		<official-title>To improve the enforcement of criminal and civil law with
		  respect to cloud computing, and for other purposes.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Cloud Computing Act of
			 2012</short-title></quote>.</text>
		</section><section id="IDeb48340e0d0a44e0b78092974f0e990c"><enum>2.</enum><header>Unlawful access
			 to cloud computing services</header>
			<subsection id="IDa17aecfb14474d5fa417d6985d041b87"><enum>(a)</enum><header>In
			 general</header><text>Section 1030 of title 18, United States Code, is amended
			 by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id3B12CD2FC8F848D9B6BDC586797B64C8" style="OLC">
					<subsection id="IDdeea32bdf37c40a7b45ddaac19ba26d8"><enum>(k)</enum><text>For purposes of
				an offense described in paragraph (2)(C), (4), or (5) of subsection (a) or an
				attempt or conspiracy to commit such an offense, if the protected computer is
				part of a cloud computing service, each instance of unauthorized access of a
				cloud computing account, access in excess of authorization of a cloud computing
				account, or attempt or conspiracy to access a cloud computing account without
				authorization or in excess of authorization shall constitute a separate
				offense.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="ID458a23946d40447bb4f5a41b1ba05de9"><enum>(b)</enum><header>Definitions</header><text>Section
			 1030(e) of title 18, United States Code, is amended—</text>
				<paragraph id="ID1724251bfe9840b39dc0cd35c12b4e30"><enum>(1)</enum><text>in paragraph
			 (11), by striking <quote>and</quote> at the end;</text>
				</paragraph><paragraph id="ID57ee41d5282f4d16aa7789b23baac507"><enum>(2)</enum><text>in paragraph
			 (12), by striking the period at the end and inserting a semicolon; and</text>
				</paragraph><paragraph id="ID93ad9e126ab94c0bb4e127f05559d77b"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="idCA7BE3D76C1B4234A766515EF63D6723" style="OLC">
						<paragraph id="IDb565e155656f4786a47bfc98374c6fba"><enum>(13)</enum><text>the term
				<term>cloud computing account</term> means information stored on a cloud
				computing service that requires a password or similar information to access and
				is attributable to an individual, which may include allowing a customer of the
				cloud computing service to have multiple accounts; and</text>
						</paragraph><paragraph id="IDb8d798c0e73e41d2939797dee8659f2e"><enum>(14)</enum><text>the term
				<term>cloud computing service</term> means a service that enables convenient,
				on-demand network access to a shared pool of configurable computing resources
				(including networks, servers, storage, applications, and services) that can be
				rapidly provisioned and released with minimal management effort or interaction
				by the provider of the
				service.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection></section><section id="ID8b0b2a7568b74bd494a2092fe7158434"><enum>3.</enum><header>Presumed
			 losses</header><text display-inline="no-display-inline">Section 1030 of title
			 18, United States Code, as amended by section 2(a), is amended by adding at the
			 end the following:</text>
			<quoted-block display-inline="no-display-inline" id="idA2675A0CC2AB41A3A36B7ED9C6A4F100" style="OLC">
				<subsection id="ID03673fa220284791a57848b16c642cec"><enum>(l)</enum><text>If an offense
				under this section involves a protected computer that is part of a cloud
				computing service, the value of the loss of the use of the protected computer
				for purposes of subsection (a)(4), the value of the information obtained for
				purposes of subsection (c)(2)(B)(iii), and the value of the aggregated loss for
				purposes of subsection (c)(4)(A)(i)(I) shall be the greater of—</text>
					<paragraph id="IDf431a6c972fc412f9b06b55794574708"><enum>(1)</enum><text>the value of the
				loss of use, information, or aggregated loss to 1 or more persons; or</text>
					</paragraph><paragraph id="ID877d9ccdf1044678be8ae42ae61ae022"><enum>(2)</enum><text>the product
				obtained by multiplying the number of cloud computing accounts accessed by
				$500.</text>
					</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="ID8b687512a81c4b8ba03b6388b3241946"><enum>4.</enum><header>Interaction with
			 international fora to advance international interoperability with law and
			 policies of United States</header><text display-inline="no-display-inline">The
			 Secretary of State shall work with other international fora, such as the
			 Organization for Economic Cooperation and Development, to advance the aims of
			 ensuring interoperability between the provisions of this Act, the amendments
			 made by this Act, and other laws and policies of the United States and foreign
			 countries, including in consultations between the United States and the
			 European Union.</text>
