		  prevention and treatment of eating disorders, to improve access to treatment of

		<section commented="no" display-inline="no-display-inline" id="S1" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Federal Response to Eliminate Eating
			 Disorders Act</short-title></quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="id88B6AEFCCA8C4CC38A1E6B06AD735EFA" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Findings</header><text display-inline="no-display-inline">Congress finds as follows:</text>
			<paragraph commented="no" display-inline="no-display-inline" id="id20AA25BBCC0B491E92E56D7F2AF8C005"><enum>(1)</enum><text display-inline="yes-display-inline">Estimates, based on current research,
			 indicate that at least 5,000,000 people in the United States suffer from eating
			 disorders including anorexia nervosa, bulimia nervosa, binge eating disorder,
			 and eating disorders not otherwise specified (referred to in this Act as
			 <quote>EDNOS</quote>).</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDa04711747f47422eb6efc4aee4293d0d"><enum>(2)</enum><text display-inline="yes-display-inline">Anecdotal evidence suggests that as many as
			 11,000,000 people in the United States, including 1,000,000 males, may suffer
			 from eating disorders.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDcdf568cc09de46dfb451f52f792db4fc"><enum>(3)</enum><text display-inline="yes-display-inline">Eating disorders occur in all nations and
			 in all populations, and among people of all ages and races and of both
			 genders.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDb7a78d78b08a4f6fb54dc0ce3c08791a"><enum>(4)</enum><text display-inline="yes-display-inline">Eating disorders are diseases with grave
			 health consequences and high rates of mortality.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID67a03b2dca134c8a81cfe50ed4486441"><enum>(5)</enum><text display-inline="yes-display-inline">Health consequences associated with eating
			 disorders include heart failure and other serious cardiac conditions,
			 electrolyte imbalance, kidney failure, osteoporosis, debilitating tooth decay,
			 and gastrointestinal disorders, including esophageal inflammation and rupture,
			 gastric rupture, peptic ulcers, and pancreatitis.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDa9dab49e9d14490a996b0c38cb158b05"><enum>(6)</enum><text display-inline="yes-display-inline">Anorexia nervosa has one of the highest
			 overall mortality rates of any mental illness. According to the National
			 Institute of Mental Health, 1 in 10 people with anorexia nervosa will die of
			 starvation, cardiac arrest, or another medical complication.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idECAD5CC5746044F3941BF101196B77CE"><enum>(7)</enum><text display-inline="yes-display-inline">The risk of death among adolescents with
			 anorexia nervosa is 11 times greater than in disease-free adolescents.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID121ab05dfc0c4bf583168021865f2e37"><enum>(8)</enum><text display-inline="yes-display-inline">Anorexia nervosa has the highest suicide
			 rate of all mental illnesses.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID2a199a4cff3240c1bb3237ebd845a49b"><enum>(9)</enum><text display-inline="yes-display-inline">New research suggests that bulimia nervosa
			 has a much higher rate of mortality than is reflected in current statistics,
			 because of the failure to identify the underlying eating disorder.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idE7EE3BF4EDDE469D9BB30B6FE5119FB5"><enum>(10)</enum><text display-inline="yes-display-inline">Binge eating disorder is the most common
			 eating disorder, with an estimated 3.5 percent of American women and 2 percent
			 of American men expected to suffer from this disorder in their lifetime. Binge
			 eating disorder is characterized by frequent episodes of uncontrolled
			 overeating and is associated with obesity, heart disease, gall bladder disease,
			 and diabetes.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID522b5203f276468db73670a4b1beae5c"><enum>(11)</enum><text display-inline="yes-display-inline">Research demonstrates that there is a
			 significant genetic component to the development of eating disorders.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDd20952e3edb741b7b0c75b7f5ef7d89e"><enum>(12)</enum><text display-inline="yes-display-inline">Certain populations, including adolescent
			 females and athletes of both genders, are at higher risk of developing an
			 eating disorder.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDde458b259ced4c73b248868674ab7523"><enum>(13)</enum><text display-inline="yes-display-inline">Different types of eating disorders may
			 affect certain races and genders disproportionately.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID10905e447c8a4fb8a99ffece077cd9bd"><enum>(14)</enum><text display-inline="yes-display-inline">Despite the serious health consequences and
			 the high risk of death, Federal research funding for eating disorders has
			 lagged behind research concerning other diseases, when compared by the number
			 of individuals affected by, and the relative health consequences of, the
			 diseases.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID434dcd50406a43f99114f9db8540622d"><enum>(15)</enum><text display-inline="yes-display-inline">The ability of individuals suffering from
			 eating disorders, particularly bulimia nervosa, binge eating disorder, and
			 EDNOS to access appropriate treatment is unacceptably low.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id18E3E4358DDE4633AF2CD0A378BD153E"><enum>(16)</enum><text display-inline="yes-display-inline">The development of an eating disorder is
			 frequently preceded by unhealthy weight control behaviors commonly identified
			 as disordered eating, including skipping meals, using diet pills, taking
			 laxatives, self-induced vomiting, and fasting. Such disordered eating behaviors
			 should be included in enhanced research prevention and training efforts.</text>
			</paragraph></section><section commented="no" display-inline="no-display-inline" id="idB5DFDC86D1B140F3ABFA4D8F309F467C" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Purposes</header><text display-inline="no-display-inline">The purposes of this Act are—</text>
			<paragraph commented="no" display-inline="no-display-inline" id="idE7075315AE3C4F4BBCD0D466F413BB13"><enum>(1)</enum><text display-inline="yes-display-inline">to expand research into the prevention of
			 eating disorders;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idA1C1D624B9AE4FD6B15D4D71CEE5F0B1"><enum>(2)</enum><text display-inline="yes-display-inline">to expand research on effective treatment
			 and intervention of eating disorders and to support evidence-based programs
			 designed to prevent eating disorders;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2F9F24908AB14D58815F78A171EDA408"><enum>(3)</enum><text display-inline="yes-display-inline">to expand research on the causes, courses,
			 and outcomes of eating disorders;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id86B8D1D56B084F32AD306D56B15A3AF2"><enum>(4)</enum><text display-inline="yes-display-inline">to increase the number of people properly
			 screened and diagnosed with an eating disorder;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idCBD50E43CED6441D912D9CFC4B971836"><enum>(5)</enum><text display-inline="yes-display-inline">to improve training and education of health
			 care and behavioral care providers and of school personnel at all levels of
			 elementary and secondary education;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4B04351C5FEC497D9FC68B907DD95F78"><enum>(6)</enum><text display-inline="yes-display-inline">to improve surveillance and data systems
			 for tracking the prevalence, severity, and economic costs of eating disorders;
			 and</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDee146c3815e4411a9e5c692868240efe"><enum>(7)</enum><text display-inline="yes-display-inline">to enhance access to comprehensive
			 treatment for eating disorders.</text>
			</paragraph></section><title commented="no" id="idD3F341B7F2B141CC922CCF43EB258628" level-type="subsequent"><enum>I</enum><header display-inline="yes-display-inline">Eating disorder detection and
			 research</header>
			<section commented="no" display-inline="no-display-inline" id="idFAACF03B29ED41E3A9D7CE946FED0A05" section-type="subsequent-section"><enum>101.</enum><header display-inline="yes-display-inline">Expansion and coordination of the
			 activities of the National Institute of Health and the National Institute of
