			</subsection></section><section id="ID5FED9ECE74E049CAB0E30FA1D3DAD856"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text>
			<paragraph id="ID18B59B98E5F7457DA941E758F4C4B622"><enum>(1)</enum><text>A vibrant and
			 growing small business sector is critical to the recovery of the economy of the
			 United States.</text>
			</paragraph><paragraph id="ID7ACDE27B41E4426993876F7679C6259A"><enum>(2)</enum><text>Regulations
			 designed for application to large-scale entities have been applied uniformly to
			 small businesses and other small entities, sometimes inhibiting the ability of
			 small entities to create new jobs.</text>
			</paragraph><paragraph id="ID99B7A3E3F2404432A70FF75064326F57"><enum>(3)</enum><text>Uniform Federal
			 regulatory and reporting requirements in many instances have imposed on small
			 businesses and other small entities unnecessary and disproportionately
			 burdensome demands, including legal, accounting, and consulting costs, thereby
			 threatening the viability of small entities and the ability of small entities
			 to compete and create new jobs in a global marketplace.</text>
			</paragraph><paragraph id="ID3D3ED19F47894B93BB814E93BCF1A449"><enum>(4)</enum><text>Since 1980,
			 Federal agencies have been required to recognize and take account of the
			 differences in the scale and resources of regulated entities, but in many
			 instances have failed to do so.</text>
			</paragraph><paragraph id="ID74b136e646e64044bc90f10e8e82b349"><enum>(5)</enum><text>In 2009, there
			 were nearly 70,000 pages in the Federal Register, and, according to research by
			 the Office of Advocacy of the Small Business Administration, the annual cost of
			 Federal regulations totals $1,750,000,000,000. Small firms bear a
			 disproportionate burden, paying approximately 36 percent more per employee than
			 larger firms in annual regulatory compliance costs.</text>
			</paragraph><paragraph id="id5DBDA186C98A4D579BE978A468890CEE"><enum>(6)</enum><text>All agencies in
			 the Federal Government should fully consider the costs, including indirect
			 economic impacts and the potential for job creation and job loss, of proposed
			 rules, periodically review existing regulations to determine their impact on
			 small entities, and repeal regulations that are unnecessarily duplicative or
			 have outlived their stated purpose.</text>
			</paragraph><paragraph id="ID1D71B6D38AC148BE84AE545BAC5304FB"><enum>(7)</enum><text>It is the
			 intention of Congress to amend chapter 6 of title 5, United States Code, to
			 ensure that all impacts, including foreseeable indirect effects, of proposed
			 and final rules are considered by agencies during the rulemaking process and
			 that the agencies assess a full range of alternatives that will limit adverse
			 economic consequences, enhance economic benefits, and fully address potential
			 job creation or job loss.</text>
			</paragraph></section><section id="ID2AA2C8F7C9C8430FAED5E25F4048E700"><enum>3.</enum><header>Including
			 indirect economic impact in small entity analyses</header><text display-inline="no-display-inline">Section 601 of title 5, United States Code,
			 is amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="IDEDADB1282A9144CE82A8F32D92940636" style="OLC">
				<paragraph id="ID2008BE38FE1940338A0E3D76E9A1E1F3"><enum>(9)</enum><text>the term
				<term>economic impact</term> means, with respect to a proposed or final
				rule—</text>
					<subparagraph id="IDF71EA6BCBC8F47E985A484EE92CA2799"><enum>(A)</enum><text>any direct
				economic effect of the rule on small entities; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDEA0747316AE54A2FB13F6757CE998B56"><enum>(B)</enum><text>any indirect
				economic effect on small entities, including potential job creation or job
