		<section id="idf0027bc1-0196-4876-bfb5-86fbd6ab38f6" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Valles Caldera National Preserve
			 Management Act</short-title></quote>.</text>
		</section><section id="id40583bea-8c9f-4da1-8794-bef9ab846054"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="id9a9dc282-692b-4c2c-85d5-fb65d595e375"><enum>(1)</enum><header>Eligible
			 employee</header><text>The term <term>eligible employee</term> means a person
			 who was a full-time or part-time employee of the Trust during the 180-day
			 period immediately preceding the date of enactment of this Act.</text>
			</paragraph><paragraph id="id1c1ef218-0583-4d9f-b68c-ee48b74d04d8"><enum>(2)</enum><header>Fund</header><text>The
			 term <quote>Fund</quote> means the Valles Caldera Fund established by section
			 106(h)(2) of the Valles Caldera Preservation Act (16 U.S.C.
			 698v–4(h)(2)).</text>
			</paragraph><paragraph id="id96667378-3941-49be-a24b-f2db61ff011f"><enum>(3)</enum><header>Preserve</header><text>The
			 term <quote>Preserve</quote> means the Valles Caldera National Preserve in the
			 State.</text>
			</paragraph><paragraph id="id95975fae-3de8-4988-903e-2e860175ce39"><enum>(4)</enum><header>Secretary</header><text>The
			 term <quote>Secretary</quote> means the Secretary of the Interior.</text>
			</paragraph><paragraph id="ide4760742-0a8d-4f71-9e31-d3377640325e"><enum>(5)</enum><header>State</header><text>The
			 term <quote>State</quote> means the State of New Mexico.</text>
			</paragraph><paragraph id="id16de44b5-e6bb-44a6-a6a2-469c3148000d"><enum>(6)</enum><header>Trust</header><text>The
			 term <quote>Trust</quote> means the Valles Caldera Trust established by section
			 106(a) of the Valles Caldera Preservation Act (16 U.S.C. 698v–4(a)).</text>
			</paragraph></section><section id="idec94070e-7054-4de2-bb3e-b81352e3ea51"><enum>3.</enum><header>Valles
			 caldera national preserve</header>
			<subsection id="id06ae702c-0d0e-4c4b-8cfb-4eaeedd04b26"><enum>(a)</enum><header>Designation
			 as Unit of the National Park System</header><text>To protect, preserve, and
			 restore the fish, wildlife, watershed, natural, scientific, scenic, geologic,
			 historic, cultural, archaeological, and recreational values of the area, the
			 Valles Caldera National Preserve is designated as a unit of the National Park
			 System.</text>
			</subsection><subsection id="id2f0934d4-4a4d-47f9-b5b1-17e9f7747a71"><enum>(b)</enum><header>Management</header>
				<paragraph id="ideaac5dde-aa6a-4dd5-be48-522348c8b054"><enum>(1)</enum><header>Applicable
			 law</header><text>The Secretary shall administer the Preserve in accordance
			 with—</text>
					<subparagraph id="id31ab52fe-acc2-4520-a940-2fe3cc0378b1"><enum>(A)</enum><text>this Act;
			 and</text>
					</subparagraph><subparagraph id="id0da930db-dceb-403c-86d0-255a7771ca7c"><enum>(B)</enum><text>the laws
			 generally applicable to units of the National Park System, including—</text>
						<clause id="idf0207ccc-4377-4a89-9b04-a0e8c7b99c40"><enum>(i)</enum><text>the National
			 Park Service Organic Act (16 U.S.C. 1 et seq.); and</text>
						</clause><clause id="idf2ac38e9-0a23-4d3a-bda0-99fc93c21307"><enum>(ii)</enum><text>the Act of
			 August 21, 1935 (16 U.S.C. 461 et seq.).</text>
						</clause></subparagraph></paragraph><paragraph id="id0698cb5c-cab1-4771-89ea-4d8d9388183c"><enum>(2)</enum><header>Management
			 coordination</header><text>The Secretary may coordinate the management and
			 operations of the Preserve with the Bandelier National Monument.</text>
