		<official-title>To provide for the restoration of legal rights for
		  claimants under holocaust-era insurance policies.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Restoration of Legal Rights for
			 Claimants under Holocaust-Era Insurance Policies Act of
			 2011</short-title></quote>.</text>
		</section><section id="ID5b19225f6f7040dd82afc628a9e9c0d0"><enum>2.</enum><header>Purposes</header><text display-inline="no-display-inline">The purposes of this Act are to—</text>
			<paragraph id="ID05a8914962a34504b3d2bda1eed09543"><enum>(1)</enum><text>allow for the
			 enforcement of State laws requiring the disclosure of information about
			 Holocaust-era insurance policies, notwithstanding the holding of the Supreme
			 Court of the United States in American Insurance Association v. Garamendi, 539
			 U.S. 396 (2003) that such laws are preempted by the foreign policy espoused by
			 the executive branch of the Federal Government addressed in that case;</text>
			</paragraph><paragraph id="ID23ca81284b934b82abedfb9a10b4ca66"><enum>(2)</enum><text>facilitate the
			 disclosure of information about Holocaust-era insurance policies under
			 applicable State laws so that citizens of the United States (and other persons
			 on whose behalf such laws were enacted) may know whether they hold any rights
			 under the policies;</text>
			</paragraph><paragraph id="IDcef6288ef5f54aec9af706ef5d3babf5"><enum>(3)</enum><text>allow the
			 beneficiaries of Holocaust-era insurance policies, many of whom are citizens of
			 the United States, to bring suits in the courts of the United States to recover
			 any proceeds under the policies to which they may be entitled, notwithstanding
			 the defense that such suits are preempted by the executive-branch foreign
			 policy addressed in Garamendi;</text>
			</paragraph><paragraph id="IDb0741ae7d86b42e3ba13b0f27c6c2350"><enum>(4)</enum><text>foreclose
			 defenses to claims brought under section 4 of this Act arising from any prior
			 judgments or settlement agreements (including the class action judgment and
			 settlement agreement (M 21–89, United States District Court for the Southern
			 District of New York) in In re: Assicurazioni General S.p.A. Holocaust
			 Insurance Litigation) that were entered and approved based on the erroneous
			 conclusion that State-law claims to recover under Holocaust-era insurance
			 claims are preempted by the executive-branch foreign policy addressed in
			 Garamendi;</text>
			</paragraph><paragraph id="IDb4b0b661fe58486f8165fbe438ba7acd"><enum>(5)</enum><text>provide for a
			 uniform statute of limitations of 10 years after the date of enactment of this
			 Act in any action to recover under Holocaust-era insurance policies under this
			 Act or State law; and</text>
			</paragraph><paragraph id="ID710fa8e14d344b34b370da3107ebb1a7"><enum>(6)</enum><text>in carrying out
			 the purposes described in paragraphs (1) through (5), preserve the lawmaking
			 powers of Congress under article I of the Constitution of the United States,
			 with which the judicial decisions cited in this section are
			 inconsistent.</text>
			</paragraph></section><section id="ID4ddcfa45c817457d85c6ea59bda361af"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="idBE6E30665570488090F17893C129EB98"><enum>(1)</enum><header>Beneficiary</header><text>The
			 term <term>beneficiary</term> includes—</text>
				<subparagraph id="id77150646F2AF487492B81999D61BB928"><enum>(A)</enum><text>a named insured
			 or named beneficiary under a covered policy; and</text>
				</subparagraph><subparagraph id="id11ECE263813B4C398720E8576B3CD83B"><enum>(B)</enum><text>an heir,
			 assignee, or legal representative of a named insured or named beneficiary
			 described in subparagraph (A).</text>
				</subparagraph></paragraph><paragraph id="IDee2fe6495a604c9e9ed0d2782ff0d1ca"><enum>(2)</enum><header>Covered
			 policy</header><text>The term <term>covered policy</term> means any life,
			 dowry, education, annuity, property, or other insurance policy that was—</text>
				<subparagraph id="IDd7120a9f44a242b2bf4fe6235bd730f2"><enum>(A)</enum><text>in effect at any
