		<official-title>To reassert the proper role of Congress in closing or
		  realigning military installations. </official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Limitations on base closure
			 and realignment activities and criteria for certain decisions involving such
			 activities</header>
			<subsection id="idB67E76806CC443B4A5BB98C2A464D755"><enum>(a)</enum><header>Findings</header><text>Congress
			 makes the following findings:</text>
				<paragraph id="idb35431138d4a4a8194d291da1dc151ae"><enum>(1)</enum><text>In 2012, the
			 Department of Defense requested additional rounds of defense base closure and
			 realignment in 2013 and 2015.</text>
				</paragraph><paragraph id="id2a60f1660e2c45949416dd4f638e7f82"><enum>(2)</enum><text>There have been
			 five rounds of defense base closure and realignment (BRAC) in the last 25 years
			 (1988, 1991, 1993, 1995, and 2005).</text>
				</paragraph><paragraph id="id21516a0bfd13400fb6be1254257d503c"><enum>(3)</enum><text>Congress has not
			 approved additional rounds of base closure and realignment to occur after 2005,
			 and recognizes that the 2005 round incurred substantial costs that will not be
			 offset by savings for nearly two decades.</text>
				</paragraph><paragraph id="id30213b43b21b4b93b268e437be524295"><enum>(4)</enum><text>According to the
			 Government Accountability Office, implementation of the 2005 round of defense
			 base closure and realignment cost $35,100,000,000, or approximately
			 $14,100,000,000 more than was estimated by the 2005 Base Closure and
			 Realignment Commission.</text>
				</paragraph><paragraph id="id0aecaba326614fb78eedba90388488d8"><enum>(5)</enum><text>Furthermore, the
			 Government Accountability Office has determined that the 2005 round of defense
			 base closure and realignment will take 17 years before taxpayers realize net
			 savings from the round.</text>
				</paragraph><paragraph id="idf46984db7e4d40babb6eb853964d4e50"><enum>(6)</enum><text>On March 8, 2012,
			 defending the request for additional rounds of defense base closure and
			 realignment in testimony before the Committee on Armed Services of the House of
			 Representatives, Dr. Dorothy Robyn, Deputy Undersecretary of Defense for
			 Installations and Environment, asserted that the Department of Defense would
			 close military installations using non-BRAC authorities, stating that <quote>if
			 Congress does not authorize additional BRAC rounds the department will be
			 forced to use its existing authorities to begin to realign and close
			 bases</quote>.</text>
				</paragraph><paragraph id="idab02ea8aa7f94be8ac7b837785ab0abc"><enum>(7)</enum><text>The Department of
			 Defense may close or realign bases only if a round of defense base closure and
			 realignment is carried out in compliance with sections 2687 and 993 of title
			 10, United States Code.</text>
				</paragraph><paragraph id="id89cce81772e64d938c5d92d97033aac2"><enum>(8)</enum><text>Section 2687 of
			 title 10, United States Code, contains ambiguous language, leading the
			 Department of Defense to pursue significant closures and realignments without
			 congressional approval or an authorization for a round of defense base closure
			 and realignment.</text>
				</paragraph><paragraph id="id128b46fb9fc846c4bcdff8dc6bfa41ff"><enum>(9)</enum><text>Sections 2687 and
			 993 of title 10, United States Code, contain single action limits on reductions
			 that are too easily circumvented by cumulative actions.</text>
				</paragraph><paragraph id="idb1eb271cd87a444f80cd2beca8888888"><enum>(10)</enum><text>As demonstrated
			 by BRAC and other closure and realignment actions, base closures and
			 realignments can have significant effects on Department of Defense functions,
			 current and future operational capabilities, and on host communities and
			 States.</text>
				</paragraph><paragraph id="id3630d9e0cab949e681cb4931e40501b3"><enum>(11)</enum><text>Recommendations
			 for closures and realignments should be carried out only with the consent of
			 Congress, which has the constitutional responsibility to <quote>raise and
			 support Armies,</quote><quote>provide and maintain a Navy,</quote><quote>make
			 Rules for the Government and Regulation of the land and naval Forces,</quote>
			 and <quote>provide for organizing, arming, and disciplining, the Militia, and
			 for governing such Part of them as may be employed in the Service of the United
			 States</quote>.</text>
				</paragraph></subsection><subsection id="idF20A5856228945259C765130DE538538"><enum>(b)</enum><header>Limitations on
			 base closure and realignment activities</header><text>Section 2687 of title 10,
			 United States Code, is amended—</text>
				<paragraph id="idC24FE164FCB54B3AA0FDA59559D33389"><enum>(1)</enum><text>in subsection
			 (a)—</text>
					<subparagraph id="idC661593E800041048E2CD5E33349397A"><enum>(A)</enum><text>in paragraph (1),
			 by striking <quote>at which at least 300 civilian personnel are authorized to
			 be employed</quote>;</text>
					</subparagraph><subparagraph id="idD8EF8A5B95AE4303B0C03827BCA9D72E"><enum>(B)</enum><text>by amending