				loss, that is reasonably foreseeable and that results from the rule, without
				regard to whether small entities are directly regulated by the
				rule.</text>
					</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="id724D4B28840C49B5AF3057307D24099E"><enum>4.</enum><header>Judicial review
			 to allow small entities to challenge proposed regulations</header><text display-inline="no-display-inline">Section 611(a) of title 5, United States
			 Code, is amended—</text>
			<paragraph id="id9808CE39AA214FDCA83E6D46DD18E624"><enum>(1)</enum><text>in paragraph (1),
			 by inserting <quote>603,</quote> after <quote>601,</quote>;</text>
			</paragraph><paragraph id="id94A928348C1A4707BAE020FA7B41FE6C"><enum>(2)</enum><text>in paragraph (2),
			 by inserting <quote>603,</quote> after <quote>601,</quote>;</text>
			</paragraph><paragraph id="idBB161C06B8A64AC8A13504883A1C176C"><enum>(3)</enum><text>by striking
			 paragraph (3) and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="idBFBAF79C567E47A09EC871C5C6834166" style="OLC">
					<paragraph commented="no" display-inline="no-display-inline" id="HB5966E1A4DCA4817D3A17D99F52BB6D" indent="up1"><enum>(3)</enum><text>A small entity may seek such review
				during the 1-year period beginning on the date of final agency action, except
				that—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="id18E50575172442DC8101CAF0B56DF7D8"><enum>(A)</enum><text>if a provision of law requires that an
				action challenging a final agency action be commenced before the expiration of
				1 year, the lesser period shall apply to an action for judicial review under
				this section; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7121A67145CC468A827BEB019ACE8720"><enum>(B)</enum><text>in the case of noncompliance with
				section 603 or 605(b), a small entity may seek judicial review of agency
				compliance with such section before the close of the public comment
				period.</text>
						</subparagraph></paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
			</paragraph><paragraph id="id45D63E4B662E404085C3B167C903F347"><enum>(4)</enum><text>in paragraph
			 (4)—</text>
				<subparagraph id="id450756A25C5F4BF4A31ABD8C462F7163"><enum>(A)</enum><text>in subparagraph
			 (A), by striking <quote>, and</quote> and inserting a semicolon;</text>
				</subparagraph><subparagraph id="id8F5AC803FEF94D53A9A9231CFF9B4A08"><enum>(B)</enum><text>in subparagraph
			 (B), by striking the period and inserting <quote>; or</quote>; and</text>

				agency from taking any agency action with respect to a rulemaking until that
				agency is in compliance with the requirements of section 603 or
				605.</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</subparagraph></paragraph></section><section id="id6CCF9C19953144EEB7F23B3DC52A0EF3"><enum>5.</enum><header>Periodic review
			 and sunset of existing rules</header><text display-inline="no-display-inline">Section 610 of title 5, United States Code,
			 is amended to read as follows:</text>
			<quoted-block id="idBB19ED1A6E94473798098BBFC680E1A8" style="USC">
				<section id="idA4C726593D314B00970CDD5C1A310679"><enum>610.</enum><header>Periodic
				review of rules</header>
					<subsection id="id8D110941B0EF4C33819702723D0EAF38"><enum>(a)</enum><paragraph commented="no" display-inline="yes-display-inline" id="idF89617E336EA4B9FB0B5477030945BB5"><enum>(1)</enum><text>Not later than 180 days
				after the date of enactment of the <short-title>Small
				Business Regulatory Freedom Act of 2011</short-title>, each agency shall
				establish a plan for the periodic review of—</text>
							<subparagraph id="id542E5BF666B04E0080DC8BD168D8F1DC" indent="up1"><enum>(A)</enum><text>each rule issued by the agency that