			 time during the period beginning on January 31, 1933, and ending on December
			 31, 1945; and</text>
				</subparagraph><subparagraph id="ID23a1bd30db9a47c38b72d1dc2a6411ca"><enum>(B)</enum><text>issued to a
			 policyholder domiciled in—</text>
					<clause id="idEACDDCF12AB54932B22FE1624E356C59"><enum>(i)</enum><text>any
			 area that was occupied or controlled by Nazi Germany; or</text>
					</clause><clause id="ID35158f5b6f6645598b3d23483493ac55"><enum>(ii)</enum><text>the territorial
			 jurisdiction of Switzerland.</text>
					</clause></subparagraph></paragraph><paragraph id="IDd6b8253093494ebfb297cc204058ff2c"><enum>(3)</enum><header>Insurer</header><text>The
			 term <term>insurer</term>—</text>
				<subparagraph id="id2D3DE175BB164EC19AB8FE193A2DDC6A"><enum>(A)</enum><text>means any person
			 engaged in the business of insurance (including reinsurance) in interstate or
			 foreign commerce that issued a covered policy; and</text>
				</subparagraph><subparagraph id="id5D921D2B40794BB580E149AA80A24CAC"><enum>(B)</enum><text>includes any
			 successor in interest to a person described in subparagraph (A).</text>
				</subparagraph></paragraph><paragraph id="IDb1fa2df24bed4c04afa4cf36a8b97810"><enum>(4)</enum><header>Nazi
			 germany</header><text>The term <term>Nazi Germany</term> means—</text>
				<subparagraph id="ID2e3393b415ae4712bf2845bfe98ed289"><enum>(A)</enum><text>the Nazi
			 government of Germany; and</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID75d12d2f03414d349f7844bc895fe2ad"><enum>(B)</enum><text>any government
			 that—</text>
					<clause commented="no" display-inline="no-display-inline" id="id32BC8840E9CD4EBEABE444AD79E5B860"><enum>(i)</enum><text>had friendly
			 relations with the Nazi government of Germany;</text>
					</clause><clause commented="no" display-inline="no-display-inline" id="id499249C623384F21AACFC9F2706278AD"><enum>(ii)</enum><text>was allied with
			 or controlled by the Nazi government of Germany; or</text>
					</clause><clause commented="no" display-inline="no-display-inline" id="id5BFDCC8BDFF7463FA438A4278D155E72"><enum>(iii)</enum><text>exercised or
			 claimed sovereignty over any area occupied by the military forces of the Nazi
			 government of Germany.</text>
					</clause></subparagraph></paragraph><paragraph id="IDb80c61e213834c4b8cebdc4488aff206"><enum>(5)</enum><header>Related
			 company</header><text>The term <term>related company</term> means an affiliate,
			 as that term is defined in section 104(g) of the Gramm-Leach-Bliley Act (15
			 U.S.C. 6701(g)).</text>
			</paragraph></section><section id="ID9ab4c118154f4580b088f0427aefcdf8"><enum>4.</enum><header>Private right of
			 action; civil actions</header>
			<subsection id="ID2b5b89454aee4839a20ddde74f430c1c"><enum>(a)</enum><header>Civil actions
			 To recover under covered policies</header><text>A beneficiary of a covered
			 policy may bring a civil action against the insurer for the covered policy or a
			 related company of the insurer to recover proceeds due under the covered policy
			 or otherwise to enforce any rights under the covered policy.</text>
			</subsection><subsection id="ID52db69fb163d4d0a953045c2aa73dfde"><enum>(b)</enum><header>Nationwide
			 Service of Process</header><text>For a civil action brought under subsection
			 (a) in a district court of the United States, process may be served in the
			 judicial district where the case is brought or any other judicial district of
			 the United States where the defendant may be found, resides, has an agent, or
			 transacts business.</text>
			</subsection><subsection id="ID34a0a5ec3fb14bbe9334ba9dc3318b5e"><enum>(c)</enum><header>Remedies</header>
				<paragraph id="IDdc01ecf994c74155950d0da8844b8238"><enum>(1)</enum><header>Damages</header>
					<subparagraph id="id88FD1178ED9440348A6EF2F31AD4B50C"><enum>(A)</enum><header>In
			 general</header><text>A court shall award to a prevailing beneficiary in a
			 civil action brought under subsection (a)—</text>
						<clause id="idC782290B961B43DCAE44E18E95F98D66"><enum>(i)</enum><text>the
			 amount of the proceeds due under the covered policy;</text>
