		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Metal Theft Prevention Act of
			 2012</short-title></quote>.</text>
		</section><section id="ID59af58caeaa24e85b758475b04c725bc"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act—</text>
			<paragraph id="IDcd6e8b948d5c47f88c689a2fc555a180"><enum>(1)</enum><text>the term
			 <term>critical infrastructure</term> has the meaning given the term in section
			 1016(e) of the Uniting and Strengthening America by Providing Appropriate Tools
			 Required to Intercept and Obstruct Terrorism (USA PATRIOT ACT) Act of 2001 (42
			 U.S.C. 5195c(e));</text>
			</paragraph><paragraph id="id790C95921ECC423C9EC7B6C2E8D97AC8"><enum>(2)</enum><text>the term
			 <term>specified metal</term> means metal that—</text>
				<subparagraph id="ID6203588f6feb4224bd320fb3dfe48239"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="id0BC57C4B66C946C1B8CD3360E7B4C8AC"><enum>(i)</enum><text>is marked with the
			 name, logo, or initials of a city, county, State, or Federal government entity,
			 a railroad, an electric, gas, or water company, a telephone company, a cable
			 company, a retail establishment, or a public utility; or</text>
					</clause><clause id="id4C28BA51F53040A38E4F68D46CC0D2E4" indent="up1"><enum>(ii)</enum><text>has been altered in such a manner
			 that a recycling agent would have a reasonable basis to believe that such
			 alteration was made for the purpose of removing, concealing, or obliterating a
			 name, logo, or initials described in clause (i) through burning or cutting of
			 wire sheathing or other means; or</text>
					</clause></subparagraph><subparagraph id="idAE5024B9E63E4890BB394DB5B1AF8968"><enum>(B)</enum><text>is part
			 of—</text>
					<clause id="ID9dd30945e92b4758b3c437cdccd86213"><enum>(i)</enum><text>a
			 street light pole or fixture;</text>
					</clause><clause id="ID5aabfcf0f4124bbfb0f97ee62c7999e4"><enum>(ii)</enum><text>a
			 road or bridge guard rail;</text>
					</clause><clause id="ID7c6b431e7b1343eca8d9f9ac7cecf372"><enum>(iii)</enum><text>a
			 highway or street sign;</text>
					</clause><clause id="ID1aa3fc7b74d749ca9787413a54088da0"><enum>(iv)</enum><text>a
			 water meter cover;</text>
					</clause><clause id="IDb9633e4c49e3474cba186a858fc97ef2"><enum>(v)</enum><text>a
			 storm water grate;</text>
					</clause><clause id="id8181EB11384B4FC1B90D21D2F95D7493"><enum>(vi)</enum><text>unused or
			 undamaged building construction or utility material;</text>
					</clause><clause id="idFFA86E70EA0E40E69032D026A049FCA1"><enum>(vii)</enum><text>a
			 historical marker;</text>
					</clause><clause id="id05CF8D92A2F044A28F80D5079212DC82"><enum>(viii)</enum><text>a grave marker
			 or cemetery urn;</text>
					</clause><clause id="ID6ab6633839ec492f86620fbc1f19a922"><enum>(ix)</enum><text>a
			 utility access cover; or</text>
					</clause><clause id="id488BFDEEEE3E4651B8CA4A127DBDAEF6"><enum>(x)</enum><text>a
			 container used to transport or store beer with a capacity of 7.75 gallons or
			 more;</text>
					</clause></subparagraph><subparagraph id="ID89b9010fd5ca425e8f40cc94f46cd655"><enum>(C)</enum><text>is a wire or
			 cable commonly used by communications and electrical utilities; or</text>
				</subparagraph><subparagraph id="ID6db467469e8a4ee48405bc7b8a8f16f7"><enum>(D)</enum><text>is copper,
			 aluminum, and other metal (including any metal combined with other materials)
			 that is valuable for recycling or reuse as raw metal, except for aluminum cans;
			 and</text>
				</subparagraph></paragraph><paragraph id="ID8949f0bca9ec4d1db732e6de2df57caf"><enum>(3)</enum><text>the term
			 <term>recycling agent</term> means any person engaged in the business of
			 purchasing specified metal for reuse or recycling, without regard to whether
			 that person is engaged in the business of recycling or otherwise processing the
			 purchased specified metal for reuse.</text>
			</paragraph></section><section id="id6874C016F86D496689D15D20AC600607"><enum>3.</enum><header>Theft of
			 specified metal</header>
			<subsection id="id1CE4983567D840498176B8FB8ADC338A"><enum>(a)</enum><header>Offense</header><text display-inline="yes-display-inline">It shall be unlawful to steal specified
