		<official-title>To require contractors to notify small business concerns
		  that have been included in offers relating to contracts let by Federal
		  agencies, and for other purposes.</official-title>

		<section id="idC39D6AB004F3406DB9C9AC3EEBB1D2C7" section-type="section-one"><enum>1.</enum><header>Subcontractor
			 notifications</header><text display-inline="no-display-inline">Section 8(d) of
			 the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/637">15 U.S.C. 637(d)</external-xref>) is amended by adding at the end the
			 following:</text>
			<quoted-block display-inline="no-display-inline" id="idB277ED324A2B4E348DF1757FA9CC68C6" style="OLC">
				<paragraph id="id1D66279568224D94BCCC34AC2F5F31D5" indent="up1"><enum>(13)</enum><header>Notification requirement</header>
					<subparagraph id="idD6FB8236E92144D397321617875063E6"><enum>(A)</enum><header>In general</header><text>An offeror
				with respect to a contract let by a Federal agency that is to be awarded
				pursuant to the negotiated method of procurement that intends to identify a
				small business concern as a potential subcontractor in the offer relating to
				the contract shall—</text>
						<clause id="idC0A1AA0210E949538CF9BBB549035508"><enum>(i)</enum><text>notify the small business concern
				that the offeror intends to identify the small business concern as a potential
				subcontractor in the offer; and</text>
						</clause><clause id="id0201F5A3D8894D46962D712F6ACDA19D"><enum>(ii)</enum><text>include with the offer a written
				acknowledgment by the small business concern that the small business concern
				has received the notice required under clause (i).</text>
						</clause></subparagraph><subparagraph id="idA9526EB37D2146ADB95AE6A139EB1A22"><enum>(B)</enum><header>Penalties</header><text>If an
				offeror fails to notify a small business concern under subparagraph (A)(i), the
				head of the Federal agency that let the contract described in subparagraph (A)
				shall—</text>
						<clause id="id64E84390A5484EFCAFF94D31F13E28BE"><enum>(i)</enum><text>for the first such failure by the
				offeror, fine the offeror, in an amount equal to 20 percent of the value of the
				contract;</text>
						</clause><clause id="idAB8077C0339944C6890EFBFBB30059FF"><enum>(ii)</enum><text>for the second such failure by the
				offeror—</text>
							<subclause id="idB138EEFBCD4F4F29978190F53207F091"><enum>(I)</enum><text>fine the offeror, in an amount equal to
				50 percent of the value of the contract; and</text>
							</subclause><subclause id="id4C21F14F4EDE41D98E6F5518DDAF8359"><enum>(II)</enum><text>debar the offeror from contracting with
				the United States for a period of 1 year; and</text>
							</subclause></clause><clause id="id7DAA6AC6E7A4423F9649E1952EF6B5D5"><enum>(iii)</enum><text>for the third such failure by the
				offeror, debar the offeror from contracting with the United States.</text>
						</clause></subparagraph></paragraph><paragraph id="id5C24AA96E18C4BF8A3A889482C62B35B" indent="up1"><enum>(14)</enum><header>Reporting by
				subcontractors</header><text>The Administrator shall establish a reporting
				mechanism that allows a subcontractor to report fraudulent activity by a
				contractor with respect to a subcontracting plan submitted to a procurement
				authority under paragraph
				(4)(B).</text>
