		<official-title>To amend chapter 301 of title 49, United States Code, to
		  prohibit the rental of motor vehicles that contain a defect related to motor
		  vehicle safety, and for other purposes.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Raechel and Jacqueline Houck Safe
			 Rental Car Act</short-title></quote>.</text>
		</section><section id="id40038404D9514B2AB31FBAAF268D8138"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 30102(a) of title 49, United States
			 Code, is amended—</text>
			<paragraph id="id498B94D252A24E59BFB4499E9A9B48DB"><enum>(1)</enum><text>by redesignating
			 paragraphs (10) and (11) as paragraphs (12) and (13), respectively;</text>
			</paragraph><paragraph id="id51E9C7B7C1D348FD96632F0DA7C321BA"><enum>(2)</enum><text>by redesignating
			 paragraphs (1) through (9) as paragraphs (2) through (10), respectively;</text>
			</paragraph><paragraph id="id2707AFEB65F448DF8A376FFD465D360F"><enum>(3)</enum><text>by inserting
			 before paragraph (2), as redesignated, the following:</text>
				<quoted-block display-inline="no-display-inline" id="id2A45E0FB5BBC426992925B4991F11763" style="OLC">
					<paragraph id="id9AEFF34716C84C33A5137EA0E234CC66"><enum>(1)</enum><text><term>covered
				rental vehicle</term> means a motor vehicle that—</text>
						<subparagraph id="id6EFE836BBE504C39B58E6315B29240DC"><enum>(A)</enum><text>has a gross
				vehicle weight rating of 10,000 pounds or less;</text>
						</subparagraph><subparagraph id="id9BBD05B1147C4B0789B7A7776673D902"><enum>(B)</enum><text>is rented without
				a driver for an initial term of less than 4 months; and</text>
						</subparagraph><subparagraph id="id4B4945FD4E214F398A5CEBB6D7F7140F"><enum>(C)</enum><text>is part of a
				motor vehicle fleet of 5 or more motor vehicles that are used for rental
				purposes by a rental company.</text>
						</subparagraph></paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
			</paragraph><paragraph id="id0315F25BB4EB4EB4A0476ADF886B04AF"><enum>(4)</enum><text>by inserting
			 after paragraph (10), as redesignated, the following:</text>
				<quoted-block display-inline="no-display-inline" id="id0733C401A59E4491B24C10B68A360AA7" style="OLC">
					<paragraph id="id7D0F70FED1184576837F4557D09242F4"><enum>(11)</enum><text><term>rental
				company</term> means a person who—</text>
						<subparagraph id="id995EEC9AF8B24AC0B50461C00A587FD5"><enum>(A)</enum><text>is engaged in the
				business of renting covered rental vehicles; and</text>
						</subparagraph><subparagraph id="id1348793A424F44239A67EAB8A49B0F57"><enum>(B)</enum><text>uses for rental
				purposes a motor vehicle fleet of 5 or more covered rental
				vehicles.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="idD8937CC355824BAEBEB4D5541163F99A"><enum>3.</enum><header>Remedies for
			 defects and noncompliance</header><text display-inline="no-display-inline">Section 30120(i) of title 49, United States
			 Code, is amended—</text>
			<paragraph id="id6AE4C8DD589A45A9929EBF2741D12657"><enum>(1)</enum><text>in the subsection
			 heading, by adding <quote><header-in-text level="subsection" style="USC">, or
			 rental</header-in-text></quote> at the end;</text>
			</paragraph><paragraph id="id6DC2D0731FC64DB5A3A74F4B099BFA2F"><enum>(2)</enum><text>in paragraph
			 (1)—</text>
				<subparagraph id="id52E3058FE2A14877B36D3126D26ED98A"><enum>(A)</enum><text>by striking
			 <quote>(1) If notification</quote> and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="id862C006246934B1BAA4A1B5A335BB021" style="OLC">
						<paragraph id="idB6362D20395A44B7917C8A9C794CE1E2"><enum>(1)</enum><header>In
				general</header><text>If
				notification</text>
						</paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
				</subparagraph><subparagraph id="idED5A8A8CEF4B457EB4D4EFA5422BAFD0"><enum>(B)</enum><text>by indenting
			 subparagraphs (A) and (B) four ems from the left margin;</text>
				</subparagraph><subparagraph id="idDC5D17A63E8943CFA770A63909FE7B0C"><enum>(C)</enum><text>by inserting
			 <quote>or the manufacturer has provided to a rental company notification about
			 a covered rental vehicle in the company’s possession at the time of
			 notification</quote> after <quote>time of notification</quote>;</text>
				</subparagraph><subparagraph id="idD8B3DBBD2E884CC6BAD80AB4DB649EF4"><enum>(D)</enum><text>by striking
