8d6fbc"><enum>(II)</enum><header>Geographical
			 representation</header><text>Not more than 2 of the members appointed under
			 clause (i)(IV) shall represent the same Corps of Engineers geographical
			 division described in subclause (I).</text>
								</subclause></clause></subparagraph><subparagraph id="idE670B4E4B9D9493AB899448E6B2BC253"><enum>(B)</enum><header>Qualifications</header>
							<clause id="idCBA1D577D3ED481396F88249FC9F3AED"><enum>(i)</enum><header>In
			 general</header><text>Subject to clause (ii), members shall be appointed to the
			 Commission from among individuals who—</text>
								<subclause id="idD67BD29830B9484698DF8FB3B3783320"><enum>(I)</enum><item commented="no" display-inline="yes-display-inline" id="id84F5F78EB0D04DFDB6C73B38F43F4940"><enum>(aa)</enum><text>are knowledgeable in
			 the fields of navigation, water infrastructure, or natural resources; or</text>
									</item><item id="idEF20C076CF054DC4AEFB7BBA25F80427" indent="up1"><enum>(bb)</enum><text>are recognized as having expertise in
			 project management or cost-benefit analysis; and</text>
									</item></subclause><subclause id="id2DB96AF8E6724520AB37C421246ABF76"><enum>(II)</enum><text>while serving on
			 the Commission, do not hold any other position as an officer or employee of the
			 United States, except as a retired officer or retired civilian employee of the
			 United States.</text>
								</subclause></clause><clause id="id6F0C500267CC42FEB6F2E5BCFDF19D27"><enum>(ii)</enum><header>Requirement</header><text>At
			 least 1 of the members under subparagraph (A) shall have knowledge of safety
			 issues relating to water resources projects carried out by the Corps of
			 Engineers.</text>
							</clause></subparagraph><subparagraph id="IDe5ed4851dfb440c7970b2eb72596f497"><enum>(C)</enum><header>Date of
			 appointments</header><text>The members of the Commission shall be appointed
			 under subparagraph (A) not later than 90 days after the date of enactment of
			 this Act.</text>
						</subparagraph></paragraph><paragraph id="IDbaa5a2bf9af34e4aa9ff7457111727d2"><enum>(3)</enum><header>Term;
			 vacancies</header>
						<subparagraph id="ID40a10701ce6e4e72b2f195027a3b81e8"><enum>(A)</enum><header>Term</header><text>A
			 member shall be appointed for the life of the Commission.</text>
						</subparagraph><subparagraph id="ID08193b3279a44a6bade43c88289887ac"><enum>(B)</enum><header>Vacancies</header><text>A
			 vacancy in the Commission—</text>
							<clause id="IDc93884e7daf04baabb457745b5770c74"><enum>(i)</enum><text>shall not affect
			 the powers of the Commission; and</text>
							</clause><clause id="ID03a15e104e5246ecba162b54da955878"><enum>(ii)</enum><text>shall be filled
			 not later than 30 days after the date on which the vacancy occurs, in the same
			 manner as the original appointment was made.</text>
							</clause></subparagraph></paragraph><paragraph id="ID4f3859c8d486401684e3df769965b2c3"><enum>(4)</enum><header>Initial
			 meeting</header><text>Not later than 30 days after the date on which all
			 members of the Commission have been appointed, the Commission shall hold the
			 initial meeting of the Commission.</text>
					</paragraph><paragraph id="ID01598dd6dfbb4e2d86528e1aabeb0bc2"><enum>(5)</enum><header>Meetings</header><text>The
			 Commission shall meet at the call of—</text>
						<subparagraph id="id221E9E11F3E34D79A96DB43C7A6BF810"><enum>(A)</enum><text>the Chairperson;
			 or</text>
						</subparagraph><subparagraph id="idD02C055EC7344EFF9AE6290B6A258570"><enum>(B)</enum><text>the majority of
			 the members of the Commission.</text>
						</subparagraph></paragraph><paragraph id="ID8d7c6f8e99db45c18fc88629317474c8"><enum>(6)</enum><header>Quorum</header><text>A
			 majority of the members of the Commission shall constitute a quorum, but a
			 lesser number of members may hold hearings.</text>
					</paragraph><paragraph id="ID2a487fbc0a1347bfb27ffcd67e3d541d"><enum>(7)</enum><header>Chairperson and
			 vice chairperson</header><text>The Commission shall select a Chairperson and
			 Vice Chairperson from among the members of the Commission.</text>
