		<official-title>To amend title 37, United States Code, to provide
		  flexible spending arrangements for members of the uniformed services, and for
		  other purposes.</official-title>

			 arrangements for the uniformed services</header>
			<subsection id="id4A420FCFEDA94784B528BBB3C5D71274"><enum>(a)</enum><header>Flexible
			 spending arrangements</header>
				<paragraph id="id40EF304AC6164F22BB86AFFBA475E8E5"><enum>(1)</enum><header>In
			 general</header><text>Chapter 3 of title 37, United States Code, is amended by
			 adding at the end the following new section:</text>

						<section id="id736657A89AB041F9A72B38B89A448646"><enum>213.</enum><header>Flexible
				spending arrangements</header>
							<subsection id="ID9c958662b5914ccdbfa08a95ea4c352d"><enum>(a)</enum><header>Flexible
				spending arrangements for the uniformed services</header><paragraph commented="no" display-inline="yes-display-inline" id="id11F7F5563CB4415584B87671B4C34D71"><enum>(1)</enum><text>Not later than 180 days
				after the date of the enactment of this section, each Secretary concerned shall
				establish procedures to implement flexible spending arrangements with respect
				to basic pay under section 204 of this title for health care and dependent care
				on a pre-tax basis in accordance with regulations prescribed under sections
				106(c) and 125 of the Internal Revenue Code of 1986.</text>
								</paragraph><paragraph id="idDF6569B171714D03BD96A486F288733B" indent="up1"><enum>(2)</enum><text>In establishing the procedures
				required by paragraph (1), each Secretary concerned shall consider life events
				of members of the uniformed services that are unique to them as members of the
				uniformed services, including changes relating to permanent changes of duty
				station and deployments to overseas contingency operations.</text>
								</paragraph></subsection><subsection id="ID888ddcb5f7054a269854c123e4cc0830"><enum>(b)</enum><header>Deductions not
				prohibited for enlisted members</header><text>Section 701(c) of this title,
				relating to assignment of the pay of an enlisted member, may not be construed
				to prohibit or invalidate the arrangements authorized by this section with
				respect to the pay or compensation of an enlisted
				member.</text>
							</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="id35BD81126B754E6C80A0212130D9C71D"><enum>(2)</enum><header>Clerical
			 amendment</header><text>The table of sections at the beginning of chapter 3 of
			 such title is amended by inserting after the item relating to section 204 the
			 following new item:</text>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idCF8E0AD4E11D47709862F77C579DCEB5"><enum>(b)</enum><header>Implementation
			 and source of funds</header>
				<paragraph commented="no" display-inline="no-display-inline" id="idB7C0B7BD83594E2EA3A0BD7944A9A484"><enum>(1)</enum><header>Implementation</header><text>Each
			 Secretary concerned shall establish the procedures required by section 213(a)
			 of such title, as added by subsection (a)(1), not later than 180 days after the
			 date of the enactment of this Act.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3620A80A43D1406EA2D97F9DB6D5EEA5"><enum>(2)</enum><header>Source of
			 funds</header><text>To cover the cost of establishing the procedures described
			 in paragraph (1), each Secretary concerned shall use funds otherwise available
			 for the operation of the Office of that Secretary.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1D653FFE3F4540419048563647116D78"><enum>(3)</enum><header>Secretary
			 concerned defined</header><text>In this subsection, the term <term>Secretary
			 concerned</term> has the meaning given such term in section 101 of such
			 title.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDa2adff6aa5c4453297a230351fc4dc06"><enum>(c)</enum><header display-inline="yes-display-inline">Review of applicability to members of
			 reserve components of the uniformed services</header>
				<paragraph commented="no" display-inline="no-display-inline" id="id94D16C58D2A2424B91B1CFCB907FEA37"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Not later than 180
			 days after the date of the enactment of this Act, the Secretary of Defense
			 shall submit to the congressional defense committees recommendations on the
			 advisability of authorizing flexible spending arrangements as described in such
			 section 213(a), for pay received as a member of a reserve component of the
			 uniformed services other than under section 204 of such title.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id12FE81925F5840BFA371EC4BEF8D2C28"><enum>(2)</enum><header>Congressional
			 defense committees defined</header><text>In this subsection, the term
			 <term>congressional defense committees</term> has the meaning given such term
			 in section 101(a) of title 10, United States Code.</text>