			 metal—</text>
				<paragraph id="id2F71AF3AF53E41BA8F1FF9A4D202CC0C"><enum>(1)</enum><text display-inline="yes-display-inline">being used in or affecting interstate or
			 foreign commerce; and</text>
				</paragraph><paragraph id="id2CBA5562B6BC4CB384FD0D3F928E9BAC"><enum>(2)</enum><text display-inline="yes-display-inline">the theft of which harms critical
			 infrastructure, including metal used as part of an electrical substation, power
			 line, cellular tower, telephone land line, highway equipment and facilities,
			 railroad equipment and facilities, water well, reservoir, or sewage
			 line.</text>
				</paragraph></subsection><subsection id="id282EE10C77544ADBACFF3F94EBFB2E1F"><enum>(b)</enum><header>Penalty</header><text display-inline="yes-display-inline">Any person who commits an offense described
			 in subsection (a) shall be fined under title 18, United States Code, imprisoned
			 not more than 10 years, or both.</text>
			</subsection></section><section id="ID7da52a5d0e4f4f8ba100816f13fd69b9"><enum>4.</enum><header>Documentation of
			 ownership or authority to sell</header>
			<subsection id="IDb3b023d2aaa84a12bcf3668a7543ab9c"><enum>(a)</enum><header>Offenses</header>
				<paragraph commented="no" id="id07163A0F1366447CB21D79202F86D031"><enum>(1)</enum><header>In
			 general</header><text>Except as provided in paragraph (2), it shall be unlawful
			 for a recycling agent to purchase specified metal described in subparagraph (A)
			 or (B) of section 2(2), unless—</text>
					<subparagraph commented="no" id="id0DD6A6FCC31F4F7BB6E00AA8AB5EA651"><enum>(A)</enum><text>the seller, at
			 the time of the transaction, provides documentation of ownership of, or other
			 proof of the authority of the seller to sell, the specified metal; and</text>
					</subparagraph><subparagraph commented="no" id="idDB489A7D9257431589CDD24F71E91D87"><enum>(B)</enum><text>there is a
			 reasonable basis to believe that the documentation or other proof of authority
			 provided under subparagraph (A) is valid.</text>
					</subparagraph></paragraph><paragraph id="idEA39C21384384A2F9CF71019CEEB2C42"><enum>(2)</enum><header>Exception</header><text>Paragraph
			 (1) shall not apply to a recycling agent that is subject to a State or local
			 law that sets forth a requirement on recycling agents to obtain documentation
			 of ownership or proof of authority to sell specified metal before purchasing
			 specified metal.</text>
				</paragraph><paragraph commented="no" id="id33A3EDD9D00A4F1CAEFAA48A30E83057"><enum>(3)</enum><header>Responsibility
			 of recycling agent</header><text>A recycling agent is not required to
			 independently verify the validity of the documentation or other proof of
			 authority described in paragraph (1).</text>
				</paragraph><paragraph id="id53EFF659BEE04C658D9A6EF60C417566"><enum>(4)</enum><header>Purchase of
			 stolen metal</header><text>It shall be unlawful for a recycling agent to
			 purchase any specified metal that the recycling agent knows, or has a
			 reasonable basis to believe, to be stolen.</text>
				</paragraph></subsection><subsection id="idBF4BE936C2F34A90B87BAA6A77B3C2B7"><enum>(b)</enum><header>Civil
			 penalty</header><text>A person who knowingly violates subsection (a) shall be
			 subject to a civil penalty of not more than $10,000 for each violation.</text>
			</subsection></section><section id="IDe4dc709f85c348adb72f6956e41d021b"><enum>5.</enum><header>Transaction
			 requirements</header>
			<subsection id="id677836B8EDD14F9A8E3BAB035E5926FA"><enum>(a)</enum><header>Recording
			 requirements</header>
				<paragraph id="ID03ec7ebf8d2748cbb076afd7362ee0f2"><enum>(1)</enum><header>In
			 general</header><text>Except as provided in paragraph (2), a recycling agent
			 shall maintain a written or electronic record of each purchase of specified
			 metal.</text>
				</paragraph><paragraph id="id474C0A19AE0A4BD9BA836DC31140FB06"><enum>(2)</enum><header>Exception</header><text>Paragraph
			 (1) shall not apply to a recycling agent that is subject to a State or local
			 law that sets forth recording requirements that are substantially similar to