					</paragraph></subsection><subsection id="IDfc4457eab52d4a788465ef56bbac6617"><enum>(b)</enum><header>Duties of
			 Commission</header>
					<paragraph id="ID33c8aa9eec234b8989457249cb141ff0"><enum>(1)</enum><header>Prioritization
			 of water resources projects</header>
						<subparagraph id="ID0da89912931344cfa32a016e0977db43"><enum>(A)</enum><header>In
			 general</header><text>In accordance with this section, the Commission shall
			 make recommendations for the means by which to prioritize water resources
			 projects of the Corps of Engineers and prioritize water resources projects of
			 the Corps of Engineers that are not being carried out under a continuing
			 authorities program.</text>
						</subparagraph><subparagraph id="ID489c21e9b33d438f8c8c949a1c1a69a7"><enum>(B)</enum><header>Report</header><text>Not
			 later than 1 year after the date of enactment of this Act, the Commission shall
			 submit to Congress a report containing the recommendations and prioritization
			 method required under this paragraph.</text>
						</subparagraph><subparagraph id="idDC47087FF06940E6995F34D61FF2E603"><enum>(C)</enum><header>Recommendations</header><text>The
			 report shall include recommendations for—</text>
							<clause id="id839D6AA2F9F24F93B5CE901B7A341136"><enum>(i)</enum><text>a
			 process of regularized prioritization assessments that ensures continuity in
			 project prioritization rankings and the inclusion of newly authorized
			 projects;</text>
							</clause><clause id="id3CA63D8230AB4581A3ED4FB2D1D4581D"><enum>(ii)</enum><text>a
			 process to prioritize water resources projects across project type; and</text>
							</clause><clause id="id427CB476B11F4640BD4908492D027DA0"><enum>(iii)</enum><text>a
			 method of analysis, with respect to the prioritization process, of recreation
			 and other ancillary benefits resulting from the construction of Corps of
			 Engineers projects.</text>
							</clause></subparagraph><subparagraph id="idCC003E4F67D046FF98C5445FA272C62E"><enum>(D)</enum><header>Project
			 inclusions</header><text>The report shall include, at a minimum, each water
			 resources project authorized for study or construction on or before the date of
			 enactment of this Act.</text>
						</subparagraph><subparagraph id="idE3E159C8824F4712BB03AC8001DE763E"><enum>(E)</enum><header>Prioritization
			 requirements</header>
							<clause id="idDCF5F82C98FA44459116A263F383408B"><enum>(i)</enum><header>In
			 general</header><text>Each project described in the report shall be categorized
			 by project type and be classified into a tier system of descending priority, to
			 be established by the Commission, in a manner that reflects the extent to which
			 the project achieves project prioritization criteria established under
			 subparagraph (F).</text>
							</clause><clause id="id6693337BE8BA44079E35F954F0038AA1"><enum>(ii)</enum><header>Multipurpose
			 projects</header><text>Each multipurpose project described in the report shall
			 be classified—</text>
								<subclause id="id5541525AF93246A7B0837AEAE4A9EF6E"><enum>(I)</enum><text>by the project
			 type that best represents the primary project purpose, as determined by the
			 Commission; and</text>
								</subclause><subclause id="idF71FA8578F3B41739B2902A81FDC21F5"><enum>(II)</enum><text>into the tier
			 system described in clause (i) within that project type.</text>
								</subclause></clause><clause id="idDA7D02A9C9A1473C973A54AF8EBCB9E7"><enum>(iii)</enum><header>Tier system
			 requirements</header><text>In establishing a tier system under clause (i), the
			 Commission shall ensure that each tier—</text>
								<subclause id="id7080732C452D43168D5F683A75B771A3"><enum>(I)</enum><text>is limited to
			 total authorized project costs of $5,000,000,000; and</text>
								</subclause><subclause id="id0229FF2234B14077A294102BC5F7FC47"><enum>(II)</enum><text>includes not
			 more than 100 projects.</text>
								</subclause></clause><clause id="id7EA57DE2F48B4D1A8BCF07F3914BEC0B"><enum>(iv)</enum><header>Balance</header><text>The
