		<official-title>To amend the Denali Commission Act of 1998 to reauthorize
		  and modify the membership of the Denali Commission, and for other
		  purposes.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Denali Commission Reauthorization
			 Act of 2012</short-title></quote>.</text>
		</section><section id="id4B00FF5EDC674A74BD5521964539F45E"><enum>2.</enum><header>Establishment of
			 Commission</header><text display-inline="no-display-inline">Section 303 of the
			 Denali Commission Act of 1998 (42 U.S.C. 3121 note; Public Law 105–277) is
			 amended—</text>
			<paragraph id="idEC7CE9B674BC4E389763A166060ACD16"><enum>(1)</enum><text display-inline="yes-display-inline">by striking subsection (b) and inserting
			 the following:</text>
				<quoted-block display-inline="no-display-inline" id="idD3A258F72EE448E195F917EBF838AD22" style="OLC">
					<subsection id="id182CBC02395C41678CD67B53D67C7955"><enum>(b)</enum><header>Membership</header>
						<paragraph id="idFEC445B3BF894C869EE32115D6C9AD65"><enum>(1)</enum><header>Composition</header><text>The
				Commission shall be composed of 7 members with a Statewide perspective and
				knowledge regarding rural Alaska matters (including transportation, health,
				education and training, energy, economic development, community and regional
				planning, design, construction, and maintenance of rural infrastructure,
				workforce development, and communication infrastructure and systems), of
				whom—</text>
							<subparagraph id="idDFB25155D62D4C9695C0299209C91E45"><enum>(A)</enum><text>5 shall appointed
				by the Secretary of Commerce (referred to in this title as the
				<term>Secretary</term>), of whom—</text>
								<clause id="ID2797f64549274c2aa06480763b7e58df"><enum>(i)</enum><text>1
				shall represent the views and perspectives of an organized labor or vocational
				training group within the State of Alaska;</text>
								</clause><clause id="IDaae76424e6a94292b0d92d11fec589ef"><enum>(ii)</enum><text>1 shall
				represent the views and perspectives of Native Corporations (as defined in
				section 3 of the Alaska Native Claims Settlement Act (43 U.S.C. 1602));</text>
								</clause><clause id="IDcf562319d45d49618d878761abf0e070"><enum>(iii)</enum><text>1 shall have
				experience relating to project management and construction in rural
				Alaska;</text>
								</clause><clause id="ID72fc449cc8b84c04ae3f5bef4a367eaf"><enum>(iv)</enum><text>1 shall
				represent the views and perspectives of rural local government interests in the
				State of Alaska; and</text>
								</clause><clause id="IDa6ad90d75f0647828867b46ef840a258"><enum>(v)</enum><text>1
				shall represent the views and perspectives of rural tribal interests in the
				State of Alaska;</text>
								</clause></subparagraph><subparagraph id="idabe20e7887ee4db5a239bab74d00322a"><enum>(B)</enum><text>1 shall be the
				Governor of the State of Alaska or an individual selected by the Secretary from
				nominations submitted by the Governor; and</text>
							</subparagraph><subparagraph id="id902686AE6AD54A248712160AB5EF95BF"><enum>(C)</enum><text>1 shall be the
				Federal Cochairperson of the Commission, to be appointed by the Secretary in
				accordance with paragraph (3).</text>
							</subparagraph></paragraph><paragraph id="id930B0CAEBC9148CA95483DFA726332CD"><enum>(2)</enum><header>Date of
				appointments</header><text>The appointments of the members of the Commission
				under subparagraphs (A) and (B) of paragraph (1) shall be made by not later
				than 90 days after the date of enactment of the
				<short-title>Denali Commission Reauthorization Act of
				2012</short-title>.</text>
						</paragraph><paragraph id="idE46868B4904A436EA53E6A834CF3FE72"><enum>(3)</enum><header>Federal
				Cochairperson</header>
							<subparagraph id="ID22d3cda9546f46d69ee44f2c035d3f53"><enum>(A)</enum><header>Recommendations</header><text>Not