			 paragraph (2) to read as follows:</text>
						<quoted-block act-name="" id="idCD106472DD9F460E8E4D074FE50CE761" style="OLC">
							<paragraph id="idD345C58E82304685A95F3CFBA10A8150"><enum>(2)</enum><text>any realignment
				with respect to any military installation involving a reduction in the number
				of military and civilian personnel authorized to be employed at such military
				installation at the time the Secretary of Defense notifies Congress under
				subsection (b) of the Secretary's proposal to close or realign such
				installation by more than the lesser of—</text>
								<subparagraph id="id494CE7CA46EC4CC78473BD0423AF396A"><enum>(A)</enum><text>100; or</text>
								</subparagraph><subparagraph id="id58570534500C41EBA175D482B7896123"><enum>(B)</enum><text>50 percent of the
				highest number of military and civilian personnel assigned to such installation
				during any of the previous 4 years; or</text>
								</subparagraph></paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="id12A9797DFEB24C3D95F8CFA14C1975E0"><enum>(C)</enum><text>in paragraph
			 (3)—</text>
						<clause commented="no" id="id0F2484935150491ABA7BBD795968016F"><enum>(i)</enum><text>by striking
			 <quote>other than a military installation referred to in clause (1) or
			 (2)</quote>;</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="id2A867259BE8A450DBD9D3A111FF187B8"><enum>(ii)</enum><text>by inserting
			 <quote>military or</quote> before <quote>civilian personnel</quote>; and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="id71F25BA716F4494599A95BC87983F15B"><enum>(iii)</enum><text>by striking
			 <quote>to which clause (1) or (2)</quote> and inserting <quote>to which
			 paragraph (1) or (2)</quote>;</text>
						</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id817E78226F12436684545410508BE688"><enum>(2)</enum><text>in subsection
			 (b)—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="id07CC060ED59049BD8F1A0127527E0D7D"><enum>(A)</enum><text>by striking
			 <quote>referred to in such subsection</quote>;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id82BF2620EFA547E49AF55925C64FBB8A"><enum>(B)</enum><text>in paragraph
			 (1)—</text>
						<clause commented="no" display-inline="no-display-inline" id="idEB89C70863DA4CF59A8444B6B493455E"><enum>(i)</enum><text>by striking
			 <quote>or the Secretary of the military department concerned</quote>;</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="id562B0D771A684DD3B9E0F706911F01A0"><enum>(ii)</enum><text>by redesignating
			 subparagraphs (A) and (B) as subparagraphs (B) and (D), respectively;</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="id29B16A9B1491465FB7EB288C52253579"><enum>(iii)</enum><text>by inserting
			 before subparagraph (B), as redesignated by clause (ii), the following new
			 subparagraph:</text>
							<quoted-block act-name="" id="id23742AEA83D542A28279A41C41544BF6" style="OLC">
								<subparagraph id="id28214CD90867413A933C281DE3C0D01E"><enum>(A)</enum><text>a justification
				for the proposed
				action;</text>
								</subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
						</clause><clause commented="no" display-inline="no-display-inline" id="idC53E8C71E415481BB9D8CDBDC575FF9F"><enum>(iv)</enum><text>in subparagraph
			 (B), as so redesignated, by striking <quote>; and</quote> and inserting a
			 semicolon;</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="idDC03CB4D57CD4BA3B4E8B02318B14153"><enum>(v)</enum><text>by inserting
			 after subparagraph (B), as so redesignated, the following new
			 subparagraph:</text>
							<quoted-block act-name="" id="id7CF673B33D764C508C31294747F36300" style="OLC">
								<subparagraph id="id317222D71079404CB3B04BB28BA95A72"><enum>(C)</enum><text>a description of
				the alternatives
				considered;</text>
								</subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
						</clause><clause commented="no" display-inline="no-display-inline" id="id43394B1A6B714523867F45866C96A0DE"><enum>(vi)</enum><text>in clause (ii)
			 of subparagraph (D), as so redesignated, by striking <quote>; and</quote> and
			 inserting a semicolon; and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="id682E2120B9F847388E696F3E89AF25ED"><enum>(vii)</enum><text>by inserting
			 after subparagraph (D), as so redesignated, the following new
			 subparagraphs:</text>
							<quoted-block act-name="" id="idB40F6F38D25A4FF0940724F1FA0184BA" style="OLC">
								<subparagraph id="id34CFE5E109CE48568D0C5F7EADD0A843"><enum>(E)</enum><text>an estimate of
				the number of military, civilian, and contractor personnel affected by the
				proposed action; and</text>
								</subparagraph><subparagraph id="idF4D093C3DDE1475C8D1BD1BD76A14C0A"><enum>(F)</enum><text>a plan to provide
				support for affected communities; and</text>
								</subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id392025FC44724F7E8485F01E0C575EBB"><enum>(C)</enum><text>by amending
			 paragraph (2) to read as follows:</text>
						<quoted-block act-name="" id="idAF550806627344EE8183DBE31E905797" style="OLC">