				</paragraph><paragraph id="idbd2418a2-9bce-4b23-8a8c-78cd366ac79c"><enum>(3)</enum><header>Management
			 plan</header>
					<subparagraph id="id7326fa0e-27cb-44ae-bc34-e943451afb28"><enum>(A)</enum><header>In
			 general</header><text>Not later than 3 fiscal years after the date on which
			 funds are made available to implement this subsection, the Secretary shall
			 prepare a management plan for the Preserve.</text>
					</subparagraph><subparagraph id="id9604d4a4-14f5-4c94-b10a-fe1764f7b1a1"><enum>(B)</enum><header>Applicable
			 law</header><text>The management plan shall be prepared in accordance
			 with—</text>
						<clause id="idcfcdeb5c-56b9-46fa-b8c8-8faa3efa69c2"><enum>(i)</enum><text>section 12(b)
			 of Public Law 91–383 (commonly known as the <quote>National Park Service
			 General Authorities Act</quote>) (16 U.S.C. 1a–7(b)); and</text>
						</clause><clause id="id00c033b2-9466-487d-9578-f5074dec7a07"><enum>(ii)</enum><text>any other
			 applicable laws.</text>
						</clause></subparagraph><subparagraph id="idbf1e81f8-80d5-446f-8f86-0b26f49659ff"><enum>(C)</enum><header>Consultation</header><text>The
			 management plan shall be prepared in consultation with—</text>
						<clause id="idD08D3A0C6AC847888590C63B69519344"><enum>(i)</enum><text>the
			 Secretary of Agriculture;</text>
						</clause><clause id="id855c5bdb-3b81-448b-acf8-da32dc7a8c7f"><enum>(ii)</enum><text>State and
			 local governments;</text>
						</clause><clause id="id0b2ae8c8-074a-43dc-a26b-cf2038d2d25d"><enum>(iii)</enum><text>Indian
			 tribes and pueblos, including the Pueblos of Jemez, Santa Clara, and San
			 Ildefonso; and</text>
						</clause><clause id="idb42af442-21db-4a9d-9a36-54fb134361ea"><enum>(iv)</enum><text>the
			 public.</text>
						</clause></subparagraph></paragraph></subsection><subsection id="id9f521616-1e1b-4c57-a70c-13cdc786346a"><enum>(c)</enum><header>Acquisition
			 of land</header>
				<paragraph id="idefbb3aae-2094-407d-9633-68806bda68b9"><enum>(1)</enum><header>in
			 general</header><text>The Secretary may acquire land and interests in land
			 within the boundaries of the Preserve by—</text>
					<subparagraph id="ida3442ade-e958-4c2e-89ce-401942c20a3e"><enum>(A)</enum><text>purchase with
			 donated or appropriated funds;</text>
					</subparagraph><subparagraph id="id53441f5c-b843-466b-8cf4-096b756700db"><enum>(B)</enum><text>donation;
			 or</text>
					</subparagraph><subparagraph id="idcb22952b-2053-4648-9821-ff436e3a88a6"><enum>(C)</enum><text>transfer from
			 another Federal agency.</text>
					</subparagraph></paragraph><paragraph id="id546a4ada-be0a-4661-bf61-ddc860a824b9"><enum>(2)</enum><header>Administration
			 of acquired land</header><text>On acquisition of any land or interests in land
			 under paragraph (1), the acquired land or interests in land shall be
			 administered as part of the Preserve.</text>
				</paragraph></subsection><subsection id="idb2f0056e-21be-4246-a4b7-0ba09e92058a"><enum>(d)</enum><header>Science and
			 education program</header>
				<paragraph id="id7a5ae798-dae2-4250-a942-b1c878123fd4"><enum>(1)</enum><header>In
			 general</header><text>The Secretary shall—</text>
					<subparagraph id="id16c00bb8-5662-4a42-a030-9c2e67f89ece"><enum>(A)</enum><text>until the
			 date on which a management plan is completed in accordance with subsection
			 (b)(3), carry out the science and education program for the Preserve
			 established by the Trust; and</text>
					</subparagraph><subparagraph id="id2288e15a-94f4-4279-a465-a9c61b43cfd0"><enum>(B)</enum><text>beginning on
