			<paragraph commented="no" display-inline="no-display-inline" id="ID90E77D2671F040D08DC431CFFC8BEE33"><enum>(1)</enum><header display-inline="yes-display-inline">Advanced glazing</header><text display-inline="yes-display-inline">The term <term>advanced glazing</term>
			 means glazing installed in a portal on the side or the roof of a motorcoach
			 that is designed to be highly resistant to partial or complete occupant
			 ejection in all types of motor vehicle crashes.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID72FCBBDC56CB40DDB99D16756DF8512A"><enum>(2)</enum><header display-inline="yes-display-inline">Bus</header><text display-inline="yes-display-inline">The term <term>bus</term> has the meaning
			 given such term in section 571.3(b) of title 49, Code of Federal Regulations
			 (as in effect on the day before the date of enactment of this Act).</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDC35439BE33F74704A80AE44F25342F6E"><enum>(3)</enum><header display-inline="yes-display-inline">Commercial motor vehicle</header><text display-inline="yes-display-inline">Except as otherwise specified, the term
			 <term>commercial motor vehicle</term> has the meaning given such term in
			 section 31132(1) of title 49, United States Code.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID4C25F8E445C44D3E912BAAC4F0B57E3B"><enum>(4)</enum><header display-inline="yes-display-inline">Direct tire pressure monitoring
			 system</header><text display-inline="yes-display-inline">The term <term>direct
			 tire pressure monitoring system</term> means a tire pressure monitoring system
			 (as defined in section 571.138 of title 49, Code of Federal Regulations), that
			 is capable of directly detecting when the air pressure level in any tire is
			 significantly under-inflated and immediately providing the driver a low tire
			 pressure warning as to which specific tire is significantly
			 under-inflated.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID3AF1BBC4C2C04AA09F0240F94D4B4F9E"><enum>(5)</enum><header display-inline="yes-display-inline">Electronic on-board recorder</header><text display-inline="yes-display-inline">The term <term>electronic on-board
			 recorder</term> means an electronic device that acquires and stores data
			 showing the record of duty status of the vehicle operator and performs the
			 functions required of an automatic on-board recording device in section
			 395.15(b) of title 49, Code of Federal Regulations.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID3D5D6B0067124273B8327E8B87C59B5E"><enum>(6)</enum><header display-inline="yes-display-inline">Event data recorder</header><text display-inline="yes-display-inline">The term <term>event data recorder</term>
			 has the meaning given that term in section 563.5 of title 49, Code of Federal
			 Regulations.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID8C43B2186D6B425BA343F3A039E94398"><enum>(7)</enum><header display-inline="yes-display-inline">Motor carrier</header><text display-inline="yes-display-inline">The term <term>motor carrier</term>
			 means—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="ID2B0868E10F274C13828C0D06A452FD75"><enum>(A)</enum><text display-inline="yes-display-inline">a motor carrier (as defined in section
			 13102(14) of title 49, United States Code); or</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID6E9A5CF82CE1449AB4F77C83F85BC7F5"><enum>(B)</enum><text display-inline="yes-display-inline">a motor private carrier (as defined in
			 section 13102(15) of such title).</text>
				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID05D69A290B974B8381674E7904800277"><enum>(8)</enum><header display-inline="yes-display-inline">Motorcoach</header><text display-inline="yes-display-inline">The term <term>motorcoach</term> has the
			 meaning given the term <term>over-the-road bus</term> in section 3038(a)(3) of
			 the Transportation Equity Act for the 21st Century (Public Law 105–178; 49
			 U.S.C. 5310 note), but does not include—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="ID5C8E9E868BFA4100A36FA8309EC6488A"><enum>(A)</enum><text display-inline="yes-display-inline">buses used in public transportation
			 provided by a State or local government; or</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID872031CFF5A047668CC2A97F6BCB7D7F"><enum>(B)</enum><text display-inline="yes-display-inline">school buses, including multifunction
			 school activity buses.</text>
				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID65823D94D63E4F2399681BB6A572A403"><enum>(9)</enum><header display-inline="yes-display-inline">Motorcoach services</header><text display-inline="yes-display-inline">The term <term>motorcoach services</term>
			 means passenger transportation by motorcoach for compensation.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID684A8E8AECCB45C9A2C46949B76A7D62"><enum>(10)</enum><header display-inline="yes-display-inline">Multifunction school activity
			 buses</header><text display-inline="yes-display-inline">The term
			 <term>multifunction school activity buses</term> has the meaning given such
			 term in section 571.3(b) of title 49, Code of Federal Regulations (as in effect
			 on the day before the date of the enactment of this Act).</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID723EC571B1C343E38A2D6531086BBA23"><enum>(11)</enum><header display-inline="yes-display-inline">Portal</header><text display-inline="yes-display-inline">The term <term>portal</term> means any
			 opening on the front, sides, rear, or roof of a motorcoach that could, in the
			 event of a crash involving the motorcoach, permit the partial or complete
			 ejection of any occupant from the motorcoach, including a young child.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID4F8F5ED9988F4952BECE42ABA04CB481"><enum>(12)</enum><header display-inline="yes-display-inline">Provider of motorcoach
			 services</header><text display-inline="yes-display-inline">The term
			 <term>provider of motorcoach services</term> means a motor carrier that
			 provides passenger transportation services with a motorcoach, including
			 per-trip compensation and contracted or chartered compensation.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDFB7E8C17F3AA414BACBE3CDD77FB3C7A"><enum>(13)</enum><header display-inline="yes-display-inline">Public transportation</header><text display-inline="yes-display-inline">The term <term>public transportation</term>
			 has the meaning given such term in section 5302(a)(10) of title 49, United
			 States Code.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDEE3466CC6CA54B9080025A4AC86C1B04"><enum>(14)</enum><header display-inline="yes-display-inline">Safety belt</header><text display-inline="yes-display-inline">The term <term>safety belt</term> has the
			 meaning given such term in section 153(i)(4)(B) of title 23, United States
			 Code.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID46624425EAA1483F95353764A7B2AFF6"><enum>(15)</enum><header display-inline="yes-display-inline">Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the
			 Secretary of Transportation.</text>
			</paragraph></section><section changed="deleted" commented="no" committee-id="SSCM00" display-inline="no-display-inline" id="IDEE2215352FDC43E383F7829FDAFE89E1" reported-display-style="strikethrough" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Regulations for improved occupant
			 protection and motorcoach crash avoidance</header>
			<subsection commented="no" display-inline="no-display-inline" id="ID64455361D6C443E99D740B5B9FBAED3F"><enum>(a)</enum><header display-inline="yes-display-inline">Regulations required within 1
			 year</header><text display-inline="yes-display-inline">Not later than 1 year
			 after the date of the enactment of this Act, the Secretary shall prescribe the
			 following regulations:</text>
				<paragraph commented="no" display-inline="no-display-inline" id="IDA4F17847FAE94121BE5622988C0DC22D"><enum>(1)</enum><header display-inline="yes-display-inline">Safety belts</header><text display-inline="yes-display-inline">The Secretary shall require safety belts to
			 be installed in motorcoaches at each designated seating position.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDC30D90C9F47D41F397C339AE7DC9271B"><enum>(2)</enum><header display-inline="yes-display-inline">Roof strength and crush
			 resistance</header><text display-inline="yes-display-inline">The Secretary
			 shall establish improved roof standards for motorcoaches that substantially
			 improve the resistance of motorcoach roofs to deformation and intrusion to
			 prevent serious occupant injury in rollover crashes involving
			 motorcoaches.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDE61B6A2271CB44B38805E03251E3FB86"><enum>(3)</enum><header display-inline="yes-display-inline">Anti-ejection safety
			 countermeasures</header><text display-inline="yes-display-inline">The Secretary
			 shall require advanced glazing to be installed in each motorcoach portal to
			 prevent partial or complete ejection of passengers of motorcoaches, including
			 such passengers that are children.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID0AD7E5D3C33B4C7CBAA24885399B4107"><enum>(4)</enum><header display-inline="yes-display-inline">Rollover crash avoidance</header><text display-inline="yes-display-inline">The Secretary shall require motorcoaches to
			 be equipped with stability enhancing technology, such as electronic stability
			 control, or torque vectoring, to reduce the number and frequency of rollover
			 crashes among motorcoaches.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID6C9D2FA1DDC74067B7B3A9879C8C4DA2"><enum>(5)</enum><header display-inline="yes-display-inline">Firefighting equipment</header><text display-inline="yes-display-inline">The Secretary shall require the
			 installation in motorcoaches of improved fire extinguishers or other readily
			 available firefighting equipment for the purpose of effectively extinguishing
			 fires in motorcoaches to prevent passenger deaths and injuries.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID94048F30A48749DE86ACC18277EA3351"><enum>(b)</enum><header display-inline="yes-display-inline">Regulations required within 2
			 years</header><text display-inline="yes-display-inline">Not later than 2 years
			 after the date of enactment of this Act, the Secretary shall prescribe the
			 following commercial motor vehicle tire regulations:</text>
				<paragraph commented="no" display-inline="no-display-inline" id="ID5A8BFEADA48549C2AB710229D676279E"><enum>(1)</enum><header display-inline="yes-display-inline">Commercial motor vehicle tire pressure
			 monitoring systems</header>
					<subparagraph commented="no" display-inline="no-display-inline" id="ID5396BB9F1EF44D558A70F651414A0F4D"><enum>(A)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Secretary shall
			 prescribe regulations that require motorcoaches to be equipped with direct tire
			 pressure monitoring systems that warn the operator of a commercial motor
			 vehicle when any tire exhibits a level of air pressure that is below a
			 specified level of air pressure established by the Secretary.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDEF46E153B4D64CB0BA2FAC4BD40172AB"><enum>(B)</enum><header>Performance
			 requirements</header><text display-inline="yes-display-inline">The regulations
			 prescribed by the Secretary under this section shall include performance
			 requirements to ensure that direct tire pressure monitoring systems are capable
			 of performing—</text>
						<clause commented="no" display-inline="no-display-inline" id="ID27104B77E125456092E7E67B49D422A3"><enum>(i)</enum><text display-inline="yes-display-inline">at all times when the ignition locking
			 system is in the <quote>On</quote> position;</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="ID3489BD0D3370469E968592FCBB0D6EC8"><enum>(ii)</enum><text display-inline="yes-display-inline">at all vehicle speeds;</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="ID5B23B74C52B1491FA9B1693599F61DA1"><enum>(iii)</enum><text display-inline="yes-display-inline">on all road surfaces;</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="ID5CFA8CFB7FA34ED1B7F5F659F4E33273"><enum>(iv)</enum><text display-inline="yes-display-inline">during all weather conditions; and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="ID8B9633D2CADD4369BE4CF508AAB871DF"><enum>(v)</enum><text display-inline="yes-display-inline">after a repair or other service is
			 performed on a tire.</text>
						</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDBA6BCB2B901441128278F55FDB3D2E9B"><enum>(2)</enum><header display-inline="yes-display-inline">Tire performance standard</header><text display-inline="yes-display-inline">The Secretary shall upgrade performance
			 standards for tires used on motorcoaches, including an enhanced endurance test
			 and a new high-speed performance test.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID9EBD803193F24A8BAEC4865D5C6F59AA"><enum>(c)</enum><header display-inline="yes-display-inline">Application of regulations</header>
				<paragraph commented="no" display-inline="no-display-inline" id="ID7AB4A2BEF1E94C68BA5EE39A4EF07D16"><enum>(1)</enum><header display-inline="yes-display-inline">New motorcoaches</header><text display-inline="yes-display-inline">Any regulation prescribed pursuant to
			 subsection (a) or (b) shall apply to all motorcoaches that are manufactured
			 more than 2 years after the date on which the regulation is published as a
			 final rule.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID4FDD55B6CC414A6488367484422D6570"><enum>(2)</enum><header display-inline="yes-display-inline">Retrofit requirements for existing
			 motorcoaches</header><text display-inline="yes-display-inline">The Secretary
			 may, by regulation, provide for the application of any requirement established
			 under this section to motorcoaches manufactured before the date on which the
			 requirement applies to new motorcoaches under paragraph (1) based on an
			 assessment of the feasibility, benefits, and costs of retrofitting the older
			 motorcoaches. The Secretary shall complete an assessment with respect to safety
			 belt retrofits not later than 2 years after the date of the enactment of this
			 Act.</text>
				</paragraph></subsection></section><section changed="deleted" commented="no" committee-id="SSCM00" display-inline="no-display-inline" id="IDB9EEA8407A884FCABB7AC7E20EA11F84" reported-display-style="strikethrough" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Standards for improved fire safety</header>
			<subsection commented="no" display-inline="no-display-inline" id="IDCC89DC5069C34C9E818FCEBA709F338E"><enum>(a)</enum><header display-inline="yes-display-inline">Evaluations</header><text display-inline="yes-display-inline">Not later than 18 months after the date of
			 the enactment of this Act, the Secretary shall complete an evaluation of the
			 following:</text>
				<paragraph commented="no" display-inline="no-display-inline" id="ID26348579A93E41BAA485F1A2B02DA694"><enum>(1)</enum><header display-inline="yes-display-inline">Flammability standard for exterior
			 components</header><text display-inline="yes-display-inline">The Secretary
			 shall examine the feasibility of establishing requirements for fire hardening
			 or fire resistance of motorcoach exterior components to prevent fire and smoke
			 inhalation injuries to occupants.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID92705F67F1854E89B3E342746D98A5EC"><enum>(2)</enum><header display-inline="yes-display-inline">Smoke suppression</header><text display-inline="yes-display-inline">The Secretary shall review Federal motor
			 vehicle safety standard number 302 (49 CFR 571.302; relating to flammability of
			 interior materials) to consider more realistic tests to improve the resistance
			 of motorcoach interiors and components to burning, prevent inhalation by
			 passengers of toxic smoke and vapors, and permit sufficient time for the safe
			 evacuation of passengers from motorcoaches.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID29451D57BA4B480D87115F9B7BFFD1EB"><enum>(3)</enum><header display-inline="yes-display-inline">Prevention of, and resistance to, wheel
			 well fires</header><text display-inline="yes-display-inline">The Secretary
			 shall assess technologies to prevent and mitigate the propagation of wheel well
			 fires into the passenger compartment and substantially reduce occupant deaths
			 and injuries from such fires.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID06EEAAAA72B74914BE240E20083FA2F5"><enum>(4)</enum><header display-inline="yes-display-inline">Passenger evacuation</header><text display-inline="yes-display-inline">The Secretary shall evaluate requirements
			 for motorcoaches to be equipped with the following:</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="ID5B4C31D445C14BDBA51824CE458189E5"><enum>(A)</enum><header display-inline="yes-display-inline">Improved emergency evacuation
			 designs</header><text display-inline="yes-display-inline">Improved emergency
			 exit window, door, roof hatch, and wheelchair lift door designs to expedite
			 access and use by passengers of motorcoaches under all emergency circumstances,
			 including crashes and fires.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID2FED577779934057922991D85254F4A1"><enum>(B)</enum><header display-inline="yes-display-inline">Emergency interior lighting</header><text display-inline="yes-display-inline">Emergency interior lighting systems,
			 including luminescent or retroreflectorized delineation of evacuation paths and
			 exits, that are triggered by a crash or other emergency incidents to accomplish
			 more rapid and effective evacuation of passengers.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID65F2B2411E9D4FD8AB00AB32EC5E4D02"><enum>(5)</enum><header display-inline="yes-display-inline">Automatic fire suppression</header><text display-inline="yes-display-inline">The Secretary shall evaluate requirements
			 for motorcoaches to be equipped with highly effective fire suppression systems
			 that automatically respond to and suppress all fires in such
			 motorcoaches.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDAB4F165DB0864D029C86965FC4C55F81"><enum>(b)</enum><header display-inline="yes-display-inline">Performance requirements</header><text display-inline="yes-display-inline">Not later than 3 years after the date of
			 the enactment of this Act, the Secretary shall issue performance requirements
			 for improved fire safety and passenger evacuation based on the results of the

