1.This Act may be cited as the
Stop Asian Carp Act of
2011
.
2.In this Act:
(1)The
term CAWS means the Chicago Area Water System.
(2)The
term Director means the Director of the United States Geological
Survey.
(3)The term hydrological separation means a
physical separation on the CAWS that—
(A)would disconnect
the Mississippi River from Lake Michigan; and
(B)shall be designed
to be adequate in scope to prevent the transfer of aquatic species between each
of those bodies of water.
(4)The
term Secretary means the Secretary of the Army, acting through the
Chief of Engineers.
(5)The
term study means the feasibility study described in section
101(a).
<enum>I</enum><header>Feasibility
study</header>
<section id="idA056D1A227614783A21A2041E0F93B7B"><enum>101.</enum><header>Feasibility
study</header>
<subsection id="idB37C15D6EC9E4BEB977FD8323289B24F"><enum>(a)</enum><header>In
general</header><text display-inline="yes-display-inline">Not later than 30
days after the date of enactment of this Act, the Secretary, pursuant to
section 206 of the Flood Control Act of 1958 (Public Law 85–500; 72 Stat. 317),
shall initiate a study of the watersheds of the following rivers (including the
tributaries of the rivers) that drain directly into Lake Michigan:</text>
<paragraph id="id06CD9AE79AEB43F5B6FA99DD4567F673"><enum>(1)</enum><text>The Illinois
River, at and in the vicinity of Chicago, Illinois.</text>
</paragraph><paragraph id="id8C97031EECD443E69B7E2EAE8190B0BC"><enum>(2)</enum><text>The Chicago River
in the State of Illinois.</text>
</paragraph><paragraph id="id0C5CA52A88604669AC75577CFB04E082"><enum>(3)</enum><text>The Calumet River
in the States of Illinois and Indiana.</text>
</paragraph></subsection><subsection id="idC91D291C70054900BAB63D2330251F79"><enum>(b)</enum><header>Purpose of
study</header><text>The purpose of the study shall be to determine the
feasibility and best means of implementing the hydrological separation of the
Great Lakes and Mississippi River Basins to prevent the introduction or
establishment of populations of aquatic nuisance species between the Great
Lakes and Mississippi River Basins through the CAWS and other aquatic
pathways.</text>
</subsection><subsection id="id7E0E628043694B4D97A6789DC5282D2E"><enum>(c)</enum><header>Requirements of
study</header>
<paragraph id="idE7011F6704D043B7B0AD776B3E34AC3F"><enum>(1)</enum><header>Options</header><text>The
study shall include options to address—</text>
<subparagraph id="idFF06BB9642FD48CEB5BCCE2CF1CA585D"><enum>(A)</enum><text>flooding;</text>
</subparagraph><subparagraph id="id22CCCEBDB707431A92088CF4BA9D5C3A"><enum>(B)</enum><text>Chicago
wastewater and stormwater infrastructure;</text>
</subparagraph><subparagraph id="id4C5DBCCA43024C9799B58839C3008D41"><enum>(C)</enum><text>waterway safety
operations; and</text>
</subparagraph><subparagraph id="idC56C10DB323E45B1B9691BA795BA75FD"><enum>(D)</enum><text>barge and
recreational vessel traffic alternatives, which shall include—</text>
<clause id="id7B797E50B914423584C9C30C9C7BEF30"><enum>(i)</enum><text>examining other
modes of transportation for cargo and CAWS users; and</text>
</clause><clause id="idBFA7353D369E4609948F135A291E8876"><enum>(ii)</enum><text>creating
engineering designs to move canal traffic from 1 body of water to another body
of water without transferring aquatic species.</text>
</clause></subparagraph></paragraph><paragraph id="id656D6B2885CA49FD919F592EBA4B08DB"><enum>(2)</enum><header>Cost-benefit
analysis</header><text>The study shall contain a detailed analysis of the
environmental benefits and costs of each option described in paragraph
(1).</text>
</paragraph><paragraph id="id725A1FDEC9B94B6B8DF851A3564F62CC"><enum>(3)</enum><header>Association
with other study</header><text>The study shall be conducted in association with
the study required under section 3061(d) of the Water Resources Development Act
of 2007 (Public Law 110–114; 121 Stat. 1121).</text>
</paragraph><paragraph id="id39880EE581A643BD87A69FB10D0F03BC"><enum>(4)</enum><header>Consultation</header><text>In
conducting the study, the Secretary shall consult with any relevant expert or
stakeholder knowledgeable on the issues of hydrological separation and aquatic
nuisance species.</text>
</paragraph></subsection><subsection id="id3971351554AC4FB8BC9896B8BDF53139"><enum>(d)</enum><header>Deadline</header><text>The