			 the requirements described in paragraph (3) for the purchase of specified
			 metal.</text>
				</paragraph><paragraph id="IDd09c515874854de28ebfeaf8d55625e1"><enum>(3)</enum><header>Contents</header><text>A
			 record under paragraph (1) shall include—</text>
					<subparagraph id="ID3c19de4dce9a4d7ab0fbf4a61c4243d8"><enum>(A)</enum><text>the name and
			 address of the recycling agent; and</text>
					</subparagraph><subparagraph id="IDfd54c54059324adcaccefa770c297840"><enum>(B)</enum><text>for each purchase
			 of specified metal—</text>
						<clause id="IDdf93789e9df74489833af7d82a3f50cc"><enum>(i)</enum><text>the
			 date of the transaction;</text>
						</clause><clause commented="no" id="ID93753f7eb6ce4389bd1de99c13ffe22b"><enum>(ii)</enum><text>a description of
			 the specified metal purchased using widely used and accepted industry
			 terminology;</text>
						</clause><clause id="IDb0d994b0273e4f3b9296c147f1a39c89"><enum>(iii)</enum><text>the amount paid
			 by the recycling agent;</text>
						</clause><clause id="IDadfc73d062164ef89c673ec0acdff702"><enum>(iv)</enum><text>the name and
			 address of the person to which the payment was made;</text>
						</clause><clause id="IDfecc2c1f755d4c5798e37fe81989ebe3"><enum>(v)</enum><text>the
			 name of the person delivering the specified metal to the recycling agent,
			 including a distinctive number from a Federal or State government-issued photo
			 identification card and a description of the type of the identification;
			 and</text>
						</clause><clause id="ID3c4bbf926d5c46ce989f2910413606d0"><enum>(vi)</enum><text>the license
			 plate number and State-of-issue, make, and model, if available, of the vehicle
			 used to deliver the specified metal to the recycling agent.</text>
						</clause></subparagraph></paragraph><paragraph id="ID7499687aece64d47bdc74aad74db1960"><enum>(4)</enum><header>Repeat
			 sellers</header><text>A recycling agent may comply with the requirements of
			 this subsection with respect to a purchase of specified metal from a person
			 from which the recycling agent has previously purchased specified metal
			 by—</text>
					<subparagraph id="ID2eb313726508481e9797d30dd93e4055"><enum>(A)</enum><text>reference to the
			 existing record relating to the seller; and</text>
					</subparagraph><subparagraph id="ID72eadb9a670f469998a32d79f769c404"><enum>(B)</enum><text>recording any
			 information for the transaction that is different from the record relating to
			 the previous purchase from that person.</text>
					</subparagraph></paragraph><paragraph id="ID740ba67df5a6469b96d23588200f8367"><enum>(5)</enum><header>Record
			 retention period</header><text>A recycling agent shall maintain any record
			 required under this subsection for not less than 2 years after the date of the
			 transaction to which the record relates.</text>
				</paragraph><paragraph id="id8CBACA6A9ABF4091A6A02428E72C4C76"><enum>(6)</enum><header>Confidentiality</header>
					<subparagraph id="idB90AF96A233640AC9F1500277B2791A9"><enum>(A)</enum><header>Recycling
			 agents</header><text>A recycling agent cannot be required to provide any
			 information collected or retained under this subsection to any person other
			 than a law enforcement agency with jurisdiction over the recycling agent,
			 unless acting pursuant a court order.</text>
					</subparagraph><subparagraph id="id9C860F5B7B504DCEB70C7738DA250DD7"><enum>(B)</enum><header>Other
			 persons</header><text>Any person other than a recycling agent who receives
			 information collected or retained under this subsection from a recycling agent
			 may not provide such information to any person other than a law enforcement
			 agency with jurisdiction over the recycling agent, unless acting pursuant a
			 court order.</text>
					</subparagraph></paragraph></subsection><subsection id="IDf8ad191498d1450fbc939021da37b1b3"><enum>(b)</enum><header>Purchases in
			 excess of $100</header>
				<paragraph id="IDd89f41a9a9d746d89e055e50d328e041"><enum>(1)</enum><header>In
			 general</header><text>Except as provided in paragraph (2), a recycling agent
			 may not pay cash for a single purchase of specified metal of more than $100.