			 research</header>
			<subsection commented="no" display-inline="no-display-inline" id="ID0E283B1A585A4EDEA7014BC8B16FCB70"><enum>(a)</enum><header display-inline="yes-display-inline">Safety research initiatives</header><text display-inline="yes-display-inline">Not later than 2 years after the date of
			 the enactment of this Act, the Secretary shall complete research on the
			 following:</text>
				<paragraph commented="no" display-inline="no-display-inline" id="IDBF70625C681B41FA9F7B616446F02FA7"><enum>(1)</enum><header display-inline="yes-display-inline">Compartmentalization safety
			 countermeasures</header><text display-inline="yes-display-inline">Enhanced
			 compartmentalization safety countermeasures for motorcoaches, including
			 enhanced seating designs, to reduce substantially the risk of passengers being
			 thrown from their seats and colliding with other passengers, interior surfaces,
			 and components in the event of a crash involving a motorcoach.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDA39C9D1C747B47B39BA50F4611350421"><enum>(2)</enum><header display-inline="yes-display-inline">Interior impact protection</header><text display-inline="yes-display-inline">Enhanced occupant impact protection
			 standards for motorcoach interiors to reduce substantially serious injuries for
			 all passengers of motorcoaches.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDFAF77C179A2740ABACC61DAADBC45E53"><enum>(3)</enum><header display-inline="yes-display-inline">Collision avoidance systems</header><text display-inline="yes-display-inline">Forward and lateral crash warning systems
			 applications for motorcoaches.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDF759AF37F8314E978474459D41F0B9D0"><enum>(b)</enum><header display-inline="yes-display-inline">Standards and regulations</header><text display-inline="yes-display-inline">Not later than 2 years after the completion
			 of each research initiative required under subsection (a), the Secretary shall
			 prescribe a standard or regulation based on the results of that
			 research.</text>
			</subsection></section><section changed="deleted" commented="no" committee-id="SSCM00" display-inline="no-display-inline" id="ID8BAE9859CE3E44F996AF83FFB97F4A1F" reported-display-style="strikethrough" section-type="subsequent-section"><enum>6.</enum><header display-inline="yes-display-inline">New entrants</header>
			<subsection commented="no" display-inline="no-display-inline" id="ID00B85A210EB042E199B73092CB6A2364"><enum>(a)</enum><header display-inline="yes-display-inline">Registration requirements</header><text display-inline="yes-display-inline">Section 13902(b) of title 49, United States
			 Code, is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="id3C6325DB202146D088E4E811AB0AF51F"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (1) through (8)
			 as paragraphs (2) through (9), respectively; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idAA90598F58764236A0F019D7E7F2AC6A"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting before paragraph (2), as
			 redesignated, the following:</text>

				motorcoach services only after that person—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="IDADE33FEFD85E4116988EB4C83499AD33"><enum>(A)</enum><text display-inline="yes-display-inline">undergoes a pre-authorization safety audit,
				including verification, in a manner sufficient to demonstrate the ability to
				comply with Federal rules and regulations, of—</text>
								<clause commented="no" display-inline="no-display-inline" id="IDC97EC76421DE4174891D1CF06A4FB821"><enum>(i)</enum><text display-inline="yes-display-inline">a drug and alcohol testing program
				consistent with part 40 of title 49, Code of Federal Regulations;</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="ID8D885ABA1CD545EABAA0720FC219B397"><enum>(ii)</enum><text display-inline="yes-display-inline">the carrier's system of compliance with
				hours-of-service rules, including hours-of-service records;</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="ID19504D1DD8E744B5BC3A9E8F0FB230D4"><enum>(iii)</enum><text display-inline="yes-display-inline">the ability to obtain required
				insurance;</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="ID1C9BED10C9DD4C628A2631D59F1A2BAF"><enum>(iv)</enum><text display-inline="yes-display-inline">driver qualifications, including the
				validity of the commercial driver's license of each driver who will be
				operating under such authority;</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="ID9B9FC72876CB458586DA2E54D48693B4"><enum>(v)</enum><text display-inline="yes-display-inline">disclosure of common ownership, common
				control, common management, common familial relationship, or other corporate
				relationship with another motor carrier or applicant for motor carrier
				authority during the most recent 3 years;</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="ID16E8779527724472867870D3666C1928"><enum>(vi)</enum><text display-inline="yes-display-inline">records of the State inspections, or of a
				Level I or Level V Commercial Vehicle Safety Alliance Inspection, for all
				vehicles that will be operated by the carrier;</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="ID709FF49F520549619F324CA7F98CD3B8"><enum>(vii)</enum><text display-inline="yes-display-inline">safety management programs, including
				vehicle maintenance and repair programs; and</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="IDD90A5D3EDD3040FA8051FEF9F32FBDB1"><enum>(viii)</enum><text display-inline="yes-display-inline">the ability to comply with the Americans
				with Disabilities Act of 1990 (42 U.S.C. 12101 et seq.) and the Over-the-Road
				Bus Transportation Accessibility Act of 2007 (49 U.S.C. 10101 note);</text>
								</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDC68EE1E0FC7B4E3EA920FDDD37815745"><enum>(B)</enum><text display-inline="yes-display-inline">has been interviewed to review safety
				management controls and the carrier's written safety oversight policies and
				practices; and</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDB3E7599B183F4E7794CE0C60B17B6C54"><enum>(C)</enum><text display-inline="yes-display-inline">has demonstrated, through the successful
				completion of a written examination developed by the Secretary, proficiency to
				comply with and carry out the requirements and regulations described in
				subsection
				(a)(1).</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDAF3372C6AB30444999475F89B5DE9B71"><enum>(b)</enum><header display-inline="yes-display-inline">Safety reviews of new
			 operators</header><text display-inline="yes-display-inline">Section 31144(g)(1)
			 of title 49, United States Code, is amended to read as follows:</text>
				<quoted-block changed="deleted" committee-id="SSCM00" display-inline="no-display-inline" id="ID31397541754C44D4ACF8403133FDFADF" reported-display-style="strikethrough" style="OLC">
					<paragraph commented="no" display-inline="no-display-inline" id="ID4CC0278FE066430F96E4106FEF2A9E70"><enum>(1)</enum><header display-inline="yes-display-inline">Safety review</header>
						<subparagraph commented="no" display-inline="no-display-inline" id="ID96E99016A0964375AADDB2BF37D4B964"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary shall require, by regulation,
				each owner and each operator granted new registration under section 13902 to
				undergo a safety review not later than 18 months after the date on which the
				owner or operator, as the case may be, begins operations under such
				registration.</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDA2977C4DA6284FCE937D10B1E98A6545"><enum>(B)</enum><header display-inline="yes-display-inline">Providers of motorcoach
				services</header><text display-inline="yes-display-inline">Safety reviews of
				owners and operators registered as providers of motorcoach services shall be
				conducted not later than 9 months after the owner or operator, as the case may
				be, begins operations under such registration.</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID2FE0B9C54141459EA6B2CE4BFCC7F5A9"><enum>(2)</enum><header display-inline="yes-display-inline">Pre-authorization safety
				audit</header><text display-inline="yes-display-inline">The pre-authorization
				safety audit required under paragraph (1)(A) shall be completed on-site not
				later than 90 days after the submission of an application for operating
				authority.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID3A33015ABCD64D6992487FC0AF1481D2"><enum>(c)</enum><header display-inline="yes-display-inline">Effective
			 date</header><text display-inline="yes-display-inline">The amendments made by
			 this section shall take effect on the date that is 1 year after the date of the
			 enactment of this Act.</text>

			 employees</header><text display-inline="yes-display-inline">Section 31135 of
			 such title is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="ID54F35617FDBD41CCAC010D2F51246D6F"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating subsection (d) as
			 subsection (e); and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID46751E807E2641D39ED84229DC6ECC09"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after subsection (c) the
			 following:</text>

				chapter 315, or an order of the Secretary issued under this subchapter, chapter
				315, or such regulations.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id77C664DC67114D0F892848D15C364EFB"><enum>(2)</enum><header>Civil
				penalties</header><text display-inline="yes-display-inline">If the Secretary
				determines that an employer has engaged in any of the prohibited actions
				described in paragraph (1), the Secretary shall—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="id53F894F32E9F46FFA3AA96AB5699C810"><enum>(A)</enum><text display-inline="yes-display-inline">deny, suspend, amend, or revoke all or part
				of any such employer's registration under section 13905; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0CEC4C5A4F4E480C84B539ADB5675480"><enum>(B)</enum><text display-inline="yes-display-inline">take into account such noncompliance for
				purposes of determining the amount of the civil penalty to be assessed under
				section
				521(b)(2)(D).</text>
								</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection></section><section changed="deleted" commented="no" committee-id="SSCM00" display-inline="no-display-inline" id="ID7C799F11FCEB4CF5B88DF69F55BB0DE0" reported-display-style="strikethrough" section-type="subsequent-section"><enum>8.</enum><header display-inline="yes-display-inline">Improved oversight of providers of
			 motorcoach services and other motorcoach carriers of passengers</header>
			<subsection commented="no" display-inline="no-display-inline" id="ID297064DD96AA429DA03BCD2FB22D252D"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 31144 of title 49, United States
			 Code, is amended by adding at the end the following:</text>
				<quoted-block changed="deleted" committee-id="SSCM00" display-inline="no-display-inline" id="ID922BB7D411694A3A82C1941C39D4759B" reported-display-style="strikethrough" style="OLC">
					<subsection commented="no" display-inline="no-display-inline" id="IDA8B37B2375EA4897811C7672E4528B86"><enum>(h)</enum><header display-inline="yes-display-inline">Periodic safety reviews of providers of
				motorcoach services</header>
						<paragraph commented="no" display-inline="no-display-inline" id="ID0BB5E0D7DC294835B9D8F5240E09E3FF"><enum>(1)</enum><header display-inline="yes-display-inline">Safety review</header><text display-inline="yes-display-inline">Not later than 3 years after the date of
				the enactment of the <short-title>Motorcoach Enhanced
				Safety Act of 2011</short-title>, the Secretary shall—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="id1C4048FD1F1245FC8E3BBA07AE5499B2"><enum>(A)</enum><text display-inline="yes-display-inline">determine the safety fitness of each
				provider of motorcoach services registered with the Federal Motor Carrier
				Safety Administration; and</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id370DD5E363D0489195F1C59A39D2AD5C"><enum>(B)</enum><text display-inline="yes-display-inline">assign a safety fitness rating to each such
				provider.</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID10279C91E0B9492AB9927B4FD44B24F4"><enum>(2)</enum><header display-inline="yes-display-inline">Periodic review</header><text display-inline="yes-display-inline">The Secretary shall establish a process, by
				regulation, for monitoring the safety performance of each provider of
				motorcoach services on a regular basis following the assignment of a safety
				fitness rating, including progressive intervention to correct unsafe
				practices.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID1EA4746B14DC41C5BC8519DD34598B4E"><enum>(3)</enum><header display-inline="yes-display-inline">Enforcement strike forces</header><text display-inline="yes-display-inline">In addition to the enhanced monitoring and
				enforcement actions required under paragraph (2), the Secretary may organize
				special enforcement strike forces targeting providers of motorcoach services,
				when and where the Secretary considers appropriate.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID458DF0A2D288465E9AEFF07B8C1761DC"><enum>(4)</enum><header display-inline="yes-display-inline">Periodic update of safety fitness
				rating</header><text display-inline="yes-display-inline">As part of the safety
				review required by this subsection, the Secretary shall reassess such rating
				not less frequently than every 3 years.</text>