			 <quote>the dealer may sell or lease,</quote> and inserting <quote>the dealer or
			 rental company may sell, lease, or rent</quote>; and</text>
				</subparagraph><subparagraph id="id050A21EF132440FB821A49F46DE704B1"><enum>(E)</enum><text>in subparagraph
			 (A), by striking <quote>sale or lease</quote> and inserting <quote>sale, lease,
			 or rental agreement</quote>;</text>
				</subparagraph></paragraph><paragraph id="id8FB6F67CCD964F4BB3922847BC6F74C3"><enum>(3)</enum><text>by amending
			 paragraph (2) to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="id7B8BF1F110B44F399B7BAB63D2265CFF" style="OLC">
					<paragraph id="idD7777189018B49EF829645A64052C81E"><enum>(2)</enum><header>Rule of
				construction</header><text>Nothing in this subsection may be construed to
				prohibit a dealer or rental company from offering the vehicle or equipment for
				sale, lease, or rent.</text>
					</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
			</paragraph><paragraph id="id715AB59C691C43E4937E3F12EF3C2BE6"><enum>(4)</enum><text>by adding at the
			 end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id9B51D552108841F78053E7590BB59455" style="OLC">
					<paragraph id="id1D4FB01F1CD44A26ADA93F6ADBFF1BE9"><enum>(3)</enum><header>Specific rules
				for rental companies</header>
						<subparagraph id="id590E4F2A575B4ED58231FAEDCC079FF1"><enum>(A)</enum><header>In
				general</header><text>Except as otherwise provided under this paragraph, a
				rental company shall comply with the limitations on sale, lease, or rental set
				forth in subparagraph (C) and paragraph (1) as soon as practicable, but not
				later than 24 hours after the earliest receipt of the notice to owner under
				subsection (b) or (c) of section 30118 (including the vehicle identification
				number for the covered vehicle) by the rental company, whether by electronic
				means or first class mail.</text>
						</subparagraph><subparagraph id="idCE11B3F0CDDC4EC9B4EC31E645172C6E"><enum>(B)</enum><header>Special rule
				for large vehicle fleets</header><text>Notwithstanding subparagraph (A), if a
				rental company receives a notice to owner covering more than 5,000 motor
				vehicles in its fleet, the rental company shall comply with the limitations on
				sale, lease, or rental set forth in subparagraph (C) and paragraph (1) as soon
				as practicable, but not later than 48 hours after the earliest receipt of the
				notice to owner under subsection (b) or (c) of section 30018 (including the
				vehicle identification number for the covered vehicle) by the rental company,
				whether by electronic means or first class mail.</text>
						</subparagraph><subparagraph id="id52E96AC825524B75958E3A3FB4EF33C4"><enum>(C)</enum><header>Special rule
				for when remedies not immediately available</header><text>If a notification
				required under subsection (b) or (c) of section 30118 indicates that the remedy
				for the defect or noncompliance is not immediately available and specifies
				actions to temporarily alter the vehicle that eliminate the safety risk posed
				by the defect or noncompliance, the rental company, after causing the specified
				actions to be performed, may rent (but may not sell or lease) the motor
				vehicle. Once the remedy for the rental vehicle becomes available to the rental
				company, the rental company may not rent the vehicle until the vehicle has been
				remedied, as provided in subsection (a).</text>
						</subparagraph><subparagraph id="idF0322C9644BF47F4AAED31C636479118"><enum>(D)</enum><header>Inapplicability
				to junk automobiles</header><text>Notwithstanding paragraph (1), this
				subsection does not prohibit a rental company from selling a covered rental
				vehicle if such vehicle—</text>
							<clause id="id384490A65B2A42DE90A17F4BD25B5ADE"><enum>(i)</enum><text>meets the
				definition of a junk automobile under section 201 of the Anti-Car Theft Act of
				1992 (49 U.S.C. 30501);</text>
							</clause><clause id="id7A6DD732798246589B4E3AA140E874EB"><enum>(ii)</enum><text>is retitled as a
				junk automobile pursuant to applicable State law; and</text>
							</clause><clause id="id45FFC4A303BF4919827EA8DF82C6351F"><enum>(iii)</enum><text>is reported to
				the National Motor Vehicle Information System, if required under section 204 of
				such Act (49 U.S.C.
