		<official-title display="yes">To amend the Public Health Service Act to
		  improve women’s health by prevention, diagnosis, and treatment of heart
		  disease, stroke, and other cardiovascular diseases in women.</official-title>

	<legis-body display-enacting-clause="yes-display-enacting-clause" id="HDAEE079B7ECB47958B95E325546527AB" style="OLC">
		<section display-inline="no-display-inline" id="HC68085B884444FC490731B5DE1465E0E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Heart Disease Education, Analysis,
			 Research, and Treatment for Women Act</short-title></quote> or the
			 <quote><short-title>HEART for Women
			 Act</short-title></quote>.</text>
		</section><section id="H45C0769D4A5741769323DB25D623894F"><enum>2.</enum><header>Reporting of data
			 in applications for drugs, biologics, and devices</header>
			<subsection id="HB03250BC738543059030E648FEE447F5"><enum>(a)</enum><header>In
			 General</header><text display-inline="yes-display-inline">The Comptroller
			 General of the United States shall conduct a study investigating the extent to
			 which sponsors of clinical studies of investigational drugs, biologics, and
			 devices and sponsors of applications for approval or licensure of new drugs,
			 biologics, and devices comply with Food and Drug Administration requirements
			 and follow guidance for presentation of clinical study safety and effectiveness
			 data by sex, age, and racial subgroups.</text>
			</subsection><subsection id="H6C611ABD00624878A8470AC03D59C275"><enum>(b)</enum><header>Report by
			 GAO</header>
				<paragraph id="HFD600430660F464FB4329A21628F9252"><enum>(1)</enum><header>Submission</header><text>Not
			 later than 12 months after the date of the enactment of this Act, the
			 Comptroller General shall complete the study under subsection (a) and submit to
			 the Committee on Energy and Commerce of the House of Representatives and the
			 Committee on Health, Education, Labor, and Pensions of the Senate a report on
			 the results of such study.</text>
				</paragraph><paragraph id="H3D3B268137A941689B6F1EB2399B6DEF"><enum>(2)</enum><header>Contents</header><text>The
			 report required by paragraph (1) shall include each of the following:</text>
					<subparagraph id="HCF16E86ACE8040B1B12A0D859C8C101A"><enum>(A)</enum><text>A description of
			 the extent to which the Food and Drug Administration assists sponsors in
			 complying with the requirements and following the guidance referred to in
			 subsection (a).</text>
					</subparagraph><subparagraph id="H938F83B7D6B44AC08BE0E1DA9E525197"><enum>(B)</enum><text>A description of
			 the effectiveness of the Food and Drug Administration’s enforcement of
			 compliance with such requirements.</text>
					</subparagraph><subparagraph id="H64D267CBA522489B984D3AAEBD1755D6"><enum>(C)</enum><text>An analysis of the
			 extent to which females, racial and ethnic minorities, and adults of all ages
			 are adequately represented in Food and Drug Administration-approved clinical
			 studies (at all phases) so that product safety and effectiveness data can be
			 evaluated by gender, age, and racial subgroup.</text>
					</subparagraph><subparagraph id="H5A792AE151E34939B0236B369DF8A88C"><enum>(D)</enum><text>An analysis of the
			 extent to which a summary of product safety and effectiveness data
			 disaggregated by sex, age, and racial subgroup is readily available to the
			 public in a timely manner by means of the product label or the Food and Drug
			 Administration’s Website.</text>
					</subparagraph><subparagraph id="H71606CF9C9FE4C96A0F8FB073F2DB267"><enum>(E)</enum><text>Appropriate
			 recommendations for—</text>
						<clause id="H64E98E84F8D0435C825B94EC8954456E"><enum>(i)</enum><text>modifications to
			 the requirements and guidance referred to in subsection (a); or</text>
						</clause><clause id="H7B4A3191A6AD4BB383C78A66D031F198"><enum>(ii)</enum><text>oversight by the
			 Food and Drug Administration of such requirements.</text>
						</clause></subparagraph></paragraph></subsection><subsection id="HA214C782B0B140C7A95D1EF9025C1F48"><enum>(c)</enum><header>Report by
			 HHS</header><text display-inline="yes-display-inline">Not later than 6 months
			 after the submission by the Comptroller General of the report required under
			 subsection (b), the Secretary of Health and Human Services shall submit to the
			 Committee on Energy and Commerce of the House of Representatives and the
			 Committee on Health, Education, Labor, and Pensions of the Senate a response to
			 that report, including a corrective action plan as needed to respond to the
			 recommendations in that report.</text>
			</subsection><subsection id="idC71ABD8E13424EFBB4F82777DBBFD5A2"><enum>(d)</enum><header>Biennial
			 reports by the Food and Drug Administration</header><text display-inline="yes-display-inline">Not later than 2 years after the date of
			 enactment of this Act, and every 2 years thereafter—</text>
				<paragraph id="idF0DCA84F2D114EF0A6852C8913E56DFB"><enum>(1)</enum><text display-inline="yes-display-inline">the Director of the Office of Women's
			 Health of the Food and Drug Administration shall submit to the Committee on
			 Energy and Commerce of the House of Representatives and the Committee on
			 Health, Education, Labor, and Pensions of the Senate, a report that includes
			 each of the elements described in subparagraphs (A) through (E) of subsection
			 (b)(2), with respect to women's health; and</text>
				</paragraph><paragraph id="id1B35F6A6EE5547D8ABA61FF9549ACDA5"><enum>(2)</enum><text>the Director of
			 the Office of Minority Health of the Food and Drug Administration shall submit
			 to such Committees a report that includes each of such elements, with respect
			 to minority health.</text>
				</paragraph></subsection><subsection id="H86AF66AC8AF04A9BB991B91C464A3C40"><enum>(e)</enum><header>Definitions</header><text>In
			 this section:</text>
				<paragraph id="HC33D5541A34F412F84C06912AC6FCA54"><enum>(1)</enum><text>The term
			 <term>biologic</term> has the meaning given to the term <quote>biological
			 product</quote> in section 351(i) of the Public Health Service Act (42 U.S.C.