						</clause><clause id="id0002E9D284C4482CBD44AC8C4A782123"><enum>(ii)</enum><text>prejudgment
			 interest on the amount described in clause (i) from the date the amount was due
			 until the date of judgment, calculated at a rate of 6 percent per year,
			 compounded annually; and</text>
						</clause><clause id="id5D6AD4B849EA4EBAA29A864CD55DAD80"><enum>(iii)</enum><text>any other
			 appropriate relief necessary to enforce rights under the covered policy.</text>
						</clause></subparagraph><subparagraph id="id15C34352950645B686282065A6F6A94A"><enum>(B)</enum><header>Treble
			 damages</header><text>If a court finds that an insurer or related company of
			 the insurer acted in bad faith, the court shall award damages in an amount
			 equal to 3 times the amount otherwise to be awarded under subparagraph
			 (A).</text>
					</subparagraph></paragraph><paragraph id="ID43159058cf874cf69fb9fed48bdda5d4"><enum>(2)</enum><header>Attorney’s fees
			 and costs</header><text>A court shall award reasonable attorney’s fees and
			 costs to a prevailing beneficiary in a civil action brought under subsection
			 (a).</text>
				</paragraph></subsection><subsection id="ID2bc9cc4c9cb742d6aaf71ef8aff9de37"><enum>(d)</enum><header>Limitation</header><text>A
			 civil action may not be brought under this section on or after the date that is
			 10 years after the date of enactment of this Act.</text>
			</subsection></section><section id="ID5c34b1aeadb1439fa78f72289f63ee07"><enum>5.</enum><header>Effect of prior
			 judgments and releases</header>
			<subsection id="ID6b88ca247e68437f9289a70c6f2c5afb"><enum>(a)</enum><header>In
			 general</header>
				<paragraph id="idDC50032758E0462A9053099FCFD01288"><enum>(1)</enum><header>Effect</header><text>Subject
			 to subsection (b)(1), a judgment or release described in paragraph (2) shall
			 not preclude, foreclose, bar, release, waive, acquit, discharge, or otherwise
			 impair any claim brought under section 4 by any person.</text>
				</paragraph><paragraph id="idB854592524C54E00B502774DCCB10EF4"><enum>(2)</enum><header>Judgments and
			 releases</header><text>A judgment or release described in this paragraph
			 is—</text>
					<subparagraph id="idE5A8748BA5AB4012873142439D9A514F"><enum>(A)</enum><text>a judgment
			 entered before the date of enactment of this Act for any claim arising under a
			 covered policy in any civil action in a Federal or State court; or</text>
					</subparagraph><subparagraph id="id96E38C1D70254210858B10244FC830C7"><enum>(B)</enum><text>an agreement
			 entered into before the date of enactment of this Act under which any person
			 (on behalf of the person, any other person, or a class of persons) agrees not
			 to assert or agrees to waive or release any claim described in subparagraph
			 (A), regardless of whether the agreement is—</text>
						<clause id="id0C0F2FE8CADA4FA58ADD20841E6B5C06"><enum>(i)</enum><text>denominated as a
			 release, discharge, covenant not to sue, or otherwise; or</text>
						</clause><clause id="idFF8CEF63701D46F48C3CAC02ACBD8521"><enum>(ii)</enum><text>approved by a
			 court.</text>
						</clause></subparagraph></paragraph></subsection><subsection id="ID72091a7d25b94e598f90e52de8894bbd"><enum>(b)</enum><header>Rules of
			 construction</header>
				<paragraph id="id9877873B8A56448EB19966CCE4C2ACA3"><enum>(1)</enum><header>In
			 general</header><text>Except as provided in paragraph (2), nothing in this
			 section shall affect the validity or enforceability of any agreement entered
			 into between any claimant under a covered policy and the International
			 Commission on Holocaust Era Insurance Claims or an insurer under which the
			 claimant has agreed to release or waive any claim in consideration for payment
			 under a covered policy.</text>
				</paragraph><paragraph id="id0BC7495A9A494F07922AD270A6DF3064"><enum>(2)</enum><header>Exception</header><text>Paragraph
			 (1) shall not apply to any agreement for which the payment is denominated as
			 humanitarian by the International Commission on Holocaust Era Insurance
			 Claims.</text>
				</paragraph></subsection></section><section id="ID88f0ff68fa724297922b60de9545332e"><enum>6.</enum><header>Effect of