			 Mental Health with respect to research on eating disorders</header><text display-inline="no-display-inline">Part B of title IV of the Public Health
			 Service Act (42 U.S.C. 284 et seq.) is amended by adding at the end the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="id28DF542F8F214A2A9E23E2068D191BE0" style="OLC">
					<section commented="no" display-inline="no-display-inline" id="id7B968DC445454889A988B6E16BE8E9B7" section-type="subsequent-section"><enum>409K.</enum><header display-inline="yes-display-inline">Expansion and coordination of activities
				with respect to research on eating disorders</header>
						<subsection commented="no" display-inline="no-display-inline" id="id5A37F3E591BD45D29449FCB0F06C1D23"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Director of NIH, pursuant to the
				general authority of such director, shall expand, intensify, and coordinate the
				activities of the National Institutes of Health with respect to research on
				eating disorders.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="id162A920136444E31A8F92A9D974E4DC2"><enum>(b)</enum><header display-inline="yes-display-inline">Grants</header><text display-inline="yes-display-inline">The Director of NIH may award grants to
				public or private entities to pay all or part of the cost of planning,
				establishing, improving, and providing basic operating support for such
				entities to establish consortia in eating disorder research and to carry out
				the activities described in subsection (e).</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="idBFD551ECA99046E184A04A4E3D49B3F3"><enum>(c)</enum><header display-inline="yes-display-inline">Eligible entities</header><text display-inline="yes-display-inline">To be eligible to receive a grant under
				this section, an entity shall—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="idA71F945BFC02470B83A97F16FACD3FAD"><enum>(1)</enum><text display-inline="yes-display-inline">be public or nonprofit private entity
				(including a health department of a State, a political subdivision of a State,
				or an institution of higher education); and</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF496AC98DC2246668DA6BCA589B3615B"><enum>(2)</enum><text display-inline="yes-display-inline">submit to the Secretary an application at
				such time, in such manner, and containing such information as the Secretary may
				require.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idB54EB9CBD05C43EC9DD2AE9294ED9D34"><enum>(d)</enum><header display-inline="yes-display-inline">Requirements of consortia</header>
							<paragraph commented="no" display-inline="no-display-inline" id="id97F537F3B97B4FAA9303B9A2E534044E"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Each consortium established as described in
				subsection (b) may use the facilities of a single lead institution, or may be
				formed from several cooperating institutions, meeting such requirements as may
				be prescribed by the Director of NIH.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID0fe2e3439341446589924daba765f46f"><enum>(2)</enum><header display-inline="yes-display-inline">Coordination of consortia</header><text display-inline="yes-display-inline">The Director of NIH—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="id5CB835F7108B476088C27203BD444CF3"><enum>(A)</enum><text display-inline="yes-display-inline">may, as appropriate, provide for the
				coordination of information among consortia established under subsection (b);
				and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idB7FB780A67044B879C70907B137DA955"><enum>(B)</enum><text display-inline="yes-display-inline">shall ensure regular communication between
				members of the various consortia established using grants awarded under this
				section.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5EC460FB639C4B56BC029CD4709D9DBD"><enum>(3)</enum><header display-inline="yes-display-inline">Reports</header><text display-inline="yes-display-inline">The Director of NIH shall require each
				consortium to prepare and submit to such director annual reports on the
				activities of such consortium.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id55445064930D4756B6D76E7F3DAEF868"><enum>(e)</enum><header display-inline="yes-display-inline">Activities</header><text display-inline="yes-display-inline">Each consortium receiving a grant under
				subsection (b) shall conduct basic, clinical, epidemiological,
				population-based, or translational research regarding eating disorders, which
				may include research related to—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="idB31ABA56D5614B2FA843A4B94ED642E6"><enum>(1)</enum><text display-inline="yes-display-inline">the identification and classification of
				eating disorders and disordered eating;</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idA6310CE236174239B0C3387314379026"><enum>(2)</enum><text display-inline="yes-display-inline">the causes, diagnosis, and early detection
				of eating disorders;</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id55D0594CD4274ABD8D7D1F0F3473883F"><enum>(3)</enum><text display-inline="yes-display-inline">the treatment of eating disorders,
				including the development and evaluation of new treatments and best
				practices;</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idA8DA8A1D6F20445B8A8669A03624A043"><enum>(4)</enum><text display-inline="yes-display-inline">the conditions or diseases related to, or
				arising from, an eating disorder; and</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idFA0818E2A0394483A5079DFCB8B10CA8"><enum>(5)</enum><text display-inline="yes-display-inline">the evaluation of existing prevention
				programs and the development of reliable prevention and screening
				programs.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID5468f742e85141e8b18a6228eb0762db"><enum>(f)</enum><header display-inline="yes-display-inline">Collaboration</header><text display-inline="yes-display-inline">The Secretary, acting through the Director
				of NIH and the Director of the National Institute of Mental Health, shall
				identify relevant Federal agencies (including the other institutes and centers
				of the National Institutes of Health, the Centers for Medicare &amp; Medicaid
				Services, the Centers for Disease Control and Prevention, the Agency for
				Healthcare Research and Quality, the Substance Abuse and Mental Health Services
				Administration, the Health Resources and Services Administration, and the
				Office on Women’s Health) that shall collaborate with respect to activities
				conducted under subsection (d).</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="ID27e8d989de494ae68c3f8849b788177f"><enum>(g)</enum><header display-inline="yes-display-inline">Public input</header><text display-inline="yes-display-inline">The Director of NIH shall provide for a
				mechanism—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="idDE281B714C4B412EA1EE1023EBB92334"><enum>(1)</enum><text display-inline="yes-display-inline">to educate and disseminate information on
				the existing and planned programs and research activities of the National
				Institutes of Health with respect to eating disorders; and</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id95A27540C57A4A9F8D2E33701953778D"><enum>(2)</enum><text display-inline="yes-display-inline">through which the Director of NIH may
				receive comments from the public regarding such programs and activities.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idED17207736274DFB927FF21FECE7583C"><enum>(h)</enum><header display-inline="yes-display-inline">Dissemination of information</header><text display-inline="yes-display-inline">The Director of NIH shall provide for a
				mechanism for making the results and information generated by the consortia
				publicly available, such as through the Internet.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="idE8BE828F0A4F449BAC3AC742E7300E71"><enum>(i)</enum><header display-inline="yes-display-inline">Definition</header><text display-inline="yes-display-inline">For purposes of this section, the term
				<term>eating disorder</term> has the meaning given such term in section
				399OO(e).</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="id5974312551B148D39D3AC98FF04E9FB4"><enum>(j)</enum><header display-inline="yes-display-inline">Authorization of
				appropriations</header><text display-inline="yes-display-inline">To carry out
				this section, there are authorized to be appropriated such sums as may be
				necessary for each of fiscal years 2012 through
