		<official-title>To authorize utilities to obtain national criminal
		  history background checks of certain employees in sensitive positions.
		  </official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Utility Employee Background Check
			 Act of 2012</short-title></quote>.</text>
		</section><section id="idD5538CD99D0E438FA67831FD22152E31" section-type="subsequent-section"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act—</text>
			<paragraph id="id4951D7AA28E74C49B697D7785CFBC46C"><enum>(1)</enum><text>the term
			 <term>Chemical Facility Anti-Terrorism Standards</term> means the interim final
			 regulations issued by the Secretary of Homeland Security under section 550 of
			 the Department of Homeland Security Appropriations Act, 2007 (6 U.S.C. 121
			 note); and</text>
			</paragraph><paragraph id="idCA2DF2F14FB843B5B966003452CFF16D"><enum>(2)</enum><text>the term
			 <term>covered entities</term> means—</text>
				<subparagraph id="idF63B062EF8B2440C9201603389F369C7"><enum>(A)</enum><text>a regional entity
			 or user, owner, or operator of the bulk-power system, as defined in section 215
			 of the Federal Power Act (16 U.S.C. 824(o));</text>
				</subparagraph><subparagraph id="id9BCD78052D904263AC2092DF7E5E2F50"><enum>(B)</enum><text>a facility
			 licensed pursuant to the Atomic Energy Act of 1954 (42 U.S.C. 2011 et seq.) and
			 covered by the provisions of section 170 a. of such Act (42 U.S.C. 2210(a));
			 and</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id251C0221334B49619615CC0EA649CCC2"><enum>(C)</enum><text>a chemical
			 facility subject to the Chemical Facility Anti-Terrorism Standards.</text>
				</subparagraph></paragraph></section><section id="id7745EBC3DC364BC2813712C57DEC76B1"><enum>3.</enum><header>Access to FBI
			 background checks</header>
			<subsection id="id19FD692BAA4545DD9ED0B4A2EEEC78DA"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Attorney General,
			 acting through the Director of the Federal Bureau of Investigation, shall
			 establish procedures for owners and operators of covered entities to obtain
			 national criminal history background checks, including a search of the
			 Interstate Identification Index of the National Crime Information Centers, for
			 employees of the covered entities who have access to the most sensitive areas
			 of operation.</text>
			</subsection><subsection id="id80057BE658D94A189CDA758098F3E3E1"><enum>(b)</enum><header>User
			 fees</header><text>The Director of the Federal Bureau of Investigation may
			 collect fees for national criminal history background checks provided for under
			 subsection (a).</text>
			</subsection></section><section id="id7C2B6BF37EE444C29C211590681AC103"><enum>4.</enum><header>Mandatory
			 background checks</header>
			<subsection id="id48CD4D1207614A4984DA45BC6CF8FBE0"><enum>(a)</enum><header>Electric
			 utilities</header><text>Section 215(d) of the Federal Power Act (16 U.S.C.
			 824o(d)) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id0B0E612AB8D6485F9B3F35BC963AAAD7" style="OLC">
					<paragraph id="id97A9249748594B1FB03564E845604A9A" indent="up1"><enum>(7)</enum><text>The Commission shall order the
				Electric Reliability Organization to submit to the Commission a proposed
				reliability standard that would require each regional entity and user, owner,
				and operator of the bulk-power system to obtain a background check authorized
				under section 3(a) of the <short-title>Utility Employee
				Background Check Act of 2012</short-title> for every employee of the regional
				entity, user, owner, or operator of the bulk-power system that has access to
				the most sensitive areas of operation of the bulk-power
				system.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="idFD61D9886D4248EF865D18FF33523D9D"><enum>(b)</enum><header>Nuclear
			 facilities</header><text>Section 170D of the Atomic Energy Act of 1954 (42
			 U.S.C. 2210d) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id3128AA0BDBF84E6B99AE0CB9A97DA561" style="OLC">
					<subsection id="id13A5AE116C45419BB62C846B3CC00D7F"><enum>f.</enum><header>Background
				checks</header><text>The Commission shall require each licensed facility to
				obtain a background check authorized under section 3(a) of the
				<short-title>Utility Employee Background Check Act of
				2012</short-title> for every employee of the licensed facility who has access
				to the most sensitive areas of operation of the licensed
				facility.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="idFF140C0385254C42875780707B590E61"><enum>(c)</enum><header>Chemical
			 facilities</header><text>Not later than 180 days after the date of enactment of
			 this Act, the Secretary of Homeland Security shall promulgate rules that
			 require that each chemical facility subject to the Chemical Facility
			 Anti-Terrorism Standards obtain a background check authorized under section
			 3(a) of this Act for every employee of the chemical facility who has access to
			 the most sensitive areas of operation of the chemical facility.</text>