							<paragraph id="id5E1453C9F7204BF292124BE63949C3C9"><enum>(2)</enum><text>Congress has
				enacted legislation expressly authorizing the
				action.</text>
							</paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idB9F9F39594E1498C81EA929CADBEE91D"><enum>(3)</enum><text>in subsection
			 (c)—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="idBEB17F44FA464FFC85EC74613995A18E"><enum>(A)</enum><text>by striking
			 <quote>shall not apply to the closure</quote> and inserting the following:
			 “shall not apply—</text>
						<quoted-block act-name="" id="id8DF80DA37E0C479681E44AF61BA180AD" style="OLC">
							<paragraph id="idD8EB2E96E90A477B99E58D1104DB08C8"><enum>(1)</enum><text>to the
				closure</text>
							</paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id04F4CCEC1EB146188DB5068BA937C0D8"><enum>(B)</enum><text>by striking
			 <quote>or a military emergency.</quote> and inserting <quote>or a military
			 emergency; or</quote>; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id23ACAD094C644F0D8F4CFA77FC448E24"><enum>(C)</enum><text>by adding at the
			 end the following new paragraph:</text>
						<quoted-block act-name="" id="id4BFF149DCF2744D7AB5E781EF0C62915" style="OLC">
							<paragraph id="idD9C142FED91845DD86CE96A74A57C4DD"><enum>(2)</enum><text>to the relocation
				from a military installation of personnel or functions that are required to
				support the deployment of members of the armed forces, provided that such
				personnel and functions are returned to the military installation after the
				deployment.</text>
							</paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC50AB8182B7540B99B4BC646EBB519F8"><enum>(4)</enum><text>in subsection
			 (d), by striking <quote>(1) After the expiration</quote> and all that follows
			 through <quote>(2) Nothing in this section</quote> and inserting <quote>Nothing
			 in this section</quote>;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id478B1EFDB4994219871FDE4061354DEC"><enum>(5)</enum><text>in subsection
			 (e)—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="id29F53A419892466BB9467080576738C4"><enum>(A)</enum><text>in paragraph (1),
			 by inserting <quote>and any public land under Bureau of Land Management control
			 that is withdrawn and reserved for military training and testing</quote> after
			 <quote>including any leased facility</quote>;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idBB04DBDB3D7641479ADABB607505CE11"><enum>(B)</enum><text>by amending
			 paragraph (3) to read as follows:</text>
						<quoted-block display-inline="no-display-inline" id="id48ACDF6615BF4DF39AD91E1C57DC000C" style="OLC">
							<paragraph commented="no" display-inline="no-display-inline" id="id4205D805359A4F63B8A994126F95E5E1"><enum>(3)</enum><text>The term
				<term>realignment</term> includes any action or combination of actions within a
				4-year period that reduces or relocates functions and military or civilian
				personnel positions, but does not include a reduction in force resulting from a
				reduction in military end strength levels or a reduction in total civilian
				personnel
				levels.</text>
							</paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id71E9E53460A64C40AEDCF92EB056DB6A"><enum>(C)</enum><text>by striking
			 paragraph (4); and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idEECDFF504A2D4F078EFB1DDAE7B17743"><enum>(D)</enum><text>by adding at the
			 end the following new paragraph:</text>
						<quoted-block act-name="" id="idE756EE6CAB384931BFBCD462180D8251" style="OLC">
							<paragraph id="id4559D1FB6E7540A6B2AC751CBAA00FA4"><enum>(4)</enum><text>The term
				<term>closure</term> includes any action or combination of actions that results
				in the elimination of all active functions at a military installation, the
				elimination of all military and civilian personnel positions at a military
				installation, or the placement of a military installation into non-active
				status.</text>
							</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id612881DD3BDB492CA5468654E53593B7"><enum>(6)</enum><text>by adding at the
			 end the following new subsections:</text>
					<quoted-block act-name="" id="id073905A9061449EAA9DCD9A6499065D0" style="OLC">
						<subsection id="id801EA35CBDEE4A6A90FE5AE1FC84F94B"><enum>(g)</enum><text>For purposes of
				this section, the component bases of a joint base shall be considered as
				independent military installations, and not collectively as a single military
				installation.</text>
						</subsection><subsection id="id952D953116DB481E93F8D75674B99D4A"><enum>(h)</enum><text>For purposes of
				this section, any leased space in which more than 300 combined military and
				civilian personnel are housed shall be considered to be an independent military
				installation, and shall not be considered part of a larger military
				installation. Functions and personnel located at a leased space may be
				transferred to another leased space located within 50 miles or to the nearest
				military installation located within 50 miles notwithstanding any limitations
				in this
				section.</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
