		<official-title>To amend title 10, United States Code, to authorize
		  space-available travel on military aircraft for members of the reserve
		  components, a member or former member of a reserve component who is eligible
		  for retired pay but for age, widows and widowers of retired members, and
		  dependents.</official-title>

		<section id="id98FED3E0901C4FF78F013627D405FD6E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>National Guard, Reserve, “Gray Area”
			 Retiree, and Surviving Spouses Space-available Travel Equity Act of
			 2011</short-title></quote>.</text>
		</section><section id="idA63E4D3772344691A62591BA85C7AC45" section-type="subsequent-section"><enum>2.</enum><header>Eligibility of reserve
			 members, gray-area retirees, widows and widowers of retired members, and
			 dependents for space-available travel on military aircraft</header>
			<subsection id="id0FC7ADEB501D4EEE8CDD8D9EF770AF53"><enum>(a)</enum><header>Eligibility</header><text display-inline="yes-display-inline">Chapter 157 of title 10, United States
			 Code, is amended by inserting after section 2641b the following new
			 section:</text>
				<quoted-block display-inline="no-display-inline" id="idD0446CDFFD5C4CAEAC80B21DC78DC4E4" style="USC">
					<section id="IDda359e9fd41d4983848680e884d34589"><enum>2641c.</enum><header>Space-available
				travel on Department of Defense aircraft: reserve members, reserve members
				eligible for retired pay but for age; widows and widowers of retired members
				and dependents</header>
						<subsection id="IDf4d73ba4a77041b196d9b81687b1ac7a"><enum>(a)</enum><header>Reserve
				members</header><text>A member of a reserve component holding a valid Uniformed
				Services Identification and Privilege Card shall be provided transportation on
				Department of Defense aircraft, on a space-available basis, on the same basis
				as active duty members of the uniformed services under any other provision of
				law or Department of Defense regulation.</text>
						</subsection><subsection id="ID6676e3e1f51643088b12b40ff8c93888"><enum>(b)</enum><header>Reserve
				retirees under applicable eligibility age</header><text>A member or former
				member of a reserve component who, but for being under the eligibility age
				applicable to the member under section 12731 of this title, otherwise would be
				eligible for retired pay under chapter 1223 of this title shall be provided
				transportation on Department of Defense aircraft, on a space-available basis,
				on the same basis as members of the armed forces entitled to retired pay under
				any other provision of law or Department of Defense regulation.</text>
						</subsection><subsection id="ID2355ee96453145f496c5401159e70950"><enum>(c)</enum><header>Widows and
				widowers of retired members</header>
							<paragraph id="id4D7F46DA85C94CAAA2BDF62572477F5A"><enum>(1)</enum><header>In
				general</header><text>An unremarried widow or widower of a member of the armed
				forces described in paragraph (2) shall be provided transportation on
				Department of Defense aircraft, on a space-available basis, on the same basis
				as members of the armed forces entitled to retired pay under any other
				provision of law or Department of Defense regulation.</text>
							</paragraph><paragraph id="id9A1C2CD781B84E6C8877E3441608C0E8"><enum>(2)</enum><header>Members
				covered</header><text>A member of the armed forces referred to in paragraph (1)
				is a member who—</text>
								<subparagraph id="id11D5A8C4193847AB8BBE4B338FE6D1F8"><enum>(A)</enum><text>is entitled to
				retired pay;</text>
								</subparagraph><subparagraph id="idD997C48717104D03865946F9C2BBBC42"><enum>(B)</enum><text>dies in line of
				duty while on active duty and is not eligible for retired pay; or</text>
								</subparagraph><subparagraph id="id60034749D28F4DE983D6EA3F6D4AD15A"><enum>(C)</enum><text>in the case of a
				member of a reserve component, dies as a result of a line of duty condition and
				is not eligible for retired pay.</text>
								</subparagraph></paragraph></subsection><subsection id="ID9c340190b90946f98bad8da08d3d596c"><enum>(d)</enum><header>Dependents</header><text>A
				dependent of a member or former member described in either subsections (a) or
				(b) or of a deceased member entitled to retired pay holding a valid Uniformed
				Services Identification and Privilege Card and a surviving unremarried spouse
				and the surviving dependent of a deceased member or former member described in
				subsection (b) holding a valid Uniformed Services Identification and Privilege
				Card shall be provided transportation on Department of Defense aircraft, on a
				space-available basis, if the dependent is accompanying the member or, in the
				case of a deceased member, is the surviving unremarried spouse of the deceased
				member or is a dependent accompanying the surviving unremarried spouse of the
				deceased member.</text>
						</subsection><subsection id="IDacbe072b9efb4d18bbde04805b9eba98"><enum>(e)</enum><header>Definition of
				dependent</header><text display-inline="yes-display-inline">In this section,
				the term <term>dependent</term> has the meaning given that term in section 1072
				of this
				title.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="IDd6490c2d8eb2442985d5b00b9381c111"><enum>(b)</enum><header>Clerical
			 amendment</header><text>The table of sections at the beginning of such chapter
			 is amended by inserting after the item relating to section 2641b the following
			 new item:</text>
