		<official-title>To change the effective date for the internet publication
		  of certain information to prevent harm to the national security or endangering
		  the military officers and civilian employees to whom the publication
		  requirement applies, and for other purposes.</official-title>

	<legis-body>
		<section id="S1" section-type="section-one"><enum>1.</enum><header>Changed effective date for
			 financial disclosure forms of certain officers and employees</header>
			<subsection id="id46D91CD34F94422D80277E0FE81CF284"><enum>(a)</enum><header>In
			 general</header><text>Except with respect to financial disclosure forms filed
			 by officers and employees referred to in subsection (b), section 8(a)(1) and
			 section 11(a)(1) of the STOCK Act (5 U.S.C. App. 105 note) shall take effect on
			 December 8, 2012.</text>
			</subsection><subsection id="id7D8C4C568D454D3EB6A40AB278DE5C7A"><enum>(b)</enum><header>Financial
			 Disclosure Forms Not Subject to New Effective Date</header><text>Financial
			 disclosure forms filed by the following individuals shall not be subject to the
			 effective date under this section:</text>
				<paragraph id="id5d8d7b2d76ef41bca5116a4e892eb7f9"><enum>(1)</enum><text>The
			 President.</text>
				</paragraph><paragraph id="ide834779789e942e1bab77603e921a2d8"><enum>(2)</enum><text>The Vice
			 President.</text>
				</paragraph><paragraph id="ide874a78d00944b5da9b9d0b08043f2b8"><enum>(3)</enum><text>Any Member of
			 Congress.</text>
				</paragraph><paragraph id="id55C44D397C464C94B8630BDA0D8660BE"><enum>(4)</enum><text>Any candidate for
			 Congress.</text>
				</paragraph><paragraph id="id1668c21756824d67a2d576d98e276134"><enum>(5)</enum><text>Any officer
			 occupying a position listed in section 5312 or section 5313 of title 5, United
			 States Code, having been nominated by the President and confirmed by the Senate
			 to that position.</text>
				</paragraph></subsection></section><section id="ide161cd33c40a4f819a09172dd0808b3c"><enum>2.</enum><header>Study and
			 report</header>
			<subsection id="id87a6b31f71fa4eccba10f06b4e8654a1"><enum>(a)</enum><header>In
			 general</header><text>Not later than 30 days after the date of enactment of
			 this Act, the Director of the Office of Personnel Management shall contract
			 with the National Academy of Public Administration (referred to in this section
			 as the <quote>National Academy</quote>) to—</text>
				<paragraph id="id92F25193C973492ABACA647DABE62D35"><enum>(1)</enum><text>conduct a study
			 of issues raised by website publication of financial disclosure forms as is
			 required under the STOCK Act (Public Law 112–105; 126 Stat. 291); and</text>
				</paragraph><paragraph id="id5725A29AD23848D396C204870D4762CE"><enum>(2)</enum><text>issue a report
			 containing findings and recommendations.</text>
				</paragraph></subsection><subsection id="id26C407D6E61F4D27987584252006D135"><enum>(b)</enum><header>Scope of
			 Study</header><text>The study conducted under subsection (a)(1) shall—</text>
				<paragraph id="id8a7fd65414df481bb7eb0774645d75e7"><enum>(1)</enum><text>examine the
			 nature, scope, and degree of risk, including risk of harm to national security,
			 law enforcement, or other Federal missions and risk of endangerment, including
			 to personal safety and security, financial security (such as through identity
			 theft), and privacy, of officers and employees and their family members, that
			 may be posed by website and other publication of financial disclosure forms and
			 associated personal information;</text>
				</paragraph><paragraph id="idea00f120a166417fa4dbcd678fcbaff9"><enum>(2)</enum><text>examine any harm
			 that may have arisen from the current online availability of financial
			 disclosure forms and associated personal information of employees of the
			 legislative branch, including any harm to national security, law enforcement,
			 or other Federal missions and any endangerment that may have occurred,
			 including to personal safety and security, financial security (such as through
			 identity theft), and privacy, of such legislative branch officers and employees
			 or their family members; and</text>
				</paragraph><paragraph id="id456b6802ae0c44059dcb9709906bb42a"><enum>(3)</enum><text>include any other
			 analysis that the National Academy believes is necessary or desirable on the
			 topic of the study.</text>
				</paragraph></subsection><subsection id="idb1836594ecb343cab787cd245fc0a6bd"><enum>(c)</enum><header>Report</header><text>Not
			 later than 6 months after the date of enactment of this Act, the National
			 Academy shall submit to Congress and the President a report that
			 contains—</text>
				<paragraph id="id64013a8fb7474dfc884f6555f8c29d22"><enum>(1)</enum><text>the findings of
