		<official-title>To amend the National Forest Ski Area Permit Act of 1986
		  to clarify the authority of the Secretary of Agriculture regarding additional
		  recreational uses of National Forest System land that is subject to ski area
		  permits, and for other purposes.</official-title>

		<section id="id67F432C5E22D4F8CABF81A6AE9956BE3" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Ski Area Recreational Opportunity
			 Enhancement Act of 2011</short-title></quote>.</text>
		</section><section id="IDeed88f146228472cb20a0c665c500019"><enum>2.</enum><header>Purpose</header><text display-inline="no-display-inline">The purpose of this Act is to amend the
			 National Forest Ski Area Permit Act of 1986 (16 U.S.C. 497b)—</text>
			<paragraph id="IDfa5c1c2c291f4f6a8b6f7a4682ec9611"><enum>(1)</enum><text>to enable
			 snow-sports (other than nordic and alpine skiing) to be permitted on National
			 Forest System land subject to ski area permits issued by the Secretary of
			 Agriculture under section 3 of the National Forest Ski Area Permit Act of 1986
			 (16 U.S.C. 497b); and</text>
			</paragraph><paragraph id="ID8833395c7ac440f8b2faabaf5c8eca28"><enum>(2)</enum><text>to clarify the
			 authority of the Secretary of Agriculture to permit appropriate additional
			 seasonal or year-round recreational activities and facilities on National
			 Forest System land subject to ski area permits issued by the Secretary of
			 Agriculture under section 3 of the National Forest Ski Area Permit Act of 1986
			 (16 U.S.C. 497b).</text>
			</paragraph></section><section id="ID9b3e6d987a5048e7be06176fca79703e"><enum>3.</enum><header>Ski area
			 permits</header><text display-inline="no-display-inline">Section 3 of the
			 National Forest Ski Area Permit Act of 1986 (16 U.S.C. 497b) is amended—</text>
			<paragraph id="ID6a5412bf6df54b658a45b6ab5a9d145b"><enum>(1)</enum><text>in subsection
			 (a), by striking <quote>nordic and alpine ski areas and facilities</quote> and
			 inserting <quote>ski areas and associated facilities</quote>;</text>
			</paragraph><paragraph id="ID7941e049ee964ffb9f4a43cfe2af8e94"><enum>(2)</enum><text>in subsection
			 (b), in the matter preceding paragraph (1), by striking “nordic and alpine
			 skiing operations and purposes” and inserting “skiing and other snow sports and
			 recreational uses authorized by this Act”;</text>
			</paragraph><paragraph id="IDf6260727317743fb939a7d3eb3f5d6b2"><enum>(3)</enum><text>by redesignating
			 subsections (c) and (d) as subsections (d) and (e), respectively;</text>
			</paragraph><paragraph id="ID4020108e4e714a7693bdfa2423fa63e9"><enum>(4)</enum><text>by inserting
			 after subsection (b) the following:</text>
				<quoted-block display-inline="no-display-inline" id="idDCF027C3796343BCA44D2E0768AD8019" style="OLC">
					<subsection id="ID4d26e9be9d28431ebd5afc29dc818b5f"><enum>(c)</enum><header>Other
				Recreational Uses</header>
						<paragraph id="ID1b4da21bae55463ca480f2ff3fea7a20"><enum>(1)</enum><header>Authority of
				Secretary</header><text>Subject to the terms of a ski area permit issued
				pursuant to subsection (b), the Secretary may authorize a ski area permittee to
				provide such other seasonal or year-round natural resource-based recreational
				activities and associated facilities (in addition to skiing and other
				snow-sports) on National Forest System land subject to a ski area permit as the
				Secretary determines to be appropriate.</text>
						</paragraph><paragraph id="ID3270575518de4d578ed7d04c08c34281"><enum>(2)</enum><header>Requirements</header><text>Each
				activity and facility authorized by the Secretary under paragraph (1)
				shall—</text>
							<subparagraph id="IDd733d59475e7490d988e75cd25080b40"><enum>(A)</enum><text>encourage outdoor
				recreation and enjoyment of nature;</text>
							</subparagraph><subparagraph id="ID9cdcb30b2016471c9cd33ed029888984"><enum>(B)</enum><text>to the extent
				practicable—</text>
								<clause id="ID7fd5ee097fbf4e868cc593cf40812b8e"><enum>(i)</enum><text>harmonize with
				the natural environment of the National Forest System land on which the
				activity or facility is located; and</text>
								</clause><clause id="ID7030aa55acf74c1497128a4b24bdb84d"><enum>(ii)</enum><text>be located
				within the developed portions of the ski area;</text>
								</clause></subparagraph><subparagraph id="ID3e21b75a51054933a2371cf87b05364f"><enum>(C)</enum><text>be subject to
				such terms and conditions as the Secretary determines to be appropriate;
				and</text>
							</subparagraph><subparagraph id="ID74ed00447c3149d791e41d77f2e0ff8c"><enum>(D)</enum><text>be authorized in
				accordance with—</text>
								<clause id="ID09e05c6e61e1449da786f16e4efa81a3"><enum>(i)</enum><text>the applicable