				2016.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section commented="no" display-inline="no-display-inline" id="id01E7B3A4AFBC4D108837E31332167BCF" section-type="subsequent-section"><enum>102.</enum><header display-inline="yes-display-inline">Interagency coordinating council;
			 Surveillance and research program; study on economic cost</header><text display-inline="no-display-inline">Title III of the Public Health Service Act
			 (42 U.S.C. 241 et seq.) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id3AA586231CF14BF38DD51C79DE5CB51A" style="OLC">
					<part commented="no" id="idBBACEF157FC6471CAA63C1A8202F9D11" level-type="subsequent"><enum>W</enum><header display-inline="yes-display-inline">Programs relating to eating
				disorders</header>
						<section commented="no" display-inline="no-display-inline" id="idBFB7544EDF34442C9FF0608B1AC0839B" section-type="subsequent-section"><enum>399OO.</enum><header display-inline="yes-display-inline">Interagency eating disorders coordinating
				council</header>
							<subsection commented="no" display-inline="no-display-inline" id="idF90AC52C4A6B4404B2CA242279CDB52F"><enum>(a)</enum><header display-inline="yes-display-inline">Establishment</header><text display-inline="yes-display-inline">There is established within the Department
				of Health and Human Services the Interagency Eating Disorders Coordinating
				Council (referred to in this section as the <quote>Coordinating
				Council</quote>).</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="ID3bf66ff286da4258bfa4186b06670b69"><enum>(b)</enum><header display-inline="yes-display-inline">Responsibilities</header><text display-inline="yes-display-inline">The Coordinating Council shall—</text>
								<paragraph commented="no" display-inline="no-display-inline" id="idBFB9D70A52B4493C838C74B0A75D399A"><enum>(1)</enum><text display-inline="yes-display-inline">develop and annually update a summary of
				advances in eating disorder research concerning causes of, prevention of, early
				screening for, treatment and access to services related to, and supports for
				individuals affected by, eating disorders;</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idEF79C5D73BFB4D04B4737591988BEA12"><enum>(2)</enum><text display-inline="yes-display-inline">monitor Federal activities with respect to
				eating disorders;</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0D04D99FB94149A19692361AAAF0C51E"><enum>(3)</enum><text display-inline="yes-display-inline">make recommendations to the Secretary
				regarding any appropriate changes to such activities, and to the Director of
				NIH, with respect to the strategic plan developed under paragraph (4);</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id61CDA23EB21E44B395A5C1E1F984DE52"><enum>(4)</enum><text display-inline="yes-display-inline">develop and annually update a strategic
				plan for the conduct of, and support for, eating disorder research, including
				proposed budgetary recommendations; and</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF8EBFBDD5CAD46ED8E6FBE217F0B107C"><enum>(5)</enum><text display-inline="yes-display-inline">submit annually to the Committee on Health,
				Education, Labor, and Pensions of the Senate and the Committee on Energy and
				Commerce of the House of Representatives the strategic plan developed under
				paragraph (4) and all updates to such plan.</text>
								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id8BB861710D094F0FA48FF58751587E46"><enum>(c)</enum><header display-inline="yes-display-inline">Membership</header>
								<paragraph commented="no" display-inline="no-display-inline" id="idF469A0F8483B4E2AB95A3254BE49D740"><enum>(1)</enum><header display-inline="yes-display-inline">Chairperson</header><text display-inline="yes-display-inline">The Director of NIH shall serve as the
				chairperson of the Coordinating Council and shall be responsible for the
				leadership and oversight of the activities of the Coordinating Council.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3AA82ABA276D4ED4B523D58BC556D0C6"><enum>(2)</enum><header display-inline="yes-display-inline">Members in general</header><text display-inline="yes-display-inline">The Coordinating Council shall be composed
				of—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="idF4C10D855BDA479580F644BEF8D3ADEE"><enum>(A)</enum><text display-inline="yes-display-inline">representatives of—</text>
										<clause commented="no" display-inline="no-display-inline" id="IDe2f8916dc792445aa4f4b6dcf62f0aae"><enum>(i)</enum><text display-inline="yes-display-inline">the Agency for Healthcare Research and
				Quality;</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="idBD96C4BD79E24F508F1C4FD861501A0B"><enum>(ii)</enum><text display-inline="yes-display-inline">the Substance Abuse and Mental Health
				Administration;</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="id0808DDF37748446AB3FD858C62529162"><enum>(iii)</enum><text display-inline="yes-display-inline">the research institutes at the National
				Institutes of Health, as the Director of NIH determines appropriate;</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="id48EF0CE1CD0B4A1E80B485E63EA46102"><enum>(iv)</enum><text display-inline="yes-display-inline">the Health Resources and Services
				Administration;</text>

										</clause><clause commented="no" display-inline="no-display-inline" id="id6492AAF374C44E6794556CA0B799F1F0"><enum>(vii)</enum><text display-inline="yes-display-inline">the Centers for Disease Control and
				Prevention;</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="id04616264F12E416A8D2E684897BAC52B"><enum>(viii)</enum><text display-inline="yes-display-inline">the Department of Education; and</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="idE249EB82068843998AA4F45A0E992E11"><enum>(ix)</enum><text display-inline="yes-display-inline">any other Federal agency that the
				chairperson determines is appropriate; and</text>
										</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1FD3F5EAD00448318ABF0B0C6235E728"><enum>(B)</enum><text display-inline="yes-display-inline">the additional members appointed under
				paragraph (3).</text>
									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2A555E7C45B144AAB24E2E390A9DFB5E"><enum>(3)</enum><header display-inline="yes-display-inline">Additional members</header><text display-inline="yes-display-inline">Not fewer than <fraction>1/3</fraction> of
				the total membership of the Coordinating Council shall be composed of
				non-Federal public members to be appointed by the Secretary, including
				representatives of—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="idA6AE9A3EFC4D46ABB43AF07FEE794530"><enum>(A)</enum><text display-inline="yes-display-inline">academic medical centers or schools of
				medicine, nursing, or other health professions;</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1D363CE11CE94C1E926B456085EC9BCD"><enum>(B)</enum><text display-inline="yes-display-inline">health care professionals who are actively
				involved in the treatment of eating disorders;</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idB4DD67210F014730B168BC90D642AADD"><enum>(C)</enum><text display-inline="yes-display-inline">researchers with expertise in eating
				disorders; and</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idA4FBF8D4B5EE4A409BF4E0C7B29243E3"><enum>(D)</enum><text display-inline="yes-display-inline">at least 2 individuals with a past or
				present diagnosis of an eating disorder or parents of individuals with a past
				or present diagnosis of an eating disorder.</text>
									</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idB426C6A25781499EA44E96137B7C2A8E"><enum>(d)</enum><header display-inline="yes-display-inline">Administrative support; terms of service;
				other provisions</header>
								<paragraph commented="no" display-inline="no-display-inline" id="ID76910880dfd5481a8b63e91035c6ebef"><enum>(1)</enum><header display-inline="yes-display-inline">Administrative support</header><text display-inline="yes-display-inline">The Coordinating Council shall receive
				necessary and appropriate administrative support from the Secretary.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDb5b7d059311d44f082eeba14beba9291"><enum>(2)</enum><header display-inline="yes-display-inline">Terms of service</header><text display-inline="yes-display-inline">Members of the Coordinating Council
				appointed under subsection (c)(2) shall serve for a term of 4 years, and may be
				reappointed for one or more additional 4-year terms. Any member appointed to