			 executive agreements and executive foreign policy</header>
			<subsection id="IDd831b14359174948a2dec76f9db79e33"><enum>(a)</enum><header>Effect of
			 executive agreements and executive foreign policy on State
			 laws</header><text>An executive agreement described in subsection (c)(1) and an
			 executive foreign policy described in subsection (c)(2) shall not supercede or
			 preempt the law of any State—</text>
				<paragraph id="idD41DC0B9A3FA43998012A7C3AEAD2243"><enum>(1)</enum><text>relating to a
			 claim under or relating to a covered policy against the insurer for the covered
			 policy or a related company of the insurer; or</text>
				</paragraph><paragraph id="idC3554716ED134352BD42AC2716F8DD03"><enum>(2)</enum><text>that requires an
			 insurer doing business in the State or any related company of the insurer to
			 disclose information regarding a covered policy issued by the insurer.</text>
				</paragraph></subsection><subsection id="IDbd3bf91b84f84f98b51ce0b0e06e85cc"><enum>(b)</enum><header>Effect of
			 executive agreements and executive foreign policy on claims brought under this
			 Act</header><text>An executive agreement described in subsection (c)(1) and an
			 executive foreign policy described in subsection (c)(2) shall not compromise,
			 settle, extinguish, waive, preclude, bar, or foreclose a claim brought under
			 section 4.</text>
			</subsection><subsection id="id8EC1E8A8610E4D81A4D6FDCB0E43FFF5"><enum>(c)</enum><header>Executive
			 agreements and executive foreign policy covered</header>
				<paragraph id="idBED5249CCD394E048E6F237EDE0DB095"><enum>(1)</enum><header>Executive
			 agreements</header><text>An executive agreement described in this paragraph is
			 an executive agreement between the United States and a foreign government
			 entered into before, on, or after the date of enactment of this Act.</text>
				</paragraph><paragraph id="id13599CB55106403AB8CDE9DC235E467C"><enum>(2)</enum><header>Executive
			 foreign policy</header><text>An executive foreign policy described in this
			 paragraph is a foreign policy of the executive branch of the Federal Government
			 established before, on, or after the date of enactment of this Act.</text>
				</paragraph></subsection></section><section id="IDf68d605655f44dc38e32d8d7a31d8c85"><enum>7.</enum><header>Effect on State
			 laws</header><text display-inline="no-display-inline">Nothing in this Act shall
			 supersede or preempt any State law except to the extent the law of the State
			 conflicts with this Act.</text>
		</section><section commented="no" id="IDca2adab1269c431f9d6e6d3c11a97032"><enum>8.</enum><header>Timeliness of
			 actions brought under State law</header><text display-inline="no-display-inline">A claim brought under any State law
			 described in section 6(a) shall not be deemed untimely on the basis of any
			 State or Federal statute of limitations or on the basis of any other legal or
			 equitable rule or doctrine (including laches) governing the timeliness of
			 claims if the claim is filed not later than 10 years after the date of
			 enactment of this Act.</text>
		</section><section id="ID2f4d1cfbe71141b18d6f5aa4a543e824"><enum>9.</enum><header>Severability</header><text display-inline="no-display-inline">If any provision of this Act or the
			 application of such provision to any person or circumstance is held to be
			 unconstitutional, the remainder of this Act and the application of such
			 provision to any other person or circumstance shall not be affected
			 thereby.</text>
		</section><section id="IDde2e86d8eb2940ef87cdbfe7e99c44e4"><enum>10.</enum><header>Effective date;
			 applicability</header><text display-inline="no-display-inline">This Act
			 shall—</text>
			<paragraph id="idEA87597EEAC94BC3B5BAFAFFC6FD0D00"><enum>(1)</enum><text>take effect on
			 the date of enactment of this Act; and</text>
			</paragraph><paragraph id="ID4de74425e39245a88b6dcb186e4721ff"><enum>(2)</enum><text>apply to any
			 claim relating to a covered policy that is brought, before, on, or after the
			 date of enactment of this Act.</text>