			 Commission shall seek, to the maximum extent practicable, a balance between the
			 water resource needs of all States, regardless of the size or population of a
			 State.</text>
							</clause></subparagraph><subparagraph id="IDffa9df48c7094943ba3ea4341b7624c0"><enum>(F)</enum><header>Project
			 prioritization criteria</header><text>In preparing the report, the Commission
			 shall prioritize each water resources project of the Corps of Engineers based
			 on the extent to which the project meets at least the following criteria and
			 such additional criteria as the Commission may fully explain in the
			 report:</text>
							<clause id="ID5ee4be264bb94c78aa63b45dd82e4249"><enum>(i)</enum><text>For
			 flood damage reduction projects, the extent to which such a project—</text>
								<subclause id="id9E977A3AC9AD4A78BC42F072ED96AD4F"><enum>(I)</enum><text>addresses
			 critical flood damage reduction needs of the United States, including by
			 reducing the risk of loss of life;</text>
								</subclause><subclause id="id189F0031ACA447F4A9BE243E72030968"><enum>(II)</enum><text>avoids
			 increasing risks to human life or damages to property in the case of large
			 flood events; and</text>
								</subclause><subclause id="idA091C7EFD1F940F49325CF03FAD09A1E"><enum>(III)</enum><text>avoids adverse
			 environmental impacts or produces environmental benefits.</text>
								</subclause></clause><clause id="ID4d4c2f712ae04aadbae94eab74540a07"><enum>(ii)</enum><text>For navigation
			 projects, the extent to which such a project—</text>
								<subclause id="id94E7DDD5CC8D46108F657BB5C6D4928A"><enum>(I)</enum><text>addresses
			 priority navigation needs of the United States, including by having a high
			 probability of producing the economic benefits projected with respect to the
			 project and reflecting regional planning needs, as applicable; and</text>
								</subclause><subclause id="idCCBC09042AE94B08BE5D6FD21C30C9FB"><enum>(II)</enum><text>avoids adverse
			 environmental impacts.</text>
								</subclause></clause><clause id="ID245a6951afb1445eaae9c16deb39bed1"><enum>(iii)</enum><text>For
			 environmental restoration projects, the extent to which such a project
			 addresses priority environmental restoration needs of the United States,
			 including by restoring the natural hydrologic processes and spatial extent of
			 an aquatic habitat, while being, to the maximum extent practicable,
			 self-sustaining.</text>
							</clause></subparagraph></paragraph><paragraph id="ID3dff0c95904841c8a26a1d341d000ffa"><enum>(2)</enum><header>Availability</header><text>The
			 report prepared under this subsection shall be—</text>
						<subparagraph id="id34F0E54C034E4C7CA8A667B5AC4248D7"><enum>(A)</enum><text>published in the
			 Federal Register; and</text>
						</subparagraph><subparagraph id="idE1714E4584214EC2A04F96E49B395571"><enum>(B)</enum><text>submitted
			 to—</text>
							<clause id="idB52DD33E533742BBA907679803A11EBF"><enum>(i)</enum><text>the
			 Committees on Environment and Public Works and Appropriations of the Senate;
			 and</text>
							</clause><clause id="id228D0EFFB74C4FE6AEBA3496196F0951"><enum>(ii)</enum><text>the Committees
			 on Transportation and Infrastructure and Appropriations of the House of
			 Representatives.</text>
							</clause></subparagraph></paragraph></subsection><subsection id="ID64610fb77eea4069960ea1003fe54883"><enum>(c)</enum><header>Powers of
			 Commission</header>
					<paragraph id="IDf896da3a1edd431c9c1022ff68bef9c0"><enum>(1)</enum><header>Hearings</header><text>The
			 Commission shall hold such hearings, meet and act at such times and places,
			 take such testimony, administer such oaths, and receive such evidence as the
			 Commission considers advisable to carry out this section.</text>
					</paragraph><paragraph id="IDe7dbaf973096484ba77f066ce303b405"><enum>(2)</enum><header>Information
			 from Federal agencies</header>
						<subparagraph id="IDa6353f94330f41b598ea5bdda4a13acb"><enum>(A)</enum><header>In
			 general</header><text>The Commission may secure directly from a Federal agency
