		<official-title>To reaffirm and amend the National Aeronautics and Space
		  Administration Authorization Act of 2010, and for other
		  purposes.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Space Exploration Sustainability
			 Act</short-title></quote>.</text>
		</section><section id="idB914C3CB99674D508192BAAE38789D12"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress makes the following
			 findings:</text>
			<paragraph id="idBBD3CF6E599244808AF47E07E5BC2DF1"><enum>(1)</enum><text>A robust and
			 balanced space program enhances the United States long-term national and
			 economic security by—</text>
				<subparagraph id="id88B8CA43C7FB4914A5838603DD2E14DD"><enum>(A)</enum><text>inspiring
			 students to pursue disciplines in science, technology, engineering, and
			 mathematics;</text>
				</subparagraph><subparagraph id="id2BC5DE7B3DCF4E98AF3571A07C0A9B15"><enum>(B)</enum><text>stimulating
			 development of advanced technologies with widespread applications;</text>
				</subparagraph><subparagraph id="idC7406F9440A64C37A1B71192AD633537"><enum>(C)</enum><text>increasing the
			 United States technological competitiveness; and</text>
				</subparagraph><subparagraph id="id68DA6AB8ED524FDF93509B582332E298"><enum>(D)</enum><text>enhancing global
			 prosperity and security through cooperation in shared interests, such as
			 advancement of science, understanding of Earth and the universe, and protection
			 from space borne threats, such as asteroids.</text>
				</subparagraph></paragraph><paragraph id="id50040DC14A6743BCB6DA77BAEBD97CA2"><enum>(2)</enum><text>The Nation’s
			 space program should include endeavors that balance—</text>
				<subparagraph id="idC7517489473E4D5BAB660189271A992C"><enum>(A)</enum><text>national security
			 space and civil space;</text>
				</subparagraph><subparagraph id="id480B7B5DB0DE4D7B801E8272E54EC78F"><enum>(B)</enum><text>robotic and human
			 exploration;</text>
				</subparagraph><subparagraph id="idD3DC5B84470A4B01B6185A29424AF35B"><enum>(C)</enum><text>advancement of
			 scientific knowledge and engagement of the general public;</text>
				</subparagraph><subparagraph id="id459F25BF08F640949E845F67A3B48DBA"><enum>(D)</enum><text>U.S. Government
			 led launch capability development, including the Space Launch System and
			 multi-purpose crew vehicle, and partnerships with commercial and international
			 entities;</text>
				</subparagraph><subparagraph id="id774D9778B47D4F29A16594926407CD03"><enum>(E)</enum><text>advancement of
			 the space frontier and stimulation of commerce within Earth Orbit; and</text>
				</subparagraph><subparagraph id="idB12BBEDDDBA44E769A90B718E16CA74F"><enum>(F)</enum><text>peering outward
			 to further understanding of the universe and observing Earth to expand
			 knowledge of our home planet.</text>
				</subparagraph></paragraph><paragraph id="idC142BDC632B94F309402D9949E764A29"><enum>(3)</enum><text>The National
			 Aeronautics and Space Administration Authorization Act of 2010 (42 U.S.C. 18301
			 et seq.) provides for a robust and balanced national space program.</text>
			</paragraph></section><section id="id78EF09A702B54903BBC6D350D0C35262"><enum>3.</enum><header>Goals and
			 objectives</header><text display-inline="no-display-inline">Section 202 of the
			 National Aeronautics and Space Administration Authorization Act of 2010 (42
			 U.S.C. 18312) is amended—</text>
			<paragraph id="id07D1E77ED63B46EF8D1BD2AD2B35747B"><enum>(1)</enum><text>by amending
			 subsection (a) to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="id1FC782FE8417416294493A7383947EB5" style="OLC">
					<subsection id="id6A61278643A248289749BE7A9EAFFD86"><enum>(a)</enum><header>Long-Term
				goal</header><text>The long-term goal of the human space flight and exploration
				efforts of NASA shall be to sustainably expand permanent human presence beyond
				low-Earth orbit and to do so, where practical, in a manner involving
				international partners and expanding economic activity in
				space.</text>
					</subsection><after-quoted-block>;
				and</after-quoted-block></quoted-block>
			</paragraph><paragraph id="idF63D990D3F2744CAAB989727FD585280"><enum>(2)</enum><text>in subsection
			 (b)(2), by inserting <quote>and expanding throughout cis-lunar space and
			 beyond</quote> after <quote>infrastructure</quote>.</text>
			</paragraph></section><section id="idF8658D1ADA5949BBAB1666A3CD89C9B8"><enum>4.</enum><header>Report on
			 cis-lunar space</header>
			<subsection id="idEC3C7CABC02C40CB91336BF089EC230D"><enum>(a)</enum><header>In