				the head of the agency determines has a significant economic impact on a
				substantial number of small entities, without regard to whether the agency
				performed an analysis under section 604 with respect to the rule; and</text>
							</subparagraph><subparagraph id="id34A7815BB37C4099A8A61B3A50BAC7E5" indent="up1"><enum>(B)</enum><text>any small entity compliance guide
				required to be published by the agency under section 212 of the Small Business
				Regulatory Enforcement Fairness Act of 1996 (5 U.S.C. 601 note).</text>
							</subparagraph></paragraph><paragraph id="id61515192BA934DE2ACAA2B79F6D4AA2E" indent="up1"><enum>(2)</enum><text>In reviewing rules and small entity
				compliance guides under paragraph (1), the agency shall determine whether the
				rules and guides should—</text>
							<subparagraph id="id4B682CC0C3CF474BAA861EC16420C268"><enum>(A)</enum><text>be amended or rescinded, consistent
				with the stated objectives of applicable statutes, to minimize any significant
				adverse economic impacts on a substantial number of small entities (including
				an estimate of any adverse impacts on job creation and employment by small
				entities); or</text>
							</subparagraph><subparagraph id="idEA9AB6F4DC4D4FA59D704CE0AC342CFA"><enum>(B)</enum><text>continue in effect without
				change.</text>
							</subparagraph></paragraph><paragraph id="idB981CE4DCECA41FAAC5D9237693276D2" indent="up1"><enum>(3)</enum><text>Each agency shall publish the plan
				established under paragraph (1) in the Federal Register and on the Web site of
				the agency.</text>
						</paragraph><paragraph id="id45B49FCB5DA643459DE07097879FE110" indent="up1"><enum>(4)</enum><text>An agency may amend the plan
				established under paragraph (1) at any time by publishing the amendment in the
				Federal Register and on the Web site of the agency.</text>
						</paragraph></subsection><subsection id="id5E50A4BB59734068A952110B13FC06F3"><enum>(b)</enum><paragraph commented="no" display-inline="yes-display-inline" id="id036E24A31F364FEDA31B02E287B1A062"><enum>(1)</enum><text>Each plan established
				under subsection (a) shall provide for—</text>
							<subparagraph id="idC46FD04F97EB402695FA2B494BC6F4C6" indent="up1"><enum>(A)</enum><text>the review of each rule and small
				entity compliance guide described in subsection (a)(1) in effect on the date of
				enactment of the <short-title>Small Business Regulatory
				Freedom Act of 2011</short-title>—</text>
								<clause id="idEF3D61E1F76E4F2989C49408A15A2C85"><enum>(i)</enum><text>not later than 8 years after the
				date of publication of the plan in the Federal Register; and</text>
								</clause><clause id="idBAD7110BE9994BCEAB081244902D3558"><enum>(ii)</enum><text>every 8 years thereafter;
				and</text>
								</clause></subparagraph><subparagraph id="id47F4DDABFCAD46E48EAB1042EB200FFB" indent="up1"><enum>(B)</enum><text>the review of each rule adopted and
				small entity compliance guide described in subsection (a)(1) that is published
				after the date of enactment of the <short-title>Small
				Business Regulatory Freedom Act of 2011</short-title>—</text>
								<clause id="idABF50ED055DB426994B1E65F0BD4D78A"><enum>(i)</enum><text>not later than 8 years after the
				publication of the final rule in the Federal Register; and</text>
								</clause><clause id="idB175485A6B7E4E359610C5192BBBAA59"><enum>(ii)</enum><text>every 8 years thereafter.</text>
								</clause></subparagraph></paragraph><paragraph id="id5AB50F6E162C489686C223F72125A2A0" indent="up1"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idD4070D45AEF84A1D8B7596D6D453FF73"><enum>(A)</enum><text>If an agency determines
				that the review of the rules and guides described in paragraph (1)(A) cannot be