				later than 30 days after the date of appointment of the members of the
				Commission described in paragraph (2), those members shall submit to the
				Secretary recommendations for an individual to serve as Federal Cochairperson
				of the Commission under paragraph (1)(C).</text>
							</subparagraph><subparagraph id="id55C9BF22433247A9AD1F7C07AB89CB51"><enum>(B)</enum><header>Selection</header>
								<clause id="id1D8446E9777946F1BDC071A16D4BC364"><enum>(i)</enum><header>In
				general</header><text>Not later than 60 days after the date of receipt of the
				recommendations under subparagraph (A), the Secretary shall appoint an
				individual to serve as Federal Cochairperson of the Commission.</text>
								</clause><clause id="idDADC0056C00E49AA98BED9BAB73C5187"><enum>(ii)</enum><header>Consideration</header><text>In
				appointing the Federal Cochairperson under clause (i), the Secretary may take
				into consideration, but shall not be required to select, any individual
				recommended under subparagraph (A).</text>
								</clause></subparagraph><subparagraph id="id9BA211EE51A44D879DF42E9CCA29C2E2"><enum>(C)</enum><header>Treatment</header><text>The
				Federal Cochairperson shall be a nonvoting member of the Commission.</text>
							</subparagraph><subparagraph id="idCE037BD307B44561BC7460A02E548AA0"><enum>(D)</enum><header>Vacancy</header>
								<clause id="id5195A25EA93742B9A66326711ECD9728"><enum>(i)</enum><header>In
				general</header><text>Any vacancy in the position of Federal Cochairperson
				shall be filled in the same manner as the original appointment.</text>
								</clause><clause id="id10dd7bc974c74e37a9b14453f149cb39"><enum>(ii)</enum><header>Interim
				Federal Cochairperson</header><text>Before vacating the position of Federal
				Cochairperson, the Federal Cochairperson shall appoint to serve as Interim
				Federal Cochairperson, for the period beginning on the date on which the
				vacancy in the position of Federal Cochairperson occurs and ending on the date
				on which a new Federal Cochairperson is appointed under clause (i), the staff
				member of the Commission with the most seniority.</text>
								</clause></subparagraph></paragraph><paragraph id="idD2507E13B98B44DB9F81F17CE022920B"><enum>(4)</enum><header>Status</header><text>No
				member of the Commission (other than the Federal Cochairperson) shall be
				considered to be an employee of the Federal Government for any
				purpose.</text>
						</paragraph></subsection><after-quoted-block>;
				and</after-quoted-block></quoted-block>
			</paragraph><paragraph id="idCA8A6E2C1AC94293BBE7FA04191EF5BB"><enum>(2)</enum><text>in subsection
			 (c)—</text>
				<subparagraph id="id2C39BD54A29F4BEF91A8F6C0291F5340"><enum>(A)</enum><text>in the first
			 sentence, by striking <quote>The Federal Cochairperson</quote> and inserting
			 the following:</text>

						<paragraph id="idDCB71D65BE6044C2BE76DA573F33FF76"><enum>(1)</enum><header>Federal

				</subparagraph><subparagraph id="idA33BEFA59F644D57B1AC07999AD96E9C"><enum>(B)</enum><text>by striking the
			 second and third sentences and inserting the following:</text>

						<paragraph id="id9416F905A0DD4F569A30757043D07A65"><enum>(2)</enum><header>Members</header>
							<subparagraph id="ID9D5EBC32A06E4DD2AD34FAF74C8D025A"><enum>(A)</enum><header>Terms</header><text>A
				member of the Commission shall be appointed for a term of 4 years, except that,
				of the members first appointed—</text>
								<clause id="IDB9FA1B70EB0B463584E8A7796D9CD278"><enum>(i)</enum><text>the members
				appointed under clauses (ii) and (iv) of subsection (b)(1)(A) shall be
				appointed for terms of 3 years; and</text>
								</clause><clause id="ID8A2AF533E6414911A83FC6A79B90BEC9"><enum>(ii)</enum><text>the members
				appointed under clauses (i) and (iii) of subsection (b)(1)(A) shall be