			 For purposes of this paragraph, more than 1 purchase in any 48-hour period from
			 the same seller shall be considered to be a single purchase.</text>
				</paragraph><paragraph id="idCD3D270003CE4DBB9AB4EDD72911D226"><enum>(2)</enum><header>Exception</header><text>Paragraph
			 (1) shall not apply to a recycling agent that is subject to a State or local
			 law that sets forth a maximum amount for cash payments for the purchase of
			 specified metal.</text>
				</paragraph><paragraph id="IDfd9c975245e44aeb950bd612c1d4d9ba"><enum>(3)</enum><header>Payment
			 method</header>
					<subparagraph id="ID963763d114da4e6d9cb370e7835138c9"><enum>(A)</enum><header>Occasional
			 sellers</header><text>Except as provided in subparagraph (B), for any purchase
			 of specified metal of more than $100 a recycling agent shall make payment by
			 check that—</text>
						<clause id="ID772582ad1dd842159e244b5259cfa0c7"><enum>(i)</enum><text>is
			 payable to the seller; and</text>
						</clause><clause id="ID86fc6298a3754ead9663a6d15977993f"><enum>(ii)</enum><text>includes the
			 name and address of the seller.</text>
						</clause></subparagraph><subparagraph id="IDa7e5f415c23c48b2b10d8591c12d7887"><enum>(B)</enum><header>Established
			 commercial transactions</header><text>A recycling agent may make payments for a
			 purchase of specified metal of more than $100 from a governmental or commercial
			 supplier of specified metal with which the recycling agent has an established
			 commercial relationship by electronic funds transfer or other established
			 commercial transaction payment method through a commercial bank if the
			 recycling agent maintains a written record of the payment that identifies the
			 seller, the amount paid, and the date of the purchase.</text>
					</subparagraph></paragraph></subsection><subsection id="idEE1D50B3DECD48F7A3E14F8ADF5B942A"><enum>(c)</enum><header>Civil
			 penalty</header><text>A person who knowingly violates subsection (a) or (b)
			 shall be subject to a civil penalty of not more than $10,000 for each
			 violation.</text>
			</subsection></section><section id="ID70bb57bbf952447fb710b6b25d4ca283"><enum>6.</enum><header>Enforcement by
			 Attorney General</header><text display-inline="no-display-inline">The Attorney
			 General may bring an enforcement action in an appropriate United States
			 district court against any person that engages in conduct that violates this
			 Act.</text>
		</section><section id="IDc6b3f15b749743d5b032e2ed3d03f80a"><enum>7.</enum><header>Enforcement by
			 State attorneys general</header>
			<subsection id="ID1e9895619a6b4d3e949fc1062d40854a"><enum>(a)</enum><header>In
			 general</header><text>An attorney general or equivalent regulator of a State
			 may bring a civil action in the name of the State, as parens patriae on behalf
			 of natural persons residing in the State, in any district court of the United
			 States or other competent court having jurisdiction over the defendant, to
			 secure monetary or equitable relief for a violation of this Act.</text>
			</subsection><subsection id="IDacb34b729ff543f5a56bf0d5872ed475"><enum>(b)</enum><header>Notice
			 required</header><text>Not later than 30 days before the date on which an
			 action under subsection (a) is filed, the attorney general or equivalent
			 regulator of the State involved shall provide to the Attorney General—</text>
				<paragraph id="IDd42da5d5a1a94bcea72eb7bcbe88bbee"><enum>(1)</enum><text>written notice of
			 the action; and</text>
				</paragraph><paragraph id="ID1c8f5fd45706402cbe4e25889e696f2a"><enum>(2)</enum><text>a copy of the
			 complaint for the action.</text>
				</paragraph></subsection><subsection id="ID7832ffe7f29d4b52ae35d58a8a35d06a"><enum>(c)</enum><header>Attorney
			 general action</header><text>Upon receiving notice under subsection (b), the
			 Attorney General shall have the right—</text>
				<paragraph id="ID9c24596d500e49acaa4635e2c6defa7b"><enum>(1)</enum><text>to intervene in
			 the action;</text>
				</paragraph><paragraph id="ID4d19b8e18d0142769b1d11eacdb361b1"><enum>(2)</enum><text>upon so
			 intervening, to be heard on all matters arising therein;</text>
				</paragraph><paragraph id="ID5997a2e535944928970768c1fe1cd599"><enum>(3)</enum><text>to remove the
			 action to an appropriate district court of the United States; and</text>
				</paragraph><paragraph id="IDc9fc77222d6644019692ee69dc382d69"><enum>(4)</enum><text>to file petitions
			 for appeal.</text>
				</paragraph></subsection><subsection id="IDb4cbed59d3844984b98915b365730a51"><enum>(d)</enum><header>Pending Federal
			 proceedings</header><text>If a civil action has been instituted by the Attorney
			 General for a violation of this Act, no State may, during the pendency of the
