		<section changed="deleted" committee-id="SSJU00" id="id0b6dd86b-29e2-4ade-b470-43911940b372" reported-display-style="strikethrough" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Public Corruption Prosecution
			 Improvements Act</short-title></quote>.</text>
		</section><section changed="deleted" committee-id="SSJU00" id="ide8e1ceef-60dd-42c1-a23c-3248c2edd3b4" reported-display-style="strikethrough"><enum>2.</enum><header>Extension of
			 statute of limitations for serious public corruption offenses</header>
			<subsection id="id9a5fe56d-dc05-4f77-a56a-b5ff8a55e241"><enum>(a)</enum><header>In
			 general</header><text>Chapter 213 of title 18, United States Code, is amended
			 by adding at the end the following:</text>
				<quoted-block changed="deleted" committee-id="SSJU00" display-inline="no-display-inline" id="id71cdc711-1c49-4fcf-9b14-8433f22425de" reported-display-style="strikethrough" style="USC">
					<section id="id31fa2f3e-ebe2-40c3-877d-ad13767f7116"><enum>3299A.</enum><header>Corruption
				offenses</header><text display-inline="no-display-inline">Unless an indictment
				is returned or the information is filed against a person within 6 years after
				the commission of the offense, a person may not be prosecuted, tried, or
				punished for a violation of, or a conspiracy or an attempt to violate the
				offense in—</text>
						<paragraph id="id2b797053-19de-4542-b937-9c058e28ed2f"><enum>(1)</enum><text>section 201 or
				666;</text>
						</paragraph><paragraph id="idf38fc842-a9b9-4428-812a-67ef8a9072a2"><enum>(2)</enum><text>section 1341 or
				1343, when charged in conjunction with section 1346 and where the offense
				involves a scheme or artifice to deprive another of the intangible right of
				honest services of a public official;</text>
						</paragraph><paragraph id="idb49ad2a9-76b8-42ac-bcb2-dcedb427d2ef"><enum>(3)</enum><text>section 1951, if
				the offense involves extortion under color of official right;</text>
						</paragraph><paragraph id="id61299208-4d05-40b7-a9ba-6ba56a56f6e6"><enum>(4)</enum><text>section 1952, to
				the extent that the unlawful activity involves bribery; or</text>
						</paragraph><paragraph id="id3ce0128b-bb00-45d8-9eb6-1ce44019a5bb"><enum>(5)</enum><text>section 1962, to
				the extent that the racketeering activity involves bribery chargeable under
				State law, involves a violation of section 201 or 666, section 1341 or 1343,
				when charged in conjunction with section 1346 and where the offense involves a
				scheme or artifice to deprive another of the intangible right of honest
				services of a public official, or section 1951, if the offense involves
				extortion under color of official
				right.</text>
						</paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="idc128bdd2-1c17-4cda-a252-fb94047f63ea"><enum>(b)</enum><header>Clerical
			 amendment</header><text>The table of sections at the beginning of chapter 213
			 of title 18, United States Code, is amended by adding at the end the
			 following:</text>

			 mail and wire fraud statutes to licences and other intangible
			 rights</header><text display-inline="no-display-inline">Sections 1341 and 1343
			 of title 18, United States Code, are each amended by striking <quote>money or
			 property</quote> and inserting <quote>money, property, or any other thing of
			 value</quote>.</text>

					<clause id="id34760ecc-d670-43cc-a5eb-ecf015d5abbf"><enum>(i)</enum><text>striking
			 <quote>anything of value</quote> and inserting <quote>any thing or things of
			 value</quote>; and</text>

			 following paragraph (2), by striking <quote>ten years</quote> and inserting
			 <quote>15 years</quote>; and</text>
				</subparagraph></paragraph><paragraph id="id30EAA71AA6754328B6DAFCC023053AAC"><enum>(2)</enum><text>in subsection
			 (c)—</text>