				completed before the date described in paragraph (1)(A)(i), the agency—</text>
								<clause id="id63FB47F085AC4EE28801FC1F904765D0" indent="up1"><enum>(i)</enum><text>shall publish a statement in the
				Federal Register certifying that the review cannot be completed; and</text>
								</clause><clause id="idD52BF4D4344E4B2FA010DAB3DD7C1CE2" indent="up1"><enum>(ii)</enum><text>may extend the period for the review
				of the rules and guides described in paragraph (1)(A) for a period of not more
				than 2 years, if the agency publishes notice of the extension in the Federal
				Register.</text>
								</clause></subparagraph><subparagraph id="idEC59527DB9964920BFF0A9ED972F4E2D" indent="up1"><enum>(B)</enum><text>An agency shall transmit to the Chief
				Counsel for Advocacy of the Small Business Administration and Congress notice
				of any statement or notice described in subparagraph (A).</text>
							</subparagraph></paragraph></subsection><subsection id="idCB3A19EE8E504369BF5F580ECE2BA800"><enum>(c)</enum><text>In reviewing
				rules under the plan required under subsection (a), the agency shall
				consider—</text>
						<paragraph id="id4D464B71CE2A464B8AB17AFAB1A7B810"><enum>(1)</enum><text>the continued
				need for the rule;</text>
						</paragraph><paragraph id="id55AEEC7119FB4D95B26AAF8211E980F6"><enum>(2)</enum><text>the nature of
				complaints received by the agency from small entities concerning the
				rule;</text>
						</paragraph><paragraph id="idA1D20E98638B4267B08DCF33974D421A"><enum>(3)</enum><text>comments by the
				Regulatory Enforcement Ombudsman and the Chief Counsel for Advocacy of the
				Small Business Administration;</text>
						</paragraph><paragraph id="idB832C987900C4C8DA4CF7E98461EC5D4"><enum>(4)</enum><text>the complexity of
				the rule;</text>
						</paragraph><paragraph id="id76F6C95A57AA4906BF8509BBC96FEF85"><enum>(5)</enum><text>the extent to
				which the rule overlaps, duplicates, or conflicts with other Federal rules and,
				unless the head of the agency determines it to be infeasible, State and local
				rules;</text>
						</paragraph><paragraph id="id2EC1CC8FB5EE412DA48C21871F94631B"><enum>(6)</enum><text>the contribution
				of the rule to the cumulative economic impact of all Federal rules on the class
				of small entities affected by the rule, unless the head of the agency
				determines that such a calculation cannot be made;</text>
						</paragraph><paragraph id="id029956967CCC4D4CB14D219F73071BDB"><enum>(7)</enum><text>the length of
				time since the rule has been evaluated, or the degree to which technology,
				economic conditions, or other factors have changed in the area affected by the
				rule; and</text>
						</paragraph><paragraph id="id93CFCD1A8B6D415F8B51DD07F4CE1F9D"><enum>(8)</enum><text>the impact of the
				rule, including—</text>
							<subparagraph id="id40B5BCD1D4684E7194696BA66D9913A5"><enum>(A)</enum><text>the estimated
				number of small entities to which the rule will apply;</text>
							</subparagraph><subparagraph id="idF4613E8C8E2548849486091616369672"><enum>(B)</enum><text>the estimated
				number of small entity jobs that will be lost or created due to the rule;
				and</text>
							</subparagraph><subparagraph id="id02A4AF3097EA408F9F0789D4AFA1A2F9"><enum>(C)</enum><text>the projected
				reporting, recordkeeping, and other compliance requirements of the proposed
				rule, including—</text>
								<clause id="idF7C5C105CD1D455A98816CB25C8D3F16"><enum>(i)</enum><text>an estimate of
				the classes of small entities that will be subject to the requirement;
				and</text>
								</clause><clause id="id42B3B75268D240EF9C23F1BA3D9DA2B4"><enum>(ii)</enum><text>the type of
				professional skills necessary for preparation of the report or record.</text>