				defined</header><text display-inline="yes-display-inline">In this subsection,
				the term <term>provider of motorcoach services</term> has the meaning given
				such term in section 2 of the <short-title>Motorcoach
				Enhanced Safety Act of
				2011</short-title>.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="IDAC6E37CE8D0C49A1BE24890866A7F7AB"><enum>(b)</enum><header display-inline="yes-display-inline">Revision of safety fitness rating
			 methodology</header><text display-inline="yes-display-inline">Not later than 1
			 year after the date of the enactment of this Act, the Secretary shall revise
			 the safety fitness rating methodology of the Department of Transportation
			 established pursuant to section 31144 of title 49, United States Code, to meet
			 the goals of the safety recommendation H–99–6 of the National Transportation
			 Safety Board, issued on February 26, 1999.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID541C93F6CD0241FE862D807EC6DF8BFF"><enum>(c)</enum><header display-inline="yes-display-inline">High risk carrier compliance
			 reviews</header><text display-inline="yes-display-inline">The second sentence
			 of section 4138 of Public Law 109–59 (49 U.S.C. 31144 note) is amended by
			 striking <quote>is rated as category A or B for 2 consecutive months.</quote>
			 and inserting <quote>meets the Safety Measurement System criteria for being a
			 high risk motor carrier for 2 consecutive months.</quote>.</text>
			</subsection></section><section changed="deleted" commented="no" committee-id="SSCM00" display-inline="no-display-inline" id="IDEA6497B2A6F94A0CB25D69BCAA6EF821" reported-display-style="strikethrough" section-type="subsequent-section"><enum>9.</enum><header display-inline="yes-display-inline">Motorcoach driver training</header>
			<subsection commented="no" display-inline="no-display-inline" id="ID308B7707EA78427BBCD18E3A22C071D1"><enum>(a)</enum><header display-inline="yes-display-inline">Establishment of training
			 curriculum</header>
				<paragraph commented="no" display-inline="no-display-inline" id="ID2D4FD65EFFB847BEAE573A5B00290301"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 18 months after the date of
			 the enactment of this Act, the Secretary shall establish, by regulation,
			 minimum curricular requirements for entry-level drivers of motorcoaches and
			 drivers upgrading from 1 class of commercial driver's license to another class,
			 to be adopted by public and private schools and motor carriers and motorcoach
			 operators that provide training for such drivers.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDC9A95BB6381B4D0F8D057BEC1DF31F29"><enum>(2)</enum><header display-inline="yes-display-inline">Curricular requirements</header><text display-inline="yes-display-inline">The curricular requirements under paragraph
			 (1) shall include—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="IDA15F73A09919476FBD27751B85F646B0"><enum>(A)</enum><text display-inline="yes-display-inline">classroom and behind-the-wheel instruction
			 that is adequate for training entry-level drivers of motorcoaches and drivers
			 upgrading from 1 class of commercial driver's license to another class to
			 safely operate motorcoaches and respond effectively to emergency situations;
			 and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDAD0C196F7DEE4650A1F67FAA5E1746FB"><enum>(B)</enum><text display-inline="yes-display-inline">instruction in advanced knowledge and
			 skills that are necessary to operate motorcoaches safely, including knowledge
			 and skills necessary—</text>
						<clause commented="no" display-inline="no-display-inline" id="ID693F17EC424B47719F871E2C379A6DFD"><enum>(i)</enum><text display-inline="yes-display-inline">to suppress motorcoach fires; and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="ID54615DE061264AF9B8CF06C7B837E843"><enum>(ii)</enum><text display-inline="yes-display-inline">to evacuate passengers from motorcoaches
			 safely.</text>
						</clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID1E6E28205E534481A094D02A1F00FAA4"><enum>(b)</enum><header display-inline="yes-display-inline">Training required</header>
				<paragraph commented="no" display-inline="no-display-inline" id="IDF7F5751FA90E4FABB7B9F24628484BCE"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary shall require each motorcoach
			 driver seeking a commercial driver's license passenger endorsement to undergo a
			 training program that includes the minimum curricular requirements established
			 under subsection (a) before taking a test for a commercial driver's license
			 passenger endorsement.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID0F0DCF4B62DE4685B28C30259A33C436"><enum>(2)</enum><header display-inline="yes-display-inline">Certificate required</header><text display-inline="yes-display-inline">The Secretary shall require that—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="ID48491BBDD73E4221A19DA12DD3A712D0"><enum>(A)</enum><text display-inline="yes-display-inline">each trainer of a driver seeking a
			 commercial driver's license passenger endorsement to issue a certificate to the
			 trainee and the appropriate State licensing authority certifying that the
			 trainee has completed a motorcoach driver training course that includes the
			 curricular requirements established under subsection (a);</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID53F994908EBB40EF965841DA10BB6AC2"><enum>(B)</enum><text display-inline="yes-display-inline">each driver seeking to take the test for
			 the commercial driver's license passenger endorsement to present the
			 certificate to a State licensing authority;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID9753DA2CA2A4418896DFDED87EB10E1E"><enum>(C)</enum><text display-inline="yes-display-inline">the State licensing authority to compare
			 the certificate presented by the applicant with the certificate provided by the
			 driver training school; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID7109390E08444111931E48F61BE6A070"><enum>(D)</enum><text display-inline="yes-display-inline">the State licensing authority to refuse to
			 administer the test if the certificates are not the same.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID046DBCF19CAD49F6ACEF25E903BE0945"><enum>(c)</enum><header display-inline="yes-display-inline">Report on feasibility, benefits, and costs
			 of establishing a system of certification of training programs</header><text display-inline="yes-display-inline">Not later than 2 years after the date of
			 the enactment of this Act, the Secretary shall submit a report to the
			 <committee-name committee-id="SSCM00">Committee on Commerce, Science, and
			 Transportation of the Senate</committee-name> and the
			 <committee-name committee-id="">Committee on Energy and Commerce of the House
			 of Representatives</committee-name> that describes the feasibility, benefits,
			 and costs of establishing a system of certification of public and private
			 schools and of motor carriers and motorcoach operators that provide motorcoach
			 driver training, in accordance with the curricular requirements established by
			 the Secretary under subsection (a).</text>
			</subsection></section><section changed="deleted" commented="no" committee-id="SSCM00" display-inline="no-display-inline" id="IDB15739A7D02F42ACA5CE9C00B3E2F16C" reported-display-style="strikethrough" section-type="subsequent-section"><enum>10.</enum><header display-inline="yes-display-inline">Improved testing for the commercial
			 driver's license passenger endorsement</header>
			<subsection commented="no" display-inline="no-display-inline" id="IDCE173DC389CA467EAA5F9BF08784098C"><enum>(a)</enum><header display-inline="yes-display-inline">Increased stringency of examination for
			 commercial driver's license passenger-Carrying endorsement</header>
				<paragraph commented="no" display-inline="no-display-inline" id="ID27864DC7F9734AC7BA876E3910BF0C67"><enum>(1)</enum><header display-inline="yes-display-inline">Final rule</header><text display-inline="yes-display-inline">Not later than 6 months after the date of
			 the enactment of this Act, the Secretary, after consultation with the American
			 Association of Motor Vehicle Administrators, shall issue a final rule in Docket
			 No. FMCSA 2007–27659: Commercial Driver's License Testing and Commercial
			 Learner's Permit Standards that improves the quality and stringency of the
			 examination for the commercial driver's license passenger-carrying
			 endorsement.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id06E89CD375E64760A122162FBA200174"><enum>(2)</enum><header>Requirements</header><text display-inline="yes-display-inline">The final rule issued under paragraph (1)
			 shall require—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="ID602AD5ED74B644609DB4432DAFCF0A29"><enum>(A)</enum><text display-inline="yes-display-inline">a more stringent knowledge test than the
			 test in effect on the day before the date of the enactment of this Act;
			 and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID230F2525386F446DAF833A3863455D7C"><enum>(B)</enum><text display-inline="yes-display-inline">a more stringent examination of the driving
			 skills necessary to operate safely a for-hire passenger-carrying commercial
			 motor vehicle than the examination of such skills in effect on the day before
			 the date of the enactment of this Act.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDDFA0FD4C31FF4B458A1C417E53C7559C"><enum>(b)</enum><header display-inline="yes-display-inline">Modification of requirements for commercial
			 driver's license passenger-Carrying endorsement</header><text display-inline="yes-display-inline">The Secretary shall require, by regulation,
			 that any driver who transports not fewer than 9 and not more than 15 passengers
			 (including the driver) in interstate commerce through the operation of a
			 commercial motor vehicle (as defined in section 31301(4) of title 49, United
			 States Code)—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="IDB94353EE9B0348C38060EC65AADC3278"><enum>(1)</enum><text display-inline="yes-display-inline">has a commercial driver's license
			 passenger-carrying endorsement; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDA1382CB592134E06BEBD1C98ABAA549C"><enum>(2)</enum><text display-inline="yes-display-inline">has been tested in accordance with a drug
			 and alcohol testing program that is consistent with part 40 of title 49, Code
			 of Federal Regulations.</text>
				</paragraph></subsection></section><section changed="deleted" commented="no" committee-id="SSCM00" display-inline="no-display-inline" id="ID9B54CA0C98214A7FBDE05A3DE4A6AF5E" reported-display-style="strikethrough" section-type="subsequent-section"><enum>11.</enum><header display-inline="yes-display-inline">Improved physical fitness oversight and
			 commercial driver medical certificates</header>
			<subsection commented="no" display-inline="no-display-inline" id="ID8048453DA7574FD0A00036AB1FA44A69"><enum>(a)</enum><header display-inline="yes-display-inline">Medical review board
			 functions</header><text display-inline="yes-display-inline">Section 31149(a)(1)
			 of title 49, United States Code, is amended—</text>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDA9D253A8077E4BB989543E6674E3F6C4"><enum>(b)</enum><header display-inline="yes-display-inline">Examination requirements for listing in the
			 national registry of medical examiners</header><text display-inline="yes-display-inline">Section 31149(c)(1)(D) of such title is
			 amended to read as follows:</text>

				completed to be listed in the national registry;</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="IDFB878BE4A5F146E691FEEF134CF17920"><enum>(ii)</enum><text display-inline="yes-display-inline">a rigorous written examination for which a
				passing grade must be achieved to be listed in the national registry;</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="ID1A4BD00CEFBD46C896E9150EA21A16D8"><enum>(iii)</enum><text display-inline="yes-display-inline">certification (including
				self-certification), as appropriate, to verify that the medical examiner has
				completed training, including refresher courses, that the Secretary determines
				are necessary to be listed in the national registry; and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="ID1D545C7EB2F246A8AC84A9F6FCE56753"><enum>(iv)</enum><text display-inline="yes-display-inline">demonstration of the willingness and
				ability of a medical examiner to comply with any reporting requirements
				established by the
				Secretary;</text>
						</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="IDEA11ED08B186472F9BE747353A84DCFB"><enum>(c)</enum><header display-inline="yes-display-inline">Medical examination form
			 comparisons</header><text display-inline="yes-display-inline">Not later than 18
			 months after the date of the enactment of this Act, the Secretary shall
			 prescribe a regulation that requires any medical examiner who performs a
			 medical examination to certify an applicant for a commercial driver's license
			 under section 391.43 of title 49, Code of Federal Regulations, to submit the
			 form for such examination required under subsection (f) of such section (as in
			 effect on the day before the date of the enactment of this Act) to the
			 appropriate State licensing agency.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID001D466A96474707A15F55F4A1FBA6BE"><enum>(d)</enum><header display-inline="yes-display-inline">State plan requirement</header><text display-inline="yes-display-inline">Section 31102(b) of title 49, United States
			 Code, is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="ID473FFB5ED22C4192983E83446D003AFA"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (W), by striking
			 <quote>and</quote> at the end;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID0D8BEC9FFFE04A8ABCEB7D8943DFB1E7"><enum>(2)</enum><text display-inline="yes-display-inline">in subparagraph (X), by striking the period