				fill a vacancy for an unexpired term shall be appointed for the remainder of
				such term. A member may serve after the expiration of the member's term until a
				successor has taken office.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID0593b679b4dd41c5a42a5f31fc0be12a"><enum>(3)</enum><header display-inline="yes-display-inline">Meetings</header>
									<subparagraph commented="no" display-inline="no-display-inline" id="id235D447769634CEFA3917F4D21E84ABE"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Coordinating Council shall meet at the
				call of the chairperson or upon the request of the Secretary. The Coordinating
				Council shall meet not fewer than 2 times each year.</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0F03C66BD6F349A68ABABD2CD6D1FB85"><enum>(B)</enum><header display-inline="yes-display-inline">Notice</header><text display-inline="yes-display-inline">Notice of any upcoming meeting of the
				Coordinating Council shall be published in the Federal Register.</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDc074f87ff42d4c62a768ed8918db92a5"><enum>(C)</enum><header display-inline="yes-display-inline">Public access</header><text display-inline="yes-display-inline">Each meeting of the Coordinating Council
				shall be open to the public and shall include appropriate periods of time for
				questions by the public.</text>
									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID710eef582260473684927c68d77bf024"><enum>(4)</enum><header display-inline="yes-display-inline">Subcommittees</header><text display-inline="yes-display-inline">In carrying out its functions the
				Coordinating Council may establish subcommittees and convene workshops and
				conferences.</text>
								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id54189F784B3C427582DC048B6AF5DC14"><enum>(e)</enum><header display-inline="yes-display-inline">Eating disorder</header><text display-inline="yes-display-inline">In this part, the term <term>eating
				disorder</term> includes anorexia nervosa, bulimia nervosa, binge eating
				disorder, and eating disorders not otherwise specified, as defined in the
				fourth edition of the Diagnostic and Statistical Manual of Mental Disorders or
				any subsequent edition.</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="id577A2260F4E9427DA5C7CE9962C7828B"><enum>(f)</enum><header display-inline="yes-display-inline">Authorization of
				appropriations</header><text display-inline="yes-display-inline">To carry out
				this section, there are authorized to be appropriated such sums as may be
				necessary for each of fiscal years 2012 through 2016.</text>
							</subsection></section><section commented="no" display-inline="no-display-inline" id="id61E0595334A2417E85D411F39405A5A9" section-type="subsequent-section"><enum>399OO–1.</enum><header display-inline="yes-display-inline">Eating disorder surveillance and research
				program</header>
							<subsection commented="no" display-inline="no-display-inline" id="id6A3D5F16B0DD491EB849696F3F431CBA"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary, acting through the Director
				of the Centers for Disease Control and Prevention, shall award grants or
				cooperative agreements to eligible entities for the purpose of improving the
				collection, analysis and reporting of State epidemiological data on eating
				disorders.</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="id88793380C1B5406B804115B99AE498A8"><enum>(b)</enum><header display-inline="yes-display-inline">Activities</header><text display-inline="yes-display-inline">An eligible entity shall assist with the
				development and coordination of eating disorder surveillance efforts within a
				region and may—</text>
								<paragraph commented="no" display-inline="no-display-inline" id="idDACA6092F3BD464A97ADD645E30A430B"><enum>(1)</enum><text display-inline="yes-display-inline">provide for the collection, analysis, and
				reporting of epidemiological data on eating disorders through the existing
				surveillance programs;</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7CF33869C0A84C40B3E34D0CC7A33A83"><enum>(2)</enum><text display-inline="yes-display-inline">develop recommendations to enhance existing
				surveillance programs to more accurately collect epidemiological data on
				disordered eating and eating disorders, including the prevalence, incidence,
				trends, correlates, mortality, and causes of eating disorders and the effects
				of eating disorders on quality of life;</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id17397DEC82AF472B8D0231D5E108C635"><enum>(3)</enum><text display-inline="yes-display-inline">develop recommendations to improve
				requirements for ensuring that eating disorders are accurately recorded as
				underlying and contributing causes of death; and</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1CF2EF00BC3B4CC3B2688F796686F242"><enum>(4)</enum><text display-inline="yes-display-inline">assist with the development and
				coordination of surveillance efforts within a region.</text>
								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id265BBB91ACF64356BE852A01DDBAC22B"><enum>(c)</enum><header display-inline="yes-display-inline">Eligible entities</header><text display-inline="yes-display-inline">To be eligible to receive an award under
				this section, an entity shall—</text>
								<paragraph commented="no" display-inline="no-display-inline" id="idA1DACF0C0B7F4ADBABE4652ACC59D857"><enum>(1)</enum><text display-inline="yes-display-inline">be a public or nonprofit private entity
				(including a health department of a State, a political subdivision of a State,
				or an institution of higher education); and</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id94D43B490331491E9F78B0D557B5D2CD"><enum>(2)</enum><text display-inline="yes-display-inline">submit to the Secretary an application at
				such time, in such manner, and containing such information as the Secretary may
				require.</text>
								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDada71749ca1d48ec8b5f9ddcf0af627c"><enum>(d)</enum><header display-inline="yes-display-inline">Technical assistance</header><text display-inline="yes-display-inline">In making awards under this section, the
				Secretary may provide direct technical assistance in lieu of cash.</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="ID2085092a96d7417bb4dc4def48dff637"><enum>(e)</enum><header display-inline="yes-display-inline">Reports</header><text display-inline="yes-display-inline">Each entity awarded a grant or cooperative
				agreement under this section shall annually submit to the Secretary a report
				describing the activities conducted using grant funds and providing
				recommendations for improving the collection, analysis, and reporting of
				epidemiological data on eating disorders.</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="id1A220E637A8C42D39BE9E4C01F3A748C"><enum>(f)</enum><header display-inline="yes-display-inline">Authorization of
				appropriations</header><text display-inline="yes-display-inline">To carry out
				this section, there are authorized to be appropriated such sums as may be
				necessary for each of fiscal years 2012 through 2016.</text>
							</subsection></section><section commented="no" display-inline="no-display-inline" id="IDc42caa058b904e139316e47a04967df1" section-type="subsequent-section"><enum>399OO–2.</enum><header display-inline="yes-display-inline">Study regarding economic costs of eating
				disorders</header><text display-inline="no-display-inline">Not later than 18
				months after the date of enactment of the <short-title>Federal Response to Eliminate Eating Disorders
				Act</short-title>, the Secretary, acting through the Director of the Centers
				for Disease Control and Prevention, shall conduct a study evaluating the
				economic costs of eating disorders. Such study may examine years of productive
				life lost, missed days of work, reduced work productivity, costs of medical and
				mental health treatment, costs to family, and costs to society as a result of
				eating
				disorders.</text>
						</section></part><after-quoted-block>.</after-quoted-block></quoted-block>
			</section></title><title commented="no" id="idD45CDEB1ED984F188790D3617F67A29B" level-type="subsequent"><enum>II</enum><header display-inline="yes-display-inline">Eating disorder education and prevention;
			 Studies on eating disorders and body mass index; public service
			 announcements</header>
			<section commented="no" display-inline="no-display-inline" id="idB77F07B8C2C04E1D8845AE134C6CD6DC" section-type="subsequent-section"><enum>201.</enum><header display-inline="yes-display-inline">Grants to prevent eating