			 the date on which a management plan is completed in accordance with subsection
			 (b)(3), establish a science and education program for the Preserve that—</text>
						<clause id="idf8925e0c-ed8b-4888-9b5d-ca79be101339"><enum>(i)</enum><text>allows for
			 research and interpretation of the natural, historic, cultural, geologic and
			 other scientific features of the Preserve;</text>
						</clause><clause id="id94cc4769-548a-4fe1-aefe-dbe3b1451480"><enum>(ii)</enum><text>provides for
			 improved methods of ecological restoration and science-based adaptive
			 management of the Preserve; and</text>
						</clause><clause id="IDbbe02ac2f778410187b025eb3b757f47"><enum>(iii)</enum><text>promotes
			 outdoor educational experiences in the Preserve.</text>
						</clause></subparagraph></paragraph><paragraph id="id496d9b46-37ed-4e5b-8c91-53f9246e0a4d"><enum>(2)</enum><header>Science and
			 education center</header><text>As part of the program established under
			 paragraph (1)(B), the Secretary may establish a science and education center
			 outside the boundaries of the Preserve.</text>
				</paragraph></subsection><subsection id="idf1160f0c-86dd-4a6c-9223-d3c1115aa3d9"><enum>(e)</enum><header>Grazing</header><text>The
			 Secretary may allow the grazing of livestock within the Preserve to
			 continue—</text>
				<paragraph id="idE560B88420434209A2BC4D60C5ED0723"><enum>(1)</enum><text>consistent with
			 this Act; and</text>
				</paragraph><paragraph id="id420519F1FDBC4E56934166EA2F015E03"><enum>(2)</enum><text>to the extent the
			 use furthers scientific research or interpretation of the ranching history of
			 the Preserve.</text>
				</paragraph></subsection><subsection id="idf9776723-040a-415a-85d9-3161205b7b72"><enum>(f)</enum><header>Fish and
			 wildlife</header><text>Nothing in this Act affects the responsibilities of the
			 State with respect to fish and wildlife in the State, except that the
			 Secretary, in consultation with the New Mexico Department of Game and
			 Fish—</text>
				<paragraph id="IDf9aa12c1121147ea897031fe7cbdbdf5"><enum>(1)</enum><text>shall permit
			 hunting and fishing on land and water within the Preserve in accordance with
			 applicable Federal and State laws; and</text>
				</paragraph><paragraph id="IDdd0733c830bb4729b9c746d81e3a24b8"><enum>(2)</enum><text>may designate
			 zones in which, and establish periods during which, no hunting or fishing shall
			 be permitted for reasons of public safety, administration, the protection of
			 wildlife and wildlife habitats, or public use and enjoyment.</text>
				</paragraph></subsection><subsection id="IDa8bd332f3a0f4b4f989e108586fe6727"><enum>(g)</enum><header>Ecological
			 Restoration</header>
				<paragraph id="idFFD980B707544CA3852E29FBA52BBC26"><enum>(1)</enum><header>In
			 general</header><text>The Secretary shall undertake activities to improve the
			 health of forest, grassland, and riparian areas within the Preserve, including
			 any activities carried out in accordance with title IV of the Omnibus Public
			 Land Management Act of 2009 (16 U.S.C. 7301 et seq.).</text>
				</paragraph><paragraph id="IDd11111b7ac064eb3a3061a79befc4561"><enum>(2)</enum><header>Cooperative
			 agreements</header><text>The Secretary may enter into cooperative agreements
			 with adjacent pueblos to coordinate activities carried out under paragraph (1)
			 on the Preserve and adjacent pueblo land.</text>