			 such information as the Commission considers necessary to carry out this
			 section.</text>
						</subparagraph><subparagraph id="ID0ec020f4b62c415ba06d12665afd3692"><enum>(B)</enum><header>Provision of
			 information</header><text>On request of the Chairperson of the Commission, the
			 head of the Federal agency shall provide the information to the
			 Commission.</text>
						</subparagraph></paragraph><paragraph id="ID50bbad562bfd4dd6b5a59e7dc868f5ee"><enum>(3)</enum><header>Gifts</header><text>The
			 Commission may accept, use, and dispose of gifts or donations of services or
			 property.</text>
					</paragraph><paragraph id="IDac90ee43e61941ffacd54b9237abc7ad"><enum>(4)</enum><header>Postal
			 services</header><text>The Commission may use the United States mails in the
			 same manner and under the same conditions as other agencies of the Federal
			 Government.</text>
					</paragraph></subsection><subsection id="ID7645799229924cd487c0f49d62b953d8"><enum>(d)</enum><header>Commission
			 personnel matters</header>
					<paragraph id="ID9648393e98314b51b8604ca7310489d7"><enum>(1)</enum><header>Compensation of
			 members</header><text>A member of the Commission shall serve without pay, but
			 shall be allowed a per diem allowance for travel expenses, at rates authorized
			 for an employee of an agency under subchapter I of chapter 57 of title 5,
			 United States Code, while away from the home or regular place of business of
			 the member in the performance of the duties of the Commission.</text>
					</paragraph><paragraph id="ID058980fcb27448ad91f5a54bc5934dad"><enum>(2)</enum><header>Staff</header>
						<subparagraph id="ID3671080d7d1f4a9bafc6f1bd8b6b847e"><enum>(A)</enum><header>In
			 general</header><text>The Chairperson of the Commission may, without regard to
			 the civil service laws, including regulations, appoint and terminate an
			 executive director and such other additional personnel as are necessary to
			 enable the Commission to perform the duties of the Commission.</text>
						</subparagraph><subparagraph id="ID77400af346914c0ab9d28dd6eef3ea4d"><enum>(B)</enum><header>Confirmation of
			 executive director</header><text>The employment of an executive director shall
			 be subject to confirmation by a majority of the members of the
			 Commission.</text>
						</subparagraph><subparagraph id="IDee13b99dc91544abbd864e2978078ac0"><enum>(C)</enum><header>Compensation</header>
							<clause id="ID69edffe1532845c5bb264f9a1f7f993f"><enum>(i)</enum><header>In
			 general</header><text>Except as provided in clause (ii), the Chairperson of the
			 Commission may fix the compensation of the executive director and other
			 personnel without regard to the provisions of chapter 51 and subchapter III of
			 chapter 53 of title 5, United States Code, relating to classification of
			 positions and General Schedule pay rates.</text>
							</clause><clause id="ID33b40f70f73d4038b15752605711ab48"><enum>(ii)</enum><header>Maximum rate
			 of pay</header><text>In no event shall any employee of the Commission (other
			 than the executive director) receive as compensation an amount in excess of the
			 maximum rate of pay for Executive Level IV under section 5315 of title 5,
			 United States Code.</text>
							</clause></subparagraph></paragraph><paragraph id="IDce95f27c33204508ab4d5a4056126111"><enum>(3)</enum><header>Detail of
			 Federal government employees</header>
						<subparagraph id="IDa2422bf2dcab42a79a2952769dfe2c7d"><enum>(A)</enum><header>In
			 general</header><text>An employee of the Federal Government may be detailed to
			 the Commission without reimbursement.</text>
						</subparagraph><subparagraph id="ID28b7273023f749ce8d460445b316a03e"><enum>(B)</enum><header>Civil service
			 status</header><text>The detail of a Federal employee shall be without
			 interruption or loss of civil service status or privilege.</text>
						</subparagraph></paragraph><paragraph id="ID1ec4826a0fc44cca996c3fbb07a4e17f"><enum>(4)</enum><header>Procurement of
			 temporary and intermittent services</header><text>On request of the Commission,
			 the Secretary, acting through the Chief of Engineers, shall provide, on a