			 262(i)).</text>
				</paragraph><paragraph id="HE5F847D9344D47D4BBD69FA6F5CDDDC6"><enum>(2)</enum><text>The term
			 <term>device</term> has the meaning given to such term in section 201(h) of the
			 Federal Food, Drug, and Cosmetic Act (21 U.S.C. 321(h)).</text>
				</paragraph><paragraph id="HF6FBD10133354F2DB4D882035F812964"><enum>(3)</enum><text>The term
			 <term>drug</term> has the meaning given to such term in section 201(g) of the
			 Federal Food, Drug, and Cosmetic Act (21 U.S.C. 321(g)).</text>
				</paragraph></subsection></section><section commented="no" id="H6396D8E8999E402C83EE2768F52350B2"><enum>3.</enum><header>Reporting on
			 quality of and access to care for women with cardiovascular
			 diseases</header><text display-inline="no-display-inline">Part P of title III
			 of the Public Health Service Act (42 U.S.C. 280g et seq.) is amended by adding
			 at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="H39551D1D73D04AA1A779CE6FF7D76E99" style="OLC">
				<section commented="no" id="H71F2D373C1C24A21B811C55AE0ADBA41"><enum>399V–6.</enum><header>Reporting on
				quality of and access to care for women with cardiovascular
				diseases</header><text display-inline="no-display-inline">Not later than
				September 30, 2014, and annually thereafter, the Secretary shall prepare and
				submit to the Congress a report on the quality of and access to care for women
				with heart disease, stroke, and other cardiovascular diseases. The report shall
				contain recommendations for eliminating disparities in, and improving the
				treatment of, heart disease, stroke, and other cardiovascular diseases in
				women.</text>
				</section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section commented="no" display-inline="no-display-inline" id="HBDDB7C61516B42E1937B7F45A557B79B" section-type="subsequent-section"><enum>4.</enum><header>Extension of WISEWOMAN
			 program</header>
			<subsection commented="no" display-inline="no-display-inline" id="id12DCE1E62ED94C0DAE1BB44B4E58DB4D"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 1509 of the
			 Public Health Service Act (42 U.S.C. 300n–4a) is amended—</text>
				<paragraph commented="no" id="H27CCF12B0FE541DF931A7CAC5299883E"><enum>(1)</enum><text>in subsection
			 (a)—</text>
					<subparagraph id="H1D1258C4AE9A450C8FA527ADC0012A2B"><enum>(A)</enum><text>by striking the
			 heading and inserting <quote><header-in-text level="subsection" style="OLC">In
			 general.—</header-in-text></quote>; and</text>
					</subparagraph><subparagraph id="HCD96EC4BFE8847CA83C89EE569B6A6F9"><enum>(B)</enum><text>in the matter
			 preceding paragraph (1), by striking <quote>may make grants</quote> and all
			 that follows through <quote>purpose</quote> and inserting the following:
			 <quote>may make grants to such States for the purpose</quote>; and</text>
					</subparagraph></paragraph><paragraph commented="no" id="idDE60324D3F8D4BE7BDC27C1DBE23A0DA"><enum>(2)</enum><text>in subsection
			 (d)(1), by striking <quote>there are authorized</quote> and all that follows
			 through the period and inserting <quote>there are authorized to be appropriated
			 $23,000,000 for fiscal year 2012, $25,300,000 for fiscal year 2013, $27,800,000
			 for fiscal year 2014, $30,800,000 for fiscal year 2015, and $34,000,000 for
			 fiscal year 2016.</quote>.</text>
				</paragraph></subsection><subsection commented="no" id="idBEB0595F018840D0A259F15080895625"><enum>(b)</enum><header>Study</header>
				<paragraph id="IDbed6e0f890a3498bbde24769356e994d"><enum>(1)</enum><header>In
			 general</header><text>The Secretary of Health and Human Services shall
			 (directly or through grants or contracts) conduct a study of the impact of the
			 Patient Protection and Affordable Care Act (Public Law 111–148) on the
			 preventive health services, referrals, and follow-up services authorized under
			 section 1509 of the Public Health Service Act (42 U.S.C. 300n–4a), as amended
			 by this section.</text>
				</paragraph><paragraph id="ID073701c613a04d1fa7d3ee84d34b1bdd"><enum>(2)</enum><header>Report</header><text>Not
			 later than 18 months after the date of enactment of this Act, the Secretary of
			 Health and Human Services shall complete the study required by paragraph (1)
			 and submit a report to the Committee on Energy and Commerce of the House of
			 Representatives and to the Committee on Health, Education, Labor, and Pensions
			 of the Senate containing the results of the study and recommendations for
			 improving the provision of services to eligible women authorized under such
			 section 1509.</text>
				</paragraph></subsection></section></legis-body>