			 Code, is amended by striking <quote>three years</quote> and inserting <quote>10

			</subsection><subsection id="id1f43c349-ae8e-4a10-9562-164189efb9ba"><enum>(b)</enum><header>Promise of
			 employment for political activity</header><text>Section 600 of title 18, United
			 States Code, is amended by striking <quote>one year</quote> and inserting
			 <quote>10 years</quote>.</text>
			</subsection><subsection id="id9e9ccfda-80db-4b39-979f-7cdf91ed2f38"><enum>(c)</enum><header>Deprivation of
			 employment for political activity</header><text>Section 601(a) of title 18,
			 United States Code, is amended by striking <quote>one year</quote> and
			 inserting <quote>10 years</quote>.</text>
			</subsection><subsection id="id1532bf9d-1e6c-4f82-926b-45f78fb2d70c"><enum>(d)</enum><header>Intimidation To
			 secure political contributions</header><text>Section 606 of title 18, United
			 States Code, is amended by striking <quote>three years</quote> and inserting
			 <quote>10 years</quote>.</text>
			</subsection><subsection id="ide9986197-e861-4b64-a7ba-f5a31725ce77"><enum>(e)</enum><header>Solicitation and
			 acceptance of contributions in federal offices</header><text display-inline="yes-display-inline">Section 607(a)(2) of title 18, United
			 States Code, is amended by striking <quote>3 years</quote> and inserting
			 <quote>10 years</quote>.</text>
			</subsection><subsection id="id3760f245-24c6-4fa7-b8f2-906c83c485c3"><enum>(f)</enum><header>Coercion of
			 political activity by federal employees</header><text display-inline="yes-display-inline">Section 610 of title 18, United States
			 Code, is amended by striking <quote>three years</quote> and inserting <quote>10
			 years</quote>.</text>

			 District of Columbia to theft of public money offense</header><text display-inline="no-display-inline">Section 641 of title 18, United States Code,
			 is amended by inserting <quote>the District of Columbia or</quote> before
			 <quote>the United States</quote> each place that term appears.</text>

			 predicates</header>

			 States Code, is amended—</text>
				<paragraph id="id079c0d49-3e84-4e5b-89bb-dd84cbfe7c2b"><enum>(1)</enum><text>by striking the
			 matter before subparagraph (A) and inserting <quote>otherwise than as provided
			 by law for the proper discharge of official duty, or by rule or
			 regulation—</quote>;</text>
				</paragraph><paragraph id="id28b34e35-bfe4-430f-8411-fc1b73209518"><enum>(2)</enum><text>in subparagraph
			 (A), by inserting after <quote>, or person selected to be a public
			 official,</quote> the following: <quote>for or because of the official’s or
			 person’s official position, or for or because of any official act performed or
			 to be performed by such public official, former public official, or person
			 selected to be a public official</quote>; and</text>
				</paragraph><paragraph id="id3032344B1A694B6FAF946DDCB4B50CEB"><enum>(3)</enum><text>in subparagraph
			 (B)—</text>
					<subparagraph id="id102DB5674554462795EC873EFB072FD9"><enum>(A)</enum><text>by striking
			 <quote>otherwise than as provided by law for the proper discharge of official
			 duty,</quote>; and</text>
					</subparagraph><subparagraph id="idCEE53F3D074E4143A543653D2DD1D833"><enum>(B)</enum><text>by striking all
			 after <quote>anything of value personally</quote> and inserting <quote>for or

				public official’s official capacity or in such official’s place of trust or
				profit. An official act can be a single act, more than one act, or a course of
				conduct.</text>
				</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section changed="deleted" committee-id="SSJU00" id="idc00ce13f-7141-4b88-a283-814fabfc44f7" reported-display-style="strikethrough"><enum>14.</enum><header>Clarification of
			 course of conduct bribery</header><text display-inline="no-display-inline">Section 201 of title 18, United States Code,
			 is amended—</text>

			 by striking <quote>anything of value</quote> each place it appears and
			 inserting <quote>any thing or things of value</quote>; and</text>

			 by striking <quote>anything of value</quote> each place it appears and

			 for perjury and obstruction of justice proceedings</header>

			 general</header><text display-inline="yes-display-inline">Section 1512(i) of
			 title 18, United States Code, is amended to read as follows:</text>

				proceeding (whether or not pending or about to be instituted) was intended to
				be
				affected.</text>

			</subsection><subsection id="idcc222ff5-c174-4df6-af14-603473ada7ad"><enum>(b)</enum><header>Perjury</header>
				<paragraph id="idb231bc69-48bd-4737-9318-c5c3985e14dc"><enum>(1)</enum><header>In
			 general</header><text>Chapter 79 of title 18, United States Code, is amended by
			 adding at the end the following:</text>