				appointed for terms of 2 years.</text>
								</clause></subparagraph><subparagraph id="ID25DA34B68BA54CB1BEFE4A40AFF5F8FD"><enum>(B)</enum><header>Vacancies</header>
								<clause id="IDC5A15D7DC0124B7FA613EC881645F7CE"><enum>(i)</enum><header>In
				general</header><text>A vacancy on the Commission—</text>
									<subclause id="id8478400285484056AAA22BA4E597D55B"><enum>(I)</enum><text>shall not affect
				the powers of the Commission;</text>
									</subclause><subclause id="id28AB699458B94063AD68A2DEF71A982C"><enum>(II)</enum><text>shall be filled
				in the manner in which the original appointment was made; and</text>
									</subclause><subclause id="id7C9FEE30491143FF9EE30A3D8B942F9F"><enum>(III)</enum><text>shall be
				subject to any conditions that applied with respect to the original
				appointment.</text>
									</subclause></clause><clause id="IDBA415A58E29D469982D18D070173F48D"><enum>(ii)</enum><header>Filling
				unexpired term</header><text>An individual selected to fill a vacancy shall be
				appointed for the unexpired term of the member replaced.</text>
								</clause></subparagraph><subparagraph id="IDC68C5F7ECB7B4887B0C80733CC601068"><enum>(C)</enum><header>Expiration</header><text>The
				term of any member shall not expire before the date on which the successor of
				the member takes
				office.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</subparagraph></paragraph></section><section id="id7150773D8BC74FBE8F1831BE92D1BAE4"><enum>3.</enum><header>Funding
			 requirements; duties</header>
			<subsection id="id29AB626CD7DF43D5BF4B2687A90ADCA5"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 304 of the
			 Denali Commission Act of 1998 (42 U.S.C. 3121 note; Public Law 105–277) is
			 amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="idB1BF7EFC707241C48CAB9ACEA4CE5AC4" style="OLC">
					<section id="idD8FB240716BC43D3B18E1B319D71F57F"><enum>304.</enum><header>Funding
				requirements; duties</header>
						<subsection id="id7FC84F1E0171427CA6D8F04567849879"><enum>(a)</enum><header>Cost
				share</header>
							<paragraph id="idDB983D88FD384408A1594FC50B949735"><enum>(1)</enum><header>In
				general</header><text>In carrying out any construction project or activity
				under this Act, the Commission shall require a cost share of—</text>
								<subparagraph id="id5C3F44DBAFA145EDBC80D3C352652960"><enum>(A)</enum><text>up to 50 percent
				of the total cost of the construction project or activity; or</text>
								</subparagraph><subparagraph id="id587405667AEE403EAD0B508514B88704"><enum>(B)</enum><text>for a
				construction project or activity carried out in a distressed community (as
				determined by the department of labor and workforce development of the State of
				Alaska or by the Commission), up to 20 percent of the total cost of the
				construction project or activity.</text>
								</subparagraph></paragraph><paragraph id="id69A6C37052D64BF99C47152E52041308"><enum>(2)</enum><header>Preconstruction
				procedures</header><text>The cost-share requirements under paragraph (1) shall
				not apply with respect to preconstruction procedures.</text>
							</paragraph></subsection><subsection id="id77e9e864f6ab4496b4b11b62ec494aeb"><enum>(b)</enum><header>Public
				comments</header><text>The Commission members and the Federal Cochairperson
				shall seek comments from rural Alaska communities and other stakeholder groups
				regarding rural development needs.</text>
						</subsection><subsection id="id641d652b973846d79b01d0a3e763da8c"><enum>(c)</enum><header>Duties</header><text>The
				members of the Commission shall—</text>
							<paragraph id="id9bab9e19b7444c9f81a3ef2ea9f32a96"><enum>(1)</enum><text>advise the
				Commission regarding coordinated infrastructure planning (including annual and
				multiyear strategies) among and for—</text>