								</clause></subparagraph></paragraph></subsection><subsection id="id43999492614644D6808C92842E4ABF6D"><enum>(d)</enum><paragraph commented="no" display-inline="yes-display-inline" id="idFAA0F263D56E4116A2C106E087E93222"><enum>(1)</enum><text>Each agency shall
				submit an annual report regarding the results of the review required under
				subsection (a) to—</text>
							<subparagraph id="idB1766B22F0A74FC8BDA726D1E7D05BF3" indent="up1"><enum>(A)</enum><text>Congress; and</text>
							</subparagraph><subparagraph id="id70E609CCE225468AB1D896DEBE64848C" indent="up1"><enum>(B)</enum><text>in the case of an agency that is not
				an independent regulatory agency (as defined in section 3502(5) of title 44),
				the Administrator of the Office of Information and Regulatory Affairs of the
				Office of Management and Budget.</text>
							</subparagraph></paragraph><paragraph id="id3980D76829BB433F86B086E6AC5B9C27" indent="up1"><enum>(2)</enum><text>Each report required under paragraph
				(1) shall include a description of any rule or guide with respect to which the
				agency made a determination of infeasibility under paragraph (5) or (6) of
				subsection (c), together with a detailed explanation of the reasons for the
				determination.</text>
						</paragraph></subsection><subsection id="idA185E0D1FE2F4529B66750B7D7253BEB"><enum>(e)</enum><text>Each agency shall
				publish in the Federal Register and on the Web site of the agency a list of the
				rules and small entity compliance guides to be reviewed under the plan required
				under subsection (a) that includes—</text>
						<paragraph id="id34BE5C314F4A415DB146B013CBC0739C"><enum>(1)</enum><text>a brief
				description of each rule or guide;</text>
						</paragraph><paragraph id="idEBC2BD68B4234FBDAE6DAB0C51100B63"><enum>(2)</enum><text>for each rule,
				the reason why the head of the agency determined that the rule has a
				significant economic impact on a substantial number of small entities (without
				regard to whether the agency had prepared a final regulatory flexibility
				analysis for the rule); and</text>
						</paragraph><paragraph id="id6470942B43ED4CBF89057DEF012BC8BE"><enum>(3)</enum><text>a request for
				comments from the public, the Chief Counsel for Advocacy of the Small Business
				Administration, and the Regulatory Enforcement Ombudsman concerning the
				enforcement of the rules or publication of the guides.</text>
						</paragraph></subsection><subsection id="id1E164A3A1EBE4522937B620F693D4A03"><enum>(f)</enum><paragraph commented="no" display-inline="yes-display-inline" id="idAD65CB2FDEE4432DA2F83D70C8379656"><enum>(1)</enum><text>With respect to each
				agency, not later than 6 months after each date described in subsection (b)(1),
				the Chief Counsel for Advocacy of the Small Business Administration shall
				determine whether the agency has completed the review required under subsection
				(b).</text>
						</paragraph><paragraph id="id5D47FA21E33842E9B17D9B9E7ADF6395" indent="up1"><enum>(2)</enum><text>If, after a review under paragraph
				(1), the Chief Counsel for Advocacy of the Small Business Administration
				determines that an agency has failed to complete the review required under
				subsection (b), each rule issued by the agency that the head of the agency
				determined under subsection (a) has a significant economic impact on a
				substantial number of small entities shall immediately cease to have
				effect.</text>
						</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="idD8BB10DD8A58427F9B614E11337D3F71"><enum>6.</enum><header>Requiring small
			 business review panels for all agencies</header>
			<subsection id="idC4D818D32D1648AB93A39CFDCBE97268"><enum>(a)</enum><header>Agencies</header><text display-inline="yes-display-inline">Section 609 of title 5, United States Code,