				in effect on the day before the date of the enactment of that Act), to
				determine the accuracy and validity of the information contained in such forms
				and
				certificates.</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID3D1043FAE87B465BB95D2A0F122FD718"><enum>(e)</enum><header display-inline="yes-display-inline">Additional oversight of licensing
			 authorities</header>
				<paragraph commented="no" display-inline="no-display-inline" id="ID0FE3BA71FD02408C85FF095DDC687C64"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 31149(c)(1) of title 49, United
			 States Code, is amended—</text>

				submissions by the licensing
				authorities.</text>
							</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID5DB7BA4E78134212B5D859044610E5B7"><enum>(2)</enum><header display-inline="yes-display-inline">Internal oversight policy</header>
					<subparagraph commented="no" display-inline="no-display-inline" id="IDEFF4DBDB774C43A58695497705C55DC2"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the
			 enactment of this Act, the Secretary shall establish an oversight policy and
			 process within the Department of Transportation for purposes of carrying out
			 section 31149(c)(1)(G) of title 49, United States Code, as added by paragraph
			 (1)(C).</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDBDD5A0EACEFC4E4FB7F99B5DCA00B469"><enum>(B)</enum><header display-inline="yes-display-inline">Effective
			 date</header><text display-inline="yes-display-inline">Section 31149(c)(1)(G)
			 of title 49, United States Code, as added by paragraph (1)(C), shall take
			 effect on the date on which the oversight policies and processes are
			 established pursuant to subparagraph (A).</text>
					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID99BABE87EF9F40ADBAF5F067A06B1A7C"><enum>(f)</enum><header display-inline="yes-display-inline">Deadline for establishment of national
			 registry of medical examiners</header><text display-inline="yes-display-inline">Not later than 6 months after the date of
			 the enactment of this Act, the Secretary shall establish a national registry of
			 medical examiners as required under section 31149(d)(1) of title 49, United
			 States Code.</text>
			</subsection></section><section changed="deleted" commented="no" committee-id="SSCM00" display-inline="no-display-inline" id="IDB3BEA67055A84DC0A08CE87ADF497D03" reported-display-style="strikethrough" section-type="subsequent-section"><enum>12.</enum><header display-inline="yes-display-inline">Safety and enforcement technology for
			 motorcoaches</header>
			<subsection commented="no" display-inline="no-display-inline" id="ID8A289EBB293D4C478B6A62D0831DEA1A"><enum>(a)</enum><header display-inline="yes-display-inline">Electronic on-Board recorders</header>
				<paragraph commented="no" display-inline="no-display-inline" id="ID024342DBD23F4A48B9C0BF1222E163C0"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the
			 enactment of this Act, the Secretary shall prescribe regulations requiring that
			 all motorcoaches used by any motor carrier in interstate commerce be equipped
			 with electronic on-board recorders.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID0E8E4D5B933A4A7699A59E61C679496F"><enum>(2)</enum><header>Performance
			 requirements</header><text display-inline="yes-display-inline">The regulations
			 prescribed by the Secretary under paragraph (1) shall include performance
			 requirements to ensure that electronic on-board recorders—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="IDDB16C8586F49493A9F22A6FFE111E289"><enum>(A)</enum><text display-inline="yes-display-inline">accurately record commercial driver hours
			 of service;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID85D0AE8F4BE54936AD8744E93D886BAC"><enum>(B)</enum><text display-inline="yes-display-inline">allow tracking of driver and vehicle
			 location; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDE9FA566786FC4D4BAE48CBB257D923EE"><enum>(C)</enum><text display-inline="yes-display-inline">are tamper resistant.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID37A3BC91C28A482FB4966F33B5904406"><enum>(3)</enum><header display-inline="yes-display-inline">Effective
			 date</header><text display-inline="yes-display-inline">The regulations
			 prescribed under this subsection shall—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="idB83E48198D614F48ACA4E5C9BE7740BB"><enum>(A)</enum><text display-inline="yes-display-inline">take effect on the date that is 2 years
			 after the date on which the regulation is published as a final rule; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6E2430DBE7974A47B56FFB776D4188DC"><enum>(B)</enum><text display-inline="yes-display-inline">apply to all motorcoaches described in
			 paragraph (1).</text>
					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID6D69C32DB0BA49F5A152428D1DDC408A"><enum>(b)</enum><header display-inline="yes-display-inline">Event data recorders</header>
				<paragraph commented="no" display-inline="no-display-inline" id="IDB5F73565EDB946128FB7D53A1A27D3F9"><enum>(1)</enum><header display-inline="yes-display-inline">Evaluation</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the
			 enactment of this Act, the Secretary shall complete an evaluation of event data
			 recorders, including requirements regarding specific types of vehicle
			 operations, events and incidents, and systems information to be recorded, for
			 event data recorders to be used on motorcoaches used by motor carriers in
			 interstate commerce. For this purpose, the Secretary shall consider the
			 performance requirements for event data recorders for passenger vehicles under
			 part 563 of title 49, Code of Federal Regulations.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID41ED03608CDA4B5E895621E98E73714E"><enum>(2)</enum><header display-inline="yes-display-inline">Standards and regulations</header><text display-inline="yes-display-inline">Not later than 1 year after completing the
			 evaluation required under paragraph (1), the Secretary shall issue standards
			 and regulations based on the results of such evaluation.</text>
				</paragraph></subsection></section><section changed="deleted" commented="no" committee-id="SSCM00" display-inline="no-display-inline" id="ID6A33ACB889D24C40AFC8DB264E0B38C4" reported-display-style="strikethrough" section-type="subsequent-section"><enum>13.</enum><header display-inline="yes-display-inline">Safety inspection program for commercial
			 motor vehicles of passengers</header><text display-inline="no-display-inline">Not later than 3 years after the date of the
			 enactment of this Act, the Secretary shall complete a rulemaking proceeding to
			 consider requiring States to conduct annual inspections of commercial motor
			 vehicles designed or used to transport passengers, including—</text>
			<paragraph commented="no" display-inline="no-display-inline" id="IDC135D587857B460AA2CA3DC753533E7B"><enum>(1)</enum><text display-inline="yes-display-inline">an assessment of the risks associated with
			 improperly maintained or inspected commercial motor vehicles designed or used
			 to transport passengers;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID1B89AA05299744A68D4F7B7DE1B89504"><enum>(2)</enum><text display-inline="yes-display-inline">an assessment of the effectiveness of
			 current Federal standards for the inspection of such vehicles in mitigating the
			 risks described in paragraph (1) and to ensure the safe and proper operation
			 condition of such vehicles; and</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID0ED3AA1AD6D24D52A0A6FBCD356D0A0D"><enum>(3)</enum><text display-inline="yes-display-inline">an assessment of the costs and benefits of
			 a mandatory State inspection program.</text>
			</paragraph></section><section changed="deleted" commented="no" committee-id="SSCM00" display-inline="no-display-inline" id="ID1EA7DBD4544B48A681686FC9E341E09E" reported-display-style="strikethrough" section-type="subsequent-section"><enum>14.</enum><header display-inline="yes-display-inline">Distracted driving</header>
			<subsection commented="no" display-inline="no-display-inline" id="ID479570BFF3204F5284FE9D3D4AE9F7F6"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subchapter III of chapter 311 of title 49,
			 United States Code, is amended by adding at the end the following:</text>

					<section commented="no" display-inline="no-display-inline" id="idE3D7C9AFA80749E1B439491713CD86F3" section-type="subsequent-section"><enum>31152.</enum><header>Regulation of the
				use of distracting devices in motorcoaches</header>
						<subsection commented="no" display-inline="no-display-inline" id="IDC82C6B974CE847BF844AD3B5D4C6D123"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the
				enactment of the <short-title>Motorcoach Enhanced Safety
				Act of 2011</short-title>, the Secretary of Transportation shall prescribe
				regulations on the use of electronic or wireless devices, including cell phones
				and other distracting devices, by an individual employed as the operator of a
				motorcoach (as defined in section 2(8) of that Act).</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="ID1CD808CB47454412851948F9440DAC5C"><enum>(b)</enum><header display-inline="yes-display-inline">Basis for regulations</header><text display-inline="yes-display-inline">The Secretary shall base the regulations
				required under subsection (a) on accident data analysis, the results of ongoing
				research, and other information, as appropriate.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="IDDEC94E4A539D475ABC28B1A0D714AA13"><enum>(c)</enum><header display-inline="yes-display-inline">Prohibited
				use</header><text display-inline="yes-display-inline">Except as provided in
				subsection (d), the Secretary shall prohibit the use of the devices set forth
				in subsection (a) in circumstances in which the Secretary determines that their
				use interferes with the driver's safe operation of a motorcoach.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="ID53D0DF7A11454EC88FB689B97DC3A6B1"><enum>(d)</enum><header display-inline="yes-display-inline">Permitted use</header><text display-inline="yes-display-inline">Under the regulations, the Secretary may
				permit the use of a device otherwise prohibited under subsection (c) if the
				Secretary determines that such use is necessary for the safety of the driver or
				the public in emergency
				circumstances.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="IDCF19054DE10A4373AAF42DEDED56017F"><enum>(b)</enum><header display-inline="yes-display-inline">Conforming amendment</header><text display-inline="yes-display-inline">The table of contents for chapter 311 of

				contact information of drivers, or holds itself out to the public as a charter
				bus company; and</text>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDDECF0D38C34445D1BD29508F28677C72"><enum>(B)</enum><text display-inline="yes-display-inline">does not include an individual who is an
				employee of the United States Government, a State, or a political subdivision
				of a State acting in the course of that individual's employment as such an
				employee.</text>