								<subparagraph id="id325A0328CB704C8895649687948BF30A"><enum>(A)</enum><text>rural Alaska
				communities;</text>
								</subparagraph><subparagraph id="id61D5CABF5F764E38A9DAD45494880B8B"><enum>(B)</enum><text>the State of
				Alaska;</text>
								</subparagraph><subparagraph id="idD4836963ED594084B7331C088A9BF2A2"><enum>(C)</enum><text>Federal agencies;
				and</text>
								</subparagraph><subparagraph id="id4CD5288A11B64E7B82033C16A116C3AA"><enum>(D)</enum><text>other
				governmental and nongovernmental entities;</text>
								</subparagraph></paragraph><paragraph id="id1f9259eae8f0459392b497c8bb51c789"><enum>(2)</enum><text>establish a list
				of priorities of the Commission for rural Alaska communities on an annual
				basis, including funding recommendations and the means by which the
				recommendations—</text>
								<subparagraph id="id573A8F0A63BA4978B405B446F7CC03B4"><enum>(A)</enum><text>address multiyear
				strategies; and</text>
								</subparagraph><subparagraph id="id4A30BCBCA914454F89D630C265E09A00"><enum>(B)</enum><text>are coordinated
				with—</text>
									<clause id="id8FE9945E1F2C46CEAC01F0438A8DD535"><enum>(i)</enum><text>rural Alaska
				communities;</text>
									</clause><clause id="id52CBF0A0100C44D29E2FA0172A43BFC6"><enum>(ii)</enum><text>the State of
				Alaska;</text>
									</clause><clause id="id4F13B07F778340F0A52D24247509A7C6"><enum>(iii)</enum><text>Federal
				agencies; and</text>
									</clause><clause id="idD786F29E17784D46A0F411D073F933A0"><enum>(iv)</enum><text>other government
				and nongovernmental entities;</text>
									</clause></subparagraph></paragraph><paragraph id="id2d6f7749fc7748688981d5c5aa17d8f3"><enum>(3)</enum><text>review ongoing
				and completed Commission-funded projects and programs for compliance with
				stated objectives and outcomes; and</text>
							</paragraph><paragraph id="id60655D3C1BBD469FB0371BF1011520C6"><enum>(4)</enum><text>examine
				Commission-funded projects and programs—</text>
								<subparagraph id="id49AA408BAA7D4A09BC86C154AEEE7B77"><enum>(A)</enum><text>for consistency
				and standardization; and</text>
								</subparagraph><subparagraph id="id2CEED7F009974BD6B2DFD72FF9F692D8"><enum>(B)</enum><text>to determine a
				means of improving the management and success of future Commission-funded
				projects and programs.</text>
								</subparagraph></paragraph></subsection><subsection id="id530f7a7d70dc4f34b01896baee9a821a"><enum>(d)</enum><header>Operational
				matters</header><text>The Federal Cochairperson (and not the members of the
				Commission) shall be responsible for Commission operational matters, including
				budgetary
				matters.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="idC2C3AE658C4F4F89951883FEC31D315E"><enum>(b)</enum><header>Conforming
			 amendment</header><text>Section 307 of the Denali Commission Act of 1998 (42
			 U.S.C. 3121 note; Public Law 105–277) is amended by striking subsection (c) and
			 inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="id4C3AD2BCD4ED4BEF9322CAF009F4A05E" style="OLC">
					<subsection id="IDe2e958dc88f84d22b0d83bfda39b3b5b"><enum>(c)</enum><header>Demonstration
				health projects</header>
						<paragraph id="id4957B3E1B6144DAE87933C29D136476A"><enum>(1)</enum><header>In
				general</header><text>To demonstrate the value of adequate health facilities
				and services to the economic development of the region, the Secretary of Health
				and Human Services may make interagency transfers to the Commission to plan,
				construct, and equip demonstration health, nutrition, and child care projects,
				including hospitals, health care clinics, and mental health facilities
				(including drug and alcohol treatment centers).</text>
						</paragraph><paragraph id="id09CECB3E9FB54CA883D50FFC109E819B"><enum>(2)</enum><header>Authorization
