		<official-title>To amend the Clean Air Act to provide for a reduction in
		  the number of boutique fuels, and for other purposes.</official-title>

		<section id="HE0F2E566E9B642199D9DB345EACB871" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Boutique Fuel Reduction Act of
			 2011</short-title></quote>.</text>
		</section><section id="idE5D62385EBD64CD1BAE6A6279254E2A4"><enum>2.</enum><header>Reduction in
			 number of boutique fuels</header><text display-inline="no-display-inline">Section 211(c)(4)(C) of the Clean Air Act
			 (42 U.S.C. 7545(c)(4)(C)) is amended—</text>
			<paragraph id="idBCF6BD4C0F994C159D378B2C4AB317FF"><enum>(1)</enum><text>in clause
			 (ii)(II), by inserting <quote>an unexpected problem with distribution or
			 delivery equipment that is necessary for the transportation or delivery of fuel
			 or fuel additives,</quote> after <quote>equipment failure,</quote>;</text>
			</paragraph><paragraph id="id12266C57B4794E2D8DF1D2A78DD55214"><enum>(2)</enum><text>by redesignating
			 the second clause (v) (relating to the authority of the Administrator to
			 approve certain State implementation plans) as clause (vi); and</text>
			</paragraph><paragraph id="id1591C5A5485F4237A6DBF008878775C6"><enum>(3)</enum><text>in clause (vi)
			 (as redesignated by paragraph (2))—</text>
				<subparagraph id="id624E2657D51F434B8ADBD85F89BEFFB6"><enum>(A)</enum><text>in subclause (I),
			 by striking <quote>fuels approved under</quote> and all that follows through
			 the end of the subclause and inserting <quote>fuels included on the list
			 published under subclause (II) (including any revisions to the list under
			 subclause (III)).</quote>;</text>
				</subparagraph><subparagraph id="idF904067ABD924EF098DB72ECE1D616AE"><enum>(B)</enum><text>by striking
			 subclause (III) and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="id6DFF0870EFD14FF6A9B67DAE4525099B" style="OLC">
						<subclause id="IDb5b4ffa5c3904f8094e1a76a23a167dc"><enum>(III)</enum><header>Removal of
				fuels from list</header>
							<item id="idEEA06F095408406080C089ABF9C3DA42"><enum>(aa)</enum><header>In
				general</header><text>The Administrator, after providing notice and an
				opportunity for comment, shall remove a fuel from the list published under
				subclause (II) if the Administrator determines that the fuel has ceased to be
				included in any State implementation plan or is identical to a Federal fuel
				control or prohibition established and enforced the Administrator.</text>
							</item><item id="idE5A3CEF3630343A0AFC63AAEF2A4BA88"><enum>(bb)</enum><header>Publication of
				revised list</header><text>On removing a fuel from the list under item (aa),
				the Administrator shall publish a revised list that reflects that
				removal.</text>
							</item></subclause><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</subparagraph><subparagraph id="id7E15F7443A2348D782E70B50BCC34DB3"><enum>(C)</enum><text>by striking
			 subclause (IV) and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="idB0E2480374284656A68B32A2EE3F7498" style="OLC">
						<subclause id="idC31E197B946449B1AFC173133CC9FB70"><enum>(IV)</enum><header>No limitation
				on authority</header><text>Nothing in subclause (I) or (V) limits the authority
				of the Administrator to approve a control or prohibition relating to any new
				fuel under this paragraph in a State implementation plan (or a revision to such
				a plan), if—</text>
							<item id="idAC82ECF80E424A8588EAC6A92CB4AE6C"><enum>(aa)</enum><text>the new fuel
				completely replaces a fuel on the list published under subclause (II)
				(including any revisions to the list under subclause (III)); and</text>
							</item><item id="idE5753D84E2D74EA486CC1A468756FC66"><enum>(bb)</enum><text>the
				Administrator, in consultation with the Secretary of Energy, publishes in the
				Federal Register, after providing notice and an opportunity for public comment,
				a determination that the control or prohibition will not cause any fuel supply
				or distribution interruption or have any significant adverse impact on fuel
				producibility in the affected area or any contiguous
				area.</text>