			 Sentencing Commission</header><text display-inline="yes-display-inline">Pursuant to its authority under section
			 994(p) of title 28, United States Code, and in accordance with this section,
			 the United States Sentencing Commission shall review and amend its guidelines
			 and its policy statements applicable to persons convicted of an offense under
			 sections 201, 641, and 666 of title 18, United States Code, in order to reflect
			 the intent of Congress that such penalties be increased in comparison to those
			 currently provided by the guidelines and policy statements.</text>
			</subsection><subsection id="idbe2f1cb2-1696-4043-bb3d-da0b993a52a9"><enum>(b)</enum><header>Requirements</header><text display-inline="yes-display-inline">In carrying out this section, the
			 Commission shall—</text>
				<paragraph id="idcaaa49b2-4862-4aec-8efa-5b284500a222"><enum>(1)</enum><text display-inline="yes-display-inline">ensure that the sentencing guidelines and
			 policy statements reflect Congress’ intent that the guidelines and policy
			 statements reflect the serious nature of the offenses described in subsection
			 (a), the incidence of such offenses, and the need for an effective deterrent
			 and appropriate punishment to prevent such offenses;</text>
				</paragraph><paragraph id="id64be094c-6d43-46c9-9665-4aba1f557461"><enum>(2)</enum><text>consider the
			 extent to which the guidelines may or may not appropriately account for—</text>
					<subparagraph id="id9e9f7d3d-dc05-4826-a38e-372098b88f5f"><enum>(A)</enum><text>the potential and
			 actual harm to the public and the amount of any loss resulting from the
			 offense;</text>
					</subparagraph><subparagraph id="id736ba724-1065-4c02-9866-4ce07eb185e0"><enum>(B)</enum><text>the level of
			 sophistication and planning involved in the offense;</text>
					</subparagraph><subparagraph id="idc676acc9-7c7b-4777-b2ca-9912c2d07c9a"><enum>(C)</enum><text>whether the
			 offense was committed for purposes of commercial advantage or private financial
			 benefit;</text>
					</subparagraph><subparagraph id="id0aaa529b-9bc9-42db-9a91-aa8f68f6ab7c"><enum>(D)</enum><text>whether the
			 defendant acted with intent to cause either physical or property harm in
			 committing the offense;</text>
					</subparagraph><subparagraph id="id02ab7ba8-3393-483e-b853-4860221f19e8"><enum>(E)</enum><text>the extent to
			 which the offense represented an abuse of trust by the offender and was
			 committed in a manner that undermined public confidence in the Federal, State,
			 or local government; and</text>
					</subparagraph><subparagraph id="id4ff729f6-fb86-49a6-9a2d-3a8fed0b3b45"><enum>(F)</enum><text>whether the
			 violation was intended to or had the effect of creating a threat to public
			 health or safety, injury to any person or even death;</text>
					</subparagraph></paragraph><paragraph id="id6fa80dee-078f-4286-a1d5-8ec61227dd6e"><enum>(3)</enum><text>assure reasonable
			 consistency with other relevant directives and with other sentencing
			 guidelines;</text>
				</paragraph><paragraph id="id164f47e6-de95-4440-8836-049714924336"><enum>(4)</enum><text>account for any
			 additional aggravating or mitigating circumstances that might justify
			 exceptions to the generally applicable sentencing ranges;</text>
				</paragraph><paragraph id="id33dad955-6a32-4669-90f5-f98a77a909f0"><enum>(5)</enum><text>make any necessary
			 conforming changes to the sentencing guidelines; and</text>

				the acceptance of gifts and campaign

				</paragraph></subsection><subsection id="id60e353c5-1b3b-416f-870c-b411556b0bf4"><enum>(b)</enum><header>Clarification</header><text display-inline="yes-display-inline">Section 201(c)(1) of title 18, United
			 States Code, is amended—</text>
				<paragraph id="id1820e35d-5a8c-4b4a-90c5-ca5356d54023"><enum>(1)</enum><text>by striking the matter
			 before subparagraph (A) and inserting <quote>otherwise than as provided by law
			 for the proper discharge of official duty, or by rule or
			 regulation—</quote>;</text>
				</paragraph><paragraph id="idb1399e7c-adb3-481c-baa0-05486982076c"><enum>(2)</enum><text>in subparagraph (A), by
			 inserting after <quote>, or person selected to be a public official,</quote>
			 the following: <quote>for or because of the official’s or person’s official
			 position, or for or because of any official act performed or to be performed by
			 such public official, former public official, or person selected to be a public
			 official</quote>; and</text>
				</paragraph><paragraph id="id48f74ee3-f1a1-4e66-a818-b70e12cd62a1"><enum>(3)</enum><text>in subparagraph
			 (B)—</text>
					<subparagraph id="idf3aa5970-9ef8-4539-a872-563a8d442801"><enum>(A)</enum><text>by striking
			 <quote>otherwise than as provided by law for the proper discharge of official
			 duty,</quote>; and</text>