				of appropriations</header><text>There are authorized to be appropriated such
				sums as are necessary to carry out this
				subsection.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="id2BE73B208B7D467FB0B2141E67B04FA4"><enum>4.</enum><header>Powers of
			 Commission</header><text display-inline="no-display-inline">Section 305 of the
			 Denali Commission Act of 1998 (42 U.S.C. 3121 note; Public Law 105–277) is
			 amended by striking subsection (d) and inserting the following:</text>
			<quoted-block display-inline="no-display-inline" id="id3BD080AF79394BDE8BF0F358FF8CB9C0" style="OLC">
				<subsection id="id1873f77ecec740759b46c41c984a0a52"><enum>(d)</enum><header>Detail of
				Federal employees; agreements, grants, and payments</header>
					<paragraph id="id9699E6C09BF141A4875703DA0AF96D4A"><enum>(1)</enum><header>Detail of
				Federal employees</header><text>Any employee of the Federal Government may be
				detailed to the Commission—</text>
						<subparagraph id="id11BC2296FB3E484CB426D418F70AD176"><enum>(A)</enum><text>without
				reimbursement; and</text>
						</subparagraph><subparagraph id="idE7D5076FE8CF45C29E2FC884BEAD9BDD"><enum>(B)</enum><text>without
				interruption or loss of civil service status or privilege.</text>
						</subparagraph></paragraph><paragraph id="ID18c64df4f484436996d9f65c3b3bb303"><enum>(2)</enum><header>Agreements,
				grants, and payments</header><text>The Commission, acting through the Federal
				Cochairperson, may enter into contracts and cooperative agreements, award
				grants, and make payments necessary to carry out the purposes of the
				Commission.</text>
					</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="idB9CB784CBA91437293DC00EBBD3D996A"><enum>5.</enum><header>Commission
			 personnel matters</header>
			<subsection id="id055BE3C1D5EA4087A2A88BE37CA240AC"><enum>(a)</enum><header>Compensation of
			 members</header><text>Section 306 of the Denali Commission Act of 1998 (42
			 U.S.C. 3121 note; Public Law 105–277) is amended by striking subsection (a) and
			 inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="id990E94127C37401AB20A50B9E59C684B" style="OLC">
					<subsection id="idBCC25DAC6DCD4D9480DA89CFDA61F988"><enum>(a)</enum><header>Compensation of
				members</header>
						<paragraph id="id4E39B59ABE3D4AB3963DD0AD6BD702CC"><enum>(1)</enum><header>In
				general</header><text>Subject to paragraph (2), the members of the Commission
				shall serve without compensation.</text>
						</paragraph><paragraph id="id415225D08BE34BB5A2B5AD03CB475DD9"><enum>(2)</enum><header>Federal
				Cochairperson</header><text>The Federal Cochairperson shall be compensated at
				the annual rate prescribed for level IV of the Executive Schedule under section
				5315 of title 5, United States
				Code.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="idEA8864A2BED0405396D3AE848BF1D3B9"><enum>(b)</enum><header>Travel
			 expenses</header><text>Section 306(b) of the Denali Commission Act of 1998 (42
			 U.S.C. 3121 note; Public Law 105–277) is amended—</text>
				<paragraph id="idAF5B469FA73B4069855273BE42C565F1"><enum>(1)</enum><text>by striking
			 <quote>The members</quote> and inserting the following:</text>

			 General</header>
				<paragraph id="id2117B44A433B46AFB4A3FEC442F41840"><enum>(1)</enum><header>In
			 general</header><text>Section 306 of the Denali Commission Act of 1998 (42
			 U.S.C. 3121 note; Public Law 105–277) is amended by striking subsection (h) and
			 inserting the following:</text>

			 the Inspector General Act of 1978 (5 U.S.C. App.) is amended by striking
			 <quote>the Denali Commission,</quote>.</text>
				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id60497F90406440FCBE80D5A28E12320A"><enum>6.</enum><header>Reauthorization</header><text display-inline="no-display-inline">The first section 310 of the Denali
			 Commission Act of 1998 (42 U.S.C. 3121 note; Public Law 105–277) (relating to