			 means glazing installed in a portal on the side or the roof of a motorcoach
			 that is designed to be highly resistant to partial or complete occupant
			 ejection in all types of motor vehicle crashes.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDE75A3234B583419B81E853A0899592F7"><enum>(2)</enum><header display-inline="yes-display-inline">Bus</header><text display-inline="yes-display-inline">The term <term>bus</term> has the meaning
			 given such term in section 571.3(b) of title 49, Code of Federal Regulations
			 (as in effect on the day before the date of the enactment of this Act).</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDAD46B8F16C3A4744BCCF9AA25F24CDA5"><enum>(3)</enum><header display-inline="yes-display-inline">Commercial motor vehicle</header><text display-inline="yes-display-inline">Except as otherwise specified, the term
			 <term>commercial motor vehicle</term> has the meaning given such term in
			 section 31132(1) of title 49, United States Code.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDC0A9597F4BCB4F8EAF4A635177A00757"><enum>(4)</enum><header display-inline="yes-display-inline">Direct tire pressure monitoring
			 system</header><text display-inline="yes-display-inline">The term <term>direct
			 tire pressure monitoring system</term> means a tire pressure monitoring system
			 that is capable of directly detecting when the air pressure level in any tire
			 is significantly under-inflated and providing the driver a low tire pressure
			 warning as to which specific tire is significantly under-inflated.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDF6557D2CBA5D48B1A4F30D37A5F1E3A2"><enum>(5)</enum><header display-inline="yes-display-inline">Electronic on-board recorder</header><text display-inline="yes-display-inline">The term <term>electronic on-board
			 recorder</term> means an electronic device that acquires and stores data
			 showing the record of duty status of the vehicle operator and performs the
			 functions required of an automatic on-board recording device in section
			 395.15(b) of title 49, Code of Federal Regulations.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID0D55F9D77EC2481A8FC63BDA56C34CD5"><enum>(6)</enum><header display-inline="yes-display-inline">Event data recorder</header><text display-inline="yes-display-inline">The term <term>event data recorder</term>
			 has the meaning given that term in section 563.5 of title 49, Code of Federal
			 Regulations.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDCD116AE575594A58BC1081C2BCC20E92"><enum>(7)</enum><header display-inline="yes-display-inline">Motor carrier</header><text display-inline="yes-display-inline">The term <term>motor carrier</term>
			 means—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="ID6BBC948C3D2F4466A0580C5F9A5E8AB4"><enum>(A)</enum><text display-inline="yes-display-inline">a motor carrier (as defined in section
			 13102(14) of title 49, United States Code); or</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDE77E7A46C0D1488B9C430C12EF6C1219"><enum>(B)</enum><text display-inline="yes-display-inline">a motor private carrier (as defined in
			 section 13102(15) of such title).</text>
				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID14036123E3E542429A557E4C5E366782"><enum>(8)</enum><header display-inline="yes-display-inline">Motorcoach</header><text display-inline="yes-display-inline">The term <term>motorcoach</term>
			 means—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="id8D1E3380738943718DFFBE2420276969"><enum>(A)</enum><text display-inline="yes-display-inline">a bus with—</text>
					<clause commented="no" display-inline="no-display-inline" id="idBF82B0C243B642D099EEBF23C484647B"><enum>(i)</enum><text display-inline="yes-display-inline">a gross vehicle weight rating of 26,000
			 pounds or greater;</text>
					</clause><clause commented="no" display-inline="no-display-inline" id="id8FAB01A73BA949ABB02C91B9E79306E5"><enum>(ii)</enum><text display-inline="yes-display-inline">16 or more designated seating positions
			 (including the driver); and</text>
					</clause><clause commented="no" display-inline="no-display-inline" id="idB5F67FF82E384D1EA484879CC7136132"><enum>(iii)</enum><text display-inline="yes-display-inline">at least 2 rows of passenger seats rearward
			 of the driver's seating position that are forward-facing or can be converted to
			 forward-facing without the use of tools; and</text>
					</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id301655EF9488481B8BDD3E74E9DCFF6F"><enum>(B)</enum><text display-inline="yes-display-inline">does not include—</text>
					<clause commented="no" display-inline="no-display-inline" id="ID6A48437DB9EC4B54AFD0818FB8B153E7"><enum>(i)</enum><text display-inline="yes-display-inline">a bus used in transit service provided by a
			 State or local government; or</text>
					</clause><clause commented="no" display-inline="no-display-inline" id="IDD4AC9B93B5F14BFCB6046A865CF81235"><enum>(ii)</enum><text display-inline="yes-display-inline">a school bus, including a multifunction
			 school activity bus.</text>
					</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDC4C8BD4EB1D249AAB7B7DA3E155C65E6"><enum>(9)</enum><header display-inline="yes-display-inline">Motorcoach services</header><text display-inline="yes-display-inline">The term <term>motorcoach services</term>
			 means passenger transportation by motorcoach for compensation.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID1FEFAB9783D54A44B3E53074A5174705"><enum>(10)</enum><header display-inline="yes-display-inline">Multifunction school activity
			 buses</header><text display-inline="yes-display-inline">The term
			 <term>multifunction school activity buses</term> has the meaning given such
			 term in section 571.3(b) of title 49, Code of Federal Regulations (as in effect
			 on the day before the date of the enactment of this Act).</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDB191AD8187644CF48C51AF6A881EF577"><enum>(11)</enum><header display-inline="yes-display-inline">Portal</header><text display-inline="yes-display-inline">The term <term>portal</term> means any
			 opening on the front, sides, rear, or roof of a motorcoach that could, in the
			 event of a crash involving the motorcoach, permit the partial or complete
			 ejection of any occupant from the motorcoach, including a young child.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID06B36C7B44A64A26BE29008BE73E201D"><enum>(12)</enum><header display-inline="yes-display-inline">Provider of motorcoach
			 services</header><text display-inline="yes-display-inline">The term
			 <term>provider of motorcoach services</term> means a motor carrier that
			 provides passenger transportation services with a motorcoach, including
			 per-trip compensation and contracted or chartered compensation.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDA515F120836F4DB3A970A1C40B28222D"><enum>(13)</enum><header display-inline="yes-display-inline">Safety belt</header><text display-inline="yes-display-inline">The term <term>safety belt</term> has the
			 meaning given such term in section 153(i)(4)(B) of title 23, United States
			 Code.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDFF8365DACB1249139D5940ECD42775E3"><enum>(14)</enum><header display-inline="yes-display-inline">Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the
			 Secretary of Transportation.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDC1C021DE161746A1A0738751D10924A1"><enum>(15)</enum><header display-inline="yes-display-inline">Transit service</header><text display-inline="yes-display-inline">The term <term>transit service</term> means
			 motorcoach service characterized by operating speeds of less than 45 miles per
			 hour and frequent stops.</text>
			</paragraph></section><section changed="added" commented="no" committee-id="SSCM00" display-inline="no-display-inline" id="ID7CCCB82671754171B627BE904D8DA323" reported-display-style="italic" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Regulations for improved occupant
			 protection and collision avoidance</header>
			<subsection commented="no" display-inline="no-display-inline" id="ID8B97C8E9AA934B23ACD6A60EE09025CD"><enum>(a)</enum><header display-inline="yes-display-inline">Regulations required within 1
			 year</header><text display-inline="yes-display-inline">Not later than 1 year
			 after the date of the enactment of this Act, the Secretary shall prescribe the
			 following regulations:</text>
				<paragraph commented="no" display-inline="no-display-inline" id="ID9E54C40369324D258D144AD9E6FF5340"><enum>(1)</enum><header display-inline="yes-display-inline">Safety belts</header><text display-inline="yes-display-inline">The Secretary shall issue a final rule in
			 Docket No. NHTSA 2010–0112: <italic>Federal Motor Vehicle Standards; Motorcoach
			 Definition; Occupant Crash Protection</italic>, to require safety belts to be
			 installed in motorcoaches at each designated seating position.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID57338606BE31480CB43C83AB4F45E52D"><enum>(2)</enum><header display-inline="yes-display-inline">Firefighting equipment</header><text display-inline="yes-display-inline">The Secretary shall require the
			 installation in motorcoaches of improved fire extinguishers or other readily
			 available firefighting equipment for the purpose of effectively extinguishing
			 fires in motorcoaches to prevent passenger deaths and injuries.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID7F097DF563A44AE8A4C24B55AC11608E"><enum>(b)</enum><header display-inline="yes-display-inline">Regulations required within 18
			 months</header><text display-inline="yes-display-inline">Not later than 18
			 months after the date of the enactment of this Act, the Secretary shall
			 prescribe regulations—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="ID3DBBF118694145BEB990768EBBCF7936"><enum>(1)</enum><text display-inline="yes-display-inline">establishing improved roof standards for
			 motorcoaches that substantially improve the resistance of motorcoach roofs to
			 deformation and intrusion to prevent serious occupant injury in rollover
			 crashes involving motorcoaches; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID2E73216AA44E418CABC32EB8014C3CEC"><enum>(2)</enum><text display-inline="yes-display-inline">requiring advanced glazing to be installed
			 in each motorcoach portal to prevent partial or complete ejection of passengers
			 of motorcoaches, including such passengers that are children.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDE0DA41E06137480692F2A2858CC6E014"><enum>(c)</enum><header display-inline="yes-display-inline">Regulations required within 2
			 years</header><text display-inline="yes-display-inline">Not later than 2 years
			 after the date of the enactment of this Act, the Secretary shall prescribe the
			 following commercial motor vehicle regulations:</text>
				<paragraph commented="no" display-inline="no-display-inline" id="ID7372B004F32E4AD8AAF075408A1845C2"><enum>(1)</enum><header display-inline="yes-display-inline">Rollover crash avoidance</header><text display-inline="yes-display-inline">The Secretary shall require motorcoaches to
			 be equipped with stability enhancing technology, such as electronic stability
			 control, or torque vectoring, to reduce the number and frequency of rollover
			 crashes among motorcoaches.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID72B3CF2061464FF093D5E92CE9CD9B5B"><enum>(2)</enum><header display-inline="yes-display-inline">Commercial motor vehicle tire pressure
			 monitoring systems</header>
					<subparagraph commented="no" display-inline="no-display-inline" id="ID717F635674284C8D82E8900F6101E3CC"><enum>(A)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Secretary shall
			 prescribe regulations that require motorcoaches to be equipped with direct tire
			 pressure monitoring systems that warn the operator of a commercial motor
			 vehicle when any tire exhibits a level of air pressure that is below a
			 specified level of air pressure established by the Secretary.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDD1D942E883D8406881BFDBB5277644FD"><enum>(B)</enum><header>Performance
			 requirements</header><text display-inline="yes-display-inline">The regulations
			 prescribed by the Secretary under this paragraph shall include performance
			 requirements to ensure that direct tire pressure monitoring systems are capable
			 of—</text>
						<clause commented="no" display-inline="no-display-inline" id="ID9B97CE9488374871B47B92A68771839A"><enum>(i)</enum><text display-inline="yes-display-inline">providing a warning to the driver when 1 or
			 more tires are underinflated;</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="ID8A757D786AE741A1B8E67327A9844573"><enum>(ii)</enum><text display-inline="yes-display-inline">activating in a specified time period after
			 the underinflation is detected; and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="IDF8C3786D2F2547F5AC94EB665973E9B1"><enum>(iii)</enum><text display-inline="yes-display-inline">operating at different vehicle
			 speeds.</text>
						</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDD7FA0992D70E41EEAA735923709DEA1D"><enum>(3)</enum><header display-inline="yes-display-inline">Tire performance standard</header><text display-inline="yes-display-inline">The Secretary shall upgrade performance
			 standards for tires used on motorcoaches by conducting an enhanced endurance
			 test and a new high-speed performance test.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID3D1BF2824D7B467692A864998E2068E0"><enum>(d)</enum><header display-inline="yes-display-inline">Application of regulations</header>
				<paragraph commented="no" display-inline="no-display-inline" id="ID586EB9D0995B41FEBF87D4D5DFD394D3"><enum>(1)</enum><header display-inline="yes-display-inline">New motorcoaches</header><text display-inline="yes-display-inline">A regulation prescribed in accordance with
			 subsection (a), (b), or (c) shall apply to all motorcoaches manufactured more
			 than 2 years after the date on which the regulation is published as a final
			 rule.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID3E9E8245F9854AFBACF3EC5F15D9A006"><enum>(2)</enum><header display-inline="yes-display-inline">Retrofit requirements for existing
			 motorcoaches</header><text display-inline="yes-display-inline">The Secretary
			 may, by regulation, provide for the application of any requirement established
			 under this section to motorcoaches manufactured before the date on which the
			 requirement applies to new motorcoaches under paragraph (1) based on an
			 assessment of the feasibility, benefits, and costs of retrofitting such
			 motorcoaches. The Secretary shall complete such assessment with respect to
			 safety belt retrofits no later than 2 years after the date of the enactment of
			 this Act.</text>
				</paragraph></subsection></section><section changed="added" commented="no" committee-id="SSCM00" display-inline="no-display-inline" id="IDE5CC84C1C5824783A3794C1E5986FA9C" reported-display-style="italic" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Standards for improved fire safety</header>
			<subsection commented="no" display-inline="no-display-inline" id="IDEE416D36D1634028A71DB6938B514B14"><enum>(a)</enum><header display-inline="yes-display-inline">Evaluations</header><text display-inline="yes-display-inline">Not later than 18 months after the date of
			 the enactment of this Act, the Secretary shall conduct an evaluation of the
			 following:</text>
				<paragraph commented="no" display-inline="no-display-inline" id="ID749A2E0ECB134D1692E644542498B2A1"><enum>(1)</enum><header display-inline="yes-display-inline">Flammability standard for exterior
			 components</header><text display-inline="yes-display-inline">The Secretary
			 shall examine the feasibility of establishing requirements for fire hardening
			 or fire resistance of motorcoach exterior components to prevent fire and smoke
			 inhalation injuries to occupants.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDBB20198EA01345D49FF5AE5E9660D7AC"><enum>(2)</enum><header display-inline="yes-display-inline">Smoke suppression</header><text display-inline="yes-display-inline">The Secretary shall review Federal motor
			 vehicle safety standard number 302 (49 C.F.R. 571.302; relating to flammability
			 of interior materials) to consider more realistic tests to improve the
			 resistance of motorcoach interiors and components to burning and permit
			 sufficient time for the safe evacuation of passengers from motorcoaches.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDA6224F9AB0134F1CBE99D0CCE560BEF8"><enum>(3)</enum><header display-inline="yes-display-inline">Prevention of, and resistance to, wheel
			 well fires</header><text display-inline="yes-display-inline">The Secretary
			 shall assess technologies to prevent and mitigate the propagation of wheel well
			 fires into the passenger compartment and substantially reduce occupant deaths
			 and injuries from such fires.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID12CD0887C1DB43168B7A5B8CC59336C4"><enum>(4)</enum><header display-inline="yes-display-inline">Passenger evacuation</header><text display-inline="yes-display-inline">The Secretary shall evaluate requirements
			 for motorcoaches to be equipped with the following:</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="ID7EACE17FB82846A39FE718AEA362CBCE"><enum>(A)</enum><header display-inline="yes-display-inline">Improved emergency evacuation
			 designs</header><text display-inline="yes-display-inline">Improved emergency
			 exit window, door, roof hatch, and wheelchair lift door designs to expedite
			 access and use by passengers of motorcoaches under all emergency circumstances,
			 including crashes and fires.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID714E785281CE44BFA0B1D2C152B64BA4"><enum>(B)</enum><header display-inline="yes-display-inline">Emergency interior lighting</header><text display-inline="yes-display-inline">Emergency interior lighting systems,
			 including luminescent or retroreflectorized delineation of evacuation paths and
			 exits, which are triggered by a crash or other emergency incidents to
			 accomplish more rapid and effective evacuation of passengers.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID631B6C4A7372483FBE226C5A668A9C2E"><enum>(5)</enum><header display-inline="yes-display-inline">Automatic fire suppression</header><text display-inline="yes-display-inline">The Secretary shall evaluate requirements
			 for motorcoaches to be equipped with highly effective fire suppression systems
			 that automatically respond to and suppress all fires in such
			 motorcoaches.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDEEA4D91EA5BC451E9523DD8CCC8801A1"><enum>(b)</enum><header display-inline="yes-display-inline">Performance requirements</header><text display-inline="yes-display-inline">Not later than 3 years after the date of
			 the enactment of this Act, the Secretary shall issue performance requirements
			 for improved fire safety and passenger evacuation based on the results of the
			 evaluations conducted under subsection (a).</text>
			</subsection></section><section changed="added" commented="no" committee-id="SSCM00" display-inline="no-display-inline" id="IDD8DB2CD03EA343F4A9CA4F20430C1D21" reported-display-style="italic" section-type="subsequent-section"><enum>5.</enum><header display-inline="yes-display-inline">Occupant protection and collision avoidance
			 research</header>
			<subsection commented="no" display-inline="no-display-inline" id="ID13838911E00B4AD991F78BCF5531F669"><enum>(a)</enum><header display-inline="yes-display-inline">Safety research initiatives</header><text display-inline="yes-display-inline">Not later than 2 years after the date of
			 the enactment of this Act, the Secretary shall complete research on the
			 following:</text>
				<paragraph commented="no" display-inline="no-display-inline" id="IDAAB9B5E3D3F3444A940F38B196C3D5ED"><enum>(1)</enum><header display-inline="yes-display-inline">Compartmentalization safety
			 countermeasures</header><text display-inline="yes-display-inline">Enhanced
			 compartmentalization safety countermeasures for motorcoaches, including
			 enhanced seating designs, to reduce substantially the risk of passengers being
			 thrown from their seats and colliding with other passengers, interior surfaces,
			 and components in the event of a crash involving a motorcoach.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID85EECC13C5B24260AF1BF97A92AE60D0"><enum>(2)</enum><header display-inline="yes-display-inline">Interior impact protection</header><text display-inline="yes-display-inline">Enhanced occupant impact protection
			 standards for motorcoach interiors to reduce substantially serious injuries for
			 all passengers of motorcoaches.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDE84EE2B743F74EC7990A2BDEB2E6ED47"><enum>(3)</enum><header display-inline="yes-display-inline">Collision avoidance systems</header><text display-inline="yes-display-inline">Forward and lateral crash warning systems
			 applications for motorcoaches.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDD47CA58DDC784D8592FC975388E24EB2"><enum>(b)</enum><header display-inline="yes-display-inline">Standards and regulations</header><text display-inline="yes-display-inline">Not later than 2 years after the completion
			 of each research initiative required under subsection (a), the Secretary shall
			 issue a standard or regulation based on the results of such research.</text>
			</subsection></section><section changed="added" commented="no" committee-id="SSCM00" display-inline="no-display-inline" id="ID301E50C17C384A3BB7ED70B6BAB19A53" reported-display-style="italic" section-type="subsequent-section"><enum>6.</enum><header display-inline="yes-display-inline">New entrants</header>
			<subsection commented="no" display-inline="no-display-inline" id="ID6DCB9EC8BE644865B6618A78E42862A5"><enum>(a)</enum><header display-inline="yes-display-inline">Registration requirements</header><text display-inline="yes-display-inline">Section 13902(b) of title 49, United States
			 Code, is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="id25D6697E475A44B0A6E8DA191B023456"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (1) through (8)
			 as paragraphs (5) through (12), respectively; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id40A8B6EA9DA54373ACFED663457EC6C3"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting before paragraph (5), as
			 redesignated, the following:</text>
					<quoted-block changed="added" committee-id="SSCM00" display-inline="no-display-inline" id="ID99CF3549E55747439783614993406FF2" reported-display-style="italic" style="OLC">