				</paragraph></subsection><subsection id="idec693669-7dd7-42d4-99b3-7d366e17a40f"><enum>(h)</enum><header>Withdrawal</header><text display-inline="yes-display-inline">Subject to valid existing rights, all land
			 and interests in land within the boundaries of the Preserve are withdrawn
			 from—</text>
				<paragraph id="id72f96d5c-2b0c-4edd-9aec-bb0b54b9c790"><enum>(1)</enum><text>entry,
			 disposal, or appropriation under the public land laws;</text>
				</paragraph><paragraph id="id1bebd202-8ab6-4dfb-aa94-378fc8772f2e"><enum>(2)</enum><text>location,
			 entry, and patent under the mining laws; and</text>
				</paragraph><paragraph id="id91881d79-a694-4235-9a4f-b921e46a22fe"><enum>(3)</enum><text>operation of
			 the mineral leasing laws, geothermal leasing laws, and mineral materials
			 laws.</text>
				</paragraph></subsection><subsection id="id6c05a472-d631-4e8f-8a5c-01908fad9c8a"><enum>(i)</enum><header>Volcanic
			 domes and other Peaks</header>
				<paragraph id="id51dd23ca-3ff2-4d46-978e-ffe910581449"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Except as provided in
			 paragraph (3), for the purposes of preserving the natural, cultural, religious,
			 archaeological, and historic resources of the volcanic domes and other peaks in
			 the Preserve described in paragraph (2) within the area of the domes and peaks
			 above 9,600 feet in elevation or 250 feet below the top of the dome, whichever
			 is lower—</text>
					<subparagraph id="idB98F7EE11C7E4D2C940E92F458E6C6E1"><enum>(A)</enum><text display-inline="yes-display-inline">no roads or buildings shall be constructed;
			 and</text>
					</subparagraph><subparagraph id="id23E856B64BF74325BF4C427B4FB94F31"><enum>(B)</enum><text display-inline="yes-display-inline">no motorized access shall be
			 allowed.</text>
					</subparagraph></paragraph><paragraph id="id6697e923-34b1-499e-95a7-03259f6bfe1b"><enum>(2)</enum><header>Description
			 of volcanic domes</header><text>The volcanic domes and other peaks referred to
			 in paragraph (1) are—</text>
					<subparagraph id="id983f9f22-9c35-4065-9c12-9107c0c5eb07"><enum>(A)</enum><text>Redondo
			 Peak;</text>
					</subparagraph><subparagraph id="idead7bf43-eee1-421f-848c-cefdf1f57b7b"><enum>(B)</enum><text>Redondito;</text>
					</subparagraph><subparagraph id="idf8d1148d-6d88-4ecc-8888-a63856c27314"><enum>(C)</enum><text>South
			 Mountain;</text>
					</subparagraph><subparagraph id="id549da3eb-2752-4893-a4df-c0c0329f5a45"><enum>(D)</enum><text>San Antonio
			 Mountain;</text>
					</subparagraph><subparagraph id="idb173c7a0-66af-4bf2-bfb6-a353bb09cf09"><enum>(E)</enum><text>Cerro
			 Seco;</text>
					</subparagraph><subparagraph id="id3b4c1c37-4744-4873-9cc7-64d619f550da"><enum>(F)</enum><text>Cerro San
			 Luis;</text>
					</subparagraph><subparagraph id="idbc66d1af-0828-48a5-b7f2-1cb5fd8adf6d"><enum>(G)</enum><text>Cerros Santa
			 Rosa;</text>
					</subparagraph><subparagraph id="ida4c86dbd-419d-4c58-866b-7f53aede5d62"><enum>(H)</enum><text>Cerros del
			 Abrigo;</text>
					</subparagraph><subparagraph id="id80ca60b2-b0df-47d4-b5a7-81c72b8bf142"><enum>(I)</enum><text>Cerro del
			 Medio;</text>
					</subparagraph><subparagraph id="id26709fb1-974a-4fa2-8e4b-994281512aa6"><enum>(J)</enum><text>Rabbit
			 Mountain;</text>
					</subparagraph><subparagraph id="id30b0e241-ef7b-4b3e-817c-42cf8cbfa6f1"><enum>(K)</enum><text>Cerro
			 Grande;</text>
					</subparagraph><subparagraph id="id96cf9445-f5bf-4018-ba96-894c2d215d7a"><enum>(L)</enum><text>Cerro
			 Toledo;</text>
					</subparagraph><subparagraph id="id3DEB21D9B16743028CFC48F77C4928A4"><enum>(M)</enum><text>Indian