			 is amended—</text>
				<paragraph id="id634F508793024624BAD0028B89EAB43B"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (b), by striking <quote>a
			 covered agency</quote> each place it appears and inserting <quote>an
			 agency</quote>; and</text>
				</paragraph><paragraph id="id1036CF1246AA41098FB0805940EA6747"><enum>(2)</enum><text>in subsection
			 (e)(1), by striking <quote>the covered agency</quote> and inserting <quote>the
			 agency</quote>.</text>
				</paragraph></subsection><subsection id="idF0BEE620A3144ECCA490E1548A447E1C"><enum>(b)</enum><header>Technical and
			 conforming amendments</header>

			 following: <quote>and any significant guidance document, as defined in the
			 Office of Management and Budget Final Bulletin for Agency Good Guidance
			 Procedures (72 Fed. Reg. 3432; January 25, 2007)</quote>.</text>
		</section><section id="idCBCB3DA7F4254F2CACE1585FD28EC297"><enum>8.</enum><header>Requiring the
			 Internal Revenue Service to consider small entity impact</header>
			<subsection id="idB5919B59E53A4990B67625BA2C2ED44E"><enum>(a)</enum><header>In
			 general</header><text>Section 603(a) of title 5, United States Code, is
			 amended, in the fifth sentence, by striking <quote>but only</quote> and all
			 that follows through the period at the end and inserting <quote>but only to the
			 extent that such interpretative rules, or the statutes upon which such rules
			 are based, impose on small entities a collection of information requirement or
			 a recordkeeping requirement.</quote>.</text>
			</subsection><subsection id="id602BCAB9EACD4B57BA3AA01B4B5BCA16"><enum>(b)</enum><header>Definitions</header><text>Section
			 601 of title 5, United States Code, as amended by section 3 of this Act, is
			 amended—</text>

			 Enforcement Fairness Act of 1996 (Public Law 104–121; 110 Stat. 862) is amended
			 by adding at the end the following:</text>

				<subsection id="id23D2487EAA01489EA90CCCB866395C5B"><enum>(d)</enum><header>Review of
				policies and programs</header>
					<paragraph id="id85319C90B0CB4C11B49A75CD1447B435"><enum>(1)</enum><header>Review
				required</header><text>Not later than 6 months after the date of enactment of
				this subsection, and every 2 years thereafter, each agency regulating the
				activities of small entities shall review the policy or program established by
				the agency under subsection (a) and make any modifications to the policy or
				program necessary to comply with the requirements under this section.</text>
					</paragraph><paragraph id="id1BF7ACF7DBB94EBA9D6F6F72AB65F3E2"><enum>(2)</enum><header>Report</header><text>Not
				later than 6 months after the date of enactment of this subsection, and every 2
				years thereafter, each agency described in paragraph (1) shall submit a report
				on the review and modifications required under paragraph (1) to—</text>
						<subparagraph id="id6511E41103C3441283522249E43A6DA1"><enum>(A)</enum><text>the Committee on
				Small Business and Entrepreneurship and the Committee on Homeland Security and
				Governmental Affairs of the Senate; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5B2CFA604F854A32BF8DD9DCF5D46FDA"><enum>(B)</enum><text>the Committee on
				Small Business and the Committee on the Judiciary of the House of
				Representatives.</text>
						</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="idF1220E8EE9E140D8AC1AAB6BBD803B9E"><enum>10.</enum><header>Requiring more
			 detailed small entity analyses</header>
			<subsection id="id5ABE7EE70E1D4361B02F8D04ABFEF68C"><enum>(a)</enum><header>Initial
			 regulatory flexibility analysis</header><text>Section 603 of title 5, United
			 States Code, as amended by section 1100G(b) of Public Law 111–203 (124 Stat.