			 disorders</header><text display-inline="no-display-inline">Title III of the
			 Public Health Service Act (42 U.S.C. 241 et seq.), as amended by section 102,
			 is further amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id27A278EC4D784116884E5613B6FCCADA" style="OLC">
					<section commented="no" display-inline="no-display-inline" id="id590BD134C33340B0B8ECBD1B26A4AE50" section-type="subsequent-section"><enum>399OO–3.</enum><header display-inline="yes-display-inline">Grants to prevent eating disorders</header>
						<subsection commented="no" display-inline="no-display-inline" id="id41D76F1B931B428085D492837968AEF2"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary, acting through the Director
				of the Centers for Disease Control and Prevention and in coordination with the
				Administrator of the Health Resources and Services Administration, shall award
				grants to eligible entities to plan, implement, and evaluate programs to
				prevent eating disorders and obesity and the acute and chronic medical
				conditions that accompany such conditions, and to promote healthy body image
				and appropriate nutrition-based eating behaviors.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="idFD086FCE228D419480A75E8E1B3502CC"><enum>(b)</enum><header display-inline="yes-display-inline">Eligibility</header><text display-inline="yes-display-inline">To be eligible to receive a grant under
				this section, an entity shall—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="idA0283E696EBA4992942C7EB3CDD93DB0"><enum>(1)</enum><text display-inline="yes-display-inline">be a State, local or tribal educational
				agency, an accredited institution of higher education, a State or local health
				department, or a community-based organization; and</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID416e9e70d6d64c59ab6535f2a58035f8"><enum>(2)</enum><text display-inline="yes-display-inline">submit an application to the Secretary at
				such time, in such manner, and containing such information as the Secretary may
				require.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id2B9C3D534B6B40F9824035FE00EEB69D"><enum>(c)</enum><header display-inline="yes-display-inline">Use of funds</header><text display-inline="yes-display-inline">An entity receiving a grant under this
				section shall fund development and testing of school-, clinic-, community-, or
				health department-based programs designed to promote healthy eating behaviors
				and to prevent eating disorders including—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="idF34343A0A6304F3EB47E6B3B6F9BCE5D"><enum>(1)</enum><text display-inline="yes-display-inline">developing evidence-based interventions to
				prevent eating disorders, including educational or intervention programs
				regarding nutritional content, understanding and responding to hunger and
				satiety, positive body image development, positive self-esteem development, and
				life skills, that take into account cultural and developmental issues and the
				role of family, school, and community;</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2FC84CF2683B4B47879FFBB9FC9E2044"><enum>(2)</enum><text display-inline="yes-display-inline">planning and implementing a healthy
				lifestyle curriculum or program with an emphasis on healthy eating behaviors,
				physical activity, and emotional wellness, the connection between emotional and
				physical health, and the prevention of bullying based on body size, shape, and
				weight;</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0D2E747115DA46FDBD066A9E5C82EC7C"><enum>(3)</enum><text display-inline="yes-display-inline">forming partnerships with parents and
				caregivers to educate adults about identifying unhealthy eating behaviors and
				promoting healthy eating behaviors, physical activity, and emotional wellness;
				and</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idFB79EB806466424E8882801B842F847E"><enum>(4)</enum><text display-inline="yes-display-inline">integrating eating disorder prevention and
				awareness in physical education, health, education, athletic training programs,
				and after-school recreational sports programs, to the extent possible.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id0978413BA17C43E8BCDEC252CA5F0904"><enum>(d)</enum><header display-inline="yes-display-inline">Requirements of grant recipients</header>
							<paragraph commented="no" display-inline="no-display-inline" id="id3085D712A416484C8CE6AA085FB73BD7"><enum>(1)</enum><header display-inline="yes-display-inline">Limitation on administrative
				expenses</header><text display-inline="yes-display-inline">A recipient of a
				grant under this section shall not use more than 10 percent of the amounts
				received under a grant under this section for administrative expenses.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDf6cdb8da48af443a92b42540d99ab386"><enum>(2)</enum><header display-inline="yes-display-inline">Contribution of funds</header><text display-inline="yes-display-inline">A recipient of a grant under this section,
				and any entity receiving assistance under the grant for training and education,
				shall contribute non-Federal funds, either directly or through in-kind
				contributions, to the costs of the activities to be funded under the grant in
				an amount that is not less than 10 percent of the total cost of such
				activities.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9888E81636C641CA8EBEADCFF3B6E94C"><enum>(3)</enum><header display-inline="yes-display-inline">Evaluation</header><text display-inline="yes-display-inline">Each recipient of a grant under this
				section shall provide to the Secretary, in such form and manner as the
				Secretary shall specify, relevant data and an evaluation of the activities of
				the grant recipient in promoting healthy eating behaviors and preventing eating
				disorders. Evaluation reports shall be made publicly available, such as through
				the Internet.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id66D8EDAB69C548E285A7A33B4BC095D1"><enum>(e)</enum><header display-inline="yes-display-inline">Technical assistance</header><text display-inline="yes-display-inline">The Secretary may set aside an amount not
				to exceed 1 percent of the total amount appropriated for a fiscal year to
				provide grantees with technical support in the development, implementation, and
				evaluation of programs under this section and to disseminate information about
				preventing and treating eating disorders and obesity.</text>
						</subsection></section><section commented="no" display-inline="no-display-inline" id="idA66866BB8FDA426F98A11956C4EBCE6A" section-type="subsequent-section"><enum>399OO–4.</enum><header display-inline="yes-display-inline">Study of eating disorders in elementary
				schools, secondary schools, and institutions of higher education</header><text display-inline="no-display-inline">Not later than 18 months after the date of
				enactment of the <short-title>Federal Response to
				Eliminate Eating Disorders Act</short-title>, the National Center for Health
				Statistics of the Centers for Disease Control and Prevention and the National
				Center for Education Statistics of the Department of Education shall conduct a
				joint study, or enter into a contract to have a study conducted, on the impact
				eating disorders have on educational advancement and achievement. The study
				shall—</text>
						<paragraph commented="no" display-inline="no-display-inline" id="id7EDCF9847A0441958A534F7D6A338147"><enum>(1)</enum><text display-inline="yes-display-inline">determine the incidence of eating disorders
				and disordered eating among students, and the morbidity and mortality rates
				associated with eating disorders;</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1D72EC286AEB455D8BA31494961462F4"><enum>(2)</enum><text display-inline="yes-display-inline">evaluate the extent to which students with
				eating disorders are more likely to miss school, have delayed rates of
				development, or have reduced cognitive skills;</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2C4BCEC3271F41288D902A61E9CEB5FC"><enum>(3)</enum><text display-inline="yes-display-inline">report on current State and local programs
				to increase awareness about the dangers of eating disorders among youth and to
				prevent eating disorders and the risk factors for eating disorders, and
				evaluate the value of such programs; and</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idB4639BCE180C4BD4994378A89D722B3B"><enum>(4)</enum><text display-inline="yes-display-inline">make recommendations on measures that could