			 reimbursable basis, such office space, supplies, equipment, and other support
			 services to the Commission and staff of the Commission as are necessary for the
			 Commission to carry out the duties of the Commission under this section.</text>
					</paragraph></subsection><subsection id="ID713d1177cf914c24adaad02886495b28"><enum>(e)</enum><header>Termination</header><text display-inline="yes-display-inline">The Commission shall terminate on the date
			 that is 90 days after the date on which the final report of the Commission is
			 submitted under subsection (b).</text>
				</subsection></section><section id="idC1E4891E4C7F40C986AED01D4C46FDD8"><enum>204.</enum><header>Funding</header>
				<subsection id="ID0eb47db5bc344666bfd3f081e4e61a75"><enum>(a)</enum><header>Funding</header>
					<paragraph id="id8517462D310C409FA3FCF106B9FDD927"><enum>(1)</enum><header>In
			 general</header><text>In carrying out this title, the Commission shall use
			 funds made available for the general operating expenses of the Corps of
			 Engineers.</text>
					</paragraph><paragraph id="idAB8106BDDC6F44CD8BFFD4A045E0EC8B"><enum>(2)</enum><header>Priority water
			 resources projects</header><text>In carrying out the water resources projects
			 prioritized by the Commission under section 203(b), the Secretary shall use
			 funds made available to the Corps of Engineers.</text>
					</paragraph></subsection><subsection id="id4DD39AC0001F4E57A5FC27672DAA565A"><enum>(b)</enum><header>Use of
			 Commission report by Secretary</header>
					<paragraph id="id06CA5A575C57481CBC6F6BC4F1C98B53"><enum>(1)</enum><header>In
			 general</header><text>The Secretary shall use the priority recommendations
			 described in the report under section 203(b) as a means of allocating amounts
			 appropriated under subsection (a)(2).</text>
					</paragraph><paragraph id="id4A4803F0D8B24E949CB5D3ACE1EA0DEE"><enum>(2)</enum><header>Exception</header><text>The
			 Secretary may deviate from the priority recommendations in the report under
			 section 203(b) by advancing the priority of a project only if the Secretary
			 determines that—</text>
						<subparagraph id="id4ADB5BECE1CC4179BD04BEC6C70F781C"><enum>(A)</enum><text>the project is
			 vital to the national interest of the United States; and</text>
						</subparagraph><subparagraph id="id7703448DF01443528427764EA88CECFF"><enum>(B)</enum><text>failure to
			 complete the project would cause significant harm and expense to the United
			 States.</text>
						</subparagraph></paragraph></subsection><subsection id="id01E9A25A068743E1966763971B7F47F4"><enum>(c)</enum><header>Reports</header>
					<paragraph id="id65880DC09C434F2C948920D6A2315A36"><enum>(1)</enum><header>In
			 general</header><text>For each fiscal year, the Secretary shall submit to the
			 committees described in paragraph (2), and make available to the public on the
			 Internet, a report that lists, for the year covered by the report—</text>
						<subparagraph id="idB1C99DD67F5542A6AC9DE574E50EB69D"><enum>(A)</enum><text>the water
			 resources projects that receive funding and are carried out in accordance with
			 section 203(b); and</text>
						</subparagraph><subparagraph id="id70C5251E08DC45099F819E661D25FEA2"><enum>(B)</enum><text>the water
			 resources projects that receive funding and are carried out on a
			 project-by-project basis through line items contained in appropriations
			 Acts.</text>
						</subparagraph></paragraph><paragraph id="id0ECFDB743549453FA4F665B02DE512BC"><enum>(2)</enum><header>Committees</header><text>The
			 committees referred to in paragraph (1) are—</text>
						<subparagraph id="idA576E945E46348E1962E16C238E9FF50"><enum>(A)</enum><text>the Committees on
			 Environment and Public Works and Appropriations of the Senate; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4C8C5332ABFB4CA2AF37D827715F3F70"><enum>(B)</enum><text>the Committees on
			 Transportation and Infrastructure and Appropriations of the House of
			 Representatives.</text>
						</subparagraph></paragraph></subsection></section></title></legis-body>