			 general</header><text>Not later than 120 days after the date of enactment of
			 this Act, the Administrator of the National Aeronautics and Space
			 Administration shall submit to Congress a strategy to achieve the long-term
			 goal of sustainably expanding a human presence beyond low-Earth orbit under
			 section 202(a) of the National Aeronautics and Space Administration
			 Authorization Act of 2010 (42 U.S.C. 18312(a)) through robust utilization of
			 cis-lunar space.</text>
			</subsection><subsection id="id2F4B1021E1CC41E892457DE4145461E3"><enum>(b)</enum><header>Requirements</header><text>The
			 strategy shall include a discussion of—</text>
				<paragraph id="id93CFDA3A1BBC408EAE47A6960920BA5C"><enum>(1)</enum><text>the utility of an
			 expanded permanent human presence in cis-lunar space to enable missions to the
			 lunar surface, asteroids, the Mars system, and other destinations of interest
			 for future human exploration;</text>
				</paragraph><paragraph id="id65E6AAE2E0B743AAB75692BFAEBBE194"><enum>(2)</enum><text>the utility of an
			 expanded permanent human presence in cis-lunar space to economic, scientific,
			 and technological advances;</text>
				</paragraph><paragraph id="id9017B5BECE8C4E7986F77ADF886C5E94"><enum>(3)</enum><text>the opportunities
			 for—</text>
					<subparagraph id="id6B74C42A0F64422A9BA634B39197BDAD"><enum>(A)</enum><text>international
			 partner collaboration toward the establishment and continuance of an expanded
			 permanent human presence in cis-lunar space;</text>
					</subparagraph><subparagraph id="idD67812191AD54D0EAC13548CDC561ECF"><enum>(B)</enum><text>international
			 partner contributions to the missions listed under paragraph (1) that are
			 uniquely enabled by mission architectures that make use of an expanded and
			 persistent human presence in cis-lunar space;</text>
					</subparagraph><subparagraph id="idFB8D59A569B74E5885BEE187D9CF74C3"><enum>(C)</enum><text>commercial
			 industry participation toward the expansion and continuance of permanent human
			 presence in cis-lunar space;</text>
					</subparagraph><subparagraph id="idB914B9C091F04314B8D6DC43CBE1D43A"><enum>(D)</enum><text>commercial
			 industry contributions to the missions listed under paragraph (1) that are
			 uniquely enabled by mission architectures that make use of an expanded and
			 persistent human presence in cis-lunar space; and</text>
					</subparagraph><subparagraph id="idC34A6AFD8EA44B2A9377E0E5201A7041"><enum>(E)</enum><text>commercial
			 ventures that result from an expanded and persistent human presence in
			 cis-lunar space;</text>
					</subparagraph></paragraph><paragraph id="idFA56AF32625147A2B5C9EAA0DC01BF78"><enum>(4)</enum><text>the opportunities
			 and uses for the National Aeronautics and Space Administration managed
			 allocation of the International Space Station National Laboratory, including a
			 specific discussion of high priority scientific and technological developments
			 that use the International Space Station toward expanding and sustaining a
			 human presence in cis-lunar space; and</text>
				</paragraph><paragraph id="id06CBEAC6C1264979BBB4D3D651C64DA6"><enum>(5)</enum><text>a range of
			 exploration mission architectures for the missions listed under paragraph
			 (1).</text>
				</paragraph></subsection><subsection id="idAADADEBB0793413EBC7F3A25F58DDED9"><enum>(c)</enum><header>Comparison of
			 architectures</header>
				<paragraph id="idA8EB0C71F8E04D05BE86D55F7A2F7110"><enum>(1)</enum><header>In
			 general</header><text>The strategy shall include a comparison of architectures
			 that use an expanded and persistent human presence in cis-lunar space and
			 architectures that do not, with a primary objective of identifying the
			 architectures and approaches that—</text>
					<subparagraph id="idB9EABFBD8E0945829849334E0F5EA99C"><enum>(A)</enum><text>best support the
			 long-term goal under section 202(a) of the National Aeronautics and Space
			 Administration Authorization Act of 2010 (42 U.S.C. 18312(a)); and</text>
					</subparagraph><subparagraph id="idEEC287807A294559A632A4915FC69916"><enum>(B)</enum><text>are enabled by
			 the transportation capabilities developed under titles III and IV of the
			 National Aeronautics and Space Administration Authorization Act of 2010 (42
			 U.S.C. 18301 et seq.).</text>
					</subparagraph></paragraph><paragraph id="id24D984B0CE0242A1A8E36C654AA17821"><enum>(2)</enum><header>Factors</header><text>Factors