			 the study conducted under subsection (a)(1);</text>
				</paragraph><paragraph id="id1123a5bc3075488b808ee81441b14ca5"><enum>(2)</enum><text>recommendations
			 for ways to avoid or mitigate the risks identified in the study conducted under
			 subsection (a)(1), consistent with the goal of providing appropriate public
			 disclosure of potential conflicts of interest or instances of insider trading
			 by Federal officers or employees; and</text>
				</paragraph><paragraph id="ida3230b8a127a407f9ce6e7f5306d1487"><enum>(3)</enum><text>any other
			 recommendations that the National Academy believes are necessary or
			 desirable.</text>
				</paragraph></subsection></section><section id="id7A2786D2C18A4E54A24C31D35BE2B603"><enum>3.</enum><header>Periodic
			 transaction reports for transactions of spouses and children</header>
			<subsection id="id7B514E735C2442648625BDE97E5D6347"><enum>(a)</enum><header>In
			 general</header>
				<paragraph id="id597166238CF145CEACF8E7C6E46E37C0"><enum>(1)</enum><header>Date reporting
			 requirement commences in House of Representatives and Executive
			 Branch</header><text>Section 2 of the Act entitled <quote>An Act to prevent
			 harm to the national security or endangering the military officers and civilian
			 employees to whom internet publication of certain information applies, and for
			 other purposes</quote>, approved August 16, 2012 (5 U.S.C. App. 103 note), is
			 amended by striking <quote>September 30, 2012</quote> and inserting
			 <quote>January 1, 2013</quote>.</text>
				</paragraph><paragraph id="idA903D9B137DA4D17A268F35929EC5575"><enum>(2)</enum><header>Extension to
			 Executive Branch</header><text>Section 2 of the Act entitled <quote>An Act to
			 prevent harm to the national security or endangering the military officers and
			 civilian employees to whom internet publication of certain information applies,
			 and for other purposes</quote>, approved August 16, 2012 (5 U.S.C. App. 103
			 note), is amended by striking <quote>for reporting individuals</quote> and all
			 that follows through <quote>House of Representatives</quote>.</text>
				</paragraph><paragraph id="idE226952096E14431AE02F21A62D771D0"><enum>(3)</enum><header>Technical and
			 conforming amendment</header><text>Section 2 of the Act entitled <quote>An Act
			 to prevent harm to the national security or endangering the military officers
			 and civilian employees to whom internet publication of certain information
			 applies, and for other purposes</quote>, approved August 16, 2012 (5 U.S.C.
			 App. 103 note), is amended by striking <quote>such section 101</quote> and
			 inserting <quote>section 101 of such Act (5 U.S.C. App. 101)</quote>.</text>
				</paragraph></subsection><subsection id="id1E867BD7D7C74DED8DC180A70EE06CBB"><enum>(b)</enum><header>Effective date;
			 rule of construction</header>
				<paragraph id="id187A8EAEC47F48DCB1FF4F29A000C888"><enum>(1)</enum><header>Effective
			 date</header><text>The amendments made by subsection (a) shall take effect on
			 January 1, 2013.</text>
				</paragraph><paragraph id="id837489E69D304953B7EC84514DC07AD6"><enum>(2)</enum><header>Rule of
			 construction</header><text>Before January 1, 2013, the amendments made by
			 subsection (a) shall not affect the applicability of section 2 of the Act
			 entitled <quote>An Act to prevent harm to the national security or endangering
			 the military officers and civilian employees to whom internet publication of
			 certain information applies, and for other purposes</quote>, approved August
			 16, 2012 (5 U.S.C. App. 103 note), as in effect on the day before the effective
			 date under paragraph (1).</text>
				</paragraph></subsection><subsection id="id08ED944D7654430FAB459ABBA1C2661E"><enum>(c)</enum><header>Savings
			 clause</header><text>Nothing in the amendments made by subsection (a) shall be
			 construed as affecting any requirement with respect to the House of
			 Representatives or the executive branch in effect before January 1, 2013, with
			 respect to the inclusion of transaction information for a report under section
			 103(l) of the Ethics in Government Act of 1978 (5 U.S.C. App. 103(l)).</text>
			</subsection><subsection id="id3208D8A3A1984E8B9B115B0DF6E4BF25"><enum>(d)</enum><header>No Change to
			 Existing Senate Requirements</header><text>Nothing in this section or the
			 amendments made this section shall be construed as affecting the requirement
			 that took effect with respect to the Senate on July 3, 2012, which mandates the
			 inclusion of transaction information for spouses and dependent children for a
			 report under section 103(l) of the Ethics in Government Act of 1978 (5 U.S.C.
			 App. 103(l)).</text>