		</section><section id="id691DC9D85B70413CAF1AA3A3238C1144"><enum>5.</enum><header>Annual study and
			 report on international cooperation regarding data privacy, retention, and
			 security</header>
			<subsection id="id87510FA7519947C8AF0D05A370797D4E"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Not later than 180
			 days after the date of the enactment of this Act and not less frequently than
			 once each year thereafter for 4 years, the Secretary of State shall—</text>
				<paragraph id="id03FDE054FCC4494893BCCD0672D4DDB8"><enum>(1)</enum><text display-inline="yes-display-inline">conduct a study on international
			 cooperation regarding data privacy, retention, and security; and</text>
				</paragraph><paragraph id="id32F98A6925824B89927A06A2D44A50F1"><enum>(2)</enum><text>submit to
			 Congress a report on the findings of the Secretary with respect to the most
			 recent study carried out under paragraph (1) and the activities of the
			 Secretary under section 4.</text>
				</paragraph></subsection><subsection id="id22EB47BD741E46E7A69EFCA95C146475"><enum>(b)</enum><header>Matters
			 studied</header><text>Each study conducted under subsection (a)(1) shall
			 include development of recommendations for best practices, treaties, common
			 policy frameworks, mutual recognition agreements, the creation of hybrid
			 public-private authorities, codes of conduct, or other guidance the Secretary
			 of State considers necessary to promote the development of laws and policies in
			 foreign countries that are interoperable with and that will reinforce the
			 effectiveness of—</text>
				<paragraph id="id5A87071146E44214B93CDF609B1B4C7E"><enum>(1)</enum><text>the provisions of
			 this Act and the amendments made by this Act; and</text>
				</paragraph><paragraph id="idA016539A459F45D68CBA5DC94C48995C"><enum>(2)</enum><text>policies relating
			 to data privacy, data retention, security of data, and assertions of
			 jurisdiction over data, including with respect to law enforcement access to
			 data.</text>
				</paragraph></subsection><subsection id="idA8898068BC61496CAEBBBCB521F1600F"><enum>(c)</enum><header>Interagency
			 coordination</header><text>In conducting the studies required by subsection
			 (a)(1), the Secretary of State shall consult with the heads of relevant
			 agencies, such as the following:</text>
				<paragraph id="id83597C0C043A4C95B024FE80E1ABD998"><enum>(1)</enum><text>The National
			 Economic Council.</text>
				</paragraph><paragraph id="idE815B58D64424903960CC6954B2F91CA"><enum>(2)</enum><text>The Attorney
			 General.</text>
				</paragraph><paragraph id="id5A2445FDEEEA47C79DA57E6A8DCB5052"><enum>(3)</enum><text>The Secretary of
			 Commerce.</text>
				</paragraph><paragraph id="idC7E52793DC374061855140FC621EE9D2"><enum>(4)</enum><text>The Federal Trade
			 Commission.</text>
				</paragraph><paragraph id="id41E2C24D56CE425196672A0A98B93654"><enum>(5)</enum><text>The Secretary of
			 Homeland Security.</text>
				</paragraph><paragraph id="id52DC8AF986E54A599017CD96B51FD106"><enum>(6)</enum><text>The United States
			 Trade Representative.</text>
				</paragraph></subsection></section><section id="ID9b781ea462c44b9b8e4a450e5956c8fa"><enum>6.</enum><header>Annual Federal
			 information technology and cloud computing procurement forecast</header>
			<subsection id="idE716BB980A6548C09FC7482CDCF49204"><enum>(a)</enum><header>Cloud computing
			 service defined</header><text display-inline="yes-display-inline">In this
			 section, the term <term>cloud computing service</term> has the meaning given
			 the term by the Under Secretary of Commerce for Standards and
			 Technology.</text>
			</subsection><subsection id="id26F07E98B9564EC8BAE23FBFF75DC781"><enum>(b)</enum><header>Forecast
			 required</header><text display-inline="yes-display-inline">Not later than 180
			 days after the date of the enactment of this Act and not less frequently than
			 once each year thereafter for 4 years, the head of each Federal agency
			 described in section 901(b) of title 31, United States Code, shall, consistent
			 with Cloud First policy outlined in the document of the Office of Management
			 and Budget entitled <quote>Federal Cloud Computing Strategy</quote> and dated
			 February 8, 2011, submit to the Administrator of the Office of Electronic
			 Government and Information Technology of the Office of Management and Budget a
			 3-year forecast of the plans of the agency relating to the procurement of cloud
			 computing services and support relating to such services.</text>
			</subsection><subsection id="id2D0302243177458CB8546F1F22CBDC21"><enum>(c)</enum><header>Publication</header><text display-inline="yes-display-inline">The Administrator shall make each 3-year
			 forecast submitted under subsection (b) available to the public via an Internet
			 website.</text>