			 action instituted by the Attorney General, institute a civil action under this
			 Act against any defendant named in the complaint in the civil action for any
			 violation alleged in the complaint.</text>
			</subsection><subsection id="IDc96a1823c8a448fab3730e7a8e6fed28"><enum>(e)</enum><header>Construction</header><text>For
			 purposes of bringing a civil action under subsection (a), nothing in this
			 section regarding notification shall be construed to prevent the attorney
			 general or equivalent regulator of the State from exercising any powers
			 conferred under the laws of that State to—</text>
				<paragraph id="ID3132ca19a3ee402fb4eb509bca26d368"><enum>(1)</enum><text>conduct
			 investigations;</text>
				</paragraph><paragraph id="IDb03e4e523ec24f16ba9d530940ff3ae3"><enum>(2)</enum><text>administer oaths
			 or affirmations; or</text>
				</paragraph><paragraph id="ID0ca7db9a45d947d79d028f04fbd1178d"><enum>(3)</enum><text>compel the
			 attendance of witnesses or the production of documentary and other
			 evidence.</text>
				</paragraph></subsection></section><section id="IDbf4dd90395ad4f3e90142e6f5fdbfa35"><enum>8.</enum><header>Directive to
			 sentencing commission</header>
			<subsection id="IDf1dd465deee842d385708b06303c30d0"><enum>(a)</enum><header>In
			 general</header><text>Pursuant to its authority under section 994 of title 28,
			 United States Code, and in accordance with this section, the United States
			 Sentencing Commission, shall review and, if appropriate, amend the Federal
			 Sentencing Guidelines and policy statements applicable to a person convicted of
			 a criminal violation of section 3 of this Act or any other Federal criminal law
			 based on the theft of specified metal by such person.</text>
			</subsection><subsection id="IDf1b00a74c4864c2790dabec008e77369"><enum>(b)</enum><header>Considerations</header><text>In
			 carrying out this section, the Sentencing Commission shall—</text>
				<paragraph id="ID2f6198d063f44750b1a4b571696284c7"><enum>(1)</enum><text>ensure that the
			 sentencing guidelines and policy statements reflect the—</text>
					<subparagraph id="IDc99a8d64155b4434bee2b1b37afcb0ee"><enum>(A)</enum><text>serious nature of
			 the theft of specified metal; and</text>
					</subparagraph><subparagraph id="ID5d638663740e4cf58aab7dbe29d41a32"><enum>(B)</enum><text>need for an
			 effective deterrent and appropriate punishment to prevent such theft;</text>
					</subparagraph></paragraph><paragraph id="IDc46c54bc3f4a4a5db2abbe78431c5cc2"><enum>(2)</enum><text>consider the
			 extent to which the guidelines and policy statements appropriately account
			 for—</text>
					<subparagraph id="ID57cd43da148d42a08a328376777135fa"><enum>(A)</enum><text>the potential and
			 actual harm to the public from the offense, including any damage to critical
			 infrastructure;</text>
					</subparagraph><subparagraph id="IDd1c70ba534894a6d83be964c3256ab98"><enum>(B)</enum><text>the amount of
			 loss, or the costs associated with replacement or repair, attributable to the
			 offense;</text>
					</subparagraph><subparagraph id="IDa2f22f6408a34b6bb93b8cc736ef11d3"><enum>(C)</enum><text>the level of
			 sophistication and planning involved in the offense; and</text>
					</subparagraph><subparagraph id="IDe905cf9165b5402dbe3fbc0facda8a6a"><enum>(D)</enum><text>whether the
			 offense was intended to or had the effect of creating a threat to public health
			 or safety, injury to another person, or death;</text>
					</subparagraph></paragraph><paragraph id="ID5379c3a6c38e4673afdeefe59cb1707b"><enum>(3)</enum><text>account for any
			 additional aggravating or mitigating circumstances that may justify exceptions
			 to the generally applicable sentencing ranges;</text>
				</paragraph><paragraph id="idF7722EA524F94A94B07AFDDE1660F224"><enum>(4)</enum><text>assure reasonable
			 consistency with other relevant directives and with other sentencing guidelines
			 and policy statements; and</text>
				</paragraph><paragraph id="IDcabac0c7999e45a0af752def0b56274d"><enum>(5)</enum><text>assure that the
			 sentencing guidelines and policy statements adequately meet the purposes of
			 sentencing as set forth in section 3553(a)(2) of title 18, United States
			 Code.</text>
				</paragraph></subsection></section><section id="IDccd69431cd364925bcb1870e9321827c"><enum>9.</enum><header>State and local
			 law not preempted</header><text display-inline="no-display-inline">Nothing in
			 this Act shall be construed to preempt any State or local law regulating the
			 sale or purchase of specified metal.</text>
		</section><section id="IDca896d067b474a9f870f0caca3ee0e64"><enum>10.</enum><header>Effective
			 date</header><text display-inline="no-display-inline">This Act shall take
			 effect 180 days after the date of enactment of this Act.</text>