				requirements for providers or motorcoach services</header><text display-inline="yes-display-inline">In addition to meeting the requirements
				under subsection (a)(1), the Secretary may not register a person to provide
				motorcoach services until after such person—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="ID2B2DB442BA57496B97E06202CE4A12CD"><enum>(A)</enum><text display-inline="yes-display-inline">undergoes a preauthorization safety audit,
				including verification, in a manner sufficient to demonstrate the ability to
				comply with Federal rules and regulations, of—</text>
								<clause commented="no" display-inline="no-display-inline" id="ID8CE87687D7DD445F832BA3A887233DD5"><enum>(i)</enum><text display-inline="yes-display-inline">a drug and alcohol testing program under
				part 40 of title 49, Code of Federal Regulations;</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="ID25514D0AAA43431E83046B58EC5CB757"><enum>(ii)</enum><text display-inline="yes-display-inline">the carrier's system of compliance with
				hours-of-service rules, including hours-of-service records;</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="IDF26A1100923445989A82E92E21CD9CD3"><enum>(iii)</enum><text display-inline="yes-display-inline">the ability to obtain required
				insurance;</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="ID9E3B2FAEF308487FB19286EF5AB4BA53"><enum>(iv)</enum><text display-inline="yes-display-inline">driver qualifications, including the
				validity of the commercial driver's license of each driver who will be
				operating under such authority;</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="ID6FFBBD17F2F7436D851FD0963D2D5B70"><enum>(v)</enum><text display-inline="yes-display-inline">disclosure of common ownership, common
				control, common management, common familial relationship, or other corporate
				relationship with another motor carrier or applicant for motor carrier
				authority during the past 3 years;</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="ID4BCDB1CBC62643E6885FE8A9B573E39B"><enum>(vi)</enum><text display-inline="yes-display-inline">records of the State inspections, or of a
				Level I or V Commercial Vehicle Safety Alliance Inspection, for all vehicles
				that will be operated by the carrier;</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="ID70522005347A4F7F9D8864C93C1C73BE"><enum>(vii)</enum><text display-inline="yes-display-inline">safety management programs, including
				vehicle maintenance and repair programs; and</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="ID79B23C4819834E48A5C9A0C4EFF25685"><enum>(viii)</enum><text display-inline="yes-display-inline">the ability to comply with the Americans
				with Disabilities Act of 1990 (42 U.S.C. 12101 et seq.) and the Over-the-Road
				Bus Transportation Accessibility Act of 2007 (49 U.S.C. 10101 note);</text>
								</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDF1193075A10640BBAE80192521647BF2"><enum>(B)</enum><text display-inline="yes-display-inline">has been interviewed to review safety
				management controls and the carrier's written safety oversight policies and
				practices; and</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDF6DB6008F82E47A8A65FF9590B6445F9"><enum>(C)</enum><text display-inline="yes-display-inline">through the successful completion of a
				written examination developed by the Secretary, has demonstrated proficiency to
				comply with and carry out the requirements and regulations described in
				subsection (a)(1).</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID20C6048999014AA1BF3BE43AE51CCA92"><enum>(2)</enum><header display-inline="yes-display-inline">Pre-authorization safety
				audit</header><text display-inline="yes-display-inline">The pre-authorization
				safety audit required under paragraph (1)(A) shall be completed on-site not
				later than 90 days following the submission of an application for operating
				authority.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDB7D36FDB61474FACA61FFE309A41760F"><enum>(3)</enum><header display-inline="yes-display-inline">Fee</header><text display-inline="yes-display-inline">The Secretary may establish, under section
				9701 of title 31, a fee of not more than $1,200 for new registrants that as
				nearly as possible covers the costs of performing a preauthorization safety
				audit. Amounts collected under this subsection shall be deposited in the
				Highway Trust Fund (other than the Mass Transit
				Account).</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDF76B0241A2A1428E96A810003B687C4D"><enum>(b)</enum><header display-inline="yes-display-inline">Safety reviews of new
			 operators</header><text display-inline="yes-display-inline">Section 31144(g)(1)
			 of title 49, United States Code, is amended by inserting <quote>transporting
			 property</quote> after <quote>each operator</quote>.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="IDE73689D3E234456A9B743F6C1A02EFF3"><enum>(c)</enum><header display-inline="yes-display-inline">Effective
			 date</header><text display-inline="yes-display-inline">The amendments made by
			 this section shall take effect 1 year after the date of the enactment of this
			 Act.</text>

				after the date of the enactment of the <short-title>Motorcoach Enhanced Safety Act of 2011</short-title>, the
				Secretary, after notice and opportunity for comment, shall issue regulations
				that—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="idD6C06E6FFB8E434CB3CDCDB045974D85"><enum>(A)</enum><text>provide for the denial,
				suspension, amendment, or revocation of a registration pursuant to paragraph
				(1)(C); and</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id09A8A4615C964C74A865F549839F46C3"><enum>(B)</enum><text>exempt the application of
				paragraph (1)(B) to any person who is unable to pay a civil penalty because
				such person is a debtor in a case under chapter 11 of title
				11.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDEA74F406FB3344C1BD76489E06B6F6F1"><enum>(c)</enum><header display-inline="yes-display-inline">Procedure</header><text display-inline="yes-display-inline">Section 13905(e) of such title is
			 amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="idC65ABD38CCAA4AA4B456E4AAEFC6095A"><enum>(1)</enum><text>by redesignating
			 paragraph (2) as subparagraph (B);</text>