			 Point;</text>
					</subparagraph><subparagraph id="id3557bf2b-6293-43cb-a672-2fdf60e646c8"><enum>(N)</enum><text>Sierra de los
			 Valles; and</text>
					</subparagraph><subparagraph id="id82dc61b3-1b10-4166-ab12-2bb6929087ae"><enum>(O)</enum><text>Cerros de los
			 Posos.</text>
					</subparagraph></paragraph><paragraph id="id0717ac09-54a9-4877-aea5-4c5d7241bfd3"><enum>(3)</enum><header>Exception</header><text>Paragraph
			 (1) shall not apply in cases in which construction or motorized access is
			 necessary for administrative purposes (including ecological restoration
			 activities or measures required in emergencies to protect the health and safety
			 of persons in the area).</text>
				</paragraph></subsection><subsection id="id5a3957d0-af40-4095-b5aa-40fd90a92131"><enum>(j)</enum><header>Traditional
			 cultural and religious sites</header>
				<paragraph id="id6bad8302-f272-4121-97cb-2600af3a6b58"><enum>(1)</enum><header>In
			 general</header><text>The Secretary, in consultation with Indian tribes and
			 pueblos, shall ensure the protection of traditional cultural and religious
			 sites in the Preserve.</text>
				</paragraph><paragraph id="ID4bbf09c4bccc46018f0adf9515980f71"><enum>(2)</enum><header>Access</header><text>The
			 Secretary, in accordance with Public Law 95–341 (commonly known as the
			 <quote>American Indian Religious Freedom Act</quote>) (42 U.S.C. 1996)—</text>
					<subparagraph id="IDd2156cc5eecc403081db1fc5dae2c31c"><enum>(A)</enum><text>shall provide
			 access to the sites described in paragraph (1) by members of Indian tribes or
			 pueblos for traditional cultural and customary uses; and</text>
					</subparagraph><subparagraph id="IDdfe2ea145dca4dd0bb12aff4879e1253"><enum>(B)</enum><text>may, on request
			 of an Indian tribe or pueblo, temporarily close to general public use 1 or more
			 specific areas of the Preserve to protect traditional cultural and customary
			 uses in the area by members of the Indian tribe or pueblo.</text>
					</subparagraph></paragraph><paragraph id="IDbd746604856b4813badd60fc5e10572a"><enum>(3)</enum><header>Prohibition on
			 motorized access</header><text>The Secretary shall maintain prohibitions on the
			 use of motorized or mechanized travel on Preserve land located adjacent to the
			 Santa Clara Indian Reservation, to the extent the prohibition was in effect on
			 the date of enactment of this Act.</text>
				</paragraph></subsection><subsection id="ideb5f5baa-ea44-4825-8b50-0f44f39352df"><enum>(k)</enum><header>Caldera rim
			 trail</header>
				<paragraph id="id386190bb-7df2-42ca-ab67-600d18545ba4"><enum>(1)</enum><header>In
			 general</header><text>Not later than 3 years after the date of enactment of
			 this Act, the Secretary, in consultation with the Secretary of Agriculture,
			 affected Indian tribes and pueblos, and the public, shall study the feasibility
			 of establishing a hiking trail along the rim of the Valles Caldera on—</text>
					<subparagraph id="idb87d1f4a-10eb-479f-bd7a-6a04b02f4825"><enum>(A)</enum><text>land within
			 the Preserve; and</text>
					</subparagraph><subparagraph id="id5d0b9c4e-0409-4f2b-977b-d31165ab4b56"><enum>(B)</enum><text>National
			 Forest System land that is adjacent to the Preserve.</text>
					</subparagraph></paragraph><paragraph id="ID43571f5effa54dbcb323f56e4632f001"><enum>(2)</enum><header>Agreements</header><text>On
			 the request of an affected Indian tribe or pueblo, the Secretary and the
			 Secretary of Agriculture shall seek to enter into an agreement with the Indian