				be undertaken by Congress, the Department of Education, States, and local
				educational agencies to strengthen eating disorder prevention and awareness
				programs including development of best practices.</text>
						</paragraph></section><section commented="no" display-inline="no-display-inline" id="id3364590601BE4551BA6744DDFAB19C58" section-type="subsequent-section"><enum>399OO–5.</enum><header display-inline="yes-display-inline">Study of the suitability of mandating body
				mass index reporting in Elementary Schools and Secondary Schools</header><text display-inline="no-display-inline">Not later than 18 months after the date of
				enactment of the <short-title>Federal Response to
				Eliminate Eating Disorders Act</short-title>, the Director of the Centers for
				Disease Control and Prevention, in consultation with the Secretary of
				Education, shall conduct a study on mandatory reporting of body mass index,
				including—</text>
						<paragraph commented="no" display-inline="no-display-inline" id="idE185EB2CD2F646BEB0D5F6DA3891A018"><enum>(1)</enum><text display-inline="yes-display-inline">how many schools are currently conducting
				mandatory reporting of body mass index;</text>
						</paragraph><paragraph id="IDe345f9b5de5949019aa4e7bd6a51e9dd"><enum>(2)</enum><text>how schools are
				assessing the impacts of such mandatory reporting on body mass index;
				and</text>
						</paragraph><paragraph id="ID7ce36a93213f4bc7b389b5a1d025dcfa"><enum>(3)</enum><text>how schools are
				assessing potential unintended consequences of such mandatory reporting on
				students, including those related to parent and peer relations.</text>
						</paragraph></section><section commented="no" display-inline="no-display-inline" id="id3238FE9430A343DF8CDAEC9226896A5E" section-type="subsequent-section"><enum>399OO–6.</enum><header display-inline="yes-display-inline">Public service advertisements</header><text display-inline="no-display-inline">The Secretary, in consultation with the
				Director of the National Institutes of Health and the Secretary of Education,
				shall carry out a program to develop, distribute, and promote the broadcasting
				of public service announcements to improve public awareness of, and to promote
				the identification and prevention, of eating disorders.</text>
					</section><section commented="no" display-inline="no-display-inline" id="id39EAE4C67118432CA7966C7D70886577" section-type="subsequent-section"><enum>399OO–7.</enum><header display-inline="yes-display-inline">Authorization of
				appropriations</header><text display-inline="no-display-inline">To carry out
				sections 399OO–3, 399OO–4, 399OO–5, and 399OO–6, there are authorized to be
				appropriated such sums as may be necessary for each of fiscal years 2012
				through
				2016.</text>
					</section><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section commented="no" display-inline="no-display-inline" id="idAA514ED83C514AFB8E89D8CD59E4C6D4" section-type="subsequent-section"><enum>202.</enum><header display-inline="yes-display-inline">Sense of the Senate</header><text display-inline="no-display-inline">It is the sense of the Senate that
			 critically necessary programs to reduce obesity in children may also
			 unintentionally increase the unhealthy weight control behaviors that can lead
			 to development of eating disorders, and that federally funded programs to
			 combat obesity should take this connection into consideration.</text>
			</section></title><title commented="no" id="id4389C65CC37144979193FA5029911F56" level-type="subsequent"><enum>III</enum><header display-inline="yes-display-inline">Improving training in health professions,
			 education, and related fields</header>
			<section commented="no" display-inline="no-display-inline" id="id624DF786730C46FF8D90F95B163B2738" section-type="subsequent-section"><enum>301.</enum><header display-inline="yes-display-inline">Grants for health
			 professionals</header><text display-inline="no-display-inline">Part D of title

						<subsection commented="no" display-inline="no-display-inline" id="id5B1AB469E8514B3DBD7859AC0C5DDCA1"><enum>(a)</enum><header display-inline="yes-display-inline">Grants</header><text display-inline="yes-display-inline">The Secretary, acting through the
				Administrator of the Health Resources and Services Administration, in
				collaboration with the Director of the Centers for Disease Control and
				Prevention, shall award grants under this section to develop interdisciplinary
				training and education programs that provide undergraduate, graduate,
				post-graduate medical, nursing (including advanced practice nursing students),
				dental, mental and behavioral health, pharmacy, and other health professions
				students or residents with an understanding of, and clinical skills pertinent
				to identifying and treating, eating disorders.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="id0D33A03C1809498C8257B40CBBC2D70F"><enum>(b)</enum><header display-inline="yes-display-inline">Eligibility</header><text display-inline="yes-display-inline">To be eligible to receive a grant under
				this section an entity shall—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="id22660206A6D74DE89FA5FE0CB1AFFCBA"><enum>(1)</enum><text display-inline="yes-display-inline">be an accredited school of allopathic or
				osteopathic medicine, or an accredited school of nursing, public health, social
				work, dentistry, behavioral and mental health, or pharmacy, or an accredited
				medical, dental, or nursing residency program;</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id796477AC55494089BF1FBB95510E81EA"><enum>(2)</enum><text display-inline="yes-display-inline">prepare and submit to the Secretary an
				application at such time, in such manner, and containing such information as
				the Secretary may require.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idEF749D312F484A608B0196ADA1382D4B"><enum>(c)</enum><header display-inline="yes-display-inline">Use of funds</header>
							<paragraph commented="no" display-inline="no-display-inline" id="id17079044CF524253AF11D20AA64BE56C"><enum>(1)</enum><header display-inline="yes-display-inline">Required uses</header><text display-inline="yes-display-inline">Amounts provided under a grant awarded
				under this section shall be used to fund interdisciplinary training and
				education projects that are designed to train medical, nursing, and other
				health professions students and residents to—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="id41D46C38EC8347E299D5F42E0654B322"><enum>(A)</enum><text>better identify
				patients at-risk of becoming overweight or obese or developing an eating
				disorder;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id48386A4C639D486E8846BCDFC5E12AC4"><enum>(B)</enum><text>detect overweight
				or obesity or eating disorders among a diverse patient population;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idBDDB8745891A4C44A14D8162B581EC82"><enum>(C)</enum><text>counsel, refer,
				or treat patients with overweight or obesity or an eating disorder;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3821288A89AB4E059991EAC9769A6ED5"><enum>(D)</enum><text>educate patients
				and the families of patients about effective strategies to establish healthy
				eating habits and appropriate levels of physical activity; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idC91121032CD74B608FF5FC0DD72D1FFB"><enum>(E)</enum><text>assist in the
				creation and administration of community-based overweight and obesity and
				eating disorder prevention efforts.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8C94522022B1478C922FEBCAD5C1ED2E"><enum>(2)</enum><header display-inline="yes-display-inline">Permissive
				use</header><text display-inline="yes-display-inline">Amounts provided under a
				grant under this section may be used to offer community-based training
				opportunities in rural areas for medical, nursing, and other health professions
				students and residents on eating disorders, which may include the use of
				distance learning networks and other available technologies needed to reach
				isolated rural areas.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id1399A9DD25D94A2296AD6FB3C090FF8A"><enum>(d)</enum><header display-inline="yes-display-inline">Requirements of grantees</header>
							<paragraph commented="no" display-inline="no-display-inline" id="idA0C2BA8846D54CB4A838281FDD39EE5E"><enum>(1)</enum><header display-inline="yes-display-inline">Limitation on administrative