				commercial motor vehicle safety regulations issued under this subchapter,
				chapter 315, or an order of the Secretary issued under this subchapter, chapter
				315, or such regulations.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id53831B23014D4C78BEFC57EBDAB1F42F"><enum>(2)</enum><header>Effect of
				violation</header><text display-inline="yes-display-inline">If the Secretary
				determines that an employer has engaged in any action prohibited under
				paragraph (1), the Secretary shall—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="idC59C96C952FB4431A78FC7DDA071E4F5"><enum>(A)</enum><text display-inline="yes-display-inline">deny, suspend, amend, or revoke all or part
				of such employer's registration under section 13905; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2552976A88834428A18FB7C8968049DE"><enum>(B)</enum><text display-inline="yes-display-inline">take into account such noncompliance for
				purposes of determining the amount of the civil to which the employer is liable
				under section
				521(b)(2)(D).</text>
								</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection></section><section changed="added" commented="no" committee-id="SSCM00" display-inline="no-display-inline" id="IDBBF6CB4475A343A1B1128C8E75E840F5" reported-display-style="italic" section-type="subsequent-section"><enum>8.</enum><header display-inline="yes-display-inline">Improved oversight of motorcoach service
			 providers</header>
			<subsection commented="no" display-inline="no-display-inline" id="ID858FF78221474E4D8262C7B5F2ACA115"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 31144 of title 49, United States
			 Code, is amended by adding at the end the following:</text>
				<quoted-block changed="added" committee-id="SSCM00" display-inline="no-display-inline" id="ID525CF76CE00C4BF8B189DE5A39A2F72F" reported-display-style="italic" style="OLC">
					<subsection commented="no" display-inline="no-display-inline" id="ID20CA98DD042A44F0959C1BDC94D00D5D"><enum>(h)</enum><header display-inline="yes-display-inline">Periodic safety reviews of providers of
				motorcoach services</header>
						<paragraph commented="no" display-inline="no-display-inline" id="IDA234F5A6FF1640DCAF323737A932D5E9"><enum>(1)</enum><header display-inline="yes-display-inline">Safety review</header>
							<subparagraph commented="no" display-inline="no-display-inline" id="ID77BBFE7149604EEABFE8DC49F178691B"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary shall—</text>
								<clause commented="no" display-inline="no-display-inline" id="idE1DE513CAB934B09A7533B5035BD639A"><enum>(i)</enum><text display-inline="yes-display-inline">determine the safety fitness of all
				providers of motorcoach services registered with the Federal Motor Carrier
				Safety Administration; and</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="id74D4942F026A44858074DD453AA5DFEA"><enum>(ii)</enum><text display-inline="yes-display-inline">assign a safety fitness rating to each such
				provider.</text>
								</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID398AF587E16A4A2D96A7BB83E5B4287D"><enum>(B)</enum><header display-inline="yes-display-inline">Applicability</header><text display-inline="yes-display-inline">Subparagraph (A) shall apply—</text>
								<clause commented="no" display-inline="no-display-inline" id="ID054EDCFB423A4463A2DA1B6421FBE8B0"><enum>(i)</enum><text display-inline="yes-display-inline">to any provider of motorcoach services
				registered with the Administration after the date of the enactment of the
				<short-title>Motorcoach Enhanced Safety Act of
				2011</short-title> beginning not later than 2 years after the date of such
				registration; and</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="IDB44D19FA807441CCAD18326C73D159F4"><enum>(ii)</enum><text display-inline="yes-display-inline">to any provider of motorcoach services
				registered with the Administration on or before the date of enactment of that
				Act beginning not later than 3 years after the date of the enactment of such
				Act.</text>
								</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID7CC1ADE4D79040A09289F201463DB1EF"><enum>(2)</enum><header display-inline="yes-display-inline">Periodic review</header><text display-inline="yes-display-inline">The Secretary shall establish, by
				regulation, a process for monitoring the safety performance of each provider of
				motorcoach services on a regular basis following the assignment of a safety
				fitness rating, including progressive intervention to correct unsafe
				practices.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDA0DC1E2CE8B14E498DBA620541DE478B"><enum>(3)</enum><header display-inline="yes-display-inline">Enforcement strike forces</header><text display-inline="yes-display-inline">In addition to the enhanced monitoring and
				enforcement actions required under paragraph (2), the Secretary may organize
				special enforcement strike forces targeting providers of motorcoach
				services.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDD0E6AD987E674A508B36527E6E575E18"><enum>(4)</enum><header display-inline="yes-display-inline">Periodic update of safety fitness
				rating</header><text display-inline="yes-display-inline">In conducting the
				safety reviews required under this subsection, the Secretary shall reassess the
				safety fitness rating of each provider not less frequently than once every 3
				years.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID0C36FB82A4B04F07A23403F86594D20A"><enum>(5)</enum><header display-inline="yes-display-inline">Motorcoach services defined</header><text display-inline="yes-display-inline">In this subsection, the term <term>provider
				of motorcoach services</term> has the meaning given such term in section 2 of
				the <short-title>Motorcoach Enhanced Safety Act of
				2011</short-title>.</text>
						</paragraph></subsection><after-quoted-block></after-quoted-block></quoted-block>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID4046663A75E340BF913895ECA3C6E98D"><enum>(b)</enum><header display-inline="yes-display-inline">Revision of safety fitness rating
			 methodology</header><text display-inline="yes-display-inline">Not later than 1
			 year after the date of the enactment of this Act, the Secretary shall revise
			 the safety fitness rating methodology of the Department of Transportation
			 established pursuant to section 31144 of title 49, United States Code, to meet
			 the goals of the safety recommendation H–99–6 of the National Transportation
			 Safety Board, which was issued on February 26, 1999.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="IDD023512D8D6F427F95381C71D1F2B6F0"><enum>(c)</enum><header display-inline="yes-display-inline">High risk carrier compliance
			 reviews</header><text display-inline="yes-display-inline">Section 4138 of
			 SAFETEA–LU (49 U.S.C. 31144 note) is amended by striking <quote>is rated as
			 category A or B for 2 consecutive months.</quote> and inserting <quote>meets
			 the Safety Measurement System criteria for being a high risk motor carrier for
			 2 consecutive months.</quote>.</text>
			</subsection></section><section changed="added" commented="no" committee-id="SSCM00" display-inline="no-display-inline" id="ID18D0C599067B4263B46703E24A12E05C" reported-display-style="italic" section-type="subsequent-section"><enum>9.</enum><header display-inline="yes-display-inline">Motorcoach driver training</header>
			<subsection commented="no" display-inline="no-display-inline" id="IDC12216637A224DF7B0A4AFE8D9F38589"><enum>(a)</enum><header display-inline="yes-display-inline">Establishment of training
			 curriculum</header>
				<paragraph commented="no" display-inline="no-display-inline" id="IDF2EB67753920440D99D3072A02F522CD"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 6 months after the date of
			 the enactment of this Act, the Secretary shall establish, by regulation,
			 minimum curricular requirements for entry-level drivers of motorcoaches and
			 drivers upgrading from 1 class of commercial driver's license to another class,
			 which shall be adopted by public and private schools and motor carriers and
			 motorcoach operators that provide training for such drivers.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID2B0EE84AC87444DAB070D5BB93F5D357"><enum>(2)</enum><header display-inline="yes-display-inline">Curricular requirements</header><text display-inline="yes-display-inline">The curricular requirements under paragraph
			 (1) shall include—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="IDF2742302DC24460292835E8A1D538847"><enum>(A)</enum><text display-inline="yes-display-inline">classroom and behind-the-wheel instruction
			 that is adequate for training entry-level drivers of motorcoaches and drivers
			 upgrading from 1 class of commercial driver's license to another class to
			 safely operate motorcoaches and respond effectively to emergency situations;
			 and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID3C7DA65DD82C45BDBCA6D71DE2BB2AD9"><enum>(B)</enum><text display-inline="yes-display-inline">instruction in advanced knowledge and
			 skills that are necessary to operate motorcoaches safely, including knowledge
			 and skills necessary—</text>
						<clause commented="no" display-inline="no-display-inline" id="ID224252AC51E9497B85442BD437713DAF"><enum>(i)</enum><text display-inline="yes-display-inline">to suppress motorcoach fires; and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="ID6B8621FC022E467D91C44E5C4E28AC9D"><enum>(ii)</enum><text display-inline="yes-display-inline">to evacuate passengers from motorcoaches
			 safely.</text>
						</clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID679686CF6FD34F63A6DF14D89F0B2888"><enum>(b)</enum><header display-inline="yes-display-inline">Training required</header>
				<paragraph commented="no" display-inline="no-display-inline" id="IDF9282FF8829045FAB90D2826EC2EF2C7"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary shall require each motorcoach
			 driver seeking a commercial driver's license passenger endorsement to undergo a
			 training program that includes the minimum curricular requirements established
			 under subsection (a) before taking a test for a commercial driver's license
			 passenger endorsement.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID0C43E4B3D0724C0CB1F5791F269B9D89"><enum>(2)</enum><header display-inline="yes-display-inline">Verification required</header><text display-inline="yes-display-inline">The Secretary shall require that—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="ID2EC6804B4D4D4BF9881E7A4FA8A2CD08"><enum>(A)</enum><text display-inline="yes-display-inline">each trainer of a driver seeking a
			 commercial driver's license passenger endorsement shall submit to the
			 appropriate State licensing authority information on any driver that has
			 successfully completed a motorcoach driver training course that includes the
			 curricular requirements established under subsection (a); and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID6FDB226167FC41C5B0C90C1DD10882F3"><enum>(B)</enum><text display-inline="yes-display-inline">the State licensing authority may not
			 administer the skills test for the passenger endorsement nor issue a passenger
			 endorsement to a driver unless the State licensing authority verifies that the
			 driver has successfully completed a motorcoach driver training course required
			 under subparagraph (A).</text>
					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID26F44FD891B341BDAAF7384F770ABE76"><enum>(c)</enum><header display-inline="yes-display-inline">Report on feasibility, benefits, and costs
			 of establishing a system of certification of training programs</header><text display-inline="yes-display-inline">Not later than 2 years after the date of
			 the enactment of this Act, the Secretary shall submit a report to the
			 <committee-name committee-id="SSCM00">Committee on Commerce, Science, and
			 Transportation of the Senate</committee-name> and the
			 <committee-name committee-id="">Committee on Transportation and Infrastructure
			 of the House of Representatives</committee-name>that describes the feasibility,
			 benefits, and costs of establishing a system of certification of public and
			 private schools and of motor carriers and motorcoach operators that provide
			 motorcoach driver training in accordance with the curricular requirements
			 established by the Secretary under subsection (a).</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID49D5648240CD403F884F76B857071230"><enum>(d)</enum><header display-inline="yes-display-inline">Nonpreemption of state
			 programs</header><text display-inline="yes-display-inline">The minimum
			 curricular requirements required under this section shall not preempt any State
			 or local law or regulation imposing additional or more stringent requirements
			 unless the Secretary determines that—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="IDC2246BBE9EF74826B70C6BEEE240F771"><enum>(1)</enum><text display-inline="yes-display-inline">the law or regulation is incompatible with
			 the regulation prescribed by the Secretary; or</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDE14D61A8EB3F4EEA86F8A528819D1913"><enum>(2)</enum><text display-inline="yes-display-inline">enforcement of the State law or the local
			 law or regulation would impose an unreasonable burden on interstate
			 commerce.</text>
				</paragraph></subsection></section><section changed="added" commented="no" committee-id="SSCM00" display-inline="no-display-inline" id="ID7318D9A1468A4E21B5A36789CAC4BCDB" reported-display-style="italic" section-type="subsequent-section"><enum>10.</enum><header display-inline="yes-display-inline">Improved testing for the commercial
			 driver's license passenger endorsement</header>
			<subsection commented="no" display-inline="no-display-inline" id="ID5F18E7F4960B4A489FB4436FE5B0D1EF"><enum>(a)</enum><header display-inline="yes-display-inline">Increased stringency of examination for
			 commercial driver's license passenger-carrying endorsement</header><text display-inline="yes-display-inline">Not later than 6 months after the date of
			 the enactment of this Act, the Secretary, in consultation with the American
			 Association of Motor Vehicle Administrators, shall issue a final rule in Docket
			 No. FMCSA 2007–27659: <italic>Commercial Driver's License Testing and
			 Commercial Learner's Permit Standards</italic> that—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="id6D3992C8C39142CFAD45E42CBC3FA887"><enum>(1)</enum><text display-inline="yes-display-inline">improves the quality and stringency of the
			 examination for the commercial driver's license passenger-carrying
			 endorsement;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID53E1E7FF999444629AEECD05B020D054"><enum>(2)</enum><text display-inline="yes-display-inline">requires a more stringent knowledge test
			 than the test in effect on the day before the date of enactment of this Act;
			 and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDBDDDC677C65140548554569ABC48175D"><enum>(3)</enum><text display-inline="yes-display-inline">requires a more stringent examination of
			 the driving skills necessary to operate safely a for-hire passenger-carrying
			 commercial motor vehicle than the examination of such skills in effect on the
			 day before the date of the enactment of this Act.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID0E70688A47FA4D0EA6906189FBF53BA2"><enum>(b)</enum><header display-inline="yes-display-inline">Report on driver's license requirements for
			 9-to-15 passenger vans</header><text display-inline="yes-display-inline">Not
			 later than 18 months after the date of the enactment of this Act, the Secretary
			 shall submit a plan to the <committee-name committee-id="SSCM00">Committee on
			 Commerce, Science, and Transportation of the Senate</committee-name> and the
			 <committee-name committee-id="">Committee on Transportation and Infrastructure
			 of the House of Representatives</committee-name> for requiring that all or
			 certain classes of drivers—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="IDE9EA5FD739024BBFBDF35083E97B9510"><enum>(1)</enum><text display-inline="yes-display-inline">have a commercial driver's license
			 passenger-carrying endorsement in order to operate a commercial motor vehicle
			 (as defined in section 31301(4) of title 49, United States Code) and transport
			 not less than 9 and not more than 15 passengers (including a driver) in
			 interstate commerce; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID6227EB4A413144859D7A9E2273D0AEEB"><enum>(2)</enum><text display-inline="yes-display-inline">be tested in accordance with a drug and
			 alcohol testing program under part 40 of title 49, Code of Federal
			 Regulations.</text>
				</paragraph></subsection></section><section changed="added" commented="no" committee-id="SSCM00" display-inline="no-display-inline" id="IDC904017CCD71447CA63EF5280DD4BC1C" reported-display-style="italic" section-type="subsequent-section"><enum>11.</enum><header display-inline="yes-display-inline">Improved physical fitness oversight and
			 commercial driver medical certificates</header>
			<subsection commented="no" display-inline="no-display-inline" id="IDD64BE601351145E1803F0F076FDF4579"><enum>(a)</enum><header display-inline="yes-display-inline">Medical review board
			 functions</header><text display-inline="yes-display-inline">Section 31149(a)(1)
			 of title 49, United States Code, is amended—</text>

				criteria to be used for evaluating medical examiners for admission to the
				national registry established under this
				section.</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID032A368C00474924B2F23540FFF9E7C4"><enum>(b)</enum><header display-inline="yes-display-inline">Examination requirements for listing in the
			 national registry of medical examiners</header><text display-inline="yes-display-inline">Section 31149(c)(1)(D) of title 49, United
			 States Code, is amended to read as follows:</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="ID9BA03A7C4EF9465C997A836D134C70AC"><enum>(D)</enum><text display-inline="yes-display-inline">develop requirements applicable to a
				medical examiner seeking to be listed in the national registry,
				including—</text>
						<clause commented="no" display-inline="no-display-inline" id="ID827F65ABDE5D47D39BA926152DE27F74"><enum>(i)</enum><text display-inline="yes-display-inline">specific courses and materials that must be
				completed to be listed in the national registry;</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="ID2529AEED7EF8442CB54818CD2417E5FE"><enum>(ii)</enum><text display-inline="yes-display-inline">a rigorous written examination for which a
				passing grade must be achieved to be listed in the national registry;</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="ID7FCC8F2DF78A471BBA7463602B7939A2"><enum>(iii)</enum><text display-inline="yes-display-inline">certification (including
				self-certification), as appropriate, to verify that the medical examiner has
				completed training, including refresher courses, that the Secretary determines
				are necessary to be listed in the national registry; and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="IDA4B1F28D4128415A97D61A1B81725888"><enum>(iv)</enum><text display-inline="yes-display-inline">demonstration of the willingness and
				ability of a medical examiner to comply with any reporting requirements
				established by the
				Secretary;</text>
						</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID8268E3C55DA1446FA22C3FF2652AFF57"><enum>(c)</enum><header display-inline="yes-display-inline">Medical examination form
			 comparisons</header><text display-inline="yes-display-inline">Not later than 18
			 months after the date of the enactment of this Act, the Secretary shall
			 require, by regulation, that each time a medical examiner performs a medical
			 examination to certify an applicant for a commercial driver's license under
			 section 391.43 of title 49, Code of Federal Regulations, such medical examiner
			 shall submit to the appropriate State licensing agency the form for such
			 examination required by section 391.43(f) of such title (as in effect on the
			 day before the date of the enactment of this Act).</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="IDD059DA7675BC44C880C282EA0E7C96F0"><enum>(d)</enum><header display-inline="yes-display-inline">State plan requirement</header><text display-inline="yes-display-inline">Section 31102(b)(1) of title 49, United
			 States Code, is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="ID9867151AF2434135AA15A7D86D2A5375"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (W), by striking
			 <quote>and</quote> at the end; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID10DE126C1BAF4757B6B30E0074A5B941"><enum>(2)</enum><text display-inline="yes-display-inline">in subparagraph (X), by striking the period
			 at the end and inserting the following: "; and</text>
					<quoted-block changed="added" committee-id="SSCM00" display-inline="no-display-inline" id="IDF6608D92375649B5A10DEA81BABB1239" reported-display-style="italic" style="OLC">

