		<section id="ID27E44C7E7FC94E5A86DA78164D23B647" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>No Oil Producing and Exporting Cartels
			 Act of 2011</short-title></quote> or <quote><short-title>NOPEC</short-title></quote>.</text>
		</section><section id="ID3797F4DDDCE846FD9426D371141DDD03"><enum>2.</enum><header><act-name parsable-cite="SHERMAN">Sherman Act</act-name></header><text display-inline="no-display-inline">The <act-name parsable-cite="SHERMAN">Sherman Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/15/1">15 U.S.C. 1</external-xref> et seq.) is amended by
			 adding after section 7 the following:</text>
			<quoted-block act-name="Sherman Act" id="IDEF2535F2D6FC43A69410FD622FA2412E">
				<section id="IDA3D53C08FCA14375ADEDBAEE61CD1115"><enum>7A.</enum><header>Oil producing
				cartels</header>
					<subsection id="IDFEBA403D1A5D42CAAF372D3FC5B89FEF"><enum>(a)</enum><header>In
				general</header><text>It shall be illegal and a violation of this Act for any
				foreign state, or any instrumentality or agent of any foreign state, to act
				collectively or in combination with any other foreign state, any
				instrumentality or agent of any other foreign state, or any other person,
				whether by cartel or any other association or form of cooperation or joint
				action—</text>
						<paragraph id="ID6DE4BF65124B4D37998CB063B31C55D5"><enum>(1)</enum><text>to limit the
				production or distribution of oil, natural gas, or any other petroleum
				product;</text>
						</paragraph><paragraph id="ID1EF0DC5C4DE441A1843E56FF917953F0"><enum>(2)</enum><text>to set or
				maintain the price of oil, natural gas, or any petroleum product; or</text>
						</paragraph><paragraph id="IDE31E96F005D245B09FD5A6007482188C"><enum>(3)</enum><text>to otherwise take
				any action in restraint of trade for oil, natural gas, or any petroleum
				product;</text>
						</paragraph><continuation-text continuation-text-level="subsection">when such
				action, combination, or collective action has a direct, substantial, and
				reasonably foreseeable effect on the market, supply, price, or distribution of
				oil, natural gas, or other petroleum product in the United States.</continuation-text></subsection><subsection id="ID4D36D788998A4B73B600550005CF2B8C"><enum>(b)</enum><header>Sovereign
				immunity</header><text>A foreign state engaged in conduct in violation of
				subsection (a) shall not be immune under the doctrine of sovereign immunity
				from the jurisdiction or judgments of the courts of the United States in any
				action brought to enforce this section.</text>
					</subsection><subsection id="ID5D33C87DFFC9428987D05EF933E87600"><enum>(c)</enum><header>Inapplicability
				of Act of State doctrine</header><text>No court of the United States shall
				decline, based on the act of state doctrine, to make a determination on the
				merits in an action brought under this section.</text>
					</subsection><subsection id="ID23C97F47A54E4C918D248843B6C84571"><enum>(d)</enum><header>Enforcement</header>
						<paragraph id="idC81F3B690B694742B044931545E15195"><enum>(1)</enum><header>In
				general</header><text>The Attorney General of the United States may bring an
				action to enforce this section in any district court of the United States as
				provided under the antitrust laws.</text>
						</paragraph><paragraph id="id71099DE4CE5B4476A64E6BA66DD8A92E"><enum>(2)</enum><header>No private
				right of action</header><text>No private right of action is authorized under
				this
				section.</text>
						</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="ID1BB17FA994C04D8DA307BC7E9C7D3EC3"><enum>3.</enum><header>Sovereign
			 immunity</header><text display-inline="no-display-inline">Section 1605(a) of
			 title 28, United States Code, is amended—</text>
			<paragraph id="IDDC101CEFE95549A8A142322090618072"><enum>(1)</enum><text>in paragraph (6),
			 by striking <quote>or</quote> after the semicolon;</text>
			</paragraph><paragraph id="ID91C2D65FFAE048DC9E6975600042D628"><enum>(2)</enum><text>in paragraph (7),
			 by striking the period and inserting <quote>; or</quote>; and</text>
			</paragraph><paragraph id="ID932C5C435E684F549757C424B4F90069"><enum>(3)</enum><text>by adding at the
			 end the following:</text>

					<paragraph id="ID99648F5C95B2406EBBB6ABE5E21BCCBB"><enum>(8)</enum><text>in which the
				action is brought under section 7A of the <act-name parsable-cite="SHERMAN">Sherman
				Act</act-name>.</text>