				profit. An official act can be a single act, more than one act, or a course of
				conduct.</text>

			 sentencing guidelines relating to certain crimes</header>
			<subsection id="idf05525a8-8284-48fc-873e-68e1dccfb304"><enum>(a)</enum><header>Directive to Sentencing
			 Commission</header><text display-inline="yes-display-inline">Pursuant to its
			 authority under section 994(p) of title 28, United States Code, and in
			 accordance with this section, the United States Sentencing Commission shall
			 review and amend its guidelines and its policy statements applicable to persons
			 convicted of an offense under sections 201, 641, and 666 of title 18, United
			 States Code, in order to reflect the intent of Congress that such penalties be
			 increased in comparison to those currently provided by the guidelines and
			 policy statements.</text>
			</subsection><subsection id="idfb169faa-b169-412b-b7e1-9f550ecc66f5"><enum>(b)</enum><header>Requirements</header><text display-inline="yes-display-inline">In carrying out this section, the
			 Commission shall—</text>
				<paragraph id="ida8ca56f0-b2fd-46fe-9b3a-5ec4a6703fdb"><enum>(1)</enum><text display-inline="yes-display-inline">ensure that the sentencing guidelines and
			 policy statements reflect Congress’ intent that the guidelines and policy
			 statements reflect the serious nature of the offenses described in subsection
			 (a), the incidence of such offenses, and the need for an effective deterrent
			 and appropriate punishment to prevent such offenses;</text>
				</paragraph><paragraph id="id85abc418-e5d9-4900-8a49-fff6cab40f85"><enum>(2)</enum><text>consider the extent to
			 which the guidelines may or may not appropriately account for—</text>
					<subparagraph id="id12e62f6d-802b-4681-a720-0bed35c9b84b"><enum>(A)</enum><text>the potential and actual
			 harm to the public and the amount of any loss resulting from the
			 offense;</text>
					</subparagraph><subparagraph id="idcc3652a2-eaca-4413-86f8-65d855687b7d"><enum>(B)</enum><text>the level of
			 sophistication and planning involved in the offense;</text>
					</subparagraph><subparagraph id="id42398711-8f09-443f-830c-5744454d2422"><enum>(C)</enum><text>whether the offense was
			 committed for purposes of commercial advantage or private financial
			 benefit;</text>
					</subparagraph><subparagraph id="id3a40ebb5-fecb-473e-ba43-c7b7552e47aa"><enum>(D)</enum><text>whether the defendant
			 acted with intent to cause either physical or property harm in committing the
			 offense;</text>
					</subparagraph><subparagraph id="id36843588-196f-4029-a549-8e71a083f3e3"><enum>(E)</enum><text>the extent to which the
			 offense represented an abuse of trust by the offender and was committed in a
			 manner that undermined public confidence in the Federal, State, or local
			 government; and</text>
					</subparagraph><subparagraph id="id736f5715-8936-4a78-9c0e-7694d7be237c"><enum>(F)</enum><text>whether the violation was
			 intended to or had the effect of creating a threat to public health or safety,
			 injury to any person or even death;</text>
					</subparagraph></paragraph><paragraph id="id9cfe5791-a76b-47d0-a4b9-544e7e7033f9"><enum>(3)</enum><text>assure reasonable
			 consistency with other relevant directives and with other sentencing
			 guidelines;</text>
				</paragraph><paragraph id="id99765b48-d9eb-4274-9b92-00f3acae6555"><enum>(4)</enum><text>account for any
			 additional aggravating or mitigating circumstances that might justify
			 exceptions to the generally applicable sentencing ranges;</text>
				</paragraph><paragraph id="id8d067d15-4cbf-4313-a605-1b381ed305f1"><enum>(5)</enum><text>make any necessary
			 conforming changes to the sentencing guidelines; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7a226ee9-14a1-4ae4-b8cd-a8eb406d4ce6"><enum>(6)</enum><text>assure that the
			 guidelines adequately meet the purposes of sentencing as set forth in section
			 3553(a)(2) of title 18, United States Code.</text>
				</paragraph></subsection></section><section changed="added" commented="no" committee-id="SSJU00" display-inline="no-display-inline" id="id41af95df-f281-4a58-a6c4-1a8d982e3450" reported-display-style="italic"><enum>17.</enum><header>Permitting the
			 disclosure of information regarding potential criminal activity to appropriate
			 law enforcement authorities</header><text display-inline="no-display-inline">Section 360(a) of title 28, United States