				compare the forms they receive pursuant to section 11(c) of the
				<short-title>Motorcoach Enhanced Safety Act of
				2011</short-title> with the medical examiner's certificate required under
				section 391.43(g) of title 49, Code of Federal Regulations (as in effect on the
				day before the date of enactment of that Act), to determine the accuracy and
				validity of the information contained in such forms and
				certificates.</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID83D34291455345DE98C6A9CCB9F6F340"><enum>(e)</enum><header display-inline="yes-display-inline">Additional oversight of licensing
			 authorities</header>
				<paragraph commented="no" display-inline="no-display-inline" id="IDFAC7989776B744D386E1D2FEB0678220"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 31149(c)(1) of title 49, United
			 States Code, is amended—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="ID77544CA2F369457B86AD1C696340606C"><enum>(A)</enum><text display-inline="yes-display-inline">in subparagraph (E), by striking
			 <quote>and</quote> at the end; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID2CB3040F9AA34D96B9F9F56EA38A5319"><enum>(B)</enum><text display-inline="yes-display-inline">in subparagraph (F), by striking the period
			 at the end and inserting the following: "; and</text>

				of 10 States to assess the accuracy, validity, and timeliness of physical
				examination reports and medical certificates submitted by certified medical
				examiners to such State licensing agencies and the processing of such
				submissions by the licensing
				authorities.</text>
							</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID6C43BB6B8D3647C3914F90BE0C81A21C"><enum>(2)</enum><header display-inline="yes-display-inline">Internal oversight policy</header>
					<subparagraph commented="no" display-inline="no-display-inline" id="IDC4DD9FEBEACE407D887E2518ABFF8493"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the
			 enactment of this Act, the Secretary shall establish an oversight policy and
			 process within the Department of Transportation for purposes of carrying out
			 the requirement under section 31149(c)(1)(G) of title 49, United States Code,
			 as added by paragraph (1).</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDAB29B6C0FCBD46CBAC12C8A7CC169642"><enum>(B)</enum><header display-inline="yes-display-inline">Effective
			 date</header><text display-inline="yes-display-inline">The requirement under
			 section 31149(c)(1)(G) of title 49, United States Code, shall take effect on
			 the date on which the oversight policies and processes are established pursuant
			 to subparagraph (A).</text>
					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID0BB92A3BBA7F4373886667E28442BA64"><enum>(f)</enum><header display-inline="yes-display-inline">Deadline for establishment of national
			 registry of medical examiners</header><text display-inline="yes-display-inline">Not later than 6 months after the date of
			 the enactment of this Act, the Secretary shall establish a national registry of
			 medical examiners in accordance with section 31149(d)(1) of title 49, United
			 States Code.</text>
			</subsection></section><section changed="added" commented="no" committee-id="SSCM00" display-inline="no-display-inline" id="ID8DBB96A011B3455DA0F759298CDFCE8A" reported-display-style="italic" section-type="subsequent-section"><enum>12.</enum><header display-inline="yes-display-inline">Safety and enforcement technology for
			 motorcoaches</header>
			<subsection commented="no" display-inline="no-display-inline" id="ID414C86458A3A4FC8B20F6990349957F8"><enum>(a)</enum><header display-inline="yes-display-inline">Electronic on-board recorders</header>
				<paragraph commented="no" display-inline="no-display-inline" id="ID3D6F7322EF4144EB83D42C30A95EBA87"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header>
					<subparagraph commented="no" display-inline="no-display-inline" id="IDD3E81AB3C4BB4E248EC1245AF84C3290"><enum>(A)</enum><header>Rulemaking</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the
			 enactment of this Act, the Secretary shall prescribe regulations requiring that
			 all motorcoaches used by a motor carrier in interstate commerce be equipped
			 with electronic on-board recorders.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID27543D57CF5E45BFB2DAC857CF02AD26"><enum>(B)</enum><header>Performance
			 requirements</header><text display-inline="yes-display-inline">The regulations
			 prescribed by the Secretary under this section shall include performance
			 requirements to ensure that electronic on-board recorders—</text>
						<clause commented="no" display-inline="no-display-inline" id="ID4498B1FB86BA4217977D21066F95C858"><enum>(i)</enum><text display-inline="yes-display-inline">accurately record commercial driver hours
			 of service;</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="ID14044AA2207E489C89BDB71AD31D223C"><enum>(ii)</enum><text display-inline="yes-display-inline">allow tracking of driver and vehicle
			 location; and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="ID2A3B57B0990D48908A98730AC391DCDC"><enum>(iii)</enum><text display-inline="yes-display-inline">are tamper resistant.</text>
						</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID06A19EF034D84ACC8D9AD42D71C8B7EB"><enum>(2)</enum><header display-inline="yes-display-inline">Applicability</header><text display-inline="yes-display-inline">The regulations prescribed under paragraph
			 (1) shall apply to all motorcoaches described in such paragraph beginning on
			 the date that is 2 years after the date on which the regulation is published as
			 a final rule.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID82DF8A106A514C1981D108D932D56F1F"><enum>(b)</enum><header display-inline="yes-display-inline">Event data recorders</header>
				<paragraph commented="no" display-inline="no-display-inline" id="IDF385BC2393354529BF3CFCCDDAD0D536"><enum>(1)</enum><header display-inline="yes-display-inline">Evaluation</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the
			 enactment of this Act, the Secretary, after considering the performance
			 requirements for event data recorders for passenger vehicles under part 563 of
			 title 49, Code of Federal Regulations, shall complete an evaluation of event
			 data recorders, including requirements regarding specific types of vehicle
			 operations, events and incidents, and systems information to be recorded, for
			 event data recorders to be used on motorcoaches used by motor carriers in
			 interstate commerce.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDC9BF88A2EE3540D198E754B8447E868A"><enum>(2)</enum><header display-inline="yes-display-inline">Standards and regulations</header><text display-inline="yes-display-inline">Not later than 2 years after completing the
			 evaluation required under paragraph (1), the Secretary shall issue standards
			 and regulations based on the results of that evaluation.</text>
				</paragraph></subsection></section><section changed="added" commented="no" committee-id="SSCM00" display-inline="no-display-inline" id="IDF1E92E2117F84F5CBCD1AE64B6D2160A" reported-display-style="italic" section-type="subsequent-section"><enum>13.</enum><header display-inline="yes-display-inline">Safety inspection program for commercial
			 motor vehicles of passengers</header><text display-inline="no-display-inline">Not later than 3 years after the date of the
			 enactment of this Act, the Secretary shall complete a rulemaking proceeding to
			 consider requiring States to conduct annual inspections of commercial motor
			 vehicles designed or used to transport passengers, including an assessment
			 of—</text>
			<paragraph commented="no" display-inline="no-display-inline" id="ID2F186D90BDCD4C7997801554E041FB2E"><enum>(1)</enum><text display-inline="yes-display-inline">the risks associated with improperly
			 maintained or inspected commercial motor vehicles designed or used to transport
			 passengers;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDDEF7E37C79394E0F9BEFAF6F31715D69"><enum>(2)</enum><text display-inline="yes-display-inline">the effectiveness of existing Federal
			 standards for the inspection of such vehicles in—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="id8A17E73763FC4ED48C8D081211454FE3"><enum>(A)</enum><text display-inline="yes-display-inline">mitigating the risks described in paragraph
			 (1); and</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6E4B6D4820704D39A46680BD58326CA7"><enum>(B)</enum><text display-inline="yes-display-inline">ensuring the safe and proper operation
			 condition of such vehicles; and</text>
				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID4F0365DDD9CC404E824185D95BED2D1F"><enum>(3)</enum><text display-inline="yes-display-inline">the costs and benefits of a mandatory State
			 inspection program.</text>
			</paragraph></section><section changed="added" commented="no" committee-id="SSCM00" display-inline="no-display-inline" id="ID030892190E9A428F931D4DB04ED1A0E9" reported-display-style="italic" section-type="subsequent-section"><enum>14.</enum><header display-inline="yes-display-inline">Distracted driving</header>
			<subsection commented="no" display-inline="no-display-inline" id="IDF93FE3BD250249D88B430A0BD158D824"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subchapter III of chapter 311 of title 49,
			 United States Code, is amended by adding at the end the following:</text>
				<quoted-block changed="added" committee-id="SSCM00" display-inline="no-display-inline" id="ID881FA3D26E71494498F785187B95BAAC" reported-display-style="italic" style="USC">
					<section commented="no" display-inline="no-display-inline" id="idD8090F0DA60B4C8A8EB9699B8AFAB813" section-type="subsequent-section"><enum>31152.</enum><header>Regulation of the
				use of distracting devices in motorcoaches</header>
						<subsection commented="no" display-inline="no-display-inline" id="IDEF261884F9C4485C86485792100C2780"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the
				enactment of the <short-title>Motorcoach Enhanced Safety
				Act of 2011</short-title>, the Secretary of Transportation shall prescribe
				regulations on the use of electronic or wireless devices, including cell phones
				and other distracting devices, by an individual employed as the operator of a
				motorcoach (as defined in section 2(8) of such Act).</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="ID3B138EF00E3B4C068337FDF26070D1B6"><enum>(b)</enum><header display-inline="yes-display-inline">Basis for regulations</header><text display-inline="yes-display-inline">The Secretary shall base the regulations
				prescribed under subsection (a) on accident data analysis, the results of
				ongoing research, and other information, as appropriate.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="ID47E26AF3367A4BD0BCBF3A9B991C1E6C"><enum>(c)</enum><header display-inline="yes-display-inline">Prohibited
				use</header><text display-inline="yes-display-inline">Except as provided under
				subsection (d), the Secretary shall prohibit the use of the devices described
				in subsection (a) in circumstances in which the Secretary determines that their
				use interferes with the driver's safe operation of a motorcoach.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="IDB9484CC4D2B54615891AA1AB52941AB3"><enum>(d)</enum><header display-inline="yes-display-inline">Permitted use</header><text display-inline="yes-display-inline">The Secretary may permit the use of a
				device that is otherwise prohibited under subsection (c) if the Secretary
				determines that such use is necessary for the safety of the driver or the
				public in emergency
				circumstances.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID705C401DE360498CB4A68EA34747E264"><enum>(b)</enum><header display-inline="yes-display-inline">Conforming amendment</header><text display-inline="yes-display-inline">The table of contents for chapter 311 of
			 title 49, United States Code, is amended by inserting after the item relating
			 to section 31151 the following:</text>

			 companies</header><text display-inline="no-display-inline">Section 31132(3) of
			 title 49, United States Code, is amended to read as follows:</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="ID0FF5F56DE7914D658B76F71D1083A366"><enum>(A)</enum><text display-inline="yes-display-inline">means a person engaged in a business
				affecting interstate commerce that—</text>
						<clause commented="no" display-inline="no-display-inline" id="IDBA25C311327449D6A382C53766FE6FCA"><enum>(i)</enum><text display-inline="yes-display-inline">owns or leases a commercial motor vehicle
				in connection with that business, or assigns and employee to operate it;
				or</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="IDD801177966CC47CFB581B0EBE340E94A"><enum>(ii)</enum><text display-inline="yes-display-inline">offers for rent or lease motor vehicles
				designed or used to transport more than 15 passengers, including the driver,
				and from the same location or as part of the same business provides names or
				contact information of drivers, arranges for a driver of the rented or leased
				passenger-carrying motor vehicle, or holds itself out to the public as a
				provider of transportation services; and</text>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID72A19B910CF949508B3681823291F263"><enum>(B)</enum><text display-inline="yes-display-inline">does not include an individual who is an
				employee of the United States Government, a State, or a political subdivision
				of a State acting in the course of that individual's employment as such an
				employee.</text>
					</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