				expenses</header><text display-inline="yes-display-inline">A grantee shall not
				use more than 10 percent of the amounts received under a grant under this
				section for administrative expenses.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id16E31D32B23C41F0A0373D41458D7BD7"><enum>(2)</enum><header display-inline="yes-display-inline">Contribution of funds</header><text display-inline="yes-display-inline">A grantee under this section, and any
				entity receiving assistance under the grant for training and education, shall
				contribute non-Federal funds, either directly or through in-kind contributions,
				to the costs of the activities to be funded under the grant in an amount that
				is not less than 10 percent of the total cost of such activities.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idD8A144E55EFD4B649241818695248A92"><enum>(e)</enum><header display-inline="yes-display-inline">Eating disorder</header><text display-inline="yes-display-inline">In this section, the term <term>eating
				disorder</term> has the meaning given such term in section 399OO(e).</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="ID53672e158d1449b79200c930dbedb07f"><enum>(f)</enum><header display-inline="yes-display-inline">Authorization of
				appropriations</header><text display-inline="yes-display-inline">There are
				authorized to be appropriated to carry out this section such sums as may be
				necessary for fiscal years 2012 through
				2016.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section commented="no" display-inline="no-display-inline" id="id6294BE5AE65A4AA8A2414C9EE11C967D" section-type="subsequent-section"><enum>302.</enum><header display-inline="yes-display-inline">Training in elementary and secondary
			 schools</header><text display-inline="no-display-inline">Section 5131(a) of the
			 Elementary and Secondary Education Act of 1965 (20 U.S.C. 7215(a)) is amended
			 by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="idB95FB68020EB4BB1B79075CB69E3A76F" style="OLC">
					<paragraph commented="no" display-inline="no-display-inline" id="IDfc48604afe9047dcb5584ca857c1064e"><enum>(28)</enum><text display-inline="yes-display-inline">Programs to improve the identification of
				students with eating disorders (as defined in section 399OO of the Public
				Health Service Act), increase awareness of such disorders among parents and
				students, and train educators (including teachers, school nurses, school social
				workers, coaches, school counselors, and administrators) on effective eating
				disorder prevention, screening, detection and assistance
				methods.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</section></title><title commented="no" id="idD14CFA8FFDAD4F05A46E4538D1B6448A" level-type="subsequent"><enum>IV</enum><header display-inline="yes-display-inline">Improving availability and access to
			 treatment</header>
			<section commented="no" display-inline="no-display-inline" id="id76AED698FDC6493BB47B2D6769F15BCE" section-type="subsequent-section"><enum>401.</enum><header display-inline="yes-display-inline">Medicaid coverage for eating disorder
			 treatment services</header>
				<subsection commented="no" display-inline="no-display-inline" id="id71D4848504464A4099A226E4707C1452"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 1905 of the Social Security Act (42
			 U.S.C. 1396d(a)) is amended—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="id604C31A8090B41438AF9CE65E1C4742B"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="idC5F14D72D021473C95C5E32FC9C45C76"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (28), by striking
			 <quote>and</quote> at the end;</text>

								<paragraph commented="no" display-inline="no-display-inline" id="id6AA8B0369079460F8D1FA8109A408478"><enum>(1)</enum><header display-inline="yes-display-inline">Definition</header><text display-inline="yes-display-inline">The term <term>eating disorder treatment
				services</term> means services relating to diagnosis and treatment of an eating
				disorder (as defined in section 399OO of the Public Health Service Act),
				including screening, counseling, phar­ma­co­ther­a­py (including coverage of
				drugs described in paragraph (2)), and other necessary health care
				services.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2C807570E639468CB952F641523EFE1F"><enum>(2)</enum><header display-inline="yes-display-inline">Coverage for pharmacological treatment of
				eating disorders</header><text display-inline="yes-display-inline">For purposes
				of paragraph (1), eating disorder treatment services shall include drugs
				provided as part of care in an inpatient setting, covered outpatient drugs (as
				defined in section 1927(k)(2)), and non-prescription drugs described in section
				1927(d)(2)(A) that are prescribed, in accordance with generally accepted
				medical guidelines, for treatment of an eating
				disorder.</text>
								</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id6CDC555A05BC4F1E8415F71702222E8D"><enum>(b)</enum><header display-inline="yes-display-inline">Increased FMAP for eating disorder
			 treatment services</header>
					<paragraph commented="no" display-inline="no-display-inline" id="id48BC8EE833664F23BE00509B5429C942"><enum>(1)</enum><header>Effective until
			 January 1, 2013</header><text display-inline="yes-display-inline">Section
			 1905(b) of the Social Security Act (42 U.S.C. 1396d(b)) is amended in the first
			 sentence—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="idD5FE45117C824917B54981E9341F1940"><enum>(A)</enum><text>by striking
			 <quote>and</quote> before <quote>(4)</quote>; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idBAF80943FDB94527AC3934C057A9987B"><enum>(B)</enum><text>by inserting
			 before the period at the end the following: “, and (5) the Federal medical
			 assistance percentage shall be equal to the enhanced FMAP described in section
			 2105(b) with respect to medical assistance for eating disorder treatment
			 services (as defined in subsection (ee)(1)) provided to an individual who is
			 eligible for such assistance and has an eating disorder (as defined in section
			 399OO of the Public Health Service Act)”.</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id23543AA14F694415B7588F084CE42F38"><enum>(2)</enum><header>Effective
			 January 1, 2013</header><text display-inline="yes-display-inline">Section
			 4106(b) of the Patient Protection and Affordable Care Act (Public Law 111–148)
			 is amended—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="id903B81D9B857437883782D99D70D3CA1"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (1), by striking
			 <quote>(4)</quote> each time such term appears and inserting
			 <quote>(5)</quote>; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id181E921C612143CA99AC7D73D6AC9152"><enum>(B)</enum><text>in paragraph (2),
			 by striking <quote>, and (5)</quote> and inserting <quote>, and
			 (6)</quote>.</text>
						</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idAF53CF58DB1E4117A132E459A3A0CDF5"><enum>(c)</enum><header display-inline="yes-display-inline">Inclusion in EPSDT services</header><text display-inline="yes-display-inline">Section 1905(r)(1)(B) of such Act (42
			 U.S.C. 1396d(r)(1)(B)) is amended—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="id0B877822BD584FB3A8D63BFBE2C3E518"><enum>(1)</enum><text display-inline="yes-display-inline">in clause (iv), by striking
			 <quote>and</quote> at the end;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idDA5B7B32D55948F7AD7B2CAD5B89D83C"><enum>(2)</enum><text display-inline="yes-display-inline">in clause (v), by striking the period at
			 the end and inserting <quote>; and</quote>; and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF937668A515F44A3BAF32438382D4C40"><enum>(3)</enum><text display-inline="yes-display-inline">by inserting after clause (v) the following
			 new clause:</text>

					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id8B2340CA64E04B6DA3C2ED48A88D3710"><enum>(d)</enum><header display-inline="yes-display-inline">Exception from optional restriction under
			 Medicaid drug coverage</header><text display-inline="yes-display-inline">Section 1927(d)(2)(A) of such Act (42
			 U.S.C. 1396r–8(d)(2)(A)) is amended by inserting before the period at the end
			 the following: <quote>, except for drugs that are prescribed, in accordance
			 with generally accepted medical guidelines, for the purpose of treatment of an
			 individual who is eligible for medical assistance under the State plan and has
			 an eating disorder (as defined in section 399OO of the Public Health Service