			 tribe or pueblo with respect to the Caldera Rim Trail that provides for the
			 protection of—</text>
					<subparagraph id="IDbfbe682ab62c441298b6490cb67eed37"><enum>(A)</enum><text>cultural and
			 religious sites in the vicinity of the trail; and</text>
					</subparagraph><subparagraph id="ID36c60bec4f8148ff9641e980d6d51c05"><enum>(B)</enum><text>the privacy of
			 adjacent pueblo land.</text>
					</subparagraph></paragraph></subsection><subsection id="ID70b0d661b92f4fe089dbc65af2e710a6"><enum>(l)</enum><header>Valid Existing
			 Rights</header><text>Nothing in this Act affects valid existing rights.</text>
			</subsection></section><section id="idf1ed1e70-09a4-4261-868d-f7fecebcbdb0"><enum>4.</enum><header>Transfer of
			 administrative jurisdiction</header>
			<subsection id="idf5922822-9db7-46ed-8765-101a6841de69"><enum>(a)</enum><header>In
			 general</header><text>Administrative jurisdiction over the Preserve is
			 transferred from the Secretary of Agriculture and the Trust to the Secretary,
			 to be administered as a unit of the National Park System, in accordance with
			 section 3.</text>
			</subsection><subsection id="iddcc9e9c4-5aad-4692-a5ee-f4be3a8dce48"><enum>(b)</enum><header>Exclusion
			 from santa fe national forest</header><text>The boundaries of the Santa Fe
			 National Forest are modified to exclude the Preserve.</text>
			</subsection><subsection id="ID3c71d4115ad34db39359503c488f4017"><enum>(c)</enum><header>Interim
			 management</header>
				<paragraph id="IDcae718bcc0c644fcaf6b54b5aaa8f967"><enum>(1)</enum><header>Memorandum of
			 agreement</header><text>Not later than 90 days after the date of enactment of
			 this Act, the Secretary and the Trust shall enter into a memorandum of
			 agreement to facilitate the orderly transfer to the Secretary of the
			 administration of the Preserve.</text>
				</paragraph><paragraph id="ID234ef226d32040fd9e10d87a0ff18054"><enum>(2)</enum><header>Existing
			 management plans</header><text>Notwithstanding the repeal made by section 5(a),
			 until the date on which the Secretary completes a management plan for the
			 Preserve in accordance with section 3(b)(3), the Secretary may administer the
			 Preserve in accordance with any management activities or plans adopted by the
			 Trust under the Valles Caldera Preservation Act (16 U.S.C. 698v et seq.), to
			 the extent the activities or plans are consistent with section 3(b)(1).</text>
				</paragraph><paragraph id="IDc46b4b8b3be7452a9472249b0a0954fc"><enum>(3)</enum><header>Public
			 use</header><text>The Preserve shall remain open to public use during the
			 interim management period, subject to such terms and conditions as the
			 Secretary determines to be appropriate.</text>
				</paragraph></subsection><subsection id="idd29ec8c4-0ce5-4fa2-ad32-6cb03378b201"><enum>(d)</enum><header>Valles
			 caldera trust</header>
				<paragraph id="idd0daa48c-568b-44ab-9df9-b8c6ccd856bc"><enum>(1)</enum><header>Termination</header><text>The
			 Trust shall terminate 180 days after the date of enactment of this Act unless
			 the Secretary determines that the termination date should be extended to
			 facilitate the transitional management of the Preserve.</text>
				</paragraph><paragraph id="ida240255c-c51e-48bc-85f6-4cb7b3733251"><enum>(2)</enum><header>Assets and
			 liabilities</header>
					<subparagraph id="idb6de9158-74ea-4408-9f48-396ff71c1c9c"><enum>(A)</enum><header>Assets</header><text>On
			 termination of the Trust—</text>