			 2112), is amended—</text>
				<paragraph id="idBE448873DAF246139E0F738D55A441CF"><enum>(1)</enum><text>by striking
			 subsection (b) and inserting the following:</text>
					<quoted-block id="id8795B3A217BD48B0AD0823DD4A3FEA30">
						<subsection id="idFC11C53C7E6C48DDA5FD875C0052CDF9"><enum>(b)</enum><text>Each initial
				regulatory flexibility analysis required under this section shall contain a
				detailed statement—</text>
							<paragraph id="id1B171854C27F40BC8AFFA7107BDB9171"><enum>(1)</enum><text>describing the
				reasons why action by the agency is being considered;</text>
							</paragraph><paragraph id="id50B0E6C815C44FBFADBF1619C6EE9096"><enum>(2)</enum><text>describing the
				objectives of, and legal basis for, the proposed rule;</text>
							</paragraph><paragraph id="idC1866381BB164850B4A7DD7E28225811"><enum>(3)</enum><text>estimating the
				number and type of small entities to which the proposed rule will apply;</text>
							</paragraph><paragraph id="id5F6AA25BB7144E83B9C59288FCC38EE9"><enum>(4)</enum><text>describing the
				projected reporting, recordkeeping, and other compliance requirements of the
				proposed rule, including an estimate of the classes of small entities which
				will be subject to the requirement and the type of professional skills
				necessary for preparation of the report and record;</text>
							</paragraph><paragraph id="id317DF296F709458EA25F907D796BB900"><enum>(5)</enum><text>describing all
				relevant Federal rules which may duplicate, overlap, or conflict with the
				proposed rule, or the reasons why such a description could not be provided;
				and</text>
							</paragraph><paragraph id="idD05E36C7F839477780957E9F45E61828"><enum>(6)</enum><text>estimating the
				additional cumulative economic impact of the proposed rule on small entities,
				including job creation and employment by small entities, beyond that already
				imposed on the class of small entities by the agency, or the reasons why such
				an estimate is not available.</text>
							</paragraph></subsection><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="idB6360528DA6540259C53F0F565DFB8DF"><enum>(2)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block act-name="" display-inline="no-display-inline" id="id0041A469E50946299472E80EC61EE1A7" style="USC">
						<subsection id="id4B8B295D9CC944EFBC2941B923A7A8FE"><enum>(e)</enum><text>An agency shall
				notify the Chief Counsel for Advocacy of the Small Business Administration of
				any draft rules that may have a significant economic impact on a substantial
				number of small entities—</text>
							<paragraph id="id8FC50581D2E24C58B8899971A91D6ED9"><enum>(1)</enum><text>when the agency
				submits a draft rule to the Office of Information and Regulatory Affairs of the
				Office of Management and Budget under Executive Order 12866, if that order
				requires the submission; or</text>
							</paragraph><paragraph id="idCC37B97B29FE42F2A3C967D8994F4377"><enum>(2)</enum><text>if no submission
				to the Office of Information and Regulatory Affairs is required—</text>
								<subparagraph id="idABADAC4C1E7647E8B596D82ED9D5C509"><enum>(A)</enum><text>a reasonable
				period before publication of the rule by the agency; and</text>
								</subparagraph><subparagraph id="idB0A1FB21F17D484F89E7750378E65B4D"><enum>(B)</enum><text>in any event, not
				later than 3 months before the date on which the agency publishes the
				rule.</text>
								</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="idA0D6ED22D3CA4005A607582F7373D30F"><enum>(b)</enum><header>Final
			 regulatory flexibility analysis</header>
				<paragraph id="id2ACC717AC2704003B8C82C617075CC07"><enum>(1)</enum><header>In
			 general</header><text>Section 604(a) of title 5, United States Code, is
			 amended—</text>
					<subparagraph id="id2DE7E28290DD4594A21C91F1788DB88E"><enum>(A)</enum><text>by inserting
			 <quote>detailed</quote> before <quote>description</quote> each place it
			 appears;</text>
					</subparagraph><subparagraph id="id3741977370BA4AFAB32963392EBCCEC2"><enum>(B)</enum><text>in paragraph
			 (2)—</text>

			 analysis on web site, etc</header><text>Section 604(b) of title 5, United
			 States Code, is amended to read as follows:</text>

						<subsection id="id43A816A88F6144E0A3B5F7E132E777D4"><enum>(b)</enum><text>The agency