			 to be considered in the comparison shall include recurring and non-recurring
			 cost, safety, sustainability, opportunities for international collaboration,
			 enabling of new markets and opportunities for commercial industry, compelling
			 scientific opportunities, flexibility of the architecture to adjust to evolving
			 technologies, and leadership and priorities over time.</text>
				</paragraph></subsection><subsection id="idF15D6B42C9CE45D0A7E0565A38706376"><enum>(d)</enum><header>Implementation
			 plan</header><text>The strategy shall include a plan that establishes a method
			 and schedule for implementation of the strategy. The implementation plan shall
			 include—</text>
				<paragraph id="id0B6C2069B77448D8B0943E6293879216"><enum>(1)</enum><text>proposed Program
			 Formulation events;</text>
				</paragraph><paragraph id="id73A9CCD05D8545ED82E2CAA67DC8CBEE"><enum>(2)</enum><text>Program Critical
			 Design Reviews;</text>
				</paragraph><paragraph id="id25DB1F44174148F2BAD94ADC76500B2C"><enum>(3)</enum><text>System
			 Integration Reviews;</text>
				</paragraph><paragraph id="id890300BAA8154D18ADAA61D0323293EC"><enum>(4)</enum><text>Systems Assembly,
			 Integration and Test milestones; and</text>
				</paragraph><paragraph id="idD3F990029E6D4A1CA81937FCBFE91E0D"><enum>(5)</enum><text>schedules of
			 planned test launches and events, up to and including initial missions.</text>
				</paragraph></subsection></section><section id="id9F417F67FBA84951B3A76DCBB2424A26"><enum>5.</enum><header>Assurance of
			 Core Capabilities</header><text display-inline="no-display-inline">Section 203
			 of the National Aeronautics and Space Administration Authorization Act of 2010
			 (42 U.S.C. 18313) is amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="idEFEE4399B7F146ADBB338770F16777BB" style="OLC">
				<subsection id="idCA7A97ABBE44453590992AA70A9C19C9"><enum>(c)</enum><header>Assurance of
				Core Capabilities</header><text display-inline="yes-display-inline">The
				Administrator shall proceed with the utilization of the ISS, technology
				development, and follow-on transportation systems, including the Space Launch
				System, multi-purpose crew vehicle, and commercial crew and cargo
				transportation capabilities authorized by this Act in a manner that
				ensures—</text>
					<paragraph id="id55EB5F35D9C247DB91B477D20B578FF7"><enum>(1)</enum><text display-inline="yes-display-inline">that these capabilities remain inherently
				complimentary and interrelated;</text>
					</paragraph><paragraph id="idB285C1E2A0D24BAF90A048CA079E93FE"><enum>(2)</enum><text display-inline="yes-display-inline">a balance of the development, sustainment,
				and use of each of these capacities, which are of critical importance to the
				viability and sustainability of the U.S. space program; and</text>
					</paragraph><paragraph id="idB52E13B58F2047FD8B6398E288DF14F7"><enum>(3)</enum><text display-inline="yes-display-inline">that resources required to support the
				timely and sustainable development of these capabilities are not derived from a
				reduction in resources from one capability as a means of increasing resources
				to support another
				capability.</text>
					</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="idBB529CBE17274B2EA04DD12053BBA4A5"><enum>6.</enum><header>Extension of
			 certain space launch liability provisions</header><text display-inline="no-display-inline">Section 50915(f) of title 51, United States
			 Code, is amended by striking <quote>December 31, 2012</quote> and inserting
			 <quote>December 31, 2014</quote>.</text>
		</section><section id="id24EFA3AEC61344C4A183A2CFA6FD8AC2"><enum>7.</enum><header>Exemption from
			 INKSNA</header><text display-inline="no-display-inline">Section 7(1) of the
			 Iran, North Korea, and Syria Nonproliferation Act (50 U.S.C. 1701 note) is
			 amended to read as follows:</text>
			<quoted-block display-inline="no-display-inline" id="idF970C026F190476DAE1B8704FD5016F3" style="OLC">
				<paragraph id="id8D63A2C988C0445F9816402D96117E2F"><enum>(1)</enum><header>Extraordinary
				payments in connection with the international space station</header><text>The
				term <term>extraordinary payments in connection with the International Space
				Station</term> means payments in cash or in-kind made or to be made by the
				United States Government for work on the International Space Station which the
				Russian Government pledged at any time to provide at its
				expense.</text>
				</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