				artifice to defraud</term> also includes a scheme or artifice by a public
				official to engage in undisclosed self-dealing.</text>
						</subsection><subsection id="idC9FA1661FBE947618ED3BEE84C67B2AF"><enum>(b)</enum><header>Definitions</header><text>In
				this section—</text>
							<paragraph id="id6CC06D880A1D42BA90AFDC4435997D57"><enum>(1)</enum><text>the term <term>material
				information</term> includes information—</text>
								<subparagraph id="idEAD9B34E249F43E0BA7BD3DF9527C729"><enum>(A)</enum><text>regarding a financial
				interest described in clauses (i) through (vi) of paragraph (3)(A); and</text>
								</subparagraph><subparagraph id="id445DC48060924A5FA3D5A164A8B07393"><enum>(B)</enum><text>regarding the
				association, connection, or dealings by a public official with an individual,
				business, or organization as described in clauses (iii) through (vi) of
				paragraph (3)(A);</text>
								</subparagraph></paragraph><paragraph id="idC26157C3F02B43058FA6300BF1E5AA88"><enum>(2)</enum><text>the term <term>official
				act</term>—</text>
								<subparagraph id="id54FB9CBA317C4A73A4C776745DF061AC"><enum>(A)</enum><text>includes any act within
				the range of official duty, and any decision or action on any question, matter,
				cause, suit, proceeding, or controversy, which may at any time be pending, or
				which may by law be brought before any public official, in such public
				official’s official capacity or in such official’s place of trust or profit;
				and</text>
								</subparagraph><subparagraph id="IDa4ebcd09c0b94f32b399a577ea301a7e"><enum>(B)</enum><text>can be a single act, more
				than 1 act, or a course of conduct;</text>
								</subparagraph></paragraph><paragraph id="idDD183DBFE59F451E86ABABD28B8B7913"><enum>(3)</enum><text>the term <term>public
				official</term> means an officer, employee, or elected or appointed
				representative, or person acting for or on behalf of the United States, a
				State, or subdivision of a State, or any department, agency, or branch thereof,
				in any official function, under or by authority of any such department, agency,
				or branch of government; and</text>
							</paragraph><paragraph id="id14A95DB5FF1942AA907A78FF243EADC8"><enum>(4)</enum><text>the term
				<term>undisclosed self-dealing</term> means—</text>
								<subparagraph id="IDe926b4a33eb1459393bcd19cda23da91"><enum>(A)</enum><text>the performance of an
				official act by a public official for the purpose, in whole or in material
				part, of furthering or benefitting a financial interest of—</text>
									<clause id="IDb1c535dbafaa4376842dae544efbfe9a"><enum>(i)</enum><text>the public
				official;</text>
									</clause><clause id="IDe92bc7fba10a48e1a4d9959db14fbeeb"><enum>(ii)</enum><text>the spouse or minor
				child of the public official;</text>
									</clause><clause id="IDe3d14f5e7a3d472ea1902b87870e1079"><enum>(iii)</enum><text>a general partner of
				the public official;</text>
									</clause><clause id="ID79f3d53095b2448791c38ebc984d3057"><enum>(iv)</enum><text>a business or
				organization in which the public official is serving as an employee, officer,
				director, trustee, or general partner;</text>
									</clause><clause id="IDbbf9db60586f4ea8948e19e0c8c3fedb"><enum>(v)</enum><text>an individual, business,
				or organization with whom the public official is negotiating for, or has any
				arrangement concerning, prospective employment or financial compensation;
				or</text>
									</clause><clause id="ID19ca734269354302b24b0ceaf62e8e28"><enum>(vi)</enum><text>individual, business, or
				organization from whom the public official has received any thing or things of
				value, otherwise than as provided by law for the proper discharge of official
				duty, or by rule or regulation; and</text>
									</clause></subparagraph><subparagraph id="IDc0eb6bcc50f040f5affd6df50613fd89"><enum>(B)</enum><text>the knowing
				falsification, concealment, or covering up of material information by a public
				official that is required to be disclosed by any Federal, State, or local
				statute, rule, regulation, or charter applicable to the public official, or the
				knowing failure of a public official to disclose material information in a
				manner that is required by any Federal, State, or local statute, rule,
				regulation, or charter applicable to the public
				official.</text>
								</subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