Secretary shall complete the study by not later than the date that is 18 months
after the date of enactment of this Act.</text>
</subsection></section><section id="id7E261E45C7154AA99B77E8C7F3931D23"><enum>102.</enum><header>Report</header>
<subsection id="idAF493851C54945CCA463B0DC0378E8F3"><enum>(a)</enum><header>In
general</header><text>The Secretary shall prepare a report on the waterways
described in section 101(a) in accordance with—</text>
<paragraph id="id8576005F56D7481980CFF406AE8C3F8C"><enum>(1)</enum><text>the purpose
described in section 101(b); and</text>
</paragraph><paragraph id="id0CD58BB6EAB84A6180480FD400FC615E"><enum>(2)</enum><text>each requirement
described in section 101(c).</text>
</paragraph></subsection><subsection id="id62FC57BD3193495F9CCADC0486DAB4B3"><enum>(b)</enum><header>Deadlines</header><text>The
Secretary shall submit to Congress and the President—</text>
<paragraph id="id1EF8104A057044389D011D42F3700B4E"><enum>(1)</enum><text>not later than
180 days after the date of enactment of this Act, an initial report under this
section;</text>
</paragraph><paragraph id="id0B07C82E8F97466F8DCF215BF90654CB"><enum>(2)</enum><text>not later than 1
year after the date of enactment of this Act, an interim report under this
section; and</text>
</paragraph><paragraph id="id1FED5D6DC6B742D58A9EF9BB5CC29B91"><enum>(3)</enum><text>not later than 18
months after the date of enactment of this Act, a final report under this
section.</text>
</paragraph></subsection></section><section id="idEB0D50E1E502450AA770C8839FBA8AB3"><enum>103.</enum><header>Federal
expense requirement</header><text display-inline="no-display-inline">The
Secretary shall carry out this Act at full Federal expense.</text>
</section><section id="idAE215F5A1CF44FFAB2B6F3152EAFB160"><enum>104.</enum><header>Presidential
oversight</header><text display-inline="no-display-inline">The President, or
the Council on Environmental Quality, acting as a designee of the President,
shall oversee the study to ensure the thoroughness and timely completion of the
study.</text>
</section><enum>II</enum><header>Response to
additional threats</header>
<section id="id392C4591CFE447E985053E0A46F023B3"><enum>201.</enum><header>Response</header>
<subsection id="id4481FEB1783346B182B5FAFC575582BD"><enum>(a)</enum><header>Monitoring
connecting waters</header><text>To identify additional threats that could allow
Asian Carp to enter the Great Lakes Basin, the Director, in cooperation with
the Director of the United States Fish and Wildlife Service, shall monitor and
survey all waters that connect to the Great Lakes Basin or could connect to the
Great Lakes Basin due to—</text>
<paragraph id="idF0FCEFF3564B4F18976018690C9F0E89"><enum>(1)</enum><text>flooding;</text>
</paragraph><paragraph id="idE05DF7C0FF274D369433A484C37B98DA"><enum>(2)</enum><text>underground
hydrological connection; or</text>
</paragraph><paragraph id="idA0ACD4839AFB48339C7AA5267455E780"><enum>(3)</enum><text>human-made
diversion.</text>
</paragraph></subsection><subsection id="id76413F238D3E458D803D5DC4C2A56AE5"><enum>(b)</enum><header>Response to
additional threats</header><text>As soon as practicable after the date of
identification of a threat under subsection (a), the Director, in cooperation
with the Director of the United States Fish and Wildlife Service, shall—</text>
<paragraph id="id7A301C67E0684CB7969C210123D3A6CE"><enum>(1)</enum><text>prioritize each
threat; and</text>
</paragraph><paragraph id="id6B887F4910AB4F62ABF6384722F2486B"><enum>(2)</enum><text>help identify
means to impede the passage of Asian Carp to the Great Lakes Basin.</text>
</paragraph></subsection><subsection id="id290CA307125345CF8C3E57421D95EF17"><enum>(c)</enum><header>Consultation
with other actors</header><text>In carrying out subsections (a) and (b), the
Director, in cooperation with the Director of the United States Fish and
Wildlife Service, shall consult with each relevant—</text>
<paragraph id="idDF0A11E8899F400B828B718577167950"><enum>(1)</enum><text>Federal
agency;</text>
</paragraph><paragraph id="id53B95DE8BD48406780DB78FAEF05B521"><enum>(2)</enum><text>State; and</text>
</paragraph><paragraph id="id40B7C747610B4D65913E8AD1435D37AB"><enum>(3)</enum><text>stakeholder.</text>
</paragraph></subsection></section>