				land and resource management plan; and</text>
								</clause><clause id="ID5ac40636ddab49c88e062a52a5f21336"><enum>(ii)</enum><text>applicable laws
				(including regulations).</text>
								</clause></subparagraph></paragraph><paragraph id="id00F57AE591C44E6FAC17D2401D431779"><enum>(3)</enum><header>Inclusions</header><text>Activities
				and facilities that may, in appropriate circumstances, be authorized under
				paragraph (1) include—</text>
							<subparagraph id="id178A9FC2ABC14F2895020EDDB67DCFBE"><enum>(A)</enum><text>zip lines;</text>
							</subparagraph><subparagraph id="idC7638AD5E5FC4C10B50B99675052F95F"><enum>(B)</enum><text>mountain bike
				terrain parks and trails;</text>
							</subparagraph><subparagraph id="id8A0E6887699F410DA8F8C106C3BE3440"><enum>(C)</enum><text>frisbee golf
				courses; and</text>
							</subparagraph><subparagraph id="id0AC29E3C55074E718BFAD91714F79407"><enum>(D)</enum><text>ropes
				courses.</text>
							</subparagraph></paragraph><paragraph id="ID118dc309f7244f55a16509f145066130"><enum>(4)</enum><header>Exclusions</header><text>Activities
				and facilities that are prohibited under paragraph (1) include—</text>
							<subparagraph id="ID3fcfc0002080482d99e8a0b14ec3cd4b"><enum>(A)</enum><text>tennis
				courts;</text>
							</subparagraph><subparagraph id="ID12d274a6f3cd4165934928a021e19b7f"><enum>(B)</enum><text>water slides and
				water parks;</text>
							</subparagraph><subparagraph id="ID815e66f006ce4c3fa1badf8b844a67f2"><enum>(C)</enum><text>swimming
				pools;</text>
							</subparagraph><subparagraph id="ID1328be1e01814e94b658de7e6d5eb144"><enum>(D)</enum><text>golf courses;
				and</text>
							</subparagraph><subparagraph id="id66D86B248204422BA6A3597BD1EF75AF"><enum>(E)</enum><text>amusement
				parks.</text>
							</subparagraph></paragraph><paragraph id="IDbd262064b0874218874cf9c6a9cd80ba"><enum>(5)</enum><header>Limitation</header><text>The
				Secretary may not authorize any activity or facility under paragraph (1) if the
				Secretary determines that the authorization of the activity or facility would
				result in the primary recreational purpose of the ski area permit to be a
				purpose other than skiing and other snow-sports.</text>
						</paragraph><paragraph id="id6EF3ABB392114319A8BC7E81AC9A3BDE"><enum>(6)</enum><header>Boundary
				determination</header><text>In determining the acreage encompassed by a ski
				area permit under subsection (b)(3), the Secretary shall not consider the
				acreage necessary for activities and facilities authorized under paragraph
				(1).</text>
						</paragraph><paragraph id="ID901b5d4638f4422799b44f9e96a1228c"><enum>(7)</enum><header>Effect on
				existing authorized activities and facilities</header><text>Nothing in this
				subsection affects any activity or facility authorized by a ski area permit in
				effect on the date of enactment of this subsection during the term of the
				permit.</text>
						</paragraph></subsection><after-quoted-block>;
				</after-quoted-block></quoted-block>
			</paragraph><paragraph id="ID7397298d3ecf4b7c86e0e637532ed7f9"><enum>(5)</enum><text>by striking
			 subsection (d) (as redesignated by paragraph (3)), and inserting the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="id9226F6317DD64B6EBE3D1377C5516E4F" style="OLC">
					<subsection id="idCFF35D485EC44133B94153C32F277D40"><enum>(d)</enum><header>Regulations</header><text>Not
				later than 2 years after the date of enactment of this subsection, the
				Secretary shall promulgate regulations to implement this
				section.</text>
					</subsection><after-quoted-block>;
				and</after-quoted-block></quoted-block>
			</paragraph><paragraph id="id48C99AEDF6974BC5A328792DB69D8774"><enum>(6)</enum><text>in subsection (e)
			 (as redesignated by paragraph (3)), by striking <quote>the National
			 Environmental Policy Act, or the Forest and Rangelands Renewable Resources
			 Planning Act as amended by the National Forest Management Act</quote> and
			 inserting <quote>the <act-name parsable-cite="NEPA69">National Environmental
			 Policy Act of 1969</act-name> (42 U.S.C. 4321 et seq.) and the Forest and
			 Rangeland Renewable Resources Planning Act of 1974 (16 U.S.C. 1600 et
			 seq.)</quote>.</text>
			</paragraph></section><section commented="no" display-inline="no-display-inline" id="idF9F4CFF3E4F54AECB30D8165C2974789" section-type="subsequent-section"><enum>4.</enum><header>Effect</header><text display-inline="no-display-inline">Nothing in the amendments made by this Act
			 establishes a legal preference for the holder of a ski area permit to provide
			 activities and associated facilities authorized by section 3(c) of the National
			 Forest Ski Area Permit Act of 1986 (16 U.S.C. 497b(c)) (as amended by section
			 3).</text>