						<clause id="id3AED3D2E130B40B2AD97E51995311C1D"><enum>(i)</enum><text>all
			 assets of the Trust shall be transferred to the Secretary; and</text>
						</clause><clause id="id717C109985194F2293EA5017BD2BC94E"><enum>(ii)</enum><text>any amounts
			 appropriated for the Trust shall remain available to the Secretary for the
			 administration of the Preserve.</text>
						</clause></subparagraph><subparagraph id="id766f957d-607c-4618-b5d3-cf6975765d5f"><enum>(B)</enum><header>Assumption
			 of obligations</header>
						<clause id="id22b994cd-71b4-4bdf-9827-8562fba8b915"><enum>(i)</enum><header>In
			 general</header><text>On termination of the Trust, the Secretary shall assume
			 all contracts, obligations, and other liabilities of the Trust.</text>
						</clause><clause id="id47090d28-eaf9-4e14-aa36-7373d2aa17b2"><enum>(ii)</enum><header>New
			 liabilities</header>
							<subclause id="idf98ebbb5-0220-4dd7-ab68-34a9f7314659"><enum>(I)</enum><header>Budget</header><text>Not
			 later than 90 days after the date of enactment of this Act, the Secretary and
			 the Trust shall prepare a budget for the interim management of the
			 Preserve.</text>
							</subclause><subclause id="id0cb83993-ab5b-4453-938a-121f7424d12b"><enum>(II)</enum><header>Written
			 concurrence required</header><text>The Trust shall not incur any new
			 liabilities not authorized in the budget prepared under subclause (I) without
			 the written concurrence of the Secretary.</text>
							</subclause></clause></subparagraph></paragraph><paragraph id="idf10b7bd0-c48d-457a-8868-3c463a968bab"><enum>(3)</enum><header>Personnel</header>
					<subparagraph id="id104a70b2-8103-493f-bbad-07207bf452fc"><enum>(A)</enum><header>Hiring</header><text>The
			 Secretary and the Secretary of Agriculture may hire employees of the Trust on a
			 noncompetitive basis for comparable positions at the Preserve or other areas or
			 offices under the jurisdiction of the Secretary or the Secretary of
			 Agriculture.</text>
					</subparagraph><subparagraph id="ida4c8c0ad-db79-4097-b962-998cb1c84dd9"><enum>(B)</enum><header>Salary</header><text>Any
			 employees hired from the Trust under subparagraph (A) shall be subject to the
			 provisions of chapter 51, and subchapter III of chapter 53, title 5, United
			 States Code, relating to classification and General Schedule pay rates.</text>
					</subparagraph><subparagraph id="id99ccbeba-39d3-419c-adc2-0ecb86b8afcc"><enum>(C)</enum><header>Interim
			 retention of eligible employees</header><text>For a period of not less than 180
			 days beginning on the date of enactment of this Act, all eligible employees of
			 the Trust shall be—</text>
						<clause id="idc2c12770-1b6e-41c9-a813-868c72aa4d4d"><enum>(i)</enum><text>retained in
			 the employment of the Trust;</text>
						</clause><clause id="id2e964e9d-88c3-4684-9749-190d7c072971"><enum>(ii)</enum><text>considered
			 to be placed on detail to the Secretary; and</text>
						</clause><clause id="id574b3108-7904-4880-bf43-e0a3ce90b3b1"><enum>(iii)</enum><text>subject to
			 the direction of the Secretary.</text>
						</clause></subparagraph><subparagraph id="idb633a732-1b91-43ec-ac8b-ab0ef4c790f8"><enum>(D)</enum><header>Termination
			 for cause</header><text>Nothing in this paragraph precludes the termination of
			 employment of an eligible employee for cause during the period described in
			 subparagraph (C).</text>
					</subparagraph></paragraph><paragraph id="idada57614-d9e5-4014-b480-b9bb98765ef3"><enum>(4)</enum><header>Records</header><text>The