			 Act)</quote>.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="id66BD4507E39E4EDFA767EDD1BD4E0EA3"><enum>(e)</enum><header display-inline="yes-display-inline">Effective
			 date</header><text display-inline="yes-display-inline">The amendments made by
			 this section shall apply to drugs and services furnished on or after January 1,
			 2012.</text>
				</subsection></section><section commented="no" display-inline="no-display-inline" id="id41F5B147B60540EA9F6BE3BA3C04A330" section-type="subsequent-section"><enum>402.</enum><header display-inline="yes-display-inline">Grants to support patient
			 advocacy</header><text display-inline="no-display-inline">Subpart II of part D
			 of title IX of the Public Health Service Act is amended by adding at the end
			 the following:</text>
				<quoted-block display-inline="no-display-inline" id="idEDF8BD28C8E7432EA6DBAEC644D99502" style="OLC">
					<section commented="no" display-inline="no-display-inline" id="idF87C716157BB4CE59F543AE0606786D2" section-type="subsequent-section"><enum>938.</enum><header display-inline="yes-display-inline">Grants to support patient advocacy</header>
						<subsection commented="no" display-inline="no-display-inline" id="idCA9F8D29C4C3415BACB5801BFCCA1C08"><enum>(a)</enum><header display-inline="yes-display-inline">Grants</header><text display-inline="yes-display-inline">The Secretary, acting through the Director,
				shall award grants under this section to develop and support patient advocacy
				work to help individuals with eating disorders obtain adequate health care
				services and insurance coverage.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="idE702A9F3D2D845E8B4FD77226A399F9B"><enum>(b)</enum><header display-inline="yes-display-inline">Eligibility</header><text display-inline="yes-display-inline">To be eligible to receive a grant under
				this section, an entity shall—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="id30172AA826ED4CAB84683DCB08F0E849"><enum>(1)</enum><text display-inline="yes-display-inline">be a public or nonprofit private entity
				(including a health department of a State or tribal agency, a community-based
				organization, or an institution of higher education);</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF0D2E352B2A846C68E1223D727735EC2"><enum>(2)</enum><text display-inline="yes-display-inline">prepare and submit to the Secretary an
				application at such time, in such manner, and containing such information as
				the Secretary may require, including—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="id5D0D4209B91945279E6E39E0E8C18E1B"><enum>(A)</enum><text display-inline="yes-display-inline">comprehensive strategies for advocating on
				behalf of, and working with, individuals with eating disorders or at risk for
				developing eating disorders;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idDBDB9938E0044367898EE7CC915B601C"><enum>(B)</enum><text display-inline="yes-display-inline">a plan for consulting with community-based
				coalitions, treatment centers, or eating disorder research experts who have
				experience and expertise in issues related to eating disorders or patient
				advocacy in providing services under a grant awarded under this section;
				and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id02AA5C59ADAF4F2A9ADEC421F2A9C698"><enum>(C)</enum><text display-inline="yes-display-inline">a plan for financial sustainability
				involving State, local, and private contributions.</text>
								</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id420881A7980A4AADA39453E4235B8B60"><enum>(c)</enum><header display-inline="yes-display-inline">Use of funds</header><text display-inline="yes-display-inline">Amounts provided under a grant awarded
				under this section shall be used to support patient advocacy work,
				including—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="id4E6EACD87CF247799840AA35965EC90C"><enum>(1)</enum><text display-inline="yes-display-inline">providing education and outreach in
				community settings regarding eating disorders and associated health problems,
				especially among low-income, minority, and medically underserved
				populations;</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id716D3585782548389CDDFC4E3B42EF6C"><enum>(2)</enum><text display-inline="yes-display-inline">facilitating access to appropriate,
				adequate, and timely health care for individuals with eating disorders and
				associated health problems;</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID026656e560c0457ba0931855446c9f3d"><enum>(3)</enum><text display-inline="yes-display-inline">assisting in communication and cooperation
				between patients and providers;</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID3f8f58daef39436593f56bec720004b6"><enum>(4)</enum><text display-inline="yes-display-inline">representing the interests of patients in
				managing health insurance claims and plans;</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID669ab7ad78a343258873619fe7c6fe0c"><enum>(5)</enum><text display-inline="yes-display-inline">providing education and outreach regarding
				enrollment in health insurance, including enrollment in the Medicare program
				under title XVIII of the Social Security Act, the Medicaid program under title
				XIX of such Act, and the Children’s Health Insurance Program under title XXI of
				such Act;</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDf72dd916d0a7470eb6b4d67a0be46f93"><enum>(6)</enum><text display-inline="yes-display-inline">identifying, referring, and enrolling
				underserved populations in appropriate health care agencies and community-based
				programs and organizations in order to increase access to high-quality health
				care services;</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDb1955772e74a4df48ba39e5cd9fb6591"><enum>(7)</enum><text display-inline="yes-display-inline">providing technical assistance, training,
				and organizational support for patient advocates; and</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID8dbba4baf0fa4fd59bb12337aee6eff3"><enum>(8)</enum><text display-inline="yes-display-inline">creating, operating, and participating in
				State or regional networks of patient advocates.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id38FB237847714175A2F49D6B1E6C489F"><enum>(d)</enum><header display-inline="yes-display-inline">Requirements of grantees</header>
							<paragraph commented="no" display-inline="no-display-inline" id="id100918D2D5054D2EAFBB4B0120A9F6CC"><enum>(1)</enum><header display-inline="yes-display-inline">Limitation on administrative
				expenses</header><text display-inline="yes-display-inline">A grantee shall not
				use more than 5 percent of the amounts received under a grant under this
				section for administrative expenses.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID5efc658112af43e2898dc14ab7dc68ec"><enum>(2)</enum><header display-inline="yes-display-inline">Contribution of funds</header><text display-inline="yes-display-inline">A grantee under this section, and any
				entity receiving assistance under the grant for training and education, shall
				contribute non-Federal funds, either directly or through in-kind contributions,
				to the costs of the activities to be funded under the grant in an amount that
				is not less than 75 percent of the total cost of such activities.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idE8015A62FE94422CA4622622D10C600D"><enum>(3)</enum><header display-inline="yes-display-inline">Reporting to Secretary</header><text display-inline="yes-display-inline">A grantee under this section shall annually
				submit to the Secretary a report, at such time, in such manner, and containing
				such information as the Secretary may require, including a description and
				evaluation of the activities described in subsection (c) carried out by such
				entity.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idF8EAED3329FF4BD3B115899E3FF267ED"><enum>(e)</enum><header display-inline="yes-display-inline">Eating disorder</header><text display-inline="yes-display-inline">In this section, the term <term>eating
				disorder</term> has the meaning given such term in section 399OO(e).</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="id6B914E14F0B94CB09E18C4C15DF101A4"><enum>(f)</enum><header display-inline="yes-display-inline">Authorization of
				appropriations</header><text display-inline="yes-display-inline">To carry out
				this section, there are authorized to be appropriated such sums as may be
				necessary for fiscal years 2012 through
				2016.</text>