				30504).</text>
							</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="idA5A99AB8BC79428F80B35C24F62117E2"><enum>4.</enum><header>Making safety
			 devices and elements inoperative</header><text display-inline="no-display-inline">Section 30122(b) of title 49, United States
			 Code, is amended by inserting <quote>rental company,</quote> after
			 <quote>dealer,</quote> each place such term appears.</text>
		</section><section id="idE01EA2D2D1974F9D88EE3FEE7E67C9AA"><enum>5.</enum><header>Inspections,
			 investigations, and records</header><text display-inline="no-display-inline">Section 30166 of title 49, United States
			 Code, is amended—</text>
			<paragraph id="id390C9FA5F6D3451DA2129412C9751945"><enum>(1)</enum><text>in subsection
			 (c)(2), by striking <quote>or dealer</quote> each place such term appears and
			 inserting <quote>dealer, or rental company</quote>;</text>
			</paragraph><paragraph id="id4754BFDB5F5F493985F1365B9566C8F3"><enum>(2)</enum><text>in subsection
			 (e), by striking <quote>or dealer</quote> each place such term appears and
			 inserting <quote>dealer, or rental company</quote>; and</text>
			</paragraph><paragraph id="id289A01283F1A4EA096B70EA1B6338132"><enum>(3)</enum><text>in subsection
			 (f), by striking <quote>or to owners</quote> and inserting <quote>, rental
			 companies, or other owners</quote>.</text>
			</paragraph></section><section id="idE87C3435D15B447A9FDD389244317F97"><enum>6.</enum><header>Research
			 authority</header><text display-inline="no-display-inline">The Secretary of
			 Transportation may conduct a study of—</text>
			<paragraph id="id1C8F3541E74E45B9993C3C3DE6DB7E5A"><enum>(1)</enum><text display-inline="yes-display-inline">the effectiveness of the amendments made by
			 this Act; and</text>
			</paragraph><paragraph id="idFFEA0970F3AC483FB192E7C63DE8ADB7"><enum>(2)</enum><text display-inline="yes-display-inline">other activities of rental companies (as
			 defined in section 30102(a)(11) of title 49, United States Code) related to
			 their use and disposition of motor vehicles that are the subject of a
			 notification required under section 30118 of title 49, United States
			 Code.</text>
			</paragraph></section><section id="id975acd1ad9a649689563fb0e3fe5c185"><enum>7.</enum><header>Study</header>
			<subsection id="id04287F70301B46359A17D0FE39131039"><enum>(a)</enum><header>Additional
			 requirement</header><text display-inline="yes-display-inline">Subsection (b)(2)
			 of section 32206 of the Moving Ahead for Progress in the 21st Century Act
			 (Public Law 112–141; 126 Stat. 785) is amended—</text>
				<paragraph id="idFE8FDB56DF584398B4C9E58517B5C9A9"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (E), by striking
			 <quote>and</quote> at the end;</text>
				</paragraph><paragraph id="idF9D16BC58BC645F7964240F41953E126"><enum>(2)</enum><text display-inline="yes-display-inline">by redesignating subparagraph (F) as
			 subparagraph (G); and</text>
				</paragraph><paragraph id="id0206311678784DE3A56B0CE40132E22D"><enum>(3)</enum><text>by inserting
			 after subparagraph (E) the following:</text>
					<quoted-block display-inline="no-display-inline" id="id1FDA06D36B634B59BEF5F32C4A0A52B8" style="OLC">
						<subparagraph id="idDCC7CC2BFFA6471FAC31F91A1B70CB82"><enum>(F)</enum><text>evaluate the
				completion of safety recall remedies on rental trucks;
				and</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="idD1932650CE5D4E768B74D693880930F8"><enum>(b)</enum><header>Report</header><text>Subsection
			 (c) of such section is amended—</text>
				<paragraph id="id38F5ED47986D4EE984F4A2ED57CE3359"><enum>(1)</enum><text>by redesignating
			 paragraphs (1) and (2) as subparagraphs (A) and (B), respectively, and
			 indenting such subparagraphs, as so redesignated, an additional two ems from
			 the left margin;</text>
				</paragraph><paragraph id="idAA8D180FC13A4A11853B8108630E4EEE"><enum>(2)</enum><text>by striking
			 <quote><header-in-text level="subsection" style="OLC">Report</header-in-text>.—Not later</quote> and inserting the
			 following:</text>

			 (A) through (E) and (G) of subsection (b)(2)</quote>; and</text>
				</paragraph><paragraph id="id3EC341463EE041DCAC39B078E0678472"><enum>(4)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="id42B053B83ACF450CA51A9F06741B905B" style="OLC">
						<paragraph id="id33F317B56616415B866EEBD18DBF248E"><enum>(2)</enum><header>Safety recall
				remedy report</header><text>Not later than 1 year after the date of the
				enactment of the <quote><short-title>Raechel and
				Jacqueline Houck Safe Rental Car Act</short-title></quote>, the Secretary shall
				submit a report to the congressional committees set forth in paragraph (1) that
				contains—</text>
							<subparagraph id="id7BB75A162B804345B6504FADCA25F95B"><enum>(A)</enum><text>the findings of
				the study conducted pursuant to subsection (b)(2)(F); and</text>
							</subparagraph><subparagraph id="id05F9BA854C5B451F95637F0015AE10B9"><enum>(B)</enum><text>any
				recommendations for legislation that the Secretary determines to be
				appropriate.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection></section><section id="idDD15797490EF4335835EA6B30B973327"><enum>8.</enum><header>Public
			 comments</header><text display-inline="no-display-inline">The Secretary of
			 Transportation shall solicit comments regarding the implementation of this Act
			 from members of the public, including rental companies, consumer organizations,
			 automobile manufacturers, and automobile dealers.</text>
		</section><section id="id40279919e7574fa48aa8e61c6aea2872"><enum>9.</enum><header>Rulemaking</header><text display-inline="no-display-inline">The Secretary of Transportation may
			 promulgate rules, as appropriate, to implement this Act and the amendments made
			 by this Act.</text>
		</section><section id="idd6ee2a1c7345452b9f5d49937dd1b791"><enum>10.</enum><header>Effective
			 date</header><text display-inline="no-display-inline">The amendments made by
			 this Act shall take effect on the date that is 180 days after the date of the
			 enactment of this Act.</text>