				shall—</text>

				the final regulatory flexibility analysis available to the public, including by
				publishing the entire final regulatory flexibility analysis on the Web site of

				Federal Register the final regulatory flexibility analysis, or a summary of the
				analysis that includes the telephone number, mailing address, and address of
				the Web site where the complete final regulatory flexibility analysis may be
				obtained.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="id5075A9E687EA44D2B3061493F1FC7ED2"><enum>(c)</enum><header>Cross-References
			 to other analyses</header><text>Section 605(a) of title 5, United States Code,
			 is amended to read as follows:</text>

			</subsection><subsection id="id5981EB9E1D9C437B9285033E6D2670FF"><enum>(e)</enum><header>Quantification
			 requirements</header><text>Section 607 of title 5, United States Code, is
			 amended to read as follows:</text>

			</subsection></section><section id="id58F86601076A4A1594874FF0912F537E"><enum>11.</enum><header>Ensuring that
			 agencies consider small entity impact during the rulemaking
			 process</header><text display-inline="no-display-inline">Section 605(b) of
			 title 5, United States Code, is amended—</text>
			<paragraph id="id46C6F6F3B3D746A9A7AB8D5054550D35"><enum>(1)</enum><text>by inserting
			 <quote>(1)</quote> after <quote>(b)</quote>; and</text>
			</paragraph><paragraph id="idC4F20031020747868BDAB89ADF4391D2"><enum>(2)</enum><text>by adding at the
			 end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id9A317A78A52D494C97EE1C123F13B661" style="OLC">
					<paragraph id="id2BFB7A26AFE048FBA65755EDFC325008" indent="up1"><enum>(2)</enum><text>If, after publication of the
				certification required under paragraph (1), the head of the agency determines
				that there will be a significant economic impact on a substantial number of
				small entities, the agency shall comply with the requirements of section 603
				before the publication of the final rule, by—</text>
						<subparagraph id="id939F5C1F3C6849E3A0CCA7BCD2E25F78"><enum>(A)</enum><text>publishing an initial regulatory
				flexibility analysis for public comment; or</text>
						</subparagraph><subparagraph id="id0A102ADD63A340C68286AB4477889A65"><enum>(B)</enum><text>re-proposing the rule with an initial
				regulatory flexibility analysis.</text>
						</subparagraph></paragraph><paragraph id="idCEB77333160C42DB95822D24A78C2836" indent="up1"><enum>(3)</enum><text>The head of an agency may not make a
				certification relating to a rule under this subsection, unless the head of the
				agency has determined—</text>
						<subparagraph id="idBF5CAFC6499B4688988BB8CEFFEC7A68"><enum>(A)</enum><text>the average cost of the rule for small
				entities affected or reasonably presumed to be affected by the rule;</text>
						</subparagraph><subparagraph id="id9D530373722642098F413F0780E83F5A"><enum>(B)</enum><text>the number of small entities affected
				or reasonably presumed to be affected by the rule; and</text>
						</subparagraph><subparagraph id="id8546B2375A5F4E679E256106E7D557AF"><enum>(C)</enum><text>the number of affected small entities
				for which that cost will be significant.</text>
						</subparagraph></paragraph><paragraph id="idB8F760E6F6F645A594AE662DEC8FF17D" indent="up1"><enum>(4)</enum><text>Before publishing a certification and
				a statement providing the factual basis for the certification under paragraph
				(1), the head of an agency shall—</text>
						<subparagraph id="idF31E30037AE14B24835CD071141625B3"><enum>(A)</enum><text>transmit a copy of the certification
				and statement to the Chief Counsel for Advocacy of the Small Business
				Administration; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idE55B6C7979984476AC9BE0D819B82CD3"><enum>(B)</enum><text>consult with the Chief Counsel for
				Advocacy of the Small Business Administration on the accuracy of the

			</paragraph></section><section id="ID17A20A37353E48678634B1666D025DDA"><enum>12.</enum><header>Qualifications
			 of the Chief Counsel for Advocacy and authority for the Office of
			 Advocacy</header>
			<subsection id="idFE7E7E19215448759EFCAD93E4042D92"><enum>(a)</enum><header>Qualifications
			 of Chief Counsel for Advocacy</header><text display-inline="yes-display-inline">Section 201 of Public Law 94–305 (15 U.S.C.