			 Secretary shall have access to all records of the Trust pertaining to the
			 management of the Preserve.</text>
				</paragraph><paragraph id="id92f1b9ad-b6d6-49c4-a049-c26d75ac8266"><enum>(5)</enum><header>Valles
			 caldera fund</header>
					<subparagraph id="idfdb27606-d711-47d0-ac3b-70add46f5053"><enum>(A)</enum><header>In
			 general</header><text>Effective on the date of enactment of this Act, the
			 Secretary shall assume the powers of the Trust over the Fund.</text>
					</subparagraph><subparagraph id="iddca47b38-6fe1-42d9-bbfe-d289335ed5e7"><enum>(B)</enum><header>Availability
			 and use</header><text>Any amounts in the Fund as of the date of enactment of
			 this Act shall be available to the Secretary for use, without further
			 appropriation, for the management of the Preserve.</text>
					</subparagraph></paragraph></subsection></section><section id="ide71c754b-99f1-4127-8fd4-d2c8a406348c"><enum>5.</enum><header>Repeal of
			 valles caldera preservation act</header>
			<subsection id="id84341579-d183-4a43-bfe0-d379e47e41d1"><enum>(a)</enum><header>Repeal</header><text display-inline="yes-display-inline">On the termination of the Trust, the Valles
			 Caldera Preservation Act (16 U.S.C. 698v et seq.) is repealed.</text>
			</subsection><subsection id="IDb29354d8fec54253a8f6d3f2968d16bf"><enum>(b)</enum><header>Effect of
			 repeal</header><text>Notwithstanding the repeal made by subsection (a)—</text>
				<paragraph id="ID356590a5aee449568476146e7786d124"><enum>(1)</enum><text>the authority of
			 the Secretary of Agriculture to acquire mineral interests under section 104(e)
			 of the Valles Caldera Preservation Act (16 U.S.C. 698v–2(e)) is transferred to
			 the Secretary and any proceeding for the condemnation of, or payment of
			 compensation for, an outstanding mineral interest pursuant to the transferred
			 authority shall continue;</text>
				</paragraph><paragraph id="ID7e25d818e91348d6a9ed8966e307b309"><enum>(2)</enum><text>the provisions in
			 section 104(g) of the Valles Caldera Preservation Act (16 U.S.C. 698v–2(g))
			 relating to the Pueblo of Santa Clara shall remain in effect; and</text>
				</paragraph><paragraph id="IDaa4f198ae57a401bbd6ac6ff338e3351"><enum>(3)</enum><text>the Fund shall
			 not be terminated until all amounts in the Fund have been expended by the
			 Secretary.</text>
				</paragraph></subsection><subsection id="IDcb72e629726640469229d125ee3055e0"><enum>(c)</enum><header>Boundaries</header><text>The
			 repeal of the Valles Caldera Preservation Act (16 U.S.C. 698v et seq.) shall
			 not affect the boundaries as of the date of enactment of this Act (including
			 maps and legal descriptions) of—</text>
				<paragraph id="IDd6d43d7c87a440189a541af750dfb635"><enum>(1)</enum><text>the
			 Preserve;</text>
				</paragraph><paragraph id="IDaae206e7865249c18ab242c596ce59d1"><enum>(2)</enum><text>the Santa Fe
			 National Forest (other than the modification made by section 4(b));</text>
				</paragraph><paragraph id="IDc8fa7c1bb27c467bbb08c67f01daa9b6"><enum>(3)</enum><text>Bandelier
			 National Monument; and</text>
				</paragraph><paragraph id="ID24305e88f9d343898ae6a35bbd65cccb"><enum>(4)</enum><text>any land conveyed
			 to the Pueblo of Santa Clara.</text>
				</paragraph></subsection></section><section id="id27b77b86-aea8-404c-a390-4ffc5c51a496"><enum>6.</enum><header>Authorization
			 of appropriations</header><text display-inline="no-display-inline">There are
			 authorized to be appropriated such sums as are necessary to carry out this
			 Act.</text>
