		<official-title>To amend the Federal Food, Drug, and Cosmetic Act to
		  establish and enforce a maximum somatic cell count requirement for fluid
		  milk.</official-title>

		<section id="id7447F95AF3DD4D97B24740EAD3F0F4CF" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Milk Quality Standards Act of
			 2011</short-title></quote>.</text>
		</section><section id="idAA26957EEDF442DE8EF1C8F31E6838AF"><enum>2.</enum><header>Maximum somatic
			 cell count</header><text display-inline="no-display-inline">Chapter IV of the
			 Federal Food, Drug, and Cosmetic Act (21 U.S.C. 341 et seq.) is amended by
			 adding at the end the following:</text>

				<section id="idB54C218678884778B378194C26EC9885"><enum>424.</enum><header>Maximum
				somatic cell count</header>
					<subsection id="id3F1E2D7E45E54789966CEB5342343DE4"><enum>(a)</enum><header>Maximum somatic
				cell count</header>
						<paragraph id="idD7F4CA877F0B4AED8DDC30FFA05C7D59"><enum>(1)</enum><header>In
				general</header><text>The maximum somatic cell count for all dairy products
				sold, transported, or offered for sale or transport, in interstate commerce
				shall be 400,000 cells per milliliter of fluid milk, or equivalent, as
				determined by the Secretary.</text>
						</paragraph><paragraph id="id253DD277E48049EC8482125A4AE8DBAA"><enum>(2)</enum><header>Adjustment</header><text>The
				Secretary, after consideration of any recommendations submitted by the National
				Conference on Interstate Milk Shipments, may lower the maximum somatic cell
				count established under paragraph (1).</text>
						</paragraph></subsection><subsection id="idD006A71129734900A68EBC3E8B86979A"><enum>(b)</enum><header>Calculation</header><text>The
				Secretary shall promulgate regulations to require that the calculation of a
				herd average somatic cell count under this section shall be made using a
				geometric, rather than an arithmetic, mean.</text>
					</subsection><subsection id="id368CAFEDC0FD4E00B192B6B6987635BE"><enum>(c)</enum><header>Revision</header><text>The
				Secretary, in consultation with the National Conference on Interstate Milk
				Shipments, shall revise the Pasteurized Milk Ordinance to take into account the
				requirement under subsection (a) and any regulations promulgated under
				subsection (b).</text>
					</subsection><subsection id="idEBA0D3FD243F490A89122618E8435BBD"><enum>(d)</enum><header>Enforcement</header>
						<paragraph id="id57BAB39FBF1E4CF5BC3A2F22A5A04491"><enum>(1)</enum><header>In
				general</header><text>Beginning on the date that is 18 months after the date of
				enactment of this section, any person that sells, transports, or offers for
				sale or transport, in interstate commerce any dairy product in violation of
				subsection (a) shall be subject to a civil penalty in an amount determined in
				accordance with the regulations promulgated under paragraph (2).</text>
						</paragraph><paragraph id="idC2C37C93F0ED476E95F6C4F09440550F"><enum>(2)</enum><header>Regulations</header><text>Not
				later than 18 months after the date of enactment of this section, the Secretary
				shall promulgate regulations establishing a schedule of civil penalties for
				violations of subsection
				(a).</text>