			 authorization of appropriations) is amended by striking subsection (a) and
			 inserting the following:</text>

			<subsection commented="no" display-inline="no-display-inline" id="id2F713EEDC66B46ECA53970CF396132E7"><enum>(a)</enum><header>In
			 general</header>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idDBA0A9B7D40A41C49EC76E082116467F"><enum>(b)</enum><header>Conforming
			 amendments</header><text>Sections 309 and 310 of the Denali Commission Act of
			 1998 (42 U.S.C. 3121 note; Public Law 105–277) are redesignated as sections 308
			 and 309, respectively.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="id49B505BBFEEC4E0D989C5349218400E2"><enum>8.</enum><header>Budget
			 Committee</header><text display-inline="no-display-inline">The Denali
			 Commission Act of 1998 (42 U.S.C. 3121 note; Public Law 105–277) (as amended by
			 section 7(b)) is amended by adding at the end the following:</text>

				<section commented="no" display-inline="no-display-inline" id="id65BB2FE9EEE04D37810D51D571D20237"><enum>310.</enum><header>Budget
				Committee</header>
					<subsection commented="no" display-inline="no-display-inline" id="id83CCA02CB2474B02B89360DA8A8A3800"><enum>(a)</enum><header>Establishment</header><text>Not
				later than 180 days after the date of enactment of the
				<short-title>Denali Commission Reauthorization Act of
				2012</short-title>, the Federal Cochairperson shall establish a Budget
				Committee to serve the Commission.</text>
					</subsection><subsection commented="no" display-inline="no-display-inline" id="id96F8697EC4A24EEDA05DDC768EEC7326"><enum>(b)</enum><header>Membership</header><text>The
				Budget Committee shall be composed of 3 members, of whom—</text>
						<paragraph id="id6b22b21c50f84c0b92be44ccdb19a5d7"><enum>(1)</enum><text>1 shall be the
				Governor of the State of Alaska or a member of the Commission selected in
				accordance with section 303(b)(1)(B);</text>
						</paragraph><paragraph id="id731eee6908da46f39aa499e1f86a8e90"><enum>(2)</enum><text>1 shall be a
				Federal employee or detailee with expertise in the Federal budget process, to
				be selected by the Federal Cochairperson; and</text>
						</paragraph><paragraph id="id6ea8abf477bf484a8b44ae2767602e94"><enum>(3)</enum><text>1 shall be a
				member of the Commission, to be selected by the members of the
				Commission.</text>
						</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id7B12CB4FB26245BC94967127A55A368A"><enum>(c)</enum><header>Duties</header><text>The
				Budget Committee shall carry out the following activities for the
				Commission:</text>
						<paragraph commented="no" display-inline="no-display-inline" id="idAE361A353F2E4330B735A1ED03724140"><enum>(1)</enum><text>Review the
				operating budget of the Commission.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idBD3535E21C5F4BB9B021B2BC372074F4"><enum>(2)</enum><text>Make appropriate
				recommendations to the Federal Cochairperson.</text>
						</paragraph></subsection><subsection id="idAD9A03CF5C324476AD0277667E294DB9"><enum>(d)</enum><header>Compensation of
				members</header>
						<paragraph id="id846BFFF658FF410F98536D93A89DFA25"><enum>(1)</enum><header>In
				general</header><text>The members of the Budget Committee shall serve without
				compensation.</text>
						</paragraph><paragraph id="idA0B9BDD9E7B94E88B51631BFE7DFE125"><enum>(2)</enum><header>Travel
				expenses</header><text>The members of the Budget Committee shall be allowed
				travel expenses, including per diem in lieu of subsistence, at rates authorized
				for employees of agencies under subchapter I of chapter 57 of title 5, United
				States Code, while away from their homes or regular places of business in the
				performance of services for the Budget
				Committee.</text>
						</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
